		<section id="H272A849F04E54A2184366DD95E071E8C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Clean Estuaries Act of
			 2010</short-title></quote>.</text>
		</section><section id="H214FC58E5ACB439EB1ACA7BCD0A16AC1"><enum>2.</enum><header>National estuary
			 program amendments</header>
			<subsection id="H261B2E6531D743A497BE541F8A820779"><enum>(a)</enum><header>Purposes of
			 conference</header>
				<paragraph id="HBFFBA9400B334FE19B69C19C20667623"><enum>(1)</enum><header>Development of
			 comprehensive conservation and management plans</header><text display-inline="yes-display-inline">Section 320(b) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1330(b)) is amended by striking paragraph (4)
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H75F2FB9D2D0F4FCDB923B0E0268BEEB7" style="OLC">
						<paragraph id="HDD79CC75B92A441ABE02BF568D9F5C3E"><enum>(4)</enum><text display-inline="yes-display-inline">develop and submit to the Administrator a
				comprehensive conservation and management plan that—</text>
							<subparagraph id="HAB74E0DD10C84292950C0BF3362E4E4A"><enum>(A)</enum><text display-inline="yes-display-inline">identifies the estuary and the associated
				upstream waters of the estuary to be addressed by the plan, with consideration
				given to hydrological boundaries;</text>
							</subparagraph><subparagraph id="H4CFB042141D548AF909518FBE19CA348"><enum>(B)</enum><text>recommends
				priority corrective actions and compliance schedules addressing—</text>
								<clause id="id07B6EA73581F452385DD1C4D53F0A9BA"><enum>(i)</enum><text>point and
				nonpoint sources of pollution; and</text>
								</clause><clause id="id77EE08AE55554ED0A58055E86765F623"><enum>(ii)</enum><text>protection and
				conservation actions—</text>
									<subclause id="idE1C83DE38F5B4092A70E09398CE81851"><enum>(I)</enum><text>to restore and
				maintain the chemical, physical, and biological integrity of the estuary,
				including—</text>
										<item id="idA5BFC07F53FC425189CCDE977CC04505"><enum>(aa)</enum><text>restoration and
				maintenance of water quality, wetlands, and natural hydrologic flows;</text>
										</item><item id="id7985D5D70AF74BFCA7C3B538EBD04C1A"><enum>(bb)</enum><text>a
				resilient and diverse indigenous population of shellfish, fish, and wildlife;
				and</text>
										</item><item id="idE3BBDD7D9FB843809CD6B6E67C487723"><enum>(cc)</enum><text>recreational
				activities in the estuary; and</text>
										</item></subclause><subclause id="id4941470C5295488282D7F8251F5535DD"><enum>(II)</enum><text>to ensure that
				the designated uses of the estuary are protected;</text>
									</subclause></clause></subparagraph><subparagraph id="HC7B6A2D3ACD64A1881194BEDB4B0A21C"><enum>(C)</enum><text>identifies healthy
				watershed components for protection and conservation by carrying out integrated
				assessments, where appropriate, of—</text>
								<clause id="idF90AC3438DDE428DA5BB793735D0EB2B"><enum>(i)</enum><text>aquatic habitat
				and biological integrity;</text>
								</clause><clause id="id4C1DFAAED6CB42AC89AA9436E1ACEA2F"><enum>(ii)</enum><text>water quality;
				and</text>
								</clause><clause id="id0B3D09614D594B7594BE9995D648BF9D"><enum>(iii)</enum><text>natural
				hydrologic flows;</text>
								</clause></subparagraph><subparagraph id="idF60FE677B74A4B95B1ECBD16455BFAB4"><enum>(D)</enum><text>considers current
				and future sustainable commercial activities in the estuary;</text>
							</subparagraph><subparagraph id="H4AE3550A54E44C96A69BCE7C7BDF263E"><enum>(E)</enum><text>addresses the
				impacts of climate change on the estuary, including—</text>
								<clause id="H96DEC0A0AD84488CBCB9A5240C2B5D29"><enum>(i)</enum><text>the identification
				and assessment of vulnerabilities in the estuary;</text>
								</clause><clause id="H85705981C05248C0BA6C373A49BB790C"><enum>(ii)</enum><text>the development
				and implementation of adaptation strategies; and</text>
								</clause><clause id="HBF87E14A85784B7EA89F4DF4338A7067"><enum>(iii)</enum><text display-inline="yes-display-inline">the impacts of changes in sea level on
				estuarine water quality, estuarine habitat, and infrastructure located in the
				estuary;</text>
								</clause></subparagraph><subparagraph id="H31466DA5F36F4550BEF6B03DCDFED6FC"><enum>(F)</enum><text display-inline="yes-display-inline">increases public education and awareness
				with respect to—</text>
								<clause id="H6AF302BF9E4447358018984C0F0C3E58"><enum>(i)</enum><text>the ecological
				health of the estuary;</text>
