		<section commented="no" display-inline="no-display-inline" id="H8555622CA2E841B1A9111D1ADCFBF062" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Emergency Centers
			 Establishment Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H5262D9CA3F3F4ABF92662B5EE48ACF55" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Establishment of national emergency
			 centers</header>
			<subsection commented="no" display-inline="no-display-inline" id="H2328FB04589146E6825CB2FBDE939AF4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with the requirements of this
			 Act, the Secretary of Homeland Security shall establish not fewer than 6
			 national emergency centers on military installations.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H55E23372A6174C9AB5028C51D3F59A0E"><enum>(b)</enum><header display-inline="yes-display-inline">Purpose of national emergency
			 centers</header><text display-inline="yes-display-inline">The purpose of a
			 national emergency center shall be to use existing infrastructure—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H579AF05CBB6749C09858463889588F3F"><enum>(1)</enum><text display-inline="yes-display-inline">to provide temporary housing, medical, and
			 humanitarian assistance to individuals and families dislocated due to an
			 emergency or major disaster;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCFCB35ACA92E4F1BB54488E85BA7ADD1"><enum>(2)</enum><text display-inline="yes-display-inline">to provide centralized locations for the
			 purposes of training and ensuring the coordination of Federal, State, and local
			 first responders; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF40690E5883E4D60A7DEBBC947A5BE95"><enum>(3)</enum><text display-inline="yes-display-inline">to provide centralized locations to improve
			 the coordination of preparedness, response, and recovery efforts of government,
			 private, and not-for-profit entities and faith-based organizations.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HD4CB3B16618C488EAEE28F003F47ECD7" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Designation of military installations as
			 national emergency centers</header>
			<subsection commented="no" display-inline="no-display-inline" id="H22CDB69C6B4A4E39820174D657EA024F"><enum>(a)</enum><header display-inline="yes-display-inline">Designations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id7D1D1E9E6BAB4F76AD28CFE1D07FC812"><enum>(1)</enum><header display-inline="yes-display-inline">Initial designations</header><text display-inline="yes-display-inline">Not later than 60 days after the date of
			 the enactment of this Act, the Secretary of Homeland Security, in consultation
			 with the Secretary of Defense, shall designate 2 military installations as
			 sites for the establishment of national emergency centers, of which—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id9D176CD1EDC540EC911EC48A3C21DD7C"><enum>(A)</enum><text display-inline="yes-display-inline">1 shall be located in the area consisting
			 of Federal Emergency Management Agency Regions I, II, III, IV and V; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE6EE3FCDBDA447028BBB0A59826C27B2"><enum>(B)</enum><text display-inline="yes-display-inline">1 shall be located in the area consisting
			 of Federal Emergency Management Agency Regions VI, VII, VIII, IX, and X.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9CED51B1D2D5421683F277F490947D7B"><enum>(2)</enum><header display-inline="yes-display-inline">Additional designations</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 the enactment of this Act, the Secretary of Homeland Security, in consultation
			 with the Secretary of Defense, shall designate not fewer than 4 military
			 installations as sites for the establishment of national emergency centers in
			 addition to the military installations designated under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDEE43CE55A344B13BBF0C060FBB429CB"><enum>(b)</enum><header display-inline="yes-display-inline">Minimum requirements</header><text display-inline="yes-display-inline">A site designated as a national emergency
			 center shall be—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD3B262F218F745E69137F35DCFA8D51E"><enum>(1)</enum><text display-inline="yes-display-inline">capable of meeting for an extended period
			 of time the housing, health, transportation, education, public works,
			 humanitarian and other transition needs of a large number of individuals
			 affected by an emergency or major disaster;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H373730C7584F4E33B549CBF8E2E25FE8"><enum>(2)</enum><text display-inline="yes-display-inline">environmentally safe and shall not pose a
			 health risk to individuals who may use the center;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0F583A79BB3B4D9BAB83E8CF44EBDF42"><enum>(3)</enum><text display-inline="yes-display-inline">capable of being scaled up or down to
