		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Motor Carrier Protection Act of
			 2010</short-title></quote>.</text>
		</section><section id="id48B83F4269F243E6828EFFA17BD1032E"><enum>2.</enum><header>Registration
			 requirements</header>
			<subsection id="id7F1DA9C88886400A8F11DD4E16247421"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="id0E82F079F41944ECBB9049EB387ACA5B"><enum>(1)</enum><header>Annual
			 registration fee</header><text>Each freight forwarder or freight broker that
			 registers under chapter 139 of title 49, United States Code, shall—</text>
					<subparagraph id="id663566FC8483480E86E4ED0AC3915E30"><enum>(A)</enum><text>pay an annual
			 registration renewal fee in an amount to be determined by the Secretary;</text>
					</subparagraph><subparagraph id="id6C9D8B87F50E4D12A4A81BB4FA6570CD"><enum>(B)</enum><text>provide updated
			 information for each registration; and</text>
					</subparagraph><subparagraph id="id4C2066F5F469447B9E3E08FA017E708F"><enum>(C)</enum><text>submit proof that
			 the registrant is in compliance with the applicable surety and insurance
			 requirements under such chapter 139.</text>
					</subparagraph></paragraph><paragraph id="id451259489F2642248D3269D61D28DFDD"><enum>(2)</enum><header>Use of
			 fees</header><text>All new fees collected by the Secretary as a result of the
			 new licensing requirements under this Act and the amendments made by this Act
			 shall be used to administer and enforce the registration and related
			 requirements under chapter 139 of title 49, United States Code.</text>
				</paragraph><paragraph id="idA7F040DDD65141708F8758A491B4918A"><enum>(3)</enum><header>Consequence of
			 noncompliance</header><text>Not later than 30 days after the date on which a
			 broker, freight forwarder, or motor carrier fails to comply with this
			 subsection, such entity shall be listed as inactive on all relevant Department
			 of Transportation Internet websites.</text>
				</paragraph></subsection><subsection id="id197BBBC524B64B26A070A337F1B9A4DE"><enum>(b)</enum><header>Amendments</header><text display-inline="yes-display-inline">Section 13901 of title 49, United States
			 Code, is amended—</text>
				<paragraph id="id2534EBEF19634417B3817EF6821CD933"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>A person</quote> and
			 inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id14DD4BA266BD4E2AA72929085C8B8F03" style="OLC">
						<subsection id="id842549B64D4D46199209B4E01C504B2B"><enum>(a)</enum><header>In
				general</header><text>A person</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idD3449BB7D6AD42D4869B74690B3E8BAB"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2B3E5BF12B8E4D3A907EA9D1D6EA3D3E" style="OLC">
						<subsection id="ID2cfe7f16805347468171fb30ad6cc9bd"><enum>(b)</enum><header>Registration
				numbers</header>
							<paragraph id="id251DC22CF41E418BBCB97118AADC5374"><enum>(1)</enum><header>In
				general</header><text>If the Administrator of the Federal Motor Carrier
				Administration registers a person under this chapter for 1 or more activities
				or services, including motor carrier, freight forwarder, or broker activities
				or services, the Administrator shall issue a distinctive registration number to
				the person for each such activity or service for which the person is
				registered.</text>
							</paragraph><paragraph id="id0D3DC3C3D7DF4B8CB174C792C2FF6537"><enum>(2)</enum><header>Activity or
				service type indicator</header><text>Each number issued under paragraph (1)
				shall include an indicator of the type of activity or service for which the
				registration number is issued, including whether the registration number is
				issued for registration of a motor carrier, freight forwarder, or broker
				activity or service.</text>
							</paragraph></subsection><subsection id="ID150ea0c0a0dc41048db2ea1be2bcbbf4"><enum>(c)</enum><header>Authority</header><text>For
				each shipment for which a registered person seeks compensation, the registered
				person shall specify, in writing, the operating authority under which it is
				providing the services
				required.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="id42B20F518FD34CDBAAE4BF3599F82560"><enum>3.</enum><header>Registration of
			 motor carriers</header><text display-inline="no-display-inline">Section 13902
			 of title 49, United States Code, is amended—</text>
			<paragraph id="id66B3E79DCF79458AA91BAA467096CA2C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
				<subparagraph id="idAFED0FF77F1C4F40BE39527BCA7B5654"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>using
