		  Marketing</header>
			</appropriations-intermediate><appropriations-intermediate commented="no" id="id2F75EF9950A142D7936D1128778D87DD"><header display-inline="yes-display-inline">Office of the Secretary</header><text display-inline="no-display-inline">For necessary expenses of the Office of the
		  Secretary of Agriculture, $5,338,000: 
		  <proviso><italic>Provided</italic></proviso>, That not to exceed
		  $11,000 of this amount shall be available for
		  official reception and representation expenses, not otherwise provided for, as
		  determined by the Secretary.</text>
			</appropriations-intermediate><appropriations-intermediate commented="no" id="idBA61689282B74D2EA9A293D0F3201C6C"><header display-inline="yes-display-inline">Office of tribal relations</header><text display-inline="no-display-inline">For necessary expenses of the Office of
		  Tribal Relations, $1,010,000, to support
		  communication and consultation activities with Federally Recognized Tribes, as
		  well as other requirements established by
		  law.</text>
			</appropriations-intermediate><appropriations-small commented="no" id="id05E835C908C9400CACB0992FF7DFFE25"><header display-inline="yes-display-inline">HEALTHY FOOD FINANCING
		  INITIATIVE</header><text display-inline="no-display-inline">For necessary
		  expenses of the Secretary to carry out demonstration projects to increase
		  access to healthy foods through retail outlets in predominantly rural areas,
		  $15,000,000, to remain available until September
		  30, 2012, which the Secretary may use for the cost of grants (including for
		  technical assistance), loans, and loan guarantees; and may use, not to exceed
		  $400,000, for the Federal administrative costs
		  of carrying out and evaluating such demonstration projects: 
		  <proviso><italic>Provided</italic></proviso>, That in addition, to
		  further enable the Secretary to carry out such demonstration projects, the
		  Secretary may also reserve a total, in aggregate, of up to
		  $15,000,000 of the funds made available in this
		  or any other Act for programs currently administered by the Secretary and
		  described in section 379E and paragraphs (1) and (3) of section 381E(d)(1)of
		  the Consolidated Farm and Rural Development Act (7 U.S.C. 2008s and 2009d(d)(1)
		  and (3)); 7 U.S.C. 1932 note; and section 6 of the Farmer-to-Consumer Direct
		  Marketing Act of 1976 (7 U.S.C. 3005):

		  the Secretary, under the prior proviso, may reserve not more than 10 percent of
		  the funding available for a specific program activity for the programs

		  consolidated solicitation and application processes:

		  authorized to transfer funds from a Departmental agency to this account to
		  recover the full cost of the space and security expenses of that agency that
		  are funded by this account when the actual costs exceed the agency estimate
		  which will be available for the activities and payments described

		  shall be equalized by a payment of money to the grantor which shall not exceed
		  25 percent of the total value of the land or interests transferred out of

		  hereunder shall be available for the operation and maintenance of aircraft and
		  the purchase of not to exceed one for replacement only:<proviso><italic> Provided further,</italic></proviso> That appropriations
		  hereunder shall be available pursuant to 7 U.S.C. 2250 for the construction,
		  alteration, and repair of buildings and improvements, but unless otherwise
		  provided, the cost of constructing any one building shall not exceed
		  $375,000, except for headhouses or greenhouses
		  which shall each be limited to $1,200,000, and
		  except for 10 buildings to be constructed or improved at a cost not to exceed
		  $750,000 each, and the cost of altering any one
		  building during the fiscal year shall not exceed 10 percent of the current
		  replacement value of the building or $375,000,
		  whichever is greater:<proviso><italic> Provided
			 further,</italic></proviso> That the limitations on alterations contained in
		  this Act shall not apply to modernization or replacement of existing facilities
		  at Beltsville, Maryland:<proviso><italic> Provided

		  the purchase of land from the Maine Farmland Trust, Unity, Maine; for the
		  purpose of establishing an organic agricultural research program:<proviso><italic> Provided further,</italic></proviso> That appropriations
		  hereunder shall be available for granting easements at the Beltsville
		  Agricultural Research Center:<proviso><italic> Provided
			 further,</italic></proviso> That the foregoing limitations shall not apply to
		  replacement of buildings needed to carry out the Act of April 24, 1948 (21
		  U.S.C. 113a):<proviso><italic> Provided
			 further,</italic></proviso> That funds may be received from any State, other
		  political subdivision, organization, or individual for the purpose of
		  establishing or operating any research facility or research project of the

		  available for newly constructed units financed by section 515 of the Housing

		  That rental assistance agreements entered into or renewed during the current

		  balances remaining at the end of such one-year agreements may be transferred
		  and used for the purposes of any debt reduction; maintenance, repair, or
		  rehabilitation of any existing projects; preservation; and rental assistance

			 Provided further,</italic></proviso> That rental assistance provided under
		  agreements entered into prior to fiscal year 2011 for a farm labor multi-family
		  housing project financed under section 514 or 516 of the Act may not be
		  recaptured for use in another project until such assistance has remained unused
		  for a period of 12 consecutive months, if such project has a waiting list of
		  tenants seeking such assistance or the project has rental assistance eligible
		  tenants who are not receiving such assistance:<proviso><italic>
			 Provided further,</italic></proviso> That such recaptured rental assistance
		  shall, to the extent practicable, be applied to another farm labor multifamily
		  housing project financed under section 514 or 516 of the
		  Act.</text>
			</appropriations-small><appropriations-small commented="no" id="id758C462048514441AFCA341A73A087A6"><header display-inline="yes-display-inline">Multi-family housing revitalization program
		  account</header><text display-inline="no-display-inline">For the rural housing
		  voucher program as authorized under section 542 of the Housing Act of 1949, but
		  notwithstanding subsection (b) of such section, for the cost to conduct a
		  housing demonstration program to provide revolving loans for the preservation
		  of low-income multi-family housing projects, and for additional costs to
		  conduct a demonstration program for the preservation and revitalization of
		  multi-family rental housing properties described in this paragraph,
		  $44,055,000, to remain available until expended:
		  
