		<section changed="deleted" committee-id="SLIA00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Pick-Sloan Tribal Commission Act of
			 2010</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SLIA00" id="id3E506115E6A84A04A30B7EE04A4B281E" reported-display-style="strikethrough"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="HF09C7438A58742668930F8296028FF00"><enum>(1)</enum><text>the Pick-Sloan
			 Missouri River Basin Program (known as the <quote>Pick-Sloan Program</quote>)
			 authorized by section 9 of the Act of December 22, 1944 (commonly known as the
			 <quote>Flood Control Act of 1944</quote>) (58 Stat. 891), was approved—</text>
				<subparagraph id="idE0D2A940A53949B1B877B29F9EAD4316"><enum>(A)</enum><text>to promote the
			 general economic development of the United States;</text>
				</subparagraph><subparagraph id="ID89e1f450aca443ac801b375e3c87e8ec"><enum>(B)</enum><text>to provide for
			 irrigation above Sioux City, Iowa;</text>
				</subparagraph><subparagraph id="ID6d685065b58d4e3aa1df4a9393b2bc0a"><enum>(C)</enum><text>to protect urban
			 and rural areas from devastating floods of the Missouri River; and</text>
				</subparagraph><subparagraph id="ID97fa89034e3f4ecda8260803871ba5c8"><enum>(D)</enum><text>for other
			 purposes;</text>
				</subparagraph></paragraph><paragraph id="ID426073f05d734697afaa08308bfbe18b"><enum>(2)</enum><text>the United States
			 acquired 1,422,000 acres of land in the States of North Dakota, South Dakota,
			 and Nebraska for—</text>
				<subparagraph id="id39F5F8F21CDF40869394D9B64E60615B"><enum>(A)</enum><text>the building of
			 mainstem Missouri River dams at Garrison, Oahe, Big Bend, Fort Randall, and
			 Gavin’s Point; and</text>
				</subparagraph><subparagraph id="id2665D9D5D4504342A7445DC211F8E9E1"><enum>(B)</enum><text>the creation of
			 reservoirs behind the dams named Lake Sakakawea, Lake Oahe, Lake Sharpe, Lake
			 Francis Case, and Lake Gavin, respectively;</text>
				</subparagraph></paragraph><paragraph id="IDbcf65712e6524241bef7a28b535fe567"><enum>(3)</enum><text>the construction
			 of the dams and creation of the reservoirs described in paragraph (2) included
			 the taking of title to land located on the reservations of 7 Indian tribes (but
			 did not diminish the reservations), including the taking of—</text>
				<subparagraph id="ID2ba51a6c03e84314953ed55f3c69da0a"><enum>(A)</enum><text>156,000 acres from
			 the Fort Berthold reservation;</text>
				</subparagraph><subparagraph id="ID8358ea8b8a254d51a510a7a3b024bb21"><enum>(B)</enum><text>55,994 acres from
			 the Standing Rock reservation;</text>
				</subparagraph><subparagraph id="IDae6584f02d8d4a9097746ae5794a022a"><enum>(C)</enum><text>104,420 acres from
			 the Cheyenne River reservation;</text>
				</subparagraph><subparagraph id="ID9304024efb3a49809a77e58779f31cf2"><enum>(D)</enum><text>22,955 acres from
			 the Lower Brule reservation;</text>
				</subparagraph><subparagraph id="ID0a0562dd7eca472b805808aeec926627"><enum>(E)</enum><text>15,565 acres from
			 the Crow Creek reservation;</text>
				</subparagraph><subparagraph id="ID6d0790ce40804a7490427b0f5f810111"><enum>(F)</enum><text>3,252 acres from
			 the Yankton reservation; and</text>
				</subparagraph><subparagraph id="IDb42e684b07c24b75a710656b54085b5d"><enum>(G)</enum><text>1,703 acres from
			 the Santee reservation;</text>
				</subparagraph></paragraph><paragraph id="ID0d4e45ff4f734186bf4b591074b3aa83"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id2B53F258745D4DDD9874E0C11301DC86"><enum>(A)</enum><text>the water impounded by
			 the Garrison, Oahe, Big Bend, Fort Randall, and Gavin’s Point projects of the
			 Pick-Sloan Program flooded the most fertile and wooded bottom land of the 7
			 Indian tribes referred to in paragraph (3) along the Missouri River;</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id9CA80100C65140BD9741A4D918CAADE2" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>that land
			 constituted the most productive agricultural, hunting, and collecting land of
			 those Indian tribes; and</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id5E18E87D5C1F4D8D9A69B63CC01D5D37" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>the majority of
			 the community infrastructure of each tribe was also located on the land;</text>
				</subparagraph></paragraph><paragraph id="HDC8FEC2515C644D695A3EC3BF1C7FEF5"><enum>(5)</enum><text>the flooding of
			 the productive land described in paragraph (4) greatly damaged the economy and
			 cultural resources of the 7 Indian tribes;</text>
			</paragraph><paragraph id="IDd26af4a1f57b4e7fbe2039fa0064d8bd"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDEF9916C241D4F4F9022F593A38B7007"><enum>(A)</enum><text>although those Indian
			 tribes reside on the Missouri River, the economic benefits of the Pick-Sloan
			 Program have not been passed on to the affected Indian tribes; rather</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="idA1CD17E97E734163B1E94C715A25E8E0" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>the operation of
			 the dams creates disproportionate hardships for the Indian tribes,
			 including—</text>
					<clause id="IDe9005f91ab194f4fb865bcfcea998f85"><enum>(i)</enum><text>poor water
			 quality;</text>
					</clause><clause id="IDd92ade9a40ee4f0a867c92e48e83005c"><enum>(ii)</enum><text>increased
			 trespassing and theft or damage to cultural resources;</text>
					</clause><clause id="ID857b64750353455a91a87e88ce0bff34"><enum>(iii)</enum><text>artificial
			 sediment deposits that impact water infrastructure and contain unknown
			 contaminants;</text>
					</clause><clause id="IDb1e89039122c412b8d31ddf7fe2a2690"><enum>(iv)</enum><text>harming
			 fisheries, including loss of reservoir retention time;</text>
					</clause><clause id="IDa0cb68b49fba46efaaffa3ca89ae2bab"><enum>(v)</enum><text>damage to riparian
			 habitat; and</text>
					</clause><clause id="ID269119e6c4ff48da9d3e8470de105cba"><enum>(vi)</enum><text>increased
			 recreational traffic and impacts, but with few opportunities to regulate or
			 benefit from recreational uses;</text>
					</clause></subparagraph></paragraph><paragraph id="IDe87253e221d341c4b6e8648a5a41af39"><enum>(7)</enum><text>Congress held a
			 number of hearings and promoted studies of the impacts to those tribes,
			 pursuant to which representatives of the tribes testified on impacts to tribal
			 economies, health, and welfare from the flooding of that land;</text>
			</paragraph><paragraph id="IDd403eac67c834f489f3591eb3f37e576"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5F450BDD93AE4D4E99DF8A8D999CD536"><enum>(A)</enum><text>Congress has
			 established prior commissions to study and make recommendations regarding
			 impacts of the Pick-Sloan Program, including the Garrison Diversion Unit
			 Commission established under section 207(c)(1) of the Energy and Water
			 Development Appropriation Act, 1985 (Public Law 98–360; 98 Stat. 411), which
			 recommended that a Joint Tribal Advisory Committee be formed to examine and
			 make recommendations with respect to the effects of the impoundment of water
			 behind the Garrison and Oahe Dams;</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id8C27E36D1E964E2E94B449F128A55CB5" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>the Joint Tribal
			 Advisory Committee was established by the Secretary of the Interior on May 10,
			 1985, for the purpose of assessing the impacts of the Garrison and Oahe Dams on
			 the Three Affiliated Tribes and the Standing Rock Sioux Tribe;</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id743BA1B164224BF3A30F3FA6575581E9" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>the Committee
			 delivered a final report to the Secretary on May 23, 1986;</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id16B7C02A980A44228B8693C7AE8DD3AA" indent="up1" reported-display-style="strikethrough"><enum>(D)</enum><text>in 1992, Congress
			 passed the Three Affiliated Tribes and Standing Rock Sioux Tribe Equitable
			 Compensation Act (title XXXV of Public Law 102–575; 106 Stat. 4731) to address
			 certain findings of the Committee; and</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="idA4967DF94A264BF49544655E249E023F" indent="up1" reported-display-style="strikethrough"><enum>(E)</enum><text>a number of the
			 findings of the Committee still have not been addressed as of the date of
			 enactment of this Act;</text>
				</subparagraph></paragraph><paragraph id="id768FD43152F049B28E08C7C4C103BFCC"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id501AC6F228F34B89A879F450524517F2"><enum>(A)</enum><text>before the date of
			 enactment of this Act, Congress provided compensation to the 7 affected Indian
			 tribes for the land taken from the tribes over a 55-year period;</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="id2E861EF25D6348D694FC386D11265F25" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>on 17 different
			 occasions, as part of 14 different Acts of Congress, compensation was
			 authorized for the 7 affected Indian tribes; and</text>
				</subparagraph><subparagraph changed="deleted" committee-id="SLIA00" id="idF86C6A63EC82400A80F5CBB91C2E66F1" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>1 tribe also
