		<section id="id9DA8CA762634436990B11732282CC06E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improving Student Testing Act of
			 2010</short-title></quote>.</text>
		</section><section id="ID96abc4ff90b740ebafa702c96b649c56"><enum>2.</enum><header>Improvements to
			 formula grants for creating and implementing high-quality and innovative
			 assessments</header><text display-inline="no-display-inline">Section 6111 of
			 the Elementary and Secondary Education Act of 1965 (20 U.S.C. 7301) is
			 amended—</text>
			<paragraph id="id72AE4CA254AF4865A606FC8AF76F916B"><enum>(1)</enum><text>by striking
			 <quote>The Secretary</quote> and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id53F109F62ECA42A1977FC322F3903053" style="OLC">
					<subsection id="id127E471FF89B4A06AFA9F3A88D3C9604"><enum>(a)</enum><header>In
				general</header><text>The
				Secretary</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idE4947BD17A8A49D6A8E91C0D8578BDD7"><enum>(2)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAC9F957FA1BA4C7A8DAB360A6974C7B6" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDA59179ED6018498497C754231EF80012"><enum>(1)</enum><text display-inline="yes-display-inline">to pay the costs of the development of the
				additional State assessments and standards required by section 1111(b), which
				may include the costs of working in voluntary partnerships with other States,
				at the sole discretion of each such State, and which may also include—</text>
						<subparagraph id="IDf554c01a3a5545949b9031e326bfd321"><enum>(A)</enum><text>partnering with
				institutions of higher education and nonprofit organizations to design and
				implement high-quality and innovative assessments, including performance
				assessments, technology-based assessments, through-course assessments, adaptive
				assessments, and appropriate assessments for students with disabilities and
				English language learners;</text>
						</subparagraph><subparagraph id="ID1d2d322feac94aca9b26a630104aad77"><enum>(B)</enum><text>aligning
				high-quality and innovative assessments with the common core standards or State
				challenging academic content standards and challenging student academic
				achievement standards;</text>
						</subparagraph><subparagraph id="IDbecf40718eeb498aab55c74d7711cf11"><enum>(C)</enum><text>partnering with
				institutions of higher education and other nonprofit entities with experience
				in high-quality professional development to train teachers and principals
				in—</text>
							<clause id="ID8d8ef6a67f58416bb03907247a5d3b25"><enum>(i)</enum><text>how to design
				balanced assessment systems that include summative, interim, and formative
				assessments;</text>
							</clause><clause id="IDd1953ae06e4745e985310551709c5943"><enum>(ii)</enum><text>how to
				effectively embed high-quality and innovative assessments in classroom
				instruction;</text>
							</clause><clause id="ID0bdf739132ee47c0bc53e6365b0be217"><enum>(iii)</enum><text>how to
				interpret the data generated by multiple types of assessments; and</text>
							</clause><clause id="IDa5578f0b163645d38495c204c5f409d5"><enum>(iv)</enum><text>how to use the
				data generated by assessments to improve student achievement;</text>
							</clause></subparagraph><subparagraph id="ID6fdf486b79444880b44f7fe6b8adc1da"><enum>(D)</enum><text>designing and
				implementing alternative assessments that are fair, valid, and reliable for
				students with disabilities and English language learners;</text>
						</subparagraph><subparagraph id="IDb33fa848ae564a1194614b6b789530c4"><enum>(E)</enum><text>developing
				scoring mechanisms that enable high-quality and innovative assessments to be
				scored in such a way as to produce fair, valid, reliable, and comparable
				results for all students;</text>
						</subparagraph><subparagraph id="IDee6965e2b84b4317b75aa89137d58d2a"><enum>(F)</enum><text>integrating the
				use of technology in both the design, implementation, and scoring of
				assessments;</text>
						</subparagraph><subparagraph id="IDa3230e4b22654b759c631891cc6fde3e"><enum>(G)</enum><text>implementing