		  <proviso><italic>Provided</italic></proviso>, That of the funds made
		  available under this heading, $16,400,000, shall
		  be available for rural housing vouchers to any low-income household (including
		  those not receiving rental assistance) residing in a property financed with a
		  section 515 loan which has been prepaid after September 30, 2005:<proviso><italic> Provided further,</italic></proviso> That the amount of
		  such voucher shall be the difference between comparable market rent for the
		  section 515 unit and the tenant paid rent for such unit:<proviso><italic> Provided further,</italic></proviso> That funds made
		  available for such vouchers shall be subject to the availability of annual
		  appropriations:<proviso><italic> Provided
			 further,</italic></proviso> That the Secretary shall, to the maximum extent
		  practicable, administer such vouchers with current regulations and
		  administrative guidance applicable to section 8 housing vouchers administered
		  by the Secretary of the Department of Housing and Urban Development:<proviso><italic> Provided further,</italic></proviso> That if the
		  Secretary determines that the amount made available for vouchers in this or any
		  other Act is not needed for vouchers, the Secretary may use such funds for the
		  demonstration programs for the preservation and revitalization of multi-family
		  rental housing properties described in this paragraph:<proviso><italic> Provided further,</italic></proviso> That of the funds
		  made available under this heading, $2,655,000
		  shall be available for the cost of loans to private nonprofit organizations, or
		  such nonprofit organizations' affiliate loan funds and State and local housing
		  finance agencies, to carry out a housing demonstration program to provide
		  revolving loans for the preservation of low-income multi-family housing
		  projects:<proviso><italic> Provided further,</italic></proviso>
		  That loans under such demonstration program shall have an interest rate of not
		  more than 1 percent direct loan to the recipient:<proviso><italic>
			 Provided further,</italic></proviso> That the Secretary may defer the interest
		  and principal payment to the Rural Housing Service for up to 3 years and the
		  term of such loans shall not exceed 30 years:<proviso><italic>
			 Provided further,</italic></proviso> That of the funds made available under
		  this heading, $25,000,000 shall be available for
		  a demonstration program for the preservation and revitalization of the sections
		  514, 515, and 516 multi-family rental housing properties to restructure
		  existing USDA multi-family housing loans, as the Secretary deems appropriate,
		  expressly for the purposes of ensuring the project has sufficient resources to
		  preserve the project for the purpose of providing safe and affordable housing
		  for low-income residents and farm laborers including reducing or eliminating
		  interest; deferring loan payments, subordinating, reducing or reamortizing loan
		  debt; and other financial assistance including advances, payments and
		  incentives (including the ability of owners to obtain reasonable returns on
		  investment) required by the Secretary:<proviso><italic> Provided
			 further,</italic></proviso> That the Secretary shall as part of the
		  preservation and revitalization agreement obtain a restrictive use agreement
		  consistent with the terms of the restructuring:<proviso><italic>

		  to a qualified non-profit multi-state regional technical assistance
		  organization, with experience in working with small communities on water and
		  waste water problems, the principal purpose of such grant shall be to assist
		  rural communities with populations of 3,300 or less, in improving the planning,
		  financing, development, operation, and management of water and waste water
		  systems, and of which not less than $800,000
		  shall be for a qualified national Native American organization to provide
		  technical assistance for rural water systems for tribal communities:<proviso><italic> Provided further,</italic></proviso> That not to exceed
		  $15,000,000 of the amount appropriated under
		  this heading shall be for contracting with qualified national organizations for
		  a circuit rider program to provide technical assistance for rural water

		  That of the amount appropriated under this heading, the amount equal to the
		  amount of Rural Water and Waste Disposal Program Account funds allocated by the
		  Secretary for Rural Economic Area Partnership Zones for the fiscal year 2010,

