		<section id="H3A388FBC07C041958B4F4F5A7366D335" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Accountability for Defense Contractors
			 Act</short-title></quote>.</text>
		</section><section id="H62489F841B0644D6ACD6A9A472DE74CA"><enum>2.</enum><header>Restoring
			 congressional notification of indemnification</header><text display-inline="no-display-inline">Public Law 85–804 is amended by adding at
			 the end the following new section:</text>
			<quoted-block id="H8A1401EF8EA8412E841CE45B47D09703" style="OLC">
				<section id="H6687E3CB56D34D5781861E70C93C9D42"><enum>5.</enum><header>Reports to
				Congress</header>
					<subsection id="H0A6306CED39645D4ADCE4BA0100DDE94"><enum>(a)</enum><header>Requirement</header><text>If
				the Department of Defense takes any action under authority of this Act during
				any year, the Secretary of Defense shall, by March 15 of the succeeding year,
				submit to Congress a report on all such actions taken by the Department during
				that preceding year. With respect to actions that involve actual or potential
				cost to the United States in excess of $1,000,000, the report shall—</text>
						<paragraph id="H019AF359600442E58D4CD5E1A35DFDA9"><enum>(1)</enum><text>name the
				contractor;</text>
						</paragraph><paragraph id="HE9DE821A596E4AA69037436AA3324C84"><enum>(2)</enum><text>state the actual
				cost or estimated potential cost involved;</text>
						</paragraph><paragraph id="H536AA4DD05504D079A22F8A6C6AA03AC"><enum>(3)</enum><text>describe the
				property or services involved; and</text>
						</paragraph><paragraph id="H8F18F82B9C1F418E87A279C5B6F24D4A"><enum>(4)</enum><text>state further the
				circumstances justifying the action taken.</text>
						</paragraph></subsection><subsection id="HF9E645FAC4E34424A1297D7F03935B51"><enum>(b)</enum><header>Omissions</header><text>There
				may be omitted in a report under subsection (a) any information the disclosure
				of which would be detrimental to the national security, if the Secretary of
				Defense provides justification of such omission to the relevant congressional
				committees.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H66FDBC41DDAE4C87948E014E4275359F"><enum>3.</enum><header>Prohibition of
			 indemnification for contractors in cases involving gross negligence, willful
			 misconduct, or lack of good faith by contractors</header><text display-inline="no-display-inline">Public Law 85–804, as amended by section 2,
			 is further amended by adding at the end the following new section:</text>

				<section id="H0371D7B9D3C645838B845558B14E9FA1"><enum>6.</enum><header>Prohibition of
				indemnification in certain cases</header>
					<subsection id="H93BDCE4592AD4A17B1E532FA0AEE1FC9"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">A contractor of the
				Department of Defense shall not be indemnified for—</text>
						<paragraph id="H7E817E402F414541886A37CBABE3753A"><enum>(1)</enum><text>government claims
				against the contractor (other than those arising through subrogation);</text>
						</paragraph><paragraph id="HE73549CF52094CB7A2C028CD59A9A034"><enum>(2)</enum><text>a claim, loss, or
				damage caused by gross negligence, willful misconduct, or lack of good faith on
				the part of any of the contractor’s principal officials (as defined by part
				52.250–1 of the Federal Acquisition Regulation); or</text>
						</paragraph><paragraph id="HBB5297F52F5A477B9CE9A1D616320780"><enum>(3)</enum><text display-inline="yes-display-inline">a claim, loss, or damage resulting from an
				unusually hazardous or nuclear risk not specified in the terms of the contract
				and discovered on the site where the contract is performed, or that reasonably
				should have been discovered on the site.</text>
						</paragraph></subsection><subsection id="H4E4049953AC2438D8B8E876489000178"><enum>(b)</enum><header>Notification</header><text>In
				the case of an unusually hazardous or nuclear risk referred to in subsection
				(a)(3), the contractor shall immediately notify the contracting officer of such
				risk upon discovery or when discovery reasonably should have been
				made.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H6500A636BD3F47C3A705AF87A82996DB"><enum>4.</enum><header>Congressional
			 notification and the loss of indemnification in other cases</header>
			<subsection id="H5756665966A6458D8E544968BD17001A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">A contract entered
			 into by the Department of Defense under authority that provides for
			 indemnification not authorized by the provisions of law listed in subsection
			 (b) may provide for indemnification of the contractor as the Secretary of
			 Defense determines to be necessary only if—</text>
				<paragraph id="H4BFC815B776E4CD8B58BCCC51379C7E9"><enum>(1)</enum><text>the contract
			 complies with the requirements in section 5 of Public Law 85–804 (as added by
			 section 2), relating to notice to Congress; and</text>
				</paragraph><paragraph id="H5EE26FCF8621472C9F5BF9D02E1E5F0E"><enum>(2)</enum><text>the contract
			 complies with the requirements in section 6 of Public Law 85–804 (as added by
			 section 3), relating to a prohibition on indemnification for certain claims and
			 a requirement for notification.</text>
				</paragraph></subsection><subsection id="H47BB04C1B63347499122683AEC3260C2"><enum>(b)</enum><header>Provisions of
			 law listed</header><text>The provisions of laws listed in this subsection are
			 as follows:</text>
				<paragraph id="HC8FEF063C1AC4B55814257636A9915BC"><enum>(1)</enum><text>Section 2354 of
			 title 10, United States Code.</text>
				</paragraph><paragraph id="H1E6CEF976EEF4A49BAF2214C4DE10694"><enum>(2)</enum><text>The Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9601
			 et seq.).</text>
