		<section commented="no" display-inline="no-display-inline" id="H7F30A835EDEE4EA490DE979589703300" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Green Infrastructure for Clean Water
			 Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H79E4BAF6BFCB41A09B7AB4E70E46D74B" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HE32E07A511914CE5842CC31B8F490EAA"><enum>(1)</enum><text display-inline="yes-display-inline">many water resources in the United States
			 are declining, particularly in urban areas;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H32E88E12992F441981558B638176FBF5"><enum>(2)</enum><text display-inline="yes-display-inline">that decline of water resources is the
			 result of an increase in population, water consumption, and impermeable
			 surfaces, as well as the negative effects of urbanization, commercial and
			 industrial activities, and climate change; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE60F94F4C8414B6D8B1FD4CC0FCD11D4"><enum>(3)</enum><text display-inline="yes-display-inline">an October 2008 study by the National
			 Research Council found that some of the benefits of green infrastructure
			 include increased water supplies, the creation of green jobs, cost savings, and
			 a reduction of stormwater runoff, surface water discharge, stormwater
			 pollution, and stormwater flows.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H62BDAC84CF3545398E600856CB3B6AFE" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HAE20DFA4B2744F6FA3E20CB767C6AFA2"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE14787F55ED54FD2BC5E737D8BF2FAC4"><enum>(2)</enum><header display-inline="yes-display-inline">Center</header><text display-inline="yes-display-inline">The term <term>center</term> means a center
			 of excellence for green infrastructure established under section 4(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9E56A3A251BB43149010C93B5C5635BD"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term>
			 means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H7B77A227FA304E47B7A956A0CBD314AE"><enum>(A)</enum><text display-inline="yes-display-inline">a State, tribal, or local government;
			 or</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF350F3EE75334A52AD66636E9CFE8D2F"><enum>(B)</enum><text display-inline="yes-display-inline">a local, regional, or other entity that
			 manages stormwater, water resources, or waste water resources.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9686D90C467A46F89325F7354BD3EFFC"><enum>(4)</enum><header display-inline="yes-display-inline">Eligible institution</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="H40079B4246DD41C288CC97BEAAAA5810"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>eligible institution</term>
			 means an institution of higher education (as defined in section 101 of the
			 Higher Education Act of 1965 (20 U.S.C. 1001)), or a research institution, that
			 has demonstrated excellence in green infrastructure by—</text>
					<clause commented="no" display-inline="no-display-inline" id="H5550DC4567A742D48D998B48A28B7348"><enum>(i)</enum><text display-inline="yes-display-inline">conducting research on green infrastructure
			 to determine the means by which green infrastructure reduces stormwater runoff,
			 enhances and protects drinking water sources, and improves water
			 quality;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H9288AFC6721C42D1A79B4D1EECFE2928"><enum>(ii)</enum><text display-inline="yes-display-inline">developing and disseminating information
			 regarding the means by which an organization can use green
			 infrastructure;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HFB1B3BAA869F4FE08D6AD378BDE7D4DE"><enum>(iii)</enum><text display-inline="yes-display-inline">providing technical assistance to an
			 organization for a green infrastructure project;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HE32BC94F0D994481881A64C4E6449EA7"><enum>(iv)</enum><text display-inline="yes-display-inline">developing best practices standards for
			 green infrastructure;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H72CA18CECA0B44BB86503AA0AC170016"><enum>(v)</enum><text display-inline="yes-display-inline">providing job training relating to green
			 infrastructure;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H085909C29BFA42B681B882ED6CA5ACC8"><enum>(vi)</enum><text display-inline="yes-display-inline">developing course curricula for—</text>
						<subclause commented="no" display-inline="no-display-inline" id="id962205E57E6745D689974107A4B7223F"><enum>(I)</enum><text display-inline="yes-display-inline">elementary schools (as defined in section
			 9101 of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
			 7801));</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="id8616AD3E09094C7498CDD0671A308206"><enum>(II)</enum><text display-inline="yes-display-inline">secondary schools (as defined in that