			 received compensation through a court case; and</text>
				</subparagraph></paragraph><paragraph id="ID916211fead174d799ab7348adaa34cec"><enum>(10)</enum><text>a single
			 comprehensive bill is needed to resolve and finally settle the claims of the
			 affected Indian tribes because past compensation—</text>
				<subparagraph id="IDc29f9d4604be45df853ca12742503d2c"><enum>(A)</enum><text>was provided at
			 different levels and based on different compensation methods, depending on the
			 historical time period during which the compensation was provided; and</text>
				</subparagraph><subparagraph id="idACC5FD7DE0514113B35EA687347F8E93"><enum>(B)</enum><text>resulted in each
			 of the 7 Indian tribes being compensated differently.</text>
				</subparagraph></paragraph></section><section changed="deleted" committee-id="SLIA00" id="idEE8341E69E3A42B8A5A91B91D329BDB2" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDb580696ba1134dc59a18b69a82af1bed"><enum>(1)</enum><header>Affected Indian
			 tribe</header><text>The term <term>affected Indian tribe</term> means any
			 of—</text>
				<subparagraph id="id64FD1FC7CAF540E3B416B05A4B84B3A5"><enum>(A)</enum><text>the Cheyenne River
			 Sioux Tribe;</text>
				</subparagraph><subparagraph id="id3F19A11B40304709A11F8B938D89EBD3"><enum>(B)</enum><text>the Crow Creek
			 Sioux Tribe;</text>
				</subparagraph><subparagraph id="idD51841F04C7F4283A4DB9D823EA08092"><enum>(C)</enum><text>the Lower Brule
			 Sioux Tribe;</text>
				</subparagraph><subparagraph id="id7735AABD0E0F4152B3BA33277054DFEC"><enum>(D)</enum><text>the Santee Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="idD9F758E5172B4C84AC7ED0788F25437A"><enum>(E)</enum><text>the Standing Rock
			 Sioux Tribe;</text>
				</subparagraph><subparagraph id="IDe1c5bc3b94e24993bcd6517242946261"><enum>(F)</enum><text>the Three
			 Affiliated Tribes; and</text>
				</subparagraph><subparagraph id="id52F487062B6942BBB9F53BE3B243323D"><enum>(G)</enum><text>the Yankton Sioux
			 Tribe.</text>
				</subparagraph></paragraph><paragraph id="id02DB0CB32C8247369744739B754CF8CD"><enum>(2)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Pick-Sloan Tribal Commission for
			 Comprehensive Resolution established by section 4(a)(1).</text>
			</paragraph><paragraph id="id4DB98EA48268402D9E894C69B13C87A6"><enum>(3)</enum><header>Pick-Sloan
			 Program</header><text>The term <term>Pick-Sloan Program</term> means the
			 Pick-Sloan Missouri River Basin Program authorized by section 9 of the Act of
			 December 22, 1944 (commonly known as the <quote>Flood Control Act of
			 1944</quote>) (58 Stat. 891).</text>
			</paragraph></section><section changed="deleted" committee-id="SLIA00" id="ID522301C657484C14A8409FAC789E3C2B" reported-display-style="strikethrough"><enum>4.</enum><header>Pick-Sloan Tribal
			 Commission for Comprehensive Resolution</header>
			<subsection id="IDFF26917619E146A894A6DDD0521C8CC3"><enum>(a)</enum><header>Establishment of
			 Commission</header>
				<paragraph id="id21AF3394758649419A2E8FFB1C632D0A"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>Pick-Sloan Tribal
			 Commission for Comprehensive Resolution</quote>.</text>
				</paragraph><paragraph id="IDE66DED6B9FD448588D810E13AEF3D4FD"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="id1CBFC5B2192749229A39120AC60A772F"><enum>(A)</enum><header>In
			 general</header><text>The Commission shall be composed of 7 members, of
			 whom—</text>
						<clause id="idA04AECE33B444078BFA3CC9D7838D13A"><enum>(i)</enum><text>1 shall be the
			 Chairperson of the Commission;</text>
						</clause><clause id="id49D134A684154751B9D5E6680E44F2D6"><enum>(ii)</enum><text>at least 1 shall
			 have expertise in the field of Indian law and policy;</text>
						</clause><clause id="idA34451363C244F83BC9B50B6E14BA013"><enum>(iii)</enum><text>at least 1 shall
			 have expertise in the operation and history of Federal water projects;</text>
						</clause><clause id="IDc1b8db6625bf4314a1d83492e7132709"><enum>(iv)</enum><text>1 shall have
			 expertise in the area of environmental justice;</text>
						</clause><clause id="IDa5c5809c8f0a4a2facb160a83ec9db9c"><enum>(v)</enum><text>1 shall be an
			 economist; and</text>
						</clause><clause id="IDb99e6e6d6ccd482db82ca25bf15171d1"><enum>(vi)</enum><text>at least 1 shall
			 be an authority in cultural preservation.</text>
						</clause></subparagraph><subparagraph id="IDc48339e0adca45b1bf9f944d19c86b4a"><enum>(B)</enum><header>Tribal
			 membership</header><text>Of the 7 members selected for the Commission, at least
			 3 shall be members of federally recognized Indian tribes.</text>
					</subparagraph><subparagraph id="IDfde187cdd36c41b3bb6734cdee496ad9"><enum>(C)</enum><header>Selection of
			 Commission</header>
						<clause id="id321DDA64FB6444A4BB2E911177885770"><enum>(i)</enum><header>In
			 general</header><text>The Chairperson and Vice Chairperson of the Committee on
			 Indian Affairs of the Senate and the Chairperson and Ranking Member of the
			 Committee on Natural Resources of the House of Representatives shall—</text>
							<subclause id="idB6D2B55D67004386ACBDD794E2967216"><enum>(I)</enum><text>select the 7
			 Commission members; and</text>
							</subclause><subclause id="id3FBA6C6F2D8A40969589AA153F9C89EF"><enum>(II)</enum><text>appoint 1 of the
			 members to serve as Chairperson of the Commission.</text>
							</subclause></clause><clause id="idA63901689A874418B3B40FA6555E0E71"><enum>(ii)</enum><header>Recommendations</header><text>The
			 affected Indian tribes may make recommendations to the Chairperson of the
			 Committee on Indian Affairs of the Senate and the Chairperson of the Committee
			 on Natural Resources of the House of Representatives regarding members of the
			 Commission.</text>
						</clause></subparagraph><subparagraph id="ID7e306ec2f7664cbea80c9fe33a07282b"><enum>(D)</enum><header>Deadline for
			 appointment</header><text>All members of the Commission shall be appointed not
			 later than 60 days after the date of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="ID3273B8FC42DA4116888CF5C5B78C3EE2"><enum>(3)</enum><header>Term;
			 vacancies</header>
					<subparagraph id="IDB24D11E1E20D4B2395171A2E56662091"><enum>(A)</enum><header>Term</header><text>A
			 member shall be appointed for the life of the Commission.</text>
					</subparagraph><subparagraph id="IDF9EBBD586A6D43A2814C9D7D8FAF76A8"><enum>(B)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission—</text>
						<clause id="IDA9631872155B4CE58B499962B1D0217B"><enum>(i)</enum><text>shall not affect
			 the powers of the Commission; and</text>
						</clause><clause id="ID22AE9E5E9568490B908023D1C2BCBD2E"><enum>(ii)</enum><text>shall be filled
			 in the same manner as the original appointment was made.</text>
						</clause></subparagraph></paragraph><paragraph id="IDED55AC0EF5C749C293B8CB5FAD68FE4C"><enum>(4)</enum><header>Initial
			 meeting</header><text>Not later than 30 days after the date on which all
			 members of the Commission have been appointed, the Commission shall hold the
			 initial meeting of the Commission.</text>
				</paragraph><paragraph id="IDD209FD1ED0F9443ABD8B94A9D757B60B"><enum>(5)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of the Chairperson.</text>
				</paragraph><paragraph id="IDFA8C485DEF7E44919228ECD7C7403119"><enum>(6)</enum><header>Quorum</header><text>A
			 majority of the members of the Commission shall constitute a quorum, but a
			 lesser number of members may hold hearings.</text>
				</paragraph><paragraph id="id63F0B06F94294E358F4D46F13097A739"><enum>(7)</enum><header>Nonapplicability
			 of FACA</header><text>The <act-name parsable-cite="FACA">Federal Advisory
			 Committee Act</act-name> (5 U.S.C. App.) shall not apply to the
			 Commission.</text>
				</paragraph></subsection><subsection id="IDB7C043BB83214712B28C0E9FD1A77847"><enum>(b)</enum><header>Duties</header>
				<paragraph id="ID28ABCDCE8A0F46EC8107C8B841C9DFCD"><enum>(1)</enum><header>In
			 general</header><text>In carrying out this section, the Commission shall
			 consult with the affected Indian tribes.</text>
				</paragraph><paragraph id="idA516044FEA754B9DB6DDF9DCF8EC6F77"><enum>(2)</enum><header>Study</header><text>The
			 Commission shall conduct a study of—</text>
					<subparagraph id="idA78476F7FEC84E618A113A21372C2D7B"><enum>(A)</enum><text>with respect to
			 the period beginning on the date of commencement of the Pick-Sloan Program and
			 ending on the date on which the study is initiated—</text>
						<clause id="idCC1137DCEC384DDEA39788077F0AF1C1"><enum>(i)</enum><text>the impacts on the
			 affected Indian tribes, directly or indirectly, caused by the Pick-Sloan
			 Program; and</text>
						</clause><clause id="id54E20FFF9AAB4F9AA77AAFFFA3D12A6F"><enum>(ii)</enum><text>measures
			 implemented by the Federal Government to attempt to address those
			 impacts;</text>
						</clause></subparagraph><subparagraph id="idE6769608956248C9A19B9DF3216EA0AD"><enum>(B)</enum><text>other measures
			 that have been proposed to address the impacts on the affected Indian tribes
			 caused by the Pick-Sloan Program;</text>
