		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>E-Rulemaking Act of
			 2010</short-title></quote>.</text>
		</section><section id="IDcc891c996b814ee0a46f667bc4b34707"><enum>2.</enum><header>Finding and
			 purposes</header>
			<subsection id="IDc21913f08ae34048ba14a04eaff95b71"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds the following:</text>
				<paragraph id="ID67bb05cbe2044acc91fb87257c2579b9"><enum>(1)</enum><text>Electronic
			 rulemaking allows robust public involvement in the regulatory process and
			 increases transparency of how regulations are developed.</text>
				</paragraph><paragraph id="IDacb73a0e98e3451f90163a7a6a73b4a2"><enum>(2)</enum><text>Chapter 5 of
			 title 5, United States Code, (commonly referred to as the Administrative
			 Procedures Act) codifies the rulemaking process and opens it up to public
			 participation.</text>
				</paragraph><paragraph id="ID911b35579aca4eb29f339b8e24695258"><enum>(3)</enum><text>Progress has been
			 made in the e-rulemaking program of the Federal Government which was a
			 requirement in the E-Government Act of 2002 (44 U.S.C. 3501 note) including the
			 creation of Regulations.gov. However, the systems architecture and
			 implementation of the Federal Docket Management System have run into
			 limitations in electronic rulemaking.</text>
				</paragraph><paragraph id="ID845e1807a01e4161bf5cace0af276cc2"><enum>(4)</enum><text>A dedicated,
			 stable appropriation for an enhanced core system can be leveraged by agencies
			 to bring growth and innovation more effectively than the current agency
			 fee-for-service funding models.</text>
				</paragraph><paragraph id="IDca57b54c9e834de1acc5231c16f4ef2f"><enum>(5)</enum><text>Lack of adequate
			 data standardization for key data practices makes it difficult for agencies and
			 the public to fully benefit from a Governmentwide rulemaking database.</text>
				</paragraph><paragraph id="IDc9d3afedf40b4ba6b7d9447180f2eca4"><enum>(6)</enum><text>A reliable,
			 centralized rulemaking database that improves on the current Federal Document
			 Management System architecture would allow agencies to share common elements,
			 while supporting interoperable agency applications that reflect a diversity of
			 rulemaking practices.</text>
				</paragraph></subsection><subsection id="IDcf38092799814cf5b8d3e6d69854e081"><enum>(b)</enum><header>Purposes</header><text>The
			 purposes of this Act are to—</text>
				<paragraph id="IDb449f7f50da54fb0a5f6e37fefb94ccc"><enum>(1)</enum><text>establish a
			 framework for governing, managing and funding the next stage of the
			 e-rulemaking program;</text>
				</paragraph><paragraph id="ID7d3454c1519f4e689b70967fdffa9c8b"><enum>(2)</enum><text>enhance the
			 capabilities of the Federal Docket Management System so that it can serve as
			 effective core e-rulemaking support, while allowing the system to grow through
			 innovation to provide for the development of new functions, tools and services,
			 by both agencies and interested entities outside of Government;</text>
				</paragraph><paragraph id="ID77d223e5a27f4d3e96ef4b4ef5bd736b"><enum>(3)</enum><text>promote processes
			 for discovering and disseminating good e-rulemaking practices and identifying
			 and overcoming barriers to the evolution of e-rulemaking; and</text>
				</paragraph><paragraph id="ID102d5d56f3414c1bbf9e3010dcc78a39"><enum>(4)</enum><text>encourage all
			 Federal entities that participate in the e-rulemaking process to work towards
			 an accessible and interoperable docket management system.</text>
				</paragraph></subsection></section><section id="IDab111d3d34304ee08736c38eb87d9163"><enum>3.</enum><header>Governance,
			 management, and funding</header>
			<subsection id="ID840a1d3ae7304c14a1ed42068b1c0b98"><enum>(a)</enum><header>In
			 general</header><text>Section 206 of the E-Government Act of 2002 (44 U.S.C.
