		<official-title display="yes">To amend the Public Health Service Act to
		  provide for human stem cell research, including human embryonic stem cell
		  research, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H7BB786B5324B492B805B03B97E706EA3" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Stem Cell Research Advancement Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H4C58ED22E85E4709A5570CB2714428CD" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H92A323C5DA2945E484FF80FACED30B5F"><enum>(1)</enum><text display-inline="yes-display-inline">On March 9, 2009, President Barack Obama
			 issued Executive Order 13505, entitled <quote>Removing Barriers to Responsible
			 Scientific Research Involving Human Stem Cells</quote>.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E7A8C88961346BA9D44B5ED153E7440"><enum>(2)</enum><text display-inline="yes-display-inline">On July 7, 2009, the National Institutes of
			 Health issued guidelines on human stem cell research.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2EC2CF324F4342419EFAA49EAD1B6BC4"><enum>(3)</enum><text display-inline="yes-display-inline">The scientific field of stem cell research
			 is continually advancing.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HD6E0BA237C3F4D43880F1B05E43BC266" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Human stem cell research</header>
			<subsection commented="no" display-inline="no-display-inline" id="HC59EA3B495164911B46705358214FCE3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Part H of title IV of the Public Health
			 Service Act (42 U.S.C. 289 et seq.) is amended by inserting after section 498D
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H55DD045F3AE84447A09B8E2602C68999" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="H9D587391A0CA4C67949A5BE82D7EFFAE" section-type="subsequent-section"><enum>498E.</enum><header display-inline="yes-display-inline">Human stem cell research</header>
						<subsection commented="no" display-inline="no-display-inline" id="HCEAAD72BBB124E80A2132B2511862E60"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				including section 509 of division D of the Consolidated Appropriations Act,
				2010 or any substantially similar provision in any previous or subsequent
				Departments of Labor, Health and Human Services, and Education, and Related
				Agencies Appropriations Act, the Secretary shall conduct and support research
				that utilizes human stem cells, including human embryonic stem cells.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="HD3505F2A6BAC403E9FAFABD9AC077FEB"><enum>(b)</enum><header display-inline="yes-display-inline">Eligibility</header><text display-inline="yes-display-inline">Human embryonic stem cells eligible for use
				in research under subsection (a) shall include stem cells that meet each of the
				following:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HCCDF45E9089C4217A2DCFD73EAF53DCD"><enum>(1)</enum><text display-inline="yes-display-inline">The stem cells were derived from human
				embryos that have been donated from in vitro fertilization clinics, were
				created for the purposes of reproductive treatment, and were in excess of the
				clinical need of the individuals seeking such treatment.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H04A53D8622C341368AD10AACD2DBCE4C"><enum>(2)</enum><text display-inline="yes-display-inline">It was determined through consultation with
				the individuals seeking reproductive treatment that the embryos to be donated
				would never be implanted in a woman and would otherwise be discarded.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0A4CCD4DECCE42D4AF699D53A9261B7A"><enum>(3)</enum><text display-inline="yes-display-inline">The individuals seeking reproductive
				treatment donated the embryos with written informed consent and without
				receiving any financial or other inducements to make the donation.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD4C5D7136C50495DA52FE9878294C46A" section-type="subsequent-section"><enum>498F.</enum><header display-inline="yes-display-inline">Guidelines</header><text display-inline="no-display-inline">The Secretary, in consultation with the
				Director of NIH, shall—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H72C78E7A5DE3418BB08DFAE900723676"><enum>(1)</enum><text display-inline="yes-display-inline">maintain guidelines applicable to the
				conduct or support of human stem cell research by the Department of Health and
				Human Services;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5E2DD824802B49A1BF8C2110F2C24D07"><enum>(2)</enum><text display-inline="yes-display-inline">review such guidelines not less than every
				3 years; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H627A697CA1F245349AD9E1E2CDBB05FD"><enum>(3)</enum><text display-inline="yes-display-inline">update such guidelines as scientifically
				warranted.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="H1156E51D92C64249BA926CEEBA98AAAA" section-type="subsequent-section"><enum>498G.</enum><header display-inline="yes-display-inline">Prohibition against funding for human
				cloning</header>
						<subsection commented="no" display-inline="no-display-inline" id="HD06A14F37B384355B9674F48E840AB2F"><enum>(a)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">The Secretary shall not use any funds for
				the conduct or support of human cloning.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H6BEFEA1381784A478636A79F71C45242"><enum>(b)</enum><header display-inline="yes-display-inline">Guidelines</header><text display-inline="yes-display-inline">The Secretary shall update the guidelines
				maintained under section 498F for consistency with subsection (a).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H142FF9A716564B428EBA5A54776975FB"><enum>(c)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section, the term <quote>human
				cloning</quote> means the implantation of the product of transferring the
				nuclear material of a human somatic cell into an egg cell from which the
				nuclear material has been removed or rendered inert into a uterus or the
				functional equivalent of a
				uterus.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H963C2D1E67014287BCB380D6DCD7BE72"><enum>(b)</enum><header display-inline="yes-display-inline">Technical clarification</header><text display-inline="yes-display-inline">Section 509(a)(2) of division D of the
			 Consolidated Appropriations Act, 2010 (Public Law 111–117) is amended by
			 inserting <quote>except as provided under section 498E of the Public Health
			 Service Act,</quote> before <quote>research in which</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H9C9C2A04D8094D85BEA53EB64BAD7D41" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="no-display-inline">Section 403(a)(5) of the Public Health
			 Service Act (42 U.S.C. 283(a)(5)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H2C61FB44AA224CB99EA4A00365E1EC51"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subparagraph (L) as (M);
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H12F82B6C714145298C947CF9DE5DE2C8"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (K) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H221974F65F6F4372B60333335798E91D" style="OLC">