				assessment systems that use multiple sources of evidence collected throughout
				the course of a school year for the purposes of calculating adequate yearly
				progress under section 1111(b)(2)(C); and</text>
						</subparagraph><subparagraph id="IDb4136432b90f4e9a843fd99fa1a88d5d"><enum>(H)</enum><text>collaborating
				with other State educational agencies to share information and best practices
				about assessment design and implementation;
				and</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="IDfa2430d5591a42eabe70b7aca8acf44b"><enum>(3)</enum><text>in paragraph (2),
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA7F76E046FAF41C28902A87CFE70C747" style="OLC">
					<subclause id="IDf9584ce4843846e3ab49bcf23371b79d"><enum>(I)</enum><text>Developing and
				administering formative and interim assessments to help measure student growth,
				improve classroom instruction, and provide timely feedback to teachers,
				principals, and parents during the academic
				year.</text>
					</subclause><after-quoted-block>. </after-quoted-block></quoted-block>
			</paragraph></section><section id="id06CBD16DC880466FB7A021A3CC1B5092" section-type="subsequent-section"><enum>3.</enum><header>Competitive grants for
			 creating and implementing innovative assessments</header>
			<subsection id="id7647E4CF5CD542C79BB37A0BBCCA50E0"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 6112 of the
			 Elementary and Secondary Education Act of 1965 (20 U.S.C. 7301a) is amended to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id2FA2DC095F0B4366A88E148C3EB3CB7C" style="OLC">
					<section id="id743DEE4B18C3410299CB04E2AD330710" section-type="subsequent-section"><enum>6112.</enum><header>Competitive grants
				for creating and implementing innovative assessments</header>
						<subsection id="ID1433a791c4dc4b5d9fd4ec11aeb85ebd"><enum>(a)</enum><header>Purposes</header><text>The
				purposes of this section are as follows:</text>
							<paragraph id="IDdbc773b60140412d9c751e2baee54f1e"><enum>(1)</enum><text>To provide
				additional resources to States and State educational agencies so that
				accountability decisions about students and schools are based on well-designed
				multiple measures rather than 1 high stakes standardized test.</text>
							</paragraph><paragraph id="IDec0bdd9e3f024d39a65bab65ba6ffdb8"><enum>(2)</enum><text>To assist States,
				State educational agencies, local educational agencies, and schools in the
				design and implementation of high-quality and innovative assessments, including
				technology-based assessments, adaptive assessments, formative assessments,
				performance assessments, standardized portfolio assessments, interim
				assessments, appropriate assessments for students with disabilities and English
				language learners, through-course assessments, and other assessments that
				measure higher-order thinking skills and are aligned with common core standards
				or State challenging academic content standards and challenging student
				academic achievement standards, in order to create multiple measures
				that—</text>
								<subparagraph id="idAF4000881F534019B0662B28D2C5C3E3"><enum>(A)</enum><text>are used for
				Federal and State accountability purposes;</text>
								</subparagraph><subparagraph id="id4F926FB82C8A4F55B7A02DB89E862C7B"><enum>(B)</enum><text>improve classroom
				instruction; and</text>
								</subparagraph><subparagraph id="id24A8B15BDFDE4DAAA3B59C0B65DDE011"><enum>(C)</enum><text>provide timely
				and meaningful feedback to students, teachers, principals, and parents.</text>
								</subparagraph></paragraph></subsection><subsection id="id238A4985FDB04F87BEBD4FDBF5A357FF"><enum>(b)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="ID071a34383c68458f8d0ab6403b16c006"><enum>(1)</enum><header>Adaptive
				assessment</header><text>The term <term>adaptive assessment</term> means an
				assessment in which questions are administered to students based on the
				students’ answers to previous questions both on and out of grade level.</text>
							</paragraph><paragraph id="id451FE5B0D61D4A9AADCE8BEF068B3C56"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