								</clause><clause id="H92C2A575113147D39799398F0375AA86"><enum>(ii)</enum><text>the water quality
				conditions of the estuary; and</text>
								</clause><clause id="HC480106DFC8A4892A24FADC3162879EB"><enum>(iii)</enum><text>ocean,
				estuarine, land, and atmospheric connections and interactions;</text>
								</clause></subparagraph><subparagraph commented="no" id="H2A5EC5982F3C4229B84CC896A3710868"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="id0993ECA1840142C685AB737317542686"><enum>(i)</enum><text>identifies and assesses
				impairments, including upstream impairments, coming from outside of the area
				addressed by the plan, and the sources of those impairments; and</text>
								</clause><clause commented="no" id="idAFD531B92DA148B1AC87691EE50981F2" indent="up1"><enum>(ii)</enum><text>provides the applicable State with
				any information on such impairments or the sources of such impairments;</text>
								</clause></subparagraph><subparagraph id="H9AB806F3E29B4365ABAA5AA6E8483DC4"><enum>(H)</enum><text>includes
				performance measures and goals to track implementation of the plan; and</text>
							</subparagraph><subparagraph id="H898FF8D0878640C6866998FCDA4CD360"><enum>(I)</enum><text display-inline="yes-display-inline">includes a coordinated monitoring strategy
				for Federal, State, and local governments and other
				entities.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6885C9041B2747E98A9968A50E767928"><enum>(2)</enum><header>Monitoring and
			 making results available</header><text display-inline="yes-display-inline">Section 320(b) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1330(b)) is amended by striking paragraph (6)
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="H72B105D510D74B5689BBFD1152025C41" style="OLC">
						<paragraph id="H3F5DFAFE73C5469BB850FE851ABD12B4"><enum>(6)</enum><text display-inline="yes-display-inline">monitor (and make results available to the
				public regarding)—</text>
							<subparagraph id="HD30E6D84BBFD44C183A549D334D63183"><enum>(A)</enum><text display-inline="yes-display-inline">water quality conditions in the estuary and
				the associated upstream waters of the estuary identified under paragraph
				(4)(A);</text>
							</subparagraph><subparagraph id="H8D2A41774A0C4E3FBD673D3B9F79C390"><enum>(B)</enum><text display-inline="yes-display-inline">healthy watershed and habitat conditions
				that relate to the ecological health and water quality conditions of the
				estuary; and</text>
							</subparagraph><subparagraph id="H2BD765D7FDC54A77A8FEB2A83CCAFDED"><enum>(C)</enum><text>the effectiveness
				of actions taken pursuant to the comprehensive conservation and management plan
				developed for the estuary under this
				subsection;</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HFA75347535AF4D449C45564EFF39DE43"><enum>(3)</enum><header>Information and
			 educational activities</header><text display-inline="yes-display-inline">Section 320(b) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1330(b)) is amended—</text>
					<subparagraph id="H10486E3630734AB187BAAB51F1BE36FC"><enum>(A)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
					</subparagraph><subparagraph id="H1AE1020FA96143CA830FBAE358195D99"><enum>(B)</enum><text>by inserting after
			 paragraph (6) the following:</text>
						<quoted-block display-inline="no-display-inline" id="H69C1C3963ED94CFBA3939A8528813226" style="OLC">

			 redesignated) (33 U.S.C. 1330(b)(8)) is amended by striking <quote>paragraph
			 (7)</quote> and inserting <quote>paragraph (8)</quote>.</text>
				</paragraph></subsection><subsection id="H7DCB27B902A04CF0A0FD3B8A803250C7"><enum>(b)</enum><header>Members of
			 conference; collaborative processes</header>
				<paragraph id="H555DD6C3D91C4EE296076539CEFDD00D"><enum>(1)</enum><header>Members of
			 Conference</header><text display-inline="yes-display-inline">Section 320(c)(5)
			 of the Federal Water Pollution Control Act (33 U.S.C. 1330(c)(5)) is amended by
			 inserting <quote>not-for-profit organizations,</quote> after
			 <quote>institutions,</quote>.</text>

			 processes</header><text display-inline="yes-display-inline">Section 320(d) of

				subsection (b), a management conference shall make use of collaborative
				processes—</text>
								<subparagraph id="H07E68C1B28BA4EC9890B81A93912F401"><enum>(A)</enum><text>to ensure
				equitable inclusion of affected interests;</text>
								</subparagraph><subparagraph id="H3B9ADC84DEFC4992BA8285DA217C8027"><enum>(B)</enum><text>to engage with
