			 programs</header>
				<subsection id="IDbddd72477a2d4092848542e10122287c"><enum>(a)</enum><header>Allocation</header><text>Section
			 363(b)(3) of the Energy Policy and Conservation Act (42 U.S.C. 6323(b)(3)) is
			 amended—</text>
					<paragraph id="idE23A8A46D075451E99A27797556818A7"><enum>(1)</enum><text>by redesignating
			 subparagraphs (A), (B), and (C) as clauses (i), (ii), and (iii), respectively,
			 and indenting appropriately;</text>
					</paragraph><paragraph id="idDFCAEA3C82274D9AA8F508E73C373C57"><enum>(2)</enum><text>in the matter
			 preceding clause (i) (as redesignated by paragraph (1)), by striking <quote>(3)

				general</header><text>For each fiscal year, if the funds made available to the
				Secretary to carry out this part exceed $25,500,000—</text>
									<subclause id="id4C4679DE14D340B79B65CF0A5253B0B5"><enum>(I)</enum><text>$25,500,000 shall
				be allocated to each participating State in accordance with the table contained
				in section 420.11 of title 10, Code of Federal Regulations (as in effect on the
				date of enactment of this subparagraph); and</text>
									</subclause><subclause id="idEA862D9764044E29B800A1D9C00D3129"><enum>(II)</enum><text>any additional
				amount shall be allocated in accordance with clause (ii).</text>
									</subclause></clause><clause id="id8592D591CCA240189B2B489F2DC5DE0D"><enum>(ii)</enum><header>Allocation of
				excess funds</header><text>An amount described in clause (i)(II) shall be
				allocated to each participating State as follows:</text>
									<subclause id="id1FF2027294E94F09BBCCDC575D5BB9BD"><enum>(I)</enum><text>One-third of the
				amount shall be divided equally among the participating States.</text>
									</subclause><subclause id="id90A4B0ED02694229B3B91E5E28DAC677"><enum>(II)</enum><text>One-third of the
				amount shall be distributed ratably among the participating States based on the
				population of each participating State, as contained in the most recent
				reliable census data available from the Bureau of the Census of the Department
				of Commerce, for all participating States at the time at which the Secretary
				calculates the formula for distribution.</text>
									</subclause><subclause id="id4B0FC8A49FE34830986939912BC01A65"><enum>(III)</enum><text>One third of
				the amount shall be distributed ratably among the participating States, to each
				participating State that, by State law, has—</text>
										<item id="IDd2a61a972b7b496b8800b1bbfc38bbd6"><enum>(aa)</enum><text>established
				energy efficiency as the first priority in utility energy planning; and</text>
										</item><item id="ID449dd9c161f84387866925a5b9ca70c5"><enum>(bb)</enum><text>developed energy
				efficiency resource standards, or a renewable portfolio standard (or
				equivalent) that includes energy efficiency as an eligible resource to meet the
				guidelines under section
				362.</text>
										</item></subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id0E130143B858426D9E190E0D8A7DFC33"><enum>(b)</enum><header>Use of
			 funds</header><text>Section 363 of the Energy Policy and Conservation Act (42
			 U.S.C. 6323) is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id93E749759C37479DAEE9BEEEA316EC47" style="OLC">
						<subsection id="idD5470C2DD97748658AED1D6EC8919F27"><enum>(g)</enum><header>Use of
				funds</header>
							<paragraph id="id9E7BFD4E1E7D498E88E70F294E02C1B7"><enum>(1)</enum><header>In
				general</header><text>For each fiscal year, each participating State that
				receives an amount of funds under this section shall use not less than
				<fraction>1/3</fraction> of the amount to provide grants and loans—</text>
								<subparagraph id="idDA407161207B49ACA9288CFF239B62FC"><enum>(A)</enum><text>for renewable
				energy development;</text>
								</subparagraph><subparagraph id="id806A551229D14B988354B6D958766573"><enum>(B)</enum><text>to energy
				technology companies; or</text>
								</subparagraph><subparagraph id="idAA28598835B14C289AA99E357559B5C1"><enum>(C)</enum><text>to promote energy
				efficiency.</text>
								</subparagraph></paragraph><paragraph id="id328D39E58CF343BCA4A9D888593107A3"><enum>(2)</enum><header>State
				cost-sharing</header>
								<subparagraph id="idCAC00A8CE06A459A86C6745D778F5489"><enum>(A)</enum><header>In
				general</header><text>Subject to subparagraph (B), each participating State
				that receives an amount of funds under this section shall pay 20 percent of the
				costs of each activity carried out under the grant.</text>
								</subparagraph><subparagraph id="idAB95E31B51EA42199FB06DD5A0DB36D6"><enum>(B)</enum><header>Deferral</header><text>The
				State cost-share described in subparagraph (A) may be deferred for not more
				than 5 years, at the discretion of the Secretary.</text>
								</subparagraph></paragraph></subsection><subsection id="idD64DF4B5C5724AE8976675F9F0C91842"><enum>(h)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this part $1,500,000,000 for each of fiscal years 2011 through
				2016.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection></section><section id="idCC474A88229447939FE53D066F9DCCD1"><enum>102.</enum><header>ARPA–E
			 amendments</header><text display-inline="no-display-inline">Section 5012 of the
			 America COMPETES Act (42 U.S.C. 16538) is amended—</text>
				<paragraph id="ID9b94a59ccc3c4e4f83cda5d080a99538"><enum>(1)</enum><text>in subsection
			 (c)(2)—</text>
					<subparagraph id="ID37f1cbe1d53147f8a972058db44afd77"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting <quote>and applied</quote> after <quote>advances in
