		<official-title>To extend the Emergency Contingency Fund for State
		  Temporary Assistance for Needy Families Programs, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Job Preservation for Parents in
			 Poverty Act</short-title></quote>.</text>
		</section><section id="HCE41CEED624B494F8A9DFE9C70B54CD7" section-type="subsequent-section"><enum>2.</enum><header>Extension and
			 modification of the TANF Emergency Fund</header>
			<subsection id="idD63B01A833784E40AA40D08E65ACE939"><enum>(a)</enum><header>Extension</header>
				<paragraph id="H4029AC69F14C489C8CF4FF8A2B17E688"><enum>(1)</enum><header>In
			 general</header><text>Section 403(c) of the Social Security Act (42 U.S.C.
			 603(c)) is amended—</text>
					<subparagraph id="H18880A96A27D484180AF2A637D1794E6"><enum>(A)</enum><text>in paragraph
			 (2)(A), by inserting <quote>, and for the first quarter of fiscal year 2011,
			 $500,000,000</quote> before <quote>for payment</quote>;</text>
					</subparagraph><subparagraph id="HEF56E2FEA2E84A57ABCF800AB1AA9780"><enum>(B)</enum><text>by striking
			 paragraph (2)(B) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HB3B5BDFE1EB94B799455AF8541549E54" style="OLC">
							<subparagraph id="H0350ADCD42F94B7B95AF9CB0BDB38F22"><enum>(B)</enum><header>Availability and
				use of funds</header>
								<clause id="H165B22264B5D4CD8AFDFEAAE392D9DA7"><enum>(i)</enum><header>Fiscal years
				2009 and 2010</header><text>The amounts appropriated to the Emergency Fund
				under subparagraph (A) for fiscal year 2009 shall remain available through
				fiscal year 2010 and shall be used to make grants to States in each of fiscal
				years 2009 and 2010 in accordance with paragraph (3), except that the amounts
				shall remain available through fiscal year 2011 to make grants and payments to
				States in accordance with paragraph (3)(C) to cover expenditures to subsidize
				employment positions held by individuals placed in the positions before fiscal
				year 2011.</text>
								</clause><clause id="H021168DB01DE48CE8C18E28AA4F6846D"><enum>(ii)</enum><header>Fiscal year
				2011</header><text display-inline="yes-display-inline">Subject to clause (iii),
				the amounts appropriated to the Emergency Fund under subparagraph (A) for the
				first quarter of fiscal year 2011 shall remain available through fiscal year
				2012 and shall be used to make grants to States based on expenditures in the
				first quarter of fiscal year 2011 for benefits and services provided in the
				first quarter of fiscal year 2011 in accordance with the requirements of
				paragraph (3).</text>
								</clause><clause id="HF72CEA08CA4F4A1984AC70A2C5EE2481"><enum>(iii)</enum><header>Reservation of
				funds</header><text>Of the amounts appropriated to the Emergency Fund under
				subparagraph (A) for the first quarter of fiscal year 2011, $500,000 shall be
				placed in reserve for use in fiscal year 2012, and shall be used to award
				grants for any expenditures described in this subsection incurred by States
				after December 31,
				2010.</text>
								</clause></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H983337AAC2E34CE9A5E974DD944DF4DC"><enum>(C)</enum><text>in paragraph
			 (2)(C), by striking <quote>2010</quote> and inserting
			 <quote>2012</quote>;</text>
					</subparagraph><subparagraph id="HE40DBAA71C8F4DC4B05EFA41C66304AC"><enum>(D)</enum><text>in paragraph
			 (3)—</text>
						<clause id="H0D414EC94E014BAE9BD45FB9C09E222F"><enum>(i)</enum><text>in
			 clause (i) of each of subparagraphs (A), (B), and (C)—</text>
							<subclause id="HA4FB6EF7DF7F469087C18B2D35D1C595"><enum>(I)</enum><text>by inserting
			 <quote>, and the first calendar quarter of fiscal year 2011,</quote> after
			 <quote>2009 or 2010,</quote>;</text>
							</subclause><subclause id="H3EA1592FD28B4B78A9D47F7245D30263"><enum>(II)</enum><text>by striking
			 <quote>and</quote> at the end of subclause (I);</text>
							</subclause><subclause id="H5F6DBB6F2EC74DD1BB1242147469FDE7"><enum>(III)</enum><text>by striking the
			 period at the end of subclause (II) and inserting <quote>; and</quote>;
			 and</text>
							</subclause><subclause id="HD5187EEB54B34AF991D8AB6365A46225"><enum>(IV)</enum><text>by adding at the
			 end the following:</text>
								<quoted-block display-inline="no-display-inline" id="HE4620AFDE3804197BC52A3EF914A0DF3" style="OLC">
									<subclause id="HCE07BF511BA6478AA3FCEE9B4A5047BC"><enum>(III)</enum><text display-inline="yes-display-inline">if the quarter is in fiscal year 2011, has
				provided the Secretary with such information as the Secretary may find
				necessary in order to make the determinations, or take any other action,
				described in paragraph (5)(C).</text>
									</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause><clause id="H7EC3391446DC4F4C88AC535AADCECDE8"><enum>(ii)</enum><text>in