					</subparagraph><subparagraph id="id935D350F1F2B4BF79889047AF0AA68C4"><enum>(C)</enum><text>the results of any
			 other studies regarding those impacts and potential solutions to the impacts,
			 including any studies conducted by the Joint Tribal Advisory Committee relating
			 to the Pick-Sloan Program; and</text>
					</subparagraph><subparagraph id="ID3f252d80e1694363a379101fcf81e3d1"><enum>(D)</enum><text>comparisons
			 involving other situations in which Federal hydroelectric projects or federally
			 licensed hydroelectric projects have resulted in the taking or occupation of
			 Indian land and the compensation, or other measures, Indian tribes have been or
			 are being provided in those situations.</text>
					</subparagraph></paragraph><paragraph id="ID032ae48f9f9d4ed8b7ff2991a6a6df51"><enum>(3)</enum><header>Hearings</header>
					<subparagraph id="idFB202E9681034EF7811B844526CCDBAB"><enum>(A)</enum><header>In
			 general</header><text>In carrying out paragraph (2), the Commission shall hold
			 at least 3 hearings to receive information from Federal agencies, Indian
			 tribes, and other interested parties regarding the resolution of Pick-Sloan
			 Program impacts.</text>
					</subparagraph><subparagraph id="ID6ef5ae27c34e496fa1ce507059ca616f"><enum>(B)</enum><header>Public
			 participation</header><text>A hearing under this paragraph shall be open to the
			 public.</text>
					</subparagraph><subparagraph id="ID0625890bec0f46fbb4ff8e66f2833832"><enum>(C)</enum><header>Records</header><text>For
			 each hearing under this paragraph, the Commission shall—</text>
						<clause id="id31B2327C38774BA2B7100CD84F6BEF6E"><enum>(i)</enum><text>compile a record
			 consisting of transcripts, written testimony, studies, and other information
			 presented at the hearing; and</text>
						</clause><clause id="ID757b9eb9c1494373ad580765513149e3"><enum>(ii)</enum><text>include the
			 record in the report of the Commission required under paragraph (5), as an
			 appendix in electronic format.</text>
						</clause></subparagraph></paragraph><paragraph id="idB5F9CC465FDD436C9C9E89048E1CBDB0"><enum>(4)</enum><header>Comprehensive
			 resolution</header>
					<subparagraph id="id769A0687B2D949C0B168DDA4098A4428"><enum>(A)</enum><header>In
			 general</header><text>Based on the results of the study under paragraph (2),
			 and hearings under paragraph (3), the Commission shall develop a proposal to
			 comprehensively resolve the impacts to the affected Indian tribes resulting
			 from the Pick-Sloan Program.</text>
					</subparagraph><subparagraph id="idAFD6036FBCEF48AA94653AE6C0761F18"><enum>(B)</enum><header>Inclusions</header><text>The
			 proposal under subparagraph (A) shall include—</text>
						<clause id="ID51750e1bda624b3ba463300d921480ee"><enum>(i)</enum><text>a comprehensive
			 proposal for a program to provide full and final compensation to the affected
			 Indian tribes;</text>
						</clause><clause id="idEA1744AA1D9A4388A73565DDC438FCC8"><enum>(ii)</enum><text>a description of
			 the measures referred to in paragraph (2) that—</text>
							<subclause id="id296A6C49C1584F84951C261E997E5C55"><enum>(I)</enum><text>have not been
			 implemented;</text>
							</subclause><subclause id="id31674FBD3BA042BEA9E6466576E19B5F"><enum>(II)</enum><text>could be
			 implemented; or</text>
							</subclause><subclause id="id36E567E96CFD44EEB8900E3AD1D9A6A3"><enum>(III)</enum><text>should be
			 implemented in a more effective manner;</text>
							</subclause></clause><clause id="idFCC3C8064BBE46A5AF699A1A39D10240"><enum>(iii)</enum><text>relevant
			 measures that could be accomplished administratively;</text>
						</clause><clause id="idA6F685282B3C43C3BF4B0363FA00F899"><enum>(iv)</enum><text>relevant measures
			 that would require legislation to be implemented; and</text>
						</clause><clause id="id355DC77970B347F4A80E2D1C0D36EEA4"><enum>(v)</enum><text>any other measures
			 necessary to comprehensively resolve the impacts of the Pick-Sloan Program on
			 the affected Indian tribes.</text>
						</clause></subparagraph></paragraph><paragraph id="ID7D240A7538A64ACD9B6004A70C5C8C19"><enum>(5)</enum><header>Report</header>
					<subparagraph id="idE3841D9990E94166B725D015838BF391"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), not later than 18 months
			 after the date on which the first meeting of the Commission takes place, the
			 Commission shall submit to the President and Congress a report that
			 contains—</text>
						<clause id="IDEA7E4F851EB14AF1AA932D540CE1EE33"><enum>(i)</enum><text>a detailed
			 statement of the study findings and conclusions of the Commission; and</text>
						</clause><clause id="ID3ADFC9E9908547549EE8AC7CAB05C161"><enum>(ii)</enum><text>the proposal of
			 the Commission for such legislation and administrative actions as the
			 Commission considers to be appropriate to resolve the impacts on the affected
			 Indian tribes caused by the Pick-Sloan Program.</text>
						</clause></subparagraph><subparagraph id="id6CA9437F29664A2DBD27A1832663E885"><enum>(B)</enum><header>Extension</header><text>The
			 deadline described in subparagraph (A) may be extended for a period of not more
			 than 180 days if the Commission submits to the Committee on Indian Affairs of
			 the Senate and the Committee on Natural Resources of the House of
			 Representatives a request for the extension that—</text>
						<clause id="id357613ED413541699FB3955B82FF0A05"><enum>(i)</enum><text>is received by the
			 Committees before the deadline described in subparagraph (A); and</text>
						</clause><clause id="id97AD4274B6524F4AB767B39BA717BEE9"><enum>(ii)</enum><text>includes a
			 description of the reasons why the extension is needed.</text>
						</clause></subparagraph></paragraph><paragraph id="ID2150c32c25374eb09e75f2d90757fb7c"><enum>(6)</enum><header>Website</header>
					<subparagraph id="id7558F87C274F42B5A6D8A4ACCC34200C"><enum>(A)</enum><header>In
			 general</header><text>The Commission shall maintain a website for the period
			 beginning on the date on which the first meeting of the Commission takes place
			 and ending on the date that is 180 days after the date of termination of the
			 Commission.</text>
					</subparagraph><subparagraph id="IDc1816bdc473c4d6ea7f37bedac400683"><enum>(B)</enum><header>Requirements</header><text>The
			 Commission shall use the website—</text>
						<clause id="id70FDB81C722A483FA41BC5960BEAE4AD"><enum>(i)</enum><text>to describe the
			 activities of the Commission;</text>
						</clause><clause id="idE2F6B647FE024F26A8D057216857B61B"><enum>(ii)</enum><text>to provide access
			 to information studied by the Commission;</text>
						</clause><clause id="idB97421391579486B80028D6263A51461"><enum>(iii)</enum><text>to provide
			 notice of, and make available all information presented at, hearings of the
			 Commission; and</text>
						</clause><clause id="ID0beac50da58a44f8930d69f9454ad7dd"><enum>(iv)</enum><text>to post the
			 report (including all appendices to that report) of the Commission required
			 under paragraph (5).</text>
						</clause></subparagraph><subparagraph id="id5E66BB003980418E9043DAE88373CF6F"><enum>(C)</enum><header>Archiving of
			 website content</header><text>At the time at which the website of the
			 Commission is terminated, all content on the website shall be—</text>
						<clause id="id45BF6530B549402DBAD7F4B28904733F"><enum>(i)</enum><text>collected on
			 compact disk, digital video disk, or other appropriate digital media;
			 and</text>
						</clause><clause id="id0AD9E7AFBC2242E99EA72C8CAD7CB287"><enum>(ii)</enum><text>included in the
			 report to be submitted under paragraph (5).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDF07ACC39769C491DB68AA3328182CA9D"><enum>(c)</enum><header>Powers</header>
				<paragraph id="ID1618657E01794A3CBD30B1CA7C721E46"><enum>(1)</enum><header>Hearings</header><text>The
			 Commission may hold such hearings, meet and act at such times and places, take
			 such testimony, and receive such evidence as the Commission considers to be
			 advisable to carry out this Act.</text>
				</paragraph><paragraph id="ID9F2DFF4FD67B4848850FB6A9D5163A41"><enum>(2)</enum><header>Information from
			 Federal agencies</header>
					<subparagraph id="IDC441D234895B4B08BF9511974F6BE278"><enum>(A)</enum><header>In
			 general</header><text>The Commission may secure directly from a Federal agency
			 such information as the Commission considers to be necessary to carry out this
			 Act.</text>
					</subparagraph><subparagraph id="IDAD56F68235BE45E78F03E5540FE7301A"><enum>(B)</enum><header>Provision of
			 information</header><text>On request of the Chairperson of the Commission, the
			 head of an applicable Federal agency shall provide the information to the
			 Commission.</text>
					</subparagraph></paragraph><paragraph id="ID628DFFD3FCE443AFBBA043B8634B7263"><enum>(3)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
				</paragraph><paragraph id="IDD17FC2DA8DE9489C9C793A204115E648"><enum>(4)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
				</paragraph></subsection><subsection id="IDCF2AFC6016204C4992172D7E1050ACA9"><enum>(d)</enum><header>Commission
			 personnel matters</header>
				<paragraph id="ID40CD19C2755743E0A877328695537261"><enum>(1)</enum><header>Compensation of
