			 subsection (d) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8AB63A36A3B74CCFB323E5BE4B64CAFA" style="OLC">
						<subsection id="id5392400B8BA644A1987F1644BF338EB4"><enum>(d)</enum><header>Private sector
				information sharing on security threats</header>
							<paragraph id="idD46E1A4089D74E2CB388DF4559A6DDA6"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall establish a program to promote
				sharing information with Tier 3 participants and other private entities
				regarding—</text>
								<subparagraph id="id7386E7E33E2C44B382D153A1BD5C30A3"><enum>(A)</enum><text>potential
				vulnerabilities, attacks, and exploitations of the international supply chain;
				and</text>
								</subparagraph><subparagraph id="id95D61A9DCDBF44A98DC9F4E0D39AFFE5"><enum>(B)</enum><text>means and methods
				of preventing, responding to, and mitigating consequences from the
				vulnerabilities, attacks, and exploitations described in subparagraph
				(A).</text>
								</subparagraph></paragraph><paragraph id="id4CD3735CF6DA4D14AB5DE6BBCF381B05"><enum>(2)</enum><header>Contents</header><text>The
				program established under paragraph (1) shall include—</text>
								<subparagraph id="id1D73D26ECFFF41D6A046E578D557E423"><enum>(A)</enum><text>the creation of
				classified and unclassified means of accessing information that may be used by
				appropriately cleared personnel and that will provide, as appropriate, ongoing
				situational awareness of the security of the international supply chain;
				and</text>
								</subparagraph><subparagraph id="ID0650c9fcd23e4f52ab6d8b299eb066bd"><enum>(B)</enum><text>the creation of
				guidelines to establish a mechanism by which owners and operators of
				international supply chain infrastructure may report actual or potential
				security
				breaches.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id14D3BB70B92F47E59269EA857BB1880E"><enum>5.</enum><header>Recognition of
			 other countries’ trusted shipper programs</header><text display-inline="no-display-inline">Section 218 of the
			 <short-title>SAFE Port Act</short-title> (6 U.S.C. 968) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id30A9EA04FAD4440A8AF8D8BCC3D51EB1" style="OLC">
				<subsection id="id4EB8F07EA17042818CBDE6E4AB0D4E62"><enum>(j)</enum><header>Recognition of
				other countries’ trusted shipper programs</header><text display-inline="yes-display-inline">Not later than 30 days before entering into
				an agreement between the United States and a foreign government providing for
				mutual recognition of supply chain security programs, which would result in the
				awarding of benefits described in section 214, 215, or 216 of the SAFE Port
				Act, the Secretary of Homeland Security shall—</text>
					<paragraph id="id8F64A2E2C8A94671BB8F1AC9899EB0C7"><enum>(1)</enum><text display-inline="yes-display-inline">notify Congress of the proposed terms of
				such agreement; and</text>
					</paragraph><paragraph id="idB7108EF3AF89403B84FDF602ABE494D4"><enum>(2)</enum><text display-inline="yes-display-inline">determine, in consultation with the
				Commissioner, Customs and Border Protection, that the foreign government’s
				supply chain security program provides an equivalent level of supply chain
				security as provided by the Customs-Trade Partnership Against
				Terrorism.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id5F34AE2E00704E61A5C3F2ACC959C8AB"><enum>6.</enum><header>Secure Freight
			 Initiative</header><text display-inline="no-display-inline">Section 232(b) of
			 the <short-title>SAFE Port Act</short-title> (6 U.S.C.