				members of the management conference, including through—</text>
									<clause id="H1D2C6574568741A6A27DA1A68669E8B5"><enum>(i)</enum><text>the use of
				consensus-based decision rules; and</text>
									</clause><clause id="H621087B07B384B0F88D953B99DE98A00"><enum>(ii)</enum><text>assistance from
				impartial fa­cil­i­ta­tors, as appropriate;</text>
									</clause></subparagraph><subparagraph id="HC1342360D7BF44088665D4FAC3321678"><enum>(C)</enum><text>to ensure relevant
				information, including scientific, technical, and cultural information, is
				accessible to members;</text>
								</subparagraph><subparagraph id="HE1D21311F1D8471E87FA1342D4D0ABD2"><enum>(D)</enum><text display-inline="yes-display-inline">to promote accountability and transparency
				by ensuring members are informed in a timely manner of—</text>
									<clause id="H336FAD3CBD5A46BF9D4F576BE8866218"><enum>(i)</enum><text>the purposes and
				objectives of the management conference; and</text>
									</clause><clause id="H18413A6A0A3E451CA6076AD273A67E09"><enum>(ii)</enum><text>the results of an
				evaluation conducted under subsection (f)(3);</text>
									</clause></subparagraph><subparagraph commented="no" id="H0D973625628740E8AF1A95D29D45C3C3"><enum>(E)</enum><text>to identify the
				roles and responsibilities of members—</text>
									<clause commented="no" id="H85B7DD5E31CB4CABB3754F11EA6C3853"><enum>(i)</enum><text>in the management
				conference proceedings; and</text>

				of conflicts or disputes as
				necessary.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection id="H1005CF2F5A054ACAA35F93FA6129C8A5"><enum>(c)</enum><header>Administration
			 of Plans</header><text display-inline="yes-display-inline">Section 320 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1330) is amended by striking
			 subsection (f) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H52E0EEEF3B9149DB958CDA6EEB6ABBAB" style="OLC">
					<subsection id="H3EAA41BD7C2E422A8C78572E12E60479"><enum>(f)</enum><header>Administration
				of Plans</header>
						<paragraph id="H38F8964A5EB74A928A8444488202B0F2"><enum>(1)</enum><header>Approval</header><text display-inline="yes-display-inline">Not later than 120 days after the date on
				which a management conference submits to the Administrator a comprehensive
				conservation and management plan under this section, and after providing for
				public review and comment, the Administrator shall approve the plan, if—</text>
							<subparagraph id="idEA740805CC82475BB579833D40AE373C"><enum>(A)</enum><text display-inline="yes-display-inline">the Administrator determines that the plan
				meets the requirements of this section; and</text>
							</subparagraph><subparagraph id="id97996CE3ECDA4FC5B2260BCE271CE770"><enum>(B)</enum><text display-inline="yes-display-inline">each affected Governor concurs.</text>
							</subparagraph></paragraph><paragraph id="H4582AD10B9FA4EC39BBC316C990817D3"><enum>(2)</enum><header>Implementation</header>
							<subparagraph id="id4CFD5746DB614A43A9A9002B66068188"><enum>(A)</enum><header>In
				general</header><text>On the approval of a comprehensive conservation and
				management plan under this section, the plan shall be implemented.</text>
							</subparagraph><subparagraph id="id37DB9E0770274B628E704D825D4D146C"><enum>(B)</enum><header>Use of
				authorized amounts</header><text>Amounts authorized to be appropriated under
				titles II and VI and section 319 may be used in accordance with the applicable
				requirements of this Act to assist States with the implementation of a plan
				approved under paragraph (1).</text>
							</subparagraph></paragraph><paragraph commented="no" id="H0D81C922A47242BAB2579668B4CE001A"><enum>(3)</enum><header>Evaluation</header>
							<subparagraph id="H6068F371A7ED464F89D8052FA73756B2"><enum>(A)</enum><header>In
				general</header><text>Not later than 5 years after the date of enactment of
				this paragraph, and every 5 years thereafter, the Administrator shall carry
				out—</text>
								<clause id="id7304A7C369184B89B080DAB671E78EB4"><enum>(i)</enum><text>an evaluation of
				the implementation of each comprehensive conservation and management plan
				developed under this section to determine the degree to which the goals of the
				plan have been met; and</text>
								</clause><clause id="id7FE0AC4528504301AE39BCB5A550F125"><enum>(ii)</enum><text>a review of the
				program designed to implement the plan.</text>
								</clause></subparagraph><subparagraph id="H1A22B9604279417292F1AC0DD2B21B22"><enum>(B)</enum><header>Review and
