			 purpose</header>
			<subsection id="id3C28512AA8DF4E00B96C27D06D74D2A7"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph id="idFC89CB33565B4F54B0F8E81BA9A2D3DF"><enum>(1)</enum><text display-inline="yes-display-inline">as of the date of enactment of this Act,
			 recently enacted Federal laws have begun to support Indian tribal energy
			 development by encouraging Indian tribes to play an active role in developing
			 tribal energy resources;</text>
				</paragraph><paragraph id="id428BFB6A91E84EA2BC60DC33C7974EF0"><enum>(2)</enum><text>the laws
			 described in paragraph (1)—</text>
					<subparagraph id="id2F6E4D51B0134E419BD14DEEAE6B4F15"><enum>(A)</enum><text>are being
			 implemented slowly; and</text>
					</subparagraph><subparagraph id="id8401EEE4F14C4A4C9427C98DE578F3B0"><enum>(B)</enum><text>require
			 modification to overcome a century of Federal policies that have created
			 uncertainty and inequality regarding tribal energy development; and</text>
					</subparagraph></paragraph><paragraph id="id24450925480743C588A66A03062601BA"><enum>(3)</enum><text>other Federal
			 laws in effect on the date of enactment of this Act—</text>
					<subparagraph id="id42607300406C49AB96C5D1FB3DE136E6"><enum>(A)</enum><text>create
			 disincentives for investment in Indian country; and</text>
					</subparagraph><subparagraph id="idC35E5138AA2D4A548EFF69A5AA28A5B6"><enum>(B)</enum><text>discourage Indian
			 tribes from initiating energy development efforts.</text>
					</subparagraph></paragraph></subsection><subsection id="idDA373C1261E74F21BF7C2CEEB9B248D9"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to address problems relating to Indian energy
			 development and efficiency, including—</text>
				<paragraph id="ID796bd08cbabc42d0ab950a0508c48a7e"><enum>(1)</enum><text>outdated laws and
			 cumbersome regulations relating to tribal energy development;</text>
				</paragraph><paragraph id="id1AE28B21DCFF4D65959908CAEDC34E56"><enum>(2)</enum><text>lack of tribal
			 access to the transmission grid; and</text>
				</paragraph><paragraph id="idF19AFF3D62E240E69FB183FBB505B5EE"><enum>(3)</enum><text>difficulty in
			 obtaining financing and investment for energy projects.</text>
				</paragraph></subsection></section><section id="id4D9D58519D1F4F23BD48A6B10686EC72"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Except as otherwise provided in this Act, in
			 this Act:</text>
			<paragraph id="id51DE454B419D4D238557399406220547"><enum>(1)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of the Interior.</text>
			</paragraph><paragraph id="id55C9C571C09E4C379FEBF2C071EACE75"><enum>(2)</enum><header>Indian
			 land</header><text>The term <term>Indian land</term> has the meaning given the
			 term in section 2601 of the Energy Policy Act of 1992 (25 U.S.C. 3501).</text>
			</paragraph><paragraph id="idF352BA78938A42CA86DB6EA03D5F1A05"><enum>(3)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the <act-name parsable-cite="ISDA">Indian
			 Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
			 450b).</text>
			</paragraph><paragraph id="id8C8F6D8ACF4F4ABEAFEEEB85114B0F87"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph></section><title id="idD6540BCF88C54CC486AB1933976782AB"><enum>I</enum><header>Energy
			 planning</header>
			<section id="ID066c739d3e7b41218fc0fa4337a2e497"><enum>101.</enum><header>Indian energy
			 integration demonstration projects</header>
				<subsection id="ID127f971f665d42a08236cfe0cbd90e2d"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="ID6db7d48597704ac0890a9e25f5c8aae4"><enum>(1)</enum><header>Agency</header><text>The
			 term <term>agency</term> has the meaning given the term in section 551 of title
			 5, United States Code.</text>
					</paragraph><paragraph id="IDaf3ff3091e684e318ff50d374159e0c6"><enum>(2)</enum><header>Agency
			 leader</header><text>The term <term>Agency leader</term> means 1 or more of the
			 following:</text>
						<subparagraph id="ID24057ff359b34547ab981c29fcbdc248"><enum>(A)</enum><text>The Secretary of
			 Agriculture.</text>
						</subparagraph><subparagraph id="ID991b90276dff4cf7b44d51253a88dd04"><enum>(B)</enum><text>The Secretary of
			 Commerce.</text>
						</subparagraph><subparagraph id="ID98d38ce6252248d09236596607cc9c07"><enum>(C)</enum><text>The Secretary of
			 Energy.</text>
						</subparagraph><subparagraph id="ID38d8abf1a3d742839e961d1d80cf949e"><enum>(D)</enum><text>The Secretary of
			 Housing and Urban Development.</text>
						</subparagraph><subparagraph id="ID75b730684e054e76a5c0c601305089fa"><enum>(E)</enum><text>The Administrator
			 of the Environmental Protection Agency.</text>
						</subparagraph><subparagraph id="ID02e92bb1674d4d008901090ff3e4fd87"><enum>(F)</enum><text>The Secretary of
			 the Interior.</text>
						</subparagraph><subparagraph id="ID0fb6bbd42b2343258a5a369564254583"><enum>(G)</enum><text>The Secretary of
			 Labor.</text>
						</subparagraph><subparagraph id="IDb938bd6b25e14daf94f9c3e1c44b8dea"><enum>(H)</enum><text>The Secretary of
			 Transportation.</text>
						</subparagraph></paragraph><paragraph id="ID8919ee5b74b444319eabbb6de242d18e"><enum>(3)</enum><header>Tribal energy
			 development organization</header><text>The term <term>tribal energy development
			 organization</term> has the meaning given the term in section 2601 of the
			 Energy Policy Act of 1992 (25 U.S.C. 3501).</text>
					</paragraph></subsection><subsection id="ID84b50306ad184b3d9cc2c6476557e6b3"><enum>(b)</enum><header>Single
			 integrated program</header>
					<paragraph id="idD297E8BC2EB54572972F8713A0A62F7E"><enum>(1)</enum><header>In
			 general</header><text>An Indian tribe or tribal energy development organization
			 may submit to the Secretary, and to applicable Agency leaders, a plan to fully
			 integrate into a single, coordinated, comprehensive program federally funded
			 energy-related activities and programs (including programs for employment
			 training, energy planning, financing, construction, and related physical
			 infrastructure and equipment).</text>
					</paragraph><paragraph id="ID26a32359c38a4af2a6272406c8792cf8"><enum>(2)</enum><header>No additional
			 requirements</header><text>The Agency leaders shall not impose any additional
			 requirement or condition, additional budget, report, audit, or supplemental
			 audit, or require additional documentation from, an Indian tribe or tribal
			 energy development organization that has satisfied the plan criteria described
			 in subsection (c).</text>
					</paragraph><paragraph id="ID02db0c4884e4481a8b55dc9a70ccbf88"><enum>(3)</enum><header>Procedure</header>
						<subparagraph id="id53E3EF14AF8D4078B24F9FCAE6B81450"><enum>(A)</enum><header>In
			 general</header><text>On receipt of a plan of an Indian tribe or a tribal
			 energy development organization described in paragraph (1) that is in a form
			 that the Secretary determines to be acceptable, the Secretary shall consult
			 with the applicable Agency leaders to determine whether the proposed use of
			 programs and services is in accordance with the eligibility rules and
			 guidelines on the use of agency funds.</text>
						</subparagraph><subparagraph id="IDc0978cd98f0d4a048d6f7bc6e03e9c22"><enum>(B)</enum><header>Integration</header><text>If
			 the Secretary and the applicable Agency leaders make a favorable determination
			 pursuant to subparagraph (A), the Secretary shall authorize the Indian tribe or
			 tribal energy development organization—</text>
							<clause id="id88556482F2C740CEB4984FE6861BCB5A"><enum>(i)</enum><text>to
			 integrate and coordinate the programs and services described in paragraph (4)
			 into a single, coordinated, and comprehensive program; and</text>
							</clause><clause id="id3A4A012C700D407D8079156FA866B72F"><enum>(ii)</enum><text>to
			 reduce administrative costs by consolidating administrative functions.</text>
							</clause></subparagraph></paragraph><paragraph id="id0D540292AC1142868720E0F213589620"><enum>(4)</enum><header>Description of
			 activities</header><text>The activities referred to in paragraph (1) are
			 federally funded energy-related activities and programs (including programs for
			 employment training, energy planning, financing, construction, and related
			 physical infrastructure and equipment), including—</text>
						<subparagraph id="ID1718f0e2e1504d48b3bb252f395c856d"><enum>(A)</enum><text>any program under
			 which an Indian tribe or tribal energy development organization is eligible to
			 receive funds under a statutory or administrative formula;</text>
						</subparagraph><subparagraph id="ID696c65ea05db4eb7b1b68a93b29b0cdb"><enum>(B)</enum><text>activities
			 carried out using any funds an Indian tribe or members of the Indian tribe are
			 entitled to under Federal law; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd9f4b46167c942f5815e9a41006cfea6"><enum>(C)</enum><text>activities
			 carried out using any funds an Indian tribe or a tribal energy development
			 organization may secure as a result of a competitive process for the purpose of
			 planning, designing, constructing, operating, or managing a renewable or
			 nonrenewable energy project on Indian land.</text>
						</subparagraph></paragraph><paragraph id="ID32c03be2bfa4416390bc909e5cf0b359"><enum>(5)</enum><header>Inventory of
			 affected programs</header>
						<subparagraph id="id9D0CBA15E022438FBB0F75AD40ACEB14"><enum>(A)</enum><header>Reports</header><text>Not
			 later than 90 days after the date of enactment of this Act, the Agency leaders
			 shall—</text>
							<clause id="id24F2C42F7D604402BEABBC3BF127D927"><enum>(i)</enum><text>conduct a survey
			 of the programs and services of the agency that are or may be included in the
			 plan of an Indian tribe or tribal energy development organization under this
			 subsection;</text>
							</clause><clause id="IDf4c3047f12f840fa9e98bd311978f6c2"><enum>(ii)</enum><text>provide a
			 description of the eligibility rules and guidelines on the manner in which the
			 funds under the jurisdiction of the agency may be used; and</text>
							</clause><clause id="id0CF4654E809D44BB867A5579FEE6CAA5"><enum>(iii)</enum><text>submit to the
			 Secretary a report identifying those programs, services, rules, and
			 guidelines.</text>
							</clause></subparagraph><subparagraph id="id0B92AC28D86A41F7BF9379C54BE2DA3F"><enum>(B)</enum><header>Publication</header><text>Not
			 later than 60 days after the date of receipt of each report under subparagraph
			 (A), the Secretary shall publish in the Federal Register a comprehensive list
			 of the programs and services identified in the reports.</text>
						</subparagraph></paragraph></subsection><subsection id="ID60d9b1fc95a74457bd19536c848e8796"><enum>(c)</enum><header>Plan
			 requirements</header><text>A plan submitted by an Indian tribe or tribal energy
			 development organization under subsection (b) shall—</text>
					<paragraph id="ID0fb5ae097e6e4331b728afe5565e2c7f"><enum>(1)</enum><text>identify the
			 activities to be integrated;</text>
					</paragraph><paragraph id="ID6fd0a02e40c64ac2a95c607073507a0e"><enum>(2)</enum><text>be consistent
			 with the purposes of this section regarding the integration of the activities
			 in a demonstration project;</text>
					</paragraph><paragraph id="ID729b1996bf0343f6b58b6698298372fb"><enum>(3)</enum><text>describe—</text>
						<subparagraph id="id6343F384BE3A45128C49BA764389129F"><enum>(A)</enum><text>the manner in
			 which services are to be integrated and delivered; and</text>
						</subparagraph><subparagraph id="id8E17DD0B7A954130B9F23047715059D0"><enum>(B)</enum><text>the expected
			 results of the plan;</text>
						</subparagraph></paragraph><paragraph id="ID7601de6b5107433c94e9a75509e1e886"><enum>(4)</enum><text>identify the
			 projected expenditures under the plan in a single budget;</text>
					</paragraph><paragraph id="IDc54c3e061fd34cb6af7f9a74fc13479d"><enum>(5)</enum><text>identify each
			 agency of the Indian tribe to be involved in the administration of activities
			 or delivery of the services integrated under the plan;</text>
					</paragraph><paragraph id="IDe28d3a2e6d264681a4a363d393fff0da"><enum>(6)</enum><text>address any
			 applicable requirements of the Agency leaders for receiving funding from the
			 federally funded energy-related activities and programs under the jurisdiction
			 of the Agency leaders, respectively;</text>
					</paragraph><paragraph id="ID730f88cca0734934b48c20ff7c2c807b"><enum>(7)</enum><text>identify any
			 statutory provisions, regulations, policies, or procedures that the Indian
			 tribe recommends to be waived to implement the plan, including any of the
			 requirements described in paragraph (6); and</text>
					</paragraph><paragraph id="ID0afdf706c05b42a68a8e70746554001c"><enum>(8)</enum><text>be approved by
			 the governing body of the affected Indian tribe.</text>
					</paragraph></subsection><subsection id="IDebe5141d80fb4536a1b5aeb1cc0a605b"><enum>(d)</enum><header>Approval
			 process</header>
					<paragraph id="IDb67d5e25442848a89b4e78ee31d8419a"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after the receipt of a plan of an
			 Indian tribe or tribal energy development organization, the Secretary and
			 applicable Agency leaders shall coordinate a single response to inform the
			 Indian tribe or tribal energy development organization in writing of the
			 determination to approve or disapprove the plan, including any request for a
			 waiver that is made as part of the plan.</text>
					</paragraph><paragraph id="ID57b99d80782d400aae85e204b6627d32"><enum>(2)</enum><header>Plan
			 disapproval</header><text>Any issue preventing approval of a plan under
			 paragraph (1) shall be resolved in accordance with subsection (e)(3).</text>
					</paragraph></subsection><subsection id="IDed0541f642434c7eb800dbc40fd262a1"><enum>(e)</enum><header>Plan review;
			 waiver authority; dispute resolution</header>
					<paragraph id="ID865f7b7730d54468b0953bedaf511207"><enum>(1)</enum><header>In
			 general</header><text>On receipt of a plan of an Indian tribe or tribal energy
			 development organization, the Secretary shall consult regarding the plan
			 with—</text>
						<subparagraph id="idE0CEB31228D64DA9B91C9551818E0501"><enum>(A)</enum><text>the applicable
			 Agency leaders; and</text>
						</subparagraph><subparagraph id="idBDDF78D9821A4CEDA63E78615BF85AEE"><enum>(B)</enum><text>the governing
			 body of the applicable Indian tribe.</text>
						</subparagraph></paragraph><paragraph id="ID33a15a4109824fda9128453db7dbed79"><enum>(2)</enum><header>Identification
			 of waivers</header>
						<subparagraph id="idFFDDFF3DEBA24A36A745CD6DA499B991"><enum>(A)</enum><header>In
			 general</header><text>In carrying out the consultation described in paragraph
			 (1), the Secretary, the applicable Agency leaders, and the governing body of
			 the applicable Indian tribe shall identify the statutory, regulatory, and
			 administrative requirements, policies, and procedures that must be waived to
			 enable the Indian tribe or tribal energy development organization to implement
			 the plan.</text>
						</subparagraph><subparagraph id="ID6d9aa525f5ce4a7d8f5869c15165cac3"><enum>(B)</enum><header>Waiver
			 authority</header><text>Notwithstanding any other provision of law, the
			 applicable Agency leaders may waive any applicable regulation, administrative
			 requirement, policy, or procedure identified under subparagraph (A) in
			 accordance with the purposes of this section.</text>
						</subparagraph><subparagraph id="ID4b0ac8cdb16442909796afe3c552cd77"><enum>(C)</enum><header>Tribal request
			 to waive</header><text>In consultation with the Secretary and the applicable
			 Agency leaders, an Indian tribe may request the applicable Agency leaders to
			 waive a regulation, administrative requirement, policy, or procedure identified
			 under subparagraph (A).</text>
						</subparagraph><subparagraph id="ID569cf6972e774035b73fe34b115a9b8b"><enum>(D)</enum><header>Declination of
			 waiver request</header><text>If the applicable Agency leaders decline to grant
			 a waiver requested under subparagraph (C), the applicable Agency leaders shall
			 provide to the requesting Indian tribe and the Secretary written notice of the
			 declination, including a description of the reasons for the declination.</text>
						</subparagraph></paragraph><paragraph id="ID1cec8ba94b6a436bb66a4754a64f5eb0"><enum>(3)</enum><header>Dispute
			 resolution</header>
						<subparagraph id="id70F0AFF4736541219FD3090F27136E5C"><enum>(A)</enum><header>In
			 general</header><text>The Secretary, in consultation with the Agency leaders,
			 shall develop dispute resolution procedures to carry out this section.</text>
						</subparagraph><subparagraph id="idD4F478CB2A7B428681C45C8C2AE2F396"><enum>(B)</enum><header>Procedures</header><text>If
			 the Secretary determines that a declination is inconsistent with the purposes
			 of this section, or prevents the Department from fulfilling the obligations
