		<official-title>To reduce preterm labor and delivery and the risk of
		  pregnancy-related deaths and complications due to pregnancy, and to reduce
		  infant mortality caused by prematurity.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Prematurity Research Expansion and
			 Education for Mothers who deliver Infants Early Act</short-title></quote> or
			 the <quote><short-title>PREEMIE
			 Act</short-title></quote>.</text>
		</section><section id="id689B0BD4B5054FAF8DCB3B2C38E73BDD"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">It is the purpose of this Act to—</text>
			<paragraph id="IDebe64150534d47a3aceb977103982701"><enum>(1)</enum><text>reduce preterm
			 birth, its associated disabilities, and deaths of babies born preterm;</text>
			</paragraph><paragraph id="IDa1a57cc04be54655a9711d68a4bba2eb"><enum>(2)</enum><text>expand research
			 into the causes of preterm birth; and</text>
			</paragraph><paragraph id="ID236d1abd2b754c6495dbf19c7b48f45b"><enum>(3)</enum><text>promote the
			 development, availability, and use of evidence-based standards of care for
			 pregnant women at risk of preterm labor or other serious pregnancy-related
			 complications and for infants born preterm.</text>
			</paragraph></section><section id="ID26f816394bd248039077b538709eba89"><enum>3.</enum><header>Research and
			 activities at the National Institutes of Health</header><text display-inline="no-display-inline">Part B of title IV of the Public Health
			 Service Act (42 U.S.C. 284 et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id0B5A800F26C144FFAAA1A25545C79F51" style="OLC">
				<section id="ID1062ccdf3c2d44998193e13cb0b88435"><enum>409K.</enum><header>Expansion and
				coordination of research relating to preterm labor and delivery and infant
				mortality</header>
					<subsection id="IDd1f7428bad3343d593c0ef5f928f15dc"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through the Director of NIH, shall
				expand, intensify, and coordinate the activities of the National Institutes of
				Health with respect to research on the causes of preterm labor and delivery,
				tools to detect, prevent, or reduce prevalence of preterm labor and delivery,
				and the care and treatment of preterm infants. Research supported under this
				section shall integrate clinical, public health, basic, and behavioral and
				social science disciplines together with bioinformatics, engineering,
				mathematical, and computer sciences to address the causes of preterm labor and
				delivery collaboratively.</text>
					</subsection><subsection id="ID9ee8a4938fe841b9bb71e35609d4a06e"><enum>(b)</enum><header>Clinical
				program</header><text>There shall be established within the National Institutes
				of Health a multi-center clinical program (that shall be initially established
				utilizing existing networks) designed to—</text>
						<paragraph id="ID98d899565254459e8ade47bd6289d3bc"><enum>(1)</enum><text>investigate
				problems in clinical obstetrics, particularly those related to prevention of
				low birth weight, prematurity, and medical problems of pregnancy;</text>
						</paragraph><paragraph id="ID311ae79634b94bc4bbbb654054eb0ba3"><enum>(2)</enum><text>improve the care
				and outcomes of neonates, especially very-low-birth weight infants; and</text>
						</paragraph><paragraph id="ID4555211fb2924a3f9b5f680f3060f4b4"><enum>(3)</enum><text>enhance the
				understanding of DNA and proteins as they relate to the underlying processes
				that lead to preterm birth to aid in formulating more effective interventions
				to prevent preterm birth.</text>
						</paragraph></subsection><subsection id="idA1A16415B8484E36A714B70C2874BF41"><enum>(c)</enum><header>Trans-Disciplinary
				centers for preterm birth research</header>
						<paragraph id="id747965E960004D69ABF5A6ECDF41DFD3"><enum>(1)</enum><header>In
				general</header><text>The Director of NIH shall award grants and contracts to
				public and nonprofit private entities to pay all or part of the cost of
				planning, establishing, improving and providing basic operating support for
				trans-disciplinary research centers for prematurity.</text>