			 section);</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="idC9EBACBCE000425DBFE5D53A54F0F278"><enum>(III)</enum><text display-inline="yes-display-inline">institutions of higher education (as
			 defined in section 101 of the Higher Education Act of 1965 (20 U.S.C. 1001));
			 and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="idD9960C3964304FA3938457B84B27D2E9"><enum>(IV)</enum><text display-inline="yes-display-inline">vocational schools;</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="H611F49EAFC9B42CD807AA95C5A8B8969"><enum>(vii)</enum><text display-inline="yes-display-inline">training students regarding green
			 infrastructure; or</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H9D2A945CC0054FA3BD7001244198D012"><enum>(viii)</enum><text display-inline="yes-display-inline">providing information to the Federal
			 Government or State, tribal, and local governments regarding the implementation
			 of green infrastructure.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC43F888887E7440AA314C51C6B9FA537"><enum>(B)</enum><header display-inline="yes-display-inline">Associated definition</header><text display-inline="yes-display-inline">For purposes of subparagraph (A), the term
			 <term>research institution</term> means an entity that is—</text>
					<clause commented="no" display-inline="no-display-inline" id="HA045F4CDD764409BBFA84645929061C1"><enum>(i)</enum><text display-inline="yes-display-inline">described in section 501(c)(3) of the
			 Internal Revenue Code of 1986;</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HB71B54EA4EE740D893F3AC68AE8D48F8"><enum>(ii)</enum><text display-inline="yes-display-inline">exempt from tax under section 501(a) of the
			 Internal Revenue Code of 1986; and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H113E6BFBF6B044818251B4B3596183CD"><enum>(iii)</enum><text display-inline="yes-display-inline">organized and operated for research
			 purposes.</text>
					</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9FC1015D51884AA09B2E020B86D617C0"><enum>(5)</enum><header display-inline="yes-display-inline">Green infrastructure</header>
				<subparagraph commented="no" display-inline="no-display-inline" id="id69454EA9184645849A8024CC6631FC19"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>green infrastructure</term>
			 means any stormwater management technique that preserves, restores, enhances,
			 or mimics natural hydrology.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8E3A9C567A441239EAE3E12CA20C8AF"><enum>(B)</enum><header display-inline="yes-display-inline">Inclusions</header><text display-inline="yes-display-inline">The term <term>green infrastructure</term>
			 includes—</text>
					<clause commented="no" display-inline="no-display-inline" id="id51844AC4F10E45F8AAA917C5E24A2E57"><enum>(i)</enum><text display-inline="yes-display-inline">methods that promote absorption, uptake,
			 percolation, evapotranspiration, and filtration by soil and plant life;
			 and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="H545B748484914284950CED096F99467A"><enum>(ii)</enum><text display-inline="yes-display-inline">the preservation or restoration of—</text>
						<subclause commented="no" display-inline="no-display-inline" id="H0EE34B01167340A7A72BC69663BF23E4"><enum>(I)</enum><text display-inline="yes-display-inline">natural topography, including hills,
			 plains, ravines, and shorelines;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="idC8E8DA9FD4D04FB1B3778CEED7DAA8F1"><enum>(II)</enum><text display-inline="yes-display-inline">interconnected networks of natural land
			 that protect essential ecological functions critical for water quality;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H63A9853D6AC44A07997C209CCF23E04F"><enum>(III)</enum><text display-inline="yes-display-inline">ecology, including forests, grasslands, and
			 deserts;</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H57C8A923162A447DAD479C0C9038F948"><enum>(IV)</enum><text display-inline="yes-display-inline">bodies of water, including lakes, flood
			 plains, headwaters, and wetlands; and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="H3083F23294984D1CA9F2C226CA29380A"><enum>(V)</enum><text display-inline="yes-display-inline">native soil characteristics of composition,
			 structure, and transmissivity.</text>
						</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB57FA2332CBC4A8EB99A374E0AC82113"><enum>(6)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian tribe</term> has the
			 meaning given the term in section 518(h) of the Federal Water Pollution Control
			 Act (33 U.S.C. 1377(h)).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA1FB7A1B01824FA8BB2812BEBBC29A7C"><enum>(7)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDFF879DE85E0E4FEC9C688D61E9026CDD"><enum>(A)</enum><text display-inline="yes-display-inline">each of the several States of the United