			 3501 note) is amended—</text>
				<paragraph id="ID34482c40828c4d748ff5565085f5aebd"><enum>(1)</enum><text>in subsection
			 (b), by striking <quote>To the extent practicable as determined by the agency
			 in consultation with the Director, each</quote> and inserting
			 <quote>Each</quote>;</text>
				</paragraph><paragraph id="IDe43acc9b28ee4168811401c5c6d87d13"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>To the extent practicable, agencies</quote> and
			 inserting <quote>Agencies</quote>;</text>
				</paragraph><paragraph id="ID50b702891e1042b2b286237f2daeb258"><enum>(3)</enum><text>in subsection
			 (d)—</text>
					<subparagraph id="id9E5D19C5726C48FB80B0A9ED99D32758"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>To the extent practicable, as determined by the agency in
			 consultation with the Director, agencies</quote> and inserting
			 <quote>Agencies</quote>; and</text>
					</subparagraph><subparagraph id="ID620861da97aa4deca45772bc15e61d2a"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>to the extent practicable, as determined by the agency in
			 consultation with the Director</quote>; and</text>
					</subparagraph></paragraph><paragraph id="id2E59B6E3427948A0B8FAF801BDD105FE"><enum>(4)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idCFDF30F355434FDBA8FB0C560E8592B2" style="OLC">
						<subsection id="IDd8fae2cdc89f43c197d289554bd9e7dd"><enum>(e)</enum><header>Interagency
				E-Rulemaking Committee and Program Management Office</header>
							<paragraph id="ID61ed0a6100ee49bba472e68587a575a0"><enum>(1)</enum><header>Establishment</header><text>Not
				later than 180 days after the date of enactment of the
				<short-title>E-Rulemaking Act of 2010</short-title>, the
				Director shall establish—</text>
								<subparagraph id="id9457ECCD89CC46E19C690CDC217EF601"><enum>(A)</enum><text>the Interagency
				E-Rulemaking Committee; and</text>
								</subparagraph><subparagraph id="idA776E7877FEC4479AA722D8ACAC63B61"><enum>(B)</enum><text>the Program
				Management Office.</text>
								</subparagraph></paragraph><paragraph id="IDcc5e6ecb8dfb4f76992e414af5b209c5"><enum>(2)</enum><header>Membership</header>
								<subparagraph id="idBBDAC831AD80454EA15BDA4560674FE4"><enum>(A)</enum><header>In
				general</header><text>The Interagency E-Rulemaking Committee shall be
				co-chaired by the Administrator of the Office of Information and Regulatory
				Affairs and the Administrator of the Office of Electronic Government and shall
				include senior officers knowledgeable about rulemaking practices from—</text>
									<clause id="IDef935f997fe345cb8b1f79af5df9b5d0"><enum>(i)</enum><text>the General
				Services Administration;</text>
									</clause><clause id="idEB54E74EA564485E8EB0F76DB8054BE4"><enum>(ii)</enum><text>the Office of
				the Federal Register;</text>
									</clause><clause id="idE76C1DF33A4F4D188EAA0865E3A9D1A3"><enum>(iii)</enum><text>the
				Administrative Conference of the United States;</text>
									</clause><clause id="IDe29c4f5247ce452caaa8f25831e3e449"><enum>(iv)</enum><text>agencies
				designated by the Director that conduct substantial amounts of significant
				rulemaking;</text>
									</clause><clause id="ID5a52ca5b01fb4cb7ab12265b6325ca0e"><enum>(v)</enum><text>agencies
				designated by the Director that conduct relatively little rulemaking;</text>
									</clause><clause id="ID3b53828c05764f4da43d0f25cecd9249"><enum>(vi)</enum><text>independent
				regulatory agencies (as defined under section 3502 of title 44, United States
				Code) designated by the Director; and</text>
									</clause><clause id="id779AD3D5842B442DAFAF95E74392874D"><enum>(vii)</enum><text>other agencies
				designated by the Director.</text>
									</clause></subparagraph><subparagraph id="IDe66f173730b1425794a695aaaa82e9e3"><enum>(B)</enum><header>Limitation</header><text>Members
				of the Interagency E-Rulemaking Committee designated under clauses (iv), (v),
				and (vi) may not comprise more than 50 percent of all committee members.</text>
