			 matters</header>
			<section commented="no" display-inline="no-display-inline" id="id099E3FD0EFD84B10A4E9F5C6F40F7063" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Pilot program on evaluation and rating of
			 service-connected disabilities of the musculoskeletal system</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC160FB0AA1F6415DBC004CA1BA88AB6F"><enum>(a)</enum><header display-inline="yes-display-inline">Pilot program required</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 carry out a pilot program to assess the feasibility and advisability of
			 applying an alternative schedule for rating service-connected disabilities of
			 the musculoskeletal system.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC8AA8F7293F049A9B7926B1F70D07733"><enum>(b)</enum><header display-inline="yes-display-inline">Schedule for rating service-Connected
			 disabilities</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id5AA66BE313734B6B90AB8823EAB67480"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 240 days after the date of
			 the enactment of this Act, the Secretary shall establish an alternative
			 schedule for rating service-connected disabilities of the musculoskeletal
			 system.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id495244E20A144F96AA61BC23D54B3903"><enum>(2)</enum><header display-inline="yes-display-inline">Publication in Federal
			 Register</header><text display-inline="yes-display-inline">Not later than 270
			 days after the date of the enactment of this Act, the Secretary shall publish
			 the alternative schedule established under paragraph (1) in the Federal
			 Register.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id434CAD04865F4D4D98DCDDF91A6767A5"><enum>(3)</enum><header display-inline="yes-display-inline">Collaboration</header><text display-inline="yes-display-inline">The Secretary shall establish the
			 alternative schedule required by paragraph (1) collaboratively through the
			 Under Secretary for Benefits, the Under Secretary for Health, and the General
			 Counsel.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD4A1B0D328C457D9FBACF2A4421F86D"><enum>(4)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The alternative schedule for rating
			 disabilities under paragraph (1) shall include the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id20A1B6D8ED0541CD849A10480E0146D7"><enum>(A)</enum><text display-inline="yes-display-inline">The use of the International Classification
			 of Diseases, as adopted by the Secretary of Health and Human Services under
			 section 1173(c) of the Social Security Act (42 U.S.C. 1320d–2(c)) and any
			 successor revisions to such classification so adopted, for purposes of
			 identifying disabilities of the musculoskeletal system.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA382A39FED5441D593A8BC882EC29AF7"><enum>(B)</enum><text display-inline="yes-display-inline">A residual functional capacity assessment
			 instrument to describe the functional musculoskeletal loss resulting from any
			 disability of the musculoskeletal system.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20297B7A5A2E4272AAD2208E54ADC2A0"><enum>(C)</enum><text display-inline="yes-display-inline">Mechanisms for the assignment of one
			 residual functional capacity rating for all musculoskeletal disabilities
			 determined to be service-connected, which mechanisms shall take into account
			 the following:</text>
							<clause commented="no" display-inline="no-display-inline" id="id93D54AF5231443E3A08E49F26DFFAC2B"><enum>(i)</enum><text display-inline="yes-display-inline">Frequency of symptoms affecting residual
			 functional capacity of the musculoskeletal system, set forth as a range
			 of—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id3F5EAB5DF1F142FE99AB4B8975947DB2"><enum>(I)</enum><text display-inline="yes-display-inline">infrequent (once a year or less);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id896569C7B6A44F168C3A333E0901E3FB"><enum>(II)</enum><text display-inline="yes-display-inline">several (two to six) times a year;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id0B69E0CF6B5240A58D475EA704DD7A1F"><enum>(III)</enum><text display-inline="yes-display-inline">occasional (seven to twelve times a
			 year);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id3EC1826E47A9433DA4506F4E9D956BCC"><enum>(IV)</enum><text display-inline="yes-display-inline">weekly; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id4E3E0436AFE748708E192E6E626D6874"><enum>(V)</enum><text display-inline="yes-display-inline">daily or continuous.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id28E2015EDAB24DDB8934F236F7DA80C4"><enum>(ii)</enum><text display-inline="yes-display-inline">Severity of symptoms affecting residual
			 functional capacity of the musculoskeletal system resulting in loss of
			 functional capacity of the musculoskeletal system, set forth as a range
			 of—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id958ECAAA03BF4524AAFB55B185762583"><enum>(I)</enum><text display-inline="yes-display-inline">minimal (symptoms present but requiring no
			 treatment);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idC2EFA6837A47409585205DF0A98422BB"><enum>(II)</enum><text display-inline="yes-display-inline">slight (such as requiring minor alteration
			 of activity or treatment with over-the-counter medication);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idD8CA7927136B46B49B3CB2C83967BD72"><enum>(III)</enum><text display-inline="yes-display-inline">mild (such as requiring rest of relevant
			 body part and use of over-the-counter medication, prescription medication, or
			 therapy, such as ice or heat to an affected part);</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id60ACC32222754992A64D6A58524FA01D"><enum>(IV)</enum><text display-inline="yes-display-inline">moderate (such as requiring medical
			 evaluation and treatment or prescription medication for pain or symptom control
			 with side effects which can be expected to interfere with full performance of
			 work-related activities); and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id1BBDA6394240452FBE2F2C297CE0D9E6"><enum>(V)</enum><text display-inline="yes-display-inline">moderately severe to severe (such as
			 requiring the need to use assistive devices for ambulation, use of opiod or
			 similar prescription medication to control pain which precludes driving or
			 being around machinery, in-patient hospitalization or rehabilitation or
			 frequent out-patient treatment physical therapy, or loss or loss of use of
			 functional capacity in both arms or feet, or one arm and one foot, or requiring
			 a wheelchair for mobility).</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id4991A9460CDA41FD86F94EC3D14A491D"><enum>(iii)</enum><text display-inline="yes-display-inline">Duration of symptoms affecting residual
			 functional capacity of the musculoskeletal system resulting in reduced
			 functional capacity of the musculoskeletal system, set forth as a range
			 of—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id779A5958D06E4A85A78308B9B522830D"><enum>(I)</enum><text display-inline="yes-display-inline">one day or less to one week;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id0A86FBA6B8314355B4FD450F4AA40AE6"><enum>(II)</enum><text display-inline="yes-display-inline">more than one week but less than four
			 weeks;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id1D635C1BEF6243CE8F1359CF396323E1"><enum>(III)</enum><text display-inline="yes-display-inline">four weeks or more but less than six
			 months;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id8C92E7FEC46F436EBABBE576674B9709"><enum>(IV)</enum><text display-inline="yes-display-inline">six months or more but less than one year;
			 and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="idCBCF78D20FE645BB851314DFBF948AA4"><enum>(V)</enum><text display-inline="yes-display-inline">one year or more.</text>
								</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC5D9875FA40F4C5E94748D5D877401DC"><enum>(D)</enum><text display-inline="yes-display-inline">Mechanisms for the assignment of ratings of
			 disability in certain cases as follows:</text>
							<clause commented="no" display-inline="no-display-inline" id="idE774A846FCD5407BA41A2481295C971A"><enum>(i)</enum><text display-inline="yes-display-inline">If the veteran has an active
			 musculoskeletal cancer or other active musculoskeletal disability likely to
			 result in death, a rating of 100 percent.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id26309557EC82485CB906AB42A77F18F6"><enum>(ii)</enum><text display-inline="yes-display-inline">If the veteran would qualify for a
			 temporary disability rating under section 1156 of title 38, United States Code,
			 the rating provided under that section.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idE087CD2A87D4471789C5694FA284886A"><enum>(iii)</enum><text display-inline="yes-display-inline">If the veteran would qualify for a
			 temporary disability rating under any regulations prescribed by the Secretary
			 not provided for under this section, the rating assigned under such
			 regulations.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C5CCDC5F66A471EBAAC36C2A8030C9B"><enum>(E)</enum><text display-inline="yes-display-inline">Such other mechanisms as the Secretary
			 considers appropriate for the pilot program.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD664746804DC4757887FF0C32E0F422F"><enum>(5)</enum><header display-inline="yes-display-inline">Forms for recording residual functional
			 capacity assessments</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idE6148F642E094B2EA1A340159FB04843"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish one or more
			 functional capacity assessment forms to be used in performing assessments with
			 the instrument required by paragraph (4)(B).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF38FC3AC7BEF4AE0A6CB15EB7C9E02B9"><enum>(B)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The Secretary shall make the forms
			 established under subparagraph (A) available to the public in an electronic
			 format for use by any physician or other medical provider in assessing the
			 residual functional capacity related to disabilities of the musculoskeletal
			 system.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC9069A1585A44E2887C26D07DBBC80A6"><enum>(6)</enum><header display-inline="yes-display-inline">Exemption from APA</header><text display-inline="yes-display-inline">The establishment of the alternative
			 schedule required by paragraph (1) shall not be subject to the requirements of
			 subchapter II of chapter 5, and chapter 7, of title 5, United States Code
			 (commonly known as the <quote>Administrative Procedure Act</quote>).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC9AA38C3E7DF41D9BF911256EB1B2CCD"><enum>(c)</enum><header display-inline="yes-display-inline">Application of alternative
			 schedule</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id93F17F95F8434BEAB49FF3B01DF74835"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out the pilot program, the
			 Secretary shall apply the alternative schedule for rating disabilities
			 established under subsection (b) to veterans described in paragraph (3) who
			 have a condition of the musculoskeletal system that has been determined to be a
			 disability incurred or aggravated during military service to determine the
			 rating to be assigned for such disability.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45EFB00DCD2B4E28AE6A4136C1A974F9"><enum>(2)</enum><header display-inline="yes-display-inline">Application through regional
			 offices</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5958803D5EAC4073A1EE5B036331CA79"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall apply the alternative
			 schedule for rating service-connected disabilities under this subsection
			 through not fewer than six and not more than ten regional offices of the
			 Department of Veterans Affairs selected by the Secretary for purposes of the
			 pilot program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id272EBCEB94BB4602AAA4463668118884"><enum>(B)</enum><header display-inline="yes-display-inline">Diversity of selection</header><text display-inline="yes-display-inline">In selecting regional offices under
			 subparagraph (A), the Secretary shall select—</text>
							<clause commented="no" display-inline="no-display-inline" id="id1021229410654D84BD60217B2F9460C7"><enum>(i)</enum><text display-inline="yes-display-inline">at least one regional office considered by
			 the Secretary to be a small office;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idB0E0D152C51C4CAEAED0B12C8D099099"><enum>(ii)</enum><text display-inline="yes-display-inline">at least one regional office considered by
			 the Secretary to be a large office; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idABB89B3959014C7F8DC438C5207AFA4F"><enum>(iii)</enum><text display-inline="yes-display-inline">regional offices representing a variety of
			 geographic settings.</text>
							</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFF182DF3CCDE4179A9C2148E11CCC306"><enum>(3)</enum><header display-inline="yes-display-inline">Covered veterans</header><text display-inline="yes-display-inline">Veterans described in this paragraph are
			 veterans who—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id401D2EB46AB94386B91529C5CE2F568C"><enum>(A)</enum><text display-inline="yes-display-inline">submit to the Secretary more than one year
			 after their date of discharge or release from the active military, naval, or
			 air service an original claim for benefits under the laws administered by the
			 Secretary;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC9623EFC0F684234A550AD18CBD29228"><enum>(B)</enum><text display-inline="yes-display-inline">allege in the claim described in
			 subparagraph (A) the existence of a condition of the musculoskeletal system
			 that was incurred or aggravated in such military, naval, or air service;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BD970951EA348B8BB069E33F38CBCF2"><enum>(C)</enum><text display-inline="yes-display-inline">file such claim with a regional office of
			 the Department with original jurisdiction of the claim that is participating in
			 the pilot program; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id75EA9FF05A554627B14D72000FEFE5E7"><enum>(D)</enum><text display-inline="yes-display-inline">have not expressly declined participation
			 in the pilot program.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBAAD44F818B145D89FE78FC9B82AC125"><enum>(4)</enum><header display-inline="yes-display-inline">Relation to Combined Ratings
			 Table</header><text display-inline="yes-display-inline">A rating assigned for a
			 musculoskeletal service-connected disability under the pilot program shall be
			 determined without regard to the Combined Ratings Table in title 38, Code of
			 Federal Regulations, except that in determining the final rating of all
			 service-connected disabilities, the rating for musculoskeletal disabilities as
			 determined under the pilot program shall be combined with any other
			 disabilities using such table.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0323D45E1F54B51B0C39BBE9DCCB3BA"><enum>(5)</enum><header display-inline="yes-display-inline">Treatment of disability ratings for loss of
			 bodily integrity</header><text display-inline="yes-display-inline">Compensation
			 under laws administered by the Secretary for a disability receiving a
			 disability rating under the schedule established under subsection (b)(1) shall
			 be, as applicable, in addition to or consistent with any compensation otherwise
			 provided under subsections (k) through (s) of section 1114 of title 38, United
			 States Code.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id68D27E9D9EF64A2AAF53F26BA2A9D5BE"><enum>(d)</enum><header display-inline="yes-display-inline">Limitations on denial of service
			 connection</header><text display-inline="yes-display-inline">During the pilot
			 program, the Secretary may not determine a musculoskeletal condition of a
			 veteran to be not service-connected for purposes of the veteran's participation
			 in the pilot program unless the Secretary—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idDB20D22A2B294D2F8224F388FD23408E"><enum>(1)</enum><text display-inline="yes-display-inline">obtains, or receives a report of, a medical
			 examination of the veteran which—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id28CB1D4EE7664486947FC450A9D6202C"><enum>(A)</enum><text display-inline="yes-display-inline">includes a brief history of the veteran's
			 military service relevant to the condition;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB96238E12D7647A3B12B540FFA790B7E"><enum>(B)</enum><text display-inline="yes-display-inline">identifies the diagnosed musculoskeletal
			 disabilities in accordance with the classification required by subsection
			 (b)(4)(A); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA648B84BB4E7434494EE5C814880B3A7"><enum>(C)</enum><text display-inline="yes-display-inline">describes the functional limitations of
			 such conditions, and if applicable, any secondary conditions related to such
			 alleged conditions or any non-service connected disability aggravated by the
			 alleged conditions; and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8AC9EA410E09481690DA138B95195227"><enum>(2)</enum><text display-inline="yes-display-inline">obtains or receives a medical opinion
			 on—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idFDD838D1448C4C44A12F16C8C86D4C93"><enum>(A)</enum><text display-inline="yes-display-inline">the nexus between any diagnosed
			 musculoskeletal condition alleged to be service-connected and the active
			 military, naval, or air service of the veteran; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id02C4473010274B1AA4BD579DFDB4B9F2"><enum>(B)</enum><text display-inline="yes-display-inline">if applicable, the relationship between any
			 service-connected disabilities of the veteran and any secondary disabilities
			 related to such disabilities or any non-service connected disability aggravated
			 by the alleged conditions.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9A41633EF3394A59978237FC79D5C03C"><enum>(e)</enum><header display-inline="yes-display-inline">Records</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idC7E8E8B21A4547CC8214DDC12F908BDC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall maintain for purposes
			 of the pilot program a separate searchable electronic file on each veteran
			 covered by the pilot program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1472BAD487DD4087A39459759D472866"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The electronic file maintained with respect
			 to a veteran under paragraph (1) shall include for the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id056062F621E44A8CA91F75C994EA245E"><enum>(A)</enum><text display-inline="yes-display-inline">An index of the documents contained in the
			 electronic file.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1499F9400FAC48DBA84E23282F04F3F9"><enum>(B)</enum><text display-inline="yes-display-inline">The claim of the veteran for benefits under
			 the laws administered by the Secretary, including any reapplication with
			 respect to such claim.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id77B5A0B16D1E42E68C084F340D808E79"><enum>(C)</enum><text display-inline="yes-display-inline">The service treatment records of the
			 veteran from medical care received while serving in the active military, naval,
			 or air service and any other medical treatment records of the veteran from
			 service during periods of active or inactive duty for training.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFA3226C7D218459F9377030418C0E74E"><enum>(D)</enum><text display-inline="yes-display-inline">The personnel records of service of the
			 veteran—</text>
							<clause commented="no" display-inline="no-display-inline" id="id45247199ECDB48A6862024F91C1F3137"><enum>(i)</enum><text display-inline="yes-display-inline">in the active military, naval, or air
			 service; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id5DCA3D4F1F0449079A41C99AD0E27142"><enum>(ii)</enum><text display-inline="yes-display-inline">in the reserve components of the Armed
			 Forces.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idED6EE1A906F848369C02B9CBBB975E62"><enum>(E)</enum><text display-inline="yes-display-inline">Such other private or public medical
			 records of the veteran as the Secretary considers appropriate.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C73B07677F44909A655D18C34015713"><enum>(F)</enum><text display-inline="yes-display-inline">Records of any medical examinations and
			 medical opinions on the residual functional capacity of the musculoskeletal
			 system of the veteran, including any examinations and opinions obtained under
			 subsection (d).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEABB870A3D024816B4AB7C8366D9F648"><enum>(G)</enum><text display-inline="yes-display-inline">Records of any medical examinations and
			 medical opinions concerning any non-musculoskeletal disabilities claimed by the
			 veteran as service-connected.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD8F06FA3563F4F3DB6776EFF4E1BBAA7"><enum>(H)</enum><text display-inline="yes-display-inline">Any non-medical evidence applicable to the
			 claim.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCB4B5637188642C28EC97EE0EAD96C12"><enum>(I)</enum><text display-inline="yes-display-inline">Current information and evidence on any
			 dependents of the veteran for purposes of the laws administered by the
			 Secretary.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB85BB6F9954A432EA7C88AAACFDEEAAC"><enum>(J)</enum><text display-inline="yes-display-inline">Ratings and decisions of the Secretary with
			 respect to the claims of the veteran.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBAD44BB7101E442D9E51A10F97273A9E"><enum>(K)</enum><text display-inline="yes-display-inline">Information concerning the amount of
			 compensation paid to the veteran under laws administered by the
			 Secretary.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA987153E877B43D3BE5C39629F09BB7D"><enum>(L)</enum><text display-inline="yes-display-inline">Any notices or correspondence sent by the
			 Secretary to the veteran or any correspondence submitted by the veteran to the
			 Secretary in connection with the claim that does not contain evidence or
			 information applicable to the claims of the veteran.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF163EA4A5F4744B6A591B0D3C75AB98E"><enum>(3)</enum><header display-inline="yes-display-inline">Organization</header><text display-inline="yes-display-inline">Each file required by paragraph (1) shall
			 be stored or displayed with separate sections for each element required under
			 paragraph (2).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67EFABC6470B4A69B7B1AAC2D6AC3539"><enum>(f)</enum><header display-inline="yes-display-inline">Termination of application</header><text display-inline="yes-display-inline">The Secretary shall cease the application
			 to veterans under subsection (c) of the alternative schedule for rating
			 service-connected disabilities under subsection (b) for purposes of the pilot
			 program on the date that is 4 years after the date of the enactment of this
			 Act.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id2107EB83FF2A47D981A7EE0DCE1C80D3"><enum>(g)</enum><header display-inline="yes-display-inline">Preservation of ratings</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idF78990340BDB4E6DA767835C20EFCD84"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), a
			 disability rating assigned under the alternative schedule established under
			 subsection (b) shall not be reduced during or after termination of the pilot
			 program absent evidence of clear and unmistakable error in the original
			 assignment of the rating or evidence of an improvement in the musculoskeletal
			 disability manifested by less frequent, less severe, or shorter duration of
			 symptoms measured over a period of at least six months in the year prior to any
			 re-evaluation.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9C5CE14361C542A3B8541571FE69E0B3"><enum>(2)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply to ratings
			 assigned for temporary periods as provided in subsection (b)(4)(D).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id554B2E20DF8C48CD963363472A0DEBF8"><enum>(h)</enum><header display-inline="yes-display-inline">Relationship to other provisions of law
			 administered by the Secretary of Veterans Affairs</header><text display-inline="yes-display-inline">Except as otherwise specifically provided
			 in this section, all applicable provisions of law administered by the Secretary
			 shall apply to decisions of the Secretary made under the pilot program.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id37B2A1E2ADE3401CAE827B31D2F77F03"><enum>(i)</enum><header display-inline="yes-display-inline">Interim report</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idE075079A18634556A437B5CA62EB7347"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 300 days after the date of
			 the enactment of this Act, the Secretary shall submit to the Committee on
			 Veterans' Affairs of the Senate and the Committee on Veterans' Affairs of the
			 House of Representatives an interim report on the pilot program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id214AC581E7FD43DAA45D757C6D6FE26C"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The interim report required by paragraph
			 (1) shall include the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id6554D8CA79C84173A324E726E7316D20"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the alternative schedule
			 for rating service-connected disabilities established under subsection
			 (b).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4849BFBA53D04832AAA24368D8BB9B99"><enum>(B)</enum><text display-inline="yes-display-inline">The rationale for the alternative schedule
			 as described under subparagraph (A).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9D275731FB664BF5AE68B7BFC5EAB6AE"><enum>(C)</enum><text display-inline="yes-display-inline">A description of the policies and
			 procedures established under the pilot program.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC9EE93418DCC45A693F370BCFF356A05"><enum>(j)</enum><header display-inline="yes-display-inline">Report</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD114E532FE3941F68CAA554B65635980"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years and 180 days after
			 the date of the enactment of this Act, the Secretary shall submit to the
			 Committee on Veterans' Affairs of the Senate and the Committee on Veterans'
			 Affairs of the House of Representatives a report on the pilot program.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id42A0587895314BF191EF4957CD8B8F15"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The report required by paragraph (1) shall
			 include the following:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC83E22A4F0874D0489830878B39DF7B6"><enum>(A)</enum><text display-inline="yes-display-inline">A copy of the alternative schedule for
			 rating service-connected disabilities established under subsection (b) and any
			 changes made to such schedule during the pilot program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72B1528E0D584BE5AD6D025F438B757D"><enum>(B)</enum><text display-inline="yes-display-inline">A description and assessment of the
			 application of the alternative schedule for rating service-connected
			 disabilities of veterans, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="idD05466FFFB0B4FE391EE8566FB08A98A"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of veterans to which the
			 alternative schedule was applied;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id71CAF92DB4E3481FAC0E14C0EF265CC3"><enum>(ii)</enum><text display-inline="yes-display-inline">the total number of veterans determined to
			 have a service-connected disability consisting of a condition of the
			 musculoskeletal system; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9387782CFC0F4CB0BE631307B47D00D4"><enum>(iii)</enum><text display-inline="yes-display-inline">the ratings of disability assigned to
			 veterans described in clause (ii), set forth by percentage of disability
			 assigned.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E9043683BFE4B7BB5E46C1977C7A11A"><enum>(C)</enum><text display-inline="yes-display-inline">An assessment of the feasibility and
			 advisability of applying the alternative schedule for rating service-connected
			 disabilities to additional claimants.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc5787836891e435caa1e07877cdc848f"><enum>(D)</enum><text display-inline="yes-display-inline">A comparison of a representative sample of
			 decisions rendered by different regional offices for similar disabilities
			 participating in the pilot program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa967cfedbac04fabba9bf18d00beba2a"><enum>(E)</enum><text display-inline="yes-display-inline">The number of appeals filed for claims
			 adjudicated under the pilot program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa2456e54498d4c019456b7e8541d2bf0"><enum>(F)</enum><text display-inline="yes-display-inline">An assessment of the effectiveness of the
			 electronic file maintained under subsection (e) in—</text>
							<clause commented="no" display-inline="no-display-inline" id="id4697930AB2A049B0852EB9579153CD21"><enum>(i)</enum><text display-inline="yes-display-inline">the adjudication of claims under the pilot
			 program; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idD86C169C881942B598DCED233C1076EB"><enum>(ii)</enum><text display-inline="yes-display-inline">improving the efficiency of decision making
			 by the Department.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE8686813AA6432C9110483811A3503F"><enum>(G)</enum><text display-inline="yes-display-inline">Such recommendations for legislative or
			 administrative action as the Secretary considers appropriate in light of the
			 pilot program.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE8B49C6B38014273A0F913B7112FCAE7"><enum>(k)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id3B3C4D180F7345F1B7F3CA6C69BC6D4F"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>active military, naval, or
			 air service</term> has the meaning given that term in section 101(24) of title
			 38, United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC471491191F4E12BF8216D8C1763061"><enum>(2)</enum><text display-inline="yes-display-inline">The term
			 <term>non-service-connected</term>, with respect to a disability, has the
			 meaning given that term in section 101(17) of title 38, United States
			 Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06253A38D17149EAB2B4F75A6569EE00"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>service-connected</term>,
			 with respect to a disability, has the meaning given that term in section
			 101(16) of title 38, United States Code.</text>
					</paragraph></subsection></section></title><title changed="deleted" commented="no" committee-id="SSVA00" id="id4B81D648E7D54CB3BEA9B394F70FC7A1" level-type="subsequent" reported-display-style="strikethrough"><enum>II</enum><header display-inline="yes-display-inline">Adjudication and appeal matters</header>
			<section commented="no" display-inline="no-display-inline" id="id1129A17ECD9D4E9286AA0455CC6BB49F" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Partial adjudication of claims for
			 disability compensation consisting of multiple issues one or more of which can
			 be quickly adjudicated</header>
				<subsection commented="no" display-inline="no-display-inline" id="idD28A76F194B74596AEAD5674BF96A00D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1157 of title 38, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idF8C32ED463A74A1C9B88AA4A44112BBA"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote>
			 and inserting the following:</text>

