			</subsection></section><section id="idB5F93EB694D741D392D8A680860A70E9" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="H81FE8A2B883C4454A40BDA69A9AFCC2A"><enum>(1)</enum><text>Seclusion and
			 physical restraint have resulted in serious bodily injury, psychological
			 trauma, and death to children in schools. National research shows children have
			 been subjected to inappropriate seclusion and physical restraint in schools as
			 a means of discipline, to force compliance, or as a substitute for appropriate
			 educational support.</text>
			</paragraph><paragraph id="H93EC928E039C4C1D80A39417DB55218A"><enum>(2)</enum><text>Despite the widely
			 recognized risks of seclusion and physical restraint, a substantial disparity
			 exists between States and localities with regard to the protection and
			 oversight of the rights of children to a safe learning environment.</text>
			</paragraph><paragraph id="H3C5C00E16D12486AABA2733A4D536F2D"><enum>(3)</enum><text display-inline="yes-display-inline">Children are protected from inappropriate
			 physical restraint and seclusion in other settings, such as hospitals, health
			 facilities, and non-medical community-based facilities. Similar protections are
			 needed in schools, yet such protections must acknowledge the differences of the
			 school environment.</text>
			</paragraph><paragraph id="H6029A37BD10147CFACAA6727B2F441A0"><enum>(4)</enum><text display-inline="yes-display-inline">Research confirms that—</text>
				<subparagraph id="idB26DF7D4EFC64E53B085C024199685B1"><enum>(A)</enum><text display-inline="yes-display-inline">seclusion and physical restraint are not
			 therapeutic; and</text>
				</subparagraph><subparagraph id="idB2D731531A6A426E87851ACA32E0703B"><enum>(B)</enum><text display-inline="yes-display-inline">these practices are not effective means to
			 calm or teach children and may have an opposite effect while simultaneously
			 decreasing a child’s ability to learn.</text>
				</subparagraph></paragraph><paragraph id="HC42477800CAB41A2AB3C2BBBEC523617"><enum>(5)</enum><text>Children are
			 subjected to seclusion and physical restraint at higher rates than adults and
			 are at greater risk of injury. Physical restraint that restricts air flow to
			 the lungs, as well as seclusion in the absence of continuous face-to-face
			 monitoring, has resulted in the deaths of children in schools.</text>
			</paragraph><paragraph id="HD098133B5CA34FDBBEB41FE71DBAA7AC"><enum>(6)</enum><text>Behavioral
			 interventions for children must promote the right of all children to be treated
			 with dignity. All children have the right to be free from abuse, any aversive
			 behavioral intervention that compromises health and safety, and any physical
			 restraint or seclusion imposed for purposes of discipline or
			 convenience.</text>
			</paragraph><paragraph id="HA2A816F8B29A4F71BCFAB4B539FC0997"><enum>(7)</enum><text>Safe and effective
			 evidence-based strategies are available to support children who display
			 challenging behaviors in school settings. Staff training focused on the dangers
			 of seclusion and physical restraint, as well as training in evidence-based
			 positive behavioral interventions and supports, de-escalation techniques, and
			 seclusion and physical restraint prevention can reduce injury, trauma, and
			 death.</text>
			</paragraph><paragraph id="HBD831A7A01B34938BE29D919FD81CBA3"><enum>(8)</enum><text display-inline="yes-display-inline">School personnel have the right to work in
			 a safe environment and should be provided training and support to prevent
			 injury and trauma to themselves and others.</text>
			</paragraph><paragraph id="H1C44381AF64F48A0B4FE8EFBEE57D792"><enum>(9)</enum><text>The effective
			 implementation of school-wide positive behavioral interventions and supports is
			 linked to greater academic achievement, significantly fewer disciplinary
			 problems, increased instruction time, and staff perception of a safer teaching
			 environment.</text>
			</paragraph><paragraph id="ID58df95ad0a5f41aaa9039748758f0e15"><enum>(10)</enum><text>Perspectives of
			 parents and relevant community and advocacy organizations, including those run
			 by individuals with disabilities, are important when developing and
			 implementing strategies, policies, and procedures to prevent or reduce
			 seclusion and physical restraint in schools.</text>
			</paragraph></section><section id="H1CA87FE08D054B468707B45A008234CB"><enum>3.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text>
			<paragraph id="id1BF659199B7541FD8B171A205E4CC596"><enum>(1)</enum><text>prevent and
			 reduce the use of seclusion and physical restraint in schools;</text>
			</paragraph><paragraph id="H54795AD330114CF28F356B730D1D4154"><enum>(2)</enum><text display-inline="yes-display-inline">ensure the safety of all students and
			 personnel in schools and promote a positive school culture and climate;</text>
			</paragraph><paragraph id="H203BCC2C226E46388770A5C582592940"><enum>(3)</enum><text>protect students
			 from—</text>
				<subparagraph commented="no" id="H11C0E2293BA74E42AB67C5E1810B3304"><enum>(A)</enum><text>abuse;</text>
				</subparagraph><subparagraph id="H7B55DD9FCE9143D6A5C2C79DF4465E0E"><enum>(B)</enum><text>any aversive
			 behavioral intervention that compromises health and safety; and</text>
				</subparagraph><subparagraph id="HC8B99A56A4234E66963DD79480D86A93"><enum>(C)</enum><text>any physical
			 restraint or seclusion imposed for purposes of discipline or
			 convenience;</text>
				</subparagraph></paragraph><paragraph id="HA7A4D9D1B2694735AA2CCA97C4E2EAAC"><enum>(4)</enum><text>ensure that
			 seclusion and physical restraint are imposed in school only when a student’s
			 behavior poses an imminent danger of serious bodily injury to the student,
			 school personnel, or others; and</text>
			</paragraph><paragraph id="HB7CE885B80E94890A9F0E3353FFBA9C6"><enum>(5)</enum><text>assist States,
			 local educational agencies, and schools in—</text>
				<subparagraph id="HCBBF1DDCF5514840B0FC71BA12475C70"><enum>(A)</enum><text>establishing
			 policies and procedures to keep all students, including students with the most
			 complex and intensive behavioral needs, and school personnel safe;</text>
				</subparagraph><subparagraph id="H4FB364D40E2D4338A1016CB0CAC9DF02"><enum>(B)</enum><text>providing school
			 personnel with the necessary tools, training, and support to ensure the safety
			 of all students and all school personnel;</text>
				</subparagraph><subparagraph id="HA86D20BE2C6F4FCFB5777F2ACCC6C3DF"><enum>(C)</enum><text>collecting and
			 analyzing data on seclusion and physical restraint in schools;</text>
				</subparagraph><subparagraph id="ID46cb8fa5e67d4b51a9ae6b9383fecfd7"><enum>(D)</enum><text>implementing
			 systemic approaches to school-wide positive behavioral interventions and
			 supports; and</text>
				</subparagraph><subparagraph id="H4C7D144A097B4D5CA0D75BA63356292C"><enum>(E)</enum><text>identifying and
			 implementing effective evidence-based models to prevent and reduce seclusion
			 and physical restraint in schools.</text>
				</subparagraph></paragraph></section><title id="idC638205911884572A48967E147FC2E8E"><enum>I</enum><header>Prevention of
			 seclusion and physical restraint in schools</header>
			<section id="H125DEDDD8C764F8188D2E2E9D9900336"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
				<paragraph id="idD89A99690864426C83C9425A8F6C8EBE"><enum>(1)</enum><header>ESEA
			 definitions</header><text>The terms <term>educational service agency</term>,
			 <term>elementary school</term>, <term>local educational agency</term>,
			 <term>parent</term>, <term>secondary school</term>, and <term>State</term> have
			 the meanings given such terms in section 9101 of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 7801).</text>
				</paragraph><paragraph id="idC93BE6F4A10B4A149B5EFC4E01FCA676"><enum>(2)</enum><header>Applicable
			 program</header><text>The term <term>applicable program</term> has the meaning
			 given the term in section 400(c) of the General Education Provisions Act (20
			 U.S.C. 1221(c)).</text>
				</paragraph><paragraph id="id95AD2E3325EE4B16B78B99217259900D"><enum>(3)</enum><header>Chemical
