		<official-title>To establish a competitive grant program in the
		  Department of Energy to provide grants to States and units of local government
		  to carry out clean energy and carbon reduction measures, to close big oil
		  company tax loopholes to pay for the competitive grant program and reduce the
		  deficit, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>States as Energy Leaders for the
			 Future Act</short-title></quote> or <quote>SELF Act</quote>.</text>
		</section><section id="idB854A6CC12D345A580F00A8C14969875"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id74D1399E1B924E6ABE0677BC0A2AAFBC"><enum>(1)</enum><header>Eligible
			 entity</header><text>The term <quote>eligible entity</quote> means an entity
			 described in section 3(b).</text>
			</paragraph><paragraph id="idE2C2FBB17A8041668116D0CA6DEC7FDB"><enum>(2)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Energy.</text>
			</paragraph></section><section id="id1F4C2D8257C64D48B904B2855BBE222D"><enum>3.</enum><header>Clean energy
			 grant program</header>
			<subsection id="idEEEFFB62C2374DF9B7F872116E8507C3"><enum>(a)</enum><header>In
			 general</header><text>There is established in the Department of Energy a
			 program to provide grants to eligible entities, on a competitive basis, to
			 develop and carry out clean energy and carbon reduction measures, such
			 as—</text>
				<paragraph id="id2A5E7ABBEF834FB39A2DF9FD085B9E49"><enum>(1)</enum><text>renewable
			 electricity standards;</text>
				</paragraph><paragraph id="id4CC8C37E933946869ACF04F71078DBEB"><enum>(2)</enum><text>regional or
			 statewide climate action plans;</text>
				</paragraph><paragraph id="id0C24915370364D50851B44427B89E1CE"><enum>(3)</enum><text>the use of
			 hybrid, electric, compressed natural gas, or fuel cell vehicles in State or
			 local fleets;</text>
				</paragraph><paragraph id="id1B5EB6E9B4DA48688E3551D9871945DA"><enum>(4)</enum><text>measures to
			 increase the percentage of public buildings of the eligible entity that are
			 certified with respect to standards for energy efficiency;</text>
				</paragraph><paragraph id="idC3F6956BF21847D2B09C5CDBAF2B2442"><enum>(5)</enum><text>participation in
			 a regional greenhouse gas reduction program;</text>
				</paragraph><paragraph id="id8A5BC72909764BA1923C3F8C38FC0CA1"><enum>(6)</enum><text>facilitation of
			 on-bill financing for energy efficiency improvements for residences and
			 business served by rural coops;</text>
				</paragraph><paragraph id="idBB34D9A506B6474D8980AEE55CA6606D"><enum>(7)</enum><text>provision of
			 State tax incentives for the manufacture or installation of clean energy
			 components or energy efficiency upgrades;</text>
				</paragraph><paragraph id="IDf4dc64e86a904d34a6132868028a3d1c"><enum>(8)</enum><text>provision of
			 innovative financing mechanisms to private sector entities to encourage the
			 deployment of clean energy technologies;</text>
				</paragraph><paragraph id="IDc5484a0431cf4153b621a9cbb9b809e2"><enum>(9)</enum><text>implementation of
			 best management practices for the public utility commission of an eligible
			 entity;</text>
				</paragraph><paragraph id="ID88d0ed2a204e4fff8c96bf600c629f59"><enum>(10)</enum><text>improvement and
			 updating of grid technology; and</text>
				</paragraph><paragraph id="IDea5424b6e84949c190f52d54507c6009"><enum>(11)</enum><text>implementation
			 of carbon efficiency standards.</text>
				</paragraph></subsection><subsection id="id579917AAB368477297C65D55B859F859"><enum>(b)</enum><header>Eligible
			 entities</header><text>To be eligible to receive a grant under this section, a
			 State or unit of local government, or a regional consortium comprised of States
			 or units of local governments, in partnership with private sector and
			 nongovernmental organization partners, shall—</text>
				<paragraph id="id128C1684BF9944A49E5A4901645A86FF"><enum>(1)</enum><text>meet any
			 requirements established by the Secretary under subsection (e); and</text>
				</paragraph><paragraph id="id142C7C6450614E8E9B1941FD00708D5C"><enum>(2)</enum><text>submit an
			 application to the Secretary at such time, in such form, and containing such
			 information as the Secretary may require.</text>
				</paragraph></subsection><subsection id="id7080B65E71E94CF6A3B11FAD751F1CCA"><enum>(c)</enum><header>Award</header><text>The
