		<official-title>To require the National Telecommunications and
		  Information Administration to conduct a competition to award grants for the
		  development of nonstationary radio over Internet protocol devices that support
		  mission-critical broadband voice and data communications of public safety
		  personnel, and for other purposes. </official-title>

		<section id="H7A957BFDBA484655B5AB0D95749C611C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Next Generation Public Safety Device
			 Act of 2010</short-title></quote>.</text>
		</section><section id="H1B818FFDC15746BBBF456B7EAC768C35"><enum>2.</enum><header>Public safety
			 RoIP device development competition</header>
			<subsection id="H186817DB14094443B30B76841B40E83F"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Assistant Secretary, in coordination
			 with the Commission, the Director of the National Institute of Standards and
			 Technology, and the Director of the Office of Emergency Communications in the
			 Department of Homeland Security, shall conduct a competition to award grants to
			 eligible entities for the development of nonstationary radio over Internet
			 protocol devices that support mission-critical broadband voice and data
			 communications of public safety personnel.</text>
			</subsection><subsection id="HB5734C690C214C68AD7E0CD1E72089D5"><enum>(b)</enum><header>Working
			 group</header>
				<paragraph id="HC9C06E5C5DE84AFE8F522B3F9550E184"><enum>(1)</enum><header>Composition</header><text display-inline="yes-display-inline">The Assistant Secretary shall establish a
			 working group composed of—</text>
					<subparagraph id="HBA33EA9811B64FDBA725320B7AEC6AC6"><enum>(A)</enum><text display-inline="yes-display-inline">a representative of the Commission, the
			 Director of the National Institute of Standards and Technology, and the
			 Director of the Office of Emergency Communications in the Department of
			 Homeland Security; and</text>
					</subparagraph><subparagraph id="H01992C1D448447F3BFF34FA172149FAA"><enum>(B)</enum><text>such other public
			 or private stakeholders with technical expertise in the development of
			 emergency communications devices as the representative of the Commission
			 considers appropriate.</text>
					</subparagraph></paragraph><paragraph id="HB5B29676D1A849C5BCD2328464CFB259"><enum>(2)</enum><header>Duties</header><text display-inline="yes-display-inline">The working group shall provide the
			 Assistant Secretary with advice and technical assistance in conducting the
			 competition under this section.</text>
				</paragraph><paragraph id="HDFBDECAFDBA241B4B7FB5D6B3982E491"><enum>(3)</enum><header>Support
			 services</header><text>The Assistant Secretary shall provide the working group
			 with the administrative, professional, and technical support required by the
			 working group to carry out its duties.</text>
				</paragraph><paragraph id="H95E93F70FE844C8A837CD094D96AFED7"><enum>(4)</enum><header>Duration</header><text>The
			 working group shall terminate not later than the earlier of—</text>
					<subparagraph id="HDF7BDEA0C948464AAC6D378438A53384"><enum>(A)</enum><text>the date that is
			 15 days after the date of the submission by the Comptroller General of the
			 United States of the report required by subsection (e)(3); or</text>
					</subparagraph><subparagraph id="HC616EFC6027A43A797119A3D54673B30"><enum>(B)</enum><text>the date that is 6
			 years after the date of the enactment of this section.</text>
					</subparagraph></paragraph></subsection><subsection id="H1873A5CF6C1E47BE9BEEC65C6259B9A9"><enum>(c)</enum><header>Device
			 requirements</header>
				<paragraph id="H8FBE0D5B62D44151B0942FC9BC247E1E"><enum>(1)</enum><header>In
			 general</header><text>The Assistant Secretary, in coordination with the working
			 group, shall establish requirements for RoIP devices developed, in whole or in
			 part, using a grant under this section.</text>
				</paragraph><paragraph id="H654FF57ED0594A108312C977263799B2"><enum>(2)</enum><header>Content</header><text>The
			 requirements established under paragraph (1) shall include—</text>
					<subparagraph id="H7BE8728578B14280B5389A1F936F522F"><enum>(A)</enum><text>an identification
			 of specific communication needs of public safety personnel and any
			 corresponding characteristics or capabilities of the devices for meeting such
			 needs; and</text>