			 accommodate major disaster preparedness and response drills, operations, and
			 procedures;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H68367FAA39794C22926FC1584DF60646"><enum>(4)</enum><text display-inline="yes-display-inline">capable of housing existing permanent
			 structures necessary to meet training and first responders coordination
			 requirements during nondisaster periods;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDCFDBBCFFF7B4FFBA71162071C8876C6"><enum>(5)</enum><text display-inline="yes-display-inline">capable of hosting the infrastructure
			 necessary to rapidly adjust to temporary housing, medical, and humanitarian
			 assistance needs;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC5F3AD080B7E4CF3A5290A43DEA1ABF4"><enum>(6)</enum><text display-inline="yes-display-inline">required to consist of a complete
			 operations command center, including 2 state-of-the-art command and control
			 centers that will comprise a 24/7 operations watch center as follows:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3ECDE027BEE942799DDB5B722B0B3DE1"><enum>(A)</enum><text display-inline="yes-display-inline">one of the command and control centers
			 shall be in full ready mode; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE35F0C4D0276494BB5F16CE44F045295"><enum>(B)</enum><text display-inline="yes-display-inline">the other shall be used daily for training;
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC0726D7E049A435EBB802350EF04B726"><enum>(7)</enum><text display-inline="yes-display-inline">easily accessible at all times and be able
			 to facilitate handicapped and medical facilities, including during an emergency
			 or major disaster.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7777C679FBEC4A75981FDCF733729951"><enum>(c)</enum><header display-inline="yes-display-inline">Location of national emergency
			 centers</header><text display-inline="yes-display-inline">There shall be
			 established not fewer than 1 national emergency center in each of the following
			 areas:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HD8D699E087444C7FBFFBFC3381AB8B68"><enum>(1)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Regions I, II, and III.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H75E709D23CD4462C912F64C6BB9370CF"><enum>(2)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Region IV.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDC4F9C33FFFE49F0B82252A66570664E"><enum>(3)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Regions V and VII.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H53307EE0E08346B2869BB9C99BCC3F35"><enum>(4)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Region VI.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8BA5B0CE1D154407B125451F5E2652F4"><enum>(5)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Regions VIII and X.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB9C3FAAAA96B40C8861918448548A500"><enum>(6)</enum><text display-inline="yes-display-inline">The area consisting of Federal Emergency
			 Management Agency Region IX.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6DE5E3B1B8044ED3A60C5364FCB0F813"><enum>(d)</enum><header display-inline="yes-display-inline">Preference for military installations
			 designated as Regional Joint Readiness Centers and closed or materially
			 affected military installations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID1bbcee3dfc8a4182ad51768680002c1a"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In making designations under subsection
			 (a), the Secretary of Homeland Security, in consultation with the Secretary of
			 Defense, shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id74B3DFC1D15B4C23A41BCB2ED0AECECF"><enum>(A)</enum><text display-inline="yes-display-inline">give preference to any military
			 installation designated as a Regional Joint Readiness Center under the Defense
			 Base Closure and Realignment Act of 1990 (part A of title XXIX of Public Law
			 101–510; 10 U.S.C. 2687 note) that meets the requirements of subsections (b)
			 and (c); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E6213E3EAED4059B3CB91AA5EBDC87B"><enum>(B)</enum><text display-inline="yes-display-inline">after the application of subparagraph (A),
			 give preference to any closed military installation or materially affected
			 military installation that meets the requirements of subsections (b) and
			 (c).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0E11B3845ABC416796CE744B89ABA711"><enum>(2)</enum><header display-inline="yes-display-inline">Designation of portions of military
			 installations</header><text display-inline="yes-display-inline">If the
			 Secretary of Homeland Security and the Secretary of Defense jointly determine
			 that there is not a sufficient number of closed military installations that
			 meet the requirements of subsections (b) and (c), the Secretaries shall jointly
			 designate portions of military installations other than closed military