			 unobligated balances of discretionary funds appropriated by this Act or other
			 available unobligated discretionary balances of the Department of Agriculture
			 to the Working Capital Fund for the acquisition of plant and capital equipment
			 necessary for the delivery of financial, administrative, and information
			 technology services of primary benefit to the agencies of the Department of
			 Agriculture: 
			 <proviso><italic>Provided</italic></proviso>, That none of the funds
			 made available by this Act or any other Act shall be transferred to the Working
			 Capital Fund without the prior approval of the agency administrator:<proviso><italic> Provided further,</italic></proviso> That none of the
			 funds transferred to the Working Capital Fund pursuant to this section shall be
			 available for obligation without written notification to and the prior approval
			 of the Committees on Appropriations of both Houses of Congress:<proviso><italic> Provided further,</italic></proviso> That none of the
			 funds appropriated by this Act or made available to the Department's Working
			 Capital Fund shall be available for obligation or expenditure to make any
			 changes to the Department's National Finance Center without written
			 notification to and prior approval of the Committees on Appropriations of both
			 Houses of Congress as required by section 711 of this Act:<proviso><italic> Provided further,</italic></proviso> That of annual
			 income amounts in the Working Capital Fund of the Department of Agriculture
			 allocated for the National Finance Center, the Secretary may reserve not more
			 than 4 percent for the replacement or acquisition of capital equipment,
			 including equipment for the improvement and implementation of a financial
			 management plan, information technology, and other systems of the National
			 Finance Center or to pay any unforeseen, extraordinary cost of the National
			 Finance Center:<proviso><italic> Provided
				further,</italic></proviso> That none of the amounts reserved shall be
			 available for obligation unless the Secretary submits written notification of
			 the obligation to the Committees on Appropriations of the House of
			 Representatives and the Senate:<proviso><italic> Provided
				further,</italic></proviso> That the limitation on the obligation of funds
			 pending notification to Congressional Committees shall not apply to any
			 obligation that, as determined by the Secretary, is necessary to respond to a
			 declared state of emergency that significantly impacts the operations of the
			 National Finance Center; or to evacuate employees of the National Finance
			 Center to a safe haven to continue operations of the National Finance
			 Center.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idC887808AA16F490AA063880492A33FC3" section-type="subsequent-section"><enum>703.</enum><text display-inline="yes-display-inline">No part of any appropriation contained in
			 this Act shall remain available for obligation beyond the current fiscal year
			 unless expressly so provided herein.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idAAA786C26E48435DB37832AF7EE2E27F" section-type="subsequent-section"><enum>704.</enum><text display-inline="yes-display-inline">No funds appropriated by this Act may be
			 used to pay negotiated indirect cost rates on cooperative agreements or similar
			 arrangements between the United States Department of Agriculture and nonprofit
			 institutions in excess of 10 percent of the total direct cost of the agreement
			 when the purpose of such cooperative arrangements is to carry out programs of
			 mutual interest between the two parties. This does not preclude appropriate
			 payment of indirect costs on grants and contracts with such institutions when
			 such indirect costs are computed on a similar basis for all agencies for which
			 appropriations are provided in this Act.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id20E44EED0ADC4518B6EE8E7E409307E2" section-type="subsequent-section"><enum>705.</enum><text display-inline="yes-display-inline">Appropriations to the Department of
			 Agriculture for the cost of direct and guaranteed loans made available in the
			 current fiscal year shall remain available until expended to disburse
			 obligations made in the current fiscal year for the following accounts: the
			 Rural Development Loan Fund program account, the Rural Electrification and
			 Telecommunication Loans program account, and the Rural Housing Insurance Fund
			 program account.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idCDF4E13F77034CC295BB729917E9123F" section-type="subsequent-section"><enum>706.</enum><text display-inline="yes-display-inline">Of the funds made available by this Act,
			 not more than $1,800,000 shall be used to cover
			 necessary expenses of activities related to all advisory committees, panels,
			 commissions, and task forces of the Department of Agriculture, except for
			 panels used to comply with negotiated rule makings and panels used to evaluate
			 competitively awarded grants.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id00E3F65A196144CDBE7F3849E6EADCA3" section-type="subsequent-section"><enum>707.</enum><text display-inline="yes-display-inline">Hereafter, none of the funds appropriated
			 by this Act may be used to carry out section 410 of the Federal Meat Inspection
			 Act (21 U.S.C. 679a) or section 30 of the Poultry Products Inspection Act (21
			 U.S.C. 471).</text>
			</section><section commented="no" display-inline="no-display-inline" id="id90F273DF7FA244EDBD213DBDBF2527F7" section-type="subsequent-section"><enum>708.</enum><text display-inline="yes-display-inline">No employee of the Department of
			 Agriculture may be detailed or assigned from an agency or office funded by this
			 Act or any other Act to any other agency or office of the Department for more
			 than 30 days unless the individual's employing agency or office is fully
			 reimbursed by the receiving agency or office for the salary and expenses of the
			 employee for the period of assignment.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id41DE3774A1FB45619397F02F742A7E49" section-type="subsequent-section"><enum>709.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
			 made available to the Department of Agriculture or the Food and Drug
			 Administration shall be used to transmit or otherwise make available to any
			 non-Department of Agriculture or non-Department of Health and Human Services
			 employee questions or responses to questions that are a result of information
			 requested for the appropriations hearing process.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id5F62E064E15C458C9A9CA4CC841E7783" section-type="subsequent-section"><enum>710.</enum><text display-inline="yes-display-inline">None of the funds made available to the
			 Department of Agriculture by this Act may be used to acquire new information
			 technology systems or significant upgrades, as determined by the Office of the
			 Chief Information Officer, without the approval of the Chief Information
			 Officer and the concurrence of the Executive Information Technology Investment
			 Review Board: 
			 <proviso><italic>Provided</italic></proviso>, That notwithstanding
			 any other provision of law, none of the funds appropriated or otherwise made
			 available by this Act may be transferred to the Office of the Chief Information
			 Officer without written notification to and the prior approval of the
			 Committees on Appropriations of both Houses of Congress:<proviso><italic> Provided further,</italic></proviso> That none of the
			 funds available to the Department of Agriculture for information technology
			 shall be obligated for projects over $25,000
			 prior to receipt of written approval by the Chief Information Officer.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idA27C1DDA6EBB416BB1E72C7DE85C99C6" section-type="subsequent-section"><enum>711.</enum><subsection commented="no" display-inline="yes-display-inline" id="idB65063EB9DE343AFA605E59EF3B2729F"><enum>(a)</enum><text display-inline="yes-display-inline">None of the funds provided by this Act, or
			 provided by previous Appropriations Acts to the agencies funded by this Act
			 that remain available for obligation or expenditure in the current fiscal year,
			 or provided from any accounts in the Treasury of the United States derived by
			 the collection of fees available to the agencies funded by this Act, shall be
			 available for obligation or expenditure through a reprogramming or transfer of
			 funds which—</text>