			 States;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID32C27061274442F382CB1733506BBDE3"><enum>(B)</enum><text display-inline="yes-display-inline">the District of Columbia;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3101047A4BF14895A4996D0E3B56607E"><enum>(C)</enum><text display-inline="yes-display-inline">the Commonwealth of Puerto Rico;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7162086E82BE4862A921D0568448B976"><enum>(D)</enum><text display-inline="yes-display-inline">Guam;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC397CB348D70414D852ED0B69C50A495"><enum>(E)</enum><text display-inline="yes-display-inline">American Samoa;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEC09872E97EB435AA63029F6A624BB53"><enum>(F)</enum><text display-inline="yes-display-inline">the Commonwealth of the Northern Mariana
			 Islands;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA047B181B08F4BBB82D242D53C80EF1F"><enum>(G)</enum><text display-inline="yes-display-inline">the Federated States of Micronesia;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6A5ECA5967DA43868BF48973945D5E95"><enum>(H)</enum><text display-inline="yes-display-inline">the Republic of the Marshall
			 Islands;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFEE3C0A255D341F193E516DB29CE0938"><enum>(I)</enum><text display-inline="yes-display-inline">the Republic of Palau; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id088ACAC6B82345C3AE6B99FA7772CD9F"><enum>(J)</enum><text display-inline="yes-display-inline">the United States Virgin Islands.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="H9AE74D58B5DB4ECDB466DEBA6FD0F3B5" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Centers of Excellence for Green
			 Infrastructure</header>
			<subsection commented="no" display-inline="no-display-inline" id="H86F02C2A72014DE2834C134024563A41"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of centers</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H3015788CFDB04962A02B5DFB47E80C1D"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall provide grants, on
			 a competitive basis, to eligible institutions to establish and maintain not
			 less than 3, and not more than 5, centers of excellence for green
			 infrastructure, to be located in various regions throughout the United
			 States.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H62B6A504414A4C198FB45092DB0B03FC"><enum>(2)</enum><header display-inline="yes-display-inline">General operation</header><text display-inline="yes-display-inline">Each center shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H10F8D49E3ACC4A61AF1F6A2033DD5A3E"><enum>(A)</enum><text display-inline="yes-display-inline">conduct research on green infrastructure
			 that is relevant to the geographical region in which the center is located,
			 including stormwater and sewer overflow reduction, other approaches to water
			 resource enhancement, and other environmental, economic, and social
			 benefits;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1AF32DF401D1455C97ADEC32DA2F1F07"><enum>(B)</enum><text display-inline="yes-display-inline">develop manuals and establish industry
			 standards on best management practices relating to State, tribal, local, and
			 commercial green infrastructure for use by State, tribal, and local governments
			 and the private sector;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HCB139A320437494FB0779B26779AA53A"><enum>(C)</enum><text display-inline="yes-display-inline">provide information regarding research
			 conducted under subparagraph (A) and manuals developed under subparagraph (B)
			 to the national electronic clearinghouse center for publication on the Internet
			 website established under subsection (c) to provide to the Federal Government
			 and State, tribal, and local governments and the private sector information
			 regarding green infrastructure;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H75F0F8E9FA884D239A97BE7EA43EEB49"><enum>(D)</enum><text display-inline="yes-display-inline">provide technical assistance to State,
			 tribal, and local governments to assist with the construction, operation, and
			 maintenance of green infrastructure projects;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H51135B9413B34F669C17E94EB7330242"><enum>(E)</enum><text display-inline="yes-display-inline">collaborate with institutions of higher
			 education and private and public organizations in the geographical region in
			 which the center is located on green infrastructure research and technical
			 assistance projects;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDEA15A1C33494CCCB3A252063771E392"><enum>(F)</enum><text display-inline="yes-display-inline">assist institutions of higher education,
			 secondary schools, and vocational schools to develop green infrastructure
			 curricula;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE5B635F3DC234A458E1B37D0323FE692"><enum>(G)</enum><text display-inline="yes-display-inline">provide training regarding green
			 infrastructure to institutions of higher education and professional
			 schools;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF8CAE1DFE99A4CE0AD967CAF4CAB154A"><enum>(H)</enum><text display-inline="yes-display-inline">evaluate regulatory and policy issues