				Secretary a claim for compensation under this chapter for more than one
				condition and the Secretary determines that a disability rating can be assigned
				without further development for one or more conditions but not all conditions
				in the claim, the Secretary shall—</text>
									<subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id0DA85D844D654ECBA848B4DAE351EEB3" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">expeditiously assign a disability rating
				for the condition or conditions that the Secretary determined could be assigned
				without further development; and</text>
									</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idC3003AA44B194212A0EFD3FECE1BEE6B" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">continue development of the remaining
				conditions.</text>
									</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id06E12344A05340D3839E48312E2893BB" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary is able to assign a
				disability rating for a condition described in paragraph (1)(B) with respect to
				a claim, the Secretary shall assign such rating and combine such rating with
				the rating or ratings previously assigned under paragraph (1)(A) with respect
				to that
				claim.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA244162209A84F28894D8484B0E6EA93"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 60 days
			 after the date of the enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id48A64D200AB94F7AA85C653243193267" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Clarification that requirement of Secretary
			 of Veterans Affairs to provide notice to claimants of additional information
			 and evidence required only applies when additional information or evidence is
			 actually required</header>
				<subsection commented="no" display-inline="no-display-inline" id="idBB8AA64EF35F485894DF7BC22C6AB433"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5103(a)(1) of title 38, United
			 States Code, is amended by striking the first sentence and inserting the
			 following: <quote>If the Secretary receives a complete or substantially
			 complete application that does not include information or medical or lay
			 evidence not previously provided to the Secretary that is necessary to
			 substantiate the claim, the Secretary shall, upon receipt of such application,
			 notify the claimant and the claimant's representative, if any, that such
			 information or evidence is necessary to substantiate the claim.</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idEE7DC027528C4EEAA1DC1754080D7B30"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 60 days
			 after the date of the enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id0ABECEF3849A47BAB810937A5AC4E7D6" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Equal deference to private medical opinions
			 in assessing claims for disability compensation</header>
				<subsection commented="no" display-inline="no-display-inline" id="id57E477170EAB4DEDB4B9BFF13A1BDF90"><enum>(a)</enum><header display-inline="yes-display-inline">Provision of deference</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id45D5107DC68B448D9E8CB11F65D21F85"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 51 of title 38,
			 United States Code, is amended by inserting after section 5103A the following
			 new section:</text>