			 restraint</header><text display-inline="yes-display-inline">The term
			 <term>chemical restraint</term> means a drug or medication used on a student to
			 control behavior or restrict freedom of movement that is not—</text>
					<subparagraph id="id6E76F076B0264007A9CE81B0658349D9"><enum>(A)</enum><text display-inline="yes-display-inline">prescribed by a licensed physician or other
			 qualified health professional acting under the scope of the professional’s
			 authority under State law for standard treatment of the student’s medical or
			 psychiatric condition; or</text>
					</subparagraph><subparagraph id="id3A3C1DFC120D46AC804CAD29E8AC15B9"><enum>(B)</enum><text display-inline="yes-display-inline">administered as prescribed by the licensed
			 physician or other qualified health professional acting under the scope of the
			 professional’s authority under State law.</text>
					</subparagraph></paragraph><paragraph commented="no" id="id3EA76AC23BF64874A93AFCC5ED95FDD8"><enum>(4)</enum><header>Free
			 appropriate public education</header><text>The term <term>free appropriate
			 public education</term> has the meaning given the term in section 602 of the
			 Individuals with Disabilities Education Act (20 U.S.C. 1401).</text>
				</paragraph><paragraph id="IDa2ba5ff4782d4ba68792b184cc72edff"><enum>(5)</enum><header>Mechanical
			 restraint</header><text>The term <term>mechanical restraint</term> means the
			 use of devices as a means of restricting a student’s freedom of
			 movement.</text>
				</paragraph><paragraph id="H4379C535FB794E9DAE3E935404F8BAF8"><enum>(6)</enum><header>Positive
			 behavioral interventions and supports</header><text>The term <term>positive
			 behavioral interventions and supports</term> means a systematic approach to
			 embed evidence-based practices and data-driven decisionmaking to improve school
			 climate and culture, including a range of systemic and individualized
			 strategies to reinforce desired behaviors and diminish reoccurrence of problem
			 behaviors, in order to achieve improved academic and social outcomes and
			 increase learning for all students, including those with the most complex and
			 intensive behavioral needs.</text>
				</paragraph><paragraph commented="no" id="idF942531F71E24A6687957F417EACE126"><enum>(7)</enum><header>Protection and
			 advocacy system</header>
					<subparagraph commented="no" id="id225A301A40434A7096A04D4D614E262C"><enum>(A)</enum><header>In
			 general</header><text>The term <term>protection and advocacy system</term>
			 means a protection and advocacy system authorized under a covered
			 provision.</text>
					</subparagraph><subparagraph commented="no" id="id46B2F4020EF54CE8B0D1024C804BFA4B"><enum>(B)</enum><header>Covered
			 provision</header><text>In this paragraph, the term <term>covered
			 provision</term> means subtitle C of title I of the Developmental Disabilities
			 Assistance and Bill of Rights Act of 2000 (42 U.S.C. 15041 et seq.).</text>
					</subparagraph></paragraph><paragraph id="IDf458bd9d07f145a0a89cb0d80626be70"><enum>(8)</enum><header>Physical
			 escort</header><text>The term <term>physical escort</term> means the temporary
			 touching or holding of the hand, wrist, arm, shoulder, or back for the purpose
			 of inducing a student who is acting out to walk to a safe location.</text>
				</paragraph><paragraph id="IDb082a95cda66482b99dfa06b3e1ecf8f"><enum>(9)</enum><header>Physical
			 restraint</header><text>The term <term>physical restraint</term> means a
			 personal restriction that immobilizes or reduces the ability of an individual
			 to move the individual’s arms, legs, body, or head freely. Such term does not
			 include a physical escort.</text>
				</paragraph><paragraph commented="no" id="HE4DBECFE24364293B0DBB29CC269F911"><enum>(10)</enum><header>School</header><text display-inline="yes-display-inline">The term <term>school</term> means an
			 entity that—</text>
					<subparagraph commented="no" id="H66E3327FB50B403FBC81E85EB7C9C9F1"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id8F511EB2BF0D4269A615DF3D24B8442E"><enum>(i)</enum><text>is—</text>
							<subclause commented="no" id="H86691B6743C4488EB5A90CB1CC3F6138" indent="up1"><enum>(I)</enum><text>a public day or residential elementary
			 school or secondary school; or</text>
							</subclause><subclause commented="no" id="H2BFD6B6650E84A219DC186EC51E589DE" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">an
			 early childhood program that is under the jurisdiction of a public school,
			 educational service agency, or other public educational institution or program;
			 and receives, or serves students who receive, support in any form from any
			 program supported in whole or in part with funds appropriated to the Department
			 of Education;</text>
							</subclause></clause></subparagraph><subparagraph commented="no" id="id7C09ADAB8958490B83A2CDB328D1F34C"><enum>(B)</enum><text>is a private day
			 or residential elementary school or secondary school that receives or serves a
			 student who has been placed or referred to such school by, or whose education
			 at such school is paid for by, a State or local educational agency under
			 paragraph (B) or (C) of section 612(a)(10) of the Individuals with Disabilities
			 Education Act (20 U.S.C. 1412(a)(10)(B), (C)), in order to provide the student
			 with a free appropriate public education; or</text>
					</subparagraph><subparagraph commented="no" id="ID1d1107a650a34c309712ac9ed509d2ae"><enum>(C)</enum><text>is a school
			 funded or operated by the Department of the Interior.</text>
					</subparagraph></paragraph><paragraph id="H5AE033C8AC6043E6997F4F710E562623"><enum>(11)</enum><header>School
			 personnel</header><text>The term <term>school personnel</term> means school
			 personnel and school resource officers, as such terms are defined in section
			 4151 of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7161),
			 who are employed in a school.</text>
				</paragraph><paragraph id="IDc310a1cc9c024cdf94336cabd44c82bd"><enum>(12)</enum><header>Seclusion</header><text>The
			 term <term>seclusion</term> means a behavior control technique involving the
			 involuntary confinement of a student alone in a room, or other area, from which
			 the student is physically prevented from leaving. Such term does not include a
			 time out.</text>
				</paragraph><paragraph id="HEF1979089463456DA0A214FC5D4A811B"><enum>(13)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Education.</text>
				</paragraph><paragraph id="idBA4C3453BF7A4B84AEF0C7EC16C488DB"><enum>(14)</enum><header>Serious bodily
			 injury</header><text>The term <term>serious bodily injury</term> has the
			 meaning given the term in section 1365(h) of title 18, United States
			 Code.</text>
				</paragraph><paragraph id="HE0BEECD0CF59473BB5F28C709A836DF3"><enum>(15)</enum><header>State-approved
			 training program</header><text>The term <term>State-approved training
			 program</term> means a training program approved by a State that, at a minimum,
			 provides—</text>
					<subparagraph display-inline="no-display-inline" id="H1C2EA99159EE405291C43158FF4C0B3E"><enum>(A)</enum><text>training in
			 evidence-based techniques shown to be effective in the prevention of seclusion
			 and physical restraint;</text>
					</subparagraph><subparagraph commented="no" id="ID1f4c9239226d4bb8819f7e1009e9be16"><enum>(B)</enum><text>training in
			 evidence-based techniques shown to be effective in keeping both school
			 personnel and students safe when imposing physical restraint or
			 seclusion;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H94E8891E87284D518CBBD45CF4956E37"><enum>(C)</enum><text>evidence-based
			 skills training that is related to positive behavioral interventions and
			 supports, conflict prevention, functional behavior assessments, de-escalation,
			 and conflict management;</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="HF60431032D4B4284AB8BC006CB1F337A"><enum>(D)</enum><text>training in first
			 aid and car­dio­pul­mo­nary resuscitation;</text>
					</subparagraph><subparagraph commented="no" id="IDb1ea6b7d60d04cf3a11491c1da6bcf80"><enum>(E)</enum><text>information