								</subparagraph></paragraph><paragraph id="ID188a0eb158524c2cbf5c9c49474c5ac9"><enum>(3)</enum><header>Functions</header><text>The
				Interagency E-Rulemaking Committee shall—</text>
								<subparagraph id="ID70710e0fde814a9eba4a9dd46a75519f"><enum>(A)</enum><text>assist the
				Director in establishing a Program Management Office to conduct and oversee the
				day-to-day operations of the E-Rulemaking Program;</text>
								</subparagraph><subparagraph id="ID0d87ed8ba932413d849700afa2d37d85"><enum>(B)</enum><text>advise the
				Program Management Office and the Director on the needs and desires of agencies
				for e-rulemaking capabilities for functionality;</text>
								</subparagraph><subparagraph id="ID4128afaad0ab45cda319c12ac3aaed22"><enum>(C)</enum><text>develop
				recommendations for the Program Management Office and the Director on
				e-rulemaking policies and requirements;</text>
								</subparagraph><subparagraph id="ID98e7f5f1eb9a4901b59f5d4d00da08f9"><enum>(D)</enum><text>assist the
				Director, and the Program Management Office in the identification, development,
				and coordination of e-rulemaking projects and other innovative initiatives to
				improve the Federal Docket Management System;</text>
								</subparagraph><subparagraph id="ID4f4212965df24154b02b976c231a5001"><enum>(E)</enum><text>promote the
				development and use of common performance measures for agency e-rulemaking
				resources management;</text>
								</subparagraph><subparagraph id="IDb69b8bb31ae745c295747e3e6790e12c"><enum>(F)</enum><text>develop
				recommendations in consultation with the Public E-Rulemaking Advisory Committee
				for the online disclosure of rulemaking information to federal agencies and to
				the public, including—</text>
									<clause id="IDc79eb01bbc2f49c7b78f36948e363e3f"><enum>(i)</enum><text>recommendations
				to ensure that dockets stored in the Federal Docket Management System are
				consistent, both in content and organization, with the requirements for
				electronic rulemaking dockets described under subsection (d);</text>
									</clause><clause id="ID8529cb37695d46db8759950cbce6943e"><enum>(ii)</enum><text>recommendations
				to ensure that information exempted from public disclosure under section 552(b)
				of title 5, United States Code, is not made publicly available; and</text>
									</clause><clause id="ID6d3d46b6b94b4648b15d923da56a28e6"><enum>(iii)</enum><text>recommendations
				to ensure that personally identifiable information is protected under section
				552(l) of title 5, United States Code.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="ID1b47d88433c544d1ae71499976bee027"><enum>(f)</enum><header>Public
				E-Rulemaking Advisory Committee</header>
							<paragraph id="IDc87e9bbd6292472ba7e5a41f51245f64"><enum>(1)</enum><header>Establishment</header><text>There
				is established in the executive branch a Public E-Rulemaking Advisory Committee
				(in this subsection referred to as the <quote>Advisory
				Committee</quote>).</text>
							</paragraph><paragraph id="ID293ed07a8691402e8dd66da0a3026a64"><enum>(2)</enum><header>Membership</header>
								<subparagraph id="id503431EEDC46497D90A88B086A685908"><enum>(A)</enum><header>In
				general</header><text>The Advisory Committee shall be composed of 20 members
				who are not Federal employees and who shall—</text>
									<clause id="ID131b826c905441e487b7447aa4ba5035"><enum>(i)</enum><text>be jointly
				appointed by the Administrator of the Office on Information and Regulatory
				Affairs and the Administrator of the Office of Electronic Government using a
				process which provides for transparency and public input;</text>
									</clause><clause id="ID8bd6488704614b4d82904fb1eb25a22b"><enum>(ii)</enum><text>select—</text>
										<subclause id="idB3607B4FC1FC4D9F911AB6C69603CED9"><enum>(I)</enum><text>1 chairperson who
				is not a Federal officer; and</text>
										</subclause><subclause id="id147035197FDA42BFA0CFF7E86A64E2F0"><enum>(II)</enum><text>1 vice
				chairperson from the Program Management Office who shall be the designated
				Federal officer; and</text>
