		<section id="idABDF6720AFF3461F84CD7DB32DD667CA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>American Solar Energy Pilot Leasing
			 Act of 2010</short-title></quote>.</text>
		</section><section id="id6AB79E0E59A34AD5B83957A8285127FB"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id39CDEE6D6173496FB4A55965B48DF9DF"><enum>(1)</enum><header>County</header><text>The
			 term <term>County</term> means Lincoln County, Nevada.</text>
			</paragraph><paragraph id="idAF16B5B50F8943C186EFCE97D591C5C1"><enum>(2)</enum><header>Federal
			 land</header><text>The term <quote>Federal land</quote> means any of the
			 Federal land in the State under the administrative jurisdiction of the Bureau
			 of Land Management that is identified as a <quote>solar development
			 zone</quote> on the maps.</text>
			</paragraph><paragraph id="id9FD2187DD2014923819E17405C51A47E"><enum>(3)</enum><header>Fund</header><text>The
			 term <quote>Fund</quote> means the Renewable Energy Mitigation and Fish and
			 Wildlife Fund established by section 3(d)(5)(A).</text>
			</paragraph><paragraph id="idB992E5065A2D4AF7BCCFF194917FA6CA"><enum>(4)</enum><header>Map</header><text>The
			 term <quote>map</quote> means each of—</text>
				<subparagraph id="idD8FED2BD26AE41FEACF64793904AEB76"><enum>(A)</enum><text>the map entitled
			 <quote>Dry Lake Valley Solar Development Zone</quote> and dated May 25, 2010;
			 and</text>
				</subparagraph><subparagraph id="id39B1E1D1AA4A44288652C6BAA15FF552"><enum>(B)</enum><text>the map entitled
			 <quote>Delamar Valley Solar Development Zone</quote> and dated May 25,
			 2010.</text>
				</subparagraph></paragraph><paragraph id="id6788C4C31A6A4730A281BDCD77B6D964"><enum>(5)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of the Interior, acting
			 through the Director of the Bureau of Land Management.</text>
			</paragraph><paragraph id="id1C763154E9EF46E39C224A44C6CB298E"><enum>(6)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of Nevada.</text>
			</paragraph></section><section id="id7807120B56C24285B3F161F8940BEE5F"><enum>3.</enum><header>Development of
			 solar pilot project areas on public land in Lincoln County, Nevada</header>
			<subsection id="IDae2ddf0e21ad4dca817081f1aa8333ec"><enum>(a)</enum><header>Designation</header><text>In
			 accordance with sections 201 and 202 of the Federal Land Policy and Management
			 Act of 1976 (43 U.S.C. 1711, 1712) and subject to valid existing rights, the
			 Secretary shall designate the Federal land as a solar pilot project
			 area.</text>
			</subsection><subsection id="id91D4887651964510A7A6F451A618757C"><enum>(b)</enum><header>Applicable
			 law</header><text>The designation of the solar pilot project area under
			 subsection (a) shall be subject to the requirements of—</text>
				<paragraph id="idA8BC64B4CDF34B4D9E26EAE49E34A914"><enum>(1)</enum><text>this Act;</text>
				</paragraph><paragraph id="idB87E66A5B71F47C782CC6250262F9A2F"><enum>(2)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.); and</text>
				</paragraph><paragraph id="id7EFBF55DB3EC46C19C77EFB9BA1F4CE3"><enum>(3)</enum><text>any other
			 applicable law (including regulations).</text>
				</paragraph></subsection><subsection id="ID7afaf8f5c74f49a0b43c2918ce935083"><enum>(c)</enum><header>Solar lease
			 sales</header>
				<paragraph id="id388E79AF097640D49F87A28B78E1AD34"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall conduct lease sales and issue leases
			 for commercial solar energy development on the Federal land, in accordance with
			 this subsection.</text>
				</paragraph><paragraph id="IDc618bb43c6224595a45743bad4cd6b55"><enum>(2)</enum><header>Deadline for
			 lease sales</header><text>Not later than 60 days after the date of enactment of
			 this Act, the Secretary, after consulting with affected governments and other
			 stakeholders, shall conduct lease sales for the Federal land.</text>
				</paragraph><paragraph id="ID49eeb46cf1cc4202a6e074520af4e98b"><enum>(3)</enum><header>Easements,