			 under subsection (f), the Secretary shall establish interagency dispute
			 resolution procedures involving—</text>
							<clause id="id8B0ECCA1E356490EB560C6B8195DFC90"><enum>(i)</enum><text>the
			 participating Indian tribe or tribal energy development organization;
			 and</text>
							</clause><clause id="id12254A9D40B9409380BB17870220D5F0"><enum>(ii)</enum><text>the applicable
			 Agency leaders.</text>
							</clause></subparagraph></paragraph><paragraph id="ID221ca171e60d4d9893804c434c1453d1"><enum>(4)</enum><header>Final
			 decision</header><text>In the event of a failure of the dispute resolution
			 procedures under paragraph (3), the Secretary shall inform the applicable
			 Indian tribe or tribal energy development organization of the final
			 determination not later than 180 days after the date of receipt of the
			 plan.</text>
					</paragraph></subsection><subsection id="ID4ac29d474bb94a41ad368f126073d9a1"><enum>(f)</enum><header>Responsibilities
			 of Department</header>
					<paragraph id="IDcbddb475086c47aa8e230a8d05a3b1a0"><enum>(1)</enum><header>Memorandum of
			 agreement</header><text>Not later than 180 days after the date of enactment of
			 this Act, the Secretary and the Agency leaders shall enter into an
			 interdepartmental memorandum of agreement that shall require and
			 include—</text>
						<subparagraph id="IDe9d7871da32d4e988ad0b99593e06930"><enum>(A)</enum><text>an annual meeting
			 of participating Indian tribes, tribal energy development organizations, and
			 Agency leaders, to be co-chaired by a representative of the President and a
			 representative of the participating Indian tribes and tribal energy development
			 organizations;</text>
						</subparagraph><subparagraph id="ID382fb6ff1652426a814b3d96f1b3f60e"><enum>(B)</enum><text>an annual review
			 of the achievements made under this section and statutory, regulatory,
			 administrative, and policy obstacles that prevent participating Indian tribes
			 and tribal energy development organizations from fully carrying out the
			 purposes of this section;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID97cd953787884f618b79fef7976fa3d4"><enum>(C)</enum><text>a forum comprised
			 of participating Indian tribes, tribal energy development organizations, and
			 agencies to identify and resolve interagency or Federal-tribal conflicts that
			 occur in carrying out this section; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE2F2F6308C5B4E5AB28830BCD40B9F09"><enum>(D)</enum><text>the dispute
			 resolution procedures required by subsection (e)(3).</text>
						</subparagraph></paragraph><paragraph id="idF85664D718B9429D9AC8182FC96541EA"><enum>(2)</enum><header>Department
			 responsibilities</header><text>The responsibilities of the Department
			 include—</text>
						<subparagraph id="ID0ddb7b963bc841c099508082a17e269f"><enum>(A)</enum><text>in accordance
			 with paragraph (3), developing a model single report for each approved plan of
			 an Indian tribe or tribal energy development organization regarding the
			 activities carried out and expenditures made under the plan;</text>
						</subparagraph><subparagraph id="ID89bd3144ac6a48cf8882b93d7f03fb3d"><enum>(B)</enum><text>providing,
			 subject to the consent of an Indian tribe or tribal energy development
			 organization with an approved plan under this section, technical assistance
			 either directly or pursuant to a contract;</text>
						</subparagraph><subparagraph id="ID3c8cfca2974e4e8fb978571d6b34f158"><enum>(C)</enum><text>developing a
			 single monitoring and oversight system for the plans approved under this
			 section;</text>
						</subparagraph><subparagraph id="ID6b0e2e2e7fd24a0580b860e8f829c52c"><enum>(D)</enum><text>receiving and
			 distributing all funds covered by a plan approved under this section;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0ab99577f292453d8872d73e9285261b"><enum>(E)</enum><text>conducting any
			 required investigation relating to a waiver or an interagency dispute
			 resolution under this section.</text>
						</subparagraph></paragraph><paragraph id="IDbaa6ee9c0c7e4c619b97618c1dfd8378"><enum>(3)</enum><header>Model single
			 report</header><text>The model single report described in paragraph (2)(A)
			 shall—</text>
						<subparagraph id="id298863793D8E4B06AE4249A28E20F389"><enum>(A)</enum><text>be developed by
			 the Secretary, in accordance with the requirements of this section; and</text>
						</subparagraph><subparagraph id="id50A2E87247F04A9EB76790DEFDD706A4"><enum>(B)</enum><text>together with
			 records maintained at the Indian tribal level regarding the plan of the Indian
			 tribe or tribal resource development organization, contain such information as
			 would allow a determination that the Indian tribe or tribal energy development
			 organization—</text>
							<clause id="idA73B4D5C54954361827A5ABDB76D80A2"><enum>(i)</enum><text>has
			 complied with the requirements incorporated in the applicable plan; and</text>
							</clause><clause id="idEA79B4BB311E486B8A2088E5A55F2DD7"><enum>(ii)</enum><text>will provide
			 assurances to each applicable agency that the Indian tribe or tribal energy
			 development organization has complied with all directly applicable statutory
			 and regulatory requirements.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="ID9f6d626dc37d429cb136209bcf223859"><enum>(g)</enum><header>No reduction,
			 denial, or withholding of funds</header><text>No Federal funds may be reduced,
			 denied, or withheld as a result of participation by an Indian tribe or tribal
			 energy development organization in the program under this section.</text>
				</subsection><subsection id="IDd0e223c5eb1f45838d8baefc13e237c9"><enum>(h)</enum><header>Interagency
			 fund transfers</header>
					<paragraph id="IDd2d55a0070584db3ad1e14147c6b06ca"><enum>(1)</enum><header>In
			 general</header><text>If a plan submitted by an Indian tribe or tribal energy
			 development organization under this section is approved, the Secretary and the
			 applicable Agency leaders shall take all necessary steps to effectuate
			 interagency transfers of funds to the Department for distribution to the Indian
			 tribe or tribal energy development organization.</text>
					</paragraph><paragraph id="IDdf1c965c58794c5982a264b2e6edb3b0"><enum>(2)</enum><header>Coordinated
			 agency action</header><text>As part of an interagency transfer under paragraph
			 (1), the applicable Agency leader shall provide the Department a 1-time
			 transfer of all required funds by not later than October 1 of each applicable
			 fiscal year.</text>
					</paragraph><paragraph id="ID71a22b426f0a453e9eb5d0430f1effa2"><enum>(3)</enum><header>Agencies not
			 authorized to withhold funds</header><text>If a plan is approved under this
			 section, none of the applicable Agency leaders may withhold funds for the
			 plan.</text>
					</paragraph></subsection><subsection id="ID0b775713cf8a4f3a8c0ae5b1a75b6a42"><enum>(i)</enum><header>Administration;
			 recordkeeping; overage</header>
					<paragraph id="ID91ffee144ff24bc788eb90d2204037a2"><enum>(1)</enum><header>Administration
			 of funds</header>
						<subparagraph id="ID07e842160afe418d95a159a188cabfae"><enum>(A)</enum><header>In
			 general</header><text>The funds for a plan under this section shall be
			 administered in a manner that allows for a determination that funds from a
			 specific program (or an amount equal to the amount attracted from each program)
			 shall be used for activities described in the plan.</text>
						</subparagraph><subparagraph id="ID49b57b1673034f3ab4bbd296f6ad018c"><enum>(B)</enum><header>Separate
			 records not required</header><text>Nothing in this section requires an Indian
			 tribe or tribal energy development organization—</text>
							<clause id="id029D44F598A44F7E9EA85B1D90C1A2FF"><enum>(i)</enum><text>to
			 maintain separate records relating to any service or activity conducted under
			 the applicable plan for the program under which the funds were authorized;
			 or</text>
							</clause><clause id="idA29D0F142B8242F8A970DBCC833879A0"><enum>(ii)</enum><text>to
			 allocate expenditures among those programs.</text>
							</clause></subparagraph></paragraph><paragraph id="IDe36ba09385d449f69c559583ca124814"><enum>(2)</enum><header>Administrative
			 expenses</header>
						<subparagraph id="idAEC98FFC88C2433B8CF953DF354584BD"><enum>(A)</enum><header>Commingling</header><text>Administrative
			 funds for activities under a plan under this section may be commingled.</text>
						</subparagraph><subparagraph id="id28825945065D42CCB245D665AC9623AF"><enum>(B)</enum><header>Entitlement</header><text>An
			 Indian tribe or tribal energy development organization shall be entitled to the
			 full amount of administrative costs for the activities of a plan under this
			 section, in accordance with applicable regulations.</text>
						</subparagraph><subparagraph id="idDA3503CB6A34473D9983B0D6132F16C7"><enum>(C)</enum><header>Overages</header><text>No
			 overage of administrative costs for the activities of a plan under this section
			 shall be counted for Federal audit purposes, if the overage is used for the
			 purposes described in this section.</text>
						</subparagraph></paragraph></subsection><subsection id="ID19d45e40f4dc4915bf975afe92757aa9"><enum>(j)</enum><header>Single Audit
			 Act</header><text>Nothing in this section interferes with the ability of the
			 Secretary to fulfill the responsibilities for the safeguarding of Federal funds
			 pursuant to chapter 75 of title 31, United States Code (commonly known as the
			 <quote>Single Audit Act</quote>).</text>
				</subsection><subsection id="ID2c9899be86b5443494a81cefa4721d52"><enum>(k)</enum><header>Training and
			 technical assistance</header>
					<paragraph id="idCA96251AB1A84A2887B3C29292AE9548"><enum>(1)</enum><header>In
			 general</header><text>The Department, with the participation and assistance of
			 the Agency leaders, shall conduct activities for technical assistance and
			 training relating to plans under this section, including—</text>
						<subparagraph id="id46612FB9F8074C258B8613B93654FFBF"><enum>(A)</enum><text>orientation
			 sessions for Indian tribal leaders;</text>
						</subparagraph><subparagraph id="id4AB53BC3EF5945AA86B459E0FD8F5EA5"><enum>(B)</enum><text>workshops on
			 planning, operations, and procedures for employees of Indian tribes;</text>
						</subparagraph><subparagraph id="id54967531C5BA4D2F8BB8CEC832682841"><enum>(C)</enum><text>training relating
			 to case management, client assessment, education and training options, employer
			 involvement, and related topics; and</text>
						</subparagraph><subparagraph id="idAE34EEAA7B064544B6854BB6D0310F20"><enum>(D)</enum><text>the development
			 and dissemination of training and technical assistance materials in printed
			 form and over the Internet.</text>
						</subparagraph></paragraph><paragraph id="IDcf1a8419509043299edb5ab42546015a"><enum>(2)</enum><header>Administration</header><text>To
			 effectively administer the training and technical assistance activities under
			 this subsection, the Department shall collaborate with an Indian tribe that has
			 experience with federally funded energy-related activities and programs
			 (including programs for employment training, energy planning, financing,
			 construction, and related physical infrastructure and equipment).</text>
					</paragraph><paragraph id="IDd0a4c87c311c43ab87acff9c37555f17"><enum>(3)</enum><header>Authorization
			 of appropriations</header><text>To carry out this subsection, there is
			 authorized to be appropriated to the Department, $500,000 for each of fiscal
			 years 2011 through 2016, to remain available until expended.</text>
					</paragraph></subsection></section><section id="idFC2EB5DD0F4045B2815C2E40121F6DF9"><enum>102.</enum><header>Indian land
			 predevelopment feasibility activities</header>
				<subsection commented="no" id="idC073646214A84D85ABDBC0F23EB57361"><enum>(a)</enum><header>Definition of
			 renewable energy</header><text display-inline="yes-display-inline">In this
			 section, the term <term>renewable energy</term> means electric energy generated
			 from—</text>
					<paragraph commented="no" id="IDe18557fabfdb4492bc3daff5db8a781d"><enum>(1)</enum><text>solar
			 energy;</text>
					</paragraph><paragraph commented="no" id="ID330e064013774416bd9632e89b91ea96"><enum>(2)</enum><text>wind
			 energy;</text>
					</paragraph><paragraph commented="no" id="IDd298733312eb45e083e1b6da35c5b681"><enum>(3)</enum><text>marine and
			 hydrokinetic renewable energy;</text>
					</paragraph><paragraph commented="no" id="ID920fd3a1efab4dd495a20076be69471a"><enum>(4)</enum><text>geothermal
			 energy;</text>
					</paragraph><paragraph commented="no" id="ID5647f7b5b87d40fd9488dec791d99074"><enum>(5)</enum><text>instream
			 hydrokinetic energy or micro-hydroelectric projects;</text>
					</paragraph><paragraph commented="no" id="ID64dd24f264c943279a635d17ab4961ec"><enum>(6)</enum><text>biomass;
			 or</text>
					</paragraph><paragraph commented="no" id="ID3a6055dac3914a4e8a0542fc28ec6ba9"><enum>(7)</enum><text>landfill
			 gas.</text>
					</paragraph></subsection><subsection id="id36F9A4034A554660A2DD49DDE6F213FE"><enum>(b)</enum><header>Approval
			 requirement</header><text display-inline="yes-display-inline">Notwithstanding
			 any other provision of law, including section 2103 of the Revised Statutes (25
			 U.S.C. 81), United States Code, no agreement for activities on Indian land
			 shall require the review or approval of the Secretary of the Interior if the
			 agreement—</text>
					<paragraph id="IDaa307b9ff2db4d8aaf0847e218852424"><enum>(1)</enum><text>involves an
			 activity for the purpose of conducting a scientific, geological, environmental,
			 energy, or other related and necessary study or assessment;</text>
					</paragraph><paragraph id="IDfe5fcd0fb16240adbcd7baa3f5e75882"><enum>(2)</enum><text>involves the
			 construction of a temporary facility that will be fully removed or reclaimed
			 after the activity described in paragraph (1) is completed;</text>
					</paragraph><paragraph id="IDcee82c94c4604240b7cf1d6016ef8dd6"><enum>(3)</enum><text>does not, as
			 determined by the Indian tribe, threaten the natural, cultural, or historic
			 resources of the Indian tribe;</text>
					</paragraph><paragraph id="ID4950c7ca19174767956bc9c91eb1e121"><enum>(4)</enum><text>applies for a
			 period of less than 7 years; and</text>
					</paragraph><paragraph id="ID0b43427bb3d2432e918cbfa31b22f852"><enum>(5)</enum><text>is executed to
			 study the feasibility of, or in preparation for, the development of a renewable
			 energy project on Indian land.</text>
					</paragraph></subsection></section><section id="id669DC434827E43D78AE9BDD008480F5D"><enum>103.</enum><header>Indian energy
			 planning</header><text display-inline="no-display-inline">Section 2602(a) of
			 the Energy Policy Act of 1992 (25 U.S.C. 3502(a)) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id54EC41FF3CC044978A823D0AE18D8968" style="OLC">
					<paragraph id="idCBCFB1D233E94FD5BD5EB45569606A6A"><enum>(4)</enum><header>Planning</header>
						<subparagraph id="id403B5149FC2146339A3D5C65C754A4E4"><enum>(A)</enum><header>In
				general</header><text>In carrying out the program established by paragraph (1),
				the Secretary shall provide assistance to interested Indian tribes to develop
				energy plans, including—</text>
							<clause id="ID20aca481be46445dbed6177966a820b4"><enum>(i)</enum><text>plans for
				electrification;</text>
							</clause><clause id="ID11b9ba01f58946b1b25c9642051f21e6"><enum>(ii)</enum><text>plans for oil
				and gas permitting, renewable energy permitting, energy efficiency, electricity
				generation, transmission planning, water planning, and other planning relating
				to energy issues;</text>
							</clause><clause id="IDce2520bc7d474b2d8cf0aaa175c51e8c"><enum>(iii)</enum><text>plans for the
				development of energy resources and to ensure the protection of natural,
				historic, and cultural resources; and</text>
							</clause><clause id="ID4d123a2e1d5144339f6f99ef953e09a6"><enum>(iv)</enum><text>any other plans
				that would assist an Indian tribe in the development or use of energy
				resources.</text>
							</clause></subparagraph><subparagraph id="idFF8DBE6F7A2B4454B3FA14D0032B374C"><enum>(B)</enum><header>Cooperation</header><text>In
				establishing the program under paragraph (1), the Secretary shall work in
				cooperation with the Office of Indian Energy Policy and Programs of the
				Department of
				Energy.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="ID43b997ef68274eeb82a196bff721ac14"><enum>104.</enum><header>Department of
			 Energy Indian energy education planning and management assistance
			 program</header><text display-inline="no-display-inline">Section 2602(b) of the
			 Energy Policy Act of 1992 (25 U.S.C. 3502(b)) is amended—</text>
				<paragraph id="ID9ada0d0be5f7485d8357cadc98f1199c"><enum>(1)</enum><text>in paragraph
			 (2)—</text>