								<subparagraph id="idA8DCAEA751C0426E82A6158459DCFC83"><enum>(A)</enum><text>a consortium of
				States;</text>
								</subparagraph><subparagraph id="idA76906D3A09C49C1BE4BCE95B99C43F1"><enum>(B)</enum><text>a State
				educational agency;</text>
								</subparagraph><subparagraph id="IDb17b02c97e214805bf0ad4b7307dab6d"><enum>(C)</enum><text>a consortium of
				local education agencies; or</text>
								</subparagraph><subparagraph id="IDb05eedd1dc2f4603a59528e04cc45db1"><enum>(D)</enum><text>a local education
				agency.</text>
								</subparagraph></paragraph><paragraph id="IDb7f3fd5027e94477ba15aa6e8a339015"><enum>(3)</enum><header>Formative
				assessment</header><text>The term <term>formative assessment</term> means an
				assessment that—</text>
								<subparagraph id="id0ED865ED733345AEB36382255AE6D6A9"><enum>(A)</enum><text>is integrated
				into classroom instruction;</text>
								</subparagraph><subparagraph id="id7DEB09EEE6DB44D58906A2F5CEF1B6B0"><enum>(B)</enum><text>produces evidence
				about student learning and achievement in a timely manner; and</text>
								</subparagraph><subparagraph id="idF6BE239C3E444556A7F766389811E7AB"><enum>(C)</enum><text>provides students
				and teachers with meaningful feedback so that teachers can modify, improve, and
				target instructional strategies based on individual student need, and so that
				teachers and students can assess the students' academic growth.</text>
								</subparagraph></paragraph><paragraph id="IDde3086ca25064211b41193554603363b"><enum>(4)</enum><header>Interim
				assessment</header><text>The term <term>interim assessment</term> means an
				assessment that—</text>
								<subparagraph id="idBBF62399700E4D1085AC53458CBAC5FD"><enum>(A)</enum><text>is given at
				regular and specified intervals throughout the school year;</text>
								</subparagraph><subparagraph id="id549CEE26CD72454F8E12B5DFF1FEBDB2"><enum>(B)</enum><text>is designed to
				evaluate students’ knowledge and skills relative to a specific set of academic
				standards; and</text>
								</subparagraph><subparagraph id="id2ED6C345789E480DBC5E540C561F1098"><enum>(C)</enum><text>produces results
				that can be aggregated by course, grade level, school, or local educational
				agency in order to inform students, teachers, and administrators at the
				student, classroom, school, and local educational agency levels.</text>
								</subparagraph></paragraph><paragraph id="id96D4CF7E05704F7D92CCE7961AB1E45C"><enum>(5)</enum><header>Multiple
				measures</header><text>The term <term>multiple measures</term> means evidence
				gained from different forms of assessment that offer all students various ways
				to fairly, validly, and reliable demonstrate academic achievement and academic
				growth.</text>
							</paragraph><paragraph id="ID1f2039ca6b68483bb09111255223c03c"><enum>(6)</enum><header>Performance
				assessment</header><text>The term <term>performance assessment</term> means an
				assessment that measures the ability of students to apply knowledge and skills,
				and demonstrate achievement through performance-based tasks.</text>
							</paragraph><paragraph id="id65152F83196049CDA3FA414E7A05C632"><enum>(7)</enum><header>Standardized
				portfolio assessment</header><text>The term <term>standardized portfolio
				assessment</term> means an assessment that accumulates the same types of
				student work, created under similar conditions across all schools within a
				State, to use as formative or summative evidence of student academic
				progress.</text>
							</paragraph><paragraph id="IDa159124e35e741948087dc54eb940fff"><enum>(8)</enum><header>Technology-based
				assessment</header><text>The term <term>technology-based assessment</term>
				means an assessment that utilizes technology such as computers in the
				development, administration, and scoring of the assessment.</text>
							</paragraph><paragraph id="ID5bce73cce3e3418e8344e8e9ca9003dd"><enum>(9)</enum><header>Through-course
				assessment</header><text>The term <term>through-course assessment</term> means
				an assessment system or component or set of assessment system components that