			 members</header><text>Each member of the Commission shall be compensated at a
			 rate equal to the daily equivalent of the annual rate of basic pay prescribed
			 for level IV of the Executive Schedule under section 5315 of title 5, United
			 States Code, for each day (including travel time) during which the member is
			 engaged in the performance of the duties of the Commission.</text>
				</paragraph><paragraph id="ID2806C7831D624B0282FF382049442273"><enum>(2)</enum><header>Travel
			 expenses</header><text>Each member of the Commission shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for an
			 employee of an agency under subchapter I of chapter 57 of title 5, United
			 States Code, while away from the home or regular place of business of the
			 member in the performance of the duties of the Commission.</text>
				</paragraph><paragraph id="ID0C94A54F18724CA78604561BDE2A59AC"><enum>(3)</enum><header>Staff</header>
					<subparagraph id="IDE0F4CB3012E4442EBCCA7C3B0E2CB797"><enum>(A)</enum><header>In
			 general</header><text>The Chairperson of the Commission may, without regard to
			 the civil service laws (including regulations), appoint and terminate an
			 executive director and such other additional personnel as are necessary to
			 enable the Commission to perform the duties of the Commission.</text>
					</subparagraph><subparagraph id="IDE702DC947A0449AA8F55F169AFCADE1C"><enum>(B)</enum><header>Confirmation of
			 executive director</header><text>The employment of an executive director shall
			 be subject to confirmation by the Commission.</text>
					</subparagraph><subparagraph id="ID5E46BDE4566A42EB82523C89E701671B"><enum>(C)</enum><header>Compensation</header>
						<clause id="IDAA2990FA9B504AEB9E14B14852EACEDD"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Chairperson
			 of the Commission may fix the compensation of the executive director and other
			 personnel without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of title 5, United States Code, relating to classification of
			 positions and General Schedule pay rates.</text>
						</clause><clause id="ID53852F21B50A4AD49866A188D63DA634"><enum>(ii)</enum><header>Maximum rate of
			 pay</header><text>The rate of pay for the executive director and other
			 personnel shall not exceed the rate payable for level IV of the Executive
			 Schedule under section 5316 of title 5, United States Code.</text>
						</clause></subparagraph><subparagraph id="ID2B7B620D91FF4CBD8C1299B90E180B9D"><enum>(D)</enum><header>Detail of
			 Federal Government employees</header>
						<clause id="ID6494AD933D7D4EC79DB151E93E4BA5BD"><enum>(i)</enum><header>In
			 general</header><text>An employee of the Federal Government may be detailed to
			 serve as staff for the Commission without reimbursement.</text>
						</clause><clause id="ID3A4FD5B4FBB244FAA53CA36D5B4E7F64"><enum>(ii)</enum><header>Civil service
			 status</header><text>The detail of the employee shall be without interruption
			 or loss of civil service status or privilege.</text>
						</clause></subparagraph></paragraph><paragraph id="ID063a7bc92ecc4e459ab360e76396db95"><enum>(4)</enum><header>Human resources
			 support</header><text>The Commission may request the Secretary of Defense to
			 provide, and the Secretary of Defense shall provide, through human resource
			 departments under the jurisdiction of the Secretary of Defense, on a
			 reimbursable basis, operational support for activities of the
			 Commission.</text>
				</paragraph><paragraph id="IDc72df2d4003f4e77878aeaedfcfe62db"><enum>(5)</enum><header>Contract
			 authority</header><text>The Commission may, to such extent and using such
			 amounts as are provided in appropriation Acts, enter into contracts to enable
			 the Commission to discharge the duties of the Commission under this Act.</text>
				</paragraph><paragraph id="ID69106cabf38246ba918c9f79c713e7ab"><enum>(6)</enum><header>Volunteer
			 services</header><text>Notwithstanding section 1342 of title 31, United States
			 Code, the Commission may accept and use such voluntary and uncompensated
			 services as the Commission determines to be necessary.</text>
				</paragraph><paragraph id="ID0B6BBB4F11C648BBA937F2BCD7909B6C"><enum>(7)</enum><header>Procurement of
			 temporary and intermittent services</header><text>The Chairperson of the
			 Commission may procure temporary and intermittent services in accordance with
			 section 3109(b) of title 5, United States Code, at rates for individuals that
			 do not exceed the daily equivalent of the annual rate of basic pay prescribed
			 for level V of the Executive Schedule under section 5316 of that title.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE49794939934C658A910E53F75E5FB0"><enum>(e)</enum><header display-inline="yes-display-inline">Termination of Commission</header><text display-inline="yes-display-inline">The Commission shall terminate 90 days
			 after the date on which the Commission submits the report of the Commission
			 under subsection (b)(5).</text>
			</subsection></section><section changed="deleted" commented="no" committee-id="SLIA00" id="ID25A6EB519DDD44C08D519751B984DF19" reported-display-style="strikethrough"><enum>5.</enum><header>Funding</header>
			<subsection commented="no" id="idE9868A78D5464EAEBE95159BD0AA7EBE"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this Act
			 for each of fiscal years 2010 and 2011, to remain available until
			 expended.</text>
			</subsection><subsection id="ID6ce4b4f4243544c6a7b6ddde884c57a0"><enum>(b)</enum><header>Transfer of
			 funds in lieu of appropriation</header>
				<paragraph id="ID5db4e3f329ba47c9970d7a921d567ff5"><enum>(1)</enum><header>In
			 general</header><text>For any fiscal year, or at any time during a fiscal year,
			 in which insufficient amounts are available to fund activities of the
			 Commission, the Secretary of the Interior or the Secretary of the Army may
			 transfer to the Commission such unobligated amounts as are available to the
			 Secretary of the Interior or the Secretary of the Army for use by the
			 Commission in carrying out this Act.</text>
				</paragraph><paragraph id="ID8e43abcef3be4cde9b8e6366fd951901"><enum>(2)</enum><header>Availability</header><text>Amounts
			 transferred to the Commission under paragraph (1) shall remain available until
			 the earlier of—</text>
					<subparagraph id="idA9239BBFBE0948E9AE200C11981B4E0F"><enum>(A)</enum><text>the date of
			 termination of the Commission; or</text>
					</subparagraph><subparagraph id="idB3AD0C90EA1241208BDE307A5271C1C3"><enum>(B)</enum><text>the date on which
			 amounts that are sufficient to carry out this Act are made available.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SLIA00" id="id11DF6E438C1D46558656B0E5517BF354" reported-display-style="strikethrough"><enum>6.</enum><header>Savings
			 clause</header><text display-inline="no-display-inline">Nothing in this Act
			 diminishes, changes, or otherwise affects—</text>
			<paragraph id="id4B616E6284564A048C348A92805898DA"><enum>(1)</enum><text display-inline="yes-display-inline">the water rights of the affected Indian
			 tribes;</text>
			</paragraph><paragraph id="id037AC8622D904374A6F5A87693502E8F"><enum>(2)</enum><text display-inline="yes-display-inline">any other right (including treaty rights)
			 of the affected Indian tribes;</text>
			</paragraph><paragraph id="id7A083325FFFF4CCEBFC4E0CCC5735257"><enum>(3)</enum><text display-inline="yes-display-inline">the status of Indian reservation land or
			 the boundaries of any reservation of an Indian tribe; or</text>
			</paragraph><paragraph id="idE76821559CB043A8BE3EAF3B2AF004E1"><enum>(4)</enum><text display-inline="yes-display-inline">any Congressional authorization of
			 appropriations for the benefit of the affected Indian tribes.</text>
			</paragraph></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SLIA00" id="idacb592a9-2f48-485c-b2a3-e9fbb37cdb6c" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Pick-Sloan Tribal Commission Act of
			 2010</short-title></quote>.</text>
		</section><section changed="added" committee-id="SLIA00" id="id9c636a6f-1b5d-465b-a5cf-c7c6e9f681d8" reported-display-style="italic"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="id7f24d934-914c-4dab-a30c-b117b81b51eb"><enum>(1)</enum><text>the Pick-Sloan Missouri
			 River Basin Program (known as the <quote>Pick-Sloan Program</quote>) authorized
			 by section 9 of the Act of December 22, 1944 (commonly known as the
			 <quote>Flood Control Act of 1944</quote>) (58 Stat. 891), was approved—</text>
				<subparagraph id="idd7a180a9-7f3c-4f86-85b1-f8c7c0580b6a"><enum>(A)</enum><text>to promote the general
			 economic development of the United States;</text>
				</subparagraph><subparagraph id="id188500d4-c392-463a-a177-c5400a2f9b4b"><enum>(B)</enum><text>to provide for irrigation
			 above Sioux City, Iowa;</text>
				</subparagraph><subparagraph id="ida6182ff8-22af-4d6d-82a1-82f5d545ede4"><enum>(C)</enum><text>to protect urban and
			 rural areas from devastating floods of the Missouri River; and</text>
				</subparagraph><subparagraph id="id0008a73d-d464-4245-aca0-d8e96afdba7d"><enum>(D)</enum><text>for other
			 purposes;</text>
