		<official-title>To authorize the Secretary of Health and Human Services,
		  acting through the Director of the Centers for Disease Control and Prevention,
		  to establish and implement a birth defects prevention, risk reduction, and
		  public awareness program.</official-title>

		<section id="HBAF43BFDB8AC454DBDC545847516FA6B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Birth Defects Prevention, Risk
			 Reduction, and Awareness Act of 2010</short-title></quote>.</text>
		</section><section commented="no" id="H9E95088608664D3389570874DFE67AB0"><enum>2.</enum><header>Birth defects
			 prevention, risk reduction, and awareness</header>
			<subsection id="H7FB7AA9D7EA140AFB6FADF8346E42DF6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 establish and implement a birth defects prevention and public awareness
			 program, consisting of the activities described in subsections (c) and
			 (d).</text>
			</subsection><subsection id="H3C586B642BCB4F938074424659D6604A"><enum>(b)</enum><header>Definitions</header><text>In
			 this Act:</text>
				<paragraph id="H11E0C1AB9E674218AFE687FCBCAA8786"><enum>(1)</enum><text>The term
			 <term>organization</term> means an organization with a demonstrated ability to
			 provide, and experience providing, specialized information on prenatal
			 exposures and breastfeeding exposures with oversight by a licensed health care
			 provider.</text>
				</paragraph><paragraph id="idDDDB0CE8C6294A6B8001FCB0C23A453F"><enum>(2)</enum><text>The term
			 <term>pregnancy and breastfeeding information services</term> includes
			 only—</text>
					<subparagraph id="H82A3CDD9DB69431F80EBBEC737851965"><enum>(A)</enum><text>information
			 services to provide accurate, evidence-based, clinical information regarding
			 maternal exposures during pregnancy that may be associated with birth defects
			 or other health risks, such as exposures to medications, chemicals, infections,
			 foodborne pathogens, illnesses, nutrition, or lifestyle factors;</text>
					</subparagraph><subparagraph id="H420659145F4547F48BC77759E0856247"><enum>(B)</enum><text>information
			 services to provide accurate, evidence-based, clinical information regarding
			 maternal exposures during breastfeeding that may be associated with health
			 risks to a breast-fed infant, such as exposures to medications, chemicals,
			 infections, foodborne pathogens, illnesses, nutrition, or lifestyle
			 factors;</text>
					</subparagraph><subparagraph id="HEC02D7D6577449B6943187263E3EA551"><enum>(C)</enum><text>the provision of
			 accurate, evidence-based information weighing risks of exposures during
			 breastfeeding against benefits of breastfeeding; and</text>
					</subparagraph><subparagraph id="HC14FF21E97BC470991495901A2E3111A"><enum>(D)</enum><text>the provision of
			 information described in subparagraph (A), (B), or (C) through counselors, Web
			 sites, fact sheets, telephonic or electronic communication, community outreach
			 efforts, or other appropriate means.</text>
					</subparagraph></paragraph><paragraph id="HE1FBF85288EC4DD9B85470CF0AC7F4C7"><enum>(3)</enum><text>The term
			 <term>Secretary</term> means the Secretary of Health and Human Services, acting
			 through the Director of the Centers for Disease Control and Prevention.</text>
				</paragraph></subsection><subsection commented="no" id="HC5BB035E60A843AC81B67BC482D46EE6"><enum>(c)</enum><header>Nationwide media
			 campaign</header><text>In carrying out subsection (a), the Secretary shall
			 conduct or support a nationwide media campaign to increase awareness among
			 health care providers and at-risk populations about pregnancy and breastfeeding
			 information services.</text>
			</subsection><subsection commented="no" id="HBEB182539B5B47F497B4E66797E5CFE4"><enum>(d)</enum><header>Grants for
			 pregnancy and breastfeeding information services</header>
				<paragraph id="H8B98B4CCD25640119244E5F4EA1FE359"><enum>(1)</enum><header>In
			 general</header><text>In carrying out subsection (a), the Secretary shall award
