		<official-title>To amend and reauthorize the controlled substance
		  monitoring program under section 399O of the Public Health Service Act and to
		  authorize the Secretary of Veterans Affairs to share information about the use
		  of controlled substances by veterans with State prescription monitoring
		  programs to prevent misuse and diversion of prescription medicines.
		  </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>National All Schedules
			 Prescription Electronic Reporting Reauthorization Act of
			 2010</short-title></quote>.</text>
		</section><section id="HAC3FD4ED95954CDD849AAB3BABFE658D"><enum>2.</enum><header>Amendment to
			 purpose</header><text display-inline="no-display-inline">Paragraph (1) of
			 section 2 of the National All Schedules Prescription Electronic Reporting Act
			 of 2005 (Public Law 109–60) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="H01D8671DA8914799B57BDA35787BB147" style="OLC">
				<paragraph id="H9D158A8E4DB9461DBA171ADA61808B33"><enum>(1)</enum><text display-inline="yes-display-inline">foster the establishment of
				State-administered controlled substance monitoring systems in order to ensure
				that—</text>
					<subparagraph id="H93FB716B4438426382FB1FC60CD0126B"><enum>(A)</enum><text>health care
				providers have access to the accurate, timely prescription history information
				that they may use as a tool for the early identification of patients at risk
				for addiction in order to initiate appropriate medical interventions and avert
				the tragic personal, family, and community consequences of untreated addiction;
				and</text>
					</subparagraph><subparagraph id="H7B3AB2DE94F646C28904C5A7A31740BB"><enum>(B)</enum><text display-inline="yes-display-inline">appropriate law enforcement, regulatory,
				and State professional licensing authorities have access to prescription
				history information for the purposes of investigating drug diversion and
				prescribing and dispensing practices of errant prescribers or pharmacists;
				and</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="H21F896D1C28D4554A683DF6C726F9427"><enum>3.</enum><header>Amendments to
			 controlled substance monitoring program</header><text display-inline="no-display-inline">Section 399O of the Public Health Service
			 Act (42 U.S.C. 280g–3) is amended—</text>
			<paragraph id="HC6D679D28D2A4C2AAA03222897FD29BA"><enum>(1)</enum><text>in subsection
			 (a)(1)—</text>
				<subparagraph id="HA74CBE7F34FC4255927ABD4C5270FEA2"><enum>(A)</enum><text>in subparagraph
			 (A), by striking <quote>or</quote>;</text>
				</subparagraph><subparagraph id="H32E35226CA4743DFBC27C561656F0D1F"><enum>(B)</enum><text>in subparagraph
			 (B), by striking the period at the end and inserting <quote>; or</quote>;
			 and</text>
				</subparagraph><subparagraph id="HC70C7BA6AAB2422AAEBD700851646DAA"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H3839FD3FBA9B41F7B27D8DCC6ED03198" style="OLC">
						<subparagraph id="H13BA3160F4CA4B699F512BB0824E533B"><enum>(C)</enum><text display-inline="yes-display-inline">to maintain and operate an existing State
				controlled substance monitoring
				program.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="H7C5510007FC942CBA26C0A07E41E6708"><enum>(2)</enum><text>by amending
			 subsection (b) to read as follows:</text>
				<quoted-block id="H2DFEC6734F904ACC8F89E58DA92B77BC" style="OLC">
					<subsection id="HCC08A9AED2ED40299F5B09445DA8EB3B"><enum>(b)</enum><header>Minimum
				requirements</header><text>The Secretary shall maintain and, as appropriate,
				supplement or revise (after publishing proposed additions and revisions in the
				Federal Register and receiving public comments thereon) minimum requirements
				for criteria to be used by States for purposes of clauses (ii), (v), (vi), and
				(vii) of subsection
				(c)(1)(A).</text>