			 vehicles the motor carrier owns or leases</quote> after <quote>motor
			 carrier</quote>; and</text>
				</subparagraph><subparagraph id="id836852C86B494B82A3872E90629A2195"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB338B0686E3D4BE0AA9A12F00A56AF8B" style="OLC">
						<paragraph id="id46827F42CF0248C2A737C56DB34DD5A6"><enum>(6)</enum><header>Separate
				registration required</header><text>A motor carrier may not broker
				transportation services unless the motor carrier has registered as a broker
				under this chapter.</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id0E0640EABB8348BFA343C52614F98405"><enum>(2)</enum><text>in subsection
			 (f), by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id63E4D6DEC5F5428AA17C5C5209ACFB05" style="OLC">
					<paragraph id="id99BD57F84237420DB84730176FBA97A1"><enum>(4)</enum><header>Insurance
				requirements</header><text>A motor carrier registered under this section shall
				maintain insurance for property damage required under section 13906(a)(4) for
				all shipments transported under its operating
				authority.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idAA628B125AC040D18E8993CEC4A9A65A"><enum>4.</enum><header>Registration and
			 security of freight forwarders and brokers</header>
			<subsection id="idF9A32A9BD13345FE911E5B551D74339B"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="id0A9D3F45E35A412CAD069B56A88428CC"><enum>(1)</enum><header>Amendment</header><text display-inline="yes-display-inline">Chapter 139 of title 49, United States
			 Code, is amended by striking sections 13903 and 13904 and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id4D6E1C6F5A304F2FA11FC2B2E94E3815" style="USC">
						<section id="ID4335b246d2cd4c1db25ea6b15e68d9fe"><enum>13903.</enum><header>Registration
				of freight forwarders and brokers</header>
							<subsection id="IDb92df1a4c5e746f8a7ff71c218786ea7"><enum>(a)</enum><header>In
				general</header><text>A person may not act as a freight forwarder by providing
				service subject to the jurisdiction under subchapter III of chapter 135 or as a
				broker unless the person holds a freight forwarder’s permit or a broker’s
				license, as the case may be, issued by the Federal Motor Carrier Safety
				Administration.</text>
							</subsection><subsection id="idF83A200607F849738982C3335E647A76"><enum>(b)</enum><header>Issuance of
				permit or license</header>
								<paragraph id="id82846BDDF4D74DBBBEB0B6398E700892"><enum>(1)</enum><header>Eligibility
				requirements</header><text>The Administrator of the Federal Motor Carrier
				Safety Administration shall issue a freight forwarder’s permit or broker’s
				license to any person that the Administration determines—</text>
									<subparagraph id="idABB9C3A1F6CA4D61A99DAB21290185B0"><enum>(A)</enum><text>to be qualified
				by experience and character to act as a freight forwarder or broker,
				respectively; and</text>
									</subparagraph><subparagraph id="id53F5B523A0F3441EB484B63DA194D2FF"><enum>(B)</enum><text>to be fit,
				willing, and able to provide the service and to comply with this part and
				applicable regulations of the Secretary.</text>
									</subparagraph></paragraph><paragraph id="id85248FBB47184609B518A2F77025318D"><enum>(2)</enum><header>Duration</header><text>The
				permit or license issued under paragraph (1) shall remain in effect only as
				long as the freight forwarder or broker is in compliance with section
				13904.</text>
								</paragraph></subsection><subsection id="ID9b0fa0cfa24844e7b7b4451a2333386b"><enum>(c)</enum><header>Registration as
				motor carrier required</header>
								<paragraph id="id1C6CF1612E1443B1B44E88433194BA40"><enum>(1)</enum><header>Freight
				forwarders</header><text>A freight forwarder may not provide transportation as
				a motor carrier unless the freight forwarder—</text>
									<subparagraph id="id234D1D64EF7B43A4998C6FDB47758621"><enum>(A)</enum><text>has registered
				separately to provide transportation as a motor carrier; and</text>
									</subparagraph><subparagraph id="id99651C8DCA73493D9EAF97BB8F423B6C"><enum>(B)</enum><text>has met all the
				requirements under this chapter applicable to motor carriers.</text>
									</subparagraph></paragraph><paragraph id="idF46E565A1D584C4882006D585A54EBEB"><enum>(2)</enum><header>Brokers</header><text>A
				broker may not provide transportation as a motor carrier unless the
				broker—</text>
									<subparagraph id="id5112909ACA8943AABCE022F361F221B7"><enum>(A)</enum><text>has registered