						</paragraph><paragraph id="idE7972DB9D77B4FF295490634C2224EDC"><enum>(2)</enum><header>Eligibility</header><text>To
				be eligible to receive a grant or contract under paragraph (1), an entity shall
				submit to the Director an application at such time, in such manner, and
				containing such information as the Director may require, including, if
				appropriate, an assurance that the entity will carry out programs related to
				prematurity research that include neonatal and maternal-fetal medicine
				multi-center research networks with a focus on clinical trials.</text>
						</paragraph><paragraph id="idF8231171486143EE8CC220F3B6B994B6"><enum>(3)</enum><header>Focus</header><text>Activities
				carried out under this subsection shall focus primarily on basic research and
				progress logically over time to include the need for translational,
				interventional, and clinical research.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idACA251F1C37A4BA386CAA86774AAE091"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section, such sums as may be
				necessary for each of fiscal years 2011 through 2016, of which—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idEE2541F63D63401E840C6377C01992B9"><enum>(1)</enum><text display-inline="yes-display-inline">for fiscal year 2011, such sums as may be
				necessary shall be made available for planning grants under subsection (c);
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id316FD1CDAD5E4D08B41AD061BB2BCAC0"><enum>(2)</enum><text display-inline="yes-display-inline">for each of fiscal years 2012 through 2016,
				such sums as may be necessary for each such fiscal year for establishing
				centers under such subsection.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB228A0760D104DAAACCB5CD0109C3EC4"><enum>(e)</enum><header>Report</header><text display-inline="yes-display-inline">The Director of NIH shall include in the
				report under section 402A(c) information on the activities of the
				trans-disciplinary research centers for prematurity under subsection
				(c).</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id1B942EB5EA8047DFBC53347DE7B45F58"><enum>4.</enum><header>Research and
			 activities at the Centers for Disease Control and Prevention</header>
			<subsection id="id9274144749D14AF0A68395C29D2B2C3F"><enum>(a)</enum><header>Epidemiological
			 studies</header><text>Section 3 of the Prematurity Research Expansion and
			 Education for Mothers who deliver Infants Early Act (42 U.S.C. 247b–4f) is
			 amended by striking subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id631730666BAC4C2F967838684447B28B" style="OLC">
					<subsection id="idC3F821674D8A4B329EEF8173E27CD0EF"><enum>(b)</enum><header>Studies and
				activities on the relationship between prematurity and birth defects</header>
						<paragraph id="idC5EE801A13594FD980871E2639361DD3"><enum>(1)</enum><header>In
				general</header><text>The Secretary of Health and Human Services, acting
				through the Director of the Centers for Disease Control and Prevention, shall,
				subject to the availability of appropriations—</text>
							<subparagraph id="id2C7C79F403FD47DEA56CFB41A7DCF2A1"><enum>(A)</enum><text>conduct ongoing
				epidemiological studies on the clinical, biological, social, environmental,
				genetic and behavioral factors relating to prematurity;</text>
							</subparagraph><subparagraph id="idFBE5F5EBAAD14EA39BD8343CDBAB938E"><enum>(B)</enum><text>conduct
				activities to improve national data to facilitate tracking the burden of
				preterm birth;</text>
							</subparagraph><subparagraph id="id8A622ED1C48C46D292B6ACDC8A0183D0"><enum>(C)</enum><text>develop,
				implement, and evaluate novel methods for prevention to better understand the
				growing problem of late preterm birth;</text>
							</subparagraph><subparagraph id="id89977DF77BD14C6E9129F16A56E09E7C"><enum>(D)</enum><text>conduct etiologic
				and epidemiologic studies of preterm birth;</text>
							</subparagraph><subparagraph id="id603B8314F76145BE873E07CF1DAF15C6"><enum>(E)</enum><text>expand research