			 describing State policies and procedures that meet the minimum standards
			 established by regulations promulgated pursuant to section 102(a); and</text>
					</subparagraph><subparagraph display-inline="no-display-inline" id="H11AFEC8BADFA497AAD9450F0ABDAFA29"><enum>(F)</enum><text>certification for
			 school personnel in the techniques and skills described in subparagraphs (A)
			 through (D), which shall be required to be renewed on a periodic basis.</text>
					</subparagraph></paragraph><paragraph commented="no" id="idCF15E028F9094B52B9EAC4087824D855"><enum>(16)</enum><header>State
			 educational agency</header><text>The term <term>State educational agency</term>
			 means a State educational agency, as defined in section 9101 of the Elementary
			 and Secondary Education Act of 1965 (20 U.S.C. 7801), that receives support in
			 any form from an applicable program.</text>
				</paragraph><paragraph commented="no" id="H794C1490ABBD483DAFC695E925CC6C35"><enum>(17)</enum><header>Student</header><text>The
			 term <term>student</term> means a student—</text>
					<subparagraph id="H602D719F0C084A00A707D5342ED586FC"><enum>(A)</enum><text>who is enrolled in
			 a school described in subparagraph (A) or (C) of paragraph (10); or</text>
					</subparagraph><subparagraph commented="no" id="ID79372fc44afa48e684efec6107927a2a"><enum>(B)</enum><text>who is enrolled
			 in a private school described in paragraph (10)(B) and who is receiving a free
			 appropriate public education at the school, under subparagraph (B) or (C) of
			 section 612(a)(10) of the Individuals with Disabilities Education Act (20
			 U.S.C. 1412(a)(10)(B), (C)).</text>
					</subparagraph></paragraph><paragraph id="ID783eb12c89964024ae8677ade232c96b"><enum>(18)</enum><header>Time
			 out</header><text>The term <term>time out</term> means a behavior management
			 technique that is part of an approved treatment program and may involve the
			 separation of the student from the group, in a non-locked setting, for the
			 purpose of calming. Time out is not seclusion.</text>
				</paragraph></section><section id="H8232DBCE6BFB41928253D0D69B36ADF6"><enum>102.</enum><header>Minimum
			 standards; rule of construction</header>
				<subsection id="H3ED8C8FAAE36411EB2A34A24868E267B"><enum>(a)</enum><header>Minimum
			 standards</header><text>Not later than 1 year after the date of enactment of
			 this Act, in order to protect each student from any aversive behavioral
			 intervention that compromises student health and safety or any physical
			 restraint or seclusion imposed for purposes of discipline or convenience or in
			 a manner otherwise inconsistent with this Act, the Secretary shall promulgate
			 regulations establishing the following minimum standards:</text>
					<paragraph id="H5546F1A1EFC748B095779A60B7539588"><enum>(1)</enum><text>School personnel
			 shall be prohibited from imposing on any student the following:</text>
						<subparagraph id="H8AE340FF5D0544809A94C05254A5E4B1"><enum>(A)</enum><text>Mechanical
			 restraint.</text>
						</subparagraph><subparagraph id="HA1B1E703C99C4B868259B05582E873B9"><enum>(B)</enum><text>Chemical
			 restraint.</text>
						</subparagraph><subparagraph commented="no" id="H8A82769E87DE4ED3897A58765078D033"><enum>(C)</enum><text>Physical restraint
			 or physical escort that restricts breathing.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA8A2F682CEF4316B54DBACFA6092C7B"><enum>(D)</enum><text>Aversive
			 behavioral intervention that compromises health and safety.</text>
						</subparagraph></paragraph><paragraph id="HF264AA4B70524506AE1726B0C9AEAF8C"><enum>(2)</enum><text>School personnel
			 shall be prohibited from imposing physical restraint or seclusion on a student
			 unless—</text>
						<subparagraph id="H0C40838916C6452AA89D002A4DE30C09"><enum>(A)</enum><text>the student’s
			 behavior poses an imminent danger of serious bodily injury to the student,
			 school personnel, or others; and</text>
						</subparagraph><subparagraph id="HA0948BB2E2954C7BBA1E221CE29B68DD"><enum>(B)</enum><text>less restrictive
			 interventions would be ineffective in stopping such imminent danger of serious
			 bodily injury.</text>
						</subparagraph></paragraph><paragraph id="H6B8E35B0CD8246FA9DB06CC3ECC6A668"><enum>(3)</enum><text display-inline="yes-display-inline">In the event physical restraint or
			 seclusion is imposed upon a student, such physical restraint or seclusion
			 shall—</text>
						<subparagraph id="HDD5F0CEAB9E74067B354CD26E0597051"><enum>(A)</enum><text>end upon the
			 cessation of the conditions described in
			 <internal-xref idref="HF264AA4B70524506AE1726B0C9AEAF8C" legis-path="3.(a)(1)">paragraph (2)</internal-xref>;</text>
						</subparagraph><subparagraph id="H4DE851D7B5674D80ABF398AA6B2C1A37"><enum>(B)</enum><text>be imposed by
			 school personnel who—</text>
							<clause id="HC37C43552D564DF59FA9CCEAB715D3D7"><enum>(i)</enum><text>continuously
			 monitor the student face-to-face; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="HFBF418BC3E834ECC9C0510AA585BE29B"><enum>(ii)</enum><text>if school
			 personnel safety would be significantly compromised by such face-to-face
			 monitoring, are in continuous direct visual contact with the student;
			 and</text>
							</clause></subparagraph><subparagraph id="HA96FD9E6A6CF48E688533A62297ADB33"><enum>(C)</enum><text>be imposed
			 by—</text>
							<clause id="H0922FEB5F49C411D851E98C528FCC231"><enum>(i)</enum><text>school personnel
			 trained and certified by a State-approved training program; or</text>
							</clause><clause id="HAC42DDB89D0540A8A3862FD63503F388"><enum>(ii)</enum><text display-inline="yes-display-inline">other school personnel in the case of a
			 rare and clearly unavoidable emergency circumstance when school personnel
			 trained and certified as described in
			 <internal-xref legis-path="3.(a)(2)(C)(iii)(I)">clause (i)</internal-xref> are
			 not immediately available due to the unforeseeable nature of the emergency
			 circumstance.</text>
							</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HA5F18C3E0FB5475BBCAC92BB26247634"><enum>(4)</enum><text>Each State, in
			 consultation with local educational agencies and private schools, shall ensure
			 that a sufficient number of school personnel are trained and certified by a
			 State-approved training program to meet the needs of the specific student
			 population in each school.</text>
					</paragraph><paragraph commented="no" id="ID59fcf9e6179247a1ac9fab22552ab1e9"><enum>(5)</enum><text>The use of
			 physical restraint or seclusion shall not be written into a student’s education
			 plan, individual safety plan, behavioral plan, or individualized education
			 program (as defined in section 614(d) of the Individuals with Disabilities
			 Education Act (20 U.S.C. 1414(d))) unless all of the following conditions
			 apply:</text>
						<subparagraph commented="no" id="ID3985bcaf86094b1fbe79938b3dbede17"><enum>(A)</enum><text>The use of
			 physical restraint and seclusion complies with the minimum standards of this
			 section and any other applicable State law (including regulations) regarding
			 physical restraint or seclusion, to the extent State law (including
			 regulations) provide additional protection for students.</text>
						</subparagraph><subparagraph commented="no" id="IDbab3cb5c77e7490388b686ec433381e5"><enum>(B)</enum><text>The student has a
			 documented history showing a series of behaviors in the preceding 2 years that
			 has created an imminent danger of serious bodily injury in school.</text>
						</subparagraph><subparagraph commented="no" id="ID0e0366bd62034e818394590e35d4ed83"><enum>(C)</enum><text>A comprehensive,
			 data-driven functional behavior assessment has been conducted, and a behavioral
			 intervention plan implemented, by a qualified team of professionals.</text>
						</subparagraph></paragraph><paragraph commented="no" id="id35AA580DA2914ABB8676C2F588B48429"><enum>(6)</enum><text>After the
			 imposition of physical restraint or seclusion upon a student, all school
			 personnel involved in the physical restraint or seclusion and appropriate
			 supervisory and administrative staff shall participate in a debriefing session.