				separately to provide transportation as a motor carrier; and</text>
									</subparagraph><subparagraph id="id0844B7EB75BF49D9964FCD0140F0F469"><enum>(B)</enum><text>has met all of
				the requirements under this chapter applicable to motor carriers.</text>
									</subparagraph></paragraph></subsection><subsection id="ID955349bfb8d841238142430dfb973193"><enum>(d)</enum><header>Registration as
				freight forwarder or broker required</header><text>A motor carrier registered
				under this chapter—</text>
								<paragraph id="id5FD1C421F88543738231C5F0A00F849D"><enum>(1)</enum><text>may only provide
				transportation of property with motor vehicles owned or leased by the motor
				carrier; and</text>
								</paragraph><paragraph id="id3E5B3FCF2A944E9590784DB58AB5B878"><enum>(2)</enum><text>may not arrange
				such transportation unless the motor carrier has obtained a separate freight
				forwarder’s permit or broker’s license under this section.</text>
								</paragraph></subsection></section><section id="ID029047610ca441f0bacaeb105475c7b2"><enum>13904.</enum><header>Security of
				freight forwarders and brokers</header>
							<subsection id="ID18694e02d449464ab0e2d53e8a37464c"><enum>(a)</enum><header>Requirements</header>
								<paragraph id="id4BFC1EB3562E47CBB71EE04A29FEF56C"><enum>(1)</enum><header>In
				general</header><text>A person may not act as a freight forwarder or broker
				unless the person furnishes a bond, proof of trust fund, or other surety, or
				combination of such sureties, in a form and amount, and from a provider,
				determined by the Administrator of the Federal Motor Carrier Safety
				Administration to be adequate to insure financial responsibility.</text>
								</paragraph><paragraph id="id5643D0B3CDCC49B8BA4C35EF083FEC51"><enum>(2)</enum><header>Standards</header><text>The
				Administrator may authorize the use of a group bond, trust fund, or other
				surety, or combination of such securities that meet the cash and legal
				requirements under section 13904(d). The Administrator may not accept proof of
				security from any person whose surety or surety provider does not meet the
				standards established by the Administrator, by regulation. Bonds issued under
				this section may only be offered by a bonding company that has been approved by
				the Secretary of the Treasury.</text>
								</paragraph></subsection><subsection id="IDaa6e5936cbbb4b9fa33cebc71b1ee82e"><enum>(b)</enum><header>Scope of
				financial responsibility</header><text>A bond, trust fund, or other surety
				obtained under this section shall be available to pay any claim against a
				freight forwarder or broker arising from its failure to pay freight charges in
				its contracts, agreements, or arrangements for transportation subject to
				regulation under this chapter—</text>
								<paragraph id="ID86951cdbadb944f78c46cb937e6f291f"><enum>(1)</enum><text>with the consent
				of the insured freight forwarder or broker, subject to review by the surety
				company;</text>
								</paragraph><paragraph id="IDcdf5e92d63d74043876337bd292e3702"><enum>(2)</enum><text>if the claim is
				deemed valid by the surety company after the freight forwarder or broker has
				failed to respond to adequate notice to address the validity of the claim;
				or</text>
								</paragraph><paragraph id="ID8c3a734d809142578d4b6651510b3d28"><enum>(3)</enum><text>if the claimant
				made a reasonable attempt to resolve the claim under paragraphs (1) and (2),
				but the claim was not resolved within a reasonable period of time.</text>
								</paragraph></subsection><subsection id="IDfb4bd2c957a04c379bdaba8f92d74102"><enum>(c)</enum><header>Freight
				forwarder insurance</header>
								<paragraph id="id54A36A9BD3584E3B80275A3B23358FB9"><enum>(1)</enum><header>In
				general</header><text>The Administrator of the Federal Motor Carrier Safety
				Administration may not register a person as a freight forwarder under section
				13903 unless the person files with the Administrator a bond, insurance policy,
				or other type of security, in accordance with the standards established by the
				Administrator under this section.</text>
								</paragraph><paragraph id="IDc3c46350b4c14c08942eaa4bf48d31b9"><enum>(2)</enum><header>Liability
				insurance</header><text>A security filed under paragraph (1) shall be
				sufficient to pay an amount, not to exceed the amount of the security, for each
				final judgment against the freight forwarder for bodily injury to, or death of,
				an individual, or loss of, or damage to, property (other than property referred