					</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H33D58EFC7C164C7A9350B9BEC9DF40FD"><enum>(3)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="H8C8A4AB643904015A54ED25D62C89540"><enum>(A)</enum><text>in paragraph
			 (1)(B)—</text>
					<clause id="H6E5DE48940024F068161FB7E43CBDFF5"><enum>(i)</enum><text>in
			 the matter preceding clause (i), by striking <quote>(a)(1)(B)</quote> and
			 inserting <quote>(a)(1)(B) or (a)(1)(C)</quote>;</text>
					</clause><clause id="H9FA26DBF2F9C40F2AC88722BC94BB7F4"><enum>(ii)</enum><text>in
			 clause (i), by striking <quote>program to be improved</quote> and inserting
			 <quote>program to be improved or maintained</quote>; and</text>
					</clause><clause id="H922648DA68D84F22B00470D2D56C812A"><enum>(iii)</enum><text>in
			 clause (iv), by striking <quote>public health</quote> and inserting
			 <quote>public health or public safety</quote>;</text>
					</clause></subparagraph><subparagraph id="H3C810BD75434417EAA0F8C83D727A57A"><enum>(B)</enum><text>in paragraph
			 (3)—</text>
					<clause id="HFFD1F11E06B945D2AD473956C11C228D"><enum>(i)</enum><text>by
			 striking <quote>If a State that submits</quote> and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H737E921A3F174D4EB05252357B29B03D" style="OLC">
							<subparagraph id="HDD170E0B09C54063A331F04ACD19231E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">If a State that
				submits</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause><clause id="HE2DE6537C45F4B6DAA3AB6253FA539BD"><enum>(ii)</enum><text>by
			 inserting before the period at the end <quote>and include timelines for full
			 implementation of such interoperability</quote>; and</text>
					</clause><clause id="HACB9EB86E5AF49AD95E8A72393EC2091"><enum>(iii)</enum><text>by
			 adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H792FB39F24A84873A67E1619E2E8B2E9" style="OLC">
							<subparagraph id="H3FE8666660D74FD894B8291E35FCA82C"><enum>(B)</enum><header>Monitoring of
				efforts</header><text display-inline="yes-display-inline">The Secretary shall
				monitor State efforts to achieve interoperability, as described in subparagraph
				(A).</text>
							</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</clause></subparagraph><subparagraph id="H052C967E70C6430EB3BCEF0032D49FD0"><enum>(C)</enum><text>in paragraph
			 (5)—</text>
					<clause id="HE22A4C3069654EFF89582ECD02485254"><enum>(i)</enum><text>by
			 striking <quote>implement or improve</quote> and inserting <quote>establish,
			 improve, or maintain</quote>; and</text>
					</clause><clause id="HC665BE00C626479D8B673755993D93F0"><enum>(ii)</enum><text>by
			 adding at the end the following: <quote>The Secretary shall redistribute any
			 funds that are so returned among the remaining grantees under this section in
			 accordance with the formula described in subsection (a)(2)(B).</quote>;</text>
					</clause></subparagraph></paragraph><paragraph id="HEB249413CD5342458F564474C236E9A7"><enum>(4)</enum><text>in the matter
			 preceding paragraph (1) in subsection (d), by striking <quote>In implementing
			 or improving</quote> all that follows through <quote>with the
			 following:</quote> and inserting <quote>In establishing, improving, or
			 maintaining a controlled substance monitoring program under this section, a
			 State shall comply, or with respect to a State that applies for a grant under
			 subsection (a)(1)(B) or (C) submit to the Secretary for approval a statement of
			 why such compliance is not feasible and a plan for bringing the State into
			 compliance, with the following:</quote>;</text>
			</paragraph><paragraph id="HA713CE878EDC4B2FB4CFAB1B2A3EB299"><enum>(5)</enum><text>in subsections
			 (e), (f)(1), and (g), by striking <quote>implementing or improving</quote> each
			 place it appears and inserting <quote>establishing, improving, or
			 maintaining</quote>;</text>
