		<official-title>To prohibit trafficking in counterfeit military goods or
		  services.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Combating Military Counterfeits
			 Act of 2010</short-title></quote>.</text>
		</section><section id="id527DA44E4E734095A48BC73B8B79691D"><enum>2.</enum><header>Trafficking in
			 counterfeit military goods or services</header>
			<subsection id="idB57F53551E6A4DFAAF0C0718F6D3886B"><enum>(a)</enum><header>Trafficking in
			 counterfeit military goods or services</header><text>Section 2320 of title 18,
			 United States Code, is amended—</text>
				<paragraph id="id64678D2FD27D4420A6719B5FB16FD162"><enum>(1)</enum><text>in subsection
			 (a), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8996B9258A3342D9B884C3DD767D05CC" style="OLC">
						<paragraph id="id118330281C644483A1D5E256DB063EA3"><enum>(3)</enum><header>Military goods
				or services</header>
							<subparagraph id="id216E31463A204D42B18FA9A393E570E1"><enum>(A)</enum><header>In
				general</header><text>A person who commits an offense under paragraph (1) with
				knowledge that the good or service described in paragraph (1) is identified as
				meeting military standards or is intended for use in a military or national
				security application shall be punished in accordance with subparagraph
				(B).</text>
							</subparagraph><subparagraph id="id7F96B2D14D6641068FB9249ACBF41E69"><enum>(B)</enum><header>Penalties</header>
								<clause id="id073FC61D427246139AA53279C5E54FBE"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) shall be fined
				not more than $5,000,000, imprisoned for not more than 20 years, or
				both.</text>
								</clause><clause id="id054325A7F4004C6C958542A144A083CA"><enum>(ii)</enum><header>Person other
				than an individual</header><text>A person other than an individual that commits
				an offense described in subparagraph (A) shall be fined not more than
				$15,000,000.</text>
								</clause></subparagraph><subparagraph id="idF1F78074F65F4731A91DAD2026C55F1E"><enum>(C)</enum><header>Subsequent
				offenses</header>
								<clause id="id6ED334B2323740A3AA900446F67FE69E"><enum>(i)</enum><header>Individual</header><text>An
				individual who commits an offense described in subparagraph (A) after the
				individual is convicted of an offense under subparagraph (A) shall be fined not
				more than $15,000,000, imprisoned not more than 30 years, or both.</text>
								</clause><clause id="id416CBE936C8646129E8946A9132A6CC2"><enum>(ii)</enum><header>Person other
				than an individual</header><text>A person other than an individual that commits
				an offense described in subparagraph (A) after the person is convicted of an
				offense under subparagraph (A) shall be fined not more than
				$30,000,000.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id98D6328690874C5B9D14C60926EA7E33"><enum>(2)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="idFD8F1E33081048AB855F7872762B43FA"><enum>(A)</enum><text>in paragraph (1),
			 by striking the period at the end and inserting a semicolon;</text>
					</subparagraph><subparagraph id="id4D9EDBFF567249E4B18A62B09641405B"><enum>(B)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id7BF2ED866CC84E8F9508B005B06AB754"><enum>(C)</enum><text>in paragraph (4),
			 by striking the period at the end and a semicolon; and</text>
					</subparagraph><subparagraph id="idDF51C178EE2C44C49BA9CE140B8A5BA1"><enum>(D)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idF2F0A62E969B4B76805CEAD7D3901096" style="OLC">
							<paragraph id="id3540158394D74E44A0AB3634C428B93C"><enum>(5)</enum><text>the term
				<term>identified as meeting military standards</term> relating to a good or
				service—</text>
								<subparagraph id="idCA49C333736849ACB5C701E9C77BBC35"><enum>(A)</enum><text>means the good or
				service—</text>
									<clause id="idCB5D1D93AFB14EB8A1102467F2DEAC6B"><enum>(i)</enum><text>bears a label,
				tag, stamp, product code, phrase, or emblem of any kind that indicates that the
				good or service meets a standard, requirement, or specification issued by the
				Department of Defense, an Armed Force, or a reserve component;</text>
									</clause><clause id="id8342B3BDD5C148C8B7F3CF4F8DF7BDF2"><enum>(ii)</enum><text>is packaged in a
				wrapper, container, box, case, or packaging of any type or nature which bears a
				label, tag, stamp, product code, phrase, or emblem of any kind which indicates
				that the good or services meets a standard, requirement, or specification
				issued by the Department of Defense, an Armed Force, or a reserve component;
				or</text>