										</subclause></clause><clause id="ID7c4e98d665e24734904a0c50e38fefed"><enum>(iii)</enum><text>include—</text>
										<subclause id="IDac6649334c764f5aaabeb73fe55f4c51"><enum>(I)</enum><text>a minimum of 7
				members with demonstrated regulatory policy and practice expertise; and</text>
										</subclause><subclause id="id65E15AC5A89941148BDF4C0ABD9A912C"><enum>(II)</enum><text>a minimum of 7
				members with demonstrated technology or public access expertise.</text>
										</subclause></clause></subparagraph><subparagraph id="id44319C923CA046A084BB96D5912A4649"><enum>(B)</enum><header>Organization</header><text>The
				Administrator of the Office of Information and Regulatory Affairs and the
				Administrator of the Office of Electronic Government shall—</text>
									<clause id="id4103A8CA398E45AA87A5F2C033A2445B"><enum>(i)</enum><text>be responsible
				for the initial organization of the Advisory Committee;</text>
									</clause><clause id="id166F95DC30AD4BF1B53A4367C6B6FD19"><enum>(ii)</enum><text>assist in the
				election of co-chairpersons using a process which provides for transparency and
				public input; and</text>
									</clause><clause id="ID9217ff66858842238c4e927da6fa67f2"><enum>(iii)</enum><text>designate the
				General Services Administration to provide staff support to the Advisory
				Committee.</text>
									</clause></subparagraph></paragraph><paragraph id="ID85e2f93fa07d4a1aa3c9fee62b8bb9b1"><enum>(3)</enum><header>Broadcast of
				proceedings</header><text>To the greatest extent practicable, the General
				Services Administration shall make available to the public webcasts and
				archived footage of all meetings of the Advisory Committee.</text>
							</paragraph><paragraph id="ID21dee0de19054981b6def27fd34876a2"><enum>(4)</enum><header>Functions</header><text>The
				Advisory Committee shall—</text>
								<subparagraph id="ID70322ef65009442394d768d46e09ea26"><enum>(A)</enum><text>regularly advise
				the Administrator of the Office on Information and Regulatory Affairs, the
				Administrator of the Office of Electronic Government, and the Administrator of
				the General Services Administration on the e-rulemaking needs and desires of
				the various e-rulemaking user communities outside the Federal
				Government;</text>
								</subparagraph><subparagraph id="IDd2c6b708fdcb428690232966ae50495a"><enum>(B)</enum><text>engage in public
				consultation to the maximum extent feasible, including consultation with all
				interested communities such as public advocacy organizations, academics, and
				regulated entities;</text>
								</subparagraph><subparagraph id="ID96846398db2c4c8da3912826c5bb0a2f"><enum>(C)</enum><text>consult with the
				Interagency E-Rulemaking Committee and the Administrative Conference of the
				United States, as necessary;</text>
								</subparagraph><subparagraph id="IDe4b3871cb4b44873a866c83b80cd8ff2"><enum>(D)</enum><text>conduct studies
				and submit recommendations, as provided under this section, to the Director and
				Congress;</text>
								</subparagraph><subparagraph id="IDbefc9639cdc74374896e86af53dab528"><enum>(E)</enum><text>share effective
				practices for access to, dissemination of, and retention of regulatory
				material;</text>
								</subparagraph><subparagraph id="ID8af686a8b9f64dc78e0cc901c7e09c5b"><enum>(F)</enum><text>not later than 6
				months after establishment, annually thereafter, and upon termination submit a
				report to the Director, the Committee on Homeland Security and Governmental
				Affairs of the Senate and the Committee on Oversight and Government Reform of
				the House of Representatives that shall—</text>
									<clause id="IDb9ad86cde45f42829904bcff3120ac90"><enum>(i)</enum><text>identify legal
				provisions and agency practices that create barriers or obstacles to achieving
				e-rulemaking goals; and</text>
									</clause><clause id="ID0238e2f13adc4fcfb8b548753b85a436"><enum>(ii)</enum><text>propose
				solutions to the barriers or obstacles identified under clause (i).</text>