				to in paragraph (3)), resulting from the negligent operation, maintenance, or
				use of motor vehicles by, or under the direction and control of, the freight
				forwarder when providing transfer, collection, or delivery service under this
				part.</text>
								</paragraph><paragraph id="IDdf8fded21e424e4ab8d6194e27f0b57a"><enum>(3)</enum><header>Cargo
				insurance</header><text>The Administrator may require a registered freight
				forwarder to file with the Administrator a bond, insurance policy, or other
				type of security approved by the Secretary, that will pay an amount, not to
				exceed the amount of the security, for loss of, or damage to, property for
				which the freight forwarder provides service.</text>
								</paragraph></subsection><subsection id="IDf937c0c0ccf24eedb9ee15e6391cdedc"><enum>(d)</enum><header>Additional
				requirements</header>
								<paragraph id="IDf6e1b5ba1aca44d69ace155cc001ce35"><enum>(1)</enum><header>Reissuance of
				licenses and permits</header><text>Not later than 4 years after the date of the
				enactment of the <short-title>Motor Carrier Protection Act
				of 2010</short-title>, freight forwarders and brokers shall acquire new
				licenses and permits from the Federal Motor Carrier Safety Administration that
				are subject to the terms and conditions under this subsection. Such licenses
				and permits shall expire 5 years after the date of issuance and may be renewed
				as provided under this chapter.</text>
								</paragraph><paragraph id="IDe46d605fa1e349089fc1f8d08fe086a6"><enum>(2)</enum><header>Experience or
				training requirement</header><text>Each freight forwarder and broker shall
				employ, as an officer, an individual who—</text>
									<subparagraph id="idCF7DF053D500448D947340F0CEF96937"><enum>(A)</enum><text>has at least 3
				years of relevant experience; or</text>
									</subparagraph><subparagraph id="idE69A2A4F0AC343C38E75A10788C430CD"><enum>(B)</enum><text>provides the
				Administrator with satisfactory evidence of certified training.</text>
									</subparagraph></paragraph><paragraph id="idE71E1A407CF14E249CC7E0B10963C0EC"><enum>(3)</enum><header>Online</header><text>The
				Administrator shall make information on permits, licenses, and financial
				security publicly available online, including—</text>
									<subparagraph id="id92B1EAA234644B5CB81AD89354BC7AFE"><enum>(A)</enum><text>the names and
				addresses of the principals of each entity holding a permit or license;
				and</text>
									</subparagraph><subparagraph id="id7A5D1055D40D4674863E357766C67DCA"><enum>(B)</enum><text>the electronic
				address of its surety for the submission of claims.</text>
									</subparagraph></paragraph><paragraph id="ID485b00eed9f04ae19d4b2feb2c9b0861"><enum>(4)</enum><header>Minimum
				financial security</header><text>Each freight forwarder and broker shall
				provide financial security of at least $100,000, regardless of the number of
				branch offices or sales agents of such entities.</text>
								</paragraph><paragraph id="ID940942dde7f845acb7009a69a2e4ac05"><enum>(5)</enum><header>Specific
				performance standards</header><text>The Administrator shall set specific
				performance standards for bonds or other acceptable surety, including
				requirements that—</text>
									<subparagraph id="id6CAF99AE0A674012A42489CB138CE57C"><enum>(A)</enum><text>at least $10,000
				be deposited with the surety in cash;</text>
									</subparagraph><subparagraph id="idE325170A2EC146B3922F7FA92BA45FCA"><enum>(B)</enum><text>the balance of
				the surety amount consists of assets readily available to pay valid claims
				without resort to personal guarantees or collection of pledged accounts
				receivable; and</text>
									</subparagraph><subparagraph id="id70E043B6383F4AC4907131C011FF4C17"><enum>(C)</enum><text>the surety is
				ultimately financially responsible for any failure to make the required
				payments.</text>
									</subparagraph></paragraph><paragraph id="ID070128de2ef9440b8ec9e5c62243bcf2"><enum>(6)</enum><header>Notice to
				cancel</header><text>If a surety required under this subsection is
				canceled—</text>
									<subparagraph id="id2E7D1893D28842ACB331E225E579E65F"><enum>(A)</enum><text>the holder of the
				surety shall provide electronic notification to the Administrator of such
				cancellation not later than 30 days before the effective date of such
				cancellation; and</text>
									</subparagraph><subparagraph id="id9F579A7D4F05414991D28BB522E5085F"><enum>(B)</enum><text>the Administrator
				shall immediately post such notification on its public website.</text>