					</subparagraph><subparagraph id="H5789730B325749A19B1CCECD2A1D9D8B"><enum>(B)</enum><text>such
			 characteristics and capabilities of the devices as will ensure—</text>
						<clause id="HFAB5B0241D0D4154AFE8DAE6987A9733"><enum>(i)</enum><text>delivery of
			 communications in a real-time manner;</text>
						</clause><clause id="H6A4E2A6A22D647F1A03FDA80E21185B9"><enum>(ii)</enum><text>reliability of
			 the delivery of communications under adverse conditions;</text>
						</clause><clause id="HC445C223E8814310A11F0581EB6340B5"><enum>(iii)</enum><text>sufficient
			 clarity of transmission to permit public safety personnel to easily comprehend
			 the content of communications; and</text>
						</clause><clause id="H592AE471952D4A2FB55ECE6B34E7CB0A"><enum>(iv)</enum><text>full
			 interoperability among different types and brands of RoIP devices used by
			 public safety personnel.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="H98108BE0CBF745478D04AB81D1AA322B"><enum>(d)</enum><header>Grant
			 process</header>
				<paragraph id="H5358EE33EE134468906D2358694466D7"><enum>(1)</enum><header>3-stage
			 process</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall establish a 3-stage process for awarding grants to eligible
			 entities under this section.</text>
				</paragraph><paragraph id="HA5A479937E26440494D4459637EB6F01"><enum>(2)</enum><header>Award of
			 grants</header><text>The Secretary may only award a grant in a stage to an
			 eligible entity that—</text>
					<subparagraph id="HB6A55F9E4F184429865279A2A6FA064B"><enum>(A)</enum><text display-inline="yes-display-inline">submits a bid meeting the specifications
			 developed under paragraph (3) for such stage;</text>
					</subparagraph><subparagraph id="HC33FC8A4698447C482BBC6825DF0E727"><enum>(B)</enum><text>provides the
			 Assistant Secretary with an assurance that the eligible entity will use grant
			 funds to develop a RoIP device in accordance with the specifications included
			 in such bid;</text>
					</subparagraph><subparagraph id="HAF0E963F5A8B440FAB394B943B0AA474"><enum>(C)</enum><text>in the case of a
			 grant in stage 1 or 2 for the development of a device, provides the Assistant
			 Secretary with an assurance that the eligible entity will submit in good faith
			 a bid for a grant in stage 2 or 3, respectively, for the development of such
			 device; and</text>
					</subparagraph><subparagraph id="HA4CE58A7487D4AC6B21FA0B4BC309449"><enum>(D)</enum><text>in the case of a
			 grant in stage 2 or 3 for the development of a device, has received a grant in
			 stage 1 or 2, respectively, for the development of such device.</text>
					</subparagraph></paragraph><paragraph id="HC0432ACA72AB4D7E91BEA19C8ABB1928"><enum>(3)</enum><header>Bid
			 specifications for each stage</header>
					<subparagraph id="H66AD69EDCF17488B9BC9FCAE64E3C16D"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall develop specifications for bids submitted for grants in each
			 stage and shall ensure that such specifications are—</text>
						<clause id="H0B3AC0E872C94DB7830F1FC87011EBC9"><enum>(i)</enum><text>based on the
			 requirements established under subsection (c)(1); and</text>
						</clause><clause id="HE6ADBC3EEB1A484A8CC02E0F7F736AD8"><enum>(ii)</enum><text>provide for
			 reasonable progress from stage to stage toward the commercial production of
			 RoIP devices that meet such requirements by eligible entities receiving grants
			 in stage 3.</text>
						</clause></subparagraph><subparagraph id="HC2FE32AC6988408CA733D36DE7EF2C4A"><enum>(B)</enum><header>Specifications
			 for stage 1</header><text>The specifications for stage-1 bids shall include a
			 requirement that the eligible entity provide the Assistant Secretary with an
			 assurance that the eligible entity will use grant funds to develop the
			 prototype referred to in subparagraph (C)(i) for submission with the stage-2
			 bid of the entity.</text>
					</subparagraph><subparagraph id="H12C14E0FD495438EA836E32F095C560F"><enum>(C)</enum><header>Specifications
			 for stage 2</header><text>The specifications for stage-2 bids shall include the
			 following:</text>
						<clause id="HCAF0C51A8E43463A8DEC0EEA5ED07858"><enum>(i)</enum><text>A
			 requirement that the eligible entity submit a prototype of the device being
			 developed.</text>
						</clause><clause id="HB920E119FAA84E6883EF9DF94350422E"><enum>(ii)</enum><text display-inline="yes-display-inline">A requirement that the eligible entity
