		<official-title display="yes">To combat online infringement, and for
		  other purposes.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Combating Online Infringement and
			 Counterfeits Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID0cb2ebb4d423424dab1d06ab9c5e191b" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Internet sites dedicated to infringing
			 activities</header><text display-inline="no-display-inline">Chapter 113 of
			 title 18, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="id262564BBBD1E4C11A341B66AA432DB20" style="USC">
				<section commented="no" display-inline="no-display-inline" id="ID0c787cfdb4aa4a3bae4b20a2e4ad7172" section-type="subsequent-section"><enum>2324.</enum><header display-inline="yes-display-inline">Internet sites dedicated to infringing
				activities</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID78f3c1058a12413697f558dbba997c0a"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">For purposes of this section, an Internet
				site is <quote>dedicated to infringing activities</quote> if such site—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID6aaaf0d96f774da6adc8a559df33448f"><enum>(1)</enum><text display-inline="yes-display-inline">is otherwise subject to civil forfeiture to
				the United States Government under section 2323; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0cb0faed04394eeda3cf53b047420159"><enum>(2)</enum><text display-inline="yes-display-inline">is—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idAA77426C49BF477AAD5270634C30DC45"><enum>(A)</enum><text display-inline="yes-display-inline">primarily designed, has no demonstrable,
				commercially significant purpose or use other than, or is marketed by its
				operator, or by a person acting in concert with the operator, to offer—</text>
								<clause commented="no" display-inline="no-display-inline" id="id1FAD18418B9E4C3EAD4CFFD920DC91C5"><enum>(i)</enum><text display-inline="yes-display-inline">goods or services in violation of title 17,
				United States Code, or enable or facilitate a violation of title 17, United
				States Code, including by offering or providing access to, without the
				authorization of the copyright owner or otherwise by operation of law, copies
				of, or public performance or display of, works protected by title 17, in
				complete or substantially complete form, by any means, including by means of
				download, transmission, or otherwise, including the provision of a link or
				aggregated links to other sites or Internet resources for obtaining such copies
				for accessing such performance or displays; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id09462C384B464C47A5B81C2473BF4ACF"><enum>(ii)</enum><text display-inline="yes-display-inline">to sell or distribute goods, services, or
				materials bearing a counterfeit mark, as that term is defined in section 34(d)
				of the Act entitled <quote>An Act to provide for the registration and
				protection of trademarks used in commerce, to carry out the provisions of
				certain international conventions, and for other purposes</quote>, approved
				July 5, 1946 (commonly referred to as the <quote>Trademark Act of 1946</quote>
				or the <quote>Lanham Act</quote>; 15 U.S.C. 1116(d)); and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8E4B6798E0C947398864C3AF29EEE3ED"><enum>(B)</enum><text display-inline="yes-display-inline">engaged in the activities described in
				subparagraph (A), and when taken together, such activities are central to the
				activity of the Internet site or sites accessed through a specific domain
				name.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf7396d67713e44b2a2ca668012899484"><enum>(b)</enum><header display-inline="yes-display-inline">Injunctive relief</header><text display-inline="yes-display-inline">On application of the Attorney General
				following the commencement of an action pursuant to subsection (c), the court
				may issue a temporary restraining order, a preliminary injunction, or an
				injunction against the domain name used by an Internet site dedicated to
				infringing activities to cease and desist from undertaking any infringing
				activity in violation of this section, in accordance with rule 65 of the
				Federal Rules of Civil Procedure. A party described in subsection (e) receiving
				an order issued pursuant to this section shall take the appropriate actions
				described in subsection (e).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDa6b8459d4a874a58abc7402a11e0e36a"><enum>(c)</enum><header display-inline="yes-display-inline">In rem action</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idEAFA236F43224C82832BF7781D28A1D9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General may commence an in rem
				action against any domain name used by an Internet site in the judicial
				district in which the domain name registrar or domain name registry is located,