				on obesity, racial, and ethnic disparities as they relate to preterm birth;
				and</text>
							</subparagraph><subparagraph id="idDDDD2A8505514F5282C29E5043096534"><enum>(F)</enum><text>conduct ongoing
				epidemiological studies on the effectiveness of community based
				interventions.</text>
							</subparagraph></paragraph><paragraph id="idEB59F112B22C477FA351C768D91F0FCE"><enum>(2)</enum><header>Report</header><text>Not
				later than 2 years after the date of enactment of this Act, and every 2 years
				thereafter, the Secretary of Health and Human Services, acting through the
				Director of the Centers for Disease Control and Prevention, shall submit to the
				appropriate committees of Congress reports concerning the progress and any
				results of studies conducted under paragraph
				(1).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id0CC960D990C94083B4A03C540DC4BD52"><enum>(b)</enum><header>Reauthorization</header><text>Section
			 3(e) of the Prematurity Research Expansion and Education for Mothers who
			 deliver Infants Early Act (42 U.S.C. 247b–4f(e)) is amended by striking
			 <quote>$5,000,000</quote> and all that follows through <quote>2011</quote> and
			 inserting the following: <quote>such sums as may be necessary for each of
			 fiscal years 2012 through 2016</quote>.</text>
			</subsection></section><section id="id5F2117B2350B4F37ABD61C20E82BE98C"><enum>5.</enum><header>Research and
			 activities at the Health Resources and Services Administration</header>
			<subsection id="id7A6FB2F86969431CABD095E338EE65E2"><enum>(a)</enum><header>Telemedicine
			 demonstration project on high risk pregnancies</header><text>Section 330I of
			 the Public Health Service Act (42 U.S.C. 254c–14) is amended—</text>
				<paragraph id="idAD5BA18AE1794D6386E0EEB9ACCEAB22"><enum>(1)</enum><text>by redesignating
			 subsections (q) through (s) as subsections (r) through (t),
			 respectively;</text>
				</paragraph><paragraph id="id8140281C385045A4838F1D526520E89D"><enum>(2)</enum><text>by inserting
			 after subsection (p), the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC56E2C32738440C58A1B2AF040C33C55" style="OLC">
						<subsection id="id263E747093AF4175A897E95678E21CA2"><enum>(q)</enum><header>Telemedicine
				demonstration project on high risk pregnancies</header>
							<paragraph id="id2FFB2BDA5CCF44638CC874A714C1D485"><enum>(1)</enum><header>In
				general</header><text>The Director shall award grants under this section to
				eligible entities to establish demonstration projects for—</text>
								<subparagraph id="idD4474D7556D84841A33895A11DBEE631"><enum>(A)</enum><text>the provision of
				preconception, antepartum, intrapartum, and obstetric services to high risk
				women of child bearing age remotely by Ob/Gyn’s, nurse practitioners, certified
				nurse-midwives, certified midwives, or other health care providers using
				telehealth; and</text>
								</subparagraph><subparagraph id="idB7CF19C6A6C1484A82B31D14A920C6BF"><enum>(B)</enum><text>for the conduct
				of educational activities regarding risk factors for preterm birth.</text>
								</subparagraph></paragraph><paragraph id="id06EA22CE93494C97B89578A8DB311552"><enum>(2)</enum><header>Eligibility</header><text>To
				be eligible to receive a grant under paragraph (1), an entity shall submit an
				application to the Director at such time, in such manner, and containing such
				information as the Director my require.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idD4E25FF10E2A45DBAB7D0C96E8B874D2"><enum>(3)</enum><text>in subsection (t)
			 (as so redesignated)—</text>
					<subparagraph id="id402F51AD8F6144E1AD73BE58DAE2E764"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>and</quote> at the end;</text>
					</subparagraph><subparagraph id="id77FAC13AF4FE48FFB2F1708AF44EAB4F"><enum>(B)</enum><text>in paragraph (2),
			 by striking the period and inserting <quote>; and</quote>; and</text>
					</subparagraph><subparagraph id="id1BE7348F59264D95A18CBF57ADD65CFA"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idA5B111D938244CA7A67C9579FC3BB307" style="OLC">