			 subparagraph (C), by adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="HC181355C78C94DA7BC0B81690C9447CA" style="OLC">
								<clause id="H2B330BD06FA7481FB32924FA9CFAC059"><enum>(iv)</enum><header>Limitation on
				expenditures for subsidized employment</header><text display-inline="yes-display-inline">An expenditure for subsidized employment
				shall be taken into account under clause (ii) only if the expenditure is used
				to subsidize employment for—</text>
									<subclause id="H41D500BF96D4470896CD949D6132CD75"><enum>(I)</enum><text>a member of a
				needy family (without regard to whether the family is receiving assistance
				under the State program funded under this part); or</text>
									</subclause><subclause id="HCB63BAB7C81D46FC88880780239143E9"><enum>(II)</enum><text display-inline="yes-display-inline">an individual who has exhausted (or, within
				60 days, will exhaust) all rights to receive unemployment compensation under
				Federal and State law, and who is a member of a needy
				family.</text>
									</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="H90573969761F47D9B5760DDF0C1AC3FA"><enum>(E)</enum><text>by striking
			 paragraph (5) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="H35242F4670314A95883ED05037AF275B" style="OLC">
							<paragraph id="H7BF5292BEEC34D1DBA266C195FD893AF"><enum>(5)</enum><header>Limitations on
				payments; adjustment authority</header>
								<subparagraph id="H9E6EF45501FE43CB9AD6B407E236DE5A"><enum>(A)</enum><header>Fiscal years
				2009 and 2010</header><text display-inline="yes-display-inline">The total
				amount payable to a single State under subsection (b) and this subsection for
				fiscal years 2009 and 2010 combined shall not exceed 50 percent of the annual
				State family assistance grant.</text>
								</subparagraph><subparagraph id="H30CBFC0F8B244FDB809BB6D78114C546"><enum>(B)</enum><header>Fiscal year
				2011</header><text>Subject to subparagraph (C), the total amount payable to a
				single State under subsection (b) and this subsection for the first quarter of
				fiscal year 2011 shall not exceed 5 percent of the annual State family
				assistance grant.</text>
								</subparagraph><subparagraph id="HA63A28743436498EAD19DE54A40EB102"><enum>(C)</enum><header>Adjustment
				authority</header><text display-inline="yes-display-inline">If the Secretary
				determines that the Emergency Fund is at risk of being depleted before December
				31, 2010, or that funds are available to accommodate additional State requests
				under this subsection, the Secretary may, through program instructions issued
				without regard to the requirements of section 553 of title 5, United States
				Code—</text>
									<clause id="HF4B3A2008D5D4CE19818B23E7803ECEB"><enum>(i)</enum><text>specify priority
				criteria for awarding grants to States during the first quarter of fiscal year
				2011; and</text>
									</clause><clause id="HAD3BCD50E4184362B13307DA07598222"><enum>(ii)</enum><text>adjust the
				percentage limitation applicable under subparagraph (B) with respect to the
				total amount payable to a single State for the first quarter of fiscal year
				2011.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H27DEFBB6BE3A41AD93FA78D22C4DCC3E"><enum>(F)</enum><text>in paragraph (6),
			 by inserting <quote>or for expenditures described in paragraph
			 (3)(C)(iv)</quote> before the period.</text>
					</subparagraph></paragraph><paragraph id="HC326D225C83F4877A5A79888D36993E7"><enum>(2)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 2101 of
			 division B of the American Recovery and Reinvestment Act of 2009 (Public Law
			 111–5) is amended—</text>
					<subparagraph id="H37C268CE45884E01901D733DD5D0470E"><enum>(A)</enum><text>in subsection
			 (a)(2)—</text>
						<clause id="HA1B039D4969C4E7AA0C95DCB8A459AE0"><enum>(i)</enum><text>by
			 striking <quote>October 1, 2010</quote> and inserting <quote>January 1,
			 2011</quote>; and</text>
						</clause><clause id="HAF6BEE292AE648AAB3520A7A5860D691"><enum>(ii)</enum><text>by
			 striking all that follows <quote>repealed</quote> and inserting a period;
			 and</text>
						</clause></subparagraph><subparagraph id="HAF83FE7C35924481B34103C7F36C2A01"><enum>(B)</enum><text>in subsection
			 (d)(1), by striking <quote>October 1, 2010</quote> and inserting <quote>January
			 1, 2011</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id36D259E90B6148D68B61DDF1FE1B78CE"><enum>(b)</enum><header>Modification of
			 grant requirements</header>
				<paragraph commented="no" id="id4B214E944738401688FB0D0F5332E374"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Effective October 1,
			 2010, section 403(c) of the Social Security Act (42 U.S.C. 603(c)), as amended
			 by subsection (a), is amended—</text>