				or, if pursuant to subsection (d)(2), in the District of Columbia, if—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDe74b2caee8ea49e895e98ff706b5acbd"><enum>(A)</enum><text display-inline="yes-display-inline">the domain name is dedicated to infringing
				activities; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc6fd08729481453ab355770761c68383"><enum>(B)</enum><text display-inline="yes-display-inline">the Attorney General simultaneously—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID9e7f1f5f749d47e4b715aeda59612d03"><enum>(i)</enum><text display-inline="yes-display-inline">sends a notice of the alleged violation and
				intent to proceed under this subsection to the registrant of the domain name at
				the postal and e-mail address provided by the registrant to the registrar, if
				available; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID10d7313b151547c2b704d2c8b40cb87c"><enum>(ii)</enum><text display-inline="yes-display-inline">publishes notice of the action as the court
				may direct promptly after filing the action.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD220659A563E45BB969293AEF835D681"><enum>(2)</enum><header display-inline="yes-display-inline">Service of process</header><text display-inline="yes-display-inline">For purposes of this section, the actions
				described under paragraph (1)(B) shall constitute service of process.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDdbda5ca0691f4a93afc90144b92438c4"><enum>(d)</enum><header display-inline="yes-display-inline">Situs</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id0F083DF10AFB40F19153CA707751BD74"><enum>(1)</enum><header display-inline="yes-display-inline">Domains for which the registry or registrar
				is located domestically</header><text display-inline="yes-display-inline">In an
				in rem action commenced under subsection (c), a domain name shall be deemed to
				have its situs in the judicial district in which—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id68B60087C2054D568ED18068407B4538"><enum>(A)</enum><text display-inline="yes-display-inline">the domain name registrar or registry is
				located, provided that for a registry that is located in more than 1 judicial
				district, venue shall be appropriate at the principal place where the registry
				operations are performed; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3FE086E244954B6C8C00F2D2D45538BC"><enum>(B)</enum><text display-inline="yes-display-inline">documents sufficient to establish control
				and authority regarding the disposition of the registration and use of the
				domain name are deposited with the court.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7F77FB3466D44BA9A2D5C1E87216518C"><enum>(2)</enum><header display-inline="yes-display-inline">Domains for which the registry or registrar
				is not located domestically</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id091E02B55EBE41F2937ABAD6B6CA56E1"><enum>(A)</enum><header display-inline="yes-display-inline">Action brought in District of
				Columbia</header><text display-inline="yes-display-inline">If the provisions of
				paragraph (1) do not apply to a particular domain name, the in rem action may
				be brought in the District of Columbia to prevent the importation into the
				United States of goods and services offered by an Internet site dedicated to
				infringing activities if—</text>
								<clause commented="no" display-inline="no-display-inline" id="idA8BC5CCCD9F14134B45FB1E1ED1B60FF"><enum>(i)</enum><text display-inline="yes-display-inline">the domain name is used to access such
				Internet site in the United States; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id72A645C241734B6DA3B6B3A8947B6497"><enum>(ii)</enum><text display-inline="yes-display-inline">the Internet site—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id350F6944D7BB4AFA9EFFDEE4993C3344"><enum>(I)</enum><text display-inline="yes-display-inline">conducts business directed to residents of
				the United States; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idE4837D68141C4819BD176164318F6E0D"><enum>(II)</enum><text display-inline="yes-display-inline">harms intellectual property rights holders
				that are residents of the United States.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37FE046A2A184FE5A891B8EB43AB2C3C"><enum>(B)</enum><header display-inline="yes-display-inline">Determination by the court</header><text display-inline="yes-display-inline">For purposes of determining whether an
				Internet site conducts business directed to residents of the United States
				under subparagraph (A)(ii)(I), a court shall consider, among other indicia
				whether—</text>
								<clause commented="no" display-inline="no-display-inline" id="id9EB1DE15F57440C2B4114B9717FF9168"><enum>(i)</enum><text display-inline="yes-display-inline">the Internet site is actually providing
				goods or services to subscribers located in the United States;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idFE07FDE4FE9A4152B9EB9E8216E6F4D1"><enum>(ii)</enum><text display-inline="yes-display-inline">the Internet site states that it is not