			 fundamental</quote>;</text>
					</subparagraph><subparagraph id="ID1ba6b3b2b9624f9f8e8cafe72a6477cd"><enum>(B)</enum><text>by striking
			 <quote>and</quote> at the end of subparagraph (B);</text>
					</subparagraph><subparagraph id="ID8b0798dcd2274d53823f6af702af042b"><enum>(C)</enum><text>by striking the
			 period at the end of subparagraph (C) and inserting <quote>; and</quote>;
			 and</text>

			 (e)—</text>
					<subparagraph id="IDcef8596aadec47e2a35a6f2d79fa92c1"><enum>(A)</enum><text>in paragraph

			 period at the end of paragraph (4) and inserting <quote>; and</quote>;
			 and</text>
					</subparagraph><subparagraph id="ID63af783109dc4f2aadd6b93ae68dc4a9"><enum>(C)</enum><text>by adding at the
			 end the following:</text>

				subsection (c)(2)(C)—</text>
								<subparagraph id="IDc4a4febfebd8411fa131bc8aa937f044"><enum>(A)</enum><text>ensuring that
				applications for funding disclose the extent of current and prior efforts,
				including monetary investments as appropriate, in pursuit of the technology
				area for which funding is being requested;</text>
								</subparagraph><subparagraph id="ID15fafa1442b549538dca6592f4fabe35"><enum>(B)</enum><text>adopting measures
				to ensure that, in making awards, program managers adhere to the objectives
				described in subsection (c)(2)(C); and</text>
								</subparagraph><subparagraph id="IDc1fec2846077448cbef7e253d404397a"><enum>(C)</enum><text>providing as part
				of the annual report required by subsection (h)(1), a summary of the instances
				of and reasons for ARPA–E funding projects in technology areas already being
				undertaken by
				industry.</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID39375313efea4d02b52aa9014c56c4ee"><enum>(3)</enum><text>by redesignating
			 subsections (f) through (m) as subsections (g), (h), (i), (j), (l), (m), (n),
			 and (o), respectively;</text>
				</paragraph><paragraph id="ID805a9856eeaa4ce884ad07c2b7e749b2"><enum>(4)</enum><text>by inserting
			 after subsection (e) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="id227F80B0957D46F2B7A5C809D388B4D0" style="OLC">
						<subsection id="ID36d84a8a12b04473bbd243d068238313"><enum>(f)</enum><header>Awards</header>
							<paragraph id="idEDF78D1318494613848AE6B23A8604C1"><enum>(1)</enum><header>In
				general</header><text>In carrying out this section, the Director may initiate
				and execute awards in the form of grants, contracts, cooperative agreements,
				cash prizes, and other transactions.</text>
							</paragraph><paragraph id="idE1142F52D2A14B09B2ACDADF443888AD"><enum>(2)</enum><header>Considerations</header><text>The
				Director shall make awards under this section that are designed—</text>
								<subparagraph id="id7B564B4DA4764CB2A6A2FEA9EAB978AD"><enum>(A)</enum><text>to overcome the
				long-term and high-risk barriers to the goals and means described in subsection
				(c); and</text>
								</subparagraph><subparagraph id="id025B4965275C4270AD175D5C8B6C2942"><enum>(B)</enum><text>to facilitate
				submissions, where possible, by small businesses and entrepreneurs, pursuant to
				announcements published not less frequently than annually, of funding
				opportunities for—</text>
									<clause id="IDa19cb4f9d3c840ebaf4e1c146958e5ab"><enum>(i)</enum><text>specific areas of
				technological innovation; and</text>
									</clause><clause id="IDed73c00dca034e65aca06dd678d1c2c5"><enum>(ii)</enum><text>broadly defined
				areas of science and technology, to remain open for periods of one
				year.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDbb917ce36d2a4c7cba486cffde442669"><enum>(5)</enum><text>in subsection (g)
			 (as redesignated by paragraph (3))—</text>
					<subparagraph id="ID3df764bc9d9942398b46aa70684c2ff0"><enum>(A)</enum><text>by redesignating
			 paragraphs (1) and (2) as paragraphs (2) and (3), respectively;</text>
					</subparagraph><subparagraph id="ID103d7edfc6954ed599a9f260efe0e337"><enum>(B)</enum><text>by inserting
			 before paragraph (2) (redesignated by subparagraph (A)) the following:</text>

				out the responsibilities of ARPA–E under this section, in conjunction with the
				operations of the rest of the
				Department.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID32a8c10eccf64e0892d8455cdcb90160"><enum>(C)</enum><text>in paragraph (2)
			 (as redesignated by subparagraph (A))—</text>
						<clause id="ID6a7c576a5a144215a332344fe2575110"><enum>(i)</enum><text>in
			 the paragraph heading, by striking <quote><header-in-text level="subparagraph" style="OLC">Program managers</header-in-text></quote> and inserting

			 inserting a semicolon; and</text>
							</subclause><subclause id="ID401f1d6bef084586b42235b988bf1a06"><enum>(VI)</enum><text>by inserting

				senior scientific, legal, business, and technical personnel to serve as fellows
				to work at ARPA–E for terms not to exceed 2 years.</text>
								</subparagraph><subparagraph id="idADFE05A818A14F9482595071803148E3"><enum>(B)</enum><header>Responsibilities</header><text>Responsibilities
				of fellows may include—</text>
									<clause id="ID7db8bb45d58f4b8391ba6cb9cc46de14"><enum>(i)</enum><text>supporting
				program directors in program creation, design, implementation, and
				management;</text>
									</clause><clause id="IDa127ab0f040d4600b11f7a126cb03ac4"><enum>(ii)</enum><text>exploring
				technical fields for future ARPA–E program areas;</text>
									</clause><clause id="ID4f70d81d8f614ebb922e0f5ba54c16ed"><enum>(iii)</enum><text>assisting the