				</paragraph></section><section id="idE045D71DA3AE43959BAF61AC40A0AE4C"><enum>105.</enum><header>Appraisals</header>
				<subsection id="id5905F460C57541119042D0E2CF76E9CF"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title XXVI of the
			 Energy Policy Act of 1992 (25 U.S.C. 3501 et seq.) is amended by adding at the
			 end the following:</text>

						<section id="idB01E68ECCF6B4B5DB737246FEED5912D"><enum>2608.</enum><header>Appraisals</header>
							<subsection id="ID94a9e69942694ba6aba169f3cd9211d4"><enum>(a)</enum><header>Options for
				conducting appraisals</header><text>With respect to a transaction involving
				tribal land or the trust assets of an Indian tribe that requires the approval
				of the Secretary, any appraisal relating to fair market value required to be
				conducted under applicable law may be conducted by—</text>
								<paragraph id="idAC746A000EAD4AAC82C905FC59B12367"><enum>(1)</enum><text>the
				Secretary;</text>
								</paragraph><paragraph id="idF7E801C3D3754229B11D7DF427171FC2"><enum>(2)</enum><text>the affected
				Indian tribe; or</text>
								</paragraph><paragraph id="ID0259112682774b9f8b56f28ad2c48eff"><enum>(3)</enum><text>a certified,
				third-party appraiser pursuant to a contract with the Indian tribe.</text>
								</paragraph></subsection><subsection id="ID93a6c0f9967345dba274bffbc7d8a8b3"><enum>(b)</enum><header>Secretarial
				review and approval</header><text>Not later than 30 days after the date on
				which the Secretary receives an appraisal conducted by or for an Indian tribe
				pursuant to paragraphs (2) or (3) of subsection (a), the Secretary
				shall—</text>
								<paragraph id="id2EACBD587AA84A9C87B45EF63AA7E6CD"><enum>(1)</enum><text>review the
				appraisal; and</text>
								</paragraph><paragraph id="idCB69ED1EA55545E881CE72BA8E87FA9E"><enum>(2)</enum><text>provide to the
				Indian tribe a written notice of approval or disapproval of the
				appraisal.</text>
								</paragraph></subsection><subsection id="IDfd3e27e4527d4a7da3c3de929a365917"><enum>(c)</enum><header>Regulations</header><text>The
				Secretary shall develop regulations for implementing this section, including
				standards the Secretary shall use for approving or disapproving an
				appraisal.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id1EDBC1AA30514167A7C71849C35D9014"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents of the Energy Policy Act of 1992
			 (42 U.S.C. 13201 note) is amended by adding at the end of the items relating to
			 title XXVI the following:</text>

				</paragraph></section><section id="ID66cd5d40295e4a28a66c24ce6cede9d2"><enum>107.</enum><header>Indian
			 hydroelectric provisions</header><text display-inline="no-display-inline">Section 7(a) of the Federal Power Act (16
			 U.S.C. 800(a)) is amended—</text>
				<paragraph id="id74E773C02A9A4322B926F59AE8469F6C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In issuing</quote> and

					</subparagraph></paragraph></section><section id="idC4002BB7D80A4B5BA0BED2C6D63770DA"><enum>108.</enum><header>Study on
			 inclusion of Indian tribes in national and regional electrical infrastructure
			 planning</header>
				<subsection id="id8FE2AEC0B1214BF5B46CAD8F12590136"><enum>(a)</enum><header>Study</header>
					<paragraph id="idBB5A0E9A747A448AAA4A93D339C41680"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Energy, in consultation with Indian
			 tribes, intertribal organizations, the Secretary of the Interior, the Federal
			 Energy Regulatory Commission, the Federal power marketing administrations,
			 regional transmission operators, national, regional, and local electric
			 transmission providers, electric utilities, electric cooperatives, electric
			 utility organizations, and other interested stakeholders, shall conduct a study
			 to assess—</text>
						<subparagraph id="idA409206581C941C38A556D429B0147F4"><enum>(A)</enum><text>the potential for
			 electric generation on Indian land and on the Outer Continental Shelf adjacent
			 to Indian land, from renewable energy resources; and</text>
						</subparagraph><subparagraph id="id0BFDAC8002A7479081A82519A9B8DA6F"><enum>(B)</enum><text>the electrical
			 transmission needs relating to carrying that energy to the market.</text>
						</subparagraph></paragraph><paragraph id="id8B77CF012A4B43568650ACB4F2C30357"><enum>(2)</enum><header>Requirements</header><text>The
			 study under paragraph (1) shall—</text>
						<subparagraph id="ID963094d6d4024798b784661c5eee9beb"><enum>(A)</enum><text>identify
			 potential energy generation resources on Indian land and on the Outer
			 Continental Shelf adjacent to Indian land, from renewable energy
			 resources;</text>
						</subparagraph><subparagraph id="ID572d591063d24af29d2e4b0b9c9f3e09"><enum>(B)</enum><text>identify existing
			 electrical transmission infrastructure on, and available to provide service to,
			 Indian land;</text>
						</subparagraph><subparagraph id="ID799949328dbf43fa804e45fadf1787d5"><enum>(C)</enum><text>identify relevant
			 potential electric transmission routes and paths that can carry electricity
			 generated on Indian land to loads;</text>
						</subparagraph><subparagraph id="IDda3a958501b74c6a9c5fdf4b933793cb"><enum>(D)</enum><text>assess the
			 capacity and availability of interconnection of existing electrical
			 transmission infrastructure;</text>
						</subparagraph><subparagraph id="IDfd75ac5ee73b4513b93cc6e488b9212a"><enum>(E)</enum><text>identify options
			 to ensure tribal access to electricity, if the development of transmission
			 infrastructure to reach tribal areas is determined to be unfeasible;</text>
						</subparagraph><subparagraph id="id7B7EEE64DCEE4E4E96A9A072B10B39D3"><enum>(F)</enum><text>identify
			 regulatory, structural, financial, or other obstacles that Indian tribes
			 encounter or would encounter in attempting to develop energy transmission
			 infrastructure or connect with existing electrical transmission infrastructure;
			 and</text>
						</subparagraph><subparagraph id="ID4f7fee83c7c242b6b8ba624a4a73fa5b"><enum>(G)</enum><text>make
			 recommendations for legislation to help Indian tribes overcome the obstacles
			 identified under subparagraph (F).</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC4C38B1C511D4F7CA91F87A67A0683DC"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 submit to Congress a report describing the results of the study under
			 subsection (a).</text>
				</subsection></section><section id="ID14d68b05b89e4137bc817c929babf683"><enum>109.</enum><header>Treatment of
			 certain activities and resources as sustainable management practices</header>
				<subsection id="ID27b6597d241944bf929bb0004e60361c"><enum>(a)</enum><header>National Indian
			 Forest Resources Management Act</header><text>The National Indian Forest
			 Resources Management Act (25 U.S.C. 3101 et seq.) is amended by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0FC4A00AE2014B80B9964254F649226D" style="OLC">
						<section id="IDcb56f2b492f4449d953b66fa30230688"><enum>322.</enum><header>Treatment of
				certain activities and resources as sustainable management
				practices</header><text display-inline="no-display-inline">Unless otherwise
				specifically exempted by Federal law, any activity conducted, or resource
				harvested or produced, pursuant to a forest management plan, including a tribal
				integrated resource management plan, approved by the Secretary under this Act
				shall be considered a sustainable management practice for the purposes of any
				applicable Federal standard, benefit, or requirement that requires a
				demonstration of
				sustainability.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="IDc324796c826b4f56b15a9c852370b1e7"><enum>(b)</enum><header>American Indian
			 Agricultural Resource Management Act</header><text>Section 101 of the American
			 Indian Agricultural Resource Management Act (25 U.S.C. 3711) is amended by
			 adding at the end the following:</text>

						<subsection id="ID22ff71f3e9334f41bc8d3a208dd16491"><enum>(c)</enum><header>Treatment of

				practices</header><text>Unless otherwise specifically exempted by Federal law,
				any activity conducted, or resource harvested or produced, pursuant to an
				agricultural resource management plan, including an integrated resource
				management plan, approved by the Secretary under this section shall be
				considered to be a sustainable management practice for the purposes of any
				applicable Federal standard, benefit, or requirement that requires a
				demonstration of
				sustainability.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="idEF5B5DCF0B014F0A919A1951EC0D1C68"><enum>110.</enum><header>Indian land
			 consolidation</header>
				<subsection id="id927B0ED2CF864CABAC50F9322C2F64F2"><enum>(a)</enum><header>Definitions</header><text>Section
			 202(6) of the Indian Land Consolidation Act (25 U.S.C. 2201(6)) is

			 revenue from acquired interests to land consolidation
			 program</header><text>Section 214(b) of the Indian Land Consolidation Act (25
			 U.S.C. 2213(b)) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6D730B4B4FF3472BB6834591CA7753EC" style="OLC">
						<paragraph id="IDd5d8d367df874d8a94a230b38bebca37"><enum>(6)</enum><header>Tribal
				authority to apply revenues against other liens</header>
							<subparagraph id="idA255145EACB84810AACB5C277DC8B9C4"><enum>(A)</enum><header>In
				general</header><text>On receipt of a written request of the governing body of
				an Indian tribe with 1 or more beneficial interests in land received pursuant
				to section 213(a)(3), the Secretary shall credit any revenues derived from
				those beneficial interests against any lien under paragraph (1) on revenues
				from 1 or more other beneficial interests of that Indian tribe (regardless of
				whether such a beneficial interest is in the same tract of land), as specified
				in the request.</text>
							</subparagraph><subparagraph id="ID25d79bb375b049fc848abccd1959e10b"><enum>(B)</enum><header>Amendment or
				revocation of request</header><text>The governing body of an Indian tribe may
				amend or revoke, in writing, a request submitted under subparagraph (A) if, as
				determined by the Secretary, the amendment or revocation does not affect the
				application of revenues made by the Secretary pursuant to that subparagraph
				before the date on which the amendment or revocation is received by the
				Secretary.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idABCED9F879EB49FEA497BE3BD162E127"><enum>(d)</enum><header>Owner-Managed
			 interests</header><text>Section 221 of the Indian Land Consolidation Act (25
			 U.S.C. 2220) is amended—</text>
					<paragraph id="id0E2A59C30D60451DA9435F02A05F0B0A"><enum>(1)</enum><text>in subsection
			 (c)—</text>
						<subparagraph id="id14E40274F7B54DDCAE2353EAB014BF41"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>agricultural purposes for a term not to exceed 10
			 years.</quote> and inserting <quote>any purpose authorized by the first section
			 of the Act of August 9, 1959 (25 U.S.C. 415), or any applicable law of the
			 Indian tribe with jurisdiction over the land, for a term of not more than 25
			 years, which may be renewed for an additional period of not more than 25
			 years.</quote>; and</text>
						</subparagraph><subparagraph id="id59AD5AE12BDC491F85ECC7C1CE94E8C0"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idBA927E4B3DAE48CCA19E4F50DE888E3B" style="OLC">
								<paragraph id="IDbb3fde14a6614711b9dd1c9de7417b03"><enum>(3)</enum><header>Prohibited
				uses</header><text>Notwithstanding paragraph (1), any lease entered into under
				that paragraph shall include a provision expressly prohibiting the use of the
				leased parcel for storing or processing hazardous wastes or materials of any
				kind.</text>
								</paragraph><paragraph id="IDeae2cf2aea0444258c38aa45a21c1184"><enum>(4)</enum><header>Inclusion of
				necessary and reasonable access in leases</header>
									<subparagraph id="id9A1D529B636B470981AA9FB4DCEAD063"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, any lease
				authorized by this section may include provisions for 1 or more access routes
				to serve, or assist in carrying out, the purposes of the lease provided that
				the term or renewal term of any access provisions does not exceed,
				respectively, the term or renewal term of the lease.</text>
									</subparagraph><subparagraph id="idB78CC81A1E57428F8FCE87A6D4B60FD3"><enum>(B)</enum><header>Compensation</header><text>If
				provisions regarding necessary and reasonable access are included in a lease
				under subparagraph (A), compensation for the provisions regarding access shall
				be included in the lease.</text>
									</subparagraph><subparagraph id="id33A299D5A8E64D85A562E6744468B629"><enum>(C)</enum><header>Nonapplicability</header><text>Any
				access provision in a lease described in subparagraph (A) shall not—</text>
										<clause id="id86139103DC314CDF8ED2F2D8CE8E45A5"><enum>(i)</enum><text>be considered a
				right-of-way; or</text>
										</clause><clause id="id1B103E8A36BB4123BF489C8AD06DEE19"><enum>(ii)</enum><text>invoke any
				Federal law, regulation, or standard relating to rights-of-way, including
				provisions in the Act of February 5, 1948 (25 U.S.C. 323 et
				seq.).</text>
										</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="id131D1656AF1F4374AB612142FCFEA2E6"><enum>(2)</enum><text>in subsection

				exceed 10 years.</text>

			 religious, educational, recreational, residential, business, and other purposes
			 requiring the grant of long-term leases</quote>, approved August 9, 1955 (25
			 U.S.C. 415), is amended as follows:</text>
					<paragraph id="H70311048F9214CA785AD4054F34E0EF3"><enum>(1)</enum><text>In subsection
			 (d)—</text>
						<subparagraph id="id7204553F58AC4B15B4A183227337FA41"><enum>(A)</enum><text>in paragraph (4),