			 relating to green infrastructure; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H313517FDC9F041E285C1F1E0B0C9765A"><enum>(I)</enum><text display-inline="yes-display-inline">coordinate with the other centers to avoid
			 duplication of efforts.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H610EC2010B0C44EF88D48BEBD033E2EE"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
			 this section, an eligible institution shall prepare and submit to the
			 Administrator an application at such a time, in such form, and containing such
			 information as the Administrator may require.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H83F8C31AAC574722BACCE72BE6AC7006"><enum>(c)</enum><header display-inline="yes-display-inline">National electronic clearinghouse
			 center</header><text display-inline="yes-display-inline">Of the centers
			 established under section (a)(1), 1 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idFC24F55CBC4042469B7085486AB42C4A"><enum>(1)</enum><text display-inline="yes-display-inline">be designated as the <quote>national
			 electronic clearinghouse center</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4C02897575EB44F687090815B818674F"><enum>(2)</enum><text display-inline="yes-display-inline">in addition to the other functions of that
			 center—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H095806E3811640248879BC5147E852C9"><enum>(A)</enum><text display-inline="yes-display-inline">develop, operate, and maintain an Internet
			 website and a public database that contain information relating to green
			 infrastructure; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4EE0A0F4C0D44A24BD9DAF777849F2BA"><enum>(B)</enum><text display-inline="yes-display-inline">post to the website information from all
			 centers.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HAECA55910DEB4BAF9ACD0D320EDC7472" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Green infrastructure project
			 grants</header>
			<subsection commented="no" display-inline="no-display-inline" id="H07693B6C3A1546F08D2B853852C7078C"><enum>(a)</enum><header display-inline="yes-display-inline">Grant authority</header><text display-inline="yes-display-inline">The Administrator shall provide grants, on
			 a competitive basis, to eligible entities to carry out green infrastructure
			 projects in accordance with this section.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB3C9E2DF6A66417ABF46FF2768C8B1A9"><enum>(b)</enum><header display-inline="yes-display-inline">Green infrastructure projects</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2997BEFA1CD54D1489769E57266615E0"><enum>(1)</enum><header display-inline="yes-display-inline">Planning and development
			 grants</header><text display-inline="yes-display-inline">The Administrator may
			 make planning and development grants under this section for the following
			 projects:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H6EA29451E0784AA5B78E4CE2B1AA2F49"><enum>(A)</enum><text display-inline="yes-display-inline">Planning and designing green infrastructure
			 projects, including engineering surveys, landscape plans, maps, and
			 implementation plans.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB7E43C51F4A1424E9E95F72A2831187B"><enum>(B)</enum><text display-inline="yes-display-inline">Identifying and developing standards and
			 revisions to local zoning, building, or other local codes necessary to
			 accommodate green infrastructure projects.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBB9774BD9EC04D62BF8C5BCDF45EE8D0"><enum>(C)</enum><text display-inline="yes-display-inline">Identifying and developing fee structures
			 to provide financial support for design, installation, and operations and
			 maintenance of green infrastructure.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HB8ED5E77342E49A487C0368D9C774473"><enum>(D)</enum><text display-inline="yes-display-inline">Developing training and educational
			 materials regarding green infrastructure for distribution to—</text>
						<clause commented="no" display-inline="no-display-inline" id="id34373F42242C439CBE4B92211E2EDCA1"><enum>(i)</enum><text display-inline="yes-display-inline">individuals and entities with applicable
			 technical knowledge; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8B13AD96B26F4A0FBEE875E905F95590"><enum>(ii)</enum><text display-inline="yes-display-inline">the public.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H39415E45A2024328AD46C5AD50D5BE7C"><enum>(E)</enum><text display-inline="yes-display-inline">Developing a green infrastructure portfolio
			 standard program described in section 6(e).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC75DA60C6477490B872F4E03D3EEF1DA"><enum>(2)</enum><header display-inline="yes-display-inline">Implementation grants</header><text display-inline="yes-display-inline">The Administrator may make implementation