				Director in the creation of the strategic vision for ARPA–E referred to in
				subsection (h)(2);</text>
									</clause><clause id="ID62a41187e0ff4dafb3f052b803c341de"><enum>(iv)</enum><text>preparing energy
				technology and economic analyses; and</text>
									</clause><clause id="ID6e7618c4be7e4bca90946b439c964146"><enum>(v)</enum><text>any other
				appropriate responsibilities identified by the
				Director.</text>
									</clause></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="IDb2f003d93ee4423d87262e95d052de37"><enum>(6)</enum><text>in subsection
			 (h)(2) (as redesignated by paragraph (3))—</text>
					<subparagraph id="ID264cf234d5484effa903bba8f43b02f3"><enum>(A)</enum><text>by striking
			 <quote>2008</quote> and inserting <quote>2010</quote>; and</text>

			 subsection (j) (as redesignated by paragraph (3)), and inserting the
			 following:</text>

						<subsection id="ID2d1b860cf8bd4668a76f656f19c84067"><enum>(j)</enum><header>Federal
				demonstration of technologies</header><text>The Director shall seek
				opportunities to partner with purchasing and procurement programs of Federal
				agencies to demonstrate energy technologies resulting from activities funded
				through
				ARPA–E.</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID69772eb003a64caf8dfa1eb61f726fa8"><enum>(8)</enum><text>by inserting
			 after subsection (j) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id93DBC1B12B2447BF9AB6943AFD0F59D8" style="OLC">
						<subsection id="ID85591a69fdcd490aadda4e2aeacb01ef"><enum>(k)</enum><header>Events</header>
							<paragraph id="ID552d039c5e334bd3a39d6fd0394297e5"><enum>(1)</enum><header>In
				general</header><text>The Director may convene, organize, and sponsor events
				that further the objectives of ARPA–E, including events that assemble awardees,
				the most promising applicants for ARPA–E funding, and a broad range of ARPA–E
				stakeholders (which may include members of relevant scientific research and
				academic communities, government officials, financial institutions, private
				investors, entrepreneurs, and other private entities), for the purposes
				of—</text>
								<subparagraph id="ID29b40f4f197f4268b91f5af1c2262ddd"><enum>(A)</enum><text>demonstrating
				projects of ARPA–E awardees;</text>
								</subparagraph><subparagraph id="ID018d431cd0154bc4afcda76d241bdad6"><enum>(B)</enum><text>demonstrating
				projects of finalists for ARPA–E awards and other energy technology
				projects;</text>
								</subparagraph><subparagraph id="IDdb000aa716db4b24acaa63e9854dcfeb"><enum>(C)</enum><text>facilitating
				discussion of the commercial application of energy technologies developed under
				ARPA–E and other government-sponsored research and development programs;
				or</text>
								</subparagraph><subparagraph id="ID65f00d280df5433fa17f5f9e35c16d26"><enum>(D)</enum><text>any other
				purposes that the Director determines to be appropriate.</text>
								</subparagraph></paragraph><paragraph id="ID0ba1bf2e84cb428296eb3e09161002c9"><enum>(2)</enum><header>Technology
				transfer</header><text>Funding for activities described in paragraph (1) shall
				be provided as part of the technology transfer and outreach activities under
				subsection
				(o)(4)(B).</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID49e3adc548694996a671560115ca20ab"><enum>(9)</enum><text>in subsection (m)
			 (as redesignated by paragraph (3))—</text>

						</clause></subparagraph></paragraph></section></title><title id="id8B781D8866EB41A0A3ABD9128377EDAB"><enum>II</enum><header>Preparing a
			 clean energy workforce </header>
			<section id="id363FEB29BE2A45C7B15CAACAD48D311B"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text>
				<paragraph id="id533ACC40600048DCB612BFDB8C43E5A1"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The terms
			 <quote>institution of higher education</quote>, <term>local area</term>,
			 <term>local board</term>, <term>Secretary</term>, <term>State</term>, and
			 <term>State board</term> have the meanings given to the terms in section 101 of
			 the Workforce Investment Act of 1998 (29 U.S.C. 2801).</text>
				</paragraph><paragraph commented="no" id="id0C94178325D144CDBB89FF2836868D4C"><enum>(2)</enum><header>Career
			 pathway</header><text>The term <quote>career pathway</quote> means a
			 high-quality, rigorous, and relevant set of education, training, and workplace
			 courses and experiences that—</text>
					<subparagraph id="idD1E9571003A14AE49DE54960BF1F6D7F"><enum>(A)</enum><text>is aligned with
			 the skill needs of an industry in a regional economy;</text>
					</subparagraph><subparagraph id="id0B4CC24559434E0598A09925035B428B"><enum>(B)</enum><text>includes the full
			 range of secondary or postsecondary education options, including registered
			 apprenticeships;</text>
					</subparagraph><subparagraph id="idEA08E1379E55461F85696C2A86868FA7"><enum>(C)</enum><text>includes academic
			 and career counseling and supports the development of individualized career
			 plans;</text>
					</subparagraph><subparagraph id="id2B5459ED3E764A0CAA7EBC471EA21E47"><enum>(D)</enum><text>includes
			 integrated education and training services, as appropriate;</text>
					</subparagraph><subparagraph id="idDD7AAEF19A144AF69E43BF9D77F82AC8"><enum>(E)</enum><text>helps workers
			 enter or advance within a specific sector or occupational field;</text>
					</subparagraph><subparagraph id="id89560E3005664966B2236C1BA1FEC83D"><enum>(F)</enum><text>leads to the