								</paragraph><paragraph id="idADC4938A3CA04651945E4259CD939BCB"><enum>(10)</enum><text>the term
				<term>individually owned allotted land</term> means a parcel of land
				that—</text>
									<subparagraph id="id449F293ABD8B4B9B9BEBE31A4FB36046"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id9F7FF22C53CD4FC2808234B549223175"><enum>(i)</enum><text>is located within the
				jurisdiction of an Indian tribe; or</text>
										</clause><clause id="idAE38DBBBF7514452B343B2DE8365A4C5" indent="up1"><enum>(ii)</enum><text>is held in trust or restricted
				status by the United States for the benefit of an Indian tribe or a member of
				an Indian tribe; and</text>
										</clause></subparagraph><subparagraph id="id3348A8F7567C4FEB94996F499DEAFC99"><enum>(B)</enum><text>is allotted to a
				member of an Indian
				tribe.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idA4E0089BFBA84DBDA708A935A1ED10DA"><enum>(2)</enum><text>By adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="idAF19071B22684878B5C88A9C931CE856" style="OLC">
							<subsection id="idD57544022F1F49AA82234112015A8702"><enum>(h)</enum><header>Tribal approval
				of leases</header>
								<paragraph id="idAA647C5E16E64E6395CF801E1FD076F4"><enum>(1)</enum><header>In
				general</header><text>At the discretion of any Indian tribe, any lease by the
				Indian tribe for the purposes authorized under subsection (a) (including any
				amendments to subsection (a)), except a lease for the exploration, development,
				or extraction of any mineral resources, shall not require the approval of the
				Secretary, if the lease is executed under the tribal regulations approved by
				the Secretary under this subsection and the term of the lease does not
				exceed—</text>
									<subparagraph id="id8BB84C205F764BF9B5C14848096F993B"><enum>(A)</enum><text>in the case of a
				business or agricultural lease, 25 years, except that any such lease may
				include an option to renew for up to 2 additional terms, each of which may not
				exceed 25 years; and</text>
									</subparagraph><subparagraph id="id5F6297A009144E0CADB93D78C56F81F7"><enum>(B)</enum><text>in the case of a
				lease for public, religious, educational, recreational, or residential
				purposes, 75 years, if such a term is provided for by the regulations issued by
				the Indian tribe.</text>
									</subparagraph></paragraph><paragraph id="id9F399C61F6F644F9810A849F4AAA7DD9"><enum>(2)</enum><header>Allotted
				land</header><text>Paragraph (1) shall not apply to any lease of individually
				owned Indian allotted land.</text>
								</paragraph><paragraph id="id26FC0FE40ED040C3B828112D856220A4"><enum>(3)</enum><header>Authority of
				Secretary over tribal regulations</header>
									<subparagraph id="id457487DDB72046BA8C1A298CBC59AD1D"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall have the authority to approve or
				disapprove any tribal regulations issued in accordance with paragraph
				(1).</text>
									</subparagraph><subparagraph id="id8A4FA3093A5E41D08E55A6AD8F1C49FD"><enum>(B)</enum><header>Considerations
				for approval</header><text>The Secretary shall approve any tribal regulation
				issued in accordance with paragraph (1), if the tribal regulations—</text>
										<clause id="id08EA0E0250554CC9BA62FB793BF76EFD"><enum>(i)</enum><text>are consistent
				with any regulations issued by the Secretary under subsection (a) (including
				any amendments to the subsection or regulations); and</text>
										</clause><clause id="id779C1B8140BE4E318751F581B86B3F52"><enum>(ii)</enum><text>provide for an
				environmental review process that includes—</text>
											<subclause id="id7F347903636745C8ABF7EF9412498D70"><enum>(I)</enum><text>the
				identification and evaluation of any significant effects of the proposed action
				on the environment; and</text>
											</subclause><subclause id="id5FDC18D959BD4423A1184A139AF147D3"><enum>(II)</enum><text>a process for
				ensuring that—</text>
												<item id="idC9A9602BCB274C8AA591C110ABDCD019"><enum>(aa)</enum><text>the public is
				informed of, and has a reasonable opportunity to comment on, any significant
				environmental impacts of the proposed action identified by the Indian tribe;
				and</text>
												</item><item id="idD6E84E21CD684E4A93C17815962DABD4"><enum>(bb)</enum><text>the Indian tribe
				provides responses to relevant and substantive public comments on any such
				impacts before the Indian tribe approves the lease.</text>
												</item></subclause></clause></subparagraph></paragraph><paragraph id="id2D77B7184BC940E7B74051C4A646A57E"><enum>(4)</enum><header>Review
				process</header>
									<subparagraph id="idA49F01BAE59B435EA529D29E8739CECC"><enum>(A)</enum><header>In
				general</header><text>Not later than 120 days after the date on which the
				tribal regulations described in paragraph (1) are submitted to the Secretary,
				the Secretary shall review and approve or disapprove the regulations.</text>
									</subparagraph><subparagraph id="idA0E492A67C964E1E9704AFCFEB586A1B"><enum>(B)</enum><header>Written
				documentation</header><text>If the Secretary disapproves the tribal regulations
				described in paragraph (1), the Secretary shall include written documentation
				with the disapproval notification that describes the basis for the
				disapproval.</text>
									</subparagraph><subparagraph id="idE2669FD9260148BF975C7148B1881F33"><enum>(C)</enum><header>Extension</header><text>The
				deadline described in subparagraph (A) may be extended by the Secretary, after
				consultation with the Indian tribe.</text>
									</subparagraph></paragraph><paragraph id="id5CB50D92FD9542208C3034BCECAC77C7"><enum>(5)</enum><header>Federal
				environmental review</header><text>Notwithstanding paragraphs (3) and (4), if
				an Indian tribe carries out a project or activity funded by a Federal agency,
				the Indian tribe shall have the authority to rely on the environmental review
				process of the applicable Federal agency rather than any tribal environmental
				review process under this subsection.</text>
								</paragraph><paragraph id="idA2B3E63EAAB749D28FE09A7296AE0643"><enum>(6)</enum><header>Documentation</header><text>If
				an Indian tribe executes a lease pursuant to tribal regulations under paragraph
				(1), the Indian tribe shall provide the Secretary with—</text>
									<subparagraph id="idDF74F82D6DE3497D87F34FA6E295F4FF"><enum>(A)</enum><text>a copy of the
				lease, including any amendments or renewals to the lease; and</text>
									</subparagraph><subparagraph id="idB583EE160275409DA0B0916A74EA1763"><enum>(B)</enum><text>in the case of
				tribal regulations or a lease that allows for lease payments to be made
				directly to the Indian tribe, documentation of the lease payments that are
				sufficient to enable the Secretary to discharge the trust responsibility of the
				United States under paragraph (7).</text>
									</subparagraph></paragraph><paragraph id="id09427324C4D844DFBF53926E788B567A"><enum>(7)</enum><header>Trust
				responsibility</header>
									<subparagraph id="id30073246C65247E4AA98D20E200E46EA"><enum>(A)</enum><header>In
				general</header><text>The United States shall not be liable for losses
				sustained by any party to a lease executed pursuant to tribal regulations under
				paragraph (1).</text>
									</subparagraph><subparagraph id="id724FFCD1D28848CFBD8B8A32058F9679"><enum>(B)</enum><header>Authority of
				Secretary</header><text>Pursuant to the authority of the Secretary to fulfill
				the trust obligation of the United States to the applicable Indian tribe under
				Federal law (including regulations), the Secretary may, upon reasonable notice
				from the applicable Indian tribe and at the discretion of the Secretary,
				enforce the provisions of, or cancel, any lease executed by the Indian tribe
				under paragraph (1).</text>
									</subparagraph></paragraph><paragraph id="id5DAB885A9F5A4D30ACECA27471EF35B0"><enum>(8)</enum><header>Compliance</header>
									<subparagraph id="idEF1FFEB5086B4048ABE5E0DA327652C4"><enum>(A)</enum><header>In
				general</header><text>An interested party, after exhausting of any applicable
				tribal remedies, may submit a petition to the Secretary, at such time and in
				such form as the Secretary determines to be appropriate, to review the
				compliance of the applicable Indian tribe with any tribal regulations approved
				by the Secretary under this subsection.</text>
									</subparagraph><subparagraph id="id27FE5301E29F4BDE93F6594834940C65"><enum>(B)</enum><header>Violations</header><text>If,
				after carrying out a review under subparagraph (A), the Secretary determines
				that the tribal regulations were violated, the Secretary may take any action
				the Secretary determines to be necessary to remedy the violation, including
				rescinding the approval of the tribal regulations and reassuming responsibility
				for the approval of leases of tribal trust lands.</text>
									</subparagraph><subparagraph id="id555D56832FC64CE1930D2000F29536E1"><enum>(C)</enum><header>Documentation</header><text>If
				the Secretary determines that a violation of the tribal regulations has
				occurred and a remedy is necessary, the Secretary shall—</text>
										<clause id="id550FDB13952C4A1F8C8E11C98ACBF78C"><enum>(i)</enum><text>make a written
				determination with respect to the regulations that have been violated;</text>
										</clause><clause id="id4F17BDDF43234D82B99A84793AEFBB93"><enum>(ii)</enum><text>provide the
				applicable Indian tribe with a written notice of the alleged violation together
				with such written determination; and</text>
										</clause><clause id="idCA138B71A506454FA0581221755C360E"><enum>(iii)</enum><text>prior to the
				exercise of any remedy, the rescission of the approval of the regulation
				involved, or the reassumption of lease approval responsibilities, provide the
				applicable Indian tribe with—</text>
											<subclause id="idA00FE09154BE4A8480074096256718CC"><enum>(I)</enum><text>a hearing that is
				on the record; and</text>
											</subclause><subclause id="idC7E58D69B95E4014AD474F811E8E335A"><enum>(II)</enum><text>a reasonable
				opportunity to cure the alleged violation.</text>
											</subclause></clause></subparagraph></paragraph><paragraph id="id29D123AADF944C4F85758AD6EF380093"><enum>(9)</enum><header>Savings
				clause</header><text>Nothing in this subsection shall affect subsection (e) or
				any tribal regulations issued under that
				subsection.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5AC3F9C5F1F0429DBF1CE591551A1E7B"><enum>(e)</enum><header>Land title
			 reports</header><text>Not later than 180 days after funds are made available
			 for this section, the Bureau of Indian Affairs shall prepare and submit to the
			 Committees on Financial Services and Natural Resources in the House of
			 Representatives and the Committees on Banking, Housing, and Urban Affairs and
			 Indian Affairs in the Senate a report regarding the history and experience of
			 Indian tribes that have chosen to assume responsibility for operating the
			 Indian Land Title and Records Office (hereafter referred to as the “LTRO”)
			 functions from the Bureau of Indian Affairs. In conducting the review, the
			 Bureau of Indian Affairs shall consult with the Department of Housing and Urban
			 Development Office of Native American Programs and those Indian tribes that are
			 managing LTRO functions (hereafter referred to as the “managing Indian
			 tribes”). The review shall include an analysis of the following factors:</text>
					<paragraph id="H9F7861B49A7D44E79FA02EEA5A886957"><enum>(1)</enum><text display-inline="yes-display-inline">Whether and how tribal management of the
			 LTRO functions has expedited the processing and issuance of Indian land title
			 certifications as compared to when the Bureau of Indian Affairs managed these
			 programs.</text>
					</paragraph><paragraph id="H3D6AE1FC33CD4F63AAB2E63545AFC1A3"><enum>(2)</enum><text>Whether and how
			 tribal management of the LTRO functions has increased home ownership among the
			 managing Indian tribe’s population.</text>
					</paragraph><paragraph id="H33B2FBC2B56F4F3DB5C9F13AB16EA8A8"><enum>(3)</enum><text>What internal
			 preparations and processes were required of the managing Indian tribes prior to
			 assuming management of the LTRO functions.</text>
					</paragraph><paragraph id="HB4AA9267B50846C38909517906AD0ECA"><enum>(4)</enum><text display-inline="yes-display-inline">Whether tribal management of the LTRO
			 functions resulting in a transfer of financial resources and manpower from the
			 Bureau of Indian Affairs to the managing Indian tribes and, if so, what
			 transfers were undertaken.</text>
					</paragraph><paragraph id="H7A71900600704D32ABE20D1BF771D43B"><enum>(5)</enum><text>Whether, in
			 appropriate circumstances and with the approval of geographically proximate
			 Indian tribes, the LTRO functions may be performed by a single Indian tribe or
			 a tribal consortium in a cost effective manner.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8250E56E3666459E90137AB8BB33B6D4"><enum>(f)</enum><header>Indian
			 Reorganization Act</header><text>Section 17 of the Act of June 18, 1934 (25
			 U.S.C. 477) (commonly known as the <quote>Indian Reorganization Act</quote>) is
			 amended in the second sentence by striking <quote>twenty-five</quote> and
			 inserting <quote>99</quote>.</text>
				</subsection></section><section commented="no" id="id3F83CA1D4B984E8DAB3D267B728E8F16"><enum>302.</enum><header>Oil and gas
			 fees on Indian land</header>
				<subsection id="idBF98D052D3A243E98BC99F03366E3900"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The second
			 undesignated paragraph of the matter under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Management of lands and
			 resources (including rescission of funds)</header-in-text></quote> under the
			 heading <quote><header-in-text level="appropriations-intermediate" style="appropriations">Bureau of land management</header-in-text></quote> of
			 title I of division A of the Department of the Interior, Environment, and
			 Related Agencies Appropriations Act, 2010 (Public Law 111–88), is amended by
			 striking <quote>, and in addition</quote> and inserting <quote>, subject to the
			 condition that no such fee may be collected by the Bureau for any application
			 for a permit to drill on Indian land (as defined in section 2601 of the Energy
			 Policy Act of 1992 (25 U.S.C. 3501)); and in addition</quote>.</text>
				</subsection><subsection id="IDe621af78659c4a629fa86ce466bc1da3"><enum>(b)</enum><header>Restriction</header><text>Notwithstanding
			 any other provision of law, the Secretary shall not collect a fee for an
			 application for a permit to drill on Indian land.</text>
				</subsection><subsection id="ID41c0617a8da1473ab0bd4bbda88f2789"><enum>(c)</enum><header>Oil and gas
			 inspection fees</header><text>Notwithstanding any other provision of law, the
			 Secretary shall not collect any fee to conduct any oil or gas inspection
			 activity on Indian land.</text>
				</subsection><subsection id="ID07df84f1f671484e88c3e88e03f8999d"><enum>(d)</enum><header>Nonproducing
			 acreage fees</header><text>Notwithstanding any other provision of law, the
			 Secretary shall not collect any fee on any oil or gas lease for nonproducing
			 acreage on Indian land.</text>
				</subsection></section><section id="id68A5789EA9AD4AF086C24DA9F5B5343C"><enum>303.</enum><header>Indian
			 distributed energy and community transmission demonstration projects</header>
				<subsection id="IDa8fbc47c051147058d8bd67ec51bcc57"><enum>(a)</enum><header>Definition of
			 Indian area</header><text>In this section, the term <term>Indian area</term>
			 has the meaning given the term in section 4 of the Native American Housing
			 Assistance and Self-Determination Act of 1996 (25 U.S.C. 4103).</text>
				</subsection><subsection id="id5CA64228CBF54FE48A580957B718743E"><enum>(b)</enum><header>Energy
			 demonstration projects</header><text>The Secretary of Energy shall conduct not
			 less than 10 distributed energy demonstration projects to increase the energy
			 resources available to Indian tribes for use in homes and community or
			 government buildings.</text>
				</subsection><subsection id="IDfb7e98207a794a8291c353bd48b273b9"><enum>(c)</enum><header>Priority</header><text>In
			 carrying out this section, the Secretary of Energy shall give priority to
			 projects in Indian areas that—</text>
					<paragraph id="id61C3203B78194435BB09D8236D2C6CCE"><enum>(1)</enum><text>reduce or
			 stabilize energy costs;</text>
					</paragraph><paragraph id="id3A9A1B10F40C4B068FC43E7B4B61AB8D"><enum>(2)</enum><text>benefit
			 populations living in poverty;</text>
					</paragraph><paragraph id="ID60e3e3c8a94d48f79d47232b4e0fedeb"><enum>(3)</enum><text>provide a new
			 generation facility or distribution or replacement system;</text>
					</paragraph><paragraph id="ID03979302115545aa9773d1b7491f9b5f"><enum>(4)</enum><text>have populations
			 whose energy needs could be completely or substantially served by projects
			 under this section; or</text>
					</paragraph><paragraph id="idF6B30A0EAA4945F3BBE50254BE25BAC2"><enum>(5)</enum><text>transmit
			 electricity or heat to homes and buildings that previously were not served or
			 were underserved.</text>
					</paragraph></subsection><subsection id="ID7fe0fff6e3aa42aea02be83697bd5db8"><enum>(d)</enum><header>Eligible
			 projects</header><text>A project under this section may include a project
			 for—</text>
					<paragraph id="idCCAE5049CC9F4D9BB02C5D12AFE1ECC3"><enum>(1)</enum><text>distributed
			 generation, local or community distribution, or both;</text>
					</paragraph><paragraph id="IDd6eecf936f9340eba8a1e9ef9322b050"><enum>(2)</enum><text>biomass combined
			 heat and power systems;</text>
					</paragraph><paragraph id="id47D3F2C0942A4B9B8FF1A15F8298EDDB"><enum>(3)</enum><text>municipal solid
			 waste generation;</text>
					</paragraph><paragraph id="idC0DAD52B56D34AC3AF1A148A02B3416B"><enum>(4)</enum><text>instream
			 hydrokinetic energy;</text>
					</paragraph><paragraph id="ID7bf4efdeb06f414c8608b577c538666b"><enum>(5)</enum><text>micro-hydroelectric
			 projects;</text>
					</paragraph><paragraph id="id9ABBAE85539A48EB9D62CF9C6258395A"><enum>(6)</enum><text>wind-diesel
			 hybrid high-penetration systems;</text>
					</paragraph><paragraph id="id2AED2A34C3614A2DBCBC954D63618373"><enum>(7)</enum><text>energy storage
			 and smart grid technology improvements;</text>
					</paragraph><paragraph id="id9C1B4FF0C3814EE69AE538504C05A704"><enum>(8)</enum><text>underground coal
			 gasification systems;</text>
					</paragraph><paragraph id="idC1F5759B07424655939FAD2F989024C9"><enum>(9)</enum><text>solar thermal,
			 distributed solar, geothermal, or wind generation; or</text>
					</paragraph><paragraph id="idB195E2C9A6274C9194729448E0B79C6B"><enum>(10)</enum><text>any other
			 project that meets the goals of this section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1821807ff38c469589fb1ee41e6ed35e"><enum>(e)</enum><header>Incorporation
			 into existing infrastructure</header><text>As necessary, the Director shall
			 encourage local utilities and local governments to incorporate demonstration
			 projects into existing transmission and distribution infrastructure.</text>
				</subsection><subsection id="ID197c344c5f254f0a86f8a1edb2e1ebc1"><enum>(f)</enum><header>Exemptions</header>
					<paragraph id="ID30d8e2d9f42943aca7da4f6842e9fe46"><enum>(1)</enum><header>In
			 general</header><text>A project carried out under this section shall be exempt
			 from all cost-sharing requirements of section 988 of the Energy Policy Act of
			 2005 (42 U.S.C. 16352).</text>
					</paragraph><paragraph id="IDf17c4992a07d4d5596c2d3a9351b6ae7"><enum>(2)</enum><header>Applications</header><text>An
			 application submitted to carry out a project under this section shall not be
			 subject—</text>
						<subparagraph id="id7F15FD2C90CF401CB536816F5081DA2F"><enum>(A)</enum><text>to any maximum
			 generation requirements; or</text>
						</subparagraph><subparagraph id="id9C3FF9C402654D00BF18EF26339AC6C4"><enum>(B)</enum><text>to any
			 requirements for maximizing benefits in relation to the population
			 served.</text>
						</subparagraph></paragraph></subsection><subsection id="IDd8e9f4055ffd4a4b84d0b5035936b575"><enum>(g)</enum><header>Reports</header><text>Not
			 later than 2 years after the date on which funds are made available for a
			 project under this section, and annually thereafter, the Secretary shall submit
			 to Congress a report describing—</text>
					<paragraph id="ID39070d3213634f04ac51ea24070219f5"><enum>(1)</enum><text>the activities
			 carried out under the project, including an evaluation of the activity;
			 and</text>
					</paragraph><paragraph id="ID9d02e6bf5e9f4e5996d46f007e6b8175"><enum>(2)</enum><text>the number of
			 applications received and funded under this section.</text>
					</paragraph></subsection><subsection id="IDbe4073007df649f2a12cb727a2355de0"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $20,000,000, to remain available until expended.</text>
				</subsection></section><section id="id97674EFD76CB4345A3D9BD65285DA6CF"><enum>304.</enum><header>Indian energy
			 efficiency</header><text display-inline="no-display-inline">Part D of title III
			 of the Energy Policy and Conservation Act (42 U.S.C. 6321 et seq.) is amended
			 by adding at the end the following:</text>