				is administered periodically during the academic year, in which a student’s
				results are combined to produce the student’s total summative assessment score
				for such academic year.</text>
							</paragraph><paragraph id="ID6e7fd9dbe0834bc5b427fe7e8ed431de"><enum>(10)</enum><header>Universal
				design for learning</header><text>The term <term>universal design for
				learning</term> means a scientifically valid framework for guiding educational
				practice that—</text>
								<subparagraph id="ID04d0febef869450aa44704cae55bbd1d"><enum>(A)</enum><text>provides
				flexibility in the ways information is presented, in the ways students respond
				or demonstrate knowledge and skills, and in the ways students are engaged;
				and</text>
								</subparagraph><subparagraph id="ID6bb3ce54011144dcbff0253432940e33"><enum>(B)</enum><text>reduces barriers
				in instruction, provides appropriate accommodations, supports, and challenges,
				and maintains high achievement expectations for all students, including
				students with disabilities and students who are English language
				learners.</text>
								</subparagraph></paragraph></subsection><subsection id="idFFEE094D6EEE4E6FA76DA1AD98795FC4"><enum>(c)</enum><header>Grants
				authorized</header><text>The Secretary is authorized to award grants to
				eligible entities to enable the eligible entities to carry out the authorized
				activities described in subsection (d).</text>
						</subsection><subsection id="ID482886b291194b51b0838034665323ac"><enum>(d)</enum><header>Authorized
				activities</header>
							<paragraph id="ID22dbdc81ace84bac9aaf2985f4c89202"><enum>(1)</enum><header>In
				general</header><text>An eligible entity that receives a grant under this
				section shall use the funds made available under this section for the design or
				implementation of high-quality and innovative assessments in local classrooms,
				including—</text>
								<subparagraph id="IDb439cbdec0c84e3d8aec0120ca279309"><enum>(A)</enum><text>partnering with
				institutions of higher education and nonprofit organizations to design, test,
				and implement assessments in classrooms;</text>
								</subparagraph><subparagraph id="IDacdcfb679e0b47fc894ee7d75033c52a"><enum>(B)</enum><text>aligning the
				assessments with common core standards or State challenging academic content
				standards and challenging student academic achievement standards under section
				1111(b)(1);</text>
								</subparagraph><subparagraph id="IDa595884796fa4ad58df346e3d8f19b2c"><enum>(C)</enum><text>partnering with
				institutions of higher education, local educational agencies, and nonprofit
				organizations that provide high-quality professional development to train
				teachers and principals in—</text>
									<clause id="idBDDEC69571E64F49919D3CD2D73B6EB3"><enum>(i)</enum><text>how to utilize
				the assessments described in subsection (a)(2) in the teachers'
				classrooms;</text>
									</clause><clause id="idEB9D0F9AE8484EF18D746428F1A4EE6A"><enum>(ii)</enum><text>how to interpret
				the data generated by these assessments; and</text>
									</clause><clause id="id4B00F311FB63483C93C6B27C9E0641CF"><enum>(iii)</enum><text>how to use the
				data generated by these assessments to improve student achievement;</text>
									</clause></subparagraph><subparagraph id="ID80340e0d87354900b2209e5093ff4331"><enum>(D)</enum><text>designing
				achievement reports that—</text>
									<clause id="id68904A3652584E06BDFB698D08E1AB24"><enum>(i)</enum><text>detail assessment
				results, including student achievement and student-level and school-level
				growth;</text>
									</clause><clause id="id4D20D19F7B6745969D906F437D73E899"><enum>(ii)</enum><text>are desegregated
				by student subgroups listed in section 1111(b)(2)(C)(v)(II); and</text>
									</clause><clause id="id62BBB208A81540EBAACD9EC180314451"><enum>(iii)</enum><text>can be used to
				inform classroom instruction and provide parents and the community with timely
				information on student-level and school-level progress;</text>
									</clause></subparagraph><subparagraph id="ID0e2e4fd8d63548c187315168525f1293"><enum>(E)</enum><text>designing and