			 982(b)) is amended—</text>
			<paragraph id="id4DD240C6AC1A45848620696EFD4FFAD0"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>A
			 container</quote> and inserting <quote>Except as provided under paragraph (10),
			 a container</quote>; and</text>
			</paragraph><paragraph id="id5F286FD8491242FD8FEEC269D2B0788D"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idE9CD505943B14E32B606378D0BAA65FF" style="OLC">
					<paragraph id="id08C6A8067B9E4AFA8B351DED51141D05"><enum>(10)</enum><header>Waiver</header><text>The
				Secretary may waive the application of paragraph (1) if the Secretary certifies
				to Congress that—</text>
						<subparagraph id="id4E65B7458A414023BFBCE0372A9BCC44"><enum>(A)</enum><text>C-TPAT
				revalidations are occurring at least once every 4 years;</text>
						</subparagraph><subparagraph id="idB7AAE72D202D4F2780BE331BB0BFF8B5"><enum>(B)</enum><text>the Container
				Security Initiative has been implemented and is in operation at all high-risk
				foreign ports;</text>
						</subparagraph><subparagraph id="id063DD1471E194476B17575339C4BD171"><enum>(C)</enum><text>100 percent of
				cargo containers originating outside the United States undergo a screening to
				identify high-risk containers;</text>
						</subparagraph><subparagraph id="id4E8FFDFE16ED4361AFF04CE899C5CABE"><enum>(D)</enum><text>100 percent of
				the containers that have been identified as high-risk are scanned or searched
				before entering the United States; and</text>
						</subparagraph><subparagraph id="id40E29D8DB03D47F385937B42FE1CB19C"><enum>(E)</enum><text>the additional
				data elements required to be submitted to the Department under section 203 to
				identify high-risk cargo have improved the capabilities of the Automated
				Targeting System, based on empirical evidence of seizures of illegal narcotics
				and dangerous
				materials.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID6b1244ca77834c918bdf835537d99878"><enum>7.</enum><header>America’s
			 waterway watch program</header>
			<subsection id="ID04736870b02e4e54a812eeb02b920047"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary of Homeland Security shall establish a national maritime homeland
			 security outreach and awareness program to be known as the America’s Waterway
			 Watch Program (referred to in this section as the <quote>Program</quote>). The
			 program shall—</text>
				<paragraph id="ID20c4cb04e3cf472e9cc05795c6db357e"><enum>(1)</enum><text>encourage the
			 public and industry to recognize and report suspected terrorist activity or
			 suspicious behavior against a vessel, facility, port, or waterway; and</text>
				</paragraph><paragraph id="ID5df98cefa1634d9083bbad8fbf01c857"><enum>(2)</enum><text>promote voluntary
			 reporting of such activity or behavior.</text>
				</paragraph></subsection><subsection id="ID9ef6a26ea73c43c98d476a09c2ed4814"><enum>(b)</enum><header>Purpose</header><text>The
			 Program shall be to promote voluntary reporting of activities that indicate
			 that a person may be preparing to engage or is engaging in a violation of law
			 relating to a threat or act of terrorism against a vessel, facility, port, or
			 waterway.</text>
			</subsection><subsection id="ID63ae711d66fc41a6b1de93fcd18c452f"><enum>(c)</enum><header>Components</header><text>The
			 Program shall—</text>
				<paragraph id="ID044a9c4ae4e041f18c33f8d7c9c74468"><enum>(1)</enum><text>consist of a
			 network of individuals, agencies, and community-based organizations to—</text>
					<subparagraph id="ID4902266af2434731b00255663206182b"><enum>(A)</enum><text>encourage the
			 public and industry to recognize and report a covered activity (as defined in
			 subsection (g));</text>
					</subparagraph><subparagraph id="IDc332307565324dd8aa5f81461286d7aa"><enum>(B)</enum><text>promote voluntary
			 reporting of such activity; and</text>
					</subparagraph><subparagraph id="IDe746baba37844a59a117151ae5c02ed1"><enum>(C)</enum><text>enhance the
			 situational awareness within the Nation’s ports and waterways;</text>
					</subparagraph></paragraph><paragraph id="ID102bf5622ec745c6a0713ac6b3831455"><enum>(2)</enum><text>be conducted in
			 cooperation with Federal, State, and local law enforcement agencies, to the
			 extent practicable; and</text>
				</paragraph><paragraph id="IDff86e97d50d34a71baf802baa7113b6c"><enum>(3)</enum><text>include education
			 in—</text>