							<paragraph id="id50BEDEBC5F8043B08E6AE77A26AB4C12"><enum>(3)</enum><text>for grants under
				subsection (q), such sums as may be necessary for each of fiscal years 2011
				through
				2015.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="idB4F77AD9A2CF4EEFA73558FFD079B904"><enum>(b)</enum><header>Public and
			 health care provider education</header><text>Section 399Q of the Public Health
			 Service Act (42 U.S.C. 280g–5) is amended—</text>
				<paragraph id="id177B497F59D9493D9E4D54FA197D3884"><enum>(1)</enum><text>in subsection
			 (b), by striking subparagraphs (A) through (F) and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id14E7EBF5887E4AADAE7B14100FEB841B" style="OLC">
						<subparagraph id="ID978381f2493a401eb11d8dcb35aa057c"><enum>(A)</enum><text>the core risk
				factors for preterm labor;</text>
						</subparagraph><subparagraph id="IDb8b9f72260e149ba89801af2634c274e"><enum>(B)</enum><text>medically
				indicated deliveries before 39 weeks;</text>
						</subparagraph><subparagraph id="ID04ef99eb031b4f09a579bc4f346be1ab"><enum>(C)</enum><text>outcomes for
				infants born before 39 weeks;</text>
						</subparagraph><subparagraph id="IDb9b904a2913e44a0bac400e84df5a4a3"><enum>(D)</enum><text>risk factors for
				preterm delivery;</text>
						</subparagraph><subparagraph id="IDab8c6e50eb7e48c7a625c32b2c71fd39"><enum>(E)</enum><text>the importance of
				preconception- and prenatal care;</text>
						</subparagraph><subparagraph id="ID5c3aba03a84a47178416d4190153bb90"><enum>(F)</enum><text>smoking cessation
				and weight maintenance;</text>
						</subparagraph><subparagraph id="ID1410b07a60214e5b9ffd046c2f3bacf6"><enum>(G)</enum><text>treatments and
				outcomes for babies born premature;</text>
						</subparagraph><subparagraph id="ID141f1ecfe9474c818ff75ee9d4edfa08"><enum>(H)</enum><text>the informational
				needs of families during the stay of an infant in a neonatal intensive care
				unit;</text>
						</subparagraph><subparagraph id="ID6e486448de0f4d8d974c5540920a6348"><enum>(I)</enum><text>preventable birth
				injuries;</text>
						</subparagraph><subparagraph id="IDd236d997db684d51937f80eee329d2ed"><enum>(J)</enum><text>oral health;
				and</text>
						</subparagraph><subparagraph id="id3990E0E768584802817430A6EDCDD9F9"><enum>(K)</enum><text>the use of
				progesterone;</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idFD5CEC3417754B199C0B32DF9067D90E"><enum>(2)</enum><text>in subsection
			 (c), by striking <quote>$5,000,000</quote> and all that follows through
			 <quote>2011</quote> and insert the following: <quote>such sums as may be
			 necessary for each of fiscal years 2011 through 2016</quote>.</text>
				</paragraph></subsection></section><section id="id191B0B669BD54F239F0AF07DC37437F4"><enum>6.</enum><header>Other
			 activities</header>
			<subsection id="id1E5EDEBBF10A4AF99D15D005EE321F37"><enum>(a)</enum><header>National
			 educational campaign</header>
				<paragraph id="ID4e8a8de56071466abaff00e35fb1638d"><enum>(1)</enum><header>Establishment</header><text>The
			 Secretary of Health and Human Services, (referred to in this section as the
			 <term>Secretary</term>) acting through the Surgeon General and in consultation
			 with Director of the National Institute on Child Health and Human Development,
			 shall establish and implement a national science-based consumer education
			 campaign on the prevention of preterm birth.</text>
				</paragraph><paragraph id="id5118A3496C7242239BFECE9B1EBADBE8"><enum>(2)</enum><header>Targeting</header><text>The
			 campaign established under paragraph (1) shall target women of childbearing
			 age, high risk populations, ethnic and minority groups, and individuals with a
			 low socioeconomic status.</text>
				</paragraph><paragraph id="id8DFE01B698284DD086E1A8297DA5CD31"><enum>(3)</enum><header>Contracts</header><text>The
			 Secretary shall implement the campaign under paragraph (1) through the awarding
			 of competitive contracts to entities submitting applications to the Secretary
			 (at such time and in such form and manner as the Secretary may require), and
			 may include the use of television, radio, the Internet, and other commercial
