		  services for all Americans and to improve Medicaid reimbursement for community
		  behavioral health services.</official-title>

		<section id="HA325E935EDC7418290C64233495D3F7A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Excellence in Mental Health
			 Act</short-title></quote>.</text>
		</section><section id="HF8DA14A5EA0A4163820EC026902D01E1"><enum>2.</enum><header>Establishing
			 community behavioral health centers</header><text display-inline="no-display-inline">Section 1913 of the Public Health Service
			 Act (42 U.S.C. 300x–3) is amended—</text>
			<paragraph id="HC036FB63C3F8423EB1547588D8C619E2"><enum>(1)</enum><text>in subsection
			 (a)(2)(A), by striking <quote>community mental health services</quote> and
			 inserting <quote>behavioral health services (of the type offered by
			 federally-qualified community behavioral health centers consistent with
			 subsection (c)(3))</quote>;</text>
			</paragraph><paragraph id="H13C865D4CD134CB08FC7071DB24616AA"><enum>(2)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="H0846BFDDFB0D4E3FAFE72A272A73803D"><enum>(A)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
					<quoted-block id="HE8F9EDB499C54BD580E04CEAF837251C" style="OLC">
						<paragraph id="H402B7F89F34446C9A98A5CC36EC7B62A"><enum>(1)</enum><text>services under the
				plan will be provided only through appropriate, qualified community programs
				(which may include federally-qualified community behavioral health centers,
				child mental health programs, psychosocial rehabilitation programs, mental
				health peer-support programs, and mental health primary consumer-directed
				programs); and</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="HCC12EE5236794C55BA82AF9FE80A5489"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>community mental health centers</quote> and inserting
			 <quote>federally-qualified community behavioral health centers</quote>;
			 and</text>
				</subparagraph></paragraph><paragraph id="HABD561459593471C9C97F4A9CBD6D2EA"><enum>(3)</enum><text>by striking
			 subsection (c) and inserting the following:</text>
				<quoted-block id="H31CC7B0EC8D743DB8785FEAFE7DDD887" style="OLC">
					<subsection id="H6D726FE7FDF44D30966D44DD0B984EE6"><enum>(c)</enum><header>Criteria for
				Federally-Qualified Community Behavioral Health Centers</header>
						<paragraph id="HAB7DCB3508D14DE9A74CBA8A81854F66"><enum>(1)</enum><header>In
				general</header><text>The Administrator shall certify, and recertify at least
				every 5 years, federally-qualified community behavioral health centers as
				meeting the criteria specified in this subsection.</text>
						</paragraph><paragraph id="H83EB3C39EE9D4CA79801A741CAF0550F"><enum>(2)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				the enactment of the <short-title>Excellence in Mental
				Health Act</short-title>, the Administrator shall issue final regulations for
				certifying non-profit or local government centers as centers under paragraph
				(1).</text>
						</paragraph><paragraph id="H4AEE113440F64B7CB7A8B4BB8971C08D"><enum>(3)</enum><header>Criteria</header><text>The
				criteria referred to in subsection (b)(2) are that the center performs each of
				the following:</text>
							<subparagraph id="HE2ECC956AB57452C99567DB0D169F838"><enum>(A)</enum><text>Provide services
				in locations that ensure services will be available and accessible promptly and
				in a manner which preserves human dignity and assures continuity of
				care.</text>
							</subparagraph><subparagraph id="H81FD7DC5768B4702B39FB76FA300ADE5"><enum>(B)</enum><text>Provide services
				in a mode of service delivery appropriate for the target population.</text>
							</subparagraph><subparagraph id="HF2D54F07F355433CA848972CFB89FAE9"><enum>(C)</enum><text>Provide
				individuals with a choice of service options where there is more than one
				efficacious treatment.</text>
							</subparagraph><subparagraph id="H45BF567557E041A59F06D83B17CD0D31"><enum>(D)</enum><text>Employ a core
				staff of clinical staff that is multidisciplinary and culturally and
				linguistically competent.</text>
							</subparagraph><subparagraph id="HD31571DDCE644527AEB49A6E8D2C8649"><enum>(E)</enum><text>Provide services,
				within the limits of the capacities of the center, to any individual residing
				or employed in the service area of the center, regardless of the ability of the
				individual to pay.</text>
							</subparagraph><subparagraph id="HDE38907D2D374EC68A6B308BF9FAB560"><enum>(F)</enum><text>Provide, directly
				or through contract, to the extent covered for adults in the State Medicaid
				plan under title XIX of the Social Security Act and for children in accordance
				with section 1905(r) of such Act regarding early and periodic screening,
				diagnosis, and treatment, each of the following services:</text>