				</subparagraph></paragraph><paragraph id="ida629ab11-245e-4695-86da-8d4a346dd30d"><enum>(2)</enum><text>the United States
			 acquired approximately 1,422,000 acres of land in the States of North Dakota,
			 South Dakota, and Nebraska for—</text>
				<subparagraph id="id3c148507-ecc2-443b-ac3b-562ebe840c44"><enum>(A)</enum><text>the building of mainstem
			 Missouri River dams at Garrison, Oahe, Big Bend, Fort Randall, and Gavin’s
			 Point; and</text>
				</subparagraph><subparagraph id="idda05dfd2-6060-4482-b925-cc2cc5790ee5"><enum>(B)</enum><text>the creation of
			 reservoirs behind the dams named Lake Sakakawea, Lake Oahe, Lake Sharpe, Lake
			 Francis Case, and Lewis and Clark Lake, respectively;</text>
				</subparagraph></paragraph><paragraph id="id64829ee4-ae43-43cb-a054-0108b76bd25c"><enum>(3)</enum><text>the construction of the
			 dams and creation of the reservoirs described in paragraph (2) included the
			 taking of title to land located on the reservations of 7 Indian tribes (but did
			 not diminish the reservations), including the taking of approximately—</text>
				<subparagraph id="idb6b9d71b-e5c1-47ea-a4c3-7912e0380266"><enum>(A)</enum><text>156,000 acres from the
			 Fort Berthold Reservation;</text>
				</subparagraph><subparagraph id="id6f19bc1b-483b-4cad-a37a-69839d3fcfba"><enum>(B)</enum><text>55,994 acres from the
			 Standing Rock Sioux Reservation;</text>
				</subparagraph><subparagraph id="idfb3a21ea-ccca-4040-b351-6aa9e657823d"><enum>(C)</enum><text>104,420 acres from the
			 Cheyenne River Sioux Reservation;</text>
				</subparagraph><subparagraph id="id7f24134c-3b25-45a8-a8b7-089c3be5144a"><enum>(D)</enum><text>22,955 acres from the
			 Lower Brule Sioux Reservation;</text>
				</subparagraph><subparagraph id="id5fb5ea5d-6c54-41d2-975f-13d05a3d049c"><enum>(E)</enum><text>15,565 acres from the
			 Crow Creek Sioux Reservation;</text>
				</subparagraph><subparagraph id="idcad80e47-ccfa-4d09-9b04-b5f34e44cb26"><enum>(F)</enum><text>3,252 acres from the
			 Yankton Sioux Reservation; and</text>
				</subparagraph><subparagraph id="id6b6a942c-7028-4797-8a51-041b10d0f631"><enum>(G)</enum><text>1,007 acres from the
			 Santee Sioux Reservation;</text>
				</subparagraph></paragraph><paragraph id="id502e55d7-9801-4c5b-9b8d-eec397794dc8"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id88fc6f3b-483d-45d4-8adf-c2c6583de1ee"><enum>(A)</enum><text>the water impounded
			 by the Garrison, Oahe, Big Bend, Fort Randall, and Gavin’s Point dams of the
			 Pick-Sloan Program flooded the most fertile and wooded bottom land of the 7
			 Indian tribes and reservations referred to in paragraph (3) along the Missouri
			 River;</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id84b02dd7-5c14-4279-9d0c-645727d11e52" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>that land constituted the
			 most productive agricultural, hunting, and collecting land of those Indian
			 tribes; and</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id4eb2c789-0427-45e6-9e3d-a90b29748f21" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>the majority of the
			 community infrastructure of each Indian tribe was also located on the
			 land;</text>
				</subparagraph></paragraph><paragraph id="id9a85bdd9-75ed-45b8-9054-a9d86f776904"><enum>(5)</enum><text>the flooding of the
			 productive land described in paragraph (4) greatly damaged the economy and
			 cultural resources of the 7 Indian tribes;</text>
			</paragraph><paragraph id="id8bd343a9-fcf0-4277-888f-8e2d021f9b71"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id53b3e78b-743f-48cd-a5fe-b794e5d1919d"><enum>(A)</enum><text>although the 7
			 Indian tribes reside on the Missouri River, the economic benefits of the
			 Pick-Sloan Program have not been passed on to those Indian tribes;
			 rather</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id9d7fc352-6d64-417f-9d1f-8fcaebbb7af4" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the operation of the dams
			 creates disproportionate hardships for the 7 Indian tribes, including—</text>
					<clause id="id20dd6204-ee28-4b5b-930a-39a233c981ab"><enum>(i)</enum><text>poor water
			 quality;</text>
					</clause><clause id="idae888343-472c-4a43-b8af-1af9dd308a22"><enum>(ii)</enum><text>increased trespassing
			 and theft or damage to cultural resources;</text>
					</clause><clause id="id4260ddc8-2b1c-4e00-9d38-66bcfc0ac6fa"><enum>(iii)</enum><text>artificial sediment
			 deposits that impact water infrastructure and contain unknown
			 contaminants;</text>
					</clause><clause id="idc35a35b8-dc19-43cb-acd9-e672061bbe98"><enum>(iv)</enum><text>harming fisheries,
			 including loss of reservoir retention time;</text>
					</clause><clause id="idd1ae1ec9-04cd-4642-95d0-d96ddfa7b7e4"><enum>(v)</enum><text>damage to riparian
			 habitat; and</text>
					</clause><clause id="id90e78913-a85e-4238-9aff-a7469083a47d"><enum>(vi)</enum><text>increased recreational
			 traffic and impacts, but with few opportunities to regulate or benefit from
			 recreational uses;</text>
					</clause></subparagraph></paragraph><paragraph id="id008186b4-61b8-46f7-8d72-75dd99f45fd0"><enum>(7)</enum><text>Congress held a number of
			 hearings and promoted studies of the impacts to the 7 Indian tribes, pursuant
			 to which representatives of the 7 Indian tribes testified on impacts to tribal
			 economies, health, and welfare from the flooding of that land;</text>
			</paragraph><paragraph id="idc6f131a1-9690-4601-b2c7-d54c1db67132"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id12ee00bf-b303-4c38-a9af-34e4c5727db6"><enum>(A)</enum><text>Congress has
			 established prior commissions to study and make recommendations regarding
			 impacts of the Pick-Sloan Program, including the Garrison Diversion Unit
			 Commission established under section 207(c)(1) of the Energy and Water
			 Development Appropriation Act, 1985 (Public Law 98–360; 98 Stat. 411), which
			 recommended that a Joint Tribal Advisory Committee be formed to examine and
			 make recommendations with respect to the effects of the impoundment of water
			 behind the Garrison and Oahe Dams;</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id21e88308-fb8d-42d8-a7d2-15948f688e4b" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the Joint Tribal Advisory
			 Committee was established by the Secretary of the Interior on May 10, 1985, for
			 the purpose of assessing the impacts of the Garrison and Oahe Dams on the Three
			 Affiliated Tribes and the Standing Rock Sioux Tribe;</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id51243740-58d9-4afc-a459-6ec9820c7265" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>the Committee delivered a
			 final report to the Secretary on May 23, 1986;</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id88778d47-f84c-4dff-80b6-c1562474f5c5" indent="up1" reported-display-style="italic"><enum>(D)</enum><text>in 1992, Congress passed
			 the Three Affiliated Tribes and Standing Rock Sioux Tribe Equitable
			 Compensation Act (title XXXV of Public Law 102–575; 106 Stat. 4731) to address
			 certain findings of the Committee; and</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id0a8bf21a-8f6f-41c7-946b-c7d175fb73f6" indent="up1" reported-display-style="italic"><enum>(E)</enum><text>a number of the findings
			 of the Committee still have not been addressed as of the date of enactment of
			 this Act;</text>
				</subparagraph></paragraph><paragraph id="idccbe8b2b-6a0f-4c08-af12-c617c72f8f89"><enum>(9)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id133a0a2d-6945-4cea-8657-94d71da302a1"><enum>(A)</enum><text>before the date of
			 enactment of this Act, Congress provided compensation to the 7 Indian tribes
			 for the land taken from the 7 Indian tribes over a 55-year period;</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id5d82fa92-eea7-4902-b9d2-79b6ddf1085b" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>on 17 different
			 occasions, as part of 14 different Acts of Congress, compensation was
			 authorized for the 7 Indian tribes; and</text>
				</subparagraph><subparagraph changed="added" committee-id="SLIA00" id="id5d3b534a-6af7-4398-b1a9-44256cea2f3e" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>at least 1 of the 7
			 Indian tribes also received compensation through a court case; and</text>
				</subparagraph></paragraph><paragraph id="idcaa81f6f-427a-485e-a64f-d63ac9c8c464"><enum>(10)</enum><text>a single comprehensive
			 bill is needed to resolve and finally settle the claims of the 7 Indian tribes
			 because past compensation—</text>
				<subparagraph id="id31c4ecc1-983f-46fe-a0f0-c9d8d1744aaa"><enum>(A)</enum><text>was provided at different
			 levels and based on different compensation methods, depending on the historical
			 time period during which the compensation was provided; and</text>
				</subparagraph><subparagraph id="idda8b2c28-82b5-47db-8d81-5e76443c39f9"><enum>(B)</enum><text>resulted in each of the 7
			 Indian tribes being compensated differently.</text>
				</subparagraph></paragraph></section><section changed="added" committee-id="SLIA00" id="id54f5fc55-d10d-4df8-87cf-44d476a4d88b" reported-display-style="italic"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id2024422c-949d-439b-bd9f-984bd2aaa346"><enum>(1)</enum><header>Affected Indian