			 provide the Assistant Secretary with an assurance that the eligible entity will
			 use grant funds to develop the plan referred to in subparagraph (D)(i) for
			 submission with the stage-3 bid of the entity and to prepare to commercially
			 produce the device in accordance with the plan.</text>
						</clause><clause id="HA96A2275528E48CEACFA82E5951F114E"><enum>(iii)</enum><text>A
			 requirement that the eligible entity submit such information as the Assistant
			 Secretary may require regarding the capability of the eligible entity to
			 commercially produce, distribute, and market the device.</text>
						</clause></subparagraph><subparagraph id="H6A263696360D4A799EF0B5B5BCB3A687"><enum>(D)</enum><header>Specifications
			 for stage 3</header><text display-inline="yes-display-inline">The
			 specifications for stage-3 bids shall include the following:</text>
						<clause id="HA218C962F6274B1FA33AAF8CD5E8B377"><enum>(i)</enum><text display-inline="yes-display-inline">A requirement that the eligible entity
			 submit a plan for the commercial production of the device by the entity that
			 demonstrates that the device, as produced, will meet the requirements
			 established under subsection (c)(1).</text>
						</clause><clause id="H6605771166884C8EAD9B81F23AAC44D0"><enum>(ii)</enum><text>A
			 requirement that the eligible entity provide the Assistant Secretary with an
			 assurance that the eligible entity will—</text>
							<subclause id="H313D79074BCF484F952CB4A0BD478533"><enum>(I)</enum><text>use grant funds to
			 commercially produce the device in accordance with the plan submitted under
			 clause (i); and</text>
							</subclause><subclause id="HE8FE97F594CE4EE5B84D529DDB1F74DD"><enum>(II)</enum><text>apply for award
			 of the label under section 3.</text>
							</subclause></clause><clause id="H70C032323311447A988508B003F1CCFB"><enum>(iii)</enum><text>A
			 requirement that the eligible entity submit such information as the Assistant
			 Secretary may require regarding the capability of the eligible entity to
			 commercially produce, distribute, and market the device.</text>
						</clause></subparagraph></paragraph><paragraph id="H0A5890F9F4E445209E5904A9F5C30673"><enum>(4)</enum><header>Additional
			 factors for consideration</header><text>In making a grant under this section,
			 the Assistant Secretary shall consider, in addition to the requirements
			 established under subsection (c)(1) and the bid specifications established
			 under paragraph (3) for the stage involved, the following factors:</text>
					<subparagraph id="H302211DEF6D64E81848DA9A6B13E2D92"><enum>(A)</enum><text>The extent to
			 which the grant will encourage competition in the market for the device being
			 developed.</text>
					</subparagraph><subparagraph id="H024BA9EA42514180A81CFAA210CB6712"><enum>(B)</enum><text>The estimated cost
			 at which public safety personnel will be able to purchase such device.</text>
					</subparagraph><subparagraph id="H20D55CD974A74AC5A2A85AE0104BA1FD"><enum>(C)</enum><text>The potential
			 contribution to public safety of such device.</text>
					</subparagraph><subparagraph id="H6B44FE65B59B4EA390A5439BED92A382"><enum>(D)</enum><text>Whether such
			 device is capable of utilizing, in addition to the portions of the
			 electromagnetic spectrum listed in subparagraphs (A) and (B) of section 4(8),
			 the following portions of the spectrum:</text>
						<clause display-inline="no-display-inline" id="HECB03A4A17724C2EB85FD56977555E6A"><enum>(i)</enum><text display-inline="yes-display-inline">Public Safety Broadband License, Guard Band
			 (the electromagnetic spectrum between 768 and 769 megahertz, inclusive, and
			 between 798 and 799 megahertz, inclusive).</text>
						</clause><clause id="H8EEBE5B738B849BDB2C9A0DCA99B341E"><enum>(ii)</enum><text display-inline="yes-display-inline">Public Safety, Narrowband Network (the
			 electromagnetic spectrum between 769 and 775 megahertz, inclusive, and between
			 799 and 805 megahertz, inclusive).</text>
						</clause></subparagraph><subparagraph id="H6A8046A329884AD5AD9149F5EA4D84AA"><enum>(E)</enum><text>Such other factors
			 as the Assistant Secretary considers appropriate to promote the public
			 interest.</text>
					</subparagraph></paragraph><paragraph id="H56BE7B6587FA442C9A28BBE9AB5C3FA4"><enum>(5)</enum><header>Priority</header><text display-inline="yes-display-inline">In making a grant under this section, the