									</clause></subparagraph></paragraph><paragraph id="ID8d8ba0ad15274eb2b4ddb84c02401084"><enum>(5)</enum><header>Termination</header>
								<subparagraph id="IDd1b67b5dfc5146a28319caaf01492e44"><enum>(A)</enum><header>In
				general</header><text>The Advisory Committee shall terminate 2 years after the
				date of enactment of the E-Rulemaking Act of 2010.</text>
								</subparagraph><subparagraph id="ID83199c6657634f209883c671fa20e777"><enum>(B)</enum><header>Extension</header><text>The
				President may—</text>
									<clause id="ID973ce1b1f14543f680578683a3f32d6d"><enum>(i)</enum><text>extend the
				Advisory Committee by executive order; and</text>
									</clause><clause id="IDda73524b6888453db7a45cb81669fd42"><enum>(ii)</enum><text>make more than 1
				extension under this subparagraph for any period as the President may
				determine.</text>
									</clause></subparagraph></paragraph><paragraph id="IDd6459fb6d9aa4d3fb6f0e7ea8daeabe2"><enum>(6)</enum><header>Application of
				FACA</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall
				apply to the Advisory Committee.</text>
							</paragraph></subsection><subsection id="IDb9609449c42a4394b998d36ed79e33b0"><enum>(g)</enum><header>Architecture</header>
							<paragraph id="IDd5ae8bcf17e040d38a6d91df821df792"><enum>(1)</enum><header>In
				general</header><text>The Program Management Office shall collaborate with the
				Interagency Committee and the Public E-Rulemaking Advisory Committee to achieve
				significant improvements in the systems architecture for the Federal Docket
				Management System.</text>
							</paragraph><paragraph id="IDe36a62f9f28241068c879e279f11d6f6"><enum>(2)</enum><header>Contents</header><text>The
				systems architecture developed under this subsection shall—</text>
								<subparagraph id="id4615D484DA3240288D792B2878FAEEB9"><enum>(A)</enum><text>include
				well-designed data and technical standards, reinforced by effective quality
				control tools and protocols in order to achieve an accurate, consistent system
				that stores all rulemaking data; and</text>
								</subparagraph><subparagraph id="id2E7B3C74F08F44B0ADFE9708DAC39F52"><enum>(B)</enum><text>facilitate
				exchange, retrieval and management of information by agencies and the
				public.</text>
								</subparagraph></paragraph><paragraph id="id1CD0EE411FD6422389DF15ED1D2868F7"><enum>(3)</enum><header>Standards,
				protocols, and guidelines</header>
								<subparagraph id="ID53a436be266044deb5c7bc08cf051e8a"><enum>(A)</enum><header>Office of
				Management and Budget policy</header>
									<clause id="id4B13F707272E4BE79FED6DCF19FBA959"><enum>(i)</enum><header>Policy</header><text>The
				Director shall issue policy regarding standards, data protocols, and related
				items to be used by agencies when publishing their electronic regulatory
				dockets.</text>
									</clause><clause id="id90E30B86DF4B4CD68543179C5C4DA210"><enum>(ii)</enum><header>Guidelines</header><text>Based
				on the policy issued under clause (i), the Program Management Office shall
				promulgate guidelines that—</text>
										<subclause id="ID248fcbd054874b808eba044105ba9b9e"><enum>(I)</enum><text>incorporate a
				widely accepted, nonproprietary, searchable, computer-readable format for
				rulemaking data;</text>
										</subclause><subclause id="ID31be7c39fa814f468f26817bce65c3cb"><enum>(II)</enum><text>improve the
				quality, transparency, consistency, security, and usability of electronic
				rulemaking systems and data;</text>
										</subclause><subclause id="IDd899c5608c964ace818c11b78f8f93e6"><enum>(III)</enum><text>ensure
				interoperability and process standardization, and appropriate reuse of
				information;</text>
										</subclause><subclause id="ID1c03b45b69d046f4adcb8d0a885d7361"><enum>(IV)</enum><text>create document
				and metadata models for rulemaking documents that accomplish the
				standardization required for accurate and efficient Governmentwide retrieval of
				information;</text>
										</subclause><subclause id="IDcb73d5b0759b4e5fa73e58e08dd01cb9"><enum>(V)</enum><text>integrate
				standards and guidelines in effect before the date of enactment of the