					<section id="idD6E6EBC70FD04168A4B0C687BBC97796"><enum>367.</enum><header>Indian energy
				efficiency program</header>
						<subsection id="ID8d059e6fd03a46f7a8b2c561cd9ebffb"><enum>(a)</enum><header>Definition of
				Indian tribe</header><text>In this section, the term <term>Indian tribe</term>
				has the meaning given the term in section 4 of the
				<act-name parsable-cite="ISDA">Indian Self-Determination and Education
				Assistance Act</act-name> (25 U.S.C. 450b).</text>
						</subsection><subsection id="id5EBEA6D5860C46308657052364D47ADB"><enum>(b)</enum><header>Purpose</header><text>The
				purpose of the grants provided under subsection (d) shall be to assist Indian
				tribes in implementing strategies—</text>
							<paragraph id="ID172c25a4167b4d38b15867edd12583b7"><enum>(1)</enum><text>to reduce fossil
				fuel emissions created as a result of activities within the jurisdictions of
				eligible entities in a manner that—</text>
								<subparagraph id="ID01cc24c184614ff4a69754c4cc63a9ec"><enum>(A)</enum><text>is
				environmentally sustainable; and</text>
								</subparagraph><subparagraph id="ID6dbc32c1c2bc4f868fe3acb5acd42236"><enum>(B)</enum><text>to the maximum
				extent practicable, maximizes benefits for Indian tribes and tribal
				members;</text>
								</subparagraph></paragraph><paragraph id="ID84fc5f42ddc74bacb34259aca211e5a6"><enum>(2)</enum><text>to increase the
				energy efficiency of Indian tribes and tribal members; and</text>
							</paragraph><paragraph id="ID9970daf616e643458f60f212ccc3a509"><enum>(3)</enum><text>to improve energy
				efficiency in—</text>
								<subparagraph id="ID2e9a13a9d5214b1daf6e440de3b6137a"><enum>(A)</enum><text>the
				transportation sector;</text>
								</subparagraph><subparagraph id="ID3b953c2b49184006a69bcc1ef4991da3"><enum>(B)</enum><text>the building
				sector; and</text>
								</subparagraph><subparagraph id="ID79421b5f268642f8ac99a4e3eecd34f8"><enum>(C)</enum><text>other appropriate
				sectors.</text>
								</subparagraph></paragraph></subsection><subsection id="idB7453B41800740AB99A240A9CA226A24"><enum>(c)</enum><header>Tribal
				allocation</header><text>Of the amount of funds authorized to be appropriated
				for each fiscal year under section 365(f) to carry out this part, the Secretary
				shall allocate not less than 5 percent of the funds for each fiscal year to be
				distributed to Indian tribes in accordance with subsection (d).</text>
						</subsection><subsection id="IDfb2468a2f76249d6829c6eb10c1dd746"><enum>(d)</enum><header>Grants</header><text>Of
				the amounts available for distribution under subsection (c), the Secretary
				shall establish a competitive process for providing grants under this section
				that gives priority to projects that—</text>
							<paragraph id="ID3bf7aaf9a05148ef9fddf2253893e36f"><enum>(1)</enum><text>increase energy
				efficiency and energy conservation rather than new energy generation
				projects;</text>
							</paragraph><paragraph id="ID074bf65296dd4b8fb4fd67b650c7a754"><enum>(2)</enum><text>integrate
				cost-effective renewable energy with energy efficiency;</text>
							</paragraph><paragraph id="ID90e8710a65954f31ad21132da6d20244"><enum>(3)</enum><text>move beyond the
				planning stage and are ready for implementation;</text>
							</paragraph><paragraph id="ID82c733920068452dbfcc084662d9713b"><enum>(4)</enum><text>clearly
				articulate and demonstrate the ability to achieve measurable goals;</text>
							</paragraph><paragraph id="idA5F1D7FC479B468CAAC5FC907ED9D035"><enum>(5)</enum><text>have the
				potential to make an impact in the government buildings, infrastructure,
				communities, and land of an Indian tribe; and</text>
							</paragraph><paragraph id="ID0d75464aeb414e468a0b6db0ebc85bb4"><enum>(6)</enum><text>maximize the
				creation or retention of jobs on Indian land.</text>
							</paragraph></subsection><subsection id="ID9d3a500a51bb485cbd846c4e7338bc74"><enum>(e)</enum><header>Use of
				funds</header><text>An Indian tribe may use a grant received under this section
				to carry out activities to achieve the purposes described in subsection (b),
				including—</text>
							<paragraph id="IDf255be4fb1894c86aa24deee7e0ec18f"><enum>(1)</enum><text>the development
				and implementation of energy efficiency and conservation strategies;</text>
							</paragraph><paragraph id="IDd190076cb4d54601b7f7601009a14e4e"><enum>(2)</enum><text>the retention of
				technical consultant services to assist the Indian tribe in the development of
				an energy efficiency and conservation strategy, including—</text>
								<subparagraph id="ID5d02f23f44e746db9cf0961940d02a55"><enum>(A)</enum><text>the formulation
				of energy efficiency, energy conservation, and energy usage goals;</text>
								</subparagraph><subparagraph id="ID6b2561e0a48b44ccb2a6f9e54652dd30"><enum>(B)</enum><text>the
				identification of strategies to achieve the goals—</text>
									<clause id="ID82c563b131ae469abb72398fb8052f21"><enum>(i)</enum><text>through efforts
				to increase energy efficiency and reduce energy consumption; and</text>
									</clause><clause id="ID30cd73294a9540758e07f8d7a37efc46"><enum>(ii)</enum><text>by encouraging
				behavioral changes among the population served by the Indian tribe;</text>
									</clause></subparagraph><subparagraph id="ID4f8d94d2777a430288d66e7954ab0335"><enum>(C)</enum><text>the development
				of methods to measure progress in achieving the goals;</text>
								</subparagraph><subparagraph id="ID7230f9e407d54b35bd2f8fd4a30d6519"><enum>(D)</enum><text>the development
				and publication of annual reports to the population served by the eligible
				entity describing—</text>
									<clause id="IDc22a498de3074202b888096205105530"><enum>(i)</enum><text>the strategies
				and goals; and</text>
									</clause><clause id="ID2fa2a74653f74cdd9a93891cf33f0501"><enum>(ii)</enum><text>the progress
				made in achieving the strategies and goals during the preceding calendar year;
				and</text>
									</clause></subparagraph><subparagraph id="ID2ab74aeaf1be483390704d6382796221"><enum>(E)</enum><text>other services to
				assist in the implementation of the energy efficiency and conservation
				strategy;</text>
								</subparagraph></paragraph><paragraph id="ID3a1f74afed914119af57931d0c340032"><enum>(3)</enum><text>the
				implementation of residential and commercial building energy audits;</text>
							</paragraph><paragraph id="IDa25ea26c921a4844a8d048bd69197e3f"><enum>(4)</enum><text>the establishment
				of financial incentive programs for energy efficiency improvements;</text>
							</paragraph><paragraph id="ID3a91452591e84fb98f35a76e203b832c"><enum>(5)</enum><text>the provision of
				grants for the purpose of performing energy efficiency retrofits;</text>
							</paragraph><paragraph id="IDe0dc6a7a690b4c0f9eaf06938ba8fc29"><enum>(6)</enum><text>the development
				and implementation of energy efficiency and conservation programs for buildings
				and facilities within the jurisdiction of the Indian tribe, including—</text>
								<subparagraph id="IDa390dab574634b4e83005cc132e0cee1"><enum>(A)</enum><text>the design and
				operation of the programs;</text>
								</subparagraph><subparagraph id="ID8eac3b90dd9c4207bb1f083f11a34f9f"><enum>(B)</enum><text>the
				identification of the most effective methods of achieving maximum participation
				and efficiency rates;</text>
								</subparagraph><subparagraph id="IDd879272dff334819995d37ee7b0d1703"><enum>(C)</enum><text>the education of
				the members of an Indian tribe;</text>
								</subparagraph><subparagraph id="IDe65c41fcb2c041488da5bec126c4f9c6"><enum>(D)</enum><text>the measurement
				and verification protocols of the programs; and</text>
								</subparagraph><subparagraph id="IDbaaabbf5410a4a7ea6df26d3c6238398"><enum>(E)</enum><text>the
				identification of energy efficient technologies;</text>
								</subparagraph></paragraph><paragraph id="IDcc0964cc03b54f14b65ddca4bad497b5"><enum>(7)</enum><text>the development
				and implementation of programs to conserve energy used in transportation,
				including—</text>
								<subparagraph id="IDb7899e76eacc4496ba2ac3a4b2fbe8aa"><enum>(A)</enum><text>the use
				of—</text>
									<clause id="id34635AF597904B8398ADC4B08D993020"><enum>(i)</enum><text>flextime by
				employers; or</text>
									</clause><clause id="IDb3042c97e8a543119c043133b29030df"><enum>(ii)</enum><text>satellite work
				centers;</text>
									</clause></subparagraph><subparagraph id="ID36573c07cdb4468f9fba013c795428b3"><enum>(B)</enum><text>the development
				and promotion of zoning guidelines or requirements that promote
				energy-efficient development;</text>
								</subparagraph><subparagraph id="ID04994754f4674f069b744c1cf55acb57"><enum>(C)</enum><text>the development
				of infrastructure, including bike lanes, pathways, and pedestrian
				walkways;</text>
								</subparagraph><subparagraph id="ID01cd543d431b4835bec2bed8a43e4e6e"><enum>(D)</enum><text>the
				synchronization of traffic signals; and</text>
								</subparagraph><subparagraph id="IDffb660cba5e14b598940b80fb303b9d5"><enum>(E)</enum><text>other measures
				that increase energy efficiency and decrease energy consumption;</text>
								</subparagraph></paragraph><paragraph id="IDddb40bb3233a46d2baefc38cb9ef2e28"><enum>(8)</enum><text>the development
				and implementation of building codes and inspection services to promote
				building energy efficiency;</text>
							</paragraph><paragraph id="ID930dba04219e4df49faf466ff609a071"><enum>(9)</enum><text>the application
				and implementation of energy distribution technologies that significantly
				increase energy efficiency, including—</text>
								<subparagraph id="IDb97aa03cfdd34f2f8f7a4e4de7dc6198"><enum>(A)</enum><text>distributed
				resources; and</text>
								</subparagraph><subparagraph id="IDab1794f5d7894062aa5390a818f5e8ad"><enum>(B)</enum><text>district heating
				and cooling systems;</text>
								</subparagraph></paragraph><paragraph id="ID771d5849e43f473bbaf44a11f92821ec"><enum>(10)</enum><text>the
				implementation of activities to increase participation and efficiency rates for
				material conservation programs, including source reduction, recycling, and
				recycled content procurement programs that lead to increases in energy
				efficiency;</text>
							</paragraph><paragraph id="ID0bc4fb9cbe74469c869db197f220cc6e"><enum>(11)</enum><text>the purchase and
				implementation of technologies to reduce, capture, and, to the maximum extent
				practicable, use methane and other greenhouse gases generated by landfills or
				similar sources;</text>
							</paragraph><paragraph id="IDd100f750124d453a91d0856d369de267"><enum>(12)</enum><text>the replacement
				of traffic signals and street lighting with energy-efficient lighting
				technologies, including—</text>
								<subparagraph id="IDf630aed453434086b0a9efc1babaa43f"><enum>(A)</enum><text>light-emitting
				diodes; and</text>
								</subparagraph><subparagraph id="ID0e1b3765ed6f4662a81936c15b8e00ad"><enum>(B)</enum><text>any other
				technology of equal or greater energy efficiency;</text>
								</subparagraph></paragraph><paragraph id="IDddcb2a7349994f3bb07ddacb3e69a70b"><enum>(13)</enum><text>the development,
				implementation, and installation on or in any government building of the Indian
				tribe of onsite renewable energy technology that generates electricity from
				renewable resources, including—</text>
								<subparagraph id="ID9fbe8603e8e14ebdb04a39071240d045"><enum>(A)</enum><text>solar
				energy;</text>
								</subparagraph><subparagraph id="IDc8e4f7a65e924313857776d238f894df"><enum>(B)</enum><text>wind
				energy;</text>
								</subparagraph><subparagraph id="ID929c4464123d494e9d89e593cf1183f5"><enum>(C)</enum><text>fuel cells;
				and</text>
								</subparagraph><subparagraph id="ID7de03b1d51a4400882ca499dcbe129b7"><enum>(D)</enum><text>biomass;
				and</text>
								</subparagraph></paragraph><paragraph id="ID6dfdd89d8ad64cc3a8f36443976e6094"><enum>(14)</enum><text>any other
				appropriate activity, as determined by the Secretary, in consultation
				with—</text>
								<subparagraph id="IDb13090dcfb2b479e81369cf0227520c3"><enum>(A)</enum><text>the Secretary of
				the Interior;</text>
								</subparagraph><subparagraph id="ID92915bc7af2d421c9009ac699c1192f9"><enum>(B)</enum><text>the Administrator
				of the Environmental Protection Agency;</text>
								</subparagraph><subparagraph id="IDf57c7672803743e8beca62a20064fb9a"><enum>(C)</enum><text>the Secretary of
				Transportation;</text>
								</subparagraph><subparagraph id="ID3c33c97954834a1eb99b5be1f247e9ee"><enum>(D)</enum><text>the Secretary of
				Housing and Urban Development; and</text>
								</subparagraph><subparagraph id="IDf5e92a0f4b3241518b4cd3e29da0f83d"><enum>(E)</enum><text>Indian
				tribes.</text>
								</subparagraph></paragraph></subsection><subsection id="ID87a8e442b54042fc965d15d8665563c2"><enum>(f)</enum><header>Grant
				applications</header>
							<paragraph id="ID970e003ca32d44f5ac3d52e0bc331818"><enum>(1)</enum><header>In
				general</header>
								<subparagraph id="IDb842017729d945a9b15c46f5a38038c8"><enum>(A)</enum><header>Application</header><text>To
				apply for a grant under this section, an Indian tribe shall submit to the
				Secretary a proposed energy efficiency and conservation strategy in accordance
				with this paragraph.</text>
								</subparagraph><subparagraph id="ID96b062b8e1744f01a8481b63a78a6e6c"><enum>(B)</enum><header>Contents</header><text>A
				proposed strategy described in subparagraph (A) shall include a description
				of—</text>
									<clause id="id70DD9E5C7C8C4D0D9CB29D8D97A16A33"><enum>(i)</enum><text>the goals of the
				Indian tribe for increased energy efficiency and conservation in the
				jurisdiction of the Indian tribe; and</text>
									</clause><clause id="id77BC4AFB5C304D8FA3BA3E1B389850A8"><enum>(ii)</enum><text>the manner in
				which—</text>
										<subclause id="idE0ACCF2FAB2040298E57E85BF8A5BF96"><enum>(I)</enum><text>the proposed
				strategy complies with the restrictions described in subsection (e); and</text>
										</subclause><subclause id="IDf3261c7e590544349ea2193556147a69"><enum>(II)</enum><text>a grant will
				allow the Indian tribe fulfill the goals of the proposed strategy.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="ID92877c89741f420d86c7ca881d213717"><enum>(2)</enum><header>Approval</header>
								<subparagraph id="ID2d2b4a781268457d968824a2dfad94f9"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall approve or disapprove a proposed
				strategy under paragraph (1) by not later than 120 days after the date of
				submission of the proposed strategy.</text>
								</subparagraph><subparagraph id="IDcac2caead49d4b468690bd400eeccb1a"><enum>(B)</enum><header>Disapproval</header><text>If
				the Secretary disapproves a proposed strategy under paragraph (1)—</text>
									<clause id="IDac5f79456ed34582bd16d1283e4d4f7a"><enum>(i)</enum><text>the Secretary
				shall provide to the Indian tribe the reasons for the disapproval; and</text>
									</clause><clause id="ID7de8c684ecb0481aad47b684eee13a91"><enum>(ii)</enum><text>the Indian tribe
				may revise and resubmit the proposed strategy as many times as necessary, until
				the Secretary approves a proposed strategy.</text>
									</clause></subparagraph><subparagraph id="ID9ebf98acb71d4e81aa206b8eeb4f72e8"><enum>(C)</enum><header>Requirement</header><text>The
				Secretary shall not provide to an Indian tribe a grant under this section until
				a proposed strategy is approved by the Secretary.</text>
								</subparagraph></paragraph><paragraph id="IDeef57ceb41df447ebffb72f236de7929"><enum>(3)</enum><header>Limitations on
				use of funds</header><text>Of the amounts provided to an Indian tribe under
				this section, an Indian tribe may use for administrative expenses, excluding
				the cost of the reporting requirements of this section, an amount equal to the
				greater of—</text>
								<subparagraph id="ID27c8988f03784f94afb22964707e6194"><enum>(A)</enum><text>10 percent of the
				administrative expenses; or</text>
								</subparagraph><subparagraph id="ID265ad17467b4420fa94a3fff963f0e3c"><enum>(B)</enum><text>$75,000.</text>
								</subparagraph></paragraph><paragraph id="IDe0943190c5194dfebab6336afa6a40f5"><enum>(4)</enum><header>Annual
				report</header><text>Not later than 2 years after the date on which funds are
				initially provided to an Indian tribe under this section, and annually
				thereafter, the Indian tribe shall submit to the Secretary a report
				describing—</text>
								<subparagraph id="IDfcde1e013fb14ae192a4b2836456d0a3"><enum>(A)</enum><text>the status of
				development and implementation of the energy efficiency and conservation
				strategy; and</text>
								</subparagraph><subparagraph id="IDfa5c87de69024a75a77ce20ec61125c9"><enum>(B)</enum><text>to the maximum
				extent practicable, an assessment of energy efficiency gains within the
				jurisdiction of the Indian
				tribe.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="idB41FEF952A1545C397C9638511B61EAD"><enum>305.</enum><header>Weatherization
			 assistance for Indian tribes</header><text display-inline="no-display-inline">Section 413 of the Energy Conservation and
			 Production Act (42 U.S.C. 6863) is amended by striking subsection (d) and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id1A3C37B96C29493E99E50CAA02D34B33" style="OLC">
					<subsection id="ID9a46f1ac33a94f3084683a26900843e6"><enum>(d)</enum><header>Direct grants
				to Indian tribes for weatherization of Indian homes</header>
						<paragraph id="ID89580c4b2a06467ba3d0127d0a32f2be"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
							<subparagraph id="ID569bcf7a4d6a43daa28542ef8f085140"><enum>(A)</enum><header>Indian
				area</header><text>The term <term>Indian area</term> has the meaning given the
				term in section 4 of the Native American Housing Assistance and
				Self-Determination Act of 1996 (25 U.S.C. 4103).</text>
							</subparagraph><subparagraph id="ID6c5aa81f66f141a6826ccb2247ae4fe4"><enum>(B)</enum><header>Indian
				tribe</header><text>The term <term>Indian tribe</term> has the meaning given
				the term in section 4 of the <act-name parsable-cite="ISDA">Indian
				Self-Determination and Education Assistance Act</act-name> (25 U.S.C.
				450b).</text>
							</subparagraph></paragraph><paragraph id="id0A9429B1CC124FACAA33CDCEE3849656"><enum>(2)</enum><header>In
				general</header><text>Of the amounts made available for each fiscal year to
				carry out the Weatherization Assistance Program for Low-Income Persons
				established under part A of title IV, the Secretary shall allocate for Indian
				tribes not less than 10 percent.</text>
						</paragraph><paragraph id="IDf2d887f953164b0ab553d64229dda7ee"><enum>(3)</enum><header>Regulations</header>
							<subparagraph id="idBCE5839234BD42318DD725CB06D7EEDE"><enum>(A)</enum><header>Proposed
				regulations</header><text>Not later than 90 days after the date of enactment of
				the <short-title>Indian Energy Parity Act of
				2010</short-title>, the Secretary, after consulting with the Secretary of the
				Interior, the Secretary of Housing and Urban Development, the Secretary of
				Health and Human Services, the Secretary of Labor, Indian tribes, and
				intertribal organizations, shall publish in the Federal Register proposed
				regulations to carry out this subsection.</text>
							</subparagraph><subparagraph id="id5BF0B171A6124E5496A21CB17B7E5C61"><enum>(B)</enum><header>Final
				regulations</header>
								<clause id="idC46AF731368C4F7FAD48F4F4DD95E8B1"><enum>(i)</enum><header>In
				general</header><text>Not later than 120 days from the date of enactment of the
				<short-title>Indian Energy Parity Act of
				2010</short-title>, the Secretary shall promulgate final regulations to carry
				out this subsection, taking into consideration the comments submitted in
				response to the publication of the proposed regulations described in
				subparagraph (A).</text>
								</clause><clause id="id393F26D1B86D400F9DD4F4A81A40F580"><enum>(ii)</enum><header>Criteria</header><text>Final
				regulations promulgated by the Secretary to carry out this subsection
				shall—</text>
									<subclause id="ID7cffe7afaa2249e882947ae502404178"><enum>(I)</enum><text>provide a formula
				or process for ensuring that weatherization funding is available for any Indian
				tribe that submits a qualifying weatherization funding application under
				paragraph (4)(C);</text>
									</subclause><subclause id="id497572B889F448DF9D2A9692D9D40C55"><enum>(II)</enum><text>promote
				efficiency in carrying out this subsection by the Secretary and Indian tribes;
				and</text>
									</subclause><subclause id="idE8A3CFED516D48C69658937DEC4A4EEA"><enum>(III)</enum><text>consider—</text>
										<item id="id296BF63E310E49A298AB235172F8CD4A"><enum>(aa)</enum><text>the limited
				resources of Indian tribes to carry out this subsection;</text>
										</item><item id="idEE927FA5F2444D6AB9383239686CD899"><enum>(bb)</enum><text>the unique
				characteristics of housing in Indian areas; and</text>
										</item><item id="idC41FA192ED5F47A88337BC525E0822BD"><enum>(cc)</enum><text>the remoteness
				of Indian areas.</text>
										</item></subclause></clause></subparagraph></paragraph><paragraph id="IDd7d5beb8029d40ae8fe5781260886464"><enum>(4)</enum><header>Allocation of
				funding</header>
							<subparagraph id="id42C0080C67E943819629FA5229D9A618"><enum>(A)</enum><header>In
				general</header><text>The Secretary shall provide financial assistance to an
				Indian tribe from the amounts provided under paragraph (2), if the Indian tribe
				submits to the Secretary a weatherization funding application.</text>
							</subparagraph><subparagraph id="id06C9C125ADB143E99C43809B77EF8A98"><enum>(B)</enum><header>Contents</header><text>A
				weatherization funding application described in subparagraph (A) shall—</text>
								<clause id="id490CFB0670AB489A877526AE401BD325"><enum>(i)</enum><text>describe—</text>
									<subclause id="idC415F5006AB24E9FA32E01D46DCE8779"><enum>(I)</enum><text>the estimated
				number and characteristics of the persons and dwelling units to be provided
				weatherization assistance; and</text>
									</subclause><subclause id="id8E176A9C6F5B43E0AF6DCD6C0FCF818D"><enum>(II)</enum><text>the criteria and
				methods to be used by the Indian tribe in providing the weatherization
				assistance; and</text>
									</subclause></clause><clause id="id3D64719D82774533870A4419CD2104C4"><enum>(ii)</enum><text>contain any
				other information (including information needed for evaluation purposes) and
				assurances that are required under regulations promulgated by the Secretary to
				carry out this section.</text>
								</clause></subparagraph><subparagraph id="id0D912A1FBAED425E908D2DBB9EDD82E7"><enum>(C)</enum><header>Qualifying
				weatherization funding</header><text>A weatherization funding application that
				meets the criteria under subparagraph (B) shall be considered a qualifying
				weatherization funding application.</text>