			</paragraph><paragraph id="HF868573C3BBF455682ED78110A3B8527"><enum>(6)</enum><text>in subsection
			 (f)—</text>
				<subparagraph id="H9BF2B27FA8EC40B6A67F4BCF55D67F1E"><enum>(A)</enum><text>in paragraph
			 (1)(B) by striking <quote>misuse of a schedule II, III, or IV substance</quote>
			 and inserting <quote>misuse of a controlled substance included in schedule II,
			 III, or IV of section 202(c) of the Controlled Substance Act</quote>;
			 and</text>
				</subparagraph><subparagraph id="H5F182C9B36F24BB6A96E390171AFE36D"><enum>(B)</enum><text>add at the end the
			 following:</text>
					<quoted-block id="H6844AE5376F74F689ABBAF09AFFA3B8B" style="OLC">
						<paragraph id="H8C64158747E7401AB216218D3A86FD41"><enum>(3)</enum><header>Evaluation and
				reporting</header><text>Subject to subsection (g), a State receiving a grant
				under subsection (a) shall provide the Secretary with aggregate data and other
				information determined by the Secretary to be necessary to enable the
				Secretary—</text>
							<subparagraph id="H17032AA05A844EDCB8CDF22017F358E0"><enum>(A)</enum><text>to evaluate the
				success of the State’s program in achieving its purposes; or</text>
							</subparagraph><subparagraph id="H1F7964AA406441A39C13DE5ABD055972"><enum>(B)</enum><text>to prepare and
				submit the report to Congress required by subsection (k)(2).</text>
							</subparagraph></paragraph><paragraph id="H9BE0F9F1C57C411AA0486198DB2DA5B4"><enum>(4)</enum><header>Research by
				other entities</header><text>A department, program, or administration receiving
				nonidentifiable information under paragraph (1)(D) may make such information
				available to other entities for research
				purposes.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="HB6999F72E8534A38B91EE088DB92B4EE"><enum>(7)</enum><text>by redesignating
			 subsections (h) through (n) as subsections (i) through (o),
			 respectively;</text>
			</paragraph><paragraph id="H8AF1A5E816F84137BFEFFE7C74E6798E"><enum>(8)</enum><text>in subsections
			 (c)(1)(A)(iv) and (d)(4), by striking <quote>subsection (h)</quote> each place
			 it appears and inserting <quote>subsection (i)</quote>;</text>
			</paragraph><paragraph id="HA84FFEC967094D1AA5ECB1499B8271BC"><enum>(9)</enum><text>by inserting after
			 subsection (g) the following:</text>
				<quoted-block id="HA611AF6419A04C8389FF7E81D8E8B4C0" style="OLC">
					<subsection id="H950AE3EF95544B91AB0055BC2425D2FC"><enum>(h)</enum><header>Education and
				access to the monitoring system</header><text>A State receiving a grant under
				subsection (a) shall take steps to—</text>
						<paragraph id="H09AD429A78E14D4197E0D2A4FF7CE619"><enum>(1)</enum><text>facilitate
				prescriber use of the State’s controlled substance monitoring system;
				and</text>
						</paragraph><paragraph id="H732645F10674404D9A7106388D8691B5"><enum>(2)</enum><text>educate
				prescribers on the benefits of the system both to them and
				society.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="H756C876C59154876BBF2F6C73FA41E03"><enum>(10)</enum><text>in subsection
			 (m)(1), as redesignated, by striking <quote>establishment, implementation, or
			 improvement</quote> and inserting <quote>establishment, improvement, or
			 maintenance</quote>;</text>
			</paragraph><paragraph id="H8D6A6B5FCC014D64A321258BF29CBF44"><enum>(11)</enum><text>in subsection
			 (n)(8), as redesignated, by striking <quote>and the District of
			 Columbia</quote> and inserting <quote>, the District of Columbia, and any
			 commonwealth or territory of the United States</quote>; and</text>
			</paragraph><paragraph id="H537362376D784250974DA42573DB55C8"><enum>(12)</enum><text>by amending
			 subsection (o), as redesignated, to read as follows:</text>
				<quoted-block id="HB6BB16C121AA4AA78247C281DE3ECA68" style="OLC">
					<subsection id="HA09D538165654D96BD73AF4A58FFAEFD"><enum>(o)</enum><header>Authorization of