			 attainment of a degree or industry-recognized credential; and</text>
					</subparagraph><subparagraph id="idABD9578C84C54E6E912F0FB7DCA3BA14"><enum>(G)</enum><text>has the goal of
			 increasing the educational and skills attainment, and employment outcomes, of
			 individuals.</text>
					</subparagraph></paragraph><paragraph id="id2CF99C8DBC2440179FAA7B550E610815"><enum>(3)</enum><header>Identified
			 industry</header><text display-inline="yes-display-inline">The term
			 <term>identified industry</term> means an industry that supports low carbon
			 energy sources and that is identified in a grant application submitted under
			 this title.</text>
				</paragraph></section><section id="idEF9257F125F34036980A28BC29F54FDF"><enum>202.</enum><header>Regional
			 energy alliance skills grants</header>
				<subsection id="idE4343BE08A6F4E3BB5BF7428302E1CAA"><enum>(a)</enum><header>Purpose</header><text>The
			 purpose of this section is to increase the availability of highly skilled
			 workers qualified for careers, leading to economic self-sufficiency of the
			 United States, in low carbon energy industries, including careers in the
			 production, transmission, or distribution of low carbon energy, by—</text>
					<paragraph id="id75570A254BFE4D2FB9ACA56D9D6CA246"><enum>(1)</enum><text>developing
			 industry-recognized skill standards in critical occupations;</text>
					</paragraph><paragraph id="idDD3B2CFBCDA94CF6AD48184C3F99D67A"><enum>(2)</enum><text>enhancing the
			 awareness and use of industry-recognized skill standards and credentials,
			 existing as of the date of enactment of this Act; or</text>
					</paragraph><paragraph id="idCB240B1D19254E94A797550C64F5A31C"><enum>(3)</enum><text>developing career
			 pathways on the basis of industry-recognized skill standards and
			 credentials.</text>
					</paragraph></subsection><subsection id="id8226A83AFDFC4A0495D7B6D75675A7A3"><enum>(b)</enum><header>General
			 Authority</header><text>Using funds authorized under section 205, the Secretary
			 shall award regional energy alliance skills grants on a competitive basis to
			 eligible entities.</text>
				</subsection><subsection id="id51E2DCB7D31448FF92C8D4763F7CA342"><enum>(c)</enum><header>Use of
			 funds</header>
					<paragraph id="id6E7DAE3DC1054FEEA9F20AFA4CB0F834"><enum>(1)</enum><header>In
			 general</header><text>An eligible entity that receives such a grant shall use
			 the grant funds to pay for the Federal share of the cost of supporting
			 innovative strategies to prepare workers for employment, with the skills
			 required by an identified industry within States or multi-State areas.</text>
					</paragraph><paragraph id="id0C2F72753455437E936CFDD4BACB16A2"><enum>(2)</enum><header>Required
			 activities</header><text>The eligible entity shall use the grant funds
			 to—</text>
						<subparagraph id="id6023DCE534E940228965858897A7443A"><enum>(A)</enum><text>refine workforce
			 strategic plans for the identified industry, including the identification of
			 occupations critical to the identified industry and the skills and credentials
			 necessary for workers in those occupations;</text>
						</subparagraph><subparagraph id="id7C5D964670E14F4E886D877377BED0AE"><enum>(B)</enum><text>develop or refine
			 industry-recognized skill standards and credentials for occupations critical to
			 the industry, including occupations on which the competitive success of the
			 industry depends;</text>
						</subparagraph><subparagraph id="id929BA7D285CE449A90248FB223622EFF"><enum>(C)</enum><text>integrate such
			 skill standards and credentials into curricula at secondary schools and
			 institutions of higher education to support industry-recognized credential
			 programs;</text>
						</subparagraph><subparagraph id="idE17FA47D30B14905BF275D9F20E013AC"><enum>(D)</enum><text>establish, adopt,
			 or expand career pathways for occupations supporting an identified industry,
			 using the skill standards and credentials developed and refined under
			 subparagraph (B); and</text>
						</subparagraph><subparagraph id="idE6ED28E9C5A24A54836DB1B043F09F70"><enum>(E)</enum><text>establish
			 workforce development programs and activities to meet the long-term needs of
			 the identified industry and complement programs and services administered by
			 State boards and local boards.</text>
						</subparagraph></paragraph><paragraph id="idC554FD17CCBF440B9AEB5255B968F009"><enum>(3)</enum><header>Allowable
			 activities</header><text>The eligible entity may use the funds to carry out 1
			 or more of the following:</text>
						<subparagraph id="idCBC9C0FCA0274BDBA812852670E963CA"><enum>(A)</enum><text>Implement career
			 awareness activities, focused on occupations critical to the identified
			 industry, in secondary schools and institutions of higher education.</text>
						</subparagraph><subparagraph id="id9A893A6DF9304AA4BE403A0F2EDDA967"><enum>(B)</enum><text>Implement
			 integrated education and training activities, such as paid or unpaid work
			 experiences, on-the-job training opportunities, customized training programs,
			 or transitional jobs programs.</text>
						</subparagraph><subparagraph id="id81A5CF95840042818515291B2E56F038"><enum>(C)</enum><text>Partner with
			 entities carrying out youth-serving programs (including entities operating Job
			 Corps centers under subtitle C of title I of the Workforce Investment Act of
			 1998 (29 U.S.C. 2801 et seq.), preapprenticeship programs, and YouthBuild
			 programs under section 173A of the Workforce Investment Act of 1998 (29 U.S.C.