				E-Rulemaking Act of 2010 as possible and appropriate, enhancing those standards
				and guidelines as necessary;</text>
										</subclause><subclause id="ID8421e8eb67b842fdab5c45780285834c"><enum>(VI)</enum><text>can be
				continually upgraded as technologies and content evolve over time;</text>
										</subclause><subclause id="IDe26a3193b6a64a7eb737d39af9d9194d"><enum>(VII)</enum><text>ensure that
				publicly available online Federal Government rulemaking information and
				services are made more accessible to external Government and external search
				capabilities; and</text>
										</subclause><subclause id="ID7d876a7f26a34dddb4733c7c5a9d9e19"><enum>(VIII)</enum><text>are developed
				in consultation with the National Institute of Standards and Technology.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="ID1ccd9b6c7c234145ae33c6af23aa0001"><enum>(4)</enum><header>Transfer of
				data</header><text>In collaboration with the Program Management Office, the
				Director shall establish a process for agencies to conduct authorized transfer
				of data, including bulk transfers, to and from the Federal Docket Management
				System.</text>
							</paragraph><paragraph id="id13643BB3D4E14393A6BB5F431BD0376E"><enum>(5)</enum><header>Public review
				and comment</header><text>Before taking effect, the Director and the Program
				Management Office shall make the standards and guidelines developed under this
				subsection available to the public for review and comment.</text>
							</paragraph><paragraph id="idF22D1DA0392D4AF9841D0618100DA011"><enum>(6)</enum><header>Review and
				update</header><text>The Director and the Program Management Office shall
				review the standards and guidelines developed under this subsection at regular
				intervals and revise those standards and guidelines as necessary.</text>
							</paragraph><paragraph id="IDfec1f2b8ae53446cbd63c07cdeb062ca"><enum>(7)</enum><header>Independent
				regulatory commissions</header><text>Each independent regulatory commission
				that has not migrated to the Federal Docket Management System shall—</text>
								<subparagraph id="idFD66EADEC4E04BEAAF0BF54C4526FBCB"><enum>(A)</enum><text>take any
				necessary action to establish interoperability with the Federal Docket
				Management System; and</text>
								</subparagraph><subparagraph id="idC9CB9F6196094EA7A64BF31BC263ED21"><enum>(B)</enum><text>ensure that
				rulemaking materials of that independent regulatory commission can be located
				by users of the system.</text>
								</subparagraph></paragraph></subsection><subsection id="IDb807d3f1ecca4f10943748833b2618c0"><enum>(h)</enum><header>E-Rulemaking
				practice and innovation</header>
							<paragraph id="IDb138796de33e4daab7ef2b76fd5d3917"><enum>(1)</enum><header>Assessments</header><text>The
				Director shall provide for periodic, multi-method usability assessments by
				users of the systems architecture established under subsection (g).</text>
							</paragraph><paragraph id="IDb1157118cfbb474fa56c80d2ecead309"><enum>(2)</enum><header>Practices</header><text>After
				consulting with public stakeholders and the Public E-Rulemaking Advisory
				Committee, the Interagency E-Rulemaking Committee shall make recommendations to
				the Administrator of the Office of Information and Regulatory Affairs regarding
				current and emerging practices that—</text>
								<subparagraph id="ID97993a704af74f9f853f72122e83710a"><enum>(A)</enum><text>enhance online
				accessibility and manageability of rulemaking information;</text>
								</subparagraph><subparagraph id="IDf63ecddeeac0470abeb75f7732526395"><enum>(B)</enum><text>promote informed
				and effective public participation; and</text>
								</subparagraph><subparagraph id="IDa055ba050b4b444fa240dec4e4d8d64f"><enum>(C)</enum><text>harness
				technology to improve rule formation and implementation.</text>
								</subparagraph></paragraph><paragraph id="ID117f3e1d057b409abaf3b4c92baea279"><enum>(3)</enum><header>Office of
				Management and Budget</header><text>Based on the recommendations under