				implementing alternative assessments that are fair, valid, and reliable for
				students with disabilities and English language learners;</text>
								</subparagraph><subparagraph id="ID04fd17ccd85e49a98d79e88bb5d6a3fd"><enum>(F)</enum><text>developing
				scoring mechanisms that enable the assessments to be scored in such a way as to
				produce fair, valid, reliable, and comparable results for all students;</text>
								</subparagraph><subparagraph id="ID4a8691095be543a692f5c19cf178155c"><enum>(G)</enum><text>integrating the
				use of technology in both the design, implementation, and scoring of
				assessments;</text>
								</subparagraph><subparagraph id="ID55a00812fe754755a656abac0f84b62b"><enum>(H)</enum><text>collaborating
				with other eligible entities to share information and best practices about
				assessment development and implementation across the States; and</text>
								</subparagraph><subparagraph id="id9CE9E3DD4F894F64AEB9455759A34C6D"><enum>(I)</enum><text>implementing
				assessment systems that use multiple measures collected throughout the course
				of a school year for purposes of calculating school-level and district-level
				achievement in Federal and State accountability systems.</text>
								</subparagraph></paragraph><paragraph id="IDcb9edab0bb57471b99f856784196ccd7"><enum>(2)</enum><header>Requirements</header><text>Assessments
				designed or implemented with funds provided under this section shall—</text>
								<subparagraph id="ID9dd4600f655f4d5ebd6c6f9a5f67371f"><enum>(A)</enum><text>be aligned with
				common core standards or State challenging academic content standards and
				challenging student academic achievement standards under section
				1111(b)(1);</text>
								</subparagraph><subparagraph id="IDe8f1a738b9a444b48a50ecf3e0e09b98"><enum>(B)</enum><text>be capable of
				measuring student academic growth and achievement of State challenging academic
				content standards and challenging student academic achievement
				standards;</text>
								</subparagraph><subparagraph id="ID170e2256dbec4f6fab85c2d724aff374"><enum>(C)</enum><text>be fair, valid,
				reliable, and capable of producing comparable and disaggregated results for all
				students, including all the student subgroups identified under section
				1111(b)(2)(C)(v)(II);</text>
								</subparagraph><subparagraph id="IDbf77abf93d96480faad3dc4e854cf981"><enum>(D)</enum><text>be able to
				measure readiness for college or the workplace;</text>
								</subparagraph><subparagraph id="ID2f68eec8ed7b4fb885120c5852ea8e9a"><enum>(E)</enum><text>use scoring
				mechanisms that enable the assessments to be scored in such a way as to produce
				fair, valid, reliable, and comparable results for all students;</text>
								</subparagraph><subparagraph id="ID8893f9336910458c94d01a10b138f22b"><enum>(F)</enum><text>incorporate
				principles of universal design for learning;</text>
								</subparagraph><subparagraph id="ID79cc7974f32847d5a9943ea3c0b699f1"><enum>(G)</enum><text>produce evidence
				about student learning and achievement in a timely manner; and</text>
								</subparagraph><subparagraph id="IDf04eb64957fd4098b07c486015c1639e"><enum>(H)</enum><text>provide teachers
				with meaningful feedback so that the teachers can modify, improve, and target
				instructional strategies based on individual student need.</text>
								</subparagraph></paragraph><paragraph id="ID24ae58bf8fd541bca4bb04c5941a9247"><enum>(3)</enum><header>Restrictions</header><text>Grant
				funds received under this section—</text>
								<subparagraph id="id8BE4E95B76B94A8FBD21659F2D6E5911"><enum>(A)</enum><text>shall be used
				only for the authorized activities described under this subsection; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB79147E73A444020AFCDEA44825F36D2"><enum>(B)</enum><text>may not be used
				for the purchase or development of high stakes, large scale assessments or for
				test preparation materials for high stakes testing.</text>
								</subparagraph></paragraph></subsection><subsection id="ID4f5d75d35d3f440d8faafcc475933cd3"><enum>(e)</enum><header>Other Eligible