								<clause id="HC7426A9E5EEE454781B30BB56C7FFE6B"><enum>(i)</enum><text>Screening,
				assessment, and diagnosis, including risk assessment.</text>
								</clause><clause id="HE5A028B6825E463493F17CCF21DE355C"><enum>(ii)</enum><text>Person-centered
				treatment planning or similar processes, including risk assessment and crisis
				planning.</text>
								</clause><clause id="HF7859B7DBC624C989403AAC906544C3C"><enum>(iii)</enum><text>Outpatient
				clinic mental health services, including screening, assessment, diagnosis,
				psychotherapy, substance abuse counseling, medication management, and
				integrated treatment for mental illness and substance abuse which shall be
				evidence-based (including cognitive behavioral therapy and other such therapies
				which are evidence-based).</text>
								</clause><clause id="H3A7E23547ACA4CC18E45AD93C7CCA2C0"><enum>(iv)</enum><text>Outpatient clinic
				primary care screening and monitoring of key health indicators and health risk
				(including screening for diabetes, hypertension, and cardiovascular disease and
				monitoring of weight, height, body mass index (BMI), blood pressure, blood
				glucose or HbA1C, and lipid profile).</text>
								</clause><clause id="HE04F6239B3094DF380EAD4C64546D189"><enum>(v)</enum><text>Crisis mental
				health services, including 24-hour mobile crisis teams, emergency crisis
				intervention services, and crisis stabilization.</text>
								</clause><clause id="H431CDB2F5AEE408B8CBB1EACEF31363D"><enum>(vi)</enum><text>Targeted case
				management (services to assist individuals gaining access to needed medical,
				social, educational, and other services and applying for income security and
				other benefits to which they may be entitled).</text>
								</clause><clause id="HBCC32187792E46BBA5A916DEB5FDE871"><enum>(vii)</enum><text>Psychiatric
				rehabilitation services including skills training, assertive community
				treatment, family psychoeducation, disability self-management, supported
				employment, supported housing services, therapeutic foster care services, and
				such other evidence-based practices as the Secretary may require.</text>
								</clause><clause id="H05C95E0E895342499BC11D006FC891F6"><enum>(viii)</enum><text>Peer support
				and counselor services and family supports.</text>
								</clause></subparagraph><subparagraph id="H3FC6A2DE7BCA49D5A5932B6BF5FB9543"><enum>(G)</enum><text>Maintain linkages,
				and where possible enter into formal contracts with the following:</text>
								<clause id="id5C8FEDE98990471AA4F993BF6235B2BD"><enum>(i)</enum><text>Federally
				qualified health centers.</text>
								</clause><clause id="H3B22DB6F1FF8481E81ACC934078B8ED9"><enum>(ii)</enum><text>Inpatient
				psychiatric facilities and substance abuse detoxification and residential
				programs.</text>
								</clause><clause id="H21E164FD03BE46D283B2CEEDF5DE55C3"><enum>(iii)</enum><text>Adult and youth
				peer support and counselor services.</text>
								</clause><clause id="HD489D0447A8142EA9B29C14F6E14BEA9"><enum>(iv)</enum><text>Family support
				services for families of children with serious mental disorders.</text>
								</clause><clause id="H7A87AF8E5B134A9B909F2C2915145C97"><enum>(v)</enum><text>Other community or
				regional services, supports, and providers, including schools, child welfare
				agencies, juvenile and criminal justice agencies and facilities, housing
				agencies and programs, employers, and other social services.</text>
								</clause><clause id="HA3A4249F3D534B0F877826ECBF84AF46"><enum>(vi)</enum><text>Onsite or offsite
				access to primary care services.</text>
								</clause><clause id="H9C6D747EEFDF4BCC9C868C1429145484"><enum>(vii)</enum><text>Enabling
				services, including outreach, transportation, and translation.</text>
								</clause><clause id="H7C6DD3F7D2A54A2F83430E832D4E5076"><enum>(viii)</enum><text>Health and
				wellness services, including services for tobacco cessation.</text>
								</clause></subparagraph></paragraph><paragraph id="id4BB01CE7A5804CD3839775F54ACEF674"><enum>(4)</enum><header>Rule of
				construction</header><text>Nothing in paragraph (1) shall be construed as
				prohibiting States receiving funds appropriated through the Community Mental
				Health Services Block Grant under subpart I of part B of this title from
				financing qualified community
				programs.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="HA7FEAB24DEC944E2B4B8CF159EBF1CF7"><enum>3.</enum><header>Medicaid coverage
			 and payment for community behavioral health center services</header>
			<subsection id="H32723C12D36C427C83850C2542E9206B"><enum>(a)</enum><header>Payment for
			 services provided by federally-Qualified community behavioral health
			 centers</header><text>Section 1902(bb) of the Social Security Act (42 U.S.C.
