		  relating to copyrights.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Copyright Cleanup, Clarification, and
			 Corrections Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID66bdcf5c44ac4d95a77f962911be27d5" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Copyright office procedures</header><text display-inline="no-display-inline">Title 17, United States Code, is
			 amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id43ACD6479B0D420BB6CF8E0FD98F060D"><enum>(1)</enum><text display-inline="yes-display-inline">in section 512(c)(2), in the matter
			 following subparagraph (B), by striking <quote>, in both electronic and hard
			 copy formats</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD968AE358C6D4F2794771A311AFEED53"><enum>(2)</enum><text display-inline="yes-display-inline">in section 205(a), by adding at the end the
			 following: <quote>A sworn or official certification may be submitted to the
			 Copyright Office electronically, pursuant to regulations established by the
			 Register of Copyrights.</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDbe3ebe920ed84dd1b58740512e7cd683" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Repeal of expired provisions</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID18c9594348ef46888c59d408f5ed02b2"><enum>(a)</enum><header display-inline="yes-display-inline">Technical amendments related to chapter
			 6</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id08C13D59A49A4419A3BBA656BDE9C1FE"><enum>(1)</enum><text display-inline="yes-display-inline">The heading for chapter 6 of title 17,
			 United States Code, is amended to read as follows:</text>

			 Code, is hereby repealed and reserved.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id9BC35E3314344E2B9871031F15D8EC54"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendments</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id825F1AB26E654C70B369A5A655891BAD"><enum>(1)</enum><text display-inline="yes-display-inline">Section 409 of title 17, United States
			 Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id26ADE5A27C84458989EEB3CB05A10B33"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (9), by insert
			 <quote>and</quote> after the semicolon;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF61966D8FF0B4541929C2B5699CEDD04"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (10); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61EAC77BB1D244CDAF0ECB685EDEE524"><enum>(C)</enum><text display-inline="yes-display-inline">by redesignating paragraph (11) as
			 paragraph (10).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4E62208A66BF45C8B8C60CB1243FF5EB"><enum>(2)</enum><text display-inline="yes-display-inline">The first sentence of section 602(b) of
			 title 17, United States Code, is amended by striking <quote>unless the
			 provisions of section 601 are applicable</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDb9de0f4a48da4688a42d4fbc0a9a6750" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Clarifications</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDbaa66eed6dca43f39d5c58bcc50cc09b"><enum>(a)</enum><header display-inline="yes-display-inline">Transfer of ownership</header><text display-inline="yes-display-inline">The second sentence of section 201(d)(2),
			 of title 17, United States Code, is amended by adding before the period the
			 following: <quote>, including the right to transfer or license the exclusive
			 right to another person in the absence of a written agreement to the
			 contrary</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFE4329E7FCD049B6A8AD9CFC7D9ADE63"><enum>(b)</enum><header display-inline="yes-display-inline">Certain distributions of
			 phonorecords</header><text display-inline="yes-display-inline">Section 303(b)
			 of title 17, United States Code, is amended by striking <quote>the musical
			 work</quote> and inserting <quote>any musical work, dramatic work, or literary
			 work</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1a2577c28451401fbfb3e127c7e906e4"><enum>(c)</enum><header display-inline="yes-display-inline">Proceedings of copyright royalty
			 judges</header><text display-inline="yes-display-inline">Section 803(b)(6)(A)
			 of title 17, United States Code, is amended by striking the second sentence and
			 inserting: <quote>All regulations issued by the Copyright Royalty Judges are
			 subject to the approval of the Librarian of Congress and are subject to
			 judicial review pursuant to Chapter 7 of title 5, United States Code, except as
			 set forth in subsection (d).</quote></text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idDE04A4EAA70643B7BE28556E7DD583BA"><enum>(d)</enum><header display-inline="yes-display-inline">Licenses for certain nonexempt
			 transmissions</header><text display-inline="yes-display-inline">Section
			 114(f)(2)(C) of title 17, United States Code, is amended by striking
			 <quote>preexisting subscription digital audio transmission services or
			 preexisting satellite digital radio audio services</quote> and inserting
			 <quote>eligible nonsubscription services and new subscription
			 services</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8f346d2495364f4f8eaa800893a46671" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Technical corrections</header>
			<subsection commented="no" display-inline="no-display-inline" id="id7FA10A5600E24F4494B0A6F166663EC2"><enum>(a)</enum><text display-inline="yes-display-inline">Title 17, United States Code, is
			 amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1DAD9DF05E804017ABF7EA4654D117FC"><enum>(1)</enum><text display-inline="yes-display-inline">in section 101—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id5E7383856AED4292BF16D8AC380F1F94"><enum>(A)</enum><text display-inline="yes-display-inline">by moving the definition of
			 <quote>Copyright Royalty Judges</quote> to follow the definition of
			 <quote>Copyright owner</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCB0DC7646AC84CC7A1A3A8182076E5C3"><enum>(B)</enum><text display-inline="yes-display-inline">by moving the definition of <quote>motion
			 picture exhibition facility</quote> to follow the definition of <quote>Literary
			 works</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE02E1E035F6C45F5ABB26B2739797439"><enum>(C)</enum><text display-inline="yes-display-inline">by moving the definition of <quote>food
			 service or drinking establishment</quote> to follow the definition of
			 <quote>fixed</quote>;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID42ff48b9c7084ab8b9ef36b92de49f4a"><enum>(2)</enum><text display-inline="yes-display-inline">in section 114(f)(2)(B), in the fourth
			 sentence in the matter preceding clause (i), by striking <quote>Judges shall
			 base its decision</quote> and inserting <quote>Judges shall base their
			 decision</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDec2f4607110c4ad2b3227134dfb11533"><enum>(3)</enum><text display-inline="yes-display-inline">in section 119(g)(4)(B)(vi), by striking
			 <quote>the examinations</quote> and inserting <quote>an
			 examination</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID888acadd661b48d7a274fdc9050242e7"><enum>(4)</enum><text display-inline="yes-display-inline">in section 503(a)(1)(B), by striking
			 <quote>copies of phonorecords</quote> and inserting <quote>copies or
			 phonorecords</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD2F61B10982E4CCAA888551C5E94901B"><enum>(5)</enum><text display-inline="yes-display-inline">in section 704(e), in the second sentence,
			 by striking <quote>section 708(a)(10)</quote> and inserting <quote>section
			 708(a)</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0a85c5fa3340430cb6241ea7b595a4dd"><enum>(b)</enum><text display-inline="yes-display-inline">Section 209(a)(3)(A) of Public Law 110–403,
			 is amended by striking <quote>by striking <quote>and 509</quote></quote> and
			 inserting <quote>by striking <quote>and section 509</quote></quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf8f67a98869c4ddfa4ad100e71ae34a7"><enum>(c)</enum><text display-inline="yes-display-inline">Section 4(a)(1) of Public Law 111–146 is
			 amended by striking <quote>by corporations attempting</quote> and inserting
			 <quote>the purpose of which is</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDda13e56247124751b836b19966072fd2"><enum>(d)</enum><text display-inline="yes-display-inline">Section 2318(e)(6) of title 18, United
			 States Code, is amended by striking <quote>under section</quote> and inserting
			 <quote>under this section</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id417F8229295A442BADBBB926FC3B6D23" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Budgetary effects</header><text display-inline="no-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Senate Budget Committee, provided
			 that such statement has been submitted prior to the vote on passage.</text>