			 tribe</header><text>The term <term>affected Indian tribe</term> means any
			 of—</text>
				<subparagraph id="id2c6d95f2-2240-47ed-8d4c-d3ae34cc7d64"><enum>(A)</enum><text>the Cheyenne River Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="id9f4f0e5c-1fba-4c66-9d8d-4d41639074b5"><enum>(B)</enum><text>the Crow Creek Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="idc4f343e8-9579-4656-adaf-866112b94679"><enum>(C)</enum><text>the Lower Brule Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="idd89518b1-3eee-451b-8fd8-bc21fb6bece3"><enum>(D)</enum><text>the Santee Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="id0c03d848-e2ae-409f-bccc-37e7fcfd1506"><enum>(E)</enum><text>the Standing Rock Sioux
			 Tribe;</text>
				</subparagraph><subparagraph id="id5ed40dd1-63d1-489f-8c5d-5ec83e4cd8e4"><enum>(F)</enum><text>the Three Affiliated
			 Tribes; and</text>
				</subparagraph><subparagraph id="id820703b9-c12f-4eeb-b2c0-4c8c234cc14d"><enum>(G)</enum><text>the Yankton Sioux
			 Tribe.</text>
				</subparagraph></paragraph><paragraph id="id9f094e00-f8c8-4afa-bd22-f0c739f0ffe9"><enum>(2)</enum><header>Commission</header><text>The
			 term <term>Commission</term> means the Pick-Sloan Tribal Commission for
			 Comprehensive Resolution established by section 4(a)(1).</text>
			</paragraph><paragraph id="ida976d478-b982-40a3-bfea-6d228d14c0c3"><enum>(3)</enum><header>Pick-Sloan
			 Program</header><text>The term <term>Pick-Sloan Program</term> means the
			 Pick-Sloan Missouri River Basin Program authorized by section 9 of the Act of
			 December 22, 1944 (commonly known as the <quote>Flood Control Act of
			 1944</quote>) (58 Stat. 891).</text>
			</paragraph></section><section changed="added" committee-id="SLIA00" id="id745ae89c-04ab-40b0-bff2-23887bf055c2" reported-display-style="italic"><enum>4.</enum><header>Pick-Sloan Tribal
			 Commission for Comprehensive Resolution</header>
			<subsection id="ida9585998-6177-4914-939f-94ed157bcafd"><enum>(a)</enum><header>Establishment of
			 Commission</header>
				<paragraph id="id92b8db27-b3e5-4c9c-a0e3-070b7509635d"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a commission to be known as the <quote>Pick-Sloan Tribal
			 Commission for Comprehensive Resolution</quote>.</text>
				</paragraph><paragraph id="id7a030fcf-473a-4751-843a-735c0e6977f1"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="id24a4fbfe-0ef3-4678-b04d-53f0906a67c8"><enum>(A)</enum><header>In
			 general</header><text>The Commission shall be composed of 7 members, of
			 whom—</text>
						<clause id="id52abf022-101a-4596-8447-46942f26f86f"><enum>(i)</enum><text>1 shall be the
			 Chairperson of the Commission;</text>
						</clause><clause id="id9e240aae-bd5a-4d6c-bd2d-407023709215"><enum>(ii)</enum><text>at least 1 shall have
			 expertise in the field of Indian law and policy;</text>
						</clause><clause id="idc976e010-2832-4013-a9a1-ebf1a4bb515f"><enum>(iii)</enum><text>at least 1 shall have
			 expertise in the operation and history of Federal water projects;</text>
						</clause><clause id="id0801b787-473c-4547-accc-cedd57e0b7ca"><enum>(iv)</enum><text>at least 1 shall have
			 expertise in the area of environmental justice;</text>
						</clause><clause id="ide96f3b97-9464-4abc-bedb-52cea68af4cd"><enum>(v)</enum><text>at least 1 shall be an
			 economist; and</text>
						</clause><clause id="idf1b113de-509f-4be3-9392-647fe6455d3f"><enum>(vi)</enum><text>at least 1 shall be an
			 authority in cultural preservation.</text>
						</clause></subparagraph><subparagraph id="id1a35d01a-1e3a-4031-a157-c6bba212ee61"><enum>(B)</enum><header>Tribal
			 membership</header><text>Of the 7 members selected for the Commission, at least
			 3 shall be members of federally recognized Indian tribes.</text>
					</subparagraph><subparagraph id="id3648c807-1a96-408d-96b8-8986c6360b49"><enum>(C)</enum><header>Selection of
			 Commission</header>
						<clause id="idaf7b9c05-68f1-4d2c-98a0-616ec68f2407"><enum>(i)</enum><header>In
			 general</header><text>The Chairperson and Vice Chairperson of the Committee on
			 Indian Affairs of the Senate and the Chairperson and Ranking Member of the
			 Committee on Natural Resources of the House of Representatives shall—</text>
							<subclause id="id3ac2fd7f-f556-4e80-9f7c-5cec2caa4455"><enum>(I)</enum><text>select the 7 Commission
			 members; and</text>
							</subclause><subclause id="idc72eb816-1901-49a9-b8cd-76a11edc4106"><enum>(II)</enum><text>appoint 1 of the members
			 to serve as Chairperson of the Commission.</text>
							</subclause></clause><clause id="id59eb8e77-389c-4b90-a98c-6ec6c5646c21"><enum>(ii)</enum><header>Recommendations</header><text>The
			 affected Indian tribes may make recommendations to the Chairperson of the
			 Committee on Indian Affairs of the Senate and the Chairperson of the Committee
			 on Natural Resources of the House of Representatives regarding members of the
			 Commission.</text>
						</clause></subparagraph><subparagraph id="id8b69dbc5-53c1-4808-9826-e656c0c58519"><enum>(D)</enum><header>Deadline for
			 appointment</header><text>All members of the Commission shall be appointed not
			 later than 60 days after the date of enactment of this Act.</text>
					</subparagraph></paragraph><paragraph id="id1cce4f95-24f2-4bf6-80a6-24520e6a3769"><enum>(3)</enum><header>Term;
			 vacancies</header>
					<subparagraph id="id90b81000-929c-4f38-a210-98c53336c27f"><enum>(A)</enum><header>Term</header><text>A
			 member shall be appointed for the life of the Commission.</text>
					</subparagraph><subparagraph id="idcdd395b5-845f-4200-af6b-4552827b1e4a"><enum>(B)</enum><header>Vacancies</header><text>A
			 vacancy on the Commission—</text>
						<clause id="idf9c60204-ee09-4c37-85f7-3abbba889812"><enum>(i)</enum><text>shall not affect the
			 powers of the Commission; and</text>
						</clause><clause id="idaa2837bc-8817-4690-a6fd-f3f9cbbe6b87"><enum>(ii)</enum><text>shall be filled in the
			 same manner as the original appointment was made.</text>
						</clause></subparagraph></paragraph><paragraph id="id47c9108b-490e-448e-a1bb-c6f42475e966"><enum>(4)</enum><header>Initial
			 meeting</header><text>Not later than 30 days after the date on which all
			 members of the Commission have been appointed, the Commission shall hold the
			 initial meeting of the Commission.</text>
				</paragraph><paragraph id="id03276121-bb39-48f3-9f53-473c346c7905"><enum>(5)</enum><header>Meetings</header><text>The
			 Commission shall meet at the call of the Chairperson.</text>
				</paragraph><paragraph id="id19a5c0c0-5a22-4dd7-904d-21fdf1e5c671"><enum>(6)</enum><header>Quorum</header>
					<subparagraph id="id01BAACC359C64C02BAD85A513D094763"><enum>(A)</enum><header>In
			 general</header><text>A majority of the members of the Commission shall
			 constitute a quorum.</text>
					</subparagraph><subparagraph id="id5D7454B29192478C9C56B3DA58410029"><enum>(B)</enum><header>Requirement</header><text>A
			 quorum shall be necessary for the Commission to carry out any of the duties or
			 responsibilities of the Commission under this Act.</text>
					</subparagraph></paragraph><paragraph id="id2ce0ca25-d3b4-4a4a-9342-d1ededc0625e"><enum>(7)</enum><header>Rules for
			 conduct</header><text>The Commission may establish, by majority vote, rules for
			 the conduct of Commission business, in accordance with this Act and other
			 applicable law.</text>
				</paragraph><paragraph id="id633369DC86E9466EBD429866F7C9D2F8"><enum>(8)</enum><header>Nonapplicability of
			 FACA</header><text>The <act-name parsable-cite="FACA">Federal Advisory
			 Committee Act</act-name> (5 U.S.C. App.) shall not apply to the
			 Commission.</text>
				</paragraph></subsection><subsection id="idbbcf1adf-a38d-4d76-b993-084108f3d869"><enum>(b)</enum><header>Duties</header>
				<paragraph id="id0d14d999-bf53-438d-8114-8ba087f6ca68"><enum>(1)</enum><header>In
			 general</header><text>In carrying out this section, the Commission shall
			 consult with the affected Indian tribes.</text>
				</paragraph><paragraph id="ided062128-24b8-43df-bc00-2295198cd116"><enum>(2)</enum><header>Study</header><text>The
			 Commission shall conduct a study of—</text>
					<subparagraph id="idabc1fe35-4f69-48f2-bf2e-3aa21c9140fb"><enum>(A)</enum><text>with respect to the
			 period beginning on the date of commencement of the Pick-Sloan Program and
			 ending on the date on which the study is initiated—</text>
						<clause id="idb4da34a4-26d7-497c-b11c-d7806fd966dc"><enum>(i)</enum><text>the impacts on the
			 affected Indian tribes, directly or indirectly, caused by the Pick-Sloan
			 Program; and</text>
						</clause><clause id="id97a61d91-5cfe-4313-be23-f81d9c308d79"><enum>(ii)</enum><text>measures implemented by
			 the Federal Government to attempt to address those impacts;</text>
						</clause></subparagraph><subparagraph id="ided489f0a-0465-48ed-b1e0-caf20bc82805"><enum>(B)</enum><text>other measures that have
			 been proposed to address the impacts on the affected Indian tribes caused by
			 the Pick-Sloan Program;</text>
					</subparagraph><subparagraph id="ida0d50a8c-637e-49ee-983c-2cce79ed0e1c"><enum>(C)</enum><text>the results of any other