				comment by management conference</header><text display-inline="yes-display-inline">In completing an evaluation under
				subparagraph (A), the Administrator shall submit the results of the evaluation
				to the appropriate management conference for review and comment.</text>
							</subparagraph><subparagraph commented="no" id="H33B7F330653948ACB05B47E282D5E55D"><enum>(C)</enum><header>Report</header>
								<clause commented="no" id="H4DFF6376E0F64CA6A096670E03335BB1"><enum>(i)</enum><header>In
				general</header><text>In completing an evaluation under subparagraph (A), and
				after providing an opportunity for a management conference to submit comments
				under subparagraph (B), the Administrator shall issue a report on the results
				of the evaluation, including the findings and recommendations of the
				Administrator and any comments received from the management conference.</text>
								</clause><clause id="H26196545751E446C8D03CF33849F012D"><enum>(ii)</enum><header>Availability to
				public</header><text>The Administrator shall make a report issued under this
				subparagraph available to the public, including through publication in the
				Federal Register and on the Internet.</text>
								</clause></subparagraph><subparagraph commented="no" id="HE3C2E2A095D5451AA7A0D8E3DA125073"><enum>(D)</enum><header>Special rule for
				new plans</header><text display-inline="yes-display-inline">Notwithstanding
				subparagraph (A), if a management conference submits a new comprehensive
				conservation and management plan to the Administrator after the date of
				enactment of this paragraph, the Administrator shall complete the evaluation of
				the implementation of the plan required by subparagraph (A) not later than 5
				years after the date of such submission and every 5 years thereafter.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HAC6523B559CD43AAB58A9416BC958034"><enum>(4)</enum><header>Updates</header>
							<subparagraph commented="no" id="H64C4ED9F35494D3996B4DBED972CAA2D"><enum>(A)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 18 months after the date on
				which the Administrator makes an evaluation of the implementation of a
				comprehensive conservation and management plan available to the public under
				paragraph (3)(C), a management conference convened under this section shall
				submit to the Administrator an update of the plan that reflects, to the maximum
				extent practicable, the results of the program evaluation.</text>
							</subparagraph><subparagraph commented="no" id="H8C702A961C33449DAAC998281C94CF82"><enum>(B)</enum><header>Approval of
				updates</header><text display-inline="yes-display-inline">Not later than 120
				days after the date on which a management conference submits to the
				Administrator an updated comprehensive conservation and management plan under
				subparagraph (A), and after providing for public review and comment, the
				Administrator shall approve the updated plan, if the Administrator determines
				that the updated plan meets the requirements of this section.</text>
							</subparagraph></paragraph><paragraph commented="no" id="HC3C93A8B66C54A4391307E1BA8495BB2"><enum>(5)</enum><header>Probationary
				status</header><text display-inline="yes-display-inline">The Administrator may
				consider a management conference convened under this section to be in
				probationary status, if the management conference has not received approval for
				an updated comprehensive conservation and management plan under paragraph
				(4)(B) on or before the last day of the 3-year period beginning on the date on
				which the Administrator makes an evaluation of the plan available to the public
				under paragraph
				(3)(C).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H739133921B534D2A9BB066EEBA131392"><enum>(d)</enum><header>Federal
			 agencies</header><text display-inline="yes-display-inline">Section 320 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1330) is amended—</text>
				<paragraph id="HA41F89FA92FA47F4A8B1579D7A725960"><enum>(1)</enum><text>by redesignating
			 subsections (g), (h), (i), (j), and (k) as subsections (h), (i), (j), (k), and
			 (m), respectively; and</text>
				</paragraph><paragraph id="H423DE32627DE42288E24B886BB028B8A"><enum>(2)</enum><text>by inserting after
			 subsection (f) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H1D2F08ED175241ACBC3434D719290729" style="OLC">
						<subsection id="HB25EC6BF6647483FA6463670A0F143BF"><enum>(g)</enum><header>Federal