					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9D9D1AA6480D4A6F95188ED483529FC8"><enum>(5)</enum><text display-inline="yes-display-inline">reorganizes offices, programs, or
			 activities; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13EFEE6728124BD0AB1E1AE74C4C6BB4"><enum>(6)</enum><text display-inline="yes-display-inline">contracts out or privatizes any functions
			 or activities presently performed by Federal employees; unless the Committees
			 on Appropriations of both Houses of Congress are notified in writing 30 days in
			 advance of such reprogramming or transfer of funds.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1835DE5BFD5A415DB4FA18A2497C75D5"><enum>(b)</enum><text display-inline="yes-display-inline">None of the funds provided by this Act, or
			 provided by previous Appropriations Acts to the agencies funded by this Act
			 that remain available for obligation or expenditure in the current fiscal year,
			 or provided from any accounts in the Treasury of the United States derived by
			 the collection of fees available to the agencies funded by this Act, shall be
			 available for obligation or expenditure for activities, programs, or projects
			 through a reprogramming of funds in excess of
			 $500,000 or 10 percent, whichever is less, that:
			 (1) augments existing programs, projects, or activities; (2) reduces by 10
			 percent funding for any existing program, project, or activity, or numbers of
			 personnel by 10 percent as approved by Congress; or (3) results from any
			 general savings from a reduction in personnel which would result in a change in
			 existing programs, activities, or projects as approved by Congress; unless the
			 Committees on Appropriations of both Houses of Congress are notified in writing
			 30 days in advance of such reprogramming of funds.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8AC3E293480340D7AB2CBCC1AF37A9B5"><enum>(c)</enum><text display-inline="yes-display-inline">The Secretary of Agriculture or the
			 Secretary of Health and Human Services shall notify in writing the Committees
			 on Appropriations of both Houses of Congress before implementing a program or
			 activity not carried out during the previous fiscal year unless the program or
			 activity is funded by this Act or specifically funded by any other Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id8EC4BB47B9294A518BC94760A838D77A" section-type="subsequent-section"><enum>712.</enum><text display-inline="yes-display-inline">None of the funds appropriated by this or
			 any other Act shall be used to pay the salaries and expenses of personnel who
			 prepare or submit appropriations language as part of the President's Budget
			 submission to the Congress of the United States for programs under the
			 jurisdiction of the Appropriations Subcommittees on Agriculture, Rural
			 Development, Food and Drug Administration, and Related Agencies that assumes
			 revenues or reflects a reduction from the previous year due to user fees
			 proposals that have not been enacted into law prior to the submission of the
			 Budget unless such Budget submission identifies which additional spending
			 reductions should occur in the event the user fees proposals are not enacted
			 prior to the date of the convening of a committee of conference for the fiscal
			 year 2012 appropriations Act.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id2E41497EA9624E7FB48F263EBD29EA2F" section-type="subsequent-section"><enum>713.</enum><text display-inline="yes-display-inline">None of the funds made available by this or
			 any other Act may be used to close or relocate a Rural Development office
			 unless or until the Secretary of Agriculture determines the cost effectiveness
			 and/or enhancement of program delivery: 
			 <proviso><italic>Provided</italic></proviso>, That not later than 120
			 days before the date of the proposed closure or relocation, the Secretary
			 notifies in writing the Committees on Appropriation of the House and Senate,
			 and the members of Congress from the State in which the office is located of
			 the proposed closure or relocation and provides a report that describes the
			 justifications for such closures and relocations.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id25038D41EE9741CAAAEA5132FC8E8EB3" section-type="subsequent-section"><enum>714.</enum><text display-inline="yes-display-inline">None of the funds made available to the
			 Food and Drug Administration by this Act shall be used to close or relocate, or
			 to plan to close or relocate, the Food and Drug Administration Division of
			 Pharmaceutical Analysis in St. Louis, Missouri, outside the city or county
			 limits of St. Louis, Missouri.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id092D8B9468AD48DAA581CC109E08ACA0" section-type="subsequent-section"><enum>715.</enum><text display-inline="yes-display-inline">None of the funds made available in fiscal
			 year 2010 or preceding fiscal years for programs authorized under the Food for
			 Peace Act (7 U.S.C. 1691 et seq.) in excess of
			 $20,000,000 shall be used to reimburse the
			 Commodity Credit Corporation for the release of eligible commodities under
			 section 302(f)(2)(A) of the Bill Emerson Humanitarian Trust Act (7 U.S.C.
			 1736f–1): 
			 <proviso><italic>Provided</italic></proviso>, That any such funds
			 made available to reimburse the Commodity Credit Corporation shall only be used
			 pursuant to section 302(b)(2)(B)(i) of the Bill Emerson Humanitarian Trust
			 Act.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id1A05214C5E124C318D1F0210E9B67C27" section-type="subsequent-section"><enum>716.</enum><text display-inline="yes-display-inline">There is hereby appropriated
			 $8,000,000, to remain available until expended,
			 for a grant to the National Center for Natural Products Research for
			 construction or renovation to carry out the research objectives of the natural
			 products research grant issued by the Food and Drug Administration.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id4BECA5CFB1EA4DE8AD7DA05A6EA05E89" section-type="subsequent-section"><enum>717.</enum><text display-inline="yes-display-inline">Funds made available under section 1240I
			 and section 1241(a) of the Food Security Act of 1985 and section 524(b) of the
			 Federal Crop Insurance Act (7 U.S.C. 1524(b)) in the current fiscal year shall
			 remain available until expended to disburse obligations made in the current
			 fiscal year.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idB41A64B01F184B74A1D3C390D40E534E" section-type="subsequent-section"><enum>718.</enum><text display-inline="yes-display-inline">None of the funds appropriated or otherwise
			 made available by this or any other Act shall be used to pay the salaries and
			 expenses of personnel to carry out in fiscal year 2011 the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF2475C1B49B34EEEB81A532801AEBE73"><enum>(1)</enum><text display-inline="yes-display-inline">A Wetlands Reserve Program as authorized by
			 sections 1237–1237F of the Food Security Act of 1985, as amended (16 U.S.C.
			 3837), to enroll in excess of 220,000 acres.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0DA7F050CB4D445E92D576260E835496"><enum>(2)</enum><text display-inline="yes-display-inline">A Grasslands Reserve Program as authorized
			 by subchapter D of chapter 2 of subtitle D of title XII of the Food Security
			 Act of 1985, as amended (16 U.S.C. 3838n–3838q), to enroll in excess of 245,830
			 acres.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id027A8CCB898541959B75513BCD8D34CA"><enum>(3)</enum><text display-inline="yes-display-inline">A Farmland Protection Program as authorized