				intended, and has measures to prevent, infringing material from being accessed
				in or delivered to the United States;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id65791E3C60934147A3EA060B4B97602E"><enum>(iii)</enum><text display-inline="yes-display-inline">the Internet site offers services
				accessible in the United States; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idC22DB6521087450EA03C4FBCD3326809"><enum>(iv)</enum><text display-inline="yes-display-inline">any prices for goods and services are
				indicated in the currency of the United States.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7f21c56df47446d98abda3391fd843db"><enum>(e)</enum><header display-inline="yes-display-inline">Service of court order</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idF1AD990997054DE5972AF04908B92707"><enum>(1)</enum><header display-inline="yes-display-inline">Domestic domains</header><text display-inline="yes-display-inline">In an in rem action to which subsection
				(d)(1) applies, the Attorney General shall serve any court order issued
				pursuant to this section on the domain name registrar or, if the domain name
				registrar is not located within the United States, upon the registry. Upon
				receipt of such order, the domain name registrar or domain name registry shall
				suspend operation of, and lock, the domain name.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id037A02D64E6A404A9A947361C0191598"><enum>(2)</enum><header display-inline="yes-display-inline">Nondomestic domains</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idE012AFFCE944489083096AD9FB504B51"><enum>(A)</enum><header display-inline="yes-display-inline">Entity to be served</header><text display-inline="yes-display-inline">In an in rem action to which subsection
				(d)(2) applies, the Attorney General may serve any court order issued pursuant
				to this section on any entity listed in clauses (i) through (iii) of
				subparagraph (B).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF3EC4CEA4A3A454C96E86006910727CB"><enum>(B)</enum><header display-inline="yes-display-inline">Required actions</header><text display-inline="yes-display-inline">Upon receipt of a court order issued
				pursuant to this section—</text>
								<clause commented="no" display-inline="no-display-inline" id="idA90110B44B604072BFFD7835A40DC097"><enum>(i)</enum><text display-inline="yes-display-inline">a service provider, as that term is defined
				in section 512(k)(1) of title 17, United States Code, or other operator of a
				domain name system server shall take reasonable steps that will prevent a
				domain name from resolving to that domain name’s Internet protocol
				address;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id19988544D5CD42F9AD907DF087E2F6D8"><enum>(ii)</enum><text display-inline="yes-display-inline">a financial transaction provider, as that
				term is defined in section 5362(4) of title 31, United States Code, shall take
				reasonable measures, as expeditiously as practical, to prevent—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id10D19867272D43A3B4E216B799AFFA24"><enum>(I)</enum><text display-inline="yes-display-inline">its service from processing transactions
				for customers located within the United States based on purchases associated
				with the domain name; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id3A743B181F594CE4BDE4C73F3DAFA8F1"><enum>(II)</enum><text display-inline="yes-display-inline">its trademarks from being authorized for
				use on Internet sites associated with such domain name; and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id787488BBE3A042618071FC2A31A50207"><enum>(iii)</enum><text display-inline="yes-display-inline">a service that serves contextual or display
				advertisements to Internet sites shall take reasonable measures, as
				expeditiously as practical, to prevent its network from serving advertisements
				to an Internet site accessed through such domain name.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id245398B359F54F8497F705057307D302"><enum>(3)</enum><header display-inline="yes-display-inline">Immunity</header><text display-inline="yes-display-inline">No cause of action shall lie in any Federal
				or State court or administrative agency against any entity receiving a court
				order issued under this section, or against any director, officer, employee, or
				agent thereof, for any action reasonably calculated to comply with this section
				or arising from such order.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDa4a39a1508f14439b8fde13fb27a4445"><enum>(f)</enum><header display-inline="yes-display-inline">Publication of orders</header><text display-inline="yes-display-inline">The Attorney General shall inform the
				Intellectual Property Enforcement Coordinator of all court orders issued under
				this section directed to specific domain names associated with Internet sites
				dedicated to infringing activities. The Intellectual Property Enforcement