			 1396a(bb)) is amended—</text>
				<paragraph id="H3827ED53D18D4768A7B493A05131A96C"><enum>(1)</enum><text>in the heading, by
			 striking <quote><header-in-text level="subsection" style="OLC">and Rural Health
			 Clinics</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">, federally-Qualified community behavioral
			 health centers, and Rural Health Clinics</header-in-text></quote>;</text>
				</paragraph><paragraph id="HF4FF07D7E803448CAD7D62D32EC9FFAE"><enum>(2)</enum><text>in paragraph (1),
			 by inserting <quote>(and beginning with fiscal year 2011 with respect to
			 services furnished on or after January 1, 2011, and each succeeding fiscal
			 year, for services described in section 1905(a)(2)(D) furnished by a
			 federally-qualified community behavioral health center)</quote> after <quote>by
			 a rural health clinic</quote>;</text>
				</paragraph><paragraph id="HF5D87F5D3B8D4A72916BEB1B9CAF722F"><enum>(3)</enum><text>in paragraph
			 (2)—</text>
					<subparagraph id="HB4C611FF6E97465FA25555FFF4DFAADB"><enum>(A)</enum><text>by striking the
			 heading and inserting <quote><header-in-text level="paragraph" style="OLC">Initial fiscal year</header-in-text></quote>;</text>
					</subparagraph><subparagraph id="H3FEC89749BD548118E45BBD61919CC65"><enum>(B)</enum><text>by inserting
			 <quote>(or, in the case of services described in section 1905(a)(2)(D)
			 furnished by a federally-qualified community behavioral health center, for
			 services furnished on and after January 1, 2011, during fiscal year
			 2011)</quote> after <quote>January 1, 2001, during fiscal year
			 2001</quote>;</text>
					</subparagraph><subparagraph id="HA9E364D5C1464AAFA814701521BAC4BF"><enum>(C)</enum><text>by inserting
			 <quote>(or, in the case of services described in section 1905(a)(2)(D)
			 furnished by a federally-qualified community behavioral health center, during
			 fiscal years 2009 and 2010)</quote> after <quote>1999 and 2000</quote>;
			 and</text>
					</subparagraph><subparagraph id="H3236B5EB04464B70AA1CD5065CDBDD0B"><enum>(D)</enum><text>by inserting
			 <quote>(or, in the case of services described in section 1905(a)(2)(D)
			 furnished by a federally-qualified community behavioral health center, during
			 fiscal year 2011)</quote> before the period;</text>
					</subparagraph></paragraph><paragraph id="HC373A435720440F4B7F858464FD8AD9D"><enum>(4)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="H9A47641AC44544C8948E9FA56D0C32CF"><enum>(A)</enum><text>in the heading, by
			 striking <quote><header-in-text level="paragraph" style="OLC">Fiscal year 2002
			 and succeeding</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Succeeding</header-in-text></quote>; and</text>

					</subparagraph></paragraph><paragraph id="HA8B26BB14AFA4F0CB6717EFEC9C9FF6A"><enum>(5)</enum><text>in paragraph
			 (4)—</text>
					<subparagraph id="H4C24E189F026481DBFCBDC9F4494D7F1"><enum>(A)</enum><text>by inserting
			 <quote>(or as a federally-qualified community behavioral health center after
			 fiscal year 2010)</quote> after <quote>or rural health clinic after fiscal year
			 2000</quote>;</text>
					</subparagraph><subparagraph id="H917A8458901645089F86C512C8A8CF97"><enum>(B)</enum><text>by striking
			 <quote>furnished by the center or</quote> and inserting <quote>furnished by the
			 federally qualified health center, services described in section 1905(a)(2)(D)
			 furnished by the federally-qualified community behavioral health center,
			 or</quote>;</text>
					</subparagraph><subparagraph id="HB8657431A5E4432ABA4BC9DAAAFBD9E7"><enum>(C)</enum><text display-inline="yes-display-inline">in the second sentence, by striking
			 <quote>or rural health clinic</quote> and inserting <quote>,
			 federally-qualified community behavioral health center, or rural health
			 clinic</quote>;</text>
					</subparagraph></paragraph><paragraph id="HC5A62096750A4A3180D6EF4E5EB1772A"><enum>(6)</enum><text>in paragraph (5),
			 in each of subparagraphs (A) and (B), by striking <quote>or rural health