					<subparagraph commented="no" id="id46A3217BC73A4F88AC7B4B7F2B7E7903"><enum>(A)</enum><text>in paragraph
			 (3)(A)—</text>
						<clause commented="no" id="idB040772F5EA94C299E759E8C3DCC83E2"><enum>(i)</enum><text>by striking
			 <quote><header-in-text level="subparagraph" style="OLC">related to caseload
			 increases</header-in-text></quote> in the heading and inserting
			 <quote><header-in-text level="subparagraph" style="OLC">related to increased
			 expenditures</header-in-text></quote>;</text>
						</clause><clause commented="no" id="id6C9310FAE945405894A85A48C141600C"><enum>(ii)</enum><text>by striking
			 clause (ii) and redesignating clause (iii) as clause (ii); and</text>
						</clause><clause commented="no" id="id3B130E1D674849AABA4C505079E51EC5"><enum>(iii)</enum><text>by striking
			 <quote>each State that</quote> and all that follows in clause (i) and inserting
			 <quote>each State that requests a grant under this subparagraph for the
			 quarter, to the extent provided in clause (ii)</quote>;</text>
						</clause></subparagraph><subparagraph commented="no" id="idAC720FCDEE7E4B54BAA2DCEA0E682D82"><enum>(B)</enum><text>in paragraph (4),
			 by striking <quote>the caseload of a State and</quote>; and</text>
					</subparagraph><subparagraph commented="no" id="idA6659A15E8F84BF4875A781A9A8AEEB9"><enum>(C)</enum><text>in paragraph
			 (9)—</text>
						<clause commented="no" id="id9F1879D23B33411FBB4D163E67FE283B"><enum>(i)</enum><text>by striking
			 subparagraph (A) and redesignating subparagraphs (B) and (C) as subparagraphs
			 (A) and (B), respectively; and</text>
						</clause><clause commented="no" id="idA08E5305E84841179E2479BD94F334F1"><enum>(ii)</enum><text>by striking
			 <quote>The average monthly assistance caseload of the State.</quote> in clause
			 (ii)(I) and inserting <quote>The average quarterly total expenditures of the
			 State for basic assistance (as defined by the Secretary under paragraph
			 (3)(A)(ii)).</quote>.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="id3D627A70E4564900B5ABCBCEC77295F0"><enum>(2)</enum><header>Conforming
			 amendments</header><text>Effective October 1, 2010, section 407(b)(3) of the
			 Social Security Act (42 U.S.C. 607(b)(3)) is amended—</text>
					<subparagraph commented="no" id="id723CEDE49F2240018E47E532F847A614"><enum>(A)</enum><text>by striking
			 <quote>(within the meaning of section 403(c)(9))</quote> in subparagraph
			 (A)(i); and</text>
					</subparagraph><subparagraph commented="no" id="id192E956CCBAC46C9972B5748BA83DAF3"><enum>(B)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block act-name="" id="id20B32FFF3A3B4FF39A75F6C148157893" style="OLC">
							<subparagraph id="id16EC0E88002B4BAFBA2DB18FEFD5D4B7"><enum>(C)</enum><header>Average monthly
				assistance caseload</header><text>For purposes of this paragraph, the term
				<term>average monthly assistance caseload</term> means, with respect to a State
				and a quarter, the number of families receiving assistance during the quarter
				under the State program funded under this part or as qualified State
				expenditures, subject to adjustment by the Secretary as permitted by section
				403(c)(4).</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H7B030AA96AA74A6DA9108DEE68B8A4AF"><enum>(c)</enum><header>Program
			 guidance</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall issue program guidance, without regard to the
			 requirements of section 553 of title 5, United States Code, which ensures that
			 the funds provided under the amendments made by this section to a jurisdiction
			 for subsidized employment do not support any subsidized employment position the
			 annual salary of which is greater than, at State option—</text>
				<paragraph id="HFD54F071FF9B48D19A8E641B733482B6"><enum>(1)</enum><text display-inline="yes-display-inline">200 percent of the poverty line (within the
			 meaning of section 673(2) of the Omnibus Budget Reconciliation Act of 1981,
			 including any revision required by such section 673(2)) for a family of 4;
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H82DB3BE15D6A49BB8414A39ADAD34FB5"><enum>(2)</enum><text>the median wage in
			 the jurisdiction.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idDF25E627C25D4EE78EAD608347934729"><enum>3.</enum><header>Funding level of
			 TANF Contingency Fund</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the total amount appropriated for the Contingency Fund for State Welfare
			 Programs established under section 403(b) of the Social Security Act (42 U.S.C.
			 603(b)) shall be—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id878C6779BE244A2AAE1F8A3D1D0B94AB"><enum>(1)</enum><text>for fiscal year
			 2012, $112,000,000; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C4D614186B24EFA8D980A89063354AD"><enum>(2)</enum><text>for fiscal year
			 2013, $612,000,000.</text>