			 2918a), where appropriate) and programs targeting populations of individuals
			 underrepresented in the industry, such as veterans and women.</text>
						</subparagraph><subparagraph id="idF58D0BCF392E4267BBF3B113BE58ECDE"><enum>(D)</enum><text>Build awareness
			 of relevant employers and labor organizations about the skill development
			 opportunities available through the activities carried out under the
			 grant.</text>
						</subparagraph></paragraph></subsection><subsection id="idA1D78485A40840BE83A1C00C016B6036"><enum>(d)</enum><header>Eligible
			 entities</header>
					<paragraph id="id0CA141067A3A4FAA8F0002DBF756CAD2"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, an
			 entity shall be an Energy Alliance that meets the requirements of paragraph (2)
			 and submits an application in accordance with subsection (e).</text>
					</paragraph><paragraph id="id0A99678B72E34B2E80028D2C6EAE78E9"><enum>(2)</enum><header>Energy
			 alliance</header><text>For purposes of this section, an Energy Alliance shall
			 be composed of—</text>
						<subparagraph id="idDC0748FC836E4898978561459956FA29"><enum>(A)</enum><text>at least 1
			 industry representative from each low carbon energy industry addressed in the
			 application;</text>
						</subparagraph><subparagraph id="id205BD69CDB914029A59FD43FB28D75A6"><enum>(B)</enum><text>1 representative
			 of the State board from each of the States in the area to be served under the
			 grant;</text>
						</subparagraph><subparagraph id="idB06F00F916C24A06ADFA59AFAF9BEC5D"><enum>(C)</enum><text>at least 1
			 representative of a local board from each of the local areas in the area to be
			 served under the grant;</text>
						</subparagraph><subparagraph id="id38281EFAF533479CB836FC0A31749EAA"><enum>(D)</enum><text>at least 1
			 representative from relevant institutions of higher education, providers of
			 registered apprenticeships, and other eligible training providers offering to
			 develop or refine industry-recognized skills standards or industry-recognized
			 credentials, from each such State, that offer education or training programs to
			 address the skill needs of the identified industry;</text>
						</subparagraph><subparagraph id="id6D592C3DD30A4834A7162423B15E0577"><enum>(E)</enum><text>at least 1
			 representative from relevant labor organizations from each such State;</text>
						</subparagraph><subparagraph id="id4B14223BA2B64EC9B4DB77B8CF218DD1"><enum>(F)</enum><text>at least 1
			 representative of an economic development organization; and</text>
						</subparagraph><subparagraph id="idCF1853A9B3664611B0783122525C41AA"><enum>(G)</enum><text>at least 1
			 representative from a career and technical education organization from each
			 such State.</text>
						</subparagraph></paragraph></subsection><subsection id="id48521C2BB28543218BF53C2B1336DA08"><enum>(e)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section, an entity shall submit an
			 application to the Secretary at such time, in such manner, and meeting such
			 requirements as the Secretary may determine to be appropriate. The application
			 shall contain such information as the Secretary may require, including
			 information to enable the Secretary to review the skill standards and
			 credentials to be, as appropriate, developed or used.</text>
				</subsection><subsection id="idB055A65BDCF04ECCBCFAF718D63DE31E"><enum>(f)</enum><header>Priority</header><text>In
			 making grants under this section, the Secretary shall give priority to entities
			 submitting applications for grant programs—</text>
					<paragraph id="idDE28BF91ABBA4B54A16F35409288A686"><enum>(1)</enum><text>that serve States
			 that have State laws specifying targets for reducing energy consumption by or
			 on a determined date or timeline;</text>
					</paragraph><paragraph id="idD5F95BF3E80A44DC8DA1E0AC18000847"><enum>(2)</enum><text>that serve States
			 in which industry or sector partnerships, industry associations, or the State
			 governments have developed a low carbon energy industry-specific strategic plan
			 for developing the low carbon energy assets for the State or multi-State area
			 involved for the purposes of reducing dependence on foreign oil and fossil
			 fuels, and economic development; and</text>
					</paragraph><paragraph id="idB13890F1F5104AA5A783E6863827ADB8"><enum>(3)</enum><text>that focus on a
			 low carbon energy industry with established industry-recognized skill standards
			 and credentials that lead to industry-recognized credentials.</text>
					</paragraph></subsection><subsection id="id8D6B4C90DCC741DAAC9397E403EC1D09"><enum>(g)</enum><header>Federal
			 Share</header>
					<paragraph id="idADC808EBE2214CF5AF718F1F5DDEDB8B"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the cost referred to in subsection
			 (c) shall be 50 percent.</text>
					</paragraph><paragraph id="id20B148FC7F4B4C1BAB47EDA5E1E73844"><enum>(2)</enum><header>Non-Federal
			 Share</header><text>The eligible entity involved may provide the non-Federal
			 share in cash or in kind, fairly evaluated, including plant, equipment, or
			 services.</text>
					</paragraph></subsection><subsection id="idEC8E04D94D7C4B1BBB4509D547C77A27"><enum>(h)</enum><header>Performance and
			 evaluation</header><text>After selecting entities to become grant recipients
			 and before providing the grant payments, the Secretary shall negotiate
			 performance measures, with expected levels of performance, with the entities.