			 installations as National Emergency Centers.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HC7E6710E32FE4A988F5D8705E5F94F06"><enum>(e)</enum><header display-inline="yes-display-inline">Transfer of control of closed military
			 installations</header><text display-inline="yes-display-inline">If a closed
			 military installation is designated as a national emergency center, not later
			 than 180 days after the date of designation, the Secretary of Defense shall
			 transfer to the Secretary of Homeland Security administrative jurisdiction over
			 such closed military installation.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H6D41FB8633594AF0AA6A711F225FC1C1"><enum>(f)</enum><header display-inline="yes-display-inline">Cooperative agreement for joint use of
			 existing military installations</header><text display-inline="yes-display-inline">If an existing military installation other
			 than a closed military installation is designated as a national emergency
			 center, not later than 180 days after the date of designation, the Secretary of
			 Homeland Security and the Secretary of Defense shall enter into a cooperative
			 agreement to provide for the establishment of the national emergency
			 center.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H5A59C61548614C68BCBDEA17A14BD220"><enum>(g)</enum><header display-inline="yes-display-inline">Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="HD2831F60E00A4D9C8C77C356E9158D50"><enum>(1)</enum><header display-inline="yes-display-inline">Preliminary report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
			 the enactment of this Act, the Secretary of Homeland Security, acting jointly
			 with the Secretary of Defense, shall submit to Congress a report that contains
			 for each designated site—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HFB43BC39980746FD99E55A797447E683"><enum>(A)</enum><text display-inline="yes-display-inline">an outline of the reasons why the site was
			 selected;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H66576F85576F490BA27C5FC8F1507307"><enum>(B)</enum><text display-inline="yes-display-inline">an outline of the need to construct,
			 repair, or update any existing infrastructure at the site;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE3ADBDAB18843CAA83666473856E95B"><enum>(C)</enum><text display-inline="yes-display-inline">an outline of the need to conduct any
			 necessary environmental clean-up at the site;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H57680F15848647DB819F2E5F7848C220"><enum>(D)</enum><text display-inline="yes-display-inline">an outline of preliminary plans for the
			 transfer of control of the site from the Secretary of Defense to the Secretary
			 of Homeland Security, if necessary under subsection (e); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H4DC2B900621D4BC891B28080CD8DBD62"><enum>(E)</enum><text display-inline="yes-display-inline">an outline of preliminary plans for
			 entering into a cooperative agreement for the establishment of a national
			 emergency center at the site, if necessary under subsection (f).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB11C92477A3C4658B503F277F81819AD"><enum>(2)</enum><header display-inline="yes-display-inline">Update report</header><text display-inline="yes-display-inline">Not later than 120 days after the date of
			 the enactment of this Act, the Secretary of Homeland Security, acting jointly
			 with the Secretary of Defense, shall submit to Congress a report that contains
			 for each designated site—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="H3A93B1EF41B54693A4D04F0EB2C9BD7C"><enum>(A)</enum><text display-inline="yes-display-inline">an update on the information contained in
			 the report as required by paragraph (1);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H2D9E8C0A5D9B49F6A55DACC3841BDFBD"><enum>(B)</enum><text display-inline="yes-display-inline">an outline of the progress made toward the
			 transfer of control of the site, if necessary under subsection (e);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA99F7BB735B6453080A6F0013C4BB433"><enum>(C)</enum><text display-inline="yes-display-inline">an outline of the progress made toward
			 entering a cooperative agreement for the establishment of a national emergency
			 center at the site, if necessary under subsection (f); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA10E8D717B7D4B8483A0364C0C355D49"><enum>(D)</enum><text display-inline="yes-display-inline">recommendations regarding any
			 authorizations and appropriations that may be necessary to provide for the
			 establishment of a national emergency center at the site.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAB6310663D2C4E7A8022B4FA68EDDF73"><enum>(3)</enum><header display-inline="yes-display-inline">Final report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, the Secretary of Homeland Security, acting jointly with