			 marketing venues.</text>
				</paragraph></subsection><subsection id="IDc9e5b36415db4cd49029cb4c1fcf7f5b"><enum>(b)</enum><header>Advisory
			 Committee on Infant Mortality</header>
				<paragraph id="id325DBBB121504DD9BCA07F7D061005FF"><enum>(1)</enum><header>Strategic
			 plan</header><text>The Advisory Committee on Infant Mortality of the Department
			 of Health and Human Services shall annually develop and annually update and
			 submit to the Secretary a strategic plan for the conduct of preterm birth
			 related research.</text>
				</paragraph><paragraph id="ID6d98b3f379a44fff8d29dbbb57fa3c01"><enum>(2)</enum><header>Annual
			 report</header><text>Not later than January 1, 2011, and each January 1
			 thereafter, the Advisory Committee on Infant Mortality shall submit to the
			 Secretary, and make available to the general public, a report concerning the
			 activities of the Advisory Committee related to infant mortality, prematurity,
			 and low birthweight.</text>
				</paragraph><paragraph id="ID0313a2726e414a78a6fc33dbb710fefe"><enum>(3)</enum><header>Membership</header><text>The
			 Secretary shall ensure that the membership of the Advisory Committee on Infant
			 Mortality includes the following:</text>
					<subparagraph id="id219F773CBE8943DC9D787DCA07BBA5C3"><enum>(A)</enum><text>Representatives
			 provided for in the original charter of the Advisory Committee.</text>
					</subparagraph><subparagraph id="id45DC321CF42248058489945ECE692E65"><enum>(B)</enum><text>A representative
			 of the National Center for Health Statistics.</text>
					</subparagraph></paragraph></subsection><subsection id="ID97f7aec612534b7a9fd9c366d8ad7bc0"><enum>(c)</enum><header>Pilot
			 programs</header>
				<paragraph id="idF99F12A5007F473A998000126CA0C845"><enum>(1)</enum><header>In
			 general</header><text>The Secretary, acting through the Administration of the
			 Agency for Healthcare Research and Quality, the Director of the Centers for
			 Disease Control and Prevention, the Administrator of the Health Resources and
			 Services Administration, the Director of the Centers for Medicare &amp;
			 Medicaid Services, the Assistant Secretary for Planning and Evaluation of the
			 Department of Health and Human Services, and the heads of other appropriate
			 agencies, shall conduct and report on research studies and demonstration
			 projects that test maternity care models that are designed to reduce the rate
			 of preterm birth.</text>
				</paragraph><paragraph id="ID956edc20fab143019b02e9fc2ae17722"><enum>(2)</enum><header>Grants</header><text>The
			 Secretary may carry out this subsection through the awarding of grants to
			 eligible entities.</text>
				</paragraph><paragraph id="id3E4CF0D3A31A4D77B4CF9D0E88891317"><enum>(3)</enum><header>Eligibility</header><text>To
			 be eligible to receive a grant under this section an entity shall—</text>
					<subparagraph id="idE3D3BCD82A264ABF85D70C3CC9D9EEB6"><enum>(A)</enum><text>be—</text>
						<clause id="id39C1F5476F504689BFDD279CEC449C1C"><enum>(i)</enum><text>a
			 hospital or hospital systems that utilizes evidence-based best practices;
			 or</text>
						</clause><clause id="id42C748AB59754B24A0E9E1703E1F5F7B"><enum>(ii)</enum><text>a
			 prematurity prevention network or other types of collaborative; and</text>
						</clause></subparagraph><subparagraph id="id2085B0F1BE914EE6B4C49A21E3EEFB74"><enum>(B)</enum><text>submit to the
			 Secretary an application at such time, in such manner, and containing such
			 information as the Secretary may require.</text>
					</subparagraph></paragraph><paragraph id="idC4A72E77B2244DF1BB0212705BF5407A"><enum>(4)</enum><header>Targeting</header><text>In
			 awarding grants under this subsection, the Secretary shall target those areas
			 with a demonstrated persistent high rate of preterm birth.</text>
				</paragraph></subsection><subsection id="id274730D8791C45FCBB5F385F9EE443C7"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section, such sums as may be necessary for each of fiscal years 2011
			 through 2016.</text>
			</subsection></section></legis-body>