			 The Secretary shall use the performance measures to evaluate the
			 entities.</text>
				</subsection></section><section id="idA3C1013F8262438D86808AE297F0BD8F"><enum>203.</enum><header>Regional
			 industry energy efficiency grants</header>
				<subsection id="id6C5D2AF5BF0747D296BBAE6C8E108B12"><enum>(a)</enum><header>In
			 general</header><text>Using funds authorized under section 205, the Secretary
			 shall award regional industry energy efficiency grants on a competitive basis
			 to eligible entities under this section, for the purpose of educating and
			 training incumbent workers in the skills necessary to increase energy
			 efficiency in industries in existence on the date of enactment of this Act
			 (referred to in this section as <quote>existing industries</quote>).</text>
				</subsection><subsection id="id7B6743BA88664E45A8ECCEF83C39A7E2"><enum>(b)</enum><header>Use of
			 funds</header><text>An eligible entity that receives such a grant shall use the
			 grant funds to pay for the Federal share of the cost to support—</text>
					<paragraph id="id8231B356BD7846769C767752213D405E"><enum>(1)</enum><text>assisting
			 industries in identifying new skills necessary for occupations, existing as of
			 the date of enactment of this Act, to support a more energy efficient approach
			 to such industries; and</text>
					</paragraph><paragraph id="id21916B5BFEEC40D9B6F0AD357C33BB9D"><enum>(2)</enum><text>providing
			 training and education to incumbent workers on the skills identified under
			 paragraph (1) that are necessary to use equipment referenced in subsection
			 (e)(2), and implement policies, procedures, or protocols, required to reduce
			 energy consumption in existing industries.</text>
					</paragraph></subsection><subsection id="id7CDA575E5726460DB3891ABB9F944737"><enum>(c)</enum><header>Eligible
			 entities</header>
					<paragraph id="id863A5782A6154538A5EF76FD152AB84B"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, an
			 entity shall be a covered entity that meets the requirements of paragraph (2)
			 and that submits an application in accordance with subsection (d).</text>
					</paragraph><paragraph id="idD4574D474EE14243BBF11AD48DD626DE"><enum>(2)</enum><header>Covered
			 entities</header><text>For the purposes of this section, covered entities shall
			 be partnerships that include—</text>
						<subparagraph id="idAEA80FF394FC4A28BCB2F9AEB008AE4E"><enum>(A)</enum><text>an industry group
			 or association with an energy consumption that is calculated by the
			 Environmental Protection Agency using section 763(b)(2)(A)(ii)(II)(aa) of the
			 American Clean Energy and Security Act of 2009 (H.R. 2454, 111th Congress, as
			 placed on the calendar of the Senate on July 7, 2009); and</text>
						</subparagraph><subparagraph id="id7436351155AD47A68B3468B3A4F690D8"><enum>(B)</enum><text>at least 1
			 representative of each of the following:</text>
							<clause id="id2912BD10F83646C29BB2B573F095C0E1"><enum>(i)</enum><text>State
			 boards.</text>
							</clause><clause id="idC780E969CE714C2A9DBBD17B9A8BDB7E"><enum>(ii)</enum><text>Local
			 boards.</text>
							</clause><clause id="idC8130E0F7FEC49338A1C4A224405F4BB"><enum>(iii)</enum><text>Labor
			 organizations.</text>
							</clause><clause id="idC7C0A6917EDE475D881387A3BA4964A6"><enum>(iv)</enum><text>Institutions of
			 higher education, providers of registered apprenticeships, and other entities,
			 eligible to provide training services under section 122 of the Workforce
			 Investment Act of 1998 (29 U.S.C. 2842).</text>
							</clause><clause id="id5C993F57E206499A8E536CDCCECD890F"><enum>(v)</enum><text>Economic
			 development organizations.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="id0DCF3B55E20342D2ACC34C4D043C12F2"><enum>(d)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section, an entity shall submit an
			 application to the Secretary at such time, in such manner, and meeting such
			 requirements as the Secretary may determine to be appropriate. The application
			 shall contain such information as the Secretary may require, including
			 information to enable the Secretary to review the skill standards and
			 credentials to be used.</text>
				</subsection><subsection id="id9266A7126DC44A8FB40E9228D9EE31FB"><enum>(e)</enum><header>Priority</header><text>In
			 making grants under this section, the Secretary shall give priority to entities
			 submitting applications—</text>
					<paragraph id="id174697036B1D4943B1FFE43D72CBA8FE"><enum>(1)</enum><text>for grant
			 programs that serve States that have State laws specifying targets for reducing
			 energy consumption by or on a determined date or timeline; and</text>
					</paragraph><paragraph id="id4553AF8B0AFF467DA7AFE1A53234293E"><enum>(2)</enum><text>for grant
			 programs that serve industries that have a demonstrated commitment to
			 purchasing and installing the necessary equipment, and implementing the
			 necessary work processes and protocols, to reduce energy consumption through
			 the utilization of available tax credits or other means.</text>
					</paragraph></subsection><subsection id="idCF1A494B351C44BF82615FB63675F234"><enum>(f)</enum><header>Federal
			 share</header>
					<paragraph id="id3970F7C6AF0C401FBD5E1EAF7B9084C6"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the cost described in subsection (b)
			 shall be a share negotiated between the eligible entity and the Secretary, and
			 shall range from 25 percent to 75 percent based on each of the following
			 factors:</text>
						<subparagraph id="id3981F2DC2A184093BAB08827B3C4AE85"><enum>(A)</enum><text>Whether the
			 business receiving the training and education is in an industry identified in
			 part of the energy efficiency plans of the State or local area.</text>
						</subparagraph><subparagraph id="id46889630B1624745AEFD5886C54C19DC"><enum>(B)</enum><text>The number of
			 employees employed by the business.</text>
						</subparagraph><subparagraph id="idD4CCA48105C1427A89F2C64263EDF5F9"><enum>(C)</enum><text>The number of
			 individuals to be trained or educated.</text>
						</subparagraph><subparagraph id="idC9DD00E14AFC4F93AD001598D35AE0B4"><enum>(D)</enum><text>The level of
			 wages, benefits, and other compensation available to employees in the
			 occupations and career pathways involved.</text>
						</subparagraph><subparagraph id="idF480B429AB2B4E478916555202F3B25F"><enum>(E)</enum><text>The demonstrated
			 commitment of the business to providing ongoing training and education,
			 performance improvement opportunities, career advancement, and other benefits
			 to its employees.</text>
						</subparagraph><subparagraph id="id11802C63E26F4B0489B61D6AD5573B96"><enum>(F)</enum><text>Other factors as
			 determined appropriate by the Secretary.</text>
						</subparagraph></paragraph><paragraph id="id7606F93AF0D646B2B1AE88FE8D664E69"><enum>(2)</enum><header>Non-Federal
			 share</header><text>The eligible entity may provide the non-Federal share in
			 cash or in kind, fairly evaluated, including plant, equipment, or
			 services.</text>
					</paragraph></subsection><subsection id="id7A1AC6C089364181AEC4DB6D8C3DF367"><enum>(g)</enum><header>Performance and
			 evaluation</header><text>After selecting entities to become grant recipients
			 and before providing the grant payments, the Secretary shall negotiate
			 performance measures, with expected levels of performance, with the entities.