			 the Secretary of Defense, shall submit to Congress a report that contains for
			 each designated site—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HE50332B564C34364B8D2F150289C0ED6"><enum>(A)</enum><text display-inline="yes-display-inline">finalized information detailing the
			 transfer of control of the site, if necessary under subsection (e);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H301186A671D14D2FB21F7C3D96708E11"><enum>(B)</enum><text display-inline="yes-display-inline">the finalized cooperative agreement for the
			 establishment of a national emergency center at the site, if necessary under
			 subsection (f); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H1332001DB8754BA29C277E385BB23188"><enum>(C)</enum><text display-inline="yes-display-inline">any additional information pertinent to the
			 establishment of a national emergency center at the site.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H63439932720E459785DA48B782FD1431"><enum>(4)</enum><header display-inline="yes-display-inline">Additional reports</header><text display-inline="yes-display-inline">The Secretary of Homeland Security, acting
			 jointly with the Secretary of Defense, may submit to Congress additional
			 reports as necessary to provide updates on steps being taken to meet the
			 requirements of this Act.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HEC518028C23F48E48A3D82A07F4549EC" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Limitations on statutory
			 construction</header><text display-inline="no-display-inline">This Act does not
			 affect—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H75CF44E7CFC04C298D04E9875FE6E8A5"><enum>(1)</enum><text display-inline="yes-display-inline">the authority of the Federal Government to
			 provide emergency or major disaster assistance or to implement any disaster
			 mitigation and response program, including any program authorized by the Robert
			 T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5121 et
			 seq.); or</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H26B253C8B74F4F72B0A1343BFB0461DB"><enum>(2)</enum><text display-inline="yes-display-inline">the authority of a State or local
			 government to respond to an emergency.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="H675DF3E9E6694C0C8B385890FDA04660" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as necessary to carry out this
			 Act.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H52412781B5714D03A7066FEFA6CCF604" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions
			 apply:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HA7F89E1E261245858935414EB6F775EF"><enum>(1)</enum><header display-inline="yes-display-inline">Closed military installation</header><text display-inline="yes-display-inline">The term <term>closed military
			 installation</term> means a military installation, or portion thereof, approved
			 for closure or realignment under the Defense Base Closure and Realignment Act
			 of 1990 (part A of title XXIX of Public Law 101–510; 10 U.S.C. 2687 note) that
			 meet all, or 2 out of the 3 following requirements:</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="HFAE8578D03FA4BBC9925A392630F0ABC"><enum>(A)</enum><text display-inline="yes-display-inline">Is located in close proximity to a
			 transportation corridor.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H65D6A41C03B84EE1BF79FA097B35D0D4"><enum>(B)</enum><text display-inline="yes-display-inline">Is located in a State with a high level or
			 threat of disaster related activities.</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H379678B9A9F54763AAFC01DC0BADDAF7"><enum>(C)</enum><text display-inline="yes-display-inline">Is located near a major metropolitan
			 center.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCEE84426B9F04F688DCF088229197E6A"><enum>(2)</enum><header display-inline="yes-display-inline">Emergency</header><text display-inline="yes-display-inline">The term <term>emergency</term> has the
			 meaning given such term in section 102 of the Robert T. Stafford Disaster
			 Relief and Emergency Assistance Act (42 U.S.C. 5122).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H416EF111F5B248068BE7EB754E71AFC9"><enum>(3)</enum><header display-inline="yes-display-inline">Major
			 disaster</header><text display-inline="yes-display-inline">The term <term>major
			 disaster</term> has the meaning given such term in section 102 of the Robert T.
			 Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5122).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H41615512F6244766B4AEF8E7253E2DDA"><enum>(4)</enum><header display-inline="yes-display-inline">Military installation</header><text display-inline="yes-display-inline">The term <term>military installation</term>
			 has the meaning given such term in section 2910 of the Defense Base Closure and
			 Realignment Act of 1990 (part A of title XXIX of Public Law 101–510; 10 U.S.C.
			 2687 note).</text>