			 clinic</quote> and inserting <quote>, federally-qualified community behavioral
			 health center, or rural health clinic</quote>; and</text>
				</paragraph><paragraph id="HB8704E700BE14D7C95B717DEAEA4B231"><enum>(7)</enum><text>in paragraph (6),
			 by striking <quote>or to a rural health clinic</quote> and inserting <quote>,
			 to a federally-qualified community behavioral health center for services
			 described in section 1905(a)(2)(D), or to a rural health clinic</quote>.</text>
				</paragraph></subsection><subsection id="H39F2B8AF7F9646BEAA9B9A52A896C050"><enum>(b)</enum><header>Inclusion of
			 community behavioral health center services in the term medical
			 assistance</header><text>Section 1905(a)(2) of the Social Security Act (42
			 U.S.C. 1396d(a)(2)) is amended—</text>
				<paragraph id="H5C1E8E121E3246AC95222DBB181D4376"><enum>(1)</enum><text>by striking
			 <quote>and</quote> before <quote>(C)</quote>; and</text>
				</paragraph><paragraph id="H5920416976DE42779C2571D83FDE956A"><enum>(2)</enum><text>by inserting
			 before the semicolon at the end the following: <quote>, and (D)
			 federally-qualified community behavioral health center services (as defined in
			 subsection (l)(4))</quote>.</text>
				</paragraph></subsection><subsection id="HEAB55A03D19A4CD59EFF575187191B88"><enum>(c)</enum><header>Definition of
			 federally-Qualified community behavioral health center
			 services</header><text>Section 1905(l) of the Social Security Act (42 U.S.C.
			 1396d(l)) is amended by adding at the end the following paragraph:</text>
				<quoted-block id="H4A4A0FD6377A443CAC22DC5157DE8ACF" style="OLC">
					<paragraph id="HB4E12166A931495285BE523FA14FECBB"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H168AA8DC16D341D89D6E783E6E7D0C2F"><enum>(A)</enum><text>The term <term>community
				behavioral health center services</term> means services furnished to an
				individual at a federally-qualified community behavioral health center (as
				defined by subparagraph (B)).</text>
						</subparagraph><subparagraph id="H3177A668F3A24343A3994E144D3A0F2D" indent="up1"><enum>(B)</enum><text>The term <term>federally qualified
				community behavioral health center</term> means an entity that is certified
				under section 1913(c) of the Public Health Service Act as meeting the criteria
				described in paragraph (3) of such
				section.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id0DA678BE427349799E40529A50F178A6"><enum>4.</enum><header>Health
			 information technology</header>
			<subsection id="idC96CE9CA7E2A4F359B9B964D7EE8BE34"><enum>(a)</enum><header>Health care
			 provider</header><text>Section 3000(3) of the Public Health Service Act (42
			 U.S.C. 300jj(3)) is amended by inserting before <quote>and any other
			 category</quote> the following: <quote>a federally-qualified community
			 behavioral health center described in section 1905(a)(2)(D) of the Social
			 Security Act,</quote>.</text>
			</subsection><subsection id="id977B31E55BF749CBB65DF97DCC67D486"><enum>(b)</enum><header>Health
			 Information Technology Regional Extension Centers</header><text>Section
			 3012(c)(4) of the Public Health Service Act (42 U.S.C. 300jj–32(c)(4)) is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7D471E21F1174B20997CDE7F628EDE81" style="OLC">
					<subparagraph id="id51470DF7DE3F4230A69F19670BEB706E"><enum>(F)</enum><text>Federally-qualified
				community behavioral health centers described in section 1905(a)(2)(D) of the
				Social Security
				Act.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idFF90DD3A9158448C890D8603ACA87D3C"><enum>(c)</enum><header>Medicaid
			 providers</header><text>Section 1903(t)(2)(B) of the Social Security Act (42
			 U.S.C. 1396b(t)(2)(B)) is amended—</text>
				<paragraph id="IDcda3201ac14548d2b3a4332646999431"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>or</quote> and inserting a semicolon;</text>
				</paragraph><paragraph id="ID6cd6efcb80e44b0c94242193869db8f7"><enum>(2)</enum><text>in clause (ii),