			 The debriefing session shall occur not later than 5 school days following the
			 imposition of physical restraint or seclusion, unless the debriefing session is
			 delayed, at the request of a student’s parent so that the parent can also
			 attend. The debriefing session shall include—</text>
						<subparagraph id="IDd0e169b755c34528965914da1b480099"><enum>(A)</enum><text>documentation of
			 circumstances leading to use of physical restraint or seclusion;</text>
						</subparagraph><subparagraph id="IDa36bf233f75f4d70945d761adefcb1d8"><enum>(B)</enum><text>planning to
			 prevent and reduce reoccurrence of the use of physical restraint or seclusion;
			 and</text>
						</subparagraph><subparagraph commented="no" id="id06568569642F4216B3566C2BAECEAC8C"><enum>(C)</enum><text>a plan to have a
			 qualified team of professionals conduct, review, or revise a functional
			 behavioral assessment.</text>
						</subparagraph></paragraph><paragraph id="HD110120C2D4D4C58B22A3C96B249E047"><enum>(7)</enum><text display-inline="yes-display-inline">Each local educational agency shall
			 establish procedures to be followed after each incident in a school involving
			 the imposition of physical restraint or seclusion upon a student,
			 including—</text>
						<subparagraph id="H60036A62A2484F9190E4D5812ADC7383"><enum>(A)</enum><text>procedures to
			 provide to the parent of the student, with respect to each such
			 incident—</text>
							<clause id="H7A6B931A4AEE4BB584EDFF54B33A1A17"><enum>(i)</enum><text>a
			 documented, reasonable attempt to provide immediate verbal or electronic
			 communication on the same day as each such incident;</text>
							</clause><clause id="HE3DFFAC765554E47B2B8F4D819F90998"><enum>(ii)</enum><text>within 24 hours
			 of each such incident, written notification; and</text>
							</clause><clause id="idA0F1748CF03E4E57BD200A8615F1227C"><enum>(iii)</enum><text>advance notice
			 of the debriefing session described in paragraph (6) that will be held
			 regarding such incident and an opportunity to attend the debriefing session or
			 request that the debriefing session be rescheduled so that the parent may
			 attend; and</text>
							</clause></subparagraph><subparagraph id="id86D742172EF543BC8177657DD81B38D9"><enum>(B)</enum><text>in a case in
			 which serious bodily injury or death of a student of the school occurs from the
			 use of seclusion or physical restraint, procedures to notify, in writing,
			 within 24 hours after such injury or death occurs—</text>
							<clause id="id8A66208C967D434083072E9B891AB1C5"><enum>(i)</enum><text>the
			 State educational agency and local educational agency;</text>
							</clause><clause commented="no" id="idA0C46F65F1CC42D69D6F8BA93B999C74"><enum>(ii)</enum><text>a protection and
			 advocacy system, in the case of a student who is eligible for protection and
			 advocacy services through that system; and</text>
							</clause><clause id="id0DF228D6E35548C38387759F263C3ECF"><enum>(iii)</enum><text>if appropriate,
			 law enforcement officials.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" id="ID2da6482136804213af9bdb5f486fc62a"><enum>(b)</enum><header>Secretary of
			 the interior</header><text>The Secretary of the Interior shall ensure that
			 schools operated or funded by the Department of the Interior comply with the
			 regulations promulgated by the Secretary under subsection (a).</text>
				</subsection><subsection id="H9A42228D59404F9782FFE7BC5C67E411"><enum>(c)</enum><header>Rule of
			 construction regarding certain practices</header><text>Nothing in this section
			 shall be construed to authorize the Secretary to promulgate regulations
			 prohibiting the use of—</text>
					<paragraph id="id91CDC5405D0548619B7CF5B20005D465"><enum>(1)</enum><text>time out;</text>
					</paragraph><paragraph id="IDdac3d70477a1407594d71cc89c281262"><enum>(2)</enum><text>devices
			 implemented by a trained school personnel, or utilized by a student, for the
			 specific and approved therapeutic or safety purposes for which such devices
			 were designed, and, if applicable, prescribed, including—</text>
						<subparagraph id="ID11fc2b8230dc4f10b528dcbbd4691141"><enum>(A)</enum><text>restraints for
			 medical immobilization;</text>
						</subparagraph><subparagraph id="HDCD93080A10A4B31B2106D054CE606F4"><enum>(B)</enum><text>adaptive devices
			 or mechanical supports used to achieve proper body position, balance, or
			 alignment to allow greater freedom of mobility than would be possible without
			 the use of such a mechanical support; or</text>
						</subparagraph><subparagraph id="HBE75CF0F0E354F57B39E47856B9DFEC0"><enum>(C)</enum><text>vehicle safety
			 restraints when used as intended during the transport of a student in a moving
			 vehicle; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="ID8a601df28e074471941df80f00561cf1"><enum>(3)</enum><text>handcuffs by
			 school resource officers (as such term is defined in section 4151 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7161))—</text>
						<subparagraph commented="no" id="ID6707eb2186be432c8690126d5f4a867f"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id24268AB10EA84C09A2AAFEADFD37F387"><enum>(i)</enum><text>in the case where a
			 student’s behavior poses an imminent danger of serious bodily injury to the
			 student, school personnel, or others; or</text>
							</clause><clause commented="no" id="id8168F111B7344F9488FF6D1225F83526" indent="up1"><enum>(ii)</enum><text>in the lawful exercise of law
			 enforcement duties; and</text>
							</clause></subparagraph><subparagraph commented="no" id="ID1749a7eab9c04132982caddc2d1dd737"><enum>(B)</enum><text>if less
			 restrictive interventions would be ineffective.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="IDc80f846d031a4910983ccb50fb45635b"><enum>(d)</enum><header>Interaction
			 with minimum standards and State law (including regulations)</header>
					<paragraph commented="no" id="id89B9DD78B26F4CBA9EE90FBFBF6943C1"><enum>(1)</enum><header>In
			 general</header><text>Any education plan, individual safety plan, behavioral
			 plan, or individualized education program (as defined in section 614(d) of the
			 Individuals with Disabilities Education Act (20 U.S.C. 1414(d))) for a student
			 in a State shall conform to the minimum standards described in subsection (a)
			 and with State law (including regulations) regarding physical restraint or
			 seclusion, to the extent State law (including regulations) provide additional
			 protection for students.</text>
					</paragraph><paragraph commented="no" id="id4E491E91DD5E4ADF8C7652BE89D57905"><enum>(2)</enum><header>Individualized
			 education programs</header><text>With respect to a student attending a school
			 served by a State educational agency, the requirements under subsection (a)(5)
			 shall be treated, for all purposes under the Individuals with Disabilities
			 Education Act (20 U.S.C. 1400 et seq.), as if such requirements were included
			 in section 614(d) of such Act (20 U.S.C. 1414(d)), notwithstanding any other
			 provision of law.</text>
					</paragraph></subsection></section><section id="IDeddbc81e234947819b5e9dfda3b9ee66"><enum>103.</enum><header>State plan and
			 data collection requirements and enforcement</header>
				<subsection id="ID57c4b4c6fbc54db2b1addc469879aea6"><enum>(a)</enum><header>State
			 plan</header>
					<paragraph id="id836587D3589F42CCB37D283C5FE57261"><enum>(1)</enum><header>Submission of
			 plans</header><text>Not later than 2 years after the Secretary promulgates