			 special-use permits, and rights-of-way</header><text>Except for the temporary
			 placement and operation of testing or data collection devices, as the Secretary
			 determines to be appropriate, and the rights-of-way granted under section
			 301(b)(1) of the Lincoln County Conservation, Recreation, and Development Act
			 of 2004 (Public Law 108–424; 118 Stat. 2413) and BLM Case File N–78803, no new
			 easements, special-use permits, or rights-of-way shall be allowed on the
			 Federal land during the period beginning on the date of enactment of this Act
			 and ending on the date of the issuance of a lease for the Federal land.</text>
				</paragraph><paragraph id="ID0b43a2e248024fbcacd00005b9c5fefc"><enum>(4)</enum><header>Diligent
			 development requirements</header><text>In issuing a lease under this
			 subsection, the Secretary shall include work requirements and mandatory
			 milestones—</text>
					<subparagraph id="idD0F97E05C57948568F1FE38BC0383072"><enum>(A)</enum><text>to ensure that
			 diligent development is carried out under the lease; and</text>
					</subparagraph><subparagraph id="idACCA7D4B195A4DABBDD52A3A056D2282"><enum>(B)</enum><text>to reduce
			 speculative behavior.</text>
					</subparagraph></paragraph><paragraph id="ID8242ac3086874414a0cf57b5664d18e6"><enum>(5)</enum><header>Land
			 management</header><text display-inline="yes-display-inline">The Secretary
			 shall—</text>
					<subparagraph id="ID39367aab952c4cb2a822ed9e6c70e149"><enum>(A)</enum><text>establish the
			 duration of leases issued under this subsection;</text>
					</subparagraph><subparagraph id="IDe9ae046f248844ed901a7eaeb2d8ac5a"><enum>(B)</enum><text>include
			 provisions in the lease requiring the holder of a lease granted under this
			 subsection—</text>
						<clause id="ID09db41a6734046129223b236d848b33e"><enum>(i)</enum><text>to
			 furnish a reclamation bond or other form of security determined to be
			 appropriate by the Secretary;</text>
						</clause><clause id="ID9d73af9af9f546c09948e475e73adc83"><enum>(ii)</enum><text>on
			 completion of the activities authorized by the lease—</text>
							<subclause id="IDf8a1ee2ae0264dd1bb29cbc8325a067b"><enum>(I)</enum><text>to restore the
			 Federal land that is subject to the lease to the condition in which the Federal
			 land existed before the lease was granted; or</text>
							</subclause><subclause id="ID27a8ce844d4a4c88a29a1473611c9dbe"><enum>(II)</enum><text>to conduct
			 mitigation activities if restoration of the land to the condition described in
			 subclause (I) is impracticable; and</text>
							</subclause></clause><clause id="IDecab56c15efb4fdab9aa4e9b9c92292a"><enum>(iii)</enum><text>to comply with
			 such other requirements as the Secretary considers necessary to protect the
			 interests of the public and the United States; and</text>
						</clause></subparagraph><subparagraph id="ID2c1776edeba440b296af591600fa0019"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="idE601F3E422004157A299CB18165AB236"><enum>(i)</enum><text>establish best
			 management practices to ensure the sound, efficient, and environmentally
			 responsible development of solar resources on the Federal land in a manner that
			 would avoid, minimize, and mitigate actual and anticipated impacts to habitat
			 and ecosystem function resulting from the development; and</text>
						</clause><clause id="idBFF17D23D1A740CAAB928098CA4D0C62" indent="up1"><enum>(ii)</enum><text>include provisions in the lease
			 requiring renewable energy operators to comply with the practices established
			 under clause (i).</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDbc916437bcb448afa741cc6765cd1e1f"><enum>(d)</enum><header>Royalties</header>
				<paragraph id="IDa9fdc93bb93a4cd6aa881c8d1f814b36"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish royalties, fees, rentals,
			 bonuses, and any other payments the Secretary determines to be appropriate to