				partner entities</header>
							<paragraph id="id1A902599529E4718B45D7180B40AD289"><enum>(1)</enum><header>In
				general</header><text>Each eligible entity that receives a grant under this
				section, upon receipt of the grant funds, may partner with an entity described
				in paragraph (2), in order to carry out the activities assisted under the
				grant.</text>
							</paragraph><paragraph id="idA389C561F42949DABFCD8EC161C2042D"><enum>(2)</enum><header>Partner
				Entities</header><text>A partner entity referred to in paragraph (1) is—</text>
								<subparagraph id="IDcd9807ca367e4ac59fa3dbb74f89773c"><enum>(A)</enum><text>an institution of
				higher education; or</text>
								</subparagraph><subparagraph id="ID7fd5c253a27542fab6ed099b510ddcc3"><enum>(B)</enum><text>a nonprofit
				entity with experience in designing high-quality and innovative
				assessments.</text>
								</subparagraph></paragraph></subsection><subsection id="IDf0bef220c5fd4a839be30d14bc6657fb"><enum>(f)</enum><header>Application</header><text>To
				be eligible to receive a grant under this section, an eligible entity shall
				submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary may require, including, at a
				minimum—</text>
							<paragraph id="IDc4247c24e7ee4424aa6d72ae00bf6c9a"><enum>(1)</enum><text>a proposal to use
				the grant funds to design or implement the assessments and assessment systems
				described in subsection (a)(2);</text>
							</paragraph><paragraph id="ID078a906dc6324c689473bccc66f23d12"><enum>(2)</enum><text>a description of
				how the eligible entity plans to ensure that teachers and principals are
				provided meaningful and effective professional development in the use of such
				assessments in the teachers' and principals' classrooms and schools, including
				how to interpret and utilize data generated from the assessments to improve
				student learning and outcomes;</text>
							</paragraph><paragraph id="ID7db399044d8a4912b4300435fb1311c7"><enum>(3)</enum><text>a description of
				how the eligible entity plans to assess the effectiveness of the assessments
				and assessment systems in raising student achievement and narrowing the
				achievement gap among the State’s student population;</text>
							</paragraph><paragraph id="IDeea9a4f012de4e78b7456c24172a2d71"><enum>(4)</enum><text>a description of
				how the eligible entity plans to ensure that the assessments and assessment
				systems will be used to improve teaching and provide detailed and timely
				feedback to students and parents; and</text>
							</paragraph><paragraph id="idBF31DB8E1269460EB32458CA03866DE6"><enum>(5)</enum><text>a description of
				how the eligible entity plans to ensure that there is a transparent and fair
				process for scoring assessments designed or implemented with funds provided
				under this section so that scores are accurate, valid, and reliable.</text>
							</paragraph></subsection><subsection id="id55EFF14A73754EEF92A56930D283DB34"><enum>(g)</enum><header>Duration</header><text>A
				grant under this section shall be awarded for a period of not more than 3
				fiscal years.</text>
						</subsection><subsection id="ID85dcebd6b0444e169cf128fca65d38be"><enum>(h)</enum><header>Award
				considerations</header><text>In awarding grants under this section, the
				Secretary shall select eligible entities that demonstrate the greatest need for
				the grants and the greatest potential benefit from receipt of the
				grants.</text>
						</subsection><subsection id="IDa83d7d23d1f643388d2892c0cbca1202"><enum>(i)</enum><header>Report and
				evaluation</header>
							<paragraph id="ID1c631da7762042a68043951c19b3ca46"><enum>(1)</enum><header>State
				reports</header><text>Each eligible entity that receives a grant under this
				section shall submit—</text>
								<subparagraph id="ID34b944ee91734c6fb1486f999a145f52"><enum>(A)</enum><text>an annual report
				to the Secretary detailing how the eligible entity is using the grant funds and
				detailing ongoing evaluation of—</text>
									<clause id="id1C540B23986A4B2EBD80DF64741239E7"><enum>(i)</enum><text>the design of the