			 regulations pursuant to section 102(a), and every 3 years thereafter, each
			 State educational agency shall submit to the Secretary, and make available to
			 the general public, a State plan that provides—</text>
						<subparagraph id="IDd434a1ef1c4c4ede8f983a512fbbe5be"><enum>(A)</enum><text>assurances to the
			 Secretary that the State has in effect—</text>
							<clause id="ID914704f653d045e496e20792ebf874d0"><enum>(i)</enum><text>State policies
			 and procedures that meet the minimum standards, including the standards with
			 respect to State-approved training programs, established by the regulations
			 prescribed by the Secretary pursuant to section 102(a); and</text>
							</clause><clause id="ID6e240e94f9ab421a880d89602db7484f"><enum>(ii)</enum><text>a
			 State mechanism to effectively monitor and enforce the minimum
			 standards;</text>
							</clause></subparagraph><subparagraph id="ID53415933eb5542caaa04e06c515a3e45"><enum>(B)</enum><text>a description of
			 the State policies and procedures described in subparagraph (A)(i); and</text>
						</subparagraph><subparagraph id="H1C9AFDB019E644FABAEA2C3390D4949C"><enum>(C)</enum><text>a description of
			 the plans to ensure school personnel and parents, including private school
			 personnel and parents, are aware of the State policies and procedures.</text>
						</subparagraph></paragraph><paragraph id="idA608C838AC5644AB8081E0B7A73CD710"><enum>(2)</enum><header>Updated
			 plans</header><text>Each State educational agency shall submit a new State plan
			 to the Secretary each time the State educational agency updates or makes a
			 material change in the State plan.</text>
					</paragraph></subsection><subsection id="HF637EEA1306F47AD82F2C14E1E01B3DD"><enum>(b)</enum><header>Reporting</header>
					<paragraph id="HEBA7B08D3B564AFE9F4ED575F54945F4"><enum>(1)</enum><header>Reporting
			 requirements</header><text>Not later than 2 years after the date the Secretary
			 promulgates regulations pursuant to section 102(a), and each year thereafter,
			 each State educational agency shall (in compliance with the requirements of
			 section 444 of the General Education Provisions Act (commonly known as the
			 <quote>Family Educational Rights and Privacy Act of 1974</quote>) (20 U.S.C.
			 1232g)) prepare and submit to the Secretary, and make available to the public,
			 a report with respect to each local educational agency, and each school not
			 under the jurisdiction of a local educational agency, located in the same State
			 as such State educational agency that includes the information described in
			 paragraph (2).</text>
					</paragraph><paragraph id="H2AE7979B07D6428C890C014C912B79D4"><enum>(2)</enum><header>Information
			 requirements</header>
						<subparagraph id="HC0BF04B201A8456BA9A794298FE5DF8D"><enum>(A)</enum><header>General
			 information requirements</header><text>The report described in paragraph (1)
			 shall include information on—</text>
							<clause id="H528C6CC871DA46FE95AFFDC4AF1CAEEA"><enum>(i)</enum><text>the
			 total number of incidents in the preceding full academic year in which physical
			 restraint was imposed upon a student; and</text>
							</clause><clause id="HC79A049878D244ABAB7CDC2E0028ABF6"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of incidents in the
			 preceding full academic year in which seclusion was imposed upon a
			 student.</text>
							</clause></subparagraph><subparagraph id="H94C49788DE1048BE9B21668C70B9F02A"><enum>(B)</enum><header>Disaggregation</header>
							<clause id="H4C80094B8102484E9B6FA96799262FD9"><enum>(i)</enum><header>General
			 disaggregation requirements</header><text>The information described in
			 subparagraph (A) shall be disaggregated by—</text>
								<subclause display-inline="no-display-inline" id="H44959DD7D69D4A909FC04AF131A310CD"><enum>(I)</enum><text>the total number
			 of incidents in which physical restraint or seclusion was imposed upon a
			 student—</text>
									<item id="H2C5E685380924FFF88C4B8C4CB0A3D4A"><enum>(aa)</enum><text>that
			 resulted in serious bodily injury to a student;</text>
									</item><item commented="no" id="ID5ab8910902f746808478a4e7849f0632"><enum>(bb)</enum><text>that resulted in
			 serious bodily injury to school personnel;</text>
									</item><item id="H75038722C11E4A55B63089438F32B1B3"><enum>(cc)</enum><text>that
			 resulted in the death of a student;</text>
									</item><item id="H0DDABB06AD624F89B696C17ED047312B"><enum>(dd)</enum><text>in
			 which the school personnel imposing physical restraint or seclusion were not
			 trained and certified as described in section 102(a)(3)(C)(i); and</text>
									</item><item id="id4F95886DC4A6412C817DD110CF907BF6"><enum>(ee)</enum><text>in a
			 way that did not meet the minimum standards established by the regulations
			 prescribed by the Secretary pursuant to section 102(a); and</text>
									</item></subclause><subclause id="HC9B4711C7D524C048B1468CCF7AD9CFD"><enum>(II)</enum><text>the demographic
			 characteristics of all students upon whom physical restraint or seclusion was
			 imposed, including—</text>
									<item id="HE592B9DC761647B3952D487E3F216DD8"><enum>(aa)</enum><text>the
			 categories described in section 1111(h)(1)(C)(i) of the Elementary and
			 Secondary Education Act of 1965 (20 U.S.C. 6311(h)(1)(C)(i));</text>
									</item><item id="HD1AC4AA4FC6F4CFC9D0528EB064D9C24"><enum>(bb)</enum><text>age;
			 and</text>
									</item><item id="H2FD050E27C7347F589B8CDAEDBF7EE38"><enum>(cc)</enum><text>disability
			 status, which has the meaning given the term <term>individual with a
			 disability</term> in paragraph (20) (except for subparagraph (A)) of section 7
			 of the Rehabilitation Act of 1973 (29 U.S.C. 705(20)).</text>
									</item></subclause></clause><clause id="H33A14B374F58402EBC22660733BADA28"><enum>(ii)</enum><header>Unduplicated
			 count; exception</header><text display-inline="yes-display-inline">The
			 disaggregation required under clause (i) shall—</text>
								<subclause id="H1755D4C496844E5BA14B3FAC0198BE1E"><enum>(I)</enum><text>be carried out in
			 a manner to ensure an unduplicated count of the—</text>
									<item id="H11BCE8D3123247478DAE4EB7A5865807"><enum>(aa)</enum><text>total
			 number of incidents in the preceding full-academic year in which physical
			 restraint was imposed upon a student; and</text>
									</item><item id="H21A21DA7B6A040DDB0B58439E0E90D05"><enum>(bb)</enum><text>total
			 number of incidents in the preceding full-academic year in which seclusion was
			 imposed upon a student; and</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="HA512F5203A9A48CBADD9549A010775A4"><enum>(II)</enum><text display-inline="yes-display-inline">not be required in a case in which the
			 number of students in a category would reveal personally identifiable
			 information about an individual student.</text>
								</subclause></clause></subparagraph></paragraph></subsection><subsection commented="no" id="H7D03EDBB6A7F4A96A6A781DEACAF7B9D"><enum>(c)</enum><header>Enforcement</header>
					<paragraph id="HDE227672C3E34B9CAB0E3BD87F978D32"><enum>(1)</enum><header>In
			 general</header>
						<subparagraph id="HA1458009EC8E4AFFA900F09C895184B8"><enum>(A)</enum><header>Use of
			 remedies</header><text>If a State educational agency fails to comply with
			 <internal-xref legis-path="102.(a)">subsection (a)</internal-xref> or
			 <internal-xref legis-path="4.(b)(2)">(b)</internal-xref>, the Secretary
			 shall—</text>
							<clause id="H5B22E14225344058B71E77B3A3E533FA"><enum>(i)</enum><text>require the State