									</clause><clause id="ID9897a419879a4d03afee26e6b2a0c1ee"><enum>(iii)</enum><text>is accompanied
				by or marketed with a certificate or other oral or written representation that
				the good or service meets a standard, requirement, or specification issued by
				the Department of Defense, an Armed Force, or a reserve component; and</text>
									</clause></subparagraph><subparagraph id="id1D07BB74F64E4DB8AED66AD78EAE298B"><enum>(B)</enum><text>shall not apply
				to the identification of a good or service in a manner that is unlikely to
				cause confusion, to cause mistake, or to deceive; and</text>
								</subparagraph></paragraph><paragraph id="id2A13BB5EBB4C4B75B565942B909D10D2"><enum>(6)</enum><text>the term
				<term>use in a military or national security application</term> means the use
				of a good or service, independently, in conjunction with, or as a component of
				another good or service—</text>
								<subparagraph id="id9AE95DB06E254741BD40271F8F3EFD83"><enum>(A)</enum><text>during the
				performance of the official duties of the Armed Forces of the United States or
				the reserve components of the Armed Forces; or</text>
								</subparagraph><subparagraph id="idEA8874CB75B54687B0CC0A4F96BE39CB"><enum>(B)</enum><text>by or for the
				United States in furtherance of the national defense or national
				security.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="id9D215E4BD7BF4FB5B1353DECD5682B8E"><enum>(b)</enum><header>Sentencing
			 guidelines</header>
				<paragraph id="id842AAB7241954F27A76658410A25A7CC"><enum>(1)</enum><header>Directive</header><text>Not
			 later than 180 days after the date of enactment of this Act, pursuant to is
			 authority under section 994 of title 28, United States Code, and in accordance
			 with this subsection, the United States Sentencing Commission shall review and
			 amend the Federal sentencing guidelines and policy statements application to
			 persons convicted of an offense under section 2320(a) of title 18, United
			 States Code, to reflect the intent of Congress that penalties for such offenses
			 be increased in comparison to those provided on the day before the date of
			 enactment of this Act under the guidelines and policy statements.</text>
				</paragraph><paragraph id="idD278F05EC39A4A6FAF4A3C05EE948B6C"><enum>(2)</enum><header>Requirements</header><text>In
			 amending the Federal Sentencing Guidelines and policy statements under
			 paragraph (1), the United States Sentencing Commission shall—</text>
					<subparagraph id="idC589ED1DC6FC449488CC410B5AFB8EA4"><enum>(A)</enum><text>ensure that the
			 guidelines and policy statements, including section 2B5.3 of the Federal
			 Sentencing Guidelines (and any successor thereto), reflect—</text>
						<clause id="idCBD508806C02463D82A900C01C53F694"><enum>(i)</enum><text>the
			 serious nature of the offenses described in section 2320(a) of title 18, United
			 States Code;</text>
						</clause><clause id="id79A1E0FB73FE48FD983A51B35698AF3B"><enum>(ii)</enum><text>the need for an
			 effective deterrent and appropriate punishment to prevent offenses under
			 section 2320(a) of title 18, United States Code; and</text>
						</clause><clause id="id664B73A042A8477484985EB44EA6CBC5"><enum>(iii)</enum><text>the
			 effectiveness of incarceration in furthering the objectives described in
			 clauses (i) and (ii);</text>
						</clause></subparagraph><subparagraph id="id0848CC43D9744A49A948CA2CEA5D6DA0"><enum>(B)</enum><text>consider the
			 extent to which the guidelines appropriately account for the risk, even if
			 attenuated or unknown to the offender, to members of the Armed Forces of the
			 United States, military readiness, and national security resulting from an
			 offense committed under section 2320(a) of title 18, United States Code,
			 including in instances involving a limited value or quantity of goods or
			 services;</text>
					</subparagraph><subparagraph id="id66C49AB276ED47FB9111C2E060B4C430"><enum>(C)</enum><text>ensure reasonable
			 consistency with other relevant directives and guidelines and Federal
			 statutes;</text>
					</subparagraph><subparagraph id="id894B56D46A0147E99B7B7799772CFCD3"><enum>(D)</enum><text>make any
			 necessary conforming changes to the guidelines; and</text>
					</subparagraph><subparagraph id="idCA6B632087A14859B71789715C386206"><enum>(E)</enum><text>ensure that the
			 guidelines relating to offenses under section 2320(a) of title 18, United
			 States Code, adequately meet the purposes of sentencing, as described in
			 section 3553(a)(2) of title 18, United States Code.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