				Coordinator shall post such domain names on a publicly available Internet site,
				together with other relevant information, in order to inform the public.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID21908146bf9347a5a9ba8174b4c79f06"><enum>(g)</enum><header display-inline="yes-display-inline">Enforcement of orders</header><text display-inline="yes-display-inline">In order to compel compliance with this
				section, the Attorney General may bring an action against any party receiving a
				court order issued pursuant to this section that willfully or persistently
				fails to comply with such order. A showing by the defending party in such
				action that it does not have the technical means to comply with this section
				shall serve as a complete defense to such action.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4526adc1e9354280bf5dd40793593062"><enum>(h)</enum><header display-inline="yes-display-inline">Modification or vacation of orders;
				dismissal</header>
						<paragraph commented="no" display-inline="no-display-inline" id="id4E7A7C66A3BC4E7B97DC84C760F40163"><enum>(1)</enum><header display-inline="yes-display-inline">Modification or vacation of
				order</header><text display-inline="yes-display-inline">At any time after the
				issuance of a court order constituting injunctive relief under this
				section—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5dc736ca5a9846b4a845338595f39577"><enum>(A)</enum><text display-inline="yes-display-inline">the Attorney General may apply for a
				modification of the order—</text>
								<clause commented="no" display-inline="no-display-inline" id="idE5C615CEB35B40A68475A625CB32FC4F"><enum>(i)</enum><text display-inline="yes-display-inline">to expand the order to apply to a domain
				name that is reconstituted using a different domain name subsequent to the
				original order, and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idAF93C540D5AA48A098AF2A4533C3C9E8"><enum>(ii)</enum><text display-inline="yes-display-inline">to include additional domain names that are
				used in substantially the same manner as the Internet site against which the
				action was brought,</text>
								</clause><continuation-text commented="no" continuation-text-level="subparagraph">by providing the court with clear
				indicia of joint control, ownership, or operation of the Internet site
				associated with the domain name subject to the order and the Internet site
				associated with the requested modification; and</continuation-text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID01d832fb82f64b97a9a15d4ee2e324e1"><enum>(B)</enum><text display-inline="yes-display-inline">a defendant or owner or operator of a
				domain name subject to the order, or any party required to take action based on
				the order, may petition the court to modify, suspend, or vacate the order,
				based on evidence that—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID97cb94a632ae43f1aaa2f9ca04fb4a94"><enum>(i)</enum><text display-inline="yes-display-inline">the Internet site associated with the
				domain name subject to the order is no longer dedicated to infringing
				activities; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID78938cc7b9f2434b8da3dc7e0a173f1d"><enum>(ii)</enum><text display-inline="yes-display-inline">the interests of justice require that the
				order be modified, suspended, or vacated.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDef4879dfe29a40588df1354c7922d27f"><enum>(2)</enum><header display-inline="yes-display-inline">Dismissal of order</header><text display-inline="yes-display-inline">A court order constituting injunctive
				relief under this section issued against a domain name used by an Internet site
				dedicated to infringing activities shall automatically cease to have any force
				or effect upon expiration of the registration of the domain name. It shall be
				the responsibility of the domain name registrar to notify the court of such
				expiration.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2da5db54cd5b45db8e1d4cd2ae00b548"><enum>(i)</enum><header display-inline="yes-display-inline">Savings
				clause</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed to limit civil or criminal remedies available to any
				person (including the United States) for infringing activities on the Internet
				pursuant to any other Federal or State law.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID99550b2851dd475bb8c7bb995bd827e6"><enum>(j)</enum><header display-inline="yes-display-inline">Internet sites alleged by the Department of
				Justice To be dedicated to infringing activities</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idF623BBF6FF504419B64EDA50D7DEBBFE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Attorney General shall maintain a
				public listing of domain names that, upon information and reasonable belief,
				the Department of Justice determines are dedicated to infringing activities but