									</subparagraph></paragraph><paragraph id="ID466ef2a4f6824d7a847f79cce9c4c7c0"><enum>(7)</enum><header>Suspension</header><text>The
				Administrator shall immediately suspend the registration of a freight forwarder
				or broker if its available security falls below the amount required under this
				subsection.</text>
								</paragraph><paragraph id="IDd9c76dacad6b46548476b4c05547aebc"><enum>(8)</enum><header>Payment of
				claims</header><text>If a registered freight forwarder or broker experiences
				financial failure or insolvency, the freight forwarder’s or broker’s surety
				shall—</text>
									<subparagraph id="id564ABA6C61D04B82B37E6642543C232B"><enum>(A)</enum><text>submit a notice
				to cancel the surety to the Administrator in accordance with paragraph
				(6);</text>
									</subparagraph><subparagraph id="idBA16DF483ECC4B5CB866D019A0C88318"><enum>(B)</enum><text>publicly
				advertise for claims for 60 days beginning on the date of publication by the
				Administrator of the notice to cancel the surety; and</text>
									</subparagraph><subparagraph id="idC62C78773E5A40DBBDFCBEA29E6600C0"><enum>(C)</enum><text>pay, not later
				than 30 days after the expiration of the 60-day period for submission of
				claims—</text>
										<clause id="id3B43B306430C4804BF12CC86F8A2A673"><enum>(i)</enum><text>all uncontested
				claims received during such period; or</text>
										</clause><clause id="id245CA33D07814AFD80C1B596B7CA7A31"><enum>(ii)</enum><text>a pro rata share
				of such claims if the total amount of such claims exceeds the financial
				security available.</text>
										</clause></subparagraph></paragraph><paragraph id="ID4e5dfde9024840a39f2b920e1b635608"><enum>(9)</enum><header>List of claims
				paid</header><text>Each surety under this subsection shall—</text>
									<subparagraph id="id2247361685594672B4CE58667092798C"><enum>(A)</enum><text>publish, on the
				surety’s website, a list of the claims paid by the surety immediately upon
				payment; and</text>
									</subparagraph><subparagraph id="idA6123479CDA3442886E7EAE80ECEBE39"><enum>(B)</enum><text>immediately
				submit a copy of such list to the Administrator.</text>
									</subparagraph></paragraph><paragraph id="IDfce068d990fb44ff870fd3c5be40ec23"><enum>(10)</enum><header>Penalties</header>
									<subparagraph id="id17A81ABAF2724CFBB7796F3ED8FCA800"><enum>(A)</enum><header>In
				general</header><text>Any surety that fails to comply with the requirements
				under this subsection—</text>
										<clause id="idEBF714383A2446EA91F045E08ECD0915"><enum>(i)</enum><text>shall be liable
				to the United States Government for a civil penalty in an amount not to exceed
				$10,000; and</text>
										</clause><clause id="idFB024E1ACD2B46D18FA184373DDB4B9D"><enum>(ii)</enum><text>shall be
				ineligible to offer broker and forwarder security under this chapter.</text>
										</clause></subparagraph><subparagraph id="id775FFB3D28474DBDAC8117D5322EE046"><enum>(B)</enum><header>Wilful
				violations</header><text>Any surety that knowingly and willfully violates the
				posting and notification requirements under this subsection shall be held
				financially liable for all valid claims submitted against the broker or
				forwarder involved, regardless of the amount of the security.</text>
									</subparagraph></paragraph><paragraph id="ID6be401fd2a424f87b42970095a352fb6"><enum>(11)</enum><header>Deduction of
				costs prohibited</header><text>The amount of the financial security required
				under this subsection may not be reduced by deducting attorney’s fees or
				administrative costs.</text>
								</paragraph><paragraph id="ID26709bfc40a84c8db174a43086c34b4d"><enum>(12)</enum><header>Audit</header><text>Claim
				payments by sureties shall be annually audited by a public accounting firm. The
				results of such audits shall be made publicly available on the surety’s
				website.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3694A7FCE2CA4F2591707FCACF8F3E11"><enum>(2)</enum><header display-inline="yes-display-inline">Rulemaking</header><text display-inline="yes-display-inline">Not later than 270 days after the date of
			 the enactment of this Act, the Administrator of the Federal Motor Carrier
			 Safety Administration shall issue regulations to enforce the requirements under
			 section 13904(d) of title 49, United States Code, as added by paragraph
			 (1).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82911EED2CB543E4A682CC7DCA1D5E5D"><enum>(3)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">Section 13904(d) of