					<subparagraph id="IDe2eb83b6538d4726a0519134643d35cb"><enum>(A)</enum><text>observing and
			 reporting on covered activities; and</text>
					</subparagraph><subparagraph id="ID768c8312bd27413cb025bc281313a9b9"><enum>(B)</enum><text>sharing such
			 reports and coordinating the response to such activities by Federal, State, and
			 local law enforcement agencies.</text>
					</subparagraph></paragraph></subsection><subsection id="ID9dce748b3b2546fa896076914a95054c"><enum>(d)</enum><header>Voluntary
			 participation</header><text>Participation in the Program—</text>
				<paragraph id="ID043bd1b1563541c7b01f6845081405d7"><enum>(1)</enum><text>shall be
			 voluntary;</text>
				</paragraph><paragraph id="IDe86bd19db8bd42c7ad36d8049bf14948"><enum>(2)</enum><text>shall not be a
			 prerequisite to eligibility for, or receipt of, any other service or assistance
			 from, or to participation in, any other program; and</text>
				</paragraph><paragraph id="ID74d834852a334e00961b9ad282a0d957"><enum>(3)</enum><text>shall not require
			 disclosure of information regarding the individual reporting covered activities
			 or, for proprietary purposes, the location of such individual.</text>
				</paragraph></subsection><subsection id="IDd91649f86f4c4d748203480ab4639858"><enum>(e)</enum><header>Immunity</header>
				<paragraph id="ID388b04bf9b6140bb960f43df65232b70"><enum>(1)</enum><header>Immunity for
			 reports of suspected terrorist activity or suspicious behavior and
			 response</header>
					<subparagraph id="ID6aadc104333443d0a7c0fa068cd7fea8"><enum>(A)</enum><header>In
			 general</header><text>Any individual who, in good faith and based on
			 objectively reasonable suspicion, makes, or causes to be made, a voluntary
			 report of covered activity to an authorized official shall be immune from civil
			 liability under Federal, State, and local law for such report.</text>
					</subparagraph><subparagraph id="ID5fab28ca2d6f491cb75fdd55978e0194"><enum>(B)</enum><header>False
			 reports</header><text>Subparagraph (A) shall not apply to any report
			 that—</text>
						<clause id="IDe5eefc69ef5e4c5fb7806c161943bad9"><enum>(i)</enum><text>the
			 individual knew to be false; or</text>
						</clause><clause id="IDa504d02880a74dc6a6db8a904acc0899"><enum>(ii)</enum><text>was made with
			 reckless disregard for the truth at the time that individual made the
			 report.</text>
						</clause></subparagraph></paragraph><paragraph id="IDca79ada22a6c4528b0917796cb45744d"><enum>(2)</enum><header>Immunity for
			 response</header>
					<subparagraph id="ID30d8d7d5b61249049e4607dd2035e4cd"><enum>(A)</enum><header>In
			 general</header><text>Any authorized official who observes, or receives a
			 report of, a covered activity and takes reasonable action in good faith to
			 respond to such activity shall have qualified immunity from civil liability for
			 such action, consistent with the applicable law of the relevant jurisdiction.
			 An authorized official not entitled to assert the defense of qualified immunity
			 shall be immune from civil liability under Federal, State, and local law if
			 such authorized official takes reasonable action, in good faith, to respond to
			 the reported activity.</text>
					</subparagraph><subparagraph id="ID823b43ee98ea42778668fd457d513692"><enum>(B)</enum><header>Savings
			 provision</header><text>Nothing in this paragraph may be construed to—</text>
						<clause id="ID0e7ea7f1129a4b46ac3c8623a89fc738"><enum>(i)</enum><text>affect the
			 ability of any authorized official to assert any defense, privilege, or
			 immunity that would otherwise be available under applicable law; or</text>
						</clause><clause id="ID0427ab86cbab4aba8b85994c096855ab"><enum>(ii)</enum><text>affect any such
			 defense, privilege, or immunity.</text>
						</clause></subparagraph></paragraph><paragraph id="IDe23865040ce94e91b50d83e8e57a7fbd"><enum>(3)</enum><header>Attorney fees
			 and costs</header><text>Any individual or authorized official granted immunity
			 from civil liability under this section shall be entitled to recover from the
			 plaintiff all reasonable costs and attorney fees.</text>
				</paragraph><paragraph commented="no" id="id4F8362702FEB446D8BB77143D0067DAA"><enum>(4)</enum><header>Exemption for
			 FOIA</header><text>A report regarding a covered activity made under this
			 section shall not be subject to disclosure under section 552 of title 5, United