			 grants under this section for the following projects:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H824C691548604DD1A9C561D7BCFFEEB1"><enum>(A)</enum><text display-inline="yes-display-inline">Installing green infrastructure.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A7AF7AE390640E682FA450F6D6242A6"><enum>(B)</enum><text display-inline="yes-display-inline">Protecting or restoring interconnected
			 networks of natural areas that protect water quality.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H59B66727C1C34AB3AC6BA814B9CF4B95"><enum>(C)</enum><text display-inline="yes-display-inline">Monitoring and evaluating the
			 environmental, economic, or social benefits of green infrastructure.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2B7F0403200E4C0D94F15ADF70443A88"><enum>(D)</enum><text display-inline="yes-display-inline">Implementing a best practices standard for
			 a green infrastructure program.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDEDEE7D3EF5E47A489F8EA492A7B131D"><enum>(E)</enum><text display-inline="yes-display-inline">Implementing a green infrastructure
			 portfolio standard program described in section 6(e).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB05BA0CC28684DBABEECDAC717032477"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">Except as otherwise provided in this Act,
			 to be eligible to receive a grant under this section, an eligible entity shall
			 prepare and submit to the Administrator an application at such time, in such
			 form, and containing such information as the Administrator may require,
			 including, as applicable—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H1056EC5F0A8E44B29A1D0BE9C81FB2CF"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the green infrastructure
			 project;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAAFF9F0612734EC39EA5683EFB78B740"><enum>(2)</enum><text display-inline="yes-display-inline">a plan for monitoring the impacts of the
			 green infrastructure project on the water quality and quantity;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEE1DAD315F2141D5AC3B5088F4CDB3ED"><enum>(3)</enum><text display-inline="yes-display-inline">an evaluation of other environmental,
			 economic, and social benefits of the green infrastructure project; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H08E43D29F3C745FEA68BB51F7447DA63"><enum>(4)</enum><text display-inline="yes-display-inline">a plan for the long-term operation and
			 maintenance of the green infrastructure project.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H63600CC19D7E4F92A1F8C28FA377F211"><enum>(d)</enum><header display-inline="yes-display-inline">Additional requirement for green
			 infrastructure portfolio standard project</header><text display-inline="yes-display-inline">In addition to an application under
			 subsection (c), a State or Indian tribe applying for a grant for a green
			 infrastructure portfolio standard program described in section 6(e) shall
			 prepare and submit to the Administrator a schedule of increasing minimum
			 percentages of the annual water to be managed using green infrastructure under
			 the program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4A6ACF2BE10249BCA7C53B5F7045BDE6"><enum>(e)</enum><header display-inline="yes-display-inline">Priority</header><text display-inline="yes-display-inline">In making grants under this section, the
			 Administrator shall give priority to applications submitted on behalf
			 of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HA7287A570EBD4DFA9BEEA2710FDF38AE"><enum>(1)</enum><text display-inline="yes-display-inline">a community that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD06F76C0697C40838736575AF3092790"><enum>(A)</enum><text display-inline="yes-display-inline">has combined storm and sanitary sewers in
			 the collection system of the community; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H13C76601C52B46AC980CEA7A0D4F3698"><enum>(B)</enum><text display-inline="yes-display-inline">is a low-income or disadvantaged community,
			 as determined by the Administrator; or</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7038AA15B692446CBDB8B8628B20D9F4"><enum>(2)</enum><text display-inline="yes-display-inline">an eligible entity that will use not less
			 than 10 percent of the grant to provide service to a low-income or
			 disadvantaged community, as determined by the Administrator.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6E20C2CC8F5C47EC8B04CEE8CD7A88E0"><enum>(f)</enum><header display-inline="yes-display-inline">Maximum amounts</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HF49B9DFD01BF4F09A33A3F1C64CABA16"><enum>(1)</enum><header display-inline="yes-display-inline">Planning and development grants</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idD89895E8681544B788900EF92F3078A6"><enum>(A)</enum><header display-inline="yes-display-inline">Single grant</header><text display-inline="yes-display-inline">The amount of a single planning and
			 development grant provided under this section shall be not more than