				for which the Attorney General has not filed an action under this
				section.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4A2A742462D4E77B457B496E599F987"><enum>(2)</enum><header display-inline="yes-display-inline">Protection for undertaking corrective
				measures</header><text display-inline="yes-display-inline">If an entity
				described under subsection (e) takes any action specified in such subsection
				with respect to a domain name that appears on the list established under
				paragraph (1), then such entity shall receive the immunity protections
				described under subsection (e)(3).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3CDD58CE3CDE4755ACBE00BEF6BC3EE0"><enum>(3)</enum><header display-inline="yes-display-inline">Removal from list</header><text display-inline="yes-display-inline">The Attorney General shall establish and
				publish procedures for the owner or operator of a domain name appearing on the
				list established under paragraph (1) to petition the Attorney General to remove
				such domain name from the list based on any of the factors described under
				subsection (h)(1)(B).</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6d34e77438cf4894afa45bfe23dc1315"><enum>(4)</enum><header display-inline="yes-display-inline">Judicial review</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID1ddba138af354cd1b8acf6053a4548d0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After the Attorney General makes a final
				determination on a petition to remove a domain name appearing on the list
				established under paragraph (1) filed by an individual pursuant to the
				procedures referred to in paragraph (3), the individual may obtain judicial
				review of such determination in a civil action commenced not later than 90 days
				after notice of such decision, or such further time as the Attorney General may
				allow.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDedad676e55c347009fecd8224ee8f6d5"><enum>(B)</enum><header display-inline="yes-display-inline">Jurisdiction</header><text display-inline="yes-display-inline">A civil action for such judicial review
				shall be brought in the district court of the United States for the judicial
				district in which the plaintiff resides, or has a principal place of business,
				or, if the plaintiff does not reside or have a principal place of business
				within any such judicial district, in the District Court of the United States
				for the District of Columbia.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID237d8b631f85495aaf61757a9b1a7c6c"><enum>(C)</enum><header display-inline="yes-display-inline">Answer</header><text display-inline="yes-display-inline">As part of the Attorney General’s answer to
				a complaint for such judicial review, the Attorney General shall file a
				certified copy of the administrative record compiled pursuant to the petition
				to remove, including the evidence upon which the findings and decision

				the pleadings and transcript of the record, a judgment affirming or reversing
				the result of the Attorney General's determination on the petition to remove,
				with or without remanding the cause for a
				rehearing.</text>
							</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID6db4f4a735d8479e9bdff4b06b38a5bb" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Required actions by the Attorney
			 General</header><text display-inline="no-display-inline">The Attorney General
			 shall—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idB4A938B507CF481E9A5A339EBA923774"><enum>(1)</enum><text display-inline="yes-display-inline">publish procedures to receive information
			 from the public about Internet sites that are dedicated to infringing
			 activities, as that term is defined under section 2324 of title 18, United
			 States Code;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB356B9DC321A477EA319B79AC473794D"><enum>(2)</enum><text display-inline="yes-display-inline">provide guidance to intellectual property
			 rights holders about what information such rights holders should provide the
			 Department of Justice to initiate an investigation pursuant to such section
			 2324;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id610616B0F3244ED79EBEFF6FD17B3AE4"><enum>(3)</enum><text display-inline="yes-display-inline">provide guidance to intellectual property
			 rights holders about how to supplement an ongoing investigation initiated
			 pursuant to such section 2324;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09A3CA238DFE470FA0725010E14D883C"><enum>(4)</enum><text display-inline="yes-display-inline">establish standards for prioritization of
			 actions brought under such section 2324; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id606DFD7571A540FAA5511F966F386686"><enum>(5)</enum><text display-inline="yes-display-inline">provide appropriate resources and
			 procedures for case management and development to affect timely disposition of
			 actions brought under such section 2324.</text>