			 ensure a fair return to the United States for any lease issued under this
			 section.</text>
				</paragraph><paragraph id="id95D7189E10B6412DB8D4986011A197EA"><enum>(2)</enum><header>Rate</header><text>Any
			 lease issued under this section shall require the payment of a royalty
			 established by the Secretary by regulation in an amount that is equal to a
			 percentage of the gross proceeds from the sale of electricity at a rate
			 that—</text>
					<subparagraph id="IDf3df5a0ffbff4f37aa46d7c65f215a34"><enum>(A)</enum><text>encourages
			 production of solar energy;</text>
					</subparagraph><subparagraph id="IDf2f3f9e32e414da789f03568f4665865"><enum>(B)</enum><text>ensures a fair
			 return to the public comparable to the return that would be obtained on State
			 and private land; and</text>
					</subparagraph><subparagraph id="IDb065b877778548858748a4919ee1297c"><enum>(C)</enum><text>encourages the
			 maximum energy generation practicable using the least amount of land and other
			 natural resources, including water.</text>
					</subparagraph></paragraph><paragraph id="ID91223852201c4df3bfa2f19ffa67cea5"><enum>(3)</enum><header>Royalty
			 relief</header><text>To promote the maximum generation of renewable energy, the
			 Secretary may provide that no royalty or a reduced royalty is required under a
			 lease for a period not to exceed 5 years beginning on the date on which
			 generation is initially commenced on the Federal land subject to the
			 lease.</text>
				</paragraph><paragraph id="IDc672c8fb95b54cac837c27192d4e1dbe"><enum>(4)</enum><header>Disposition of
			 proceeds</header>
					<subparagraph id="idC28BB8C3A7274B2EA9DA75A3A4E61C51"><enum>(A)</enum><header>In
			 general</header><text>Of the amounts collected as royalties, fees, rentals,
			 bonuses, or other payments under a lease issued under this section—</text>
						<clause id="ID9852b6d6e58649dfa51f249660d84455"><enum>(i)</enum><text>25
			 percent shall be paid by the Secretary of the Treasury to the State within the
			 boundaries of which the income is derived;</text>
						</clause><clause id="ID9601cea096044f1cbb7d72dd421c83bf"><enum>(ii)</enum><text>25
			 percent shall be paid by the Secretary of the Treasury to the 1 or more
			 counties within the boundaries of which the income is derived;</text>
						</clause><clause id="ID4bc4ed02e19c4302a38d7df3f719e148"><enum>(iii)</enum><text>15 percent
			 shall—</text>
							<subclause id="id602547F72F574632B346306B28FABC68"><enum>(I)</enum><text>for the period
			 beginning on the date of enactment of this Act and ending on the date specified
			 in subclause (II), be deposited in the Treasury of the United States to help
			 facilitate the processing of renewable energy permits by the Bureau of Land
			 Management in the State, subject to subparagraph (B)(i)(I); and</text>
							</subclause><subclause id="ID41c63c1ca716446ebdcd8e06dc87e3f8"><enum>(II)</enum><text>beginning on the
			 date that is 10 years after the date of enactment of this Act, be deposited in
			 the Fund; and</text>
							</subclause></clause><clause id="ID1458ae9483d441edacc1aa93bdd83a05"><enum>(iv)</enum><text>35
			 percent shall be deposited in the Fund.</text>
						</clause></subparagraph><subparagraph id="id902F5468E97C4FB0829BDAE546922CAF"><enum>(B)</enum><header>Limitations</header>
						<clause id="id8D5FE0E18F484F2F913201E8ABBF8CF4"><enum>(i)</enum><header>Renewable
			 energy permits</header><text>For purposes of subclause (I) of subparagraph
			 (A)(iii)—</text>
							<subclause id="id4A9F51FEC7494B0495E8769923F69504"><enum>(I)</enum><text>not more than
			 $10,000,000 shall be deposited in the Treasury at any 1 time under that
			 subclause; and</text>
							</subclause><subclause id="idD306FFF8A51943278497CD40FD4B82E6"><enum>(II)</enum><text>the following
			 shall be deposited in the Fund:</text>
								<item id="id9833DA4E1E86482B9FE6AB3F54494EA1"><enum>(aa)</enum><text>Any