			 by striking the period and inserting <quote>; or</quote>; and</text>
				</paragraph><paragraph id="IDd6f408bdca564b1b81c15d4bfcf21858"><enum>(3)</enum><text>by inserting
			 after clause (ii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id08F3E67AD34A44CF97D35432CFA74D27" style="OLC">
						<subparagraph id="IDe7fa67a1e64744ffbdc2fe00ec0c2a4b"><enum>(iii)</enum><text>a
				federally-qualified community behavioral health center described in section
				1905(a)(2)(D).</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idD04765E0D3694309B8F12F0B0DDD39A1"><enum>5.</enum><header>Community-based
			 mental health infrastructure improvement</header><text display-inline="no-display-inline">Title V of the Public Health Service Act (42
			 U.S.C. 280g et seq.) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idB6241ECF4E674991857E5C3D263D61B5" style="OLC">
				<part id="id8223CCFEAE2242F18FC380BAB41F0FCF"><enum>H</enum><header>Community-based
				mental health infrastructure improvements</header>
					<section id="id40F4E0524A4447999657175FC5A2BA55"><enum>560.</enum><header>Grants for
				community-based mental health infrastructure improvements</header>
						<subsection id="id2C037BC8F5054036AB4360EC4E9CD816"><enum>(a)</enum><header>Grants
				authorized</header><text>The Secretary may award grants to eligible entities to
				expend funds for the construction or modernization of facilities used to
				provide mental health and substance abuse services to individuals.</text>
						</subsection><subsection id="id6A8CA28B555E419B897531888EB6BB78"><enum>(b)</enum><header>Eligible
				entity</header><text>In this section, the term <term>eligible entity</term>
				means—</text>
							<paragraph id="id4335DBE9DB1E4760865B5735FB93CD4F"><enum>(1)</enum><text>a State that is
				the recipient of a Community Mental Health Services Block Grant under subpart I
				of part B of title XIX and a Substance Abuse Prevention and Treatment Block
				Grant under subpart II of such part; or</text>
							</paragraph><paragraph id="id69AB0CF5A8384EF5A7744995D827619F"><enum>(2)</enum><text>an Indian tribe
				or a tribal organization (as such terms are defined in sections 4(b) and 4(c)
				of the Indian Self-Determination and Education Assistance Act).</text>
							</paragraph></subsection><subsection id="id4F8B65A44B8F4E33B62FCE2B75E22457"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">A eligible entity desiring a grant under
				this section shall submit to the Secretary an application at such time, in such
				manner, and containing—</text>
							<paragraph id="idDFBC3A00AC9544D8A7A8D94C967C71ED"><enum>(1)</enum><text display-inline="yes-display-inline">a plan for the construction or
				modernization of facilities used to provide mental health and substance abuse
				services to individuals that—</text>
								<subparagraph id="ID41c8bd2fa82f4d5499771a64945aeafd"><enum>(A)</enum><text>designates a
				single State or tribal agency as the sole agency for the supervision and
				administration of the grant;</text>
								</subparagraph><subparagraph id="IDc7a060dbaa23472495459b4716dc1ef7"><enum>(B)</enum><text>contains
				satisfactory evidence that such agency so designated will have the authority to
				carry out the plan;</text>
								</subparagraph><subparagraph id="ID48f06325f8054caca127937b9646d410"><enum>(C)</enum><text>provides for the
				designation of an advisory council, which shall include representatives of
				nongovernmental organizations or groups, and of the relevant State or tribal
				agencies, that aided in the development of the plan and that will implement and
				monitor any grant awarded to the eligible entity under this section;</text>
								</subparagraph><subparagraph id="IDcde9f0f2995345d18f6b38c28601e4ac"><enum>(D)</enum><text>in the case of an
				eligible entity that is a State, includes a copy of the State plan under
				section 1912(b) and section 1932(b);</text>