								<subsection commented="no" display-inline="no-display-inline" id="id520B9E4D0B504EDBA2C3B9E35E7BA259"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a claimant submits a private medical
				opinion in support of a claim for disability compensation in accordance with
				standards established by the Secretary, such opinion shall be treated by the
				Secretary with the same deference as a medical opinion provided by a Department
				health care provider.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id2AC5B0F4D07E4F789C1F5A2DA614030D"><enum>(b)</enum><header display-inline="yes-display-inline">Supplemental information</header><paragraph commented="no" display-inline="yes-display-inline" id="idB044178D6E61416293D7EE9C362B28F2"><enum>(1)</enum><text display-inline="yes-display-inline">If a private medical opinion submitted as
				described in subsection (a) is found by the Secretary to be competent,
				credible, and probative, but otherwise not entirely adequate for purposes of
				assigning a disability rating and the Secretary determines a medical opinion
				from a Department health care provider is necessary for such purpose, the
				Secretary shall obtain from an appropriate Department health care provider (as
				determined pursuant to the standards described in subsection (a)) a medical
				opinion that is adequate for such purposes.</text>
									</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id92F26704F4AC408B898FAE22C46A0DD6" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary obtains a medical opinion
				from a Department health care provider under paragraph (1), the Secretary shall
				ensure that the medical opinion is obtained from a health care provider of the
				Department that has professional qualifications that are at least equal to the
				qualifications of the provider of the private medical opinion described in such
				paragraph.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5FC7F0601C6A40049AE7A3BF5CA7DCF0"><enum>(c)</enum><header display-inline="yes-display-inline">Department health care provider
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <term>Department health care provider</term> includes a provider of health
				care who provides health care under contract with the
				Department.</text>

			 adding at the end the following new paragraph:</text>

			 claim review process</header>
				<subsection commented="no" display-inline="no-display-inline" id="id6C1A658E6F58448A8571B505B8F97B9D"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of fast track claim review
			 process</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idBC66066BC87A47EC80D0153A1492E474"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 51 of title 38,
			 United States Code, is amended by inserting after section 5103B, as added by
			 section 203 of this Act, the following new section:</text>
						<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="idBA9B41A62C7C4AFABDAA333687CF55C8" reported-display-style="strikethrough" style="USC">

				disability compensation</header>
								<subsection commented="no" display-inline="no-display-inline" id="id378459A0E4394F4E82C7C0E7C544E955"><enum>(a)</enum><header display-inline="yes-display-inline">Process required</header><text display-inline="yes-display-inline">The Secretary shall establish a process for
				the rapid identification of initial claims for disability compensation that
				should, in the adjudication of such claims, receive priority in the order of
				review.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id75621BD045E44C84B8671201C29A1D04"><enum>(b)</enum><header display-inline="yes-display-inline">Review of initial claims</header><text display-inline="yes-display-inline">As part of the process required by
				subsection (a), the Secretary shall assign employees of the Department who are
				experienced in the processing of claims for disability compensation to carry
				out a preliminary review of all initial claims for disability compensation
				submitted to the Secretary in order to identify whether—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id16C28306C207494499C8EC37F3720833"><enum>(1)</enum><text display-inline="yes-display-inline">the claims have the potential of being
				adjudicated quickly;</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93783DCA097E4098B050C4ED5670468C"><enum>(2)</enum><text display-inline="yes-display-inline">the claims qualify for priority treatment
				under paragraph (2) of subsection (c); and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9A83CA3BD0344B9F85B6A07EDC40A674"><enum>(3)</enum><text display-inline="yes-display-inline">a temporary disability rating could be
				assigned with respect to the claims under section 1156 of this title.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA5D8171CAD224253A54D570C0D36DC5D"><enum>(c)</enum><header display-inline="yes-display-inline">Priority in adjudication of initial
				claims</header><paragraph commented="no" display-inline="yes-display-inline" id="id67C972B0C87A47CDB73B55ECF9977006"><enum>(1)</enum><text display-inline="yes-display-inline">As part of the process required by
				subsection (a) and except as provided in paragraph (2), the Secretary shall, in
				the adjudication of initial claims for disability compensation submitted to the
				Secretary, give priority in the order of review of such claims to claims
				identified under subsection (b)(1) as having the potential of being adjudicated
				quickly.</text>
									</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB176125D54AA4ED1B5A91D9D911FE154" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may, under regulations the
				Secretary shall prescribe, provide priority in the order of review of initial
				claims for disability compensation for the adjudication of the
				following:</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="idC76AA37070A64F3F98AA9B635C984172"><enum>(A)</enum><text display-inline="yes-display-inline">Initial claims for disability compensation
				submitted by homeless claimants.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3397E36718344EF181336E0041192DDA"><enum>(B)</enum><text display-inline="yes-display-inline">Initial claims for disability compensation
				submitted by veterans who are terminally ill.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BCF660900D0495C9B6DBE4120F4176B"><enum>(C)</enum><text display-inline="yes-display-inline">Initial claims for disability compensation
				submitted by claimants suffering severe financial hardship.</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF45679F695C448AABDBC978FFCFBD3F5"><enum>(D)</enum><text display-inline="yes-display-inline">Partially adjudicated claims for disability
				compensation under section 1157(b) of this
				title.</text>

			 claimants</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id3DDBEF04253F4A2CA7B0029AF90366EA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 7105(b) of title
			 38, United States Code, is amended—</text>

				agent filing the notice had good cause for the lack of filing within such time;
				and</text>

				mental, educational, or linguistic limitation of the claimant, legal guardian,
				representative, attorney, or authorized agent concerned (including lack of
				facility with the English language).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id642FF06468DE45A2B04E2DD0EBE1F012"><enum>(ii)</enum><text display-inline="yes-display-inline">Circumstances relating to significant delay
				in the delivery of the initial decision or of the notice of disagreement caused
				by natural disaster or factors relating to geographic location.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id806679DE2D444CBCB483CE6914646056"><enum>(iii)</enum><text display-inline="yes-display-inline">A change in financial circumstances,
				including the payment of medical expenses or other changes in income or net
				worth that are considered in determining eligibility for benefits and services
				on an annualized basis for purposes of needs-based benefits under chapters 15
				and 17 of this
				title.</text>
									</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3b2d56d1f974437589136f0a59598600"><enum>(b)</enum><header display-inline="yes-display-inline">Application by Department for review on
			 appeal</header><text display-inline="yes-display-inline">Section 7106 of such
			 title is amended in the first sentence by striking <quote>one-year period

			 process</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC8744B3D89F3482FB930C51D61DAD568"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID3871511b260b4b35a723d1f1da0728e0"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="IDde7e7db1d6d94302b84ce60c37559965"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>The
			 claimant will be afforded</quote> and all that follows through the end of the