				agencies</header>
							<paragraph id="H7E89D487EE804597ADDB3E4221F3A15B"><enum>(1)</enum><header>Activities
				conducted within estuaries with approved plans</header><text display-inline="yes-display-inline">After approval of a comprehensive
				conservation and management plan by the Administrator, any Federal action or
				activity affecting the estuary shall be conducted, to the maximum extent
				practicable, in a manner consistent with the plan.</text>
							</paragraph><paragraph commented="no" id="HB140F4B677ED421A863280B171E07B26"><enum>(2)</enum><header>Coordination and
				cooperation</header>
								<subparagraph commented="no" id="id9DDC20C6B2A24FBA9DD89BCDC245BF4A"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary of the
				Army (acting through the Chief of Engineers), the Administrator of the National
				Oceanic and Atmospheric Administration, the Director of the United States Fish
				and Wildlife Service, the Secretary of the Department of Agriculture, the
				Director of the United States Geological Survey, the Secretary of the
				Department of Transportation, the Secretary of the Department of Housing and
				Urban Development, and the heads of other appropriate Federal agencies, as
				determined by the Administrator, shall, to the maximum extent practicable,
				cooperate and coordinate activities, including monitoring activities, related
				to the implementation of a comprehensive conservation and management plan
				approved by the Administrator.</text>
								</subparagraph><subparagraph commented="no" id="idAF6071C7EECB49469B25971E071D2830"><enum>(B)</enum><header>Lead
				coordinating agency</header><text display-inline="yes-display-inline">The
				Environmental Protection Agency shall serve as the lead coordinating agency
				under this paragraph.</text>
								</subparagraph></paragraph><paragraph id="H0A61ACAD36974859B76C9065D800B0CA"><enum>(3)</enum><header>Consideration of
				plans in agency budget requests</header><text display-inline="yes-display-inline">In making an annual budget request for a
				Federal agency referred to in paragraph (2), the head of such agency shall
				consider the responsibilities of the agency under this section, including under
				comprehensive conservation and management plans approved by the
				Administrator.</text>
							</paragraph><paragraph id="H68474E18FBDC4106846F4B5A29BF06AB"><enum>(4)</enum><header>Monitoring</header><text>The
				heads of the Federal agencies referred to in paragraph (2) shall collaborate on
				the development of tools and methodologies for monitoring the ecological health
				and water quality conditions of estuaries covered by a management conference
				convened under this
				section.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HE8BE34EC8B2D47AAA675E5A049BA9C40"><enum>(e)</enum><header>Grants</header>
				<paragraph id="H09BDF1849C9145D186868C383058834B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (h) (as
			 redesignated by subsection (d)) of section 320 of the Federal Water Pollution
			 Control Act (33 U.S.C. 1330) is amended—</text>
					<subparagraph id="idAFA25BB108BE4906B7336C4F772FD3E9"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>other
			 public</quote> and all that follows before the period at the end and inserting
			 <quote>and other public or nonprofit private agencies, institutions, and
			 organizations</quote>; and</text>
					</subparagraph><subparagraph id="H14A88937B81E434CAD0E6420A60F8C7E"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H63C8EE2488444358BD46DC466CB91DF6" style="OLC">
							<paragraph id="H3C3D0E3064D045F187FB633D632DFFE0"><enum>(4)</enum><header>Effects of
				probationary status</header>
								<subparagraph id="H58283BB36EC14DB299349FE302777133"><enum>(A)</enum><header>Reductions in
				grant amounts</header><text display-inline="yes-display-inline">The
				Administrator shall reduce, by an amount to be determined by the Administrator,
				grants for the implementation of a comprehensive conservation and management
				plan developed by a management conference convened under this section, if the
				Administrator determines that the management conference is in probationary
				status under subsection (f)(5).</text>
								</subparagraph><subparagraph id="HC1A8218349E846679F33B9963C60FDEF"><enum>(B)</enum><header>Termination of
				management conferences</header><text>The Administrator shall terminate a
				management conference convened under this section, and cease funding for the
