		<official-title display="yes">To amend title 28, United States Code, to
		  prevent the proceeds or instrumentalities of foreign crime located in the
		  United States from being shielded from foreign forfeiture
		  proceedings.</official-title>

		<section commented="no" display-inline="no-display-inline" id="id6735DE3F7FD848F6A03117CB9DF0A22A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preserving Foreign Criminal Assets for
			 Forfeiture Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id245B26561D794917896C4B55C1739D77" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Preservation of property subject to
			 forfeiture under foreign law</header><text display-inline="no-display-inline">Section 2467(d)(3)(A) of title 28, United
			 States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idA3B4DBBE4FF940D2BAC669237A1FB1E3" style="OLC">
				<subparagraph commented="no" display-inline="no-display-inline" id="idA6ADA1DC0D564FD7B017096798C1AF0C"><enum>(A)</enum><header display-inline="yes-display-inline">Restraining orders</header>
					<clause commented="no" display-inline="no-display-inline" id="id8D5F5A0648084D78AA8108AD420DCD14"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">To preserve the availability of property
				subject to civil or criminal forfeiture under foreign law, the Government may
				apply for, and the court may issue, a restraining order at any time before or
				after the initiation of forfeiture proceedings by a foreign nation.</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="idBAEA3A6519F8428D91E6C938DF784844"><enum>(ii)</enum><header display-inline="yes-display-inline">Procedures</header>
						<subclause commented="no" display-inline="no-display-inline" id="id6FB189D8CD90476EB76F276BFABEB96B"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A restraining order under this subparagraph
				shall be issued in a manner consistent with subparagraphs (A), (C), and (E) of
				paragraph (1) and the procedural due process protections for a restraining
				order under section 983(j) of title 18.</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="id1F32BDB492AF4103ADAC37C5DB151D94"><enum>(II)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">For purposes of applying such section
				983(j)—</text>
							<item commented="no" display-inline="no-display-inline" id="ID19379176018e4083b6d92c8dd8238d9d"><enum>(aa)</enum><text display-inline="yes-display-inline">references in such section 983(j) to civil
				forfeiture or the filing of a complaint shall be deemed to refer to the
				applicable foreign criminal or forfeiture proceedings; and</text>
							</item><item commented="no" display-inline="no-display-inline" id="IDe4c4a79afeac4eda8c65d6059957792a"><enum>(bb)</enum><text display-inline="yes-display-inline">the reference in paragraph (1)(B)(i) of
				such section 983(j) to the United States shall be deemed to refer to the
				foreign
				nation.</text>