			 amounts collected under that subclause that are not obligated by the date
			 specified in subparagraph (A)(iii)(II).</text>
								</item><item id="id1346E69D411A4883836D86D954D85579"><enum>(bb)</enum><text>Any
			 amounts that exceed the $10,000,000 deposit limit under subclause (I).</text>
								</item></subclause></clause><clause id="id0114BE9DA8684D39AE75F4328906B673"><enum>(ii)</enum><header>Fund</header><text>Any
			 amounts deposited in the Fund under clause (i)(II) or subparagraph (A)(iii)(II)
			 shall be in addition to amounts deposited in the Fund under subparagraph
			 (A)(iv).</text>
						</clause></subparagraph></paragraph><paragraph id="ID0f06b9151dc7433c8737cf230d45ff1b"><enum>(5)</enum><header>Renewable
			 energy mitigation and fish and wildlife fund</header>
					<subparagraph id="id2992D5DA85B64D328E8178025286C7BB"><enum>(A)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a fund, to be known as the
			 <quote>Renewable Energy Mitigation and Fish and Wildlife Fund</quote>, to be
			 administered by the Secretary, for use in the State.</text>
					</subparagraph><subparagraph id="IDe9df65b7a0974feebc37f72ce15757e2"><enum>(B)</enum><header>Use of
			 funds</header><text>Amounts in the Fund shall be available to the Secretary,
			 who may make the amounts available to the State or other interested parties for
			 the purposes of—</text>
						<clause id="ID52e0c976536042929e55dd8dadfcef0b"><enum>(i)</enum><text>mitigating
			 impacts of renewable energy on public land, with priority given to land
			 affected by the solar development zones designated under this Act,
			 including—</text>
							<subclause id="id16C5D0F4866E4A06BEDC95CFFE8A4EA7"><enum>(I)</enum><text>protecting
			 wildlife corridors and other sensitive land; and</text>
							</subclause><subclause id="idB6B5366DA3EB4630BEC46E5EC9C02F9F"><enum>(II)</enum><text>fish and
			 wildlife habitat restoration; and</text>
							</subclause></clause><clause id="IDdff63e0a618d4d3bbbb179a5d233af23"><enum>(ii)</enum><text>carrying out
			 activities authorized under the <act-name parsable-cite="LWCFA">Land and Water
			 Conservation Fund Act of 1965</act-name> (16 U.S.C. 460l–4 et seq.) in the
			 State.</text>
						</clause></subparagraph><subparagraph id="ID842450958ed34cf98126b1cf72029d34"><enum>(C)</enum><header>Availability of
			 amounts</header><text>Amounts in the Fund shall be available for expenditure,
			 in accordance with this paragraph, without further appropriation, and without
			 fiscal year limitation.</text>
					</subparagraph><subparagraph id="IDf087437ab2f14b9a977df2fd5b04fb9d"><enum>(D)</enum><header>Investment of
			 fund</header>
						<clause id="id4EB928F08C0F488D9D6CBCF84C369C4F"><enum>(i)</enum><header>In
			 general</header><text>Any amounts deposited in the Fund shall earn interest in
			 an amount determined by the Secretary of the Treasury on the basis of the
			 current average market yield on outstanding marketable obligations of the
			 United States of comparable maturities.</text>
						</clause><clause id="idB20C26E65A8D4FCAB319D94C3CDB24AC"><enum>(ii)</enum><header>Use</header><text>Any
			 interest earned under clause (i) may be expended in accordance with this
			 paragraph.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="ID4ea952f87aed43d780d951afabffe77c"><enum>(e)</enum><header>Priority
			 development</header>
				<paragraph id="id5D7D0A741D004D6DA94C2D98E244684E"><enum>(1)</enum><header>In
			 general</header><text>Within the County, the Secretary shall give highest
			 priority consideration to implementation of the solar lease sales provided for
			 under this Act.</text>
				</paragraph><paragraph id="id148DEE841C16433B84451FCC99F76D21"><enum>(2)</enum><header>Evaluation</header><text>The
			 Secretary shall evaluate other solar development proposals in the County not
			 provided for under this Act in consultation with the State, County, and other
			 interested stakeholders.</text>
				</paragraph></subsection></section></legis-body>