			 Assistant Secretary shall give priority to bids for the development of devices
			 that are interoperable across—</text>
					<subparagraph id="H892DECEB832C494EBAC5C81858856EAA"><enum>(A)</enum><text>multiple
			 commercial bands of the electromagnetic spectrum; and</text>
					</subparagraph><subparagraph commented="no" id="H806F1686CA9A40B78F4186FBA5130CD8"><enum>(B)</enum><text>multiple
			 communications profiles.</text>
					</subparagraph></paragraph><paragraph id="H75C28B05FB024F23A94BCC5C49D84EA8"><enum>(6)</enum><header>Timing</header><text display-inline="yes-display-inline">The Assistant Secretary shall structure the
			 timing of each stage as the Assistant Secretary considers appropriate, but the
			 Assistant Secretary shall release the solicitation for stage-1 bids not later
			 than 8 months after the date of the enactment of this section and shall ensure
			 that all grants in stage 3 have been awarded not later than 4 years after the
			 date of the award of the 1st grant in stage 1.</text>
				</paragraph><paragraph id="HD83089DA2AA044E4BCC435A006E834F7"><enum>(7)</enum><header>Number and
			 amount of grants</header>
					<subparagraph id="H58E5DFE08233446D8013F3CA616695D1"><enum>(A)</enum><header>Number</header>
						<clause id="H02E2704E4EF749CA82C8ECE77922E172"><enum>(i)</enum><header>1
			 grant per device per stage</header><text display-inline="yes-display-inline">The Assistant Secretary may not award more
			 than 1 grant per device per stage.</text>
						</clause><clause id="HA46C6FCD548B47E88A6FC3405DFF9E3F"><enum>(ii)</enum><header>Number of
			 stage-3 grants</header><text display-inline="yes-display-inline">The Assistant
			 Secretary shall award not fewer than 4 and not more than 7 grants in stage
			 3.</text>
						</clause></subparagraph><subparagraph id="HF2DB98162B244DC5AE59F4C5D5BEDB5F"><enum>(B)</enum><header>Amount</header>
						<clause id="HB4A4D45873824B49BBAEBDA5C2D23CDD"><enum>(i)</enum><header>Per
			 stage</header><text display-inline="yes-display-inline">A grant for the
			 development of a device may not exceed $4,000,000 per stage.</text>
						</clause><clause id="H61D271692BA843939E1733FB514BC685"><enum>(ii)</enum><header>Per
			 device</header><text display-inline="yes-display-inline">The Assistant
			 Secretary may not award more than a total of $8,000,000 in all 3 stages for the
			 development of a single device.</text>
						</clause></subparagraph></paragraph><paragraph id="HF987A47126FC454C868BDA5E3B676B8F"><enum>(8)</enum><header>Consultation
			 with working group</header><text>The Assistant Secretary shall consult with the
			 working group in carrying out this subsection.</text>
				</paragraph></subsection><subsection id="H23A5A66E369444EAA5D0EBC0C6204781"><enum>(e)</enum><header>GAO
			 audit</header>
				<paragraph id="H44ED0C946AA04606BAE411FE18D3F9B2"><enum>(1)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct an audit of the competition conducted under this section.</text>
				</paragraph><paragraph id="H77A8C2A01246400F8FB5FF6AF2494EC2"><enum>(2)</enum><header>Factors for
			 evaluation</header><text>In conducting such audit, the Comptroller General
			 shall evaluate the following:</text>
					<subparagraph id="H78A5CFA3285A44FDB907EA849AEE4EB4"><enum>(A)</enum><text display-inline="yes-display-inline">The extent to which grants under this
			 section were awarded on the basis of the merits of the bids submitted,
			 including whether the requirements established under subsection (c)(1) were
			 sufficient to ensure that the devices developed with such grants adequately
			 support mission-critical broadband voice and data communications of public
			 safety personnel.</text>
					</subparagraph><subparagraph id="H9B5F379F571049CA89539B20AB18A596"><enum>(B)</enum><text>The extent to
			 which the grants encouraged competition in the market for the devices.</text>
					</subparagraph><subparagraph id="H6C3756B1A7064DDA865A058122BBC14A"><enum>(C)</enum><text display-inline="yes-display-inline">The effect of the grants on the cost at
			 which public safety personnel are able to purchase the devices.</text>
					</subparagraph><subparagraph id="H164FA026F44645C289E0DC64ED9D9AF4"><enum>(D)</enum><text>The contribution
			 to public safety of the devices.</text>
					</subparagraph><subparagraph id="H020DC234AD504ED19BA8CAD708E3198D"><enum>(E)</enum><text>Such other factors