								</subparagraph><subparagraph id="IDaac15151c46a46a38271c7248092c4e6"><enum>(E)</enum><clause commented="no" display-inline="yes-display-inline" id="idDB6CC2B813FE453C82CF2EC80BF33CCD"><enum>(i)</enum><text>includes a listing of
				the projects to be funded by the grant; and</text>
									</clause><clause id="idC97365A8DA704C2CA4CA2E289A18A145" indent="up1"><enum>(ii)</enum><text>in the case of an eligible entity
				that is a State, explains how each listed project helps the State in
				accomplishing its goals and objectives under the Community Mental Health
				Services Block Grant under subpart I of part B of title XIX and the Substance
				Abuse Prevention and Treatment Block Grant under subpart II of such
				part;</text>
									</clause></subparagraph><subparagraph id="ID955cac4b5e14489b88c5d2576be18bfb"><enum>(F)</enum><text>includes
				assurances that the facilities will be used for a period of not less than 10
				years for the provision of community-based mental health or substance abuse
				services for those who cannot pay for such services, subject to subsection (e);
				and</text>
								</subparagraph><subparagraph id="ID618e240c591942a9b0487360353428ba"><enum>(G)</enum><text>in the case of a
				facility that is not a public facility, includes the name and executive
				director of the entity who will provide services in the facility; and</text>
								</subparagraph></paragraph><paragraph id="id700EDF7D44274760B971A2D080293651"><enum>(2)</enum><text>with respect to
				each construction or modernization project described in the application—</text>
								<subparagraph id="IDd496cabf2e8b42c6adcdeead08c79eff"><enum>(A)</enum><text>a description of
				the site for the project;</text>
								</subparagraph><subparagraph id="ID44bc35b5a9cf426c9d42ac37742ec7d3"><enum>(B)</enum><text>plans and
				specifications for the project and State or tribal approval for the plans and
				specifications;</text>
								</subparagraph><subparagraph id="ID108e9c8d53ab42d78e6746e4f6c3d7d3"><enum>(C)</enum><text>assurance that
				the title for the site is or will be vested with either the public entity or
				private nonprofit entity who will provide the services in the facility;</text>
								</subparagraph><subparagraph id="IDf3f2f9481d264e3299d8c0bc8b1c3d2a"><enum>(D)</enum><text>assurance that
				adequate financial resources will be available for the construction or major
				rehabilitation of the project and for the maintenance and operation of the
				facility;</text>
								</subparagraph><subparagraph id="IDa66f141dfc404e0cb988db45dd13d662"><enum>(E)</enum><text>estimates of the
				cost of the project; and</text>
								</subparagraph><subparagraph id="IDefe31b70c08a48a39379e32d9c4aacdd"><enum>(F)</enum><text>the estimated
				length of time for completion of the project.</text>
								</subparagraph></paragraph></subsection><subsection id="idF84426E8FB014325A2C7F3C737955081"><enum>(d)</enum><header>Subgrants by
				States</header>
							<paragraph id="id4E8E5BAF2BBB41989E76C078E2EA276A"><enum>(1)</enum><header>In
				general</header><text>A State that receives a grant under this section may
				award a subgrant to a qualified community program (as such term is used in
				section 1913(b)(1)).</text>
							</paragraph><paragraph id="idCE7FC302248D46D0A0EB34F9AE0ADBB8"><enum>(2)</enum><header>Use of
				funds</header><text>Subgrants awarded pursuant to paragraph (1) may be used for
				activities such as—</text>
								<subparagraph id="idADB2B7E75E9A47B481A77FFD73B82B90"><enum>(A)</enum><text>the construction,
				expansion, and modernization of facilities used to provide mental health and
				substance abuse services to individuals;</text>
								</subparagraph><subparagraph commented="no" id="id6EBE3C42325541878C2FEB4D9262F70F"><enum>(B)</enum><text>acquiring and
				leasing facilities and equipment (including paying the costs of amortizing the
				principal of, and paying the interest on, loans for such facilities and