			 studies regarding those impacts and potential solutions to the impacts,
			 including any studies conducted by the Joint Tribal Advisory Committee relating
			 to the Pick-Sloan Program; and</text>
					</subparagraph><subparagraph id="id49ae917f-ee0c-44a9-95b5-32aa40734574"><enum>(D)</enum><text>comparisons involving
			 other situations in which Federal hydroelectric projects or federally licensed
			 hydroelectric projects have resulted in the taking or occupation of Indian land
			 and the compensation, or other measures, Indian tribes have been or are being
			 provided in those situations.</text>
					</subparagraph></paragraph><paragraph id="idf4a079db-57ea-4efd-8d57-0fcf0c0da178"><enum>(3)</enum><header>Member
			 landowners</header><text>The Commission may also study the impacts caused by
			 the Pick-Sloan Program to land (including land allotted under any Federal law)
			 that is—</text>
					<subparagraph id="id99443AD9C0A547A18098CD73E967E977"><enum>(A)</enum><text>owned by members of an
			 affected Indian tribe (or the heirs of those members); and</text>
					</subparagraph><subparagraph id="id5CAE706D440346C48BF49E7342063DBE"><enum>(B)</enum><text>is on the reservation of
			 the affected Indian tribe.</text>
					</subparagraph></paragraph><paragraph id="id4BD5BDC37F7D4E108B567AACDA020CAF"><enum>(4)</enum><header>Hearings</header>
					<subparagraph id="idf3be1ffa-a92e-4d73-bbc4-b333f0549ec4"><enum>(A)</enum><header>In
			 general</header><text>In carrying out paragraph (2) and, if applicable,
			 paragraph (3), the Commission shall hold at least 3 hearings to receive
			 information from Federal agencies, Indian tribes, and other interested parties
			 regarding the resolution of Pick-Sloan Program impacts.</text>
					</subparagraph><subparagraph id="id6e1aa44a-c6ad-470b-ba1e-515e3ec9c51d"><enum>(B)</enum><header>Witness
			 expenses</header>
						<clause id="id768FAF92B88D470699B336EE5F854236"><enum>(i)</enum><header>In
			 general</header><text>A witness requested to appear before the Commission shall
			 be paid the same fees and allowances as are paid to witnesses under section
			 1821 of title 28, United States Code.</text>
						</clause><clause id="idFF5DD2E438CA498286CF16401BED3CEF"><enum>(ii)</enum><header>Source of
			 funds</header><text>The per diem and mileage allowances for a witness under
			 clause (i) shall be paid from funds made available to the Commission.</text>
						</clause></subparagraph><subparagraph id="idD7F905E9BCA84458809652BD32F5C460"><enum>(C)</enum><header>Public
			 participation</header><text>A hearing under this paragraph shall be open to the
			 public.</text>
					</subparagraph><subparagraph id="id52395bec-a897-4933-b8be-7c88d9a9e95d"><enum>(D)</enum><header>Records</header><text>For
			 each hearing under this paragraph, the Commission shall—</text>
						<clause id="id448f7d8e-87f5-44f5-a37b-378ee439ef20"><enum>(i)</enum><text>compile a record
			 consisting of transcripts, written testimony, studies, and other information
			 presented at the hearing; and</text>
						</clause><clause id="id85eb86b6-2250-4bb7-b27e-c775f90743b4"><enum>(ii)</enum><text>include the record in
			 the report of the Commission required under paragraph (6), as an appendix in
			 electronic format.</text>
						</clause></subparagraph></paragraph><paragraph id="id9a6431ab-cfdb-490c-a44c-b6c5afb8eb09"><enum>(5)</enum><header>Proposal for
			 comprehensive resolution</header>
					<subparagraph id="id8bdb89b0-7ec7-4560-8abf-75ec5ac17c54"><enum>(A)</enum><header>In
			 general</header><text>Based on the results of the study under paragraph (2),
			 any study under paragraph (3), and hearings under paragraph (4), the Commission
			 shall develop a proposal to comprehensively resolve the impacts resulting from
			 the Pick-Sloan Program.</text>
					</subparagraph><subparagraph id="id233ee4ef-74fd-436d-932f-ffb081c9c394"><enum>(B)</enum><header>Contents</header>
						<clause id="id033BD85C637643F8B3E624B96C51C2E1"><enum>(i)</enum><header>In
			 general</header><text>The proposal under subparagraph (A) shall include—</text>
							<subclause id="id3ca2e5c4-33ad-4708-ae72-cb8d104daa21"><enum>(I)</enum><text>a comprehensive proposal
			 to provide full and final compensation to the affected Indian tribes;</text>
							</subclause><subclause id="idf3b0affb-b31c-463e-a543-64ec13198dd0"><enum>(II)</enum><text>a description of the
			 measures referred to in paragraph (2) that—</text>
								<item id="id26d51ca6-8868-4d0b-a0cc-0415410d0cc4"><enum>(aa)</enum><text>have not been
			 implemented;</text>
								</item><item id="id22b20e20-6163-4cb0-abaa-82299fbe8c61"><enum>(bb)</enum><text>could be implemented;
			 or</text>
								</item><item id="id22e487d2-bb5f-4316-b4d8-6e16e6ff554d"><enum>(cc)</enum><text>should be implemented in
			 a more effective manner;</text>
								</item></subclause><subclause id="id8cc99c90-4e06-4b06-81cd-5f9301ffe813"><enum>(III)</enum><text>measures that could be
			 accomplished administratively;</text>
							</subclause><subclause id="id96cf63f8-82bd-44fa-8637-fad95cab8de2"><enum>(IV)</enum><text>measures that would
			 require legislation to be implemented; and</text>
							</subclause><subclause id="id937d4bef-3968-4fac-9223-beec09b72a7b"><enum>(V)</enum><text>any other measures
			 necessary to comprehensively resolve the impacts of the Pick-Sloan Program on
			 the affected Indian tribes.</text>
							</subclause></clause><clause id="id44758FED425948DAAC1D827117B278EC"><enum>(ii)</enum><header>Member
			 landowners</header><text>The proposal under subparagraph (A) may also include
			 measures to resolve the impacts to land (including land allotted under any
			 Federal law) that is—</text>
							<subclause id="idF6CB24CCB07F4CFEB6DB474B20FEAF6E"><enum>(I)</enum><text>owned by members of an
			 affected Indian tribe (or the heirs of those members); and</text>
							</subclause><subclause id="id3CA852ACA99040F19295C27461E2162E"><enum>(II)</enum><text>is on the reservation of
			 the affected Indian tribe.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="id67a04760-04c1-4955-9db0-34b309d71ab1"><enum>(6)</enum><header>Report</header>
					<subparagraph id="id31850b7a-f893-4594-a6c4-9953c1b9ae19"><enum>(A)</enum><header>In
			 general</header><text>Subject to subparagraph (B), not later than 18 months
			 after the date on which the first meeting of the Commission takes place, the
			 Commission shall submit to the President and Congress a report that
			 contains—</text>
						<clause id="id6493f4c2-64e0-40ec-a3bf-c18986455e1b"><enum>(i)</enum><text>a detailed statement of
			 the study findings and conclusions of the Commission; and</text>
						</clause><clause id="idea39b04c-9a94-4585-906b-f8ffe7462eee"><enum>(ii)</enum><text>the proposal of the
			 Commission developed under paragraph (5) for legislation and administrative
			 actions that the Commission considers to be appropriate to comprehensively
			 resolve the impacts caused by the Pick-Sloan Program.</text>
						</clause></subparagraph><subparagraph id="idA709D0E84817426E9F269E85182FCAAD"><enum>(B)</enum><header>Extension</header><text>The
			 deadline described in subparagraph (A) may be extended for a period of not more
			 than 180 days if the Commission submits to the Committee on Indian Affairs of
			 the Senate and the Committee on Natural Resources of the House of
			 Representatives a request for the extension that—</text>
						<clause id="iddd79d277-01a2-46d3-a513-ee5a624ba6f5"><enum>(i)</enum><text>is received by the
			 Committees before the deadline described in subparagraph (A); and</text>
						</clause><clause id="id680c4559-93d0-4256-b1d6-e0d11f55e7ca"><enum>(ii)</enum><text>includes a description
			 of the reasons why the extension is needed.</text>
						</clause></subparagraph></paragraph><paragraph id="id44f1cd0c-b6f8-465c-bb59-d1567073b079"><enum>(7)</enum><header>Website</header>
					<subparagraph id="id747ed827-a975-4c53-81c7-3610baacaed2"><enum>(A)</enum><header>In
			 general</header><text>The Commission shall maintain a website for the period
			 beginning on the date on which the first meeting of the Commission takes place
			 and ending on the date on which the Commission is terminated.</text>
					</subparagraph><subparagraph id="id57b19a83-34e3-4b98-8f94-f3170ccd260c"><enum>(B)</enum><header>Requirements</header><text>The
			 Commission shall use the website—</text>
						<clause id="iddaba1df4-3220-4ed5-bc2b-91aff4cd785f"><enum>(i)</enum><text>to describe the
			 activities of the Commission;</text>
						</clause><clause id="id9c24eec3-636c-4573-a055-2bbd965072a0"><enum>(ii)</enum><text>to provide access to
			 information studied by the Commission;</text>
						</clause><clause id="id16500e78-3f15-4f03-9e96-04e33c6b133a"><enum>(iii)</enum><text>to provide notice of,
			 and make available all information presented at, hearings of the Commission;
			 and</text>
						</clause><clause id="id9d73db38-158b-45cc-b420-c441ba1ed254"><enum>(iv)</enum><text>to post the report
			 (including all appendices to that report) of the Commission required under
			 paragraph (6).</text>
						</clause></subparagraph><subparagraph id="id2f0fe663-c50a-4895-854a-7d7d4e291dae"><enum>(C)</enum><header>Archiving of website