				implementation of the comprehensive conservation and management plan developed
				by the management conference, if the Administrator determines that the
				management conference has been in probationary status for 2 consecutive
				years.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HA311868E36884CD09AA716F89B8AFD88"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 320(i) the Federal Water Pollution Control Act
			 (as redesignated by subsection (d)) is amended by striking <quote>subsection
			 (g)</quote> and inserting <quote>subsection (h)</quote>.</text>
				</paragraph></subsection><subsection id="HE4DDC482BC4A433DAF62C036A491A9CF"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">Section 320 of
			 the Federal Water Pollution Control Act (33 U.S.C. 1330) (as redesignated by
			 subsection (d)) is amended by striking subsection (j) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HAF2F2D19C8634F259124AE51349D5065" style="OLC">
					<subsection id="H6B816FA43D12492089A431B6969D0C2A"><enum>(j)</enum><header>Authorization of
				appropriations</header>
						<paragraph id="H8BBC3CBB06254434863159A7E03923A1"><enum>(1)</enum><header>In
				general</header><text>There is authorized to be appropriated to the
				Administrator $75,000,000 for each of fiscal years 2011 through 2016
				for—</text>
							<subparagraph id="H9A61E0F049A0470CAE95044F5E99454C"><enum>(A)</enum><text>expenses relating
				to the administration of management conferences by the Administrator under this
				section, except that such expenses shall not exceed 10 percent of the amount
				appropriated under this subsection;</text>
							</subparagraph><subparagraph id="HE320A936EC424D88AE4D2712BCEFC9BA"><enum>(B)</enum><text>making grants
				under subsection (h); and</text>
							</subparagraph><subparagraph id="HC4EC7640223E44FEA9505619F7CCD3C3"><enum>(C)</enum><text>monitoring the
				implementation of a conservation and management plan by the management
				conference, or by the Administrator in any case in which the conference has
				been terminated.</text>
							</subparagraph></paragraph><paragraph id="H07C02584D5494C6BAD92D9C0DE8A8470"><enum>(2)</enum><header>Allocations</header><text>Of
				the sums authorized to be appropriated under this subsection, the Administrator
				shall provide—</text>
							<subparagraph id="HE53117A97DDF4EB7A754CCBC5F4AD573"><enum>(A)</enum><text display-inline="yes-display-inline">at least $1,250,000 per fiscal year,
				subject to the availability of appropriations, for the development,
				implementation, and monitoring of each conservation and management plan
				eligible for grant assistance under subsection (h); and</text>
							</subparagraph><subparagraph id="H3B155BAD6C5A49BF952554BE22F6915D"><enum>(B)</enum><text>up to $5,000,000
				per fiscal year to carry out subsection
				(k).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H54815C58226340E5BA21933EF4D421B6"><enum>(g)</enum><header>Research</header><text display-inline="yes-display-inline">Section 320(k)(1)(A) of the Federal Water
			 Pollution Control Act (as redesignated by subsection (d)) is amended—</text>
				<paragraph id="HDFC6619670744B698874EB22E23FED48"><enum>(1)</enum><text>by striking
			 <quote>paramenters</quote> and inserting <quote>parameters</quote>; and</text>
				</paragraph><paragraph id="H2361AB45B3B146ECB48344553761B023"><enum>(2)</enum><text>by inserting
			 <quote>(including monitoring of both pathways and ecosystems to track the
			 introduction and establishment of nonnative species)</quote> before <quote>, to
			 provide the Administrator</quote>.</text>
				</paragraph></subsection><subsection id="H779EB0A6FF054E23AC3C974E133748BD"><enum>(h)</enum><header>National estuary
			 program evaluation</header><text display-inline="yes-display-inline">Section
			 320 of the Federal Water Pollution Control Act (33 U.S.C. 1330) is amended by
			 inserting after subsection (k) (as redesignated by subsection (d)) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HA04B62281EBD460E978742B94710E562" style="OLC">
					<subsection commented="no" id="HD3E2190FA69540BF932F8B5CF23E2511"><enum>(l)</enum><header>National estuary
				program evaluation</header>
						<paragraph commented="no" id="H703125DF345D49AFB21E1AD09C8DADD8"><enum>(1)</enum><header>In
				general</header><text>Not later than 5 years after the date of enactment of
				this paragraph, and every 5 years thereafter, the Administrator shall complete
				an evaluation of the national estuary program established under this
				section.</text>