			 by subchapter B of chapter 2 of subtitle D of title XII of the Food Security
			 Act of 1985, as amended (16 U.S.C. 3838h–3838i), in excess of
			 $160,000,000.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id78B21892278041AB824016C9E419838B"><enum>(4)</enum><text display-inline="yes-display-inline">An Agricultural Management Assistance
			 Program as authorized by section 524 of the Federal Crop Insurance Act, as
			 amended (7 U.S.C. 1524), in excess of $2,500,000
			 for the Natural Resources Conservation Service.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FF33556E2DE48C583043663B2228978"><enum>(5)</enum><text display-inline="yes-display-inline">An Environmental Quality Incentives Program
			 as authorized by sections 1240–1240 H of the Food Security of 1985, as amended
			 (16 U.S.C. 3839aa–3839aa(8), in excess of
			 $1,318,000,000.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id56D22F2B278144BAA9B8579F22C3F25B"><enum>(6)</enum><text display-inline="yes-display-inline">A program authorized by section 14(h)(1 of
			 the Watershed Protection and Flood Prevention Act (16 U.S.C. 1012(h)(1).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id606D296A38114B04AE68A7B15F869336"><enum>(7)</enum><text display-inline="yes-display-inline">A program under subsection (b)(2)(A)(iii)
			 of section 14222 of Public Law 110–246 in excess of
			 $1,052,000,000: 
			 <proviso><italic>Provided</italic></proviso>, That none of the funds
			 made available in this Act or any other Act shall be used for salaries and
			 expenses to carry out section 19(i)(1)(D) of the Richard B. Russell National
			 School Lunch Act as amended by section 4304 of Public Law 110–246 in excess of
			 $37,000,000, including the transfer of funds
			 under subsection (c) of section 14222 of Public Law 110–246, until October 1,
			 2011:<proviso><italic> Provided further,</italic></proviso> That
			 $113,000,000 made available on October 1, 2011,
			 to carry out section 19(i)(1)(D) of the Richard B. Russell National School
			 Lunch Act as amended by section 4304 of Public Law 110–246 shall be excluded
			 from the limitation described in subsection (b)(2)(A)(iv) of section 14222 of
			 Public Law 110–246:<proviso><italic> Provided
				further,</italic></proviso> That of the amounts made available under subsection
			 (b)(2)(A)(iii) of section 14222 of Public Law 110–246 to carry out section 32
			 activities in fiscal year 2011, $50,000,000 are
			 hereby rescinded.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id876B43627AF64851BC8CED78FA3608EC" section-type="subsequent-section"><enum>719.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 any former RUS borrower that has repaid or prepaid an insured, direct or
			 guaranteed loan under the Rural Electrification Act, or any not-for-profit
			 utility that is eligible to receive an insured or direct loan under such Act,
			 shall be eligible for assistance under section 313(b)(2)(B) of such Act in the
			 same manner as a borrower under such Act.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id1EE94FEAB9734C31AC811C0267E8D2A9" section-type="subsequent-section"><enum>720.</enum><text display-inline="yes-display-inline">There is hereby appropriated
			 $2,600,000, to remain available until expended,
			 for the construction and interim operations for establishment of an
			 agricultural pest facility in the State of Hawaii.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id79682A7DBE0D4A5C8B75DC12B5CEF920" section-type="subsequent-section"><enum>721.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Agriculture shall consider—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC7CBFB1433D14881B95805D044805453"><enum>(1)</enum><text display-inline="yes-display-inline">the town of Brattleboro, Vermont,
			 (including individuals and entities with projects within the town) eligible for
			 loans and grants funded through the Rural Utilities Service water and waste
			 disposal program; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3D6D4FEB2BE848AABD72B2C641C5EFE0"><enum>(2)</enum><text display-inline="yes-display-inline">the cities of Greenwood, South Carolina,
			 and Paragould, Arkansas, (including individuals and entities with projects
			 within the cities) eligible for loans and grants funded through the Rural
			 Community Facilities Program Account.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idBE836F31C1834623B35BAEF7B8885293" section-type="subsequent-section"><enum>722.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 there is hereby appropriated:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id01F03CD16AF9417E862FEAB3C541D293"><enum>(1)</enum><text display-inline="yes-display-inline">$3,000,000
			 of which $2,000,000 shall be for a grant to the
			 Wisconsin Department of Agriculture, Trade, and Consumer Protection, and
			 $1,000,000 shall be for a grant to the Vermont
			 Agency of Agriculture, Foods, and Markets, as authorized by section 6402 of the
			 Farm Security and Rural Investment Act of 2002 (7 U.S.C. 1621 note); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id262D618E34844498B4547C8D2AADB9E1"><enum>(2)</enum><text display-inline="yes-display-inline">$350,000 for
			 a grant to the Wisconsin Department of Agriculture, Trade and Consumer
			 Protection.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idD8F42309EC554F0ABB70E5B39D9A259F" section-type="subsequent-section"><enum>723.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Natural Resources Conservation Service shall provide financial and
			 technical assistance—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idF6B047CADF324D648C1E83E6CA68ECFD"><enum>(1)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Cooper Mine Brooke Watershed project in the
			 State of Connecticut;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1E9608BDD9FD404E85EB454E785D64F1"><enum>(2)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the East Locust Creek Watershed Plan Revision
			 in Missouri, including up to 100 percent of the engineering assistance and 75
			 percent cost share for construction cost of site RW1;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBC96590972F146C7B01E7300A271F9AD"><enum>(3)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Little Otter Creek Watershed project in
			 Missouri. The sponsoring local organization may obtain land rights by perpetual
			 easements;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id61C6C1A4029246D4A5F77EADC7FD44DC"><enum>(4)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Lake County Watershed in the State of
			 Illinois;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1227348A401B463984D96C77477C40C8"><enum>(5)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Dunloup Creek Watershed project in Fayette
			 and Raleigh Counties, West Virginia;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEB7D8292482B4C40B851166621027770"><enum>(6)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the North Fork of Elkhorn Creek Watershed
			 project in the State of West Virginia;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCC492D41E32F4945946D61A2557A953F"><enum>(7)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Pocasset River Floodplain Management
			 project in the State of Rhode Island; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13CE219739BD43D4909FFC50C28AC68A"><enum>(8)</enum><text display-inline="yes-display-inline">through the Watershed and Flood Prevention
			 Operations program to carry out the Southeast Quadrant Drainage and Flood