			 content</header><text>At the time at which the Commission submits the report
			 under paragraph (6), all content on the website shall be—</text>
						<clause id="id690d3b9f-c0a9-48d6-8a8b-9709f9e14825"><enum>(i)</enum><text>collected on compact
			 disk, digital video disk, or other appropriate digital media; and</text>
						</clause><clause id="ida6d8065c-ecdd-489a-bdfc-fd4f7b159e80"><enum>(ii)</enum><text>included in the report
			 to be submitted under paragraph (6).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id62d64313-b7cc-4df9-abed-2f0ced872470"><enum>(c)</enum><header>Powers</header>
				<paragraph id="id8179e803-e052-4f6b-9a67-3544c0c2b616"><enum>(1)</enum><header>Hearings</header><text>The
			 Commission may hold such hearings, meet and act at such times and places, take
			 such testimony, and receive such evidence as the Commission considers to be
			 advisable to carry out this Act.</text>
				</paragraph><paragraph id="ida2844e61-4e7e-471b-8d11-b6cb512311db"><enum>(2)</enum><header>Information from
			 Federal agencies</header>
					<subparagraph id="ida80e0d67-f8df-4ce8-918a-968867eef262"><enum>(A)</enum><header>In
			 general</header><text>The Commission may secure directly from a Federal agency
			 such information as the Commission considers to be necessary to carry out this
			 Act.</text>
					</subparagraph><subparagraph id="idec1c7811-5808-4159-8311-65c18cb1579f"><enum>(B)</enum><header>Provision of
			 information</header><text>On request of the Chairperson of the Commission, the
			 head of an applicable Federal agency shall provide the information to the
			 Commission.</text>
					</subparagraph></paragraph><paragraph id="id5c0f9e82-d9db-470b-bf73-111d68ed6c74"><enum>(3)</enum><header>Postal
			 services</header><text>The Commission may use the United States mails in the
			 same manner and under the same conditions as other agencies of the Federal
			 Government.</text>
				</paragraph><paragraph id="ida7d21029-20b8-461b-9c90-0455252255fa"><enum>(4)</enum><header>Gifts</header><text>The
			 Commission may accept, use, and dispose of gifts or donations of services or
			 property.</text>
				</paragraph></subsection><subsection id="ide2f5d8da-9ac0-421b-a991-1dba259760bf"><enum>(d)</enum><header>Commission personnel
			 matters</header>
				<paragraph id="id3523b03e-0f99-41a9-8512-790c985916b1"><enum>(1)</enum><header>Compensation of
			 members</header><text>Each member of the Commission shall be compensated at a
			 rate equal to the daily equivalent of the annual rate of basic pay prescribed
			 for level IV of the Executive Schedule under section 5315 of title 5, United
			 States Code, for each day (including travel time) during which the member is
			 engaged in the performance of the duties of the Commission.</text>
				</paragraph><paragraph id="idb656e45b-bd74-4421-be85-1c545fb46dbf"><enum>(2)</enum><header>Travel
			 expenses</header><text>Each member of the Commission shall be allowed travel
			 expenses, including per diem in lieu of subsistence, at rates authorized for an
			 employee of an agency under subchapter I of chapter 57 of title 5, United
			 States Code, while away from the home or regular place of business of the
			 member in the performance of the duties of the Commission.</text>
				</paragraph><paragraph id="id0b07d335-631c-4936-b1d5-a68067ce635e"><enum>(3)</enum><header>Staff</header>
					<subparagraph id="id8f5b6f0e-273c-41f0-904a-45e3d6cf5943"><enum>(A)</enum><header>In
			 general</header><text>The Chairperson of the Commission may, without regard to
			 the civil service laws (including regulations), appoint and terminate an
			 executive director and such other additional personnel as are necessary to
			 enable the Commission to perform the duties of the Commission.</text>
					</subparagraph><subparagraph id="id3b69031c-f19d-4e01-8d79-ccb97b149eae"><enum>(B)</enum><header>Confirmation of
			 executive director</header><text>The employment of an executive director shall
			 be subject to confirmation by a quorum of the Commission.</text>
					</subparagraph><subparagraph id="id9372a3bc-c79f-48f7-af2c-67e36054f5cf"><enum>(C)</enum><header>Compensation</header>
						<clause id="id13619379-4639-4db7-b3dd-29d051a1d539"><enum>(i)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Chairperson
			 of the Commission may fix the compensation of the executive director and other
			 personnel without regard to the provisions of chapter 51 and subchapter III of
			 chapter 53 of title 5, United States Code, relating to classification of
			 positions and General Schedule pay rates.</text>
						</clause><clause id="idac9f2185-ae43-42ef-9820-cacceb306a7a"><enum>(ii)</enum><header>Maximum rate of
			 pay</header><text>The rate of pay for the executive director and other
			 personnel shall not exceed the rate payable for level IV of the Executive
			 Schedule under section 5316 of title 5, United States Code.</text>
						</clause></subparagraph><subparagraph id="idd706490b-1388-49f3-8490-203349be73b7"><enum>(D)</enum><header>Detail of Federal
			 Government employees</header>
						<clause id="id89cf5798-a3cd-4029-bccf-5c3ef8c1a37c"><enum>(i)</enum><header>In
			 general</header><text>An employee of the Federal Government may be detailed to
			 serve as staff for the Commission without reimbursement.</text>
						</clause><clause id="id45575ee4-8ea2-4905-94f8-d721cc46b3e4"><enum>(ii)</enum><header>Civil service
			 status</header><text>The detail of the employee shall be without interruption
			 or loss of civil service status or privilege.</text>
						</clause></subparagraph></paragraph><paragraph id="id34fa3e94-955f-48f6-8bb7-39f0bcb1859c"><enum>(4)</enum><header>Human resources
			 support</header><text>The Commission may request the Secretary of Defense to
			 provide, and the Secretary of Defense shall provide, through human resource
			 departments under the jurisdiction of the Secretary of Defense, on a
			 reimbursable basis, operational support for activities of the
			 Commission.</text>
				</paragraph><paragraph id="idf04888e7-6e43-4aa1-9320-3f52613d3b25"><enum>(5)</enum><header>Contract
			 authority</header><text>The Commission may, to such extent and using such
			 amounts as are provided in appropriation Acts, enter into contracts to enable
			 the Commission to discharge the duties of the Commission under this Act.</text>
				</paragraph><paragraph id="id15113131-6bbc-4c6a-94aa-87a5f1246e82"><enum>(6)</enum><header>Volunteer
			 services</header><text>Notwithstanding section 1342 of title 31, United States
			 Code, the Commission may accept and use such voluntary and uncompensated
			 services as the Commission determines to be necessary.</text>
				</paragraph><paragraph id="idbbbbf654-3a98-416e-bac4-2155dd006f5f"><enum>(7)</enum><header>Procurement of
			 temporary and intermittent services</header><text>The Chairperson of the
			 Commission may procure temporary and intermittent services in accordance with
			 section 3109(b) of title 5, United States Code, at rates for individuals that
			 do not exceed the daily equivalent of the annual rate of basic pay prescribed
			 for level V of the Executive Schedule under section 5316 of that title.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idff80f32a-2b95-437a-a3c8-347b42337231"><enum>(e)</enum><header display-inline="yes-display-inline">Termination of Commission</header><text display-inline="yes-display-inline">The Commission shall terminate 90 days
			 after the date on which the Commission submits the report of the Commission
			 under subsection (b)(6).</text>
			</subsection></section><section changed="added" commented="no" committee-id="SLIA00" id="ida43cd8ef-853a-4122-a9d2-31ef3e38bc9f" reported-display-style="italic"><enum>5.</enum><header>Funding</header><text display-inline="no-display-inline">Subject to the approval of the appropriate
			 committees of Congress, out of any unobligated amounts made available to the
			 Secretary of the Interior, the Secretary may use to carry out this Act not more
			 than $2,500,000.</text>
		</section><section changed="added" committee-id="SLIA00" id="idc5463832-2a43-4a2b-896b-661ec1dc3012" reported-display-style="italic"><enum>6.</enum><header>Savings
			 clause</header><text display-inline="no-display-inline">Nothing in this Act
			 diminishes, changes, or otherwise affects—</text>
			<paragraph id="idd08cfa70-fc35-4852-8e44-a44254ea4a10"><enum>(1)</enum><text display-inline="yes-display-inline">the water rights of the affected Indian
			 tribes;</text>
			</paragraph><paragraph id="id58f248ad-ad44-46f7-b1fe-e804569ceb02"><enum>(2)</enum><text display-inline="yes-display-inline">any other right (including treaty rights)
			 of the affected Indian tribes;</text>
			</paragraph><paragraph id="idd47a1779-1548-45b2-b77d-93173aa548d5"><enum>(3)</enum><text display-inline="yes-display-inline">the status of Indian reservation land or
			 the boundaries of any reservation of an Indian tribe; or</text>
			</paragraph><paragraph id="id22d7b448-c3d2-4edd-96ae-31d260a9f7de"><enum>(4)</enum><text display-inline="yes-display-inline">any Congressional authorization of
			 appropriations for the benefit of the affected Indian tribes.</text>