			 educational agency to submit and implement, not later than 1 year after the
			 State’s failure to comply, a corrective plan of action, which may include
			 redirection of funds received under an applicable program after the date of
			 enactment of this Act;</text>
							</clause><clause id="H31EC8D40588744BE84760B37180464D3"><enum>(ii)</enum><text>withhold from the
			 State educational agency, in whole or in part, further payments under an
			 applicable program in accordance with section 455 of the General Education
			 Provisions Act (20 U.S.C. 1234d); or</text>
							</clause><clause id="HD9E4D738A7F344A0AFB62AF6847F0CBF"><enum>(iii)</enum><text display-inline="yes-display-inline">issue a complaint to compel compliance of
			 the State educational agency through a cease and desist order, in the same
			 manner the Secretary is authorized to take such action under section 456 of the
			 General Education Provisions Act (20 U.S.C. 1234e).</text>
							</clause></subparagraph><subparagraph commented="no" id="H8A03AD15DF694B2D9D937D58DCDFD8B5"><enum>(B)</enum><header>Cessation of
			 withholding of funds</header><text display-inline="yes-display-inline">Whenever
			 the Secretary determines (whether by certification or other appropriate
			 evidence) that a State educational agency that is subject to the withholding of
			 payments under subparagraph (A)(ii) has cured the failure providing the basis
			 for the withholding of payments, the Secretary shall cease the withholding of
			 payments with respect to the State educational agency under such
			 subparagraph.</text>
						</subparagraph></paragraph><paragraph id="H2971ADDC062E460E915EC4B06B6A90D0"><enum>(2)</enum><header>Rule of
			 construction</header><text display-inline="yes-display-inline">Nothing in this
			 subsection shall be construed to limit the Secretary’s authority under the
			 General Education Provisions Act (20 U.S.C. 1221 et seq.).</text>
					</paragraph></subsection></section><section display-inline="no-display-inline" id="H827EC52F5FC140179F8CBD750C1C7DE6"><enum>104.</enum><header>Grant
			 authority</header>
				<subsection id="HBA62BCC80B9E4C1191724CD5BA3E87A4"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">From the amount
			 appropriated under
			 <internal-xref idref="H9483A417ED9D42F9B1FED3EA903978DB" legis-path="107.">section 109</internal-xref>, the Secretary may award grants
			 to State educational agencies to assist the State educational agencies
			 in—</text>
					<paragraph id="H11D5993C24D5421FA7F86137B5D0CE1D"><enum>(1)</enum><text>establishing,
			 implementing, and enforcing the policies and procedures to meet the minimum
			 standards required by regulations prescribed by the Secretary pursuant to
			 <internal-xref idref="H8232DBCE6BFB41928253D0D69B36ADF6" legis-path="4.">section 102(a)</internal-xref>;</text>
					</paragraph><paragraph commented="no" id="IDa1e4bd731aae42e3b68a3f71949053cd"><enum>(2)</enum><text>improving State
			 and local capacity to collect and analyze data related to physical restraint
			 and seclusion; and</text>
					</paragraph><paragraph id="HF42C27D7CD6340F786B8FA203BDB1A40"><enum>(3)</enum><text>improving school
			 climate and culture by implementing school-wide positive behavioral
			 interventions and supports.</text>
					</paragraph></subsection><subsection id="H7C3DDB1A6AF34B96A765866E007CBB5C"><enum>(b)</enum><header>Duration of
			 grant</header><text>A grant under this section shall be awarded to a State
			 educational agency for a 3-year period.</text>
				</subsection><subsection id="H86792DE61AE442219670FBE9C4FE58B3"><enum>(c)</enum><header>Application</header><text>Each
			 State educational agency desiring a grant under this section shall submit an
			 application to the Secretary at such time, in such manner, and accompanied by
			 such information as the Secretary may require, including information on how the
			 State educational agency will target resources to schools and local educational
			 agencies in need of assistance related to preventing and reducing physical
			 restraint and seclusion.</text>
				</subsection><subsection id="H23EE38E889004F82B1143FE18F1A51F7"><enum>(d)</enum><header>Authority To
			 make subgrants</header>
					<paragraph id="H53FE72C165E946A29EA57A444CA92FB8"><enum>(1)</enum><header>In
			 general</header><text>A State educational agency receiving a grant under this
			 section may carry out the activities described in subsections (f) and (g), as
			 required under the grant, by awarding subgrants, on a competitive basis, to
			 local educational agencies.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H42FB0032A3B5419DBE424F04100209A8"><enum>(2)</enum><header>Application</header><text>A
			 local educational agency desiring to receive a subgrant under paragraph (1)
			 shall submit an application to the applicable State educational agency at such
			 time, in such manner, and containing such information as the State educational
			 agency may require.</text>
					</paragraph></subsection><subsection commented="no" id="ID9a972a09fb7348648ed0c778722bc7eb"><enum>(e)</enum><header>Private school
			 participation</header>
					<paragraph commented="no" id="IDa2563d29c40649509b0b6ba8d5ca0150"><enum>(1)</enum><header>In
			 general</header><text>A local educational agency receiving a subgrant under
			 this section shall, after timely and meaningful consultation with appropriate
			 private school officials in the school district served by the local educational
			 agency, ensure that private school personnel can participate, on an equitable
			 basis, in activities supported by subgrant funds.</text>
					</paragraph><paragraph commented="no" id="ID95c3e0ab63b3413b8792e7413975e215"><enum>(2)</enum><header>Public control
			 of funds</header><text>The control of funds provided under this section, and
			 title to materials, equipment, and property purchased with such funds, shall be
			 in a public agency, and a public agency shall administer such funds, materials,
			 equipment, and property.</text>
					</paragraph></subsection><subsection id="HC316724D30364CA4936E07540A90D849"><enum>(f)</enum><header>Required
			 activities</header><text display-inline="yes-display-inline">A State
			 educational agency receiving a grant under this section shall use such grant
			 funds to carry out all of the following:</text>
					<paragraph id="HEF647E4F57124107ACEF2322895072BF"><enum>(1)</enum><text>Researching,
			 developing, implementing, and evaluating strategies, policies, and procedures
			 to prevent and reduce seclusion and physical restraint in schools consistent
			 with the minimum standards required by regulations prescribed by the Secretary
			 pursuant to
			 <internal-xref idref="H8232DBCE6BFB41928253D0D69B36ADF6" legis-path="4.">section 102(a)</internal-xref>.</text>
					</paragraph><paragraph id="H36C085529D4A4D2B9A8791E4C5A2279E"><enum>(2)</enum><text display-inline="yes-display-inline">Providing professional development,
			 training, and certification for school personnel to meet such standards.</text>
					</paragraph><paragraph id="HD6466E1570A2450EA9DDFD039F902A46"><enum>(3)</enum><text display-inline="yes-display-inline">Carrying out the reporting requirements
			 under
			 <internal-xref idref="HF637EEA1306F47AD82F2C14E1E01B3DD" legis-path="6.(b)">section 103(b)</internal-xref> and analyzing the information
			 included in a report prepared under such section to identify student, school
			 personnel, and school needs related to use of physical restraint and
			 seclusion.</text>