				equipment) to support or further the operation of the subgrantee;</text>
								</subparagraph><subparagraph id="id38486EC4A3984A5F848C5BD13FD3ABC9"><enum>(C)</enum><text>the construction
				and structural modification (including equipment acquisition) of facilities to
				permit the integrated delivery of behavioral health and primary care of
				specialty medical services to individuals with co-occurring mental illnesses
				and chronic medical or surgical diseases at a single service site; and</text>
								</subparagraph><subparagraph id="IDdadb43f656de4affb23bda294c6ec8ea"><enum>(D)</enum><text>acquiring
				information technology required to accommodate the clinical needs of primary
				and specialty care professionals.</text>
								</subparagraph></paragraph><paragraph id="ID1f5fe248629a4ab5a057be748e73a72a"><enum>(3)</enum><header>Limitation</header><text>Not
				to exceed 15 percent of grant funds may be used for activities described in
				paragraph (2)(D).</text>
							</paragraph></subsection><subsection commented="no" id="id9BC7E14BC007420E8B570A4F28A5B7C0"><enum>(e)</enum><header>Request To
				transfer obligation</header><text>An eligible entity that receives a grant
				under this section may submit a request to the Secretary for permission to
				transfer the 10-year obligation of facility use, as described in subsection
				(c)(1)(F), to another facility.</text>
						</subsection><subsection commented="no" id="idF70B44B1F3BD4E88A3E46A32045E96F8"><enum>(f)</enum><header>Agreement to
				Federal share</header><text>As a condition of receipt of a grant under this
				section, an eligible entity shall agree, with respect to the costs to be
				incurred by the entity in carrying out the activities for which such grant is
				awarded, that the entity will make available non-Federal contributions (which
				may include State or local funds, or funds from the qualified community
				program) in an amount equal to not less than $1 for every $1 of Federal funds
				provided under the grant.</text>
						</subsection><subsection commented="no" id="idCB3A615C934A4937A7A50828054996F6"><enum>(g)</enum><header>Reporting</header>
							<paragraph commented="no" id="id1D5154267C264C309203B051E99AAEAF"><enum>(1)</enum><header>Reporting by
				States</header><text>During the 10-year period referred to in subsection
				(c)(1)(F), the Secretary shall require that a State that receives a grant under
				this section submit, as part of the report of the State required under the
				Community Mental Health Services Block Grant under subpart I of part B of title
				XIX and the Substance Abuse Prevention and Treatment Block Grant under subpart
				II of such part, a description of the progress on—</text>
								<subparagraph commented="no" id="idF95784C11C7A491EB060AF2326CE0B56"><enum>(A)</enum><text>the projects
				carried out pursuant to the grant under this section; and</text>
								</subparagraph><subparagraph commented="no" id="id4E39389409854D909527FA5C6EC8DBA7"><enum>(B)</enum><text>the assurances
				that the facilities involved continue to be used for the purpose for which they
				were funded under such grant during such 10-year period.</text>
								</subparagraph></paragraph><paragraph commented="no" id="id2B3085D5C18B4D989D47D10274990B97"><enum>(2)</enum><header>Reporting by
				Indian tribes and tribal organizations</header><text>The Secretary shall
				establish reporting requirements for Indian tribes and tribal organizations
				that receive a grant under this section. Such reporting requirements shall
				include that such Indian tribe or tribal organization provide a description of
				the progress on—</text>
								<subparagraph commented="no" id="idA23FABE23CE34F91A7C8E0BE368C952C"><enum>(A)</enum><text>the projects
				carried out pursuant to the grant under this section; and</text>
								</subparagraph><subparagraph commented="no" id="id98EB0B6829144A8AA8A15B0E1479776E"><enum>(B)</enum><text>the assurances
				that the facilities involved continue to be used for the purpose for which they