			 States Code (commonly referred to as the Freedom of Information Act).</text>
				</paragraph></subsection><subsection id="IDcb4880c92982467187f64197a728304d"><enum>(f)</enum><header>Coordination</header>
				<paragraph id="ID8a7d0477c37c44ba8828cf837a7d1569"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Homeland Security shall—</text>
					<subparagraph id="idC9F5215E8E8E422FA379914A7EC39A08"><enum>(A)</enum><text>coordinate the
			 Program with similar critical infrastructure suspicious activity reporting
			 programs within the Department of Homeland Security; and</text>
					</subparagraph><subparagraph id="id73FA74CB0C484FB1995FF7CF9FFE9A90"><enum>(B)</enum><text>identify best
			 practices from such programs, including how to provide feedback to those that
			 report suspicious activities.</text>
					</subparagraph></paragraph><paragraph id="id605F976D5C75469D9F6D94156B751DD3"><enum>(2)</enum><header>Consultation</header><text>The
			 Secretary of Homeland Security shall, in developing the Program, consult with
			 representatives of the recreational boating community and commercial fishing
			 and vessel operators to foster long-term participation and success of the
			 Program.</text>
				</paragraph><paragraph id="ID712a57ad92e14db7b0981a4073e18479"><enum>(3)</enum><header>Report</header><text>Not
			 later than January 1 of each year, the Secretary shall submit a report that
			 describes the coordination of the Program and similar critical infrastructure
			 suspicious activity reporting programs within the Department of Homeland
			 Security to—</text>
					<subparagraph id="ID8de1f449613e4d63b248a9c31f9459f7"><enum>(A)</enum><text>the Committee on
			 Homeland Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="IDe1a56410ceca4cb0abc596cae8ba26eb"><enum>(B)</enum><text>the Committee on
			 Homeland Security of the House of Representatives.</text>
					</subparagraph></paragraph></subsection><subsection id="ID6b150eee83c54b1ba193f0c6159af9bc"><enum>(g)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="IDc041e6db16fd499998104b0c3be3495f"><enum>(1)</enum><header>Act of
			 terrorism</header><text>The term <term>act of terrorism</term> has the meaning
			 given the term in section 3077 of title 18, United States Code.</text>
				</paragraph><paragraph id="IDaf235e1890364e29a5357201250bb4a8"><enum>(2)</enum><header>Authorized
			 official</header><text>The term <term>authorized official</term> means—</text>
					<subparagraph id="ID2689fab2a570490dbf7180aa2b6a6a9a"><enum>(A)</enum><text>any employee or
			 agent of a vessel, facility, port, or waterway or other person with
			 responsibilities relating to the security of such systems;</text>
					</subparagraph><subparagraph id="IDe47f743e1da84587a2b853b2fb3d954b"><enum>(B)</enum><text>any officer,
			 employee, or agent of the Department of Homeland Security, the Department of
			 Transportation, or the Department of Justice with responsibilities relating to
			 the security of vessels, facilities, ports, or waterways; and</text>
					</subparagraph><subparagraph id="ID1ed488ed07e649e1adfe5989e86adb84"><enum>(C)</enum><text>any Federal,
			 State, or local law enforcement officer.</text>
					</subparagraph></paragraph><paragraph id="ID0294947c9f1e45ea9f7e9e2148ad8961"><enum>(3)</enum><header>Covered
			 activity</header><text>The term <term>covered activity</term> means any
			 suspicious transaction, activity, or occurrence that—</text>
					<subparagraph id="ID9ecf3c499fe24ef9a83262f4c53ac74c"><enum>(A)</enum><text>involves, or is
			 directed against, a vessel or facility; and</text>
					</subparagraph><subparagraph id="IDe9a74033deac4d689c331f8457e72cfb"><enum>(B)</enum><text>indicates that an
			 individual may be preparing to engage, or is engaging, in a violation of law
			 relating to—</text>
						<clause id="ID331ad1ba937e4ed596606e371ee0c2b9"><enum>(i)</enum><text>a
			 threat to a vessel, facility, port, or waterway; or</text>
						</clause><clause id="ID8e5ecdc773754f7eadb08921a55425c9"><enum>(ii)</enum><text>an
			 act of terrorism.</text>
						</clause></subparagraph></paragraph><paragraph id="IDc7dc4084465a4716bf128a16c573133d"><enum>(4)</enum><header>Facility</header><text>The
			 term <term>facility</term> has the meaning given the term in section 70101(2)
			 of title 46, United States Code.</text>
				</paragraph></subsection><subsection id="ID5e7e186413754242b39a66f0f9586d92"><enum>(h)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated, for