							</subparagraph><subparagraph id="idCD667F20C54C4193B8129F4B55E3F3E2"><enum>(D)</enum><header>Initial
				distribution of funding</header><text>The Secretary shall distribute funding
				under this subsection to Indian tribes that submit qualifying weatherization
				funding applications—</text>
								<clause id="id018774DF3BFA43A7864D80C50EB02440"><enum>(i)</enum><text>on the basis of
				the relative need for weatherization assistance; and</text>
								</clause><clause id="id75D19D9EF3DC4CB2A8CE5EA996A307BF"><enum>(ii)</enum><text>taking into
				account—</text>
									<subclause id="idD94D33260D04429ABBB4C6B00D5E1052"><enum>(I)</enum><text>the number of
				dwelling units to be weatherized;</text>
									</subclause><subclause id="id8E5B7600178B4AEFB312AFC4F6FF8E59"><enum>(II)</enum><text>the climatic
				conditions respecting energy conservation, including a consideration of annual
				degree days;</text>
									</subclause><subclause id="id0F3A5E57E65F49FF90AF4076769D8D04"><enum>(III)</enum><text>the type of
				weatherization work to be done;</text>
									</subclause><subclause id="id8391832196024BADB7267443EEB6D8C8"><enum>(IV)</enum><text>any data
				provided in the most recent version of the Bureau of Indian Affairs American
				Indian Population and Labor Force Report prepared pursuant to Public Law
				102–477 (106 Stat. 2302), or if not available, any similar publication;
				and</text>
									</subclause><subclause id="id00762C21C88E498EB28F815CD6943881"><enum>(V)</enum><text>any other factors
				that the Secretary determines to be necessary, including the cost of heating
				and cooling, in order to carry out this section.</text>
									</subclause></clause></subparagraph><subparagraph id="ID7172172c714647c4a5bd655d6c5412aa"><enum>(E)</enum><header>Competitive
				grants</header><text>For each fiscal year, if any amounts remain available
				after the initial distribution of funding described in subparagraph (D), the
				Secretary shall solicit applications for grants from Indian tribes—</text>
								<clause id="id62F90C89C2E648FEAFD0727510E5B2F0"><enum>(i)</enum><text>to carry out
				weatherization projects and weatherization training;</text>
								</clause><clause id="idA04D364F64EE4BEABCF0C84186B8E369"><enum>(ii)</enum><text>to supply
				weatherization equipment; and</text>
								</clause><clause id="id5DF728D0D3924A16BF69B907D23E6655"><enum>(iii)</enum><text>to develop
				tribal governing capacity to carry out a weatherization program consistent with
				this subsection.</text>
								</clause></subparagraph><subparagraph id="ID4e43e1c7d7664de3bda7ae72e52106ff"><enum>(F)</enum><header>Remaining
				funding</header><text>For each fiscal year, if any amounts remain available
				after distribution under subparagraphs (D) and (E), the amounts shall remain
				available to fulfill the purpose of this subsection in subsequent fiscal
				years.</text>
							</subparagraph><subparagraph id="ID28abe2cfaaca4e9ea4a6407372a1ef9b"><enum>(G)</enum><header>Renewal of
				qualifying weatherization funding applications</header>
								<clause id="ID24631967db0c4c6cab5787c78ebb73a9"><enum>(i)</enum><header>In
				general</header><text>To achieve maximum efficiency in the allocation of
				funding, an Indian tribe that submits a qualifying weatherization funding
				application may request that the weatherization funding application of the
				Indian tribe be renewed in subsequent fiscal years.</text>
								</clause><clause id="ID9b135ffdc8a749ddaa912be9a8e6180f"><enum>(ii)</enum><header>Contents</header><text>A
				request to renew a qualifying weatherization funding application shall contain
				such information as the Secretary determines to be necessary to achieve
				efficiency in the allocation of funding under this subsection.</text>
								</clause></subparagraph></paragraph><paragraph id="id536A6EA02DE64D6B84E83E1470BE2686"><enum>(5)</enum><header>Use of
				funds</header>
							<subparagraph id="id1F65ED7BFFCE4E8E9D35AF869F14C8C6"><enum>(A)</enum><header>In
				general</header><text>An Indian tribe shall use funds provided under paragraph
				(4) to carry out weatherization and energy conservation activities that benefit
				the members of an Indian tribe in Indian areas.</text>
							</subparagraph><subparagraph id="ID09511958a8894f16884568e3359b02e2"><enum>(B)</enum><header>Eligible
				activities</header><text>The weatherization and energy conservation activities
				described in subparagraph (A) include—</text>
								<clause id="id2A200717D8C64FCB9F6C0A242BB22207"><enum>(i)</enum><text>the provision of
				existing services under this section;</text>
								</clause><clause id="idD4C1D32D2E9740E6A2CE8B0B0378ADD1"><enum>(ii)</enum><text>the acquisition
				and installation of energy-efficient windows and doors and heating and cooling
				equipment; or</text>
								</clause><clause id="id00CE96FA198A493787B7719FCA53CBB8"><enum>(iii)</enum><text>the repair,
				replacement, or insulation of floors, walls, roofs, and ceilings.</text>
								</clause></subparagraph><subparagraph id="IDd8e264b5a463488db80247c4139e8c5d"><enum>(C)</enum><header>Applicability
				of requirements</header>
								<clause id="idEB270123812B446C9CBB24F84CF221F7"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, the use of
				funds under this paragraph by an Indian tribe shall be subject only to—</text>
									<subclause id="id133189D049E2415FB42121032D707389"><enum>(I)</enum><text>the requirements
				of this subsection; and</text>
									</subclause><subclause id="idA9727FD987C64A6BA7D30AEA60AC44FA"><enum>(II)</enum><text>implementing
				regulations of the Department of Energy.</text>
									</subclause></clause><clause id="ID8fc609ab2f344667be61a68ff64762a6"><enum>(ii)</enum><header>Other
				requirements of Act</header><text>In accordance with the
				government-to-government and trust relationships between the United States and
				Indian tribes, the income, energy audit, grant limitation, and other
				administrative and eligibility requirements of this Act shall not apply to the
				use of funds under this paragraph by an Indian tribe.</text>
								</clause></subparagraph></paragraph><paragraph id="IDed6df1c6399c456a9e34c04a6aba007a"><enum>(6)</enum><header>Report</header><text>Not
				later than 90 days after the closing date of each applicable project year, each
				Indian tribe that receives funds under this subsection shall submit to the
				Secretary a simple outcome report that describes, for that project year—</text>
							<subparagraph id="id78C2F44C8784457096297FAC451C7FFB"><enum>(A)</enum><text>each activity
				carried out by the Indian tribe under this subsection, including the amounts
				used for each such activity;</text>
							</subparagraph><subparagraph id="id64A2193569224605AB5AE2EF869B89AF"><enum>(B)</enum><text>the number of
				Indian households benefitted by the activities of the Indian tribe under this
				subsection; and</text>
							</subparagraph><subparagraph id="idA5F15ACAF0094D5D9B49264163F67A9D"><enum>(C)</enum><text>the estimated
				savings in energy costs realized in the communities served by the Indian
				tribe.</text>
							</subparagraph></paragraph><paragraph id="ID1b1dcbcd3b8a4074be073f39327d1c5e"><enum>(7)</enum><header>Training and
				technical assistance</header><text>The Secretary shall carry out technical
				assistance and training activities relating to weatherization under this
				subsection, including—</text>
							<subparagraph id="IDca23dd1c80c348f2aa515e97e6cb42e1"><enum>(A)</enum><text>orientation
				sessions for Indian tribes;</text>
							</subparagraph><subparagraph id="ID5a83ee785e614b96b62aba507340570f"><enum>(B)</enum><text>workshops on
				planning, operations, and procedures for Indian tribes to use the funding
				provided under this subsection;</text>
							</subparagraph><subparagraph id="IDdce9f270a0714614ad1998006df59af3"><enum>(C)</enum><text>training relating
				to carrying out weatherization projects; and</text>
							</subparagraph><subparagraph id="IDb7f46affe7aa450b8e21257c91ae3f11"><enum>(D)</enum><text>the development
				and dissemination of training and technical assistance materials in printed
				form and over the
				Internet.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="id0C7680D7E153407288C883FF09D7A853"><enum>306.</enum><header>Tribal Biomass
			 Demonstration Project Act of 2010</header><text display-inline="no-display-inline">The Tribal Forest Protection Act of 2004
			 (Public Law 108–278; 118 Stat. 868) is amended—</text>
				<paragraph id="id75FAD213B99A4D65948725705706CB45"><enum>(1)</enum><text>in section 2(a),
			 by striking <quote>In this section</quote> and inserting <quote>In this
			 Act</quote>; and</text>
				</paragraph><paragraph id="id7E51F6AFE0AB420996C314A172557458"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBCF86E9A1AFA4FE6BBA15E310A6C116E" style="OLC">
						<section id="IDd27ade23da1a4a908875ece90b4f0c62"><enum>3.</enum><header>Tribal biomass
				demonstration project</header>
							<subsection id="IDbc16a2f46697497d935b4f9112b154da"><enum>(a)</enum><header>In
				general</header><text>For each of fiscal years 2012 through 2016, the Secretary
				shall enter into contracts or other agreements with Indian tribes to carry out
				demonstration projects to promote biomass energy production (including biofuel,
				heat, and electricity generation) on Indian forest land and in nearby
				communities by providing reliable supplies of woody biomass from Federal
				land.</text>
							</subsection><subsection id="idC4ED48353E274DC795F1E017C2E07083"><enum>(b)</enum><header>Demonstration
				projects</header><text>In each fiscal year for which amounts are authorized,
				the Secretary shall enter into contracts or other agreements described in
				subsection (a) to carry out at least 4 new demonstration projects that meet the
				eligibility criteria described in subsection (c).</text>
							</subsection><subsection id="ID7104028a5de0430d92455302e79f8d08"><enum>(c)</enum><header>Eligibility
				criteria</header><text>To be eligible to enter into a contract or other
				agreement under this subsection, an Indian tribe shall submit to the Secretary
				an application—</text>
								<paragraph id="ID36fc3d6c748444e2943c76a8dc96267f"><enum>(1)</enum><text>containing such
				information as the Secretary may require; and</text>
								</paragraph><paragraph id="IDaa783431d40b4da6bbf680438dbea4f9"><enum>(2)</enum><text>that includes a
				description of—</text>
									<subparagraph id="ID84be1e5615264c06b1b3056c9e9317f6"><enum>(A)</enum><text>the Indian forest
				land or rangeland under the jurisdiction of the Indian tribe; and</text>
									</subparagraph><subparagraph id="ID67de2a61b08845e2bca314fc60a7a15f"><enum>(B)</enum><text>the demonstration
				project proposed to be carried out by the Indian tribe.</text>
									</subparagraph></paragraph></subsection><subsection id="IDa244f86d9df4478c8c7c5c2923c660fa"><enum>(d)</enum><header>Selection</header><text>In
				evaluating the applications submitted under subsection (c), the Secretary shall
				take into consideration—</text>
								<paragraph id="ID466b300c7f2c4e2c9619be1cc0ae5ef3"><enum>(1)</enum><text>the factors set
				forth in paragraphs (1) and (2) of section 2(e); and</text>
								</paragraph><paragraph id="ID1f40bd53465a45049810f3812aeaa49d"><enum>(2)</enum><text>whether a
				proposed demonstration project would—</text>
									<subparagraph id="IDfc288f5d7ee348e3a6723c023f39529f"><enum>(A)</enum><text>increase the
				availability or reliability of local or regional energy;</text>
									</subparagraph><subparagraph id="ID55b6c592094340ffbe23f4eb82706fc5"><enum>(B)</enum><text>enhance the
				economic development of the Indian tribe;</text>
									</subparagraph><subparagraph id="IDcab70ff42b3544fdb009426c83f8d0c5"><enum>(C)</enum><text>improve the
				connection of electric power transmission facilities serving the Indian tribe
				with other electric transmission facilities;</text>
									</subparagraph><subparagraph id="id7EB2532DBD7049D1A7AFFEBDE23DD352"><enum>(D)</enum><text>improve the
				forest health of Federal land or Indian forest land or rangeland; or</text>
									</subparagraph><subparagraph id="id4A0B14942C6347DCB360C54BB0FDC267"><enum>(E)</enum><text>otherwise promote
				the use of woody biomass.</text>
									</subparagraph></paragraph></subsection><subsection id="ID115e9859b6a94571b89c0e990294fde1"><enum>(e)</enum><header>Implementation</header><text>The
				Secretary shall—</text>
								<paragraph id="id7AF9D4A4EE2B4461A9264C9B372D5B8D"><enum>(1)</enum><text>ensure that the
				criteria described in subsection (c) are publicly available by not later than
				120 days after the date of enactment of this section; and</text>
								</paragraph><paragraph id="id2E0A742A04F743688464A8C49D615157"><enum>(2)</enum><text>to the maximum
				extent practicable, consult with Indian tribes and appropriate intertribal
				organizations likely to be affected in developing the application and otherwise
				carrying out this section.</text>
								</paragraph></subsection><subsection id="ID3f197994f5e448299572d0ad456e0fb8"><enum>(f)</enum><header>Report</header><text>Not
				later than September 20, 2015, the Secretary shall submit to Congress a report
				that describes, with respect to the reporting period—</text>
								<paragraph id="IDbca4c165a51746a89db8b8934e78fbf4"><enum>(1)</enum><text>each individual
				tribal application received under this section; and</text>
								</paragraph><paragraph id="IDb621734dfa124fb98d10a278cf545cf7"><enum>(2)</enum><text>each contract and
				agreement entered into pursuant to this section.</text>
								</paragraph></subsection><subsection id="IDfb3a744c406c40c5bc0c0be543959dcc"><enum>(g)</enum><header>Incorporation
				of management plans</header><text>In carrying out a contract or agreement under
				this section, on receipt of a request from an Indian tribe, the Secretary shall
				incorporate, to the maximum extent practicable, management plans (including
				forest management and integrated resource management plans) in effect on the
				Indian forest land or rangeland of the respective Indian tribe.</text>
							</subsection><subsection id="IDb2871f4034f34eacbd15e5025d3bbf2c"><enum>(h)</enum><header>Term</header><text>A
				contract or agreement entered into under this section—</text>
								<paragraph id="ID71a61ffe222a488793532c9a3dcafbf7"><enum>(1)</enum><text>shall be for a
				term of not more than 20 years; and</text>
								</paragraph><paragraph id="IDe9797a420eb9418296556ad9590961d9"><enum>(2)</enum><text>may be renewed in
				accordance with this section for not more than an additional 10
				years.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section id="id434DA9274CA74FD1B37F539948484418"><enum>307.</enum><header>Tribal energy
			 resource agreements</header><text display-inline="no-display-inline">Section
			 2604 of the Energy Policy Act of 1992 (25 U.S.C. 3504) is amended—</text>
				<paragraph id="id0C5F2B4B4D4B463EAE3D96C5875C7AFA"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="ID765d0ea8172f49ba94a7af3a6956914c"><enum>(A)</enum><text>in paragraph
			 (1)(B)—</text>
						<clause id="id2618D0A39A6846828C64415AB020C61B"><enum>(i)</enum><text>in
			 clause (i)—</text>
							<subclause id="id75018820E4964343A5E4620CA619A15A"><enum>(I)</enum><text>by inserting
			 <quote>production,</quote> after <quote>electric</quote>; and</text>
							</subclause><subclause id="id6F625414051D453795C91B6325C693A6"><enum>(II)</enum><text>by inserting
			 <quote>(including a facility that produces electricity from renewable energy
			 resources)</quote> after <quote>facility</quote>; and</text>
							</subclause></clause><clause id="id1B88447ECB7E47C691B6CBC351EC3E07"><enum>(ii)</enum><text>in
			 clause (ii), by inserting <quote>, at least a portion of which have
			 been</quote> after <quote>energy resources</quote>; and</text>
						</clause></subparagraph><subparagraph id="idF1F74175B7F140DA9EF88448DF9F23D8"><enum>(B)</enum><text>by striking
			 paragraph (2) and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id790F73A417614C52A1CD382A1EB922DB" style="OLC">
							<paragraph id="IDb5dcade682d946e69f8128822d40441e"><enum>(2)</enum><text>a lease or
				business agreement described in paragraph (1) shall not require review by or
				the approval of the Secretary under section 2103 of the Revised Statutes (25
				U.S.C. 81), or any other provision of law, if—</text>
								<subparagraph id="idCC72B7E0EFFC46079C5BDC48CF8FE08C"><enum>(A)</enum><text>the lease or
				business agreement—</text>
									<clause id="idF7FF26E0A5E748FB987BA805119171E0"><enum>(i)</enum><text>was executed in
				accordance with the requirements of a tribal energy resource agreement that was
				approved by the Secretary pursuant to subsection (e) (including the periodic
				review and evaluation of the activities of the Indian tribe under the
				agreement, to be conducted pursuant to subparagraphs (D) and (E) of subsection
				(e)(2)); and</text>
									</clause><clause id="idB821F04FFA1A415AB1AD2EB126247777"><enum>(ii)</enum><text>has a term that
				does not exceed—</text>
										<subclause id="IDdaa542d242d642a78aeb570b6a3b6112"><enum>(I)</enum><text>30 years;
				or</text>
										</subclause><subclause id="IDba970a2337e942fb841e73f2131abe75"><enum>(II)</enum><text>in the case of a
				lease for the production of oil or gas resources, or both, the sum of 10 years
				and the period of time thereafter during which oil or gas is produced in paying
				quantities; or</text>
										</subclause></clause></subparagraph><subparagraph id="IDf554de982b1d4658a0a93a83d693392b"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idF7C4D17356714FF6AAC9F560B7509160"><enum>(i)</enum><text>the Indian tribe has
				carried out a contract or compact under title I or IV of the Indian
				Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) and,
				for a period of not less than 3 years ending on the date on which the Indian
				tribe requests a certification pursuant to subsection (h), the contract or
				compact—</text>
										<subclause id="idD77D68635E814EACB54779DA24A3198C" indent="up1"><enum>(I)</enum><text>has been carried out the Indian tribe
				without material audit exceptions (or without any such exceptions that were not
				corrected within the 3-year period); and</text>
										</subclause><subclause id="idC61F0744F2CD477DB6839A31941EF5DF" indent="up1"><enum>(II)</enum><text>has included programs or activities
				relating to the management of tribal land; and</text>
										</subclause></clause><clause id="id1C523BA558F24D6B8D6B84A7A28E6D32" indent="up1"><enum>(ii)</enum><text>the other party to the lease or
				business agreement is, and continues to be throughout the full term or renewal
				term (if any) of the lease or business agreement, a tribal energy development
				organization that is majority owned and controlled by the Indian
				tribe.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="id91C41637C46642D6820171C175771AED"><enum>(2)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id39B794F109684F5494AEACB882AECF3C" style="OLC">
						<subsection id="ID6379abc3bc604ca9938a26d08b598dd0"><enum>(b)</enum><header>Rights-of-Way</header><text>An
				Indian tribe may grant a right-of-way over tribal land without review or
				approval by the Secretary if—</text>
							<paragraph id="id18577A5B86D94176832D5B186C6968A2"><enum>(1)</enum><text>the right-of-way
				serves—</text>
								<subparagraph id="id5B67AC4728B8450498A7CD17E49D833A"><enum>(A)</enum><text>an electric
				production, generation, transmission, or distribution facility (including a
				facility that produces electricity from renewable energy resources) located on
				tribal land;</text>
								</subparagraph><subparagraph id="idCFDC2A5982CA4B59BDB1E147E6989BBB"><enum>(B)</enum><text>a facility
				located on tribal land that extracts, produces, processes, or refines energy
				resources; or</text>
								</subparagraph><subparagraph id="id8F58BAA15ACA42238A56034C56E19055"><enum>(C)</enum><text>the purposes, or
				assists in carrying out the purposes, of any lease or business agreement;
				and</text>
								</subparagraph></paragraph><paragraph id="idE13B89F2A3C84FF78EB4FE7D7B1721D9"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id14EA42E8545346818949200244EC2C24"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="id26F46A59C40347A79776E18E045C6108"><enum>(i)</enum><text>the right-of-way was
				executed in accordance with the requirements of a tribal energy resource
				agreement that was approved by the Secretary pursuant to subsection (e)
				(including the periodic review and evaluation of the activities of the Indian
				tribe under the agreement, to be conducted pursuant to subparagraphs (D) and
				(E) of subsection (e)(2)); and</text>
									</clause><clause id="idB2A870960DF54D97961812D9024E2CBE" indent="up1"><enum>(ii)</enum><text>has a term that does not exceed 30
				years; or</text>
									</clause></subparagraph><subparagraph id="ID5f99f661377d4dae86cf702a0990ae65"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idE8017B6691E148249C9466A682CCCB5C"><enum>(i)</enum><text>the Indian tribe has
				carried out a contract or compact under title I or IV of the Indian
				Self-Determination and Education Assistance Act (25 U.S.C. 458aa et seq.) and,
				for a period of not less than 3 years ending on the date on which the Indian
				tribe requests a certification pursuant to subsection (h), the contract or
				compact—</text>
										<subclause id="idE429B3B8EC5A4A3983C47C589267588B" indent="up1"><enum>(I)</enum><text>has been carried out by the Indian tribe
				without material audit exceptions (or without any such exceptions that were not
				corrected within the 3-year period); and</text>
										</subclause><subclause id="idDDF6E6A8C5784436A554B984D8F9C46E" indent="up1"><enum>(II)</enum><text>has included programs or activities
				relating to the management of tribal land; and</text>
										</subclause></clause><clause id="id9D75BCB38E4A4D3EB4B20FAC5F743419" indent="up1"><enum>(ii)</enum><text>the grantee of the right-of-way
				is, and continues to be throughout the full term or renewal term (if any) of
				the right-of-way, a tribal energy development organization that is majority
				owned and controlled by the Indian
				tribe.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID5009031917f340868a6423309d4807c0"><enum>(3)</enum><text>by striking
			 subsection (d) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDD9A8976AC3B40D2B9C3FE7A428B4C08" style="OLC">
						<subsection id="IDab22b492611d43f88e48277500bf0a61"><enum>(d)</enum><header>Validity</header><text>No
				lease or business agreement entered into, or right-of-way granted, pursuant to
				this section shall be valid unless the lease, business agreement, or
				right-of-way is authorized by subsection (a) or
				(b).</text>
						</subsection><after-quoted-block>; </after-quoted-block></quoted-block>
				</paragraph><paragraph id="idB12C27E9B5DC477ABF99BB3BFD66CA55"><enum>(4)</enum><text>in subsection
			 (e)—</text>
					<subparagraph id="id1BCBB5E591A447EFB0666ECC6194B2AC"><enum>(A)</enum><text>in paragraph (1),