			 $200,000.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8213DA01FF84B3CB2F0226E49E3316B"><enum>(B)</enum><header display-inline="yes-display-inline">Aggregate amount</header><text display-inline="yes-display-inline">The total amount of all planning and
			 development grants provided under this section during a fiscal year shall be
			 not more than <fraction>1/3</fraction> of the total amount made available to
			 carry out this section.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4A0CAC25BB75452087CAAC217105C0B0"><enum>(2)</enum><header display-inline="yes-display-inline">Implementation grants</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAB82BAD29DC54BB1AE7199E65EC8FE62"><enum>(A)</enum><header display-inline="yes-display-inline">Single grant</header><text display-inline="yes-display-inline">The amount of a single implementation grant
			 provided under this section shall be not more than $3,000,000.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D557A229A594B3CAC1773AF97145D09"><enum>(B)</enum><header display-inline="yes-display-inline">Aggregate amount</header><text display-inline="yes-display-inline">The total amount of all implementation
			 grants provided under this section during a fiscal year shall be not more than
			 <fraction>2/3</fraction> of the total amount made available to carry out this
			 section.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3ACED2EF2300439EADD3D79B8E0D5563"><enum>(g)</enum><header display-inline="yes-display-inline">Federal share</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H2E278BE5E2784579B96A2F2B51ED6BF2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (3), the
			 Federal share of a grant provided under this section shall not exceed 65
			 percent of the total project cost.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H92C839ABC8154919A6EA24B8335C4117"><enum>(2)</enum><header display-inline="yes-display-inline">Credit for implementation
			 grants</header><text display-inline="yes-display-inline">The Administrator
			 shall credit toward the non-Federal share of the cost of an implementation
			 project carried out under this section the cost of planning, design, and
			 construction work completed for the project using funds other than funds
			 provided under this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0785EA5FEB644A2FA9981775520A4E06"><enum>(3)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">The Administrator may waive the Federal
			 share limitation under paragraph (1) for an eligible entity that has adequately
			 demonstrated financial need.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H188D56E305AB4E868E5699676E24A623" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Environmental Protection Agency Green
			 Infrastructure Program</header>
			<subsection commented="no" display-inline="no-display-inline" id="HB3C925BD60214A64AB73857D3ADC86F1"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Administrator shall establish within
			 the Office of Water of the Environmental Protection Agency a green
			 infrastructure program, the purposes of which shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idE6F7AEAC77354EC19FB62725DB8E03FD"><enum>(1)</enum><text display-inline="yes-display-inline">to coordinate and promote the use of green
			 infrastructure; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8D8718B2C9145F38B3918C4A6C045C6"><enum>(2)</enum><text display-inline="yes-display-inline">to integrate green infrastructure into
			 permitting programs.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEB2B5E867054972A96A755B9EF1C154"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Administrator shall carry out the green
			 infrastructure program by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H18C9EE4BCBC1482FB3114D81F1D1D8A1"><enum>(1)</enum><text display-inline="yes-display-inline">promoting the use of green infrastructure
			 in the programs of the Environmental Protection Agency; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H077C9F81212E41979126AF5FE89C52BA"><enum>(2)</enum><text display-inline="yes-display-inline">coordinating efforts to increase the use of
			 green infrastructure with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC6724A34B1ED4D93A35F6DF102137D0E"><enum>(A)</enum><text display-inline="yes-display-inline">other Federal departments and
			 agencies;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF1C497CC8F0945F380ECA63602220181"><enum>(B)</enum><text display-inline="yes-display-inline">State, tribal, and local governments;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF0EE2B53854C4D718E2C7401E5B7FC27"><enum>(C)</enum><text display-inline="yes-display-inline">the private sector.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB9206CB836FD46B5B3B442EA4D1A47D8"><enum>(c)</enum><header display-inline="yes-display-inline">Regional implementation of green
			 infrastructure program</header><text display-inline="yes-display-inline">The