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfc17ce84e9f14883952df6ce960a2a0a"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraphs (4) and (5);
			 and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID45aa475d0fb0432fbb206f5ff3fecf0a"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>
						<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="idA6860C89CEB24650827FBCC77BD8BEA0" reported-display-style="strikethrough" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="IDd243e9079994490e8f2efa4c39353c19"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id88E4A5048B34472280EFFF4E2A19E926"><enum>(1)</enum><text display-inline="yes-display-inline">A claimant shall be afforded a period of 60
				days from the date the post-notice of disagreement decision is mailed under
				subsection (d) to file a substantive appeal.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id658682665F18410E8A0136E1EE8B884A" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idA3423B7DE48A42F6940C7428F201F462"><enum>(A)</enum><text display-inline="yes-display-inline">The period under paragraph (1) may be
				extended for an additional 60 days for good cause shown on a request for such
				extension submitted in writing within such period.</text>
									</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB07588363F594D42AA437B868F562F0D" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, good cause
				shall include the following:</text>
										<clause commented="no" display-inline="no-display-inline" id="idCCF581CA72B647B884A8403D4BE6EF51"><enum>(i)</enum><text display-inline="yes-display-inline">Circumstances relating to any physical,
				mental, educational, or linguistic limitation of the claimant, legal guardian,
				or other accredited representative, attorney, or authorized agent filing the
				request (including lack of facility with the English language).</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id7C53DA42CAE444BF8B8707A403CD252F"><enum>(ii)</enum><text display-inline="yes-display-inline">Circumstances relating to significant delay
				in the delivery of the initial decision or of the notice of disagreement caused
				by natural disaster or factors relating to geographic location.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="idE71C331591E04B999A44609E3EF592BA"><enum>(iii)</enum><text display-inline="yes-display-inline">A change in financial circumstances,
				including the payment of medical expenses or other changes in income or net
				worth that are considered in determining eligibility for benefits and services
				on an annualized basis for purposes of needs-based benefits under chapters 15
				and 17 of this title.</text>
										</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idF5C31E25E487417FA970FF9E86BEC908" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">A substantive appeal under this subsection
				shall identify the particular determination or determinations being appealed
				and allege specific errors of fact or law made by the agency of original
				jurisdiction in each determination being appealed.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idFE72DF65ECBA46DFB7AF98B9D826AF7E" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">A claimant in any case under this
				subsection may not be presumed to agree with any statement of fact contained in
				the post-notice of disagreement decision to which the claimant does not
				specifically express disagreement.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id0B4113192D524D6393E88A648E9C15B1" indent="up1" reported-display-style="strikethrough"><enum>(5)</enum><text display-inline="yes-display-inline">If the claimant does not file a substantive
				appeal in accordance with the provisions of this chapter within the period
				afforded under paragraphs (1) and (2), as the case may be, the agency of
				original jurisdiction shall dismiss the appeal and notify the claimant of the
				dismissal. The notice shall include an explanation of the procedure for
				obtaining review of the dismissal by the Board of Veterans' Appeals.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id9067782B19A741448DCE49CC24C6F570" indent="up1" reported-display-style="strikethrough"><enum>(6)</enum><text display-inline="yes-display-inline">In order to obtain review by the Board of a
				dismissal of an appeal by the agency of original jurisdiction, a claimant shall
				file a request for such review with the Board within the 60-day period
				beginning on the date on which notice of the dismissal is mailed pursuant to
				paragraph (5).</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idDBC9BA1D261C437CB87CE001C7A461E9" indent="up1" reported-display-style="strikethrough"><enum>(7)</enum><text display-inline="yes-display-inline">If a claimant does not file a request for
				review by the Board in accordance with paragraph (6) within the prescribed
				period or if such a request is timely filed and the Board affirms the dismissal
				of the appeal, the determination of the agency of original jurisdiction
				regarding the claim for benefits under this title shall become final and the
				claim may not thereafter be reopened or allowed, except as may otherwise be
				provided by regulations not inconsistent with this title.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id0D3EFCE0963348B7BFF06FAA718D55F7" indent="up1" reported-display-style="strikethrough"><enum>(8)</enum><text display-inline="yes-display-inline">If an appeal is not dismissed by the agency
				of original jurisdiction, the Board may nonetheless dismiss any appeal which
				is—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idCC6015E5E72E472095A6C5D0D32A23ED"><enum>(A)</enum><text display-inline="yes-display-inline">untimely; or</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD51A4CF38BEB4F76A3AE47FE3409FEFF"><enum>(B)</enum><text display-inline="yes-display-inline">fails to allege specific error of fact or
				law in the determination being
				appealed.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id33CD8917C4A34C25A23A04B6EFF65E26"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 180 days
			 after the date of the enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id5F9C77CDC42C4D04A1D17B2A9A8B95E6" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Provision of post-notice of disagreement
			 decisions to claimants who file notice of disagreements</header>
				<subsection commented="no" display-inline="no-display-inline" id="id45F936E614304AE99FCA3405BD0DA4A0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idBDEED47448D34899A69CDBC3A48C88CF"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>statement of the
			 case</quote> each place it appears and inserting <quote>post-notice of
			 disagreement decision</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2200D56C18FA43FBBAE0B0D8525E26C1"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), as amended by section
			 207 of this Act—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id486294FCF2824AF3B81EB43E0B093E96"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking subparagraphs
			 (A) through (C) and inserting the following new subparagraphs:</text>

				regulations that support the agency's decision.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id002EDFB341924C7C8D79EF16CB29E623" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A statement that addresses each issue and
				provides the reasons why the evidence relied upon supports the conclusions of
				the agency under the specific laws and regulations applied.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6F503D5190E446CAADBC5DD23C5E6B30" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The date by which a substantive appeal must
				be filed in order to obtain further review of the
				decision.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF9877AEFBA94112B984316E81F85FB9"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id1E7218B9BD094128A233D66CB28DF145"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date that is 180 days after the date of
			 the enactment of this Act, and shall apply with respect to notices of
			 disagreements filed on or after the date that is 180 days after the date of the
			 enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID091de9adbaff47c6b3ce69d7a92a118b" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">Automatic waiver of agency of original
			 jurisdiction review of new evidence</header>
				<subsection commented="no" display-inline="no-display-inline" id="idFC171EEE419E41F994EF1C4E9035590D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, as amended by section 207 of this Act, is further amended by adding at
			 the end the following new subsection:</text>
					<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="idEDDF66ED685E4BEE968D405815A74B68" reported-display-style="strikethrough" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDdd635244b7f14d56a8f335fed19de59c"><enum>(f)</enum><text display-inline="yes-display-inline">If, either at the time or after the agency
				of original jurisdiction receives a substantive appeal, the claimant or the
				claimant's representative, if any, submits evidence to either the agency of
				original jurisdiction or the Board of Veterans' Appeals for consideration in
				connection with the issue or issues with which disagreement has been expressed,
				such evidence shall be subject to initial review by the Board unless the
				claimant or the claimant's representative, as the case may be, requests in
				writing that the agency of original jurisdiction initially review such
				evidence. Such request for review shall accompany the submittal of the evidence
				or be made within 30 days of the
				submittal.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id788B9529F4A0421596256F2551E28CF8"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">Subsection (f) of such
			 section, as added by subsection (a), shall take effect on the date that is 180
			 days after the date of the enactment of this Act, and shall apply with respect
			 to claims for which a substantive appeal is filed on or after the date that is
			 180 days after the date of the enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="ID53a9a04544f449f8b406232693c60d20" section-type="subsequent-section"><enum>210.</enum><header display-inline="yes-display-inline">Authority for Board of Veterans' Appeals to
			 determine location and manner of appearance for hearings</header>
				<subsection commented="no" display-inline="no-display-inline" id="idB8BB296F10C344D994FD5187566C4C38"><enum>(a)</enum><header display-inline="yes-display-inline">Location</header><text display-inline="yes-display-inline">Subsection (d) of section 7107 of title 38,
			 United States Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id5A4A23C8CC934A719135556688A34329"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>An
			 appellant</quote> and all that follows through the end and inserting the
			 following: <quote>Upon request by an appellant for a hearing before the Board,
			 the Board shall determine whether the hearing will be held at its principal
			 location or at a facility of the Department, or other appropriate Federal
			 facility, located within the area served by a regional office of the Department
			 as the Secretary considers most appropriate to schedule the earliest possible
			 date for the hearing.</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0005FE3C977E44A0882DA11DA60EAAED"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
						<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="id590EC1D49ED44B9693DBD8EA9EEB8DD9" reported-display-style="strikethrough" style="OLC">

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id94BE28DCECFA453382EDE78B6EF119AD"><enum>(b)</enum><header display-inline="yes-display-inline">Manner of appearance</header><text display-inline="yes-display-inline">Subsection (e) of such section is
			 amended—</text>

			 this section shall take effect on the date that is 180 days after the date of

				</subsection></section><section commented="no" display-inline="no-display-inline" id="idAF4F85F030C04E61A386AF90F8C70579" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline">Decision by Court of Appeals for Veterans
			 Claims on all issues raised by appellants</header><text display-inline="no-display-inline">Section 7261 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id0EB114FB6D5E4DCAAB28311A9BA8D821"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter before
			 paragraph (1), by striking <quote>, to the extent necessary to its decision and
			 when presented, shall</quote> and inserting <quote>shall, when
			 presented</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9134319702E5403CB55EF6809B4AC3D1"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as
			 subsections (d) and (e), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id94E264BC82204AF6B0BE44AF2C6E6DF7"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (b) the