				paragraph (2), the Director shall—</text>
								<subparagraph id="IDdc3d22d053bb4c25af24820308e9e4fd"><enum>(A)</enum><text>identify clear
				performance objectives and timelines for action by the agency to ensure that
				all rulemaking and docket materials are available electronically;</text>
								</subparagraph><subparagraph id="IDb5563be949c040f3a805fd1cd1ed9132"><enum>(B)</enum><text>provide to the
				Public E-Rulemaking Advisory Committee any records or data on the management,
				functionality, and performance of the systems architecture and all component
				parts developed under subsection (g), as necessary for forming recommendations
				under subsection (f); and</text>
								</subparagraph><subparagraph id="IDb9233f9e81ea4b65acd1b86d524ec4b0"><enum>(C)</enum><text>identify
				innovative projects that are developed under the standards, protocol, and
				guidelines under subsection (g).</text>
								</subparagraph></paragraph></subsection><subsection id="IDf78bdddf18d4419dad30ea4d0842f21b"><enum>(i)</enum><header>Reporting</header>
							<paragraph id="IDb117d0c44dd240a791db39e0ece48c2f"><enum>(1)</enum><header>In
				general</header><text>Not later than March 1 of each year, the Director, in
				consultation with the Program Management Office, shall submit an e-rulemaking
				status report to—</text>
								<subparagraph id="idC6028B98684C457784B08AF98C7D3714"><enum>(A)</enum><text>the Committee on
				Homeland Security and Governmental Affairs of the Senate; and</text>
								</subparagraph><subparagraph id="idF2E4FD9B547843EBBACD3A55890D98EA"><enum>(B)</enum><text>the Committee on
				Oversight and Government Reform of the House of Representatives.</text>
								</subparagraph></paragraph><paragraph id="ID95656cd74a9a45c28dab3385518bcd74"><enum>(2)</enum><header>Inclusion in
				status report</header><text>An e-rulemaking status report may be submitted as
				part of the annual E-Government status report established under section 3606 of
				title 44, United States Code.</text>
							</paragraph><paragraph id="ID89952bd3e32547cb9f247c1690e25939"><enum>(3)</enum><header>Contents</header><text>Each
				report under this subsection shall contain at a minimum—</text>
								<subparagraph id="IDa835a24114814b93be31811676ece887"><enum>(A)</enum><text>the progress of
				the e-rulemaking initiative;</text>
								</subparagraph><subparagraph id="ID010f3e9d9e604a4f874d47b7e5b8eb1f"><enum>(B)</enum><text>performance
				measurements regarding achievement of system and program goals; and</text>
								</subparagraph><subparagraph id="id5B870ABE915B4CFFBB3C28B714C9D7FD"><enum>(C)</enum><text>a summary of
				public participation and collaboration efforts.</text>
								</subparagraph></paragraph><paragraph id="IDa044e59cbae847279995538f4665f4a0"><enum>(4)</enum><header>Statement of
				progress</header><text>All agencies, including independent regulatory
				commissions, shall submit to the Director, for inclusion in the annual report
				under this subsection, a statement describing the agency progress in achieving
				compliance with the requirements of this Act.</text>
							</paragraph></subsection><subsection id="ID88439aaf485e4b6e84388bfcd63eec4f"><enum>(j)</enum><header>Authorization
				of appropriations</header>
							<paragraph id="IDe7e69f42afdb4c51822f5658386c41b6"><enum>(1)</enum><header>Maintenance,
				improvement, and promotion</header><text>There are authorized to be
				appropriated to $10,000,000 for the maintenance, improvement, and promotion of
				the e-rulemaking system in accordance with this section for each of fiscal
				years 2011 through 2015, and such sums as are necessary for subsequent fiscal
				years.</text>
							</paragraph><paragraph id="IDf21a5de679e8433abb1aeb3c8bc56458"><enum>(2)</enum><header>Innovations to
				the systems architecture</header><text>There are authorized to be appropriated
				$1,000,000 for projects identified under subsection (h)(3)(C) for each of
				fiscal years 2011 through 2015, and such sums as are necessary for subsequent
				fiscal
				years.</text>