			 title 49, United States Code, as added by paragraph (1), shall take effect on
			 the date that is 270 days after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="idB41019A7463D45328772F2E3E953721E"><enum>(b)</enum><header>Clerical

				</paragraph></subsection></section><section id="idFB1E92C088DE40818D655A2C632B8D9C"><enum>5.</enum><header>Review</header>
			<subsection id="ID86aedbf3b68641449388d796dbe26a3e"><enum>(a)</enum><header>Review by
			 Inspector General</header><text>Not later than 15 months after the date of the
			 enactment of this subsection, the Inspector General of the Department of
			 Transportation shall—</text>
				<paragraph id="idFFB5E7A26B604AE18D8C4EFE49E65E71"><enum>(1)</enum><text>review the
			 regulations and enforcement practices of the Federal Motor Carrier Safety
			 Administration under section 13904(d) of title 49, United States Code, as added
			 by section 4(a); and</text>
				</paragraph><paragraph id="idE04563A165A14AE58348757D78A997B0"><enum>(2)</enum><text>make any
			 recommendations to the Secretary of Transportation that may be necessary to
			 improve the enforcement of such regulations.</text>
				</paragraph></subsection><subsection id="ID07eb418fdb4e451a86630d598be159b6"><enum>(b)</enum><header>Security and
			 insurance amount assessment</header><text>Every 5 years, the Administrator of
			 the Federal Motor Carrier Safety Administration shall review, with public
			 notice and comment, the amount of the security and insurance required under
			 section 13904 of title 49, United States Code, to determine whether such
			 amounts are sufficient to provide adequate financial security.</text>
			</subsection></section><section id="idD74A9F1E8E8F402DA481DAE8E3ABBC5E"><enum>6.</enum><header>Unlawful
			 brokerage activities</header>
			<subsection id="id368D696175E64F39A8EA2B3009EA7B19"><enum>(a)</enum><header>In
			 general</header><text>Chapter 149 of title 49, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idAA0F3EC0AECE4215AAF04049ACD3CDE0" style="USC">
					<section id="id8900FCB737D942F7AB4E4B5FDD0487E6"><enum>14916.</enum><header>Unlawful
				brokerage activities</header>
						<subsection id="idBE33FF60F4D245AEABCB2FE2EC564E1C"><enum>(a)</enum><header>Prohibited
				activities</header><text>Any person that acts as a broker, other than a
				non-vessel-operating common carrier (as defined in section 40102(16) of title
				46), or an ocean freight forwarder providing brokerage as part of an
				international through movement involving ocean transportation between the
				United States and a foreign port, is prohibited from providing interstate
				brokerage services as a broker unless that person—</text>
							<paragraph id="id831FB050BDE54678B0CA1FC5EAB816C1"><enum>(1)</enum><text>is registered
				under, and in compliance with, section 13903; and</text>
							</paragraph><paragraph id="id82E27B8447614400A4C2F994A40DDA17"><enum>(2)</enum><text>has satisfied the
				financial security requirements under section 13904.</text>
							</paragraph></subsection><subsection id="idD87FBFA5A1684A8EA1D42220D4714AD5"><enum>(b)</enum><header>Civil penalties
				and private cause of action</header><text>Any person who knowingly authorizes,
				consents to, or permits, directly or indirectly, either alone or in conjunction
				with any other person, a violation of subsection (a) is liable—</text>
							<paragraph id="idA385764E1E39423785CD1A496C8D7BCA"><enum>(1)</enum><text>to the United
				States Government for a civil penalty in an amount not to exceed $10,000 for
				each violation; and</text>
							</paragraph><paragraph id="id4AA58327E106461A9CA81DF5BA830D98"><enum>(2)</enum><text>to the injured
				party for all valid claims incurred without regard to amount.</text>
							</paragraph></subsection><subsection id="idCE62A0494E15449F97CF8CBEAE450C4F"><enum>(c)</enum><header>Liable
				parties</header><text>The liability for civil penalties and for claims under
				this section for unauthorized brokering shall apply, jointly and
				severally—</text>
							<paragraph id="id06A60001A8214BA49C9D73124FF4440D"><enum>(1)</enum><text>to any corporate
				entity or partnership involved; and</text>
							</paragraph><paragraph id="id93025CD2FD63433882DD16428CEA7B12"><enum>(2)</enum><text>to the individual
				officers, directors, and principals of such
				entities.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id58699D6F514944E591790AF37BBF65D8"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections for chapter 149 of title 49,
			 United States Code, is amended by adding at the end the following:</text>