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID65847612cde141218d18398b82a65043" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">Good cause extension of period for filing
			 notice of appeal with United States Court of Appeals for Veterans
			 Claims</header>
				<subsection commented="no" display-inline="no-display-inline" id="idCB7728E208ED43A89F24BA22FA045B60"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7266 of title 38, United States
			 Code, is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="ID8bbd757eca914bd59db8c662b709a98c"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (c), and
			 (d) as subsections (c), (d), and (e), respectively;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID66082b58f808485594f09938a4273c82"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following new subsection (b):</text>
						<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="idF36EC28EE44C4532AB553EE6290B24E3" reported-display-style="strikethrough" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idCDDDCE82BADA4764AD638B3966E675DD"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idAD9A391B19D54870BCEFD1DD4196F976"><enum>(1)</enum><text display-inline="yes-display-inline">The Court may extend the initial period for
				the filing of a notice of appeal set forth in subsection (a) for an additional
				period not to exceed 120 days from the expiration of such initial period upon a
				motion—</text>
									<subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idCD68256302B649C682FE38B5CD2B114F" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">filed with the Court not later than 120
				days after the expiration of such initial period; and</text>
									</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id83C4CC100E0347B8ACCAFAD3CF390B55" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">showing good cause for such
				extension.</text>
									</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id10A591C2917B4CADBE498EBB9B2C3E3C" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">If a motion for extension under paragraph
				(1) is filed after expiration of the initial period for the filing of a notice
				of appeal set forth in subsection (a), the notice of appeal shall be filed
				concurrently with, or prior to, the filing of the
				motion.</text>

					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2769c94cd1da4065abedd7a7812d3d31"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on the date of the enactment of this Act and
			 shall apply with respect to notices of appeal filed on or after the date of the
			 enactment of this Act.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idB22BBA6508EF404F82907D8F2AB03D02" section-type="subsequent-section"><enum>213.</enum><header display-inline="yes-display-inline">Pilot program on participation of local and
			 tribal governments in improving quality of claims for disability compensation
			 submitted to Department of Veterans Affairs</header>
				<subsection commented="no" display-inline="no-display-inline" id="id1AAAA9B9D1D0414D89E9B477947FB237"><enum>(a)</enum><header display-inline="yes-display-inline">Pilot program required</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 carry out a pilot program to assess the feasibility and advisability of
			 entering into memorandums of understanding with local governments and tribal
			 organizations—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id128FAE85D822465B8B0F73528584F4E4"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the quality of claims submitted
			 to the Secretary for compensation under chapter 11 of title 38, United States
			 Code; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA4FF84C52659409F85A9112592A6C4A2"><enum>(2)</enum><text display-inline="yes-display-inline">to provide assistance to veterans who may
			 be eligible for such compensation in submitting such claims.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2797EB90BEF7457D83B1019E28AB9047"><enum>(b)</enum><header display-inline="yes-display-inline">Minimum number of participating tribal
			 organizations</header><text display-inline="yes-display-inline">In carrying out
			 the pilot program required by subsection (a), the Secretary shall enter into
			 memorandums of understanding with at least two tribal organizations.</text>

				ratings</header><paragraph commented="no" display-inline="yes-display-inline" id="id175618dc-7c99-4bc4-a3b6-8e690298b33f"><enum>(1)</enum><text display-inline="yes-display-inline">In the case of a veteran who submits to the
				Secretary a claim for compensation under this chapter for more than one
				condition and the Secretary determines that a disability rating can be assigned
				without further development for one or more conditions but not all conditions
				in the claim, the Secretary shall—</text>
								<subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6bde322e-3e13-4cb0-aa68-be8c2085af91" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">expeditiously assign a disability rating
				for the condition or conditions that the Secretary determined could be assigned
				without further development; and</text>
								</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id5b9e8c55-a5c4-4835-ab5b-57434d41f9e4" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">continue development of the remaining
				conditions.</text>
								</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id5e94aa44-c1e7-458c-ae46-edf466854f1c" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">If the Secretary is able to assign a
				disability rating for a condition described in paragraph (1)(B) with respect to
				a claim, the Secretary shall assign such rating and combine such rating with
				the rating or ratings previously assigned under paragraph (1)(A) with respect
				to that claim.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id5D7485A4D0D64A938365A9E33A79E8CC" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">If the Secretary determines, after
				assigning a rating for a condition under paragraph (1)(A), that further
				development of the condition could result in assignment of a higher rating, the
				Secretary shall continue development of such condition and reassess the
				rating.</text>

			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 60 days
			 after the date of the enactment of this Act.</text>

			 claims filed with Secretary of Veterans Affairs on behalf of claimants</header>
			<subsection commented="no" display-inline="no-display-inline" id="id60659B62E62B4D18AE9B51B6EF935AE8"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5101 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id703D0E812E05410389CB6342D9D7E504"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7C85102343D5442ABCDA1C78A5F3C97C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>A specific</quote> and
			 inserting <quote>(1) A specific</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5756098DA8134DBF8D9555FD6450C6E8"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>

				of 18 years, is mentally incompetent, or is physically unable to sign a form, a
				form filed under paragraph (1) for the individual may be signed by a court
				appointed representative or a person who is responsible for the care of the
				individual, including a spouse or other relative. If the individual is in the
				care of an institution, the manager or principal officer of the institution may
				sign the
				form.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6CA5C386A9B74376A210A541F0844DD5"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9B99A8B00CA248E5B49C34F929825469"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1)—</text>
						<clause commented="no" display-inline="no-display-inline" id="idDB50CD5BBB8547DEBB34CE419ED7963E"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>, signs a form on
			 behalf of a person to apply for,</quote> after <quote>who applies for</quote>;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id62440D5B252547838CB287A05EA64C4C"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>, or TIN in the case
			 that the person is not an individual,</quote> after <quote>of such
			 person</quote>; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFBB76DCB0FBC4B4284B0762C0457BC58"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>or
			 TIN</quote> after <quote>social security number</quote> each place it appears;
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE22D8B53A38748808D8B434248C3D7CD"><enum>(3)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="id53A143E2B7B94CE38E8830797B7B46BD"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>mentally incompetent</term>
				with respect to an individual means that the individual lacks the mental
				capacity—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id59BFAAF90C7943BEAB03B51EDB574A93"><enum>(A)</enum><text display-inline="yes-display-inline">to provide substantially accurate
				information needed to complete a form; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA43B7A0E67E94A0A9AB92C2B10800A4E"><enum>(B)</enum><text display-inline="yes-display-inline">to certify that the statements made on a
				form are true and complete.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDDF59E53115409CA5C1FA8DEE93BC16"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>TIN</term> has the meaning
				given the term in section 7701(a)(41) of the Internal Revenue Code of
				1986.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id26A9B82EDF3F4C6DB488AFC0802CA4FD"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall
			 apply with respect to claims filed on or after the date of the enactment of
			 this Act.</text>

			 actually required</header>
			<subsection commented="no" display-inline="no-display-inline" id="id80e63ef0-b5ed-4add-9a90-eafc95c4eca4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5103(a)(1) of title 38, United
			 States Code, is amended by striking the first sentence and inserting the
			 following: <quote>If the Secretary receives a complete or substantially
			 complete application that does not include information or medical or lay
			 evidence not previously provided to the Secretary that is necessary to
			 substantiate the claim, the Secretary shall, upon receipt of such application,
			 notify the claimant and the claimant's representative, if any, that such
			 information or evidence is necessary to substantiate and grant the
			 claim.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idd615d274-9dff-47e6-8db4-c40d89f96815"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 60 days
			 after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idab07d0db-85ed-46bd-8541-67653b228f00" reported-display-style="italic" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Equal deference to private medical opinions
			 in assessing claims for disability compensation</header>
			<subsection commented="no" display-inline="no-display-inline" id="id0f1fa2b9-99c2-472f-86c8-88c711c8fd20"><enum>(a)</enum><header display-inline="yes-display-inline">Provision of deference</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id49ed8cf2-2596-4e70-be77-30b2d5359043"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 51 of title 38,
			 United States Code, is amended by inserting after section 5103A the following
			 new section:</text>

				opinions</header>
							<subsection commented="no" display-inline="no-display-inline" id="id77e8dd62-678a-4765-9cd5-720977e7f1cd"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If a claimant submits a private medical
				opinion in support of a claim for disability compensation in accordance with
				standards established by the Secretary, such opinion shall be treated by the
				Secretary with the same deference as a medical opinion provided by a Department
				health care provider.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idf1306f43-0e85-4ce8-9637-3c0f6a8761c4"><enum>(b)</enum><header display-inline="yes-display-inline">Supplemental information</header><paragraph commented="no" display-inline="yes-display-inline" id="id0717d5c4-6fe6-49d5-9661-4ba398295ba8"><enum>(1)</enum><text display-inline="yes-display-inline">If a private medical opinion submitted as
				described in subsection (a) is found by the Secretary to be competent,
				credible, and probative, but otherwise not entirely adequate for purposes of
				assigning a disability rating or determining service-connection and the
				Secretary determines a medical opinion from a Department health care provider
				is necessary for such purposes, the Secretary shall obtain from an appropriate
				Department health care provider (as determined pursuant to the standards
				described in subsection (a)) a medical opinion that is adequate for such
				purposes.</text>
								</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idF733F37364624B5C904BE84F721647DA" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>If a
				private medical opinion submitted as described in subsection (a) addresses a
				matter relevant to the claim described in such subsection and such matter is
				within an area of expertise of the provider of such opinion, any opinion
				obtained by the Secretary under paragraph (1) of this subsection that addresses
				the same matter shall, to the extent feasible, be obtained from a health care
				provider of the Department that has expertise in that area.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2ab321cc-210d-4c5d-9802-1d38a556b191"><enum>(c)</enum><header display-inline="yes-display-inline">Department health care provider
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <term>Department health care provider</term> includes a provider of health
				care who provides health care under contract with the
				Department.</text>

			 adding at the end the following new paragraph:</text>

			 claim review process</header>
			<subsection commented="no" display-inline="no-display-inline" id="id7bbfb604-8d4d-4e60-b5de-b9e278b58593"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of fast track claim review
			 process</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idb325071e-a32e-4851-a391-e7e1c1fa80e3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subchapter I of chapter 51 of title 38,
			 United States Code, is amended by inserting after section 5103B, as added by
			 section 5 of this Act, the following new section:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id0ec4e68a-eb37-422c-8dea-6b3056b3cef1" reported-display-style="italic" style="USC">
						<section commented="no" display-inline="no-display-inline" id="ide95650b8-5ac2-4379-95b3-361a7b0e8c51" section-type="subsequent-section"><enum>5103C.</enum><header display-inline="yes-display-inline">Expedited review of claims for disability
				compensation</header>
							<subsection commented="no" display-inline="no-display-inline" id="id8f36605e-fa96-4331-9b64-4d3a8b53e5e9"><enum>(a)</enum><header display-inline="yes-display-inline">Process required</header><text display-inline="yes-display-inline">The Secretary shall establish a process for
				the rapid identification of initial claims for disability compensation that
				should, in the adjudication of such claims, receive priority in the order of
				review.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idf26d8fdc-d524-4706-9388-c52dd7629390"><enum>(b)</enum><header display-inline="yes-display-inline">Review of initial claims</header><text display-inline="yes-display-inline">As part of the process required by
				subsection (a), the Secretary shall assign employees of the Department who are
				experienced in the processing of claims for disability compensation to carry
				out a preliminary review of all initial claims for disability compensation
				submitted to the Secretary in order to identify whether—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id27ff2d15-9c06-4b73-b740-6966a87eb85e"><enum>(1)</enum><text display-inline="yes-display-inline">the claims have the potential of being
				adjudicated quickly;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b0f6556-92bf-4d1e-b4b9-793151000476"><enum>(2)</enum><text display-inline="yes-display-inline">the claims qualify for priority treatment
				under paragraph (2) of subsection (c); and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id51c621f8-69fc-4b04-b4b4-10b7f66b2a75"><enum>(3)</enum><text display-inline="yes-display-inline">a temporary disability rating could be
				assigned with respect to the claims under section 1156 of this title.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id244e84c6-c19b-413f-9884-0cefbf21d044"><enum>(c)</enum><header display-inline="yes-display-inline">Priority in adjudication of
				claims</header><paragraph commented="no" display-inline="yes-display-inline" id="idf5337c9b-b9e3-4502-98aa-4dd685012ac7"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided in paragraph (2), the
				Secretary shall, in the adjudication of claims for disability compensation
				submitted to the Secretary, give priority in the order of review of such claims
				to claims identified under subsection (b)(1) as having the potential of being
				adjudicated quickly.</text>
								</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id43641aee-2344-4264-b318-a7b18053c66b" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary may, under regulations the
				Secretary shall prescribe, provide priority in the order of review of claims
				for disability
				compensation.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6350271e-d138-44b9-aa29-ed6f49cd2c42"><enum>(2)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 51 of such title is amended by inserting after the item relating to
			 section 5103B, as so added, the following new item:</text>