			 Administrator shall direct each regional office of the Environmental Protection
			 Agency to develop a program to promote and integrate the use of green
			 infrastructure within the region that includes—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H55115BE03C7A4F0883BF5805B6EBA6A5"><enum>(1)</enum><text display-inline="yes-display-inline">a plan for monitoring, financing, mapping,
			 and designing the green infrastructure;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0BA8053C842540EDB1BA5508383F5106"><enum>(2)</enum><text display-inline="yes-display-inline">outreach and training regarding green
			 infrastructure implementation for State, tribal, and local governments and the
			 private sector; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H74058FB918384989ACB3875E1197DEE6"><enum>(3)</enum><text display-inline="yes-display-inline">the incorporation of green infrastructure
			 into permitting and other regulatory programs, codes, and ordinance
			 development, including the requirements under consent decrees and settlement
			 agreements in enforcement actions.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H5EFB106320E5440A8D659AD7DD1DF231"><enum>(d)</enum><header display-inline="yes-display-inline">Green infrastructure compliance assistance
			 center</header><text display-inline="yes-display-inline">The Administrator
			 shall establish a compliance assistance center, including a Internet website,
			 to share information with, and provide technical assistance to, State, tribal,
			 and local governments, the private sector, and the public regarding green
			 infrastructure approaches for—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idC7572CAC8733487CBD0028A75A82CDB9"><enum>(1)</enum><text display-inline="yes-display-inline">reducing water pollution;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC1562D663554A859A28C3B98625CD32"><enum>(2)</enum><text display-inline="yes-display-inline">protecting water resources;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFFFFC57A4AED4A5B9847611D17CA8B48"><enum>(3)</enum><text display-inline="yes-display-inline">complying with regulatory requirements;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id315397E3E2D74977ACED381D568632B4"><enum>(4)</enum><text display-inline="yes-display-inline">achieving other environmental, public
			 health, and community goals.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAF411E01BEE243F3B426858EAA9B5ACD"><enum>(e)</enum><header display-inline="yes-display-inline">Green infrastructure portfolio
			 standard</header><text display-inline="yes-display-inline">The Administrator,
			 in collaboration with State, tribal, and local water resource managers, shall
			 establish measurable goals, to be known as the <quote>green infrastructure
			 portfolio standard</quote>, to increase the percentage of annual water managed
			 by eligible entities that use green infrastructure.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H5A53DED0E9EB497D9AD12CC2B9CE8341" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="no-display-inline">Not later than September 30, 2014, the
			 Administrator shall submit to Congress a report that includes, with respect to
			 the period covered by the report—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H8E0E31A6A1B0414AA51BFC5E3FC6233C"><enum>(1)</enum><text display-inline="yes-display-inline">a description of all grants provided under
			 this Act;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id49D544BF25224D1996DEED8180E64166"><enum>(2)</enum><text display-inline="yes-display-inline">a detailed description of—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idB1F05562547D4BF1B310563A1BAB1F3E"><enum>(A)</enum><text display-inline="yes-display-inline">the projects supported by those grants;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id967EF784905E4AB1AD2F64C1E3A6CF8B"><enum>(B)</enum><text display-inline="yes-display-inline">the outcomes of those projects;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5AEE3296F8AB45988230E28785B3CD7A"><enum>(3)</enum><text display-inline="yes-display-inline">a description of the improvements in
			 technology, environmental benefits, resources conserved, efficiencies, and
			 other benefits of the projects funded under this Act;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H185117E614F1465FA22BAF2F672EC29A"><enum>(4)</enum><text display-inline="yes-display-inline">recommendations for improvements to promote
			 and support green infrastructure for the centers, grants, and programs under
			 this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53C6DEE453504A5FB225930EE61D31B2"><enum>(5)</enum><text display-inline="yes-display-inline">a description of existing challenges
			 concerning the use of green infrastructure.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H086DF70CEC014B249B1718A25766CAC5" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act such sums as are necessary
			 for each of fiscal years 2011 through 2014.</text>