				appropriation</header><text>To carry out this section, there are authorized to
				be appropriated $15,000,000 for fiscal year 2011 and $10,000,000 for each of
				fiscal years 2012 through
				2015.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id0BC3D8C6DC2443EDAE4639EC11DFE382" section-type="subsequent-section"><enum>4.</enum><header>Amendments to title
			 38</header>
			<subsection id="id9BDA7FCDF7064501A9FC975D9C513A92"><enum>(a)</enum><header>Exception with
			 respect to confidential nature of claims</header><text>Section 5701 of title
			 38, United States Code, is amended by adding at the end the following new
			 subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id93CF29C6F2D1489F8916E713E42C2F20" style="OLC">
					<subsection id="IDc6574288c5fb4714983ef806e8892e44"><enum>(l)</enum><text>Under regulations
				the Secretary shall prescribe, the Secretary may disclose information about a
				veteran or the dependant of a veteran to a State controlled substance
				monitoring program, including a program approved by the Secretary of Health and
				Human Services under section 399O of the Public Health Service Act (42 U.S.C.
				280g–3), to the extent necessary to prevent misuse and diversion of
				prescription
				medicines.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idF34630016FD140DA9FE17D36FEA29907"><enum>(b)</enum><header>Exception with
			 respect to confidentiality of certain medical records</header><text>Section
			 7332(b)(2) of such title is amended by adding at the end the following new
			 subparagraph:</text>
				<quoted-block display-inline="no-display-inline" id="idB289CC014C8049BF8D9FB155D94D6C82" style="OLC">
					<subparagraph id="id0F1BC76EE0D44951B6C0AA0D8F45F5A8" indent="up1"><enum>(G)</enum><text>To a State controlled substance
				monitoring program, including a program approved by the Secretary of Health and
				Human Services under section 399O of the Public Health Service Act (42 U.S.C.
				280g–3), to the extent necessary to prevent misuse and diversion of
				prescription
				medicines.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id43DCD262634E4558B2EFE58FE81883CE"><enum>(c)</enum><header>Report</header>
				<paragraph id="idDCD1F4F55871491A8E80AA53CE272297"><enum>(1)</enum><header>In
			 general</header><text>Not later than one year after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall submit to Congress a
			 report on the participation of the Department of Veterans Affairs in State
			 controlled substance monitoring programs, including programs approved by the
			 Secretary of Health and Human Services under section 399O of the Public Health
			 Service Act (42 U.S.C. 280g–3).</text>
				</paragraph><paragraph id="id74D3AA2D7D5148F09510B03F49B665A4"><enum>(2)</enum><header>Elements</header><text>The
			 report required by paragraph (1) shall include the following:</text>
					<subparagraph id="id1AF3510CE0934C5789EA2F9EB30AB1C7"><enum>(A)</enum><text>A summary of the
			 activities of the Department of Veterans Affairs relating to programs described
			 in paragraph (1).</text>
					</subparagraph><subparagraph id="id50D81C0D06D242DDB6365FD34C9157AD"><enum>(B)</enum><text>A list of the
			 programs described in paragraph (1) in which the Department is
			 participating.</text>
					</subparagraph><subparagraph id="id22DFBC9A33D1417AB00535517840E477"><enum>(C)</enum><text>A description of
			 how the Secretary determines which programs described in paragraph (1) in which
			 to participate.</text>
					</subparagraph><subparagraph id="idC2BD7B979B5A42F0B56BE9B0DA424D3E"><enum>(D)</enum><text>The status of the
			 regulations, if any, prescribed by the Secretary under section 5701(l) of title
			 38, United States Code, as added by subsection (a) of this section.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