			 as the Comptroller General considers appropriate.</text>
					</subparagraph></paragraph><paragraph id="HDE4F502FE294449CAF170E2767415645"><enum>(3)</enum><header>Report to
			 Congress</header><text>Not later than 5 years after the date of the enactment
			 of this section, the Comptroller General shall submit to Congress a report on
			 the findings of such audit.</text>
				</paragraph></subsection></section><section id="HB9F5C08176EC46F085A13AA04F85115C"><enum>3.</enum><header>Award of label by
			 FCC</header>
			<subsection id="H21B4364D25614755BBB7F74AC152D967"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Commission shall
			 establish a voluntary labeling program to identify nonstationary RoIP devices
			 that meet such criteria as the Commission considers appropriate for the support
			 of mission-critical broadband voice and data communications of public safety
			 personnel.</text>
			</subsection><subsection id="H32D9EBA21A15434BB3A94E729AAE00CD"><enum>(b)</enum><header>Establishment of
			 label</header><text display-inline="yes-display-inline">Under such program, the
			 Commission shall determine a name and design for a label (in this section
			 referred to as the <quote>label</quote>) for any RoIP device that meets the
			 criteria described in subsection (a) and shall take the necessary steps to
			 register the label as a mark under the Act entitled <quote>An Act to provide
			 for the registration and protection of trademarks used in commerce, to carry
			 out the provisions of certain international conventions, and for other
			 purposes</quote>, approved March 17, 1946 (commonly referred to as the
			 Trademark Act of 1946; 15 U.S.C. 1051 et seq.).</text>
			</subsection><subsection id="HC97BC9CCC7EF419B9536B1EDDEC0A644"><enum>(c)</enum><header>Award of
			 label</header>
				<paragraph id="H57BE245FB4FD4312B1A9740C0C85ADB8"><enum>(1)</enum><header>Application</header><text display-inline="yes-display-inline">Under the program, the Commission shall
			 establish a process under which an entity manufacturing, marketing, or selling
			 a RoIP device may apply for the award of the label for such device.</text>
				</paragraph><paragraph id="H21BEAF13E4FC439EAE7B19662DFE34F8"><enum>(2)</enum><header>Award</header><text display-inline="yes-display-inline">Upon application for a device under
			 paragraph (1), the Commission shall award the label to such device if the
			 Commission determines that the device meets the criteria described in
			 subsection (a).</text>
				</paragraph><paragraph id="HF41C65F20301492E9F758CA99679649D"><enum>(3)</enum><header>Effect</header><text display-inline="yes-display-inline">An entity manufacturing, marketing, or
			 selling a RoIP device awarded the label may display the label and otherwise
			 indicate that the device has been awarded the label on the device and in or on
			 any materials accompanying the device or any advertising with respect to the
			 device.</text>
				</paragraph></subsection><subsection id="H51EC2AB017914D469424E6B2C038131A"><enum>(d)</enum><header>Revision of
			 criteria</header><text>The Commission shall periodically review the criteria
			 described in subsection (a) and revise the criteria as the Commission considers
			 appropriate.</text>
			</subsection><subsection id="H76D97B205E314DA2BC0C84FA8A07730A"><enum>(e)</enum><header>Annual
			 compliance certification</header>
				<paragraph id="HEC817C4369314D8DAEB1685066B7FED6"><enum>(1)</enum><header>In
			 general</header><text>An entity displaying or otherwise indicating that a RoIP
			 device has been awarded the label shall annually certify to the Commission that
			 the device continues to meet the criteria described in subsection (a),
			 including any revisions to the criteria since the label was awarded.</text>
				</paragraph><paragraph id="H594528A14CBC41DCA0771AE09ECCF998"><enum>(2)</enum><header>Withdrawal of
			 award of label</header><text>The Commission shall withdraw the award of the
			 label with respect to a device if—</text>
					<subparagraph id="HF72D45BB538D4868AA4C7812532E62BD"><enum>(A)</enum><text display-inline="yes-display-inline">for a year, a certification required by
			 paragraph (1) for the device is not submitted by any of the entities required
			 to submit such certification; or</text>
					</subparagraph><subparagraph id="H56F2B5B4C08B456A9FE41831464950D7"><enum>(B)</enum><text display-inline="yes-display-inline">the Commission otherwise finds that the