						</paragraph><paragraph id="H5CAF7A2857A54D30BE9F333635E89A0D"><enum>(2)</enum><header>Specific
				assessments</header><text display-inline="yes-display-inline">In conducting an
				evaluation under this subsection, the Administrator shall—</text>
							<subparagraph id="H55302C01F8914D1897F8BC1B7598703D"><enum>(A)</enum><text display-inline="yes-display-inline">assess the effectiveness of the national
				estuary program in improving water quality, natural resources, and sustainable
				uses of the estuaries covered by management conferences convened under this
				section;</text>
							</subparagraph><subparagraph id="H78CBDB76B82D4D89898C12FA500E4C01"><enum>(B)</enum><text display-inline="yes-display-inline">identify best practices for improving water
				quality, natural resources, and sustainable uses of the estuaries covered by
				management conferences convened under this section, including those practices
				funded through the use of technical assistance from the Environmental
				Protection Agency and other Federal agencies;</text>
							</subparagraph><subparagraph id="id582C09CC4A224A989D290D347D7D57B9"><enum>(C)</enum><text display-inline="yes-display-inline">assess the reasons why the best practices
				described in subparagraph (B) resulted in the achievement of program
				goals;</text>
							</subparagraph><subparagraph id="H60AB0DB9915C45AAAFCED38FE731AECE"><enum>(D)</enum><text display-inline="yes-display-inline">identify any redundant requirements for
				reporting by recipients of a grant under this section; and</text>
							</subparagraph><subparagraph id="id6EFDD0CBC0B2434DB086850ACA0D3892"><enum>(E)</enum><text display-inline="yes-display-inline">develop and recommend a plan for limiting
				reporting any redundancies.</text>
							</subparagraph></paragraph><paragraph id="H712F8E725A774995B9592C4215CFEEC7"><enum>(3)</enum><header>Report</header><text>In
				completing an evaluation under this subsection, the Administrator shall issue a
				report on the results of the evaluation, including the findings and
				recommendations of the Administrator.</text>
						</paragraph><paragraph id="H3EBCEBDF10C94940AEF556C762AB14A9"><enum>(4)</enum><header>Availability</header><text display-inline="yes-display-inline">The Administrator shall make a report
				issued under this subsection available to management conferences convened under
				this section and the public, including through publication in the Federal
				Register and on the
				Internet.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H7BB1A4771876432D93E43A215193DB8D"><enum>(i)</enum><header>Convening of
			 conference</header><text display-inline="yes-display-inline">Section 320(a)(2)
			 of the Federal Water Pollution Control Act (33 U.S.C. 1330(a)(2)) is
			 amended—</text>

			 estuaries</header><text display-inline="yes-display-inline">Section 320(m) of
			 the Federal Water Pollution Control Act (as redesignated by subsection (d)) is
			 amended by striking the subsection designation and all that follows through
			 <quote>and those portions of tributaries</quote> and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H19DD6AFC991D4F7DADAAFB1CEF400F13" style="OLC">
					<subsection id="HE14812F329A143919B5BA7A12EEB5B6E"><enum>(m)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms
				<term>estuary</term> and <term>estuarine zone</term> have the meanings given
				the terms in section 104(n)(4), except that—</text>
						<paragraph id="H7638DA51E6E349349E300CF3D84672E8"><enum>(1)</enum><text>the term
				<term>estuary</term> also includes near coastal waters and other bodies of
				water within the Great Lakes that are similar in form and function to the
				waters described in the definition of <term>estuary</term> in section
				104(n)(4); and</text>
						</paragraph><paragraph id="HB0459BD683804D9BBB74BE5DB20FBD10"><enum>(2)</enum><text>the term
				<term>estuarine zone</term> also includes—</text>
							<subparagraph id="HB12B7C99A1C843E6A007203ADA79FC58"><enum>(A)</enum><text>waters within the
				Great Lakes described in paragraph (1) and transitional areas from such waters
				that are similar in form and function to the transitional areas described in
				the definition of <quote>estuarine zone</quote> in section 104(n)(4);</text>
							</subparagraph><subparagraph id="H703C0003985348D1868F47E5355C8C62"><enum>(B)</enum><text>associated aquatic
				ecosystems; and</text>
							</subparagraph><subparagraph id="H2ED6AB8181A447A5BF55BB7EE731200F"><enum>(C)</enum><text>those portions of
				tributaries.</text>