				approve or disapprove—</text>
											<subclause id="idE72A09462F9B487D9A4125D22F03F18C" indent="up1"><enum>(I)</enum><text>a tribal energy resource agreement
				submitted under paragraph (1) not later than 270 days after the date on which
				the Secretary receives the agreement; or</text>
											</subclause><subclause id="id676B36707AD54F1693D2BA934A4484EE" indent="up1"><enum>(II)</enum><text>a revised tribal energy resource
				agreement submitted under paragraph (4)(B) not later than 60 days after the
				date on which the Secretary receives the revised agreement.</text>
											</subclause></clause><clause id="idA122516E5E3D47FC8F9DA085516E20DB" indent="up1"><enum>(ii)</enum><text>A tribal energy resource agreement
				submitted under paragraph (1) or (4)(B) shall take effect beginning on the date
				on which the Secretary approves the agreement.</text>
										</clause><clause id="id539AC0450780495A9AB381636E1F76C7" indent="up1"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id501B986857D94FEB8AC11E075D09370B"><enum>(I)</enum><text>If the Secretary has
				not yet approved or disapproved a tribal energy resource agreement submitted
				under paragraph (1), the tribal energy resource agreement shall take effect
				beginning on the date that is 270 days after the date on which the Secretary
				receives the agreement.</text>
											</subclause><subclause id="idD83515D4A72D4A94BCE7112FC4AE6446"><enum>(II)</enum><text>If the Secretary has not yet approved or
				disapproved a revised tribal energy resource agreement submitted under
				paragraph (4)(B), the revised tribal energy resource agreement shall take
				effect beginning on the date that is 60 days after the date on which the
				Secretary receives the revised agreement.</text>
											</subclause><subclause id="id91DBB16B3EB44642A9AF16F5ED481D91"><enum>(III)</enum><text>A tribal energy resource agreement that
				takes effect pursuant to subclause (I) or (II) shall be considered to have been
				approved by the Secretary for all purposes of this
				section.</text>
											</subclause></clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause><clause id="id4D312865E96C47B1BBA8F35161072608"><enum>(ii)</enum><text>in
			 subparagraph (B)—</text>
							<subclause id="idA4C92819F63C495FB4888392CA637401"><enum>(I)</enum><text>by striking
			 <quote>(B)</quote> and all that follows through <quote>if—</quote> and
			 inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="id522FEBDF2FE44C6F81CED0DE2584998F" style="OLC">