			 each of the fiscal years 2010 through 2014, $3,000,000, which shall—</text>
				<paragraph id="ID1fe0d86212a74ba58cff83c99f38e4ad"><enum>(1)</enum><text>be used to carry
			 out this section; and</text>
				</paragraph><paragraph id="ID89acc81e0545410f927efde623612fbe"><enum>(2)</enum><text>remain available
			 until expended.</text>
				</paragraph></subsection></section><section id="IDebb59239a86445b294c3443af9b4b3f5"><enum>8.</enum><header>Research,
			 development, test, and evaluation efforts in furtherance of maritime and cargo
			 security</header>
			<subsection id="ID95fb4a13809245198affceeacd691084"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Homeland Security shall—</text>
				<paragraph id="ID832297c412c84604bdb6375c04e9a80f"><enum>(1)</enum><text>direct research,
			 development, testing, and evaluation efforts in furtherance of maritime and
			 cargo security;</text>
				</paragraph><paragraph id="ID4cec360a755d4b6d99c77e5b35275cf4"><enum>(2)</enum><text>coordinate with
			 public and private sector entities to develop and test technologies, and
			 process innovations in furtherance of these objectives; and</text>
				</paragraph><paragraph id="ID3b3d260822b94a3ab5a357b3cd5d5af2"><enum>(3)</enum><text>evaluate such
			 technologies.</text>
				</paragraph></subsection><subsection id="ID81a7b32bc3cb43bba03adaeff470a0b0"><enum>(b)</enum><header>Coordination</header><text>The
			 Secretary, in coordination with the Under Secretary for Science and Technology,
			 the Assistant Secretary for Policy, the Commandant of the Coast Guard, the
			 Commissioner of U.S. Customs and Border Protection, the Chief Financial
			 Officer, and the heads of other appropriate offices or entities of the
			 Department of Homeland Security (referred to in this section as the
			 <quote>Department</quote>), shall ensure that—</text>
				<paragraph id="ID321603445c334f9b938a32ae64ee857a"><enum>(1)</enum><text>research,
			 development, testing, and evaluation efforts funded by the Department in
			 furtherance of maritime and cargo security are coordinated within the
			 Department and with other appropriate Federal agencies to avoid duplication of
			 efforts; and</text>
				</paragraph><paragraph id="ID124f8135292a444898363d12fd1e30e7"><enum>(2)</enum><text>the results of
			 such efforts are shared throughout the Department and with other Federal,
			 State, and local agencies, as appropriate.</text>
				</paragraph></subsection><subsection id="ID33a451db74444a7ea46e3f0428c49f61"><enum>(c)</enum><header>Demonstration
			 project</header><text>The Secretary, through the Under Secretary for Science
			 and Technology shall—</text>
				<paragraph id="ID2d332b7d89194b228a949329b9581920"><enum>(1)</enum><text>conduct a
			 demonstration project to determine the feasibility of using composite cargo
			 conveyances for all transportation modes to improve maritime and cargo
			 security; and</text>
				</paragraph><paragraph id="ID26aafc20bc224f568ca1e3764b7095ca"><enum>(2)</enum><text>submit a report
			 to Congress on the feasibility of using composite cargo conveyances for all
			 transportation modes to improve maritime and cargo security.</text>
				</paragraph></subsection><subsection id="IDcaaf8792ff5e4b2995108946cbded4c3"><enum>(d)</enum><header>Authorization
			 of appropriations</header>
				<paragraph id="idBBD58C798B9A4C5C85A4FE1DAC51200A"><enum>(1)</enum><header>In
			 general</header><text>In addition to any amounts otherwise appropriated to the
			 Directorate for Science and Technology and other components of the Department,
			 there are authorized to be appropriated, to carry out the demonstration project
			 described in subsection (c)—</text>
					<subparagraph id="ID4564da4dff4648aa82d52a2def9ec45e"><enum>(A)</enum><text>$10,000,000 for
			 fiscal year 2011;</text>
					</subparagraph><subparagraph id="IDea9d8b08952e4e7fb131384589470a99"><enum>(B)</enum><text>$10,000,000 for
			 fiscal year 2012; and</text>
					</subparagraph><subparagraph id="IDc3ff7537d4844021b6df19bfce60230d"><enum>(C)</enum><text>$5,000,000 for
			 fiscal year 2013.</text>
					</subparagraph></paragraph><paragraph id="id31C2325B01D74CC4BB24C0BBB5331960"><enum>(2)</enum><header>Availability</header><text>Amounts
			 appropriated pursuant to paragraph (1) shall remain available until
			 expended.</text>
				</paragraph></subsection></section><section id="ID2e85c1451af8418c9bd3e75e78c3ce1b"><enum>9.</enum><header>Coast Guard Port