			 paragraphs (2) and (3) as paragraphs (3) and (4); and</text>
			</paragraph><paragraph id="id97E40373EC234E839ADD99C23A782A78"><enum>(2)</enum><text>by inserting after
			 paragraph (1) the following new paragraph (2):</text>

			<subsection commented="no" display-inline="no-display-inline" id="idd7298c7a-e146-47c6-9863-40f424511f6c"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5104 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idfb25d566-822d-4f2e-8c6e-c8142ef11762"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking the second
			 sentence; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4966d467-5fde-48c8-8071-894f5f70f291"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b), by striking <quote>also
			 include (1) a</quote> and all that follows and inserting the following:

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id50F69B539C13416E9C4499D547DD8C28"><enum>(b)</enum><header>Consultation</header><text>In
			 developing the form required by subsection (b)(4) of such section, as added by
			 subsection (a), the Secretary of Veterans Affairs may consult with veterans
			 service organizations and such other organizations as the Secretary considers
			 appropriate.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id54f2716a-0c12-4bfc-b7e3-2255ad7bcff3"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on the date that is 180 days after the date of
			 the enactment of this Act.</text>

			 financial records of individuals represented by fiduciaries and receiving
			 benefits under laws administered by Secretary</header><text display-inline="no-display-inline">Section 5502 of title 38, United States
			 Code, is amended by adding at the end the following new subsection:</text>

				<subsection commented="no" display-inline="no-display-inline" id="idA4E574245CCD4E668E9F5FA49C56632B"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id7178E828481847CCA1D24FD73F319238"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary may require any person
				appointed or recognized as a fiduciary for a Department beneficiary under this
				section to provide authorization for the Secretary to obtain (subject to the
				cost reimbursement requirements of section 1115(a) of the Right to Financial
				Privacy Act of 1978 (12 U.S.C. 3415)) from any financial institution any
				financial record held by the institution with respect to the fiduciary or the
				beneficiary whenever the Secretary determines that the financial record is
				necessary—</text>
						<subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idC4EFBCC5797C42DFA18B81589CDC8692" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">for the administration of a program
				administered by the Secretary; or</text>
						</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id1DF96ACEF00E44B29B4143416AA68715" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">in order to safeguard the beneficiary's
				benefits against neglect, misappropriation, misuse, embezzlement, or
				fraud.</text>
						</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id74A07CA8FDFD46968A9B85163A268726" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">Notwithstanding section 1104(a)(1) of such
				Act (12 U.S.C. 3404(a)(1)), an authorization provided by a fiduciary under
				paragraph (1) with respect to a beneficiary shall remain effective until the
				earliest of—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idBB8708EB3149422F944901AEB3F439E3"><enum>(A)</enum><text display-inline="yes-display-inline">the approval by a court or the Secretary of
				a final accounting of payment of benefits under any law administered by the
				Secretary to a fiduciary on behalf of such beneficiary;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF34BE1B86A314208A1935154304F2A85"><enum>(B)</enum><text display-inline="yes-display-inline">in the absence of any evidence of neglect,
				misappropriation, misuse, embezzlement, or fraud, the express revocation by the
				fiduciary of the authorization in a written notification to the Secretary;
				or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C33A2A054D44BDC8B9F53F11F94F353"><enum>(C)</enum><text display-inline="yes-display-inline">the date that is three years after the date
				of the authorization.</text>
						</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idC7AD060C7A48493F89962CDD92321619" indent="up1" reported-display-style="italic"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id90AFFF1A38974F028C56396B0E96C207"><enum>(A)</enum><text display-inline="yes-display-inline">An authorization obtained by the Secretary
				pursuant to this subsection shall be considered to meet the requirements of the
				Right to Financial Privacy Act of 1978 (12 U.S.C. 3401 et seq.) for purposes of
				section 1103(a) of such Act (12 U.S.C. 3403(a)), and need not be furnished to
				the financial institution, notwithstanding section 1104(a) of such Act (12
				U.S.C. 3404(a)), if the Secretary provides a copy of the authorization to the
				financial institution.</text>
						</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idCBC41D9CD8C7463B8CF28C79EAD110A8" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">The certification requirements of section
				1103(b) of such Act (12 U.S.C. 3403(b)) shall not apply to requests by the
				Secretary pursuant to an authorization provided under this subsection.</text>
						</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6876E54B7C3B4BCFBCFC95C17C130FC3" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">A request for a financial record by the
				Secretary pursuant to an authorization provided by a fiduciary under this
				subsection is deemed to meet the requirements of section 1104(a)(3) of such Act
				(12 U.S.C. 3404(a)(3)) and the matter in section 1102 of such Act (12 U.S.C.
				3402) that precedes paragraph (1) of such section if such request identifies
				the fiduciary and the beneficiary concerned.</text>
						</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id71FAC3ADC3C84E8FB8A733F8A015A0B4" indent="up1" reported-display-style="italic"><enum>(D)</enum><text display-inline="yes-display-inline">The Secretary shall inform any person who
				provides authorization under this subsection of the duration and scope of the
				authorization.</text>
						</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="IDfafb743fa49b434dbeea13c99f98c424" indent="up1" reported-display-style="italic"><enum>(E)</enum><text display-inline="yes-display-inline">If a fiduciary of a Department beneficiary
				refuses to provide, or revokes, any authorization to permit the Secretary to
				obtain from any financial institution any financial record concerning benefits
				paid by the Secretary for such beneficiary, the Secretary may, on that basis,
				revoke the appointment or the recognition of the fiduciary for such beneficiary
				and for any other Department beneficiary for whom such fiduciary has been
				appointed or recognized. If the appointment or recognition of a fiduciary is
				revoked, benefits may be paid as provided in subsection (d).</text>
						</subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id04C98682FE2D4A43BD41504664ADE676" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of section 1113(d) of such Act
				(12 U.S.C. 3413(d)), a disclosure pursuant to this subsection shall be
				considered a disclosure pursuant to a Federal statute.</text>
					</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id87C79DA9C4F441CC99606FC0AECCA405" indent="up1" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF4CD4D2997D942189668FDA5234D50A2"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>fiduciary</term> includes
				any person appointed or recognized to receive payment of benefits under any law
				administered by the Secretary on behalf of a Department beneficiary.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48E8EBF1F94F4786829946C754ED7D6B"><enum>(B)</enum><text display-inline="yes-display-inline">The term <term>financial institution</term>
				has the meaning given such term in section 1101 of such Act (12 U.S.C. 3401),
				except that such term shall also include any benefit association, insurance
				company, safe deposit company, money market mutual fund, or similar entity
				authorized to do business in any State.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id514BB109D1C04EB38B7F43513CB3E045"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>financial record</term> has
				the meaning given such term in such
				section.</text>
						</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section changed="added" committee-id="SSVA00" id="idC18523B575D2467F88100DAB99FE6286" reported-display-style="italic" section-type="subsequent-section"><enum>11.</enum><header>Treatment of certain
			 misfiled documents as motions for reconsideration of decisions by Board of
			 Veterans' Appeals</header><text display-inline="no-display-inline">Section 7103
			 of title 38, United States Code, is amended—</text>
			<paragraph id="id8DC19F3B0ADE404C8A86940CBF1C2C83"><enum>(1)</enum><text>by redesignating
			 subsection (c) as subsection (d); and</text>
			</paragraph><paragraph id="idDE087B693A45433CAD93072DFA9C98CC"><enum>(2)</enum><text>by inserting after
			 subsection (b) the following new subsection (c):</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id7D5EB3DD179542A5A181578B783A78CF" reported-display-style="italic" style="OLC">
					<subsection id="idC907BC2FA2C34BF3840E129981EBF6E2"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idE50C5E88233C4D13AAE4C6D550CC683B"><enum>(1)</enum><text>Except as provided in
				paragraph (2), if a person adversely affected by a final decision of the Board,
				who has not filed a notice of appeal with the United States Court of Appeals
				for Veterans Claims under section 7266(a) of this title within the period set
				forth in that section, files a document with the Board or the agency of
				original jurisdiction referred to in section 7105(b)(1) of this title that
				expresses disagreement with such decision not later than 120 days after the
				date of such decision, such document shall be treated as a motion for
				reconsideration of such decision under subsection (a).</text>
						</paragraph><paragraph changed="added" committee-id="SSVA00" id="id60A4CDC73AC1480BB7F5BCCC84190B9D" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>A document described in
				paragraph (1) shall not be treated as a motion for reconsideration of the
				decision under paragraph (1) if—</text>
							<subparagraph id="idAD90AA99D4C142DD956AB0B85E714AF9"><enum>(A)</enum><text>the Board or the agency
				of original jurisdiction referred to in paragraph (1)—</text>
								<clause id="id9284F304BF884ED989D14F18F3041F09"><enum>(i)</enum><text>receives the document
				described in paragraph (1);</text>
								</clause><clause id="idE1D5596AD4164DD7A5241969CD0F5E88"><enum>(ii)</enum><text>determines that such
				document expresses an intent to appeal the decision to the United States Court
				of Appeals for Veterans Claims; and</text>
								</clause><clause id="idA35BA9C4E7D249279CB8A676CC51AF3C"><enum>(iii)</enum><text>forwards such document
				to the United States Court of Appeals for Veterans Claims; and</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF2F95C616B2948CCBE975B1BD4AFF8B7"><enum>(B)</enum><text>the
				United States Court of Appeals for Veterans Claims receives such document
				within the period set forth by section 7266(a) of this
				title.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id83426126-e3ff-4a29-b2d0-799b11632e6e" reported-display-style="italic" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Modification of filing period for notice of
			 disagreement to initiate appellate review of decisions of Department of
			 Veterans Affairs</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2e54d503-3e0c-449d-bfce-21963cd4eed4"><enum>(a)</enum><header display-inline="yes-display-inline">Filing of notice of disagreement by
			 claimants</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idaf69868e-652a-4524-a7ae-b6ec81e6a6f9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 7105(b) of title
			 38, United States Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id39723929-29a4-4870-8abf-0dd66eb3124b"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>one year</quote> and
			 inserting <quote>180 days</quote> in the first sentence; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idcfd11411-674e-4d53-ac6f-c2df8fb08299"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>one-year</quote> and
			 inserting <quote>180-day</quote> in the third sentence.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb41ab437-d3be-4e07-b8d4-b878ebc10937"><enum>(2)</enum><header display-inline="yes-display-inline">Electronic filing</header><text display-inline="yes-display-inline">Such paragraph is further amended by
			 inserting <quote>or transmitted by electronic means</quote> after
			 <quote>postmarked</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id01a7a649-bc0e-48a6-b6c2-752c2f25591e"><enum>(3)</enum><header display-inline="yes-display-inline">Good cause exception for untimely filing of
			 notices of disagreement</header><text display-inline="yes-display-inline">Such
			 section 7105(b) is amended by adding at the end the following new
			 paragraph:</text>
					<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="ide413c63b-babd-4fdd-a95a-0e63c12c0e3a" reported-display-style="italic" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ida5573aa7-29e7-44de-bd4b-528aa87c95a8" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3a17ac67-695b-4ab7-b870-65ec648cd358"><enum>(A)</enum><text display-inline="yes-display-inline">A notice of disagreement not filed within
				the time prescribed by paragraph (1) shall be treated by the Secretary as
				timely filed if—</text>
								<clause changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id6fdc4a1f-27c3-48c6-aa91-4e1a01a4097a" indent="up1" reported-display-style="italic"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary determines that the claimant,
				legal guardian, or other accredited representative, attorney, or authorized
				agent filing the notice had good cause for the lack of filing within such time;
				and</text>
								</clause><clause changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idc17f4e24-1ef8-4a80-bac2-1ea0adc170e5" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">the notice of disagreement is filed not
				later than 186 days after the period prescribed by paragraph (1).</text>
								</clause></subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ida6d3ffcc-7009-4e2e-b268-75748a57f032" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, good cause
				shall include the following:</text>
								<clause commented="no" display-inline="no-display-inline" id="idb64c117d-0b06-46f1-aa8c-5c3bbf2ba48c"><enum>(i)</enum><text display-inline="yes-display-inline">Circumstances relating to any physical,
				mental, educational, or linguistic limitation of the claimant, legal guardian,
				representative, attorney, or authorized agent concerned (including lack of
				facility with the English language).</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id11b467c7-c47c-4ad2-a5af-e4b43309bbcb"><enum>(ii)</enum><text display-inline="yes-display-inline">Circumstances relating to significant delay
				in the delivery of the initial decision or of the notice of disagreement caused
				by natural disaster or factors relating to geographic location.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idc0c424a9-87fe-4857-bcbe-cd9be9ba2ddf"><enum>(iii)</enum><text display-inline="yes-display-inline">A change in financial circumstances,
				including the payment of medical expenses or other changes in income or net
				worth that are considered in determining eligibility for benefits and services
				on an annualized basis for purposes of needs-based benefits under chapters 15
				and 17 of this
				title.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id088f5b35-4d41-4870-b994-6dd1f5736cc1"><enum>(b)</enum><header display-inline="yes-display-inline">Application by Department for review on
			 appeal</header><text display-inline="yes-display-inline">Section 7106 of such
			 title is amended in the first sentence by striking <quote>one-year period
			 described in section 7105</quote> and inserting <quote>period described in
			 section 7105(b)(1)</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idc939b540-48c8-4be2-89dc-7558a32d10ef"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date that is 180 days after the date of
			 the enactment of this Act, and shall apply with respect to claims filed on or
			 after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idf7fce7a4-b95e-4c89-9c3d-4229323ac2f1" reported-display-style="italic" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Provision of post-notice of disagreement
			 decisions to claimants who file notice of disagreements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2f7b8e49-5f02-461c-b931-a09568e4e367"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idcc07045f-2ea9-4e4d-a374-db441c636b72"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>statement of the
			 case</quote> each place it appears and inserting <quote>post-notice of
			 disagreement decision</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ida149c7a0-a4e7-49d1-9bc6-578b535ed396"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8dea4cf0-74db-4c59-b1c8-b82aae690a92"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking subparagraphs
			 (A) through (C) and inserting the following new subparagraphs:</text>