				assessments assisted under this section;</text>
									</clause><clause id="idC974913BF72148A6A0FC88BEDCECD21C"><enum>(ii)</enum><text>the training of
				educators in using the assessments;</text>
									</clause><clause id="id5A488F7574534A9FAA02E8B1035DF890"><enum>(iii)</enum><text>the
				effectiveness of the assessments as measured by student achievement and growth
				based on multiple measures; and</text>
									</clause><clause id="idA2E4AA519554461CA4D8DF1A0D95AEE5"><enum>(iv)</enum><text>the reliability
				and validity of the scoring process for the assessments;</text>
									</clause></subparagraph><subparagraph id="ID6ec511e3e0de43b8b07a0de1a5d7082a"><enum>(B)</enum><text>a comprehensive
				3-year report at the end of the 3-year grant period including a detailed
				analysis of—</text>
									<clause id="id9343E5AFB447434A8E413E7D3461F242"><enum>(i)</enum><text>how the grant
				funds were used; and</text>
									</clause><clause id="idFD599F71980444D5AB3130F3B0DCF350"><enum>(ii)</enum><text>the impact of
				the grant on student achievement, narrowing the achievement gap, and the
				quality of teaching, based on multiple measures.</text>
									</clause></subparagraph></paragraph><paragraph id="IDa88ce05a86534c0da199e12d1bcb5632"><enum>(2)</enum><header>Federal
				evaluation and report</header><text>Not later than 5 years after the date of
				enactment of the <short-title>Improving Student Testing
				Act of 2010</short-title>, the Secretary shall—</text>
								<subparagraph id="IDea3578ee42d34e9b940ea99dd24744d5"><enum>(A)</enum><text>develop and
				execute a plan for evaluating the assessments assisted under this section and
				section 6111 and the strategies financed under this section; and</text>
								</subparagraph><subparagraph id="idF15FFE57D40A40259F79D6A51116F2B8"><enum>(B)</enum><text>submit a report
				to Congress detailing—</text>
									<clause id="idD671FBE07658472C82BA34B22552438B"><enum>(i)</enum><text>how eligible
				entities used the grant funds provided under this section;</text>
									</clause><clause id="id16096708CED84E99B6EF272878F91ADB"><enum>(ii)</enum><text>the impact of
				the grants on student achievement and teaching in the States; and</text>
									</clause><clause id="idD3A20C8ADF7E445FA142FEAA1F029FA7"><enum>(iii)</enum><text>any
				recommendations for improvements that can be made to the grant programs under
				this section and section 6111.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf1faa9ff56d04f578583440057a2904e"><enum>(j)</enum><header>Authorization
				of appropriations</header><text>In addition to the amounts authorized to be
				appropriated under section 6113(b)(2), there are authorized to be appropriated
				to carry out this section $10,000,000 for each of fiscal years 2011 through
				2015.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idAD878811C2304C0DBA8F5E2FE0C157B0"><enum>(b)</enum><header>Table of
			 contents</header><text>The table of contents in section 2 of the Elementary and
			 Secondary Education Act of 1965 is amended by striking the item relating to
			 section 6112 and inserting the following:</text>

				for creating and implementing innovative

					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID38cebe759f3d4a5fa8a173b2dd8bdbbb"><enum>(c)</enum><header>Ending taxpayer
			 subsidies for exporters</header>
				<paragraph id="ID9ade8f7ef49b4f27b4fb9f1b75030585"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Secretary of Commerce shall develop and implement a program to impose
			 fees on businesses that benefit from the trade promotion activities of the
			 International Trade Administration.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8A76AD30D164CE9AB0B9AF7F5F0B7FA"><enum>(2)</enum><header display-inline="yes-display-inline">Budget neutrality</header><text display-inline="yes-display-inline">The fees shall be imposed in an amount that
			 ensures that any Federal expenditures on trade promotion activities of the
			 International Trade Administration are offset by the fees collected under the
			 program in a budget neutral manner.</text>
				</paragraph></subsection></section></legis-body>
