		<official-title>To repeal the CLASS Act.</official-title>

		<section id="idCD70CF5AEC514311AAFD1B1AA0FA37B3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Long-Term Care Bailout Prevention
			 Act</short-title></quote>.</text>
		</section><section id="id8BC3776512B040E2AE2BEE68630C9F83"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="ID37716fb6d0b24940add18ebae90259b5"><enum>(1)</enum><text>According to an
			 August 2010 survey by the National Business Group on Health, only 3 percent of
			 employers would participate in the CLASS program.</text>
			</paragraph><paragraph id="ID2d727cee87854b75a30c87eec4ba76ad"><enum>(2)</enum><text>While the CLASS
			 program is projected to create an initial surplus that is used to pay for the
			 programs created by the Patient Protection and Affordable Care Act, the Chief
			 Actuary of the Centers for Medicare &amp; Medicaid Services (CMS) has stated
			 that by 2025, benefit payments will exceed premium revenues and the CLASS
			 program will run deficits. This financing mechanism has even been referred to
			 as a Ponzi scheme.</text>
			</paragraph><paragraph id="ID94fc2184aeb34ba7965a9a0a649b1ec2"><enum>(3)</enum><text>The CMS Chief
			 Actuary has said, <quote>In general, voluntary, unsubsidized, and
			 non-underwritten insurance programs such as CLASS face a significant risk of
			 failure as a result of adverse selection by participants.</quote>.</text>
			</paragraph><paragraph id="IDfe77c667e6bf4542b3a7f6f2bfdd8ff1"><enum>(4)</enum><text>Because of the
			 downward spiral created by adverse selection, the program could go bankrupt and
			 the Secretary of Health and Human Services could be forced to drastically
			 increase premiums to unaffordable levels or taxpayers could be asked to bailout
			 the CLASS program.</text>
			</paragraph><paragraph id="IDab919dd1744a4026a193689eeb4ae7f8"><enum>(5)</enum><text>The alternatives
			 described in paragraph (4) are unacceptable so the program must be
			 repealed.</text>
			</paragraph></section><section id="id1739AF4D95104858A99CEBD937F21199"><enum>3.</enum><header>Repeal of the
			 CLASS Act</header><text display-inline="no-display-inline">Title VIII of the
			 Patient Protection and Affordable Care Act (Public Law 111–148) and the
			 amendments made by such title are repealed.</text>