							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idb87bf830-e530-46be-9be2-7380784fc8c5" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">A citation to pertinent laws and
				regulations that support the agency's decision.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idae32af91-0e83-4edf-8a0b-d7677c144dfb" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">A statement that addresses each issue and
				provides the reasons why the evidence relied upon supports the conclusions of
				the agency under the specific laws and regulations applied.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5a1c6ff2-bb42-4637-85b1-ab9f5a662915" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">The date by which a substantive appeal must
				be filed in order to obtain further review of the decision.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C670A87D6E143F5AC6B82871AACEE09" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">The rights of the claimant under subsection
				(f).</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93baf60a-0eac-4bde-b4d1-cbef5451596e"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>

					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide81bc88c-760a-4f04-a5bd-916b9c3a675a"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 7105A of such title is amended by
			 striking <quote>statement of the case</quote> each place it appears and
			 inserting <quote>post-notice of disagreement decision</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id44cf310f-8c51-4fa3-bc21-d91948da4751"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on the date that is 180 days after the date of
			 the enactment of this Act, and shall apply with respect to notices of
			 disagreements filed on or after the date that is 180 days after the date of the
			 enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id09084c4e-d18d-496c-9454-89c6825d4dd0" reported-display-style="italic" section-type="subsequent-section"><enum>14.</enum><header display-inline="yes-display-inline">Modification of substantive appeal
			 process</header>
			<subsection commented="no" display-inline="no-display-inline" id="id87b7d95e-3ad0-46cf-b578-a59fda3737d9"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id23798a17-58e5-4d45-9e5e-544d314334e5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (d), as amended by section 13
			 of this Act—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idba0ada47-b7e6-40ac-9ec5-4441b45a189a"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>The
			 claimant will be afforded</quote> and all that follows through the end of the
			 paragraph;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idee89625c-98fb-4fc6-8cdf-e0fc04fee518"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraphs (4) and (5);
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6CA03A4A0DB4362A4EC86CB83B45263"><enum>(C)</enum><text>by redesignating
			 paragraph (6) as paragraph (4); and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idbfa0ff24-426c-40bb-8775-6cd357eb86c4"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subsection:</text>

						<subsection commented="no" display-inline="no-display-inline" id="id80ea28e4-e57e-4162-ac6b-33f645bf0716"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idb437d63e-831a-4208-9ec5-fd2fe01b8f39"><enum>(1)</enum><text display-inline="yes-display-inline">A claimant shall be afforded a period of 60
				days from the date the post-notice of disagreement decision is mailed under
				subsection (d) to file a substantive appeal.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id0c323647-e83a-49cf-a990-b121f8f92aa1" indent="up1" reported-display-style="italic"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idf4672640-06a7-49a1-a354-5d690d4fea1f"><enum>(A)</enum><text display-inline="yes-display-inline">The period under paragraph (1) may be
				extended for an additional 60 days for good cause shown on a request for such
				extension submitted in writing within such period.</text>
								</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id163ca3fe-bb10-417f-8547-13f2bf07b7c1" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">For purposes of this paragraph, good cause
				shall include the following:</text>
									<clause commented="no" display-inline="no-display-inline" id="id5a8e67b4-1f22-43b2-bec7-e3ca77678060"><enum>(i)</enum><text display-inline="yes-display-inline">Circumstances relating to any physical,
				mental, educational, or linguistic limitation of the claimant, legal guardian,
				or other accredited representative, attorney, or authorized agent filing the
				request (including lack of facility with the English language).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id238f80bd-6798-4cbe-85a0-182ca92c2edf"><enum>(ii)</enum><text display-inline="yes-display-inline">Circumstances relating to significant delay
				in the delivery of the initial decision or of the notice of disagreement caused
				by natural disaster or factors relating to geographic location.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="iddf8c7179-c88c-4e48-97ff-c58327e8df62"><enum>(iii)</enum><text display-inline="yes-display-inline">A change in financial circumstances,
				including the payment of medical expenses or other changes in income or net
				worth that are considered in determining eligibility for benefits and services
				on an annualized basis for purposes of needs-based benefits under chapters 15
				and 17 of this title.</text>
									</clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idb8ccd4e4-30cb-497c-9d01-4e0e0b296dad" indent="up1" reported-display-style="italic"><enum>(3)</enum><text display-inline="yes-display-inline">A substantive appeal under this subsection
				shall identify the particular determination or determinations being appealed
				and allege specific errors of fact or law made by the agency of original
				jurisdiction in each determination being appealed.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id47a9d05b-422a-4ca9-9a62-7a46ed72abe5" indent="up1" reported-display-style="italic"><enum>(4)</enum><text display-inline="yes-display-inline">A claimant in any case under this
				subsection may not be presumed to agree with any statement of fact contained in
				the post-notice of disagreement decision to which the claimant does not
				specifically express disagreement.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idc784e31f-f3d3-452a-952b-cf5cec61f905" indent="up1" reported-display-style="italic"><enum>(5)</enum><text display-inline="yes-display-inline">If the claimant does not file a substantive
				appeal in accordance with the provisions of this chapter within the period
				afforded under paragraphs (1) and (2), as the case may be, the agency of
				original jurisdiction shall dismiss the appeal and notify the claimant of the
				dismissal. The notice shall include an explanation of the procedure for
				obtaining review of the dismissal by the Board of Veterans' Appeals.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id2fb45d2a-4df4-4dbf-b8cb-ec0de5221ac6" indent="up1" reported-display-style="italic"><enum>(6)</enum><text display-inline="yes-display-inline">In order to obtain review by the Board of a
				dismissal of an appeal by the agency of original jurisdiction, a claimant shall
				file a request for such review with the Board within the 60-day period
				beginning on the date on which notice of the dismissal is mailed pursuant to
				paragraph (5).</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id71f4145c-1060-4228-8c11-b55893ccdcd8" indent="up1" reported-display-style="italic"><enum>(7)</enum><text display-inline="yes-display-inline">If a claimant does not file a request for
				review by the Board in accordance with paragraph (6) within the prescribed
				period or if such a request is timely filed and the Board affirms the dismissal
				of the appeal, the determination of the agency of original jurisdiction
				regarding the claim for benefits under this title shall become final and the
				claim may not thereafter be reopened or allowed, except as may otherwise be
				provided by regulations not inconsistent with this title.</text>
							</paragraph><paragraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id9ab51452-6ece-45d8-a3f2-fe76adcecf6f" indent="up1" reported-display-style="italic"><enum>(8)</enum><text display-inline="yes-display-inline">If an appeal is not dismissed by the agency
				of original jurisdiction, the Board may nonetheless dismiss any appeal which
				is—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id32150f19-d132-4d77-9429-dba11fee33b1"><enum>(A)</enum><text display-inline="yes-display-inline">untimely; or</text>