				were funded under such grant during the 10-year period referred to in
				subsection (c)(1)(F).</text>
								</subparagraph></paragraph></subsection><subsection commented="no" id="idBF8FFCABAF834BD6A7F00F8E35D7D9BC"><enum>(h)</enum><header>Failure To meet
				obligations</header>
							<paragraph commented="no" id="id892C211EED1047A2854FC002F37565AA"><enum>(1)</enum><header>In
				general</header><text>If an eligible entity that receives a grant under this
				section fails to meet any of the obligations of the entity required under this
				section, the Secretary shall take appropriate steps, which may include—</text>
								<subparagraph commented="no" id="id7FC4F356D76246EF98E95D03DAC1E2E2"><enum>(A)</enum><text>requiring that
				the entity return the unused portion of the funds awarded under this section
				for the projects that are incomplete; and</text>
								</subparagraph><subparagraph commented="no" id="ID46da07ea3da145298f5c743b062e5149"><enum>(B)</enum><text>extending the
				length of time that the entity must ensure that the facility involved is used
				for the purposes for which it is intended, as described in subsection
				(c)(1)(F).</text>
								</subparagraph></paragraph><paragraph commented="no" id="ID7c2ef74ee103437488e5e1182dc54366"><enum>(2)</enum><header>Hearing</header><text>Prior
				to requesting the return of the funds under paragraph (1)(B), the Secretary
				shall provide the entity notice and opportunity for a hearing.</text>
							</paragraph></subsection><subsection id="IDef81e8c9d35e458caab50aadcc79d375"><enum>(i)</enum><header>Collaboration</header><text>The
				Secretary may establish intergovernmental and interdepartmental memorandums of
				agreement as necessary to carry out this section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id1D649FE5C8CF424BB7FC01BD256F26CC"><enum>(j)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $20,000,000 for fiscal year 2010 and such sums as may be
				necessary for each of fiscal years 2011 through
				2013.</text>
						</subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDe239d1617626450e9a035c43749e3d2a"><enum>6.</enum><header>Expanded
			 participation in 340B program</header><text display-inline="no-display-inline">Section 340B(a)(4) of the Public Health
			 Service Act (42 U.S.C. 256b(a)(4)) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id7EB510F749804DAFA579D290EB52741D" style="OLC">
				<subparagraph id="IDac56695a67bd476d8d5fa1f79a37d18b"><enum>(P)</enum><text>An entity
				receiving funds under subpart I of part B of title XIX of this Act for the
				provision of community mental health services.</text>
				</subparagraph><subparagraph id="ID6e3ffd2ded4b472fbfc0cf8abe444acd"><enum>(Q)</enum><text>An entity
				receiving funds under subpart II of part B of title XIX of this Act for the
				provision of treatment services for substance
				abuse.</text>
				</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idC9BB17BD571848C184B3EA2C2F25CD8F"><enum>7.</enum><header>Adding
			 federally-qualified community behavioral health center as originating sites for
			 payment of Medicare telehealth services</header>
			<subsection id="id6351D9370A8D4AE594C4242EBC9FE65F"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section
			 1834(m)(4)(C)(ii) of the Social Security Act (42 U.S.C. 1395m(m)(4)(C)(ii)) is
			 amended by adding at the end the following new subclause:</text>
				<quoted-block display-inline="no-display-inline" id="id6A69B245397F4C709154F5E55E366DAF" style="OLC">
					<subclause id="id0BFC3D5B60C94951AF6CB0B5D7C938C3"><enum>(IX)</enum><text>A
				federally-qualified community behavioral health center under section 1913 of
				the Public Health Service
				Act.</text>
					</subclause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idBA487C7213924E6FB8B9A84ADB4BCFEE"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to services
			 furnished after the date of enactment of this Act.</text>