			 The Secretary shall use the performance measures to evaluate the
			 entities</text>
				</subsection></section><section id="id3E97EEBEF3274B258CD6D82D56283A4F"><enum>204.</enum><header>Customized low
			 carbon energy training grants</header>
				<subsection id="idC4B4C0EE966C4E3E86431901E5142631"><enum>(a)</enum><header>In
			 general</header><text>Using funds authorized under section 205, the Secretary
			 shall award low carbon energy training grants on a competitive basis to
			 eligible entities to provide customized training services to businesses in
			 identified industries, or to businesses in industries that directly support or
			 supply identified industries.</text>
				</subsection><subsection id="id4DF572B918DF4E57A773A098A37DFBC3"><enum>(b)</enum><header>Use of
			 funds</header>
					<paragraph id="idCBAC449A1B634F2489002E6FE4A400A7"><enum>(1)</enum><header>In
			 general</header><text>An eligible entity that receives such a grant shall use
			 the grant funds to pay for the Federal share of the cost to support customized
			 training for incumbent workers, or job seekers identified as having the basic
			 skills likely required for success in an occupation and career within the
			 business and industry involved.</text>
					</paragraph><paragraph id="id15C99F3DAED54090B7156EA87ACA5E64"><enum>(2)</enum><header>Required
			 activities</header><text>The eligible entity shall use the grant funds
			 to—</text>
						<subparagraph id="id77FD74E9BB6147ABB6630D69F6F87BE7"><enum>(A)</enum><text>assist employers
			 in a low carbon industry that are partners in the eligible entity to address
			 documented skill shortages for which such employers have been unable to find
			 workers with the necessary skills through traditional and readily available
			 sources; and</text>
						</subparagraph><subparagraph id="id7B9E930C77A44AA5AF3045F23926080E"><enum>(B)</enum><text>address technical
			 skill needs, as well as general educational requirements for targeted
			 occupations, in a manner that leads to the attainment, by participating
			 workers, of an industry-recognized credential that has value in the labor
			 market beyond a sponsoring employer and that is portable throughout the
			 industry.</text>
						</subparagraph></paragraph><paragraph id="id677909157BB948F6BED7D88F6B6B2067"><enum>(3)</enum><header>Allowable
			 activities</header><text>The eligible entity may use the funds to carry out 1
			 or more of the following:</text>
						<subparagraph id="idE10142A87B1844809526595E130B67AE"><enum>(A)</enum><text>Assist an
			 employer in developing training plans, improving supervision, increasing
			 advancement of low-skill workers, and strengthening linkages with entities
			 providing workforce investment activities under the Workforce Investment Act of
			 1998 (29 U.S.C. 2801 et seq.), adult education programs, and education and
			 training programs of institutions of higher education.</text>
						</subparagraph><subparagraph id="id5E0A3B8506494A7FA736BDF1FAE6D9CF"><enum>(B)</enum><text>Partner with
			 entities carrying out youth-serving programs (including entities operating Job
			 Corps centers under subtitle C of title I of the Workforce Investment Act of
			 1998 (29 U.S.C. 2801 et seq.), preapprenticeship programs, and YouthBuild
			 programs under section 173A of the Workforce Investment Act of 1998 (29 U.S.C.