			 grants to organizations for any of the following:</text>
					<subparagraph commented="no" id="H6518ED03F76548EA935B10D2F237394E"><enum>(A)</enum><header>Information
			 services</header><text>The provision of, or campaigns to increase awareness
			 about, pregnancy and breastfeeding information services.</text>
					</subparagraph><subparagraph commented="no" id="HC15380727DFA453988A41C1065384EB0"><enum>(B)</enum><header>Surveillance and
			 research</header><text>The conduct or support of—</text>
						<clause id="H267657EEAC5C42CBA385F8E8E7FA57DF"><enum>(i)</enum><text>surveillance of,
			 or research on—</text>
							<subclause id="H535F38FAD01F425BB981F49E05514643"><enum>(I)</enum><text>maternal exposures
			 that may influence the risk of birth defects, prematurity, or other adverse
			 pregnancy outcomes; and</text>
							</subclause><subclause id="HE1988184F1FA42E79F4FF9C97C48E7DB"><enum>(II)</enum><text>maternal
			 exposures that may influence health risks to a breastfed infant; or</text>
							</subclause></clause><clause id="HFDC3B3485FFE42CC970B0282DBC269A3"><enum>(ii)</enum><text>networking to
			 facilitate surveillance or research described in this subparagraph.</text>
						</clause></subparagraph></paragraph><paragraph id="H533C73654FBA455C9AAC0D934B447363"><enum>(2)</enum><header>Preference for
			 certain organizations in certain states</header><text display-inline="yes-display-inline">The Secretary, in making any grant under
			 this subsection, shall give preference to organizations, otherwise equally
			 qualified, operating in States that have or had a pregnancy and breastfeeding
			 information service in place on or after January 1, 2006.</text>
				</paragraph><paragraph id="HBA39FE616E894034BEAEEE9B051B86B7"><enum>(3)</enum><header>Matching
			 funds</header><text>The Secretary may award a grant under this subsection only
			 to an organization that agrees, with respect to the costs to be incurred in
			 carrying out the grant activities, to make available (directly or through
			 donations from public or private entities) non-Federal funds toward such costs
			 in an amount that is not less than 25 percent of the amount of the
			 grant.</text>
				</paragraph><paragraph id="HE4769DFCD06B4836864E5FCC688A5B18"><enum>(4)</enum><header>Coordination</header><text>The
			 Secretary shall ensure that activities funded through a grant under this
			 subsection are coordinated, to the maximum extent practicable, with other birth
			 defects prevention and environmental health activities of the Federal
			 Government, including with respect to pediatric environmental health specialty
			 units and children’s environmental health centers.</text>
				</paragraph></subsection><subsection id="HEF702B71C05D4AB9A5B944C0F0DA834F"><enum>(e)</enum><header>Evaluation</header><text display-inline="yes-display-inline">In furtherance of the program under
			 subsection (a), the Secretary shall provide for an evaluation of pregnancy and
			 breastfeeding information services to identify efficient and effective models
			 of—</text>
				<paragraph id="H3D24ED5B0BC24E91909645E64B7ABBFD"><enum>(1)</enum><text>providing
			 information;</text>
				</paragraph><paragraph id="H20E93E534BC847BFB372E47DFD7EAA76"><enum>(2)</enum><text>raising awareness
			 and increasing knowledge about birth defects prevention measures;</text>
				</paragraph><paragraph id="H151BCBB22CEB42B288A91D52BF4CBFF2"><enum>(3)</enum><text>modifying risk
			 behaviors; or</text>
				</paragraph><paragraph id="H0A578D1F013742CF860CDC41A78982FF"><enum>(4)</enum><text>other outcome
			 measures as determined appropriate by the Secretary.</text>
				</paragraph></subsection><subsection commented="no" id="HBAFE91DD3A354894A41EB052DF4AC12E"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>To carry out this Act, there are authorized to be
			 appropriated $5,000,000 for fiscal year 2011, $6,000,000 for fiscal year 2012,
			 $7,000,000 for fiscal year 2013, $8,000,000 for fiscal year 2014, and
			 $9,000,000 for fiscal year 2015.</text>
