		<official-title>To amend title XVIII of the Social Security Act to
		  provide for Medicare coverage of comprehensive Alzheimer’s disease and other
		  dementia diagnosis and services in order to improve care and outcomes for
		  Americans living with Alzheimer’s disease by increasing detection, diagnosis,
		  care, and planning.</official-title>

		<section id="id03630AD5E62C4EBD88AC2FD6EEDF4AC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Outcomes, Planning, and
			 Education for Alzheimer’s Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="HE1BD1E6A09034EE0A57A616283CA2BEA" section-type="subsequent-section"><enum>2.</enum><header>Medicare coverage of
			 comprehensive Alzheimer’s disease and other dementia diagnosis and
			 services</header>
			<subsection id="H9EC6DDB097A74B53869694B2684462C8"><enum>(a)</enum><header>In
			 general</header><text>Section 1861 of the Social Security Act is
			 amended—</text>
				<paragraph id="H2E78423D64FC417A97866422F4742FDB"><enum>(1)</enum><text>in subsection
			 (s)(2)—</text>
					<subparagraph id="H1C2B436487EC43469862C5EADF4B5D3B"><enum>(A)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (EE);</text>
					</subparagraph><subparagraph id="HBAA427987FDE42BDADC4A7B820F9A1C6"><enum>(B)</enum><text>by adding
			 <quote>and</quote> at the end of subparagraph (FF); and</text>
					</subparagraph><subparagraph id="HDA17C13AFB104453B09B6E311B1D64ED"><enum>(C)</enum><text>by adding at the
			 end the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="H7C3198334C954D3191F1E38D9DAA80E0" style="OLC">
							<subparagraph id="H74B7B6F324C44E9CB396E1682BFC5F55" indent="up1"><enum>(GG)</enum><text display-inline="yes-display-inline">comprehensive Alzheimer’s disease and other
				dementia diagnosis and services (as defined in subsection
				(iii));</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H8E1C577D99B146F08D811041C06CC9F2"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H1DB2075BBD6348A1AD52C71ADDB5BEFD" other-style="archaic" style="other">
						<subsection id="H787DDB4FC069440F95AD8B5C8A4A80B6"><enum>(iii)</enum><header>Comprehensive Alzheimer’s disease and other dementia
		  diagnosis and services</header><paragraph commented="no" display-inline="yes-display-inline" id="HF75EFB2804774C5587A0A4760C15AD81"><enum>(1)</enum><text>The term
				<term>comprehensive Alzheimer’s disease and other dementia diagnosis and
				services</term> means the services described in paragraph (2) furnished to an
				individual—</text>
								<subparagraph id="idE1AADAE8F82C4B8F8EA6A547645E3BC6" indent="up1"><enum>(A)</enum><text>who does not already have a diagnosis
				of Alzheimer’s disease or other dementia; and</text>
								</subparagraph><subparagraph id="id3C9EB1A85F8D463A832B047D58A46F0A" indent="up1"><enum>(B)</enum><text>for whom there has been a
				determination by a physician or practitioner (as defined in section
				1842(b)(18)(C)), in a medical setting such as a physician's office, a skilled
				nursing facility, a community health center, or another similar setting, that
				the individual—</text>
									<clause id="id118E215C5ADA4A7FBA246C7153DB9BF3"><enum>(i)</enum><text>may have a cognitive impairment or
				dementia; and</text>
									</clause><clause id="id416386180FF34BFE9BD72AA6F1949979"><enum>(ii)</enum><text>has a need for a diagnostic
				evaluation for Alzheimer’s disease or another dementia.</text>
									</clause></subparagraph></paragraph><paragraph id="id4370F2C1D0E24DF4B42DAA4E0D771D94" indent="up1"><enum>(2)</enum><text>The services described in this
				paragraph are the following:</text>
								<subparagraph id="H75023B8D905148C18E3CBB7255207932"><enum>(A)</enum><text>A diagnostic evaluation, including
				referral to a specialist if recommended, in accordance with guidelines
				specified by the Secretary.</text>
								</subparagraph><subparagraph id="H5E0A8B645AF64E36A0BC7892506E45A3"><enum>(B)</enum><text>If the individual is diagnosed with
				Alzheimer’s disease or another dementia under the evaluation under subparagraph
				(A), care planning services (with the individual or with one or more family
				caregivers of the individual without the presence of the individual), including
				assistance understanding the diagnosis as well as the medical and non-medical
				options for ongoing treatment, services, and supports, and information about
				how to obtain such treatments, services, and supports.</text>
								</subparagraph><subparagraph id="H772703EA72DB4756B55BC9D93329D884"><enum>(C)</enum><text>Medical record documentation, with
				respect to an individual, of the diagnostic evaluation under subparagraph (A)
				and any care planning services under subparagraph (B).</text>
								</subparagraph></paragraph><paragraph id="HE151CC95052F4215A169166401B333A1" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall establish standards to
				carry out this subsection in consultation with Alzheimer’s disease and other
				dementia stakeholders, including patients and their advocates, and medical
				experts in the areas of detection, diagnostics, and care
				planning.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H95CAFD1273404550A2E8CB9C50696278"><enum>(b)</enum><header>Payment</header><text display-inline="yes-display-inline">Section 1833(a)(1) of the Social Security
			 Act (42 U.S.C. 1395l(a)(1)) is amended by striking <quote>and</quote> before
			 <quote>(X)</quote> and inserting before the semicolon at the end the following:
			 <quote>, and (Y) with respect to comprehensive Alzheimer’s disease and other
			 dementia diagnosis and services (as defined in section 1861(iii)), the amount
			 paid shall be an amount equal to 80 percent of the amount determined under a
			 fee schedule established by the Secretary</quote>.</text>
			</subsection><subsection id="HEF755BD3BE5A4ABDB7DF9A502F9FCA2B"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to services
			 furnished on or after January 1, 2011.</text>
			</subsection></section><section id="id224B8B91834F4DCF87EAB630EDCC8DC1"><enum>3.</enum><header>Federal
			 Coordinated Health Care Office study and report</header>
			<subsection id="idA20C91BAD4094A398472A276D72514D4"><enum>(a)</enum><header>Study</header><text>The
			 Federal Coordinated Health Care Office (as established under section 2602 of
			 the Patient Protection and Affordable Care Act (42 U.S.C. 1315b)) shall conduct
			 a study to identify—</text>
				<paragraph id="idA1A5E0DB5DFF4DCEBD058F9471F7FBD1"><enum>(1)</enum><text>barriers to the
			 detection of Alzheimer’s disease and other dementias for dual eligible
			 individuals (as defined in subsection (f) of such section 2602);</text>
				</paragraph><paragraph id="idD860AE04B50C4FAF95C86A8A2B8ACF18"><enum>(2)</enum><text>barriers to the
			 furnishing of comprehensive Alzheimer's disease and other dementia diagnosis
			 and services (as defined in section 1866(iii) of the Social Security Act, as
			 added by section 2) to such individuals; and</text>
				</paragraph><paragraph id="id5DDD5B373FBD4E9DAA2BD4C658B58582"><enum>(3)</enum><text>ways to eliminate
			 the barriers described in paragraphs (1) and (2).</text>
				</paragraph></subsection><subsection id="id096FC833E39A429B9FFB7413C8E57E73"><enum>(b)</enum><header>Report</header><text>Not
			 later than 2 years after the date of the enactment of this Act, the Federal
			 Coordinated Health Care Office shall submit to Congress a report on the study
			 conducted under subsection (a) together with recommendations for such
			 legislation and administrative actions as the Office determines
			 appropriate.</text>