			 Secretary shall determine which eligible entities shall receive grants and the
			 amount of the grants provided based on—</text>
				<paragraph id="id95CADB0186F2465895A3422FECCCC615"><enum>(1)</enum><text>the information
			 provided in an application submitted under subsection (b)(2); and</text>
				</paragraph><paragraph id="id02FFD8A951744ACF8E68F920DC4F5133"><enum>(2)</enum><text>any criteria for
			 reviewing and ranking applications developed by the Secretary by regulation
			 under subsection (e).</text>
				</paragraph></subsection><subsection id="id258D4437F6114A4084EDCB6DB7E3CEC2"><enum>(d)</enum><header>Use of
			 funds</header><text>Grant funds provided under this section shall only be used
			 for eligible uses specified by the Secretary by regulation under subsection
			 (e).</text>
			</subsection><subsection id="id3A67E0C23F234451BA3D3A0BFEAA293A"><enum>(e)</enum><header>Regulations</header>
				<paragraph id="id134C4ABD5D254709B3D11716C71A3206"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall issue regulations that establish criteria for
			 grants under this section, including specifying the types of measures that are
			 eligible for grants, establishing application criteria, and developing a point
			 system to assist the Secretary in reviewing and ranking grant
			 applications.</text>
				</paragraph><paragraph id="id88F83A4F2253482D9080E358422FF32A"><enum>(2)</enum><header>Considerations</header><text>In
			 developing the regulations under paragraph (1), the Secretary shall take into
			 account—</text>
					<subparagraph id="id9B5C958405DB40D887A3DACEFFE69BCC"><enum>(A)</enum><text>regional
			 disparities in the ways in which energy is produced and used; and</text>
					</subparagraph><subparagraph id="id847CB10871A54F65AFD54DA4801BDC58"><enum>(B)</enum><text>the clean energy
			 resource potential of the measures.</text>
					</subparagraph></paragraph></subsection><subsection id="ID783b7a2a13d4425f955317947f1e1619"><enum>(f)</enum><header>Explanation</header><text>As
			 soon as practicable after the date of enactment of this Act, the Secretary
			 shall publish in the Federal Register an explanation of the manner by which
			 grants awarded under subsection (c) would ensure an objective evaluation based
			 on the criteria regulations promulgated under subsection (e)(1).</text>
			</subsection></section><section id="idC948DDBCEE0741F68665767104FA837A"><enum>4.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary for fiscal year 2011 to carry
			 out this Act $5,000,000,000, to remain available until expended.</text>
		</section><section commented="no" id="id9537DC8D40554CB9B520B7773D1C4B70"><enum>5.</enum><header>Cost offset for
			 clean energy grant program, and deficit reduction, resulting from denial of
			 deduction for major integrated oil companies for income attributable to
			 domestic production of oil, gas, or primary products thereof</header>
			<subsection commented="no" id="ID33a77a4c1e7c4afca0f51789de5772ab"><enum>(a)</enum><header>In
			 general</header><text>Subparagraph (B) of section 199(c)(4) of the Internal
			 Revenue Code of 1986 is amended by striking <quote>or</quote> at the end of
			 clause (ii), by striking the period at the end of clause (iii) and inserting
			 <quote>, or</quote>, and by inserting after clause (iii) the following new
			 clause:</text>
				<quoted-block display-inline="no-display-inline" id="idB3EFDC953EE841BE80EEE1B951715DD8" style="OLC">
					<clause commented="no" id="ID63ad82cd1da74098919033784eef9154"><enum>(iv)</enum><text>in the case of a
				taxpayer which is a major integrated oil company (as defined in section
				167(h)(5)(B)), oil related qualified production activities (within the meaning
				of subsection
				(d)(9)(B)).</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" id="ID250704365c934f7abad63dfeab640fb3"><enum>(b)</enum><header>Conforming
			 amendment</header><text>Section 199(d)(9)(A) of the Internal Revenue Code of
			 1986 is amended by inserting <quote>(other than a major integrated oil company
			 (as defined in section 167(h)(5)(B))</quote> after
			 <quote>taxpayer</quote>.</text>
			</subsection><subsection commented="no" id="ID95a0a2c49604481e9bc983b8a86b42fc"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after December 31, 2010.</text>