			 device no longer meets the criteria described in subsection (a), including any
			 revisions to the criteria since the label was awarded.</text>
					</subparagraph></paragraph></subsection><subsection id="HF8B126C1C7E141EFB17710B92A7A3A27"><enum>(f)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Commission may promulgate regulations
			 to promote the effective use of the label and to prevent the misuse of the
			 label.</text>
			</subsection><subsection id="H10B50C122867402EA6174577EDF7AC6D"><enum>(g)</enum><header>Online
			 database</header><text>The Commission shall maintain an electronic database of
			 the devices for which the award of the label is in effect and shall make such
			 database publicly available on an appropriate Internet website.</text>
			</subsection></section><section display-inline="no-display-inline" id="H34F70F6B4D3E4ABE99EE424BC8DC560D" section-type="subsequent-section"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="H798493CF103F44E68C88FA06BCA80711"><enum>(1)</enum><header>Assistant
			 Secretary</header><text display-inline="yes-display-inline">The term
			 <term>Assistant Secretary</term> means the Assistant Secretary of Commerce for
			 Communications and Information.</text>
			</paragraph><paragraph id="H652734EAFA9F4277ADC257D98BFBF8D9"><enum>(2)</enum><header>Broadband</header><text display-inline="yes-display-inline">The term <term>broadband</term> has the
			 same meaning as under the Broadband Technology Opportunities Program
			 established under section 6001 of the American Recovery and Reinvestment Act of
			 2009 (47 U.S.C. 1305).</text>
			</paragraph><paragraph id="HEFC556B5823A4521AD2D2E072AC1ADE7"><enum>(3)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Federal Communications
			 Commission.</text>
			</paragraph><paragraph id="H023FF487FACC45ACB88390A5E60EF1F1"><enum>(4)</enum><header>Communications
			 profile</header><text>The term <term>communications profile</term> means a
			 configuration of technology or equipment that supports broadband communications
			 by radio through the public switched telephone network, the Internet, or any
			 other public network. The radio-air interface configuration used by a
			 particular communications profile is part of such profile and is one of the
			 characteristics that distinguishes such profile from a different communications
			 profile. A communications profile can be implemented using radio equipment
			 designed to support specific, fixed profiles or radio equipment capable of
			 supporting an indefinite number of profiles through software programming
			 changes.</text>
			</paragraph><paragraph id="H10376D5B9083447F8548E4ED1050CFB4"><enum>(5)</enum><header>Eligible
			 entity</header><text>The term <term>eligible entity</term> means an entity that
			 submits a bid for a grant under section 2.</text>
			</paragraph><paragraph id="H058AAD1D84B241D69FBEB3CEFE8AED10"><enum>(6)</enum><header>Mission-critical</header><text>The
			 term <term>mission-critical</term>, used with respect to communications between
			 2 or more public safety personnel, means that, in order for such personnel to
			 protect life or property or the safety of such personnel, such communications
			 must be delivered in a real-time manner and with sufficient quality and clarity
			 for easy comprehension by such personnel, regardless of the conditions under
			 which the communications are sent or received.</text>
			</paragraph><paragraph id="HAEEFD7E1A65C42E5BD91739A55E89C17"><enum>(7)</enum><header>Public safety
			 personnel</header><text>The term <term>public safety personnel</term> means any
			 Federal, State, or local law enforcement officer, firefighter, or provider of
			 emergency medical services or communications center personnel.</text>
			</paragraph><paragraph id="H560AC4C7DC2E4B68A50B40BA1104D62F"><enum>(8)</enum><header>Radio over
			 Internet protocol device or RoIP device</header><text display-inline="yes-display-inline">The term <term>radio over Internet protocol
			 device</term> or <term>RoIP device</term> means a device that is capable of
			 passing audio and other control functions of a radio system across an Internet
			 protocol-enabled network utilizing, at a minimum, the following portions of the
			 electromagnetic spectrum:</text>