			 2918a), where appropriate) and programs targeting populations of individuals
			 underrepresented in the industry, such as veterans and women.</text>
						</subparagraph></paragraph><paragraph id="id8B3B960240EB42AAB50A04802968CB95"><enum>(4)</enum><header>Prohibition</header><text>An
			 eligible entity in a State shall not use the grant funds to attract businesses
			 from other States, or to prevent businesses from moving to other States.</text>
					</paragraph></subsection><subsection id="idE9A24BE505B74C76B950DF103778D235"><enum>(c)</enum><header>Eligible
			 entities</header>
					<paragraph id="idD8FC17815D734EEDA4E0DC067B0638CB"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, an
			 entity shall be a covered entity that meets the requirements of paragraph (2)
			 and submits an application in accordance with subsection (d).</text>
					</paragraph><paragraph id="id3D292D22EBD048BA9EDFBA34BDC639C9"><enum>(2)</enum><header>Covered
			 entities</header><text>For the purposes of this section, covered entities shall
			 be partnerships that include at least 1 of the following:</text>
						<subparagraph id="id569C0F6F8E0D422692F535129A7FF177"><enum>(A)</enum><text>State
			 boards.</text>
						</subparagraph><subparagraph id="id3A83D86F1F224122B4BEAED1CBC47C21"><enum>(B)</enum><text>Local
			 boards.</text>
						</subparagraph><subparagraph id="idAB212F191E1E4A07B86FD30C3F732F6D"><enum>(C)</enum><text>A consortium of
			 State boards or local boards, and an employer in an identified industry, or in
			 an industry that directly supports or supplies an identified industry, that
			 demonstrates a need for customized training.</text>
						</subparagraph><subparagraph id="id28BA4D67E8224DBBA2409EF177A1A87D"><enum>(D)</enum><text>A consortium of
			 State boards or local boards, and a group of employers in an identified
			 industry, or in an industry that directly supports or supplies an identified
			 industry, that demonstrates a need for customized training.</text>
						</subparagraph></paragraph></subsection><subsection id="id747A4B22CDC44AF4A266EC594A7900EA"><enum>(d)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this section, an entity shall submit an
			 application to the Secretary at such time, in such manner, and meeting such
			 requirements as the Secretary may determine to be appropriate. The application
			 shall contain such information as the Secretary may require, including
			 information to enable the Secretary to review the skill standards and
			 credentials to be, as appropriate, developed or used.</text>
				</subsection><subsection id="id53DCC4386F8B495E9EABBAB3BF26E885"><enum>(e)</enum><header>Federal
			 share</header>
					<paragraph id="id319FFB97C9974F07AEFE43455CDDE9D1"><enum>(1)</enum><header>In
			 general</header><text>The Federal share of the cost of training described in
			 subsection (b)(1) shall be a share negotiated between the eligible entity and
			 the Secretary, and shall range from 25 percent to 75 percent based on each of
			 the following factors:</text>
						<subparagraph id="id92F0D8529B4A48EDAE4918E236736535"><enum>(A)</enum><text>If the business
			 receiving the training is in an industry identified in part of the energy
			 efficiency plans of the State or local area.</text>
						</subparagraph><subparagraph id="idAA1F9A7F869B4FFD91FA01B06738894A"><enum>(B)</enum><text>The number of
			 employees employed by the business.</text>
						</subparagraph><subparagraph id="id978EC59400944FA8A4B6155DF116B2E6"><enum>(C)</enum><text>The number of
			 individuals to be trained.</text>
						</subparagraph><subparagraph id="idC90F3DD3CFF44C6E82E562702CAFA5F8"><enum>(D)</enum><text>The level of
			 wages, benefits, and other compensation available to the employees in the
			 occupations involved.</text>
						</subparagraph><subparagraph id="idDAE7B195F1CF4D1097D78988F3A2CDF4"><enum>(E)</enum><text>The demonstrated
			 commitment of the business to providing ongoing training, performance
			 improvement opportunities, career advancement, and other benefits to its
			 employees.</text>
						</subparagraph><subparagraph id="idC60FEB2563D5436BBA30B1AF37F6D7A7"><enum>(F)</enum><text>Other factors as
			 determined appropriate by the State board or local board involved.</text>
						</subparagraph></paragraph><paragraph id="id548BB239870E442084AA59FDCE1493C4"><enum>(2)</enum><header>Non-federal
			 share</header><text>The eligible entity may provide the non-Federal share in
			 cash or in kind, fairly evaluated, including plant, equipment, or
			 services.</text>
					</paragraph></subsection><subsection id="idD6582AC1C6FC4200BB6C143CF3895A78"><enum>(f)</enum><header>Performance and
			 evaluation</header>
					<paragraph id="id198521EA0E9F42AA8B9125D51281B7EA"><enum>(1)</enum><header>Performance
			 measures</header><text>After selecting entities to become grant recipients and
			 before providing the grant payments, the Secretary shall—</text>
						<subparagraph id="id9ED44ED5DC7D461AAE5916473A59B90B"><enum>(A)</enum><text>negotiate
			 performance measures, with expected levels of performance, with the entities;
			 and</text>
						</subparagraph><subparagraph id="id7CD94DA072814418BA78B7F678A2C0F6"><enum>(B)</enum><text>require the
			 attainment of industry-recognized credentials, as identified in the application
			 submitted under subsection (d), to be included as a performance measure.</text>
						</subparagraph></paragraph><paragraph id="id170B3CFE69544D429B1FE1C253AAE5D6"><enum>(2)</enum><header>Evaluation</header><text>The
			 Secretary shall use the performance measures to evaluate the entities.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idEDD0947232AE4CC6B856DEC838491E99" section-type="subsequent-section"><enum>205.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to carry out this title $2,000,000,000 for each
			 of the fiscal years 2011 through 2016.</text>
			</section></title><title id="idBCEADEF9EC4E4DC1B9C091EA39A50B1D"><enum>III</enum><header>Miscellaneous</header>
			<section id="id01443087F11B4DF49DC60A04CBB5B230"><enum>301.</enum><header>Clarification
			 of application of grants for specified energy property to certain regulated
			 companies</header>
				<subsection id="idA614E52436A240389AE336247D241770"><enum>(a)</enum><header>In
			 general</header><text>The first sentence of section 1603(f) of division B of
			 the American Recovery and Reinvestment Act of 2009 is amended by inserting
			 <quote>(other than subsection (d)(2) thereof)</quote> after <quote>section 50
			 of the Internal Revenue Code of 1986</quote>.</text>
				</subsection><subsection id="id0163339BAA62450A96AF4A438A0A4F4B"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall take effect as if
			 included in section 1603 of division B of the American Recovery and
			 Reinvestment Act of 2009.</text>
				</subsection></section><section id="ID63708b5adc724017b2f523648ea49c46"><enum>302.</enum><header>Applicability