					</paragraph><paragraph id="HA6B7FCE5D85C4BE89D9C09CF6AE75C01"><enum>(4)</enum><text display-inline="yes-display-inline">Developing and implementing high-quality
			 professional development and training programs to implement evidence-based
			 systematic approaches to school-wide positive behavioral interventions and
			 supports, including improving coaching, facilitation, and training capacity for
			 administrators, teachers, specialized instructional support personnel,
			 paraprofessionals, and other staff.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF091B2B77DD34FE6A56E9452089FF842"><enum>(5)</enum><text>Providing
			 technical assistance to develop and implement evidence-based systematic
			 approaches to school-wide positive behavioral interventions and supports,
			 including technical assistance for data-driven decisionmaking related to
			 behavioral supports and interventions in the classroom.</text>
					</paragraph></subsection><subsection id="H57087FDDA2DE489A8485E005C765F454"><enum>(g)</enum><header>Authorized
			 activities</header><text display-inline="yes-display-inline">A State
			 educational agency receiving a grant under this section may use such grant
			 funds for one or more of the following:</text>
					<paragraph id="H49F876C0680141158DB3967B5F33B619"><enum>(1)</enum><text>Researching,
			 evaluating, and disseminating high-quality evidence-based programs and
			 activities that implement school-wide positive behavioral interventions and
			 supports with fidelity.</text>
					</paragraph><paragraph commented="no" id="ID64b8aa46993f443c9957e27cb8fdd07a"><enum>(2)</enum><text>Supporting other
			 local positive behavioral intervention and support implementation activities
			 consistent with this subsection, including functional behavioral
			 assessments.</text>
					</paragraph></subsection><subsection id="H826F6DE63EB743279DE38C118CC4A652"><enum>(h)</enum><header>Evaluation and
			 report</header><text display-inline="yes-display-inline">Each State educational
			 agency receiving a grant under this section shall, at the end of the grant
			 period<italic></italic>—</text>
					<paragraph id="HC0251CFF86844B0B97CCC02CCBF466D6"><enum>(1)</enum><text>evaluate the
			 State’s progress toward the reduction and elimination of seclusion and physical
			 restraint in the schools located in the State, consistent with the minimum
			 standards required by regulations prescribed by the Secretary pursuant to
			 section 102(a); and</text>
					</paragraph><paragraph id="H52A26F5A98F148B8B144D0FCF02FC007"><enum>(2)</enum><text>submit to the
			 Secretary a report on such progress.</text>
					</paragraph></subsection><subsection commented="no" id="ID23d102afec254f48ab81c65935b7e1b8"><enum>(i)</enum><header>Department of
			 the interior</header><text>From the amount appropriated under section 109, the
			 Secretary of Education may allocate funds to the Secretary of the Interior for
			 activities under this section with respect to schools operated or funded by the
			 Department of the Interior, under such terms as the Secretary of Education may
			 prescribe.</text>
				</subsection></section><section id="HB6FF871561C14A7386C0B0960A96425C"><enum>105.</enum><header>National
			 evaluation</header>
				<subsection id="H5B35419C88324849A5987AF428C68754"><enum>(a)</enum><header>National
			 evaluation</header><text>The Secretary shall carry out a national evaluation to
			 determine the effectiveness of this Act, which shall include—</text>
					<paragraph id="H016116CC25404C74B01F39EBB69ACDD3"><enum>(1)</enum><text>analyzing data
			 related to seclusion and physical restraint in schools;</text>
					</paragraph><paragraph id="H06BBE6E132AF47B68DAC588F8C61312F"><enum>(2)</enum><text>analyzing the
			 effectiveness of Federal, State, and local efforts to reduce the number of
			 seclusion and physical restraint incidents in schools;</text>
					</paragraph><paragraph id="H2BB4568767C948AA90072EB96897EA55"><enum>(3)</enum><text>identifying the
			 types of programs and services that have demonstrated the greatest
			 effectiveness in preventing and reducing the number of physical restraint and
			 seclusion incidents in schools; and</text>
					</paragraph><paragraph id="H3B55CA4D131842729BBC9D69F501AE4E"><enum>(4)</enum><text>identifying
			 personnel training models with demonstrated success in preventing and reducing
			 the number of seclusion and physical restraint incidents in schools, including
			 models that emphasize positive behavioral interventions and supports and
			 de-escalation techniques over physical intervention.</text>
					</paragraph></subsection><subsection id="H3C6F2F5AB64A48AF8CC7D997AB6DD8FC"><enum>(b)</enum><header>Report</header><text>The
			 Secretary shall submit to the Committee on Education and Labor of the House of
			 Representatives and the Committee on Health, Education, Labor, and Pensions of
			 the Senate—</text>
					<paragraph id="HEC349510B83847F9814FBAB2A28DAF73"><enum>(1)</enum><text>an interim report
			 that summarizes the preliminary findings of the evaluation described in
			 <internal-xref idref="H5B35419C88324849A5987AF428C68754" legis-path="104.(a)">subsection (a)</internal-xref> not later than 3 years
			 after the date of enactment of this Act; and</text>
					</paragraph><paragraph id="H33B2A1BD6FA8481CBC7DD80379D01B2E"><enum>(2)</enum><text>a
			 final report of the findings of the evaluation not later than 5 years after the
			 date of the enactment of this Act.</text>
					</paragraph></subsection></section><section id="HCB9391299D454DFA9B4BCCCC4308D55A"><enum>106.</enum><header>Head Start
			 programs</header>
				<subsection id="HB82260D172994E42A15FCF01ED6728C6"><enum>(a)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services,
			 in consultation with the Secretary of Education, shall promulgate regulations
			 with respect to Head Start agencies administering Head Start programs under the
			 Head Start Act (42 U.S.C. 9801 et seq.) that establish requirements consistent
			 with—</text>
					<paragraph id="HD71F60DB9E4347C6B882096ABB6413D4"><enum>(1)</enum><text display-inline="yes-display-inline">the requirements established by regulations
			 promulgated pursuant to section 102(a); and</text>
					</paragraph><paragraph id="H27D7260A1E1A4FD98CAA2D34F3C92C57"><enum>(2)</enum><text>the reporting and
			 enforcement requirements described in subsections (b) and (c) of section
			 103.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H145C46B67916463B999684F4982759D6"><enum>(b)</enum><header>Grant
			 authority</header><text display-inline="yes-display-inline">From the amount
			 appropriated under <internal-xref legis-path="12.">section 109</internal-xref>,
			 the Secretary of Education may allocate funds to the Secretary of Health and
			 Human Services to assist the Head Start agencies in establishing, implementing,
			 and enforcing policies and procedures to meet the requirements established by
			 regulations promulgated pursuant to subsection (a).</text>
				</subsection></section><section commented="no" id="H3D403E1F92DF40698AC4E650A560ECAD"><enum>107.</enum><header>Rule of
			 authority</header>
				<subsection commented="no" id="idF2F8B43762734FD7B800FD77025DBBE5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Nothing in this Act
			 shall be construed to restrict or limit, or allow the Secretary to restrict or
			 limit, any other rights or remedies otherwise available to students or the
			 families of students under Federal or State law (including regulations).</text>