				<subparagraph display-inline="no-display-inline" id="H60302B939AE8484F9E59BA9602AB3C39"><enum>(A)</enum><text display-inline="yes-display-inline">D Block (the electromagnetic spectrum
			 between 758 and 763 megahertz, inclusive, and between 788 and 793 megahertz,
			 inclusive).</text>
				</subparagraph><subparagraph id="H8B296218DE464A799060E813F217A550"><enum>(B)</enum><text display-inline="yes-display-inline">Public Safety Broadband Network (the
			 electromagnetic spectrum between 763 and 768 megahertz, inclusive, and between
			 793 and 798 megahertz, inclusive).</text>
				</subparagraph></paragraph></section><section id="H629C299EDD484CDDA7A86101F044577A"><enum>5.</enum><header>Funding</header>
			<subsection id="HFF1D53F9E98B4D3FAFB8EE8F56D1DC61"><enum>(a)</enum><header>Public Safety
			 Communications Devices Fund</header>
				<paragraph id="H769B91938CA641739F8668CFDACB27E2"><enum>(1)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund to be known as the
			 Public Safety Communications Devices Fund.</text>
				</paragraph><paragraph id="H774B9E7CBF4B454CB5FD70BC0210B68D"><enum>(2)</enum><header>Purpose</header><text display-inline="yes-display-inline">The Assistant Secretary and the Commission
			 shall use the funds deposited in the Public Safety Communications Devices Fund
			 to carry out sections 2 and 3, respectively. Of such funds, $1,000,000 in
			 fiscal year 2011 and $333,000 in each of the fiscal years 2012 through 2014
			 shall be available to the Assistant Secretary for administration of the grant
			 program established under section 2. If the Assistant Secretary does not use
			 the full amount available for administration in a fiscal year, the remainder of
			 such amount shall be available to the Assistant Secretary for administration of
			 the grant program in any fiscal year prior to fiscal year 2016.</text>
				</paragraph><paragraph id="HF153744AA18C414983CF7FD7C52D4AC6"><enum>(3)</enum><header>Credit</header>
					<subparagraph id="H917DA39B2ACF4EE0B205D226A267142E"><enum>(A)</enum><header>Borrowing
			 authority</header><text display-inline="yes-display-inline">The Assistant
			 Secretary and the Commission may borrow from the general fund of the Treasury
			 beginning on October 1, 2010, such sums as may be necessary, but not to exceed
			 a total of $70,000,000, to implement sections 2 and 3, respectively.</text>
					</subparagraph><subparagraph id="HDD54014A035042CCB7677B8526B200CD"><enum>(B)</enum><header>Reimbursement</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall
			 reimburse the general fund of the Treasury, without interest, for any amounts
			 borrowed under subparagraph (A) as funds are deposited into the Public Safety
			 Communications Devices Fund, but in no case later than September 30,
			 2015.</text>
					</subparagraph></paragraph></subsection><subsection id="H709B430D3B794B9E92DD0CDE7662B174"><enum>(b)</enum><header>Deposits</header><text display-inline="yes-display-inline">Notwithstanding subparagraphs (A) and (D)
			 of paragraph (8) of section 309(j) of the Communications Act of 1934 (47 U.S.C.
			 309(j)), the Secretary of the Treasury shall—</text>
				<paragraph id="H1BBA0C7E9C0440ECBC5E6BC192EB8386"><enum>(1)</enum><text>deposit in the
			 Public Safety Communications Devices Fund $70,000,000 of the proceeds
			 (including deposits and upfront payments from successful bidders) from the
			 auction of spectrum under such section during the period beginning on October
			 1, 2012, and ending on September 30, 2015; and</text>
				</paragraph><paragraph id="H7733257D2FAB4D0889DE16EB1290AEF2"><enum>(2)</enum><text>make the funds
			 deposited under paragraph (1) available to the Assistant Secretary and the
			 Commission without further appropriation.</text>
				</paragraph></subsection><subsection id="H476EEBF7BAFD4639A8D3E8F0788BDA7C"><enum>(c)</enum><header>Transfer of
			 unused funds</header><text display-inline="yes-display-inline">The Secretary of
			 the Treasury shall transfer to the general fund of the Treasury any funds
			 remaining in the Public Safety Communications Devices Fund after September 30,
			 2015.</text>
			</subsection><subsection id="H6BA2C8CCA6E047879AB488C0DE733CCF"><enum>(d)</enum><header>Extension of
			 auction authority</header><text display-inline="yes-display-inline">Section
			 309(j)(11) of the Communications Act of 1934 (47 U.S.C. 309(j)(11)) is amended
			 by striking <quote>2012</quote> and inserting <quote>2015</quote>.</text>