			 Prevention project in the State of Alabama.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id105E637719AA406EA56500867E12B6C2" section-type="subsequent-section"><enum>724.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 for the purposes of a grant under section 412 of the Agricultural Research,
			 Extension, and Education Reform Act of 1998, none of the funds in this or any
			 other Act may be used to prohibit the provision of in-kind support from
			 non-Federal sources under section 412(e)(3) in the form of unrecovered indirect
			 costs not otherwise charged against the grant, consistent with the indirect
			 rate of cost approved for a recipient.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id0FF8D9A1BA664ACFA24AE0C87CB2DF5E" section-type="subsequent-section"><enum>725.</enum><text display-inline="yes-display-inline">Except as otherwise specifically provided
			 by law, unobligated balances remaining available at the end of the fiscal year
			 from appropriations made available for salaries and expenses in this Act for
			 the Farm Service Agency and the Rural Development mission area, shall remain
			 available through September 30, 2012, for information technology
			 expenses.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id8E2BE7CACBF94AD8A2064F0EFF5D4F17" section-type="subsequent-section"><enum>726.</enum><text display-inline="yes-display-inline">There is hereby appropriated
			 $2,600,000 to carry out section 1621 of Public
			 Law 110–246 and $3,000,000, to remain available
			 until expended, to carry out section 1613 of Public Law 110–246.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id2F21727187EE4B7E8B26301EABEF95C5" section-type="subsequent-section"><enum>727.</enum><text display-inline="yes-display-inline">There is hereby appropriated
			 $800,000 to the Farm Service Agency to carry out
			 a pilot program to demonstrate the use of new technologies that increase the
			 rate of growth of re-forested hardwood trees on private non-industrial forests
			 lands, enrolling lands on the coast of the Gulf of Mexico that were damaged by
			 Hurricane Katrina in 2005.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id73CE1D21DF1A4B1A831FDE7A922B9465" section-type="subsequent-section"><enum>728.</enum><text display-inline="yes-display-inline">The Secretary of Agriculture may authorize
			 a State agency to use funds provided in this Act to exceed the maximum amount
			 of liquid infant formula specified in 7 C.F.R. 246.10 when issuing liquid
			 infant formula to participants.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id0760BD715C9043E7A273BFB24EA8B175" section-type="subsequent-section"><enum>729.</enum><subsection commented="no" display-inline="yes-display-inline" id="idBA9259CD52694D78BD962B460992324C"><enum>(a)</enum><header display-inline="yes-display-inline">Department of Agriculture Assistance During
			 Pandemic Emergency</header><text display-inline="yes-display-inline">During
			 fiscal year 2011, in any case in which a school is closed for at least 5
			 consecutive days during a pandemic emergency designation, each household
			 containing at least 1 member who is an eligible child attending the school
			 shall be eligible to receive assistance pursuant to a State agency plan
			 approved under subsection (b).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idD0CAAC1C1C5940AF88C52220B6012090"><enum>(b)</enum><header display-inline="yes-display-inline">Assistance</header><text display-inline="yes-display-inline">To carry out this section, the Secretary of
			 Agriculture may approve State agency plans for temporary emergency standards of
			 eligibility and levels of benefits under the Food and Nutrition Act of 2008 (7
			 U.S.C. 2011 et seq.) for households with eligible children. Plans approved by
			 the Secretary may provide for supplemental allotments to households receiving
			 benefits under such Act, and issuances to households not already receiving
			 benefits. Such level of benefits shall be determined by the Secretary in an
			 amount not less than the value of meals at the free rate over the course of 5
			 school days for each eligible child in the household.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE1BB36785DD647F2A92C30ECCCB2BD1F"><enum>(c)</enum><header display-inline="yes-display-inline">Minimum Closure Requirement</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall not
			 provide assistance under this section in the case of a school that is closed
			 for less than 5 consecutive days.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC5FCA8B0DB2A41C292AA3E5E1AA46053"><enum>(d)</enum><header display-inline="yes-display-inline">Use of EBT System</header><text display-inline="yes-display-inline">A State agency may provide assistance under
			 this section through the EBT card system established under section 7 of the
			 Food and Nutrition Act of 2008 (7 U.S.C. 2016).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3938BBF56CE6486FA9BECCCE6C8893A2"><enum>(e)</enum><header display-inline="yes-display-inline">Release of Information</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Agriculture may authorize State educational agencies and
			 school food authorities administering a school lunch program under the Richard
			 B. Russell National School Lunch Act (42 U.S.C. 1751 et seq.) to release to
			 appropriate officials administering the supplemental nutrition assistance
			 program such information as may be necessary to carry out this section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id7FEFC694173E4B69B0AA488ACA650FCE"><enum>(f)</enum><header display-inline="yes-display-inline">Waivers</header><text display-inline="yes-display-inline">To facilitate implementation of this
			 section, the Secretary of Agriculture may approve waivers of the limits on
			 certification periods otherwise applicable under section 3(f) of the Food and
			 Nutrition Act of 2008 (7 U.S.C. 2012(f)), reporting requirements otherwise
			 applicable under section 5(f) of such Act (7 U.S.C. 2014(f)), and other
			 administrative requirements otherwise applicable to State agencies under such
			 Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2ADFBB37EFF744F19C407761AAB31CE3"><enum>(g)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall use
			 funds made available under the Food and Nutrition Act of 2008 (7 U.S.C. 2011 et
			 seq.) to fund, with the exception of the commodities described in subsection
			 (h), benefits provided under this section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idA7633F02E61542F1B258A3156C041EFF"><enum>(h)</enum><header display-inline="yes-display-inline">Availability of Commodities</header><text display-inline="yes-display-inline">During fiscal year 2011, the Secretary of
			 Agriculture may utilize funds appropriated under section 32 of the Act of
			 August 24, 1935 (7 U.S.C. 612c) to purchase commodities for emergency
			 distribution in any area of the United States during a pandemic emergency
			 designation.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC1CD8C546AC340EE8D3DFC66F9B01BDB"><enum>(i)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id6F6A86F5684D43F387C47880290C8E8E"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>eligible child</quote>
			 means a child (as defined in section 12(d) of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1760(d)) who, if not for the closure of the school
			 attended by the child during a pandemic emergency designation and due to
			 concerns about an influenza pandemic, would receive free or reduced price
			 school meals under the Richard B. Russell National School Lunch Act (42 U.S.C.
			 175l et seq.) at the school.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9ECED7412B5A45FD84DCE3ECED5071A1"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>pandemic emergency