				disapprove a tribal energy resource agreement submitted under paragraph (1) or

							</subclause><subclause id="ID7fb97a3136004647a5938b7b5ffb0795"><enum>(II)</enum><text>by striking
			 clause (i) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="idF181F60F3DB546F2945B24D1498707B1" style="OLC">
									<clause id="IDcc69239ddcff4db3ac6e56b60eba5496"><enum>(i)</enum><text>the Secretary
				determines that the Indian tribe has not demonstrated that the Indian tribe has
				sufficient capacity to regulate the development of the specific 1 or more
				energy resources that would be subject to the tribal energy resource agreement
				submitted by the Indian
				tribe.</text>
									</clause><after-quoted-block>;</after-quoted-block></quoted-block>
							</subclause><subclause id="id7A711DF35AB0495081A8563B999C0AEE"><enum>(III)</enum><text>by
			 redesignating clause (iii) as clause (iv) and indenting appropriately;</text>
							</subclause><subclause id="idAFDC754D677945168CCA479294D89887"><enum>(IV)</enum><text>by striking
			 clause (ii) and inserting the following:</text>
								<quoted-block display-inline="no-display-inline" id="idD9870D30C2464BCFAC49087F8C7A1849" style="OLC">
									<clause id="id28071AF48E5E4E01AAF4A08663036A01"><enum>(ii)</enum><text>a provision of
				the tribal energy resource agreement would violate a treaty applicable to the

							</subclause><subclause id="idCDD61DF84D3A42BFA386EBC6FDC57A8E"><enum>(V)</enum><text>in clause (iv)
			 (as redesignated by subclause (III)), in the matter preceding subclause (I), by
			 striking <quote>includes</quote> and all that follows through
			 <quote>section—</quote> and inserting <quote>does not include provisions that,
			 with respect to any lease, business agreement, or right-of-way to which the
			 tribal energy resource agreement applies—</quote>; and</text>

				date on which the Indian tribe submits to the Secretary the tribal energy
				resource agreement of the Indian tribe pursuant to paragraph (1), unless the
				Secretary and the Indian tribe mutually agree to an extension of the deadline
				for making the determination.</text>
									</clause><clause id="idF31BF2117C704989A287EC42D4F14966" indent="up1"><enum>(ii)</enum><text>Any determination that the Indian
				tribe lacks the requisite capacity shall be treated as a disapproval under
				paragraph (4) and, not later than 10 days after the date of the determination,
				the Secretary shall provide to the Indian tribe—</text>
										<subclause id="id75409C11AE864944BCE62E7DAC67C31B"><enum>(I)</enum><text>a detailed, written explanation of each
				reason for the determination; and</text>
										</subclause><subclause id="id8AAF4729DC1B4CDE95C471EB498E701E"><enum>(II)</enum><text>a description of the steps that the
				Indian tribe should take to demonstrate sufficient capacity.</text>
										</subclause></clause></subparagraph><subparagraph id="ID9cfcdca22e64477f9ffe4a202e75883c"><enum>(G)</enum><text>Notwithstanding
				any other provision of this section, an Indian tribe shall be considered to
				have demonstrated sufficient capacity under subparagraph (B)(i) to regulate the
				development of the specific 1 or more energy resources of the Indian tribe that
				would be subject to the tribal energy resource agreement submitted by the
				Indian tribe under paragraph (1) if—</text>
									<clause id="ID5297b6aa2292459992bb3adb7b212454"><enum>(i)</enum><text>the Secretary
				determines that—</text>
										<subclause id="IDeb9645b4e2914a3cbec449629114a695"><enum>(I)</enum><text>the Indian tribe
				has carried out a contract or compact under title I or IV of the Indian
				Self-Determination and Education Assistance Act (25 U.S.C. 450 et seq.) without
				material audit exceptions for a period of not less than 3 years ending on the
				date on which the Indian tribe submits the tribal energy resource agreement of
				the Indian tribe under paragraph (1) (or without any such exceptions that were
				not corrected within the 3-year period); or</text>
										</subclause><subclause id="IDf1db77112384411183d050397e66afab"><enum>(II)</enum><text>the Indian tribe
				meets the capacity criteria described in the regulations promulgated under
				paragraph (8)(A); or</text>
										</subclause></clause><clause id="ID525e6b92607e4977be034d6ce51bf71d"><enum>(ii)</enum><text>the Secretary
				fails to make the determination within the time allowed under subparagraph (F)
				(including any agreed-to extension under that
				subparagraph).</text>

							</paragraph></subsection><subsection id="id9C81F97A2B52431C843F82B3CD66E8F0"><enum>(h)</enum><header>Certification</header>
							<paragraph id="id0D10C3B51C8E401FA48B256D0024131D"><enum>(1)</enum><header>In
				general</header><text>Not later than 90 days after the date on which an Indian
				tribe submits a request in accordance with regulations promulgated under
				paragraph (3), the Secretary shall determine whether—</text>
								<subparagraph id="id5896CFA798354B62863C8B9368F5EE57"><enum>(A)</enum><text>the Indian tribe
				meets the requirements described in subsections (a)(2)(B)(i) or (b)(2)(B)(i);
				and</text>
								</subparagraph><subparagraph id="id9578690B25EA43FA81E6E063F80E2925"><enum>(B)</enum><text>the tribal energy
				development organization is majority owned and controlled by the Indian
				tribe.</text>
								</subparagraph></paragraph><paragraph id="id3F53E809176D42FBBD8F29C085E944F3"><enum>(2)</enum><header>Action by
				Secretary</header><text>If the Secretary determines that the Indian tribe meets
				the requirements described in subsections (a)(2)(B)(i) or (b)(2)(B)(i) and the
				tribal energy development organization is majority owned and controlled by the
				Indian tribe, the Secretary shall, not more than 10 days after making the
				determination—</text>
								<subparagraph id="IDd7c96396d3f6418ca79864629c126056"><enum>(A)</enum><text>issue a
				certification stating that the Indian tribe meets those requirements and that
				the tribal energy development organization is majority owned and controlled by
				the Indian tribe;</text>
								</subparagraph><subparagraph id="ID37c5845baabf4884b1f4f081eb5f4e99"><enum>(B)</enum><text>deliver a copy of
				the certification to the Indian tribe; and</text>
								</subparagraph><subparagraph id="ID59857769d8dc4dfbbdab427e874ecd1e"><enum>(C)</enum><text>publish the
				certification in the Federal Register.</text>
								</subparagraph></paragraph><paragraph id="ID11f32be21cc24828b116c4f89caa4863"><enum>(3)</enum><header>Regulations</header><text>Not
				later than 1 year after the date of enactment of this paragraph, the Secretary
				shall promulgate regulations to implement subsections (a)(2)(B) and (b)(2)(B)

				and technical assistance to 1 or more intertribal organizations, as determined
				by the Secretary, to establish and operate a program of assistance to Indian
				tribes and tribal energy development organizations to carry out evaluation,
				planning, design, financing, production, transportation, and transmission
				functions relating to tribal energy resource
				development.</text>

			 assistance</header>
					<paragraph id="id54EBA7EFBBFA4A9985CA4D00C383E18D"><enum>(1)</enum><header>Indian tribal
			 energy resource regulation</header><text>Section 2603(c)(2)(B) of the Energy
			 Policy Act of 1992 (25 U.S.C. 3503(c)(2)(B)) is amended by inserting <quote>or
			 tribal energy development organization</quote> after <quote>Indian
			 tribe</quote>.</text>
					</paragraph><paragraph id="id02BCB21BBD4148E38925EDCD120CB777"><enum>(2)</enum><header>Federal power
			 marketing administrations</header><text>Section 2605 of the Energy Policy Act
			 of 1992 (25 U.S.C. 3505) is amended in subsection (d)(2)(B), by inserting
			 <quote>or tribal energy development organization</quote> after <quote>Indian
			 tribe</quote>.</text>
					</paragraph></subsection><subsection id="IDf38c4df2d4924928a124dafc064a3dbe"><enum>(e)</enum><header>Energy
			 efficiency in federally assisted housing</header><text>Section 506(a) of the
			 Energy Policy Act of 2005 (42 U.S.C. 16001) is amended—</text>
					<paragraph id="IDa9086e95dce846eab5548235d01f7d38"><enum>(1)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>weatherization, energy efficiency,
			 and</quote> after <quote>shall promote</quote>; and</text>
					</paragraph><paragraph id="IDbf9a76a3066a4946836fa62a0b985906"><enum>(2)</enum><text>in paragraph (1),
			 by striking <quote>technologies</quote> and inserting <quote>design,
			 technologies,</quote>.</text>
					</paragraph></subsection><subsection id="idFDA021D1A5B34F5680293E12DA55945E"><enum>(f)</enum><header>Conforming
			 amendments</header>
					<paragraph id="idAD7F8D367B844FC4B6122EC317C022C6"><enum>(1)</enum><text>Section 2602 of
			 the Energy Policy Act of 1992 (25 U.S.C. 3502) is amended—</text>
						<subparagraph id="id9D143FE93D2E41F699F3D206F6AA3DCA"><enum>(A)</enum><text>in subsection
			 (a)—</text>
							<clause id="id0279C618C6334BC98E3A8615DC3A8179"><enum>(i)</enum><text>in
			 paragraph (1), by striking <quote>tribal energy resource development
			 organizations</quote> and inserting <quote>tribal energy development
			 organizations</quote>; and</text>
							</clause><clause id="id255EE8B572C84A608F1A18FF1A2266F4"><enum>(ii)</enum><text>in
			 paragraph (2), by striking <quote>tribal energy resource development

							</clause></subparagraph><subparagraph id="idC07CA7015A284DCBBCA775F81271D7D5"><enum>(B)</enum><text>in subsection
			 (b)(2), by striking <quote>tribal energy resource development
			 organization</quote> and inserting <quote>tribal energy development
			 organization</quote>.</text>
						</subparagraph></paragraph><paragraph id="idA07CE108AD88451A8644C83A1F0C6F6D"><enum>(2)</enum><text>Section
			 2606(c)(3) of the Energy Policy Act of 1992 (25 U.S.C. 3506) is amended by
			 striking <quote>energy resource development</quote> and inserting <quote>energy