				</subsection><subsection commented="no" id="IDac66141368ab45afaa64adfc0828f60e"><enum>(b)</enum><header>Applicability</header>
					<paragraph commented="no" id="ID9c9884b5622f4641997cbbb43c0977a4"><enum>(1)</enum><header>Private
			 schools</header><text>Nothing in this Act shall be construed to affect any
			 private school that does not receive, or does not serve, any student who
			 receives a free appropriate public education at such school under subparagraph
			 (B) or (C) of section 612(a)(10) of the Individuals with Disabilities Education
			 Act (20 U.S.C. 1412(a)(10)(B), (C)).</text>
					</paragraph><paragraph commented="no" id="IDb79617429f134371922bcdd4f9784f65"><enum>(2)</enum><header>Home
			 schools</header><text>Nothing in this Act shall be construed to affect a home
			 school, whether or not a home school is treated as a private school or home
			 school under State law (including regulations), nor shall a parent who is
			 schooling a child at home be considered or classified as school personnel for
			 purposes of this Act.</text>
					</paragraph></subsection><subsection commented="no" id="id2C30C4D9E16949E48290AF0521DDD414"><enum>(c)</enum><header>Protection and
			 Advocacy Systems</header><text>Nothing in this Act shall be construed to limit
			 or expand the rights or authority of a protection and advocacy system, provided
			 under a covered provision as defined in section 101(7), to investigate,
			 monitor, and enforce protections for students who are eligible for protection
			 and advocacy services under such covered provision.</text>
				</subsection></section><section commented="no" id="id7A4DD3411BBD44FF9F79BB74810396B8"><enum>108.</enum><header>Limitation of
			 authority</header><text display-inline="no-display-inline">Nothing in this Act
			 shall be construed to restrict or limit, or allow the Secretary to restrict or
			 limit, any other rights or remedies otherwise available to students or parents
			 under Federal or State law (including regulations).</text>
			</section><section id="H9483A417ED9D42F9B1FED3EA903978DB"><enum>109.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as may be
			 necessary for fiscal year 2011 and each of the 4 succeeding fiscal
			 years.</text>
			</section></title><title id="idE3901D7A32334306B453EE8414594F42"><enum>II</enum><header>Amendments to
			 education laws</header>
			<section id="idA6C3F6393E8D4C7A84733B9BC9E51153"><enum>201.</enum><header>Elementary and
			 Secondary Education Act of 1965</header>
				<subsection id="idD3340859717441AFA4B7350B6F3C8D6F"><enum>(a)</enum><header>State plans and
			 State reports</header><text>Section 1111 of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6311) is amended—</text>

									</subparagraph><subparagraph id="id705DF6D792EE4CAAB7D5B9BD59639432"><enum>(B)</enum><text>provide technical
				assistance and training to local educational agencies to improve positive
				behavioral interventions and supports and to coordinate such interventions and
				supports with similar activities under the Individuals with Disabilities
				Education Act; and</text>
									</subparagraph><subparagraph id="id4D14128FAB964EEDB7842887825CB043"><enum>(C)</enum><text>evaluate the
				effects of providing positive behavioral interventions and
				supports.</text>
									</subparagraph></paragraph><after-quoted-block>;

						</subparagraph></paragraph><paragraph id="idE0D49337F6094085AA93C95EAE204EED"><enum>(2)</enum><text>in subsection

					<paragraph id="id870520FF41D84DB3BF18A29F27466AC5"><enum>(1)</enum><text>in subparagraph
			 (P), by striking <quote>and</quote> after the semicolon;</text>

			 Secondary Education Act of 1965 (20 U.S.C. 6314(b)(1)(B)(iii)(I)) is
			 amended—</text>

			 and recognition</header><text>Section 1117(a) of the Elementary and Secondary
			 Education Act of 1965 (20 U.S.C. 6317(a)) is amended—</text>
					<paragraph id="id82F896B1C6DF420B8345952AEA07D142"><enum>(1)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>

				established under part D of the Education Sciences Reform Act of 2002;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="idB62C9A959BF542EA83B7940A3F11519C" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">comprehensive centers established under the
				Educational Technical Assistance Act of 2002;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id6EEAFD47493C40E7AF476D5FA4227B70" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">comprehensive regional technical assistance
				centers and regional educational laboratories under section 941(h) of the
				Educational Research, Development, Dissemination, and Improvement Act of 1994
				(as such section existed on the day before the date of enactment of the
				Education Sciences Reform Act of 2002); and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id33468328EBB7403D9606B3F8D0BC2520" indent="up1"><enum>(iv)</enum><text display-inline="yes-display-inline">technical assistance centers on school-wide
				positive behavioral interventions and supports funded under section 665(b) of
				the Individuals with Disabilities Education Act; or</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC7F8E456346949AB9EA2E8445B76A4EF"><enum>(B)</enum><text display-inline="yes-display-inline">other providers of technical
				assistance.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="id9937245EC66A4C7793E868288E3C3F82"><enum>(2)</enum><text>in paragraph
			 (5)(B)—</text>
						<subparagraph id="id1E66ACCD93A4407499D731630662823E"><enum>(A)</enum><text>in clause (i), by

				improving school-wide positive behavioral interventions and supports and
				coordinating such interventions and supports with similar activities under the

			 paragraphs (6) through (14) as paragraphs (7) through (15), respectively;

					</paragraph></subsection><subsection id="id665E2073C20B47D1BD434D5EA48D68D5"><enum>(c)</enum><header>Accountability
			 for programs that prepare teachers</header><text>Section 205 of the Higher
			 Education Act of 1965 (20 U.S.C. 1022d) is amended—</text>
					<paragraph id="id39DB5DADDA344AE08EC345A2E5E4F2C7"><enum>(1)</enum><text>by striking
			 subparagraph (G) of subsection (a)(1) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="idBC13EEFC55414E08884AD3018D6B0AB0" style="OLC">
							<subparagraph id="id4B36FB32FCCF47D199A82834B4E0853B"><enum>(G)</enum><header>Teacher
				Training</header><text>A description of the activities that prepare general
				education and special education teachers to—</text>
								<clause id="id6C1A0ACC49B74740AC34BB5B9FF5558E"><enum>(i)</enum><text>teach students
				with disabilities effectively, including training related to participation as a
				member of individualized education program teams, as defined in section
				614(d)(1)(B) of the Individuals with Disabilities Education Act;</text>
								</clause><clause id="id361A8DBE70014A4BBE17B9FC00E4B13E"><enum>(ii)</enum><text>effectively
				implement positive behavioral interventions and supports; and</text>
								</clause><clause id="id7DFDCB42716543418A5933BD3E732CF7"><enum>(iii)</enum><text>effectively
				teach students who are limited English
				proficient.</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</paragraph><paragraph id="idBFE12D58C4F24FEB8FB4E28350D2FC06"><enum>(2)</enum><text>in subsection
			 (b)(1), by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idB4FA0688C4234C27B2FC233B50F39EF3" style="OLC">
							<subparagraph id="idEE2CAA0F1BB2436197B5777096500C19"><enum>(M)</enum><text>The extent to
				which teacher preparation programs prepare teachers, including general

				behavioral interventions and supports.</text>