			 designation</quote> means the declaration—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5F07EDFA76D44DE79F3E5BFDC45959C5"><enum>(A)</enum><text display-inline="yes-display-inline">of a public health emergency, based on
			 pandemic influenza, by the Secretary of Health and Human Services under section
			 319 of the Public Health Service Act (42 U.S.C. 247d); or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE542B2ECAB9C48729A856E26B944390E"><enum>(B)</enum><text display-inline="yes-display-inline">of a domestic emergency, based on pandemic
			 influenza, by the Secretary of Homeland Security.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id34B7E9D82987425586793CA9C804AF66"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>school</quote> has the
			 meaning given the term in section 12(d) of the Richard B. Russell National
			 School Lunch Act (42 U.S.C. 1760(d)).</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id8843023CCD37464FBCEC7C1A45D4DDF7" section-type="subsequent-section"><enum>730.</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 school food authorities which received a grant for equipment assistance under
			 the grant program carried out pursuant to the heading <quote>Food and Nutrition
			 Service Child Nutrition Programs</quote> in title I of division A of the
			 American Recovery and Reinvestment Act of 2009 (Public Law 111–5) shall be
			 eligible to receive a grant under section 749 (j) of the Agriculture, Rural
			 Development, Food and Drug Administration, and Related Agencies Appropriations
			 Act, 2010 (Public Law 111–80).</text>
			</section><section commented="no" display-inline="no-display-inline" id="idAA8B61DF242A499EAE7747F37827A00D" section-type="subsequent-section"><enum>731.</enum><text display-inline="yes-display-inline">In the case of each program established or
			 amended by the Food, Conservation, and Energy Act of 2008 (Public Law 110–246),
			 other than by title I or subtitle A of title III of such Act, or programs for
			 which indefinite amounts were provided in that Act that is authorized or
			 required to be carried out using funds of the Commodity Credit
			 Corporation—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idB4F73A90088849C79FA4290438826C54"><enum>(1)</enum><text display-inline="yes-display-inline">such funds shall be available for salaries
			 and related administrative expenses, including technical assistance, associated
			 with the implementation of the program, without regard to the limitation on the
			 total amount of allotments and fund transfers contained in section 11 of the
			 Commodity Credit Corporation Charter Act (15 U.S.C. 714i); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD51EED49B4D245AB996B1ED8DBCE761C"><enum>(2)</enum><text display-inline="yes-display-inline">the use of such funds for such purpose
			 shall not be considered to be a fund transfer or allotment for purposes of
			 applying the limitation on the total amount of allotments and fund transfers
			 contained in such section.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id67D9252802DB4255A53295D94719B141" section-type="subsequent-section"><enum>732.</enum><subsection commented="no" display-inline="yes-display-inline" id="idD5D314437EED4730BEEF77738DBD7705"><enum>(a)</enum><text display-inline="yes-display-inline">Section 502(h)(8) of the Housing Act of
			 1949 (42 U.S.C. 1472(h)(8)) is amended by striking <quote>1</quote> and
			 inserting in lieu thereof <quote>3.5</quote> and inserting at the end thereof
			 the following new sentence: <quote>In addition, the Secretary may collect from
			 the lender an annual fee not to exceed 0.5 percent of the outstanding principal
			 balance of the loan for the life of the loan.</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idBAA64CC73BE34FA5800709D6AB22F51E"><enum>(b)</enum><text display-inline="yes-display-inline">Section 739 of the Agriculture, Rural
			 Development, Food and Drug Administration, and Related Agencies Appropriation
			 Act, 2001 (H.R. 5426 as enacted by Public Law 106–387, 115 Stat. 1549A–34) is
			 repealed.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id9987856D571F4C8ABC3E1252330255D5" section-type="subsequent-section"><enum>733.</enum><text display-inline="yes-display-inline">Hereafter, notwithstanding section
			 310B(g)(5) of the Consolidated Farm and Rural Development Act (7 U.S.C.
			 1932(g)(5)), the Secretary may assess a one-time fee for any guaranteed
			 business and industry loan in an amount that does not exceed 3 percent of the
			 guaranteed principal portion of the loan.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id469CECDC92704D5CA037B948D15D896F" section-type="subsequent-section"><enum>734.</enum><text display-inline="yes-display-inline">Appropriations to the Department of
			 Agriculture made available in fiscal years 2005, 2006, and 2007 to carry out
			 section 601 of the Rural Electrification Act of 1936 (7 U.S.C. 950bb) for the
			 cost of direct loans shall remain available until expended to disburse valid
			 obligations made in fiscal years 2005, 2006, 2007, and 2008.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idC690CA5C32254B0E9A22005BA6E763C4" section-type="subsequent-section"><enum>735.</enum><text display-inline="yes-display-inline">Of the unobligated balances in the
			 Agricultural Research Service, Buildings and Facilities account,
			 $10,066,000 are hereby rescinded: 
			 <proviso><italic>Provided</italic></proviso>, That no amounts may be
			 rescinded from amounts that were designated by the Congress as an emergency
			 requirement pursuant to the Concurrent Resolution on the Budget or the Balanced
			 Budget and Emergency Deficit Control Act of 1985, as amended: 
			 <proviso><italic>Provided further</italic></proviso>,
			 That no amounts may be rescinded from amounts that have received an
			 appropriation since 2007 unless construction of those facilities has been
			 completed.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id97B2B11481024B2B9ABFD3E406D1B041" section-type="subsequent-section"><enum>736.</enum><text display-inline="yes-display-inline">Of the unobligated balances in the Rural
			 Business Program account for the Business and Industry Loan Guarantee Program,
			 $20,070,000, and of the unobligated balances
			 available for the cost of broadband loans,
			 $15,000,000 are hereby
			 rescinded:<proviso><italic> Provided</italic></proviso>, That no amounts may be
			 cancelled from amounts that were designated by the Congress as an emergency
			 requirement pursuant to the Concurrent Resolution on the Budget or the Balanced
			 Budget and Emergency Deficit Control Act of 1985, as amended.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id8494E766FC9D4B668B47DEE47E7DD90D" section-type="subsequent-section"><enum>737.</enum><text display-inline="yes-display-inline">For an additional amount for the
			 <quote>Departmental Administration</quote> account,
			 $1,000,000, to increase the Department's
			 acquisition workforce capacity and capabilities:<proviso><italic>
				Provided</italic></proviso>, That such funds may be transferred by the
			 Secretary to any other account in the Department to carry out the purposes
			 provided herein:<proviso><italic> Provided
				further,</italic></proviso> That such transfer authority is in addition to any
			 other transfer authority provided in this Act:<proviso><italic>
				Provided further,</italic></proviso> That such funds shall be available only to
			 supplement and not to supplant existing acquisition workforce
			 activities:<proviso><italic> Provided further,</italic></proviso>
			 That such funds shall be available for training, recruitment, and retention of
