		<official-title display="yes">To amend the Fair Credit Reporting Act with
		  respect to the applicability of identity theft guidelines to
		  creditors.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Red Flag Program Clarification Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id45D8D7B62AC549FFBC0E530ADA59C236" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Scope of certain creditor
			 requirements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id5C9006A832C5430CB708E5F6DAC36B22"><enum>(a)</enum><header display-inline="yes-display-inline">Amendment to FCRA</header><text display-inline="yes-display-inline">Section 615(e) of the Fair Credit Reporting
			 Act (15 U.S.C. 1681m(e)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5363CDC2E9CF40488B3A23CA8FC59397" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idB6C531B9852C433EB499084BD793AC3B"><enum>(4)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">As used in this subsection, the term
				<term>creditor</term>—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9B0A635153F64F6EB8282C734BAE75EB"><enum>(A)</enum><text display-inline="yes-display-inline">means a creditor, as defined in section 702
				of the Equal Credit Opportunity Act (15 U.S.C. 1691a), that regularly and in
				the ordinary course of business—</text>
							<clause commented="no" display-inline="no-display-inline" id="id8A71BCBF8FE548C6928327BA99EF183E"><enum>(i)</enum><text display-inline="yes-display-inline">obtains or uses consumer reports, directly
				or indirectly, in connection with a credit transaction;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF63F87429C6F4DCE89249031FA41A2D0"><enum>(ii)</enum><text display-inline="yes-display-inline">furnishes information to consumer reporting
				agencies, as described in section 623, in connection with a credit transaction;
				or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id70AB2D454B7949799FEDB0259236E5D1"><enum>(iii)</enum><text display-inline="yes-display-inline">advances funds to or on behalf of a person,
				based on an obligation of the person to repay the funds or repayable from
				specific property pledged by or on behalf of the person;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D1F5FF433274387AE0A614A86F9A6DA"><enum>(B)</enum><text display-inline="yes-display-inline">does not include a creditor described in
				subparagraph (A)(iii) that advances funds on behalf of a person for expenses
				incidental to a service provided by the creditor to that person; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9090702B4C464C169E4BBE899822A6B4"><enum>(C)</enum><text display-inline="yes-display-inline">includes any other type of creditor, as
				defined in that section 702, as the agency described in paragraph (1) having
				authority over that creditor may determine appropriate by rule promulgated by
				that agency, based on a determination that such creditor offers or maintains
				accounts that are subject to a reasonably foreseeable risk of identity
				theft.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id2DBEAF96BB274C1E97BD54FB5FEF398B"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall become effective on the date of enactment of this
			 Act.</text>