			 subsection (a) shall take effect on the date of the enactment of this Act, and
			 shall apply with respect to claims filed on or after the date that is 180 days
			 after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idb51221bb-4773-4f3f-8e01-3696321ee9cb" reported-display-style="italic" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Automatic waiver of agency of original
			 jurisdiction review of new evidence</header>
			<subsection commented="no" display-inline="no-display-inline" id="id4c54c3a5-0c7b-4773-99e7-0935f66faa15"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7105 of title 38, United States
			 Code, as amended by section 14 of this Act, is further amended by adding at the
			 end the following new subsection:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="id59a31da6-ab1e-4815-896a-e70435cde374" reported-display-style="italic" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id4d974299-b8d4-4555-a7a0-3b173e453246"><enum>(f)</enum><text display-inline="yes-display-inline">If, either at the time or after the agency
				of original jurisdiction receives a substantive appeal, the claimant or the
				claimant's representative, if any, submits evidence to either the agency of
				original jurisdiction or the Board of Veterans' Appeals for consideration in
				connection with the issue or issues with which disagreement has been expressed,
				such evidence shall be subject to initial review by the Board unless the
				claimant or the claimant's representative, as the case may be, requests in
				writing that the agency of original jurisdiction initially review such
				evidence. Such request for review shall accompany the submittal of the evidence
				or be made within 30 days of the
				submittal.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8874b258-eccf-49f3-ac21-d870457921de"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">Subsection (f) of such
			 section, as added by subsection (a), shall take effect on the date that is 180
			 days after the date of the enactment of this Act, and shall apply with respect
			 to claims for which a substantive appeal is filed on or after the date that is
			 180 days after the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id07e266b2-779b-4149-9faf-691067a274b5" reported-display-style="italic" section-type="subsequent-section"><enum>16.</enum><header display-inline="yes-display-inline">Determination of location and manner of
			 appearance for hearings</header>
			<subsection commented="no" display-inline="no-display-inline" id="id504e2021-e69c-48e0-a49f-a01d323406f2"><enum>(a)</enum><header display-inline="yes-display-inline">Location</header><text display-inline="yes-display-inline">Subsection (d)(1) of section 7107 of title
			 38, United States Code, is amended by striking <quote>An appellant</quote> and
			 all that follows through the end and inserting the following: “Upon request by
			 an appellant for a hearing before the Board, the Board shall present the
			 appellant with the following:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="idA2D794F3C78D4692AC1F8ABE94A53595" reported-display-style="italic" style="OLC">
					<subparagraph id="id3D24B5F462234784B399D0C9743F4138" indent="up1"><enum>(A)</enum><text>The option of holding the
				hearing at—</text>
						<clause id="id975EC1B3F78E44B6B842CD83E010FB52"><enum>(i)</enum><text>the Board's principal
				location; or</text>
						</clause><clause id="idA02825037D5440F7BCEBF207BE65DB96"><enum>(ii)</enum><text>a facility of the
				Department located within the area served by a regional office of the
				Department.</text>
						</clause></subparagraph><subparagraph id="id8551D5DBEB12489BBFED2AC3E926E43D" indent="up1"><enum>(B)</enum><text>A recommendation as to
				the option presented under subparagraph (A) that would lead to the earliest
				possible date for the hearing, including with respect to the use of facilities
				and equipment under subsection (e).</text>
					</subparagraph><subparagraph id="idB4F5FAB43D2C46A2950F084166A57C19" indent="up1"><enum>(C)</enum><text>Statistics on the average
				wait experienced by similarly situated appellants for hearings at either option
				presented under subparagraph
				(A).</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id8E5307461F4F462980A2B619EF55C1AA"><enum>(b)</enum><header>Manner</header><text>Subsection

			 this section shall take effect on the date that is 180 days after the date of
			 the enactment of this Act, and shall apply with respect to requests for
			 hearings filed on or after the date that is 180 days after the date of the
			 enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ida7b5f844-2e2f-4db2-8f4a-207c933f770e" reported-display-style="italic" section-type="subsequent-section"><enum>17.</enum><header display-inline="yes-display-inline">Decision by Court of Appeals for Veterans
			 Claims on all issues raised by appellants</header><text display-inline="no-display-inline">Section 7261 of title 38, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id5aae4752-7158-4f86-a961-5f6767c41f67"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter before
			 paragraph (1), by striking <quote>, to the extent necessary to its decision and
			 when presented, shall</quote> and inserting <quote>shall, when
			 presented</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id038c79f8-cb78-4a98-acbe-e200dbaf129f"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as
			 subsections (d) and (e), respectively; and</text>

			 notice of appeal with United States Court of Appeals for Veterans
			 Claims</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1eaf56ac-4b7f-45bf-b5e1-bb73688254c7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 7266 of title 38, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idde9818f6-204a-4964-b6ad-93c0a38ed08d"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsections (b), (c), and
			 (d) as subsections (c), (d), and (e), respectively;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide5b3a18e-7909-4579-b7b5-e3f59049ae07"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following new subsection (b):</text>

				period not to exceed 120 days from the expiration of such initial period upon a
				motion—</text>
								<subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ide14d262d-01ef-4d7b-bc2d-e63f82b19e1b" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">filed with the Court not later than 120
				days after the expiration of such initial period; and</text>
								</subparagraph><subparagraph changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id03c6f769-a2b4-4995-b102-a22152b78c6d" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">showing good cause for such
				extension.</text>

			 subsection (a) shall take effect on the date of the enactment of this Act and
			 shall apply with respect to notices of appeal filed on or after the date of the
			 enactment of this Act.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="ida60c063b-80eb-4951-a569-6bbc548e0a8c" reported-display-style="italic" section-type="subsequent-section"><enum>19.</enum><header display-inline="yes-display-inline">Pilot program on participation of local and
			 tribal governments in improving quality of claims for disability compensation
			 submitted to Department of Veterans Affairs</header>
			<subsection commented="no" display-inline="no-display-inline" id="id35ea3ce6-58cc-4858-a985-f0235fa86d79"><enum>(a)</enum><header display-inline="yes-display-inline">Pilot program required</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 carry out a pilot program to assess the feasibility and advisability of
			 entering into memorandums of understanding with local governments and tribal
			 organizations—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idd67af2d1-2e8d-48dc-b1b3-89599a1b309b"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the quality of claims submitted
			 to the Secretary for compensation under chapter 11 of title 38, United States
			 Code; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7545c6e9-c63f-49af-86c3-cb2bf7d51cae"><enum>(2)</enum><text display-inline="yes-display-inline">to provide assistance to veterans who may
			 be eligible for such compensation in submitting such claims.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ida1659366-a9d2-4e90-bed9-96ac2f9fe353"><enum>(b)</enum><header display-inline="yes-display-inline">Minimum number of participating tribal
			 organizations</header><text display-inline="yes-display-inline">In carrying out
			 the pilot program required by subsection (a), the Secretary shall enter into
			 memorandums of understanding with at least two tribal organizations.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id2472e89e-0700-4476-aacb-7f272ad3f7c6"><enum>(c)</enum><header display-inline="yes-display-inline">Tribal organization defined</header><text display-inline="yes-display-inline">In this section, the term <term>tribal
			 organization</term> has the meaning given that term in section 3765 of title
			 38, United States Code.</text>
			</subsection></section><section changed="added" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id51E7B1467194407980650F661CCE3F87" reported-display-style="italic"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">20.</added-phrase></enum><header>Increase in
			 rate of pension for disabled veterans married to one another and both of whom
			 require regular aid and attendance</header>
			<subsection commented="no" display-inline="no-display-inline" id="id26A3F0AC3F3E4ADCB2E4CDB123DFE9D9"><enum><added-phrase committee-id="SSVA00" reported-display-style="italic">(a)</added-phrase></enum><header>In
			 general</header><text>Section 1521(f)(2) of title 38, United States Code, is
			 amended by striking <quote>$30,480</quote> and inserting
			 <quote>$31,305</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idBA8A7745EED64B41B47364839B7873C3"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall take effect on
			 the date of the enactment of this Act.</text>
			</subsection></section><section changed="added" committee-id="SSVA00" id="H596FFA9642D6497CAD26018BF41555CD" reported-display-style="italic"><enum>21.</enum><header>Automatic annual
			 increase in rates of disability compensation and dependency and indemnity
			 compensation</header>
			<subsection id="HABCD2338A1664828BC3E52004D2F264D"><enum>(a)</enum><header>Indexing to social
			 security increases</header><text>Section 5312 of title 38, United States Code,
			 is amended by adding at the end the following new subsection:</text>
				<quoted-block changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="HEAB47BAB7328479800996C5259A02DF4" reported-display-style="italic" style="USC">
					<subsection id="H14528A2263D24D2EA4DD76FC5422132B"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H8123F37FED3549889CE879BE2161B407"><enum>(1)</enum><text display-inline="yes-display-inline">Whenever there is an increase in benefit
				amounts payable under title II of the Social Security Act (42 U.S.C. 401 et
				seq.) as a result of a determination made under section 215(i) of such Act (42
				U.S.C. 415(i)), the Secretary shall, effective on the date of such increase in
				benefit amounts, increase the dollar amounts in effect for the payment of
				disability compensation and dependency and indemnity compensation by the
				Secretary, as specified in paragraph (2), as such amounts were in effect
				immediately before the date of such increase in benefit amounts payable under
				title II of the Social Security Act, by the same percentage as the percentage
				by which such benefit amounts are increased.</text>
						</paragraph><paragraph changed="added" committee-id="SSVA00" display-inline="no-display-inline" id="H148B6ACDBEB14DCBAA00A98F75C8B9F6" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The
				dollar amounts to be increased pursuant to paragraph (1) are the

			 Code, as added by subsection (a) of this section, shall take effect on the
			 first day of the first calendar year that begins after the date of the
			 enactment of this Act.</text>

			 correlation between employee pay and performance</header>

			 general</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of the enactment of this Act, the Secretary of Veterans
			 Affairs shall, in consultation with the Director of the Office of Personnel
			 Management, submit to Congress an action plan for improving the correlation
			 between the pay, advancement, and rewards of employees of the Department of
			 Veterans Affairs with their job performance, particularly with respect to
			 employees who perform work in relation to processing and adjudicating claims
			 for compensation under chapter 11 or 13 of title 38, United States Code.</text>
			</subsection><subsection id="id068AC424D6A94742A4766D55478EAB03"><enum>(b)</enum><header>Elements</header><text>The
			 action plan required by subsection (a) shall include the following:</text>
				<paragraph id="id785063058DC04B35B81A5E5B1F10760B"><enum>(1)</enum><text>Specific objectives,
			 planned actions, metrics for measuring improvements, and methods for tracking
			 progress.</text>
				</paragraph><paragraph id="idD981A5E191D74F859C3F55B814A9DE7D"><enum>(2)</enum><text>Such legislative changes
			 as the Secretary considers necessary to enhance the capacity of the Department
			 to improve the correlation described in subsection (a).</text>