			 additional members of the acquisition workforce as defined by the Office of
			 Federal Procurement Policy Act, as amended (41 U.S.C. 401 et seq.):<proviso><italic> Provided further,</italic></proviso> That such funds
			 shall be available for information technology in support of acquisition
			 workforce effectiveness or for management solutions to improve acquisition
			 management.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id12015913D7534241B901944DA3C06D47" section-type="subsequent-section"><enum>738.</enum><text display-inline="yes-display-inline">The Secretary may reserve, through April 1,
			 2011, up to 5 percent of the funding available for the following items for
			 projects in areas that are engaged in strategic regional development planning
			 as defined by the Secretary: business and industry guaranteed loans; rural
			 development loan fund; rural business enterprise grants; rural business
			 opportunity grants; rural economic development program; rural microenterprise
			 program; biorefinery assistance program; rural energy for America program;
			 value-added producer grants; broadband program; water and waste program; and
			 rural community facilities program.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idDA2DDA5ACA1240B69D036D89FB3D0A57" section-type="subsequent-section"><enum>739.</enum><text display-inline="yes-display-inline">The Agricultural Research Service may
			 convey all rights and title of the United States, to a parcel of land
			 comprising .93 acres, more or less, located in SW1/4 Section 26 and NW1/4
			 Section 35, Township 12 North, Range 1 East, Salt Lake Meridian in Cache
			 County, Utah, originally conveyed by the Board of Trustees of the Utah State
			 University of Agriculture and Applied Science, and described in instruments
			 recorded in Book 45, pages 493–495, of the public land records of Cache County,
			 Utah, including facilities, and fixed equipment, to the Utah State University,
			 Logan, Utah, in their <quote>as is</quote> condition, once suitable headhouse
			 and greenhouse facilities have been provided and when the facilities are
			 vacated by the Agricultural Research Service.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idEC000B710BB54CD0931DE2F1F0DC9001" section-type="subsequent-section"><enum>740.</enum><text display-inline="yes-display-inline">Under the Rural Electrification Act of 1936
			 the Secretary of Agriculture shall conduct a pilot program that provides loans
			 or loan guarantees for the construction of not more than three baseload
			 electric generation plants: 
			 <proviso><italic>Provided</italic></proviso>, That in issuing loans
			 and loan guarantees the Secretary shall not discriminate based on the fuel
			 input of such plants as long as the generation facility emits into the ambient
			 air CO<subscript>2</subscript> at a rate, in lbs
			 CO<subscript>2</subscript>/MWh, not greater than the CO<subscript>2</subscript>
			 emitted from natural gas fired generation of a similar size, as determined by
			 the Secretary: 
			 <proviso><italic>Provided further</italic></proviso>,
			 That the Secretary shall charge an upfront fee equal to the subsidy cost of
			 such loans as calculated in accordance with section 502 of the Federal Credit
			 Reform Act of 1990: 
			 <proviso><italic>Provided further</italic></proviso>,
			 That the fee shall be paid from non-Federal sources: 
			 <proviso><italic>Provided further</italic></proviso>,
			 That the source of such payment received from borrowers is not a loan or other
			 debt obligation that is guaranteed by the Federal Government: 
			 <proviso><italic>Provided further</italic></proviso>,
			 That gross obligations for the principal amount of loans authorized by this
			 section shall not exceed $1,500,000,000.</text>
			</section><section commented="no" display-inline="no-display-inline" id="id451D58B37E6340708E23F7F8E97260C8" section-type="subsequent-section"><enum>741.</enum><subsection commented="no" display-inline="yes-display-inline" id="id4693975F2C524AB2AEFA840C284515C5"><enum>(a)</enum><text display-inline="yes-display-inline">When implementing the authority provided in
			 paragraphs (2) and (3) of section 740(c) of the Agriculture, Rural Development,
			 Food and Drug Administration, and Related Agencies Appropriations Act, 2010
			 (Public Law 111–80) that requires the Commissioner of Food and Drugs to develop
			 updated guidance documents and review standards for the development of safe and
			 effective products to treat rare diseases and neglected tropical diseases, the
			 Commissioner shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id08CA7724A2ED4E038A544697B0E1623F"><enum>(1)</enum><text display-inline="yes-display-inline">maximize the use of accelerated approval
			 where feasible and appropriate;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3092A17112784B26A6334D61250418F4"><enum>(2)</enum><text display-inline="yes-display-inline">work with sponsors to facilitate expanded
			 access to investigational therapies;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id63442A5AD0084AA0BBE3943B201D59E6"><enum>(3)</enum><text display-inline="yes-display-inline">increase coordination and interaction with
			 the World Health Organization, European Medicines Agency, and other
			 international regulatory agencies;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66C98FAEF2E941AA8666F703CA38FAC7"><enum>(4)</enum><text display-inline="yes-display-inline">implement mechanisms for enhanced
			 collaboration between the Food and Drug Administration and National Regulatory
			 Authorities in developing countries;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5F42B1A5B1014D9A9BE1D5C0D93244B3"><enum>(5)</enum><text display-inline="yes-display-inline">develop guidance on clinical development
			 programs for rare diseases;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6065FCEE7F3B4D56B709CDA13F7DB717"><enum>(6)</enum><text display-inline="yes-display-inline">develop guidance on the use of surrogate
			 endpoints that are reasonably likely to predict clinical benefit of drugs and
			 biological products under the regulations under subpart H of part 314 of title
			 21, Code of Federal Regulations and subpart E of part 601 of title 21, Code of
			 Federal Regulations; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC3B1CB4DFEE944458B26D4185B9DA011"><enum>(7)</enum><text display-inline="yes-display-inline">increase coordination among individual
			 drug, biological product, and device review divisions across Food and Drug
			 Administration centers to support the development of safe and effective medical
			 products for rare and neglected diseases.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id702E6DD8943C4C5D97CA211492857E0B"><enum>(b)</enum><text display-inline="yes-display-inline">The Commissioner of Food and Drugs shall
			 submit a report to the Committee on Appropriations of the Senate and the
			 Committee on Appropriations of the House of Representatives not later than 180
			 days after the report required in section 740(c)(1) of the Agriculture, Rural
			 Development, Food and Drug Administration, and Related Agencies Appropriations
			 Act, 2010 (Public Law 111–80) is submitted: 
			 <proviso><italic>Provided</italic>,</proviso> That the report
			 submitted in response to this section shall describe in detail how the Food and
			 Drug Administration is implementing subsection (a).</text>
				</subsection></section><appropriations-major commented="no" id="id4A0A04CAC4A24AB7B7FCE8108B9F5348"><text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Agriculture, Rural Development, Food
		  and Drug Administration, and Related Agencies Appropriations Act,