			 Assistance Program</header>
			<subsection id="ID8b4ccafdbad6497a8ca172b2c16627d2"><enum>(a)</enum><header>In
			 general</header><text>Section 70110 of title 46, United States Code, is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id5FA1E011221E40BAA93A1B3B55964C0E" style="OLC">
					<subsection id="ID05cecc2f125b446f9570fbc7b1a1cfb0"><enum>(f)</enum><header>Coast guard
				port assistance program</header>
						<paragraph id="ID8c7e878ecb1b48ff84607de947f7e6e5"><enum>(1)</enum><header>In
				general</header><text>The Secretary—</text>
							<subparagraph id="IDe28871bd02234b80988b13345ee64081"><enum>(A)</enum><text>in consultation
				with the Secretary of State, may provide technical advice, training, or support
				to a government of a foreign country with jurisdiction over, or control of, a
				port or facility or the owner or operator of such port or facility; and</text>
							</subparagraph><subparagraph id="ID3b363d9349bc41e9b251ee6783439c9f"><enum>(B)</enum><text>with the
				concurrence of the Secretary of State, may lend, lease, donate, or otherwise
				provide equipment to such government or such owner or operator to assist the
				port or facility—</text>
								<clause id="idE509BD6891C247B8A8A01930E5E2396B"><enum>(i)</enum><text>in meeting or
				exceeding—</text>
									<subclause id="idBB551DE01D2A40ED90A2323F76C0DB4D"><enum>(I)</enum><text>applicable
				International Ship and Port Facility Security Code standards; or</text>
									</subclause><subclause id="idE5FDD7E508F04454928016C564E921ED"><enum>(II)</enum><text>standards
				established under section 70108, or</text>
									</subclause></clause><clause id="id0240893CB403487CB9F4B3C3A48CB4CB"><enum>(ii)</enum><text>in improving or
				enhancing maritime domain awareness, port security operations, or maritime
				security in collaboration with customs efforts.</text>
								</clause></subparagraph></paragraph><paragraph id="IDcf73041812a2427f8272b5a63459241d"><enum>(2)</enum><header>Conditions</header><text>The
				Secretary—</text>
							<subparagraph id="ID340ae09989c74af09d10a55e3f6483a8"><enum>(A)</enum><text>shall provide the
				assistance described in paragraph (1) based upon an assessment of the risks to
				the security of the United States and the inability of the owner or operator of
				the port or facility to meet or exceed the standards established by regulations
				pursuant to section 70108;</text>
							</subparagraph><subparagraph id="ID8e562f0f6e4e416da28248aeb6411a1d"><enum>(B)</enum><text>may not provide
				such assistance unless the port or facility has been subjected to a
				comprehensive port security assessment by the Coast Guard to validate foreign
				port or facility compliance with International Ship and Port Facility Security
				Code standards pursuant to section 70108; and</text>
							</subparagraph><subparagraph id="ID29391e2a51224775b998c9cddad4424b"><enum>(C)</enum><text>may not lend,
				lease, or otherwise provide equipment unless the Secretary has determined that
				such equipment is not required by the Coast Guard for the performance of its
				missions.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID4c27d66384a94ef388b33598cd678e6c"><enum>(b)</enum><header>Safety and
			 security assistance for foreign ports and facilities</header><text>Section
			 70110(e)(1) of title 46, United States Code, is amended by striking the second
			 sentence and inserting the following: <quote>The Secretary shall establish a
			 program to utilize the assistance programs that are most capable of
			 implementing port security antiterrorism measures at ports and facilities in
			 foreign countries and territories of the United States that pose unique
			 security and safety threats to the United States.</quote>.</text>
			</subsection><subsection id="IDd7a6ecd8e9964ec196933f9c926f1154"><enum>(c)</enum><header>Conforming
			 amendments</header><text>Section 70110 of title 46, United States Code, is
			 amended—</text>
				<paragraph id="ID0923238df2b540179757d88aa8e8c855"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="ID467044e60d00458e86682184264c1ed1"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by inserting <quote>or facility</quote> after
			 <quote>port</quote>; and</text>
					</subparagraph><subparagraph id="ID401a8a16a4fc42d1a37cab3a36b13557"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
