			 tribes</header><text display-inline="no-display-inline">Section 201 of the
			 Indian Financing Act of 1974 (25 U.S.C. 1481) is amended by adding at the end
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="id3DCE306C2D7B4E5DA86DB145A914323D" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="id7C20A66F3F594BD4B25CE43C4C2173BC"><enum>(c)</enum><header display-inline="yes-display-inline">Improving access to capital for Indian
				tribes</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id5D2992A18FE54DF38A5418C32D7570FE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall establish a tier system
				for loans guaranteed or insured under this section that is based on the number
				of on-reservation jobs created by each loan.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25819575743E4C1788F34AE93A6EFA60"><enum>(2)</enum><header display-inline="yes-display-inline">Effect</header><text display-inline="yes-display-inline">In establishing the tier system under
				paragraph (1), the Secretary shall consider more favorable equity terms or
				allow an increase in loan guarantees from 90 percent up to 100 percent of the
				unpaid principal and interest due on any loan made under this section for
				energy development or manufacturing carried out on Indian land or within a
				tribal service area recognized by the Bureau of Indian
				Affairs.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="IDfce7de3a41654938b819c6ac608f8ac5" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Surety bond guarantees</header><text display-inline="no-display-inline">Section 218 of the Indian Financing Act of
			 1974 (25 U.S.C. 1497a) is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idD54721B8B0474937B1C683370F9AEA8E" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="id236C5C184B134BA4B519738C6BDC7A6F" section-type="subsequent-section"><enum>218.</enum><header display-inline="yes-display-inline">Surety bond guarantees</header>
					<subsection commented="no" display-inline="no-display-inline" id="ID1f7c98139ae64d9ba9f750bf0aba4c62"><enum>(a)</enum><header display-inline="yes-display-inline">Amount; eligibility</header><text display-inline="yes-display-inline">The Secretary may issue a guarantee up to
				100 percent of amounts covered by a surety bond issued for eligible
				construction, renovation, or demolition work performed or to be performed by an
				Indian individual or Indian economic enterprise.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID06d01cb751cf4f008fb65f9781acc493"><enum>(b)</enum><header display-inline="yes-display-inline">Conditions</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idBD21BFA99B414D8192C92E09DB5495B8"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may provide a surety bond
				guarantee under this section only if the Secretary determines that—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID4be9438f95e44cf3908b2479af38b8ee"><enum>(A)</enum><text display-inline="yes-display-inline">the guarantee is necessary for the Indian
				individual or Indian economic enterprise to secure a surety bond on
				commercially reasonable terms;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf50e3cf1639741beae93cf678ed46997"><enum>(B)</enum><text display-inline="yes-display-inline">not more than 25 percent of the business of
				the surety is comprised of bonds guaranteed pursuant to this section;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6e1aa4ea1e1543e497fc522f15f29144"><enum>(C)</enum><text display-inline="yes-display-inline">the surety meets eligibility standards
				established by the Secretary in rules and regulations.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbe10655ff14f47139f2cbc64e7a8f9c8"><enum>(2)</enum><header display-inline="yes-display-inline">Prevention and mitigation of
				loss</header><text display-inline="yes-display-inline">The Secretary shall
				condition each surety bond guarantee to an Indian business on the existence
				of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id9E2BC1A736B04E079E27C581E98C9ABE"><enum>(A)</enum><text display-inline="yes-display-inline">appropriate technical assistance and
				advice; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB9C53A7264D744C6ADD7A92EE8700930"><enum>(B)</enum><text display-inline="yes-display-inline">adequate monitoring of the performance of
				the project.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcaa01a60cc9e415982f3b86bf9e075e2"><enum>(c)</enum><header display-inline="yes-display-inline">Fees and charges</header>
						<paragraph commented="no" display-inline="no-display-inline" id="idF46C8B0362E14CE99078CC77CAD7065B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The rules and regulations promulgated by
				the Secretary to carry out this section shall include the setting of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id1829F899081248C2BBEA9FB192CD0A73"><enum>(A)</enum><text display-inline="yes-display-inline">reasonable fees to be paid by the Indian
				individual or economic enterprise; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D794A433B23423E8CBD91872B6588C8"><enum>(B)</enum><text display-inline="yes-display-inline">reasonable premium charges to be paid by
				sureties.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA880B80486A54D13BF82109851264743"><enum>(2)</enum><header display-inline="yes-display-inline">Receipts</header><text display-inline="yes-display-inline">The receipts from fees and charges shall be
				made available to the Secretary for administration and management of this
				section.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID8187b5bc3c23431b9f2b27d3875f3814" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Indian employment, training, and related
			 services</header><text display-inline="no-display-inline">The Indian
			 Employment, Training, and Related Services Demonstration Act of 1992 (25 U.S.C.
			 3401 et seq.) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID16241e6ff6874a499a587ebdc991046b"><enum>(1)</enum><text display-inline="yes-display-inline">in section 2 (25 U.S.C. 3401), by striking
			 <quote>The purposes of this chapter are to demonstrate how Indian tribal
			 governments can integrate the employment, training, and related services they
			 provide in order</quote> and inserting <quote>The purposes of this chapter are
			 to promote tribal government integration of employment, training, and related
			 services</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdfce3975a63e447fbc566d5e096a8806"><enum>(2)</enum><text display-inline="yes-display-inline">in section 3 (25 U.S.C. 3402), by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id792F3429CB11482BACC05E2FA6B63A12" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDa2f64453aaa4444b900d5d68b728e180"><enum>(5)</enum><header display-inline="yes-display-inline">Tribal organization</header><text display-inline="yes-display-inline">The term <term>tribal organization</term>
				has meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance
				Act</act-name> (25 U.S.C.
				450b).</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE3B12E3662F34376BFDB40CCBBD99AE7"><enum>(3)</enum><text display-inline="yes-display-inline">in section 4 (25 U.S.C. 3403)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idE2B3679968E14B9EADC83EA6ABD16508"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>The Secretary</quote>
			 and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD3B2305017A644159FCA356CC4D6BEFC" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id541F9005CB874EAE9F6DD0CB43F9FB1E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The
				Secretary</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id136BA223B4914E38BD20DB66990109CE"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id997B493473A34684A78245A18A55E4D9" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDddfbbae1c0e344049d0c163ecd8e9d24"><enum>(b)</enum><header display-inline="yes-display-inline">Single integrated plan</header><text display-inline="yes-display-inline">On approval by the Secretary of a plan
				submitted by an Indian tribe or tribal organization under subsection (a), the
				covered programs shall be fully integrated into a single, coordinated,
				comprehensive program that shall not require the Indian tribe or tribal
				organization to submit to any additional budgets, reports, audits, supplemental
				audits, or other documentation requirements.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id1382EF8590E14D4EBD916B53AC2BA076"><enum>(c)</enum><header display-inline="yes-display-inline">Transfer of funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				all funds for programs and services covered by an approved plan under this
				section shall, at the request of the Indian tribe or tribal organization, be
				transferred to the Indian tribe or tribal organization pursuant to an existing
				contract, compact, or funding agreement, including those awarded under title I
				or IV of the <act-name parsable-cite="ISDA">Indian Self-Determination and
				Education Assistance Act</act-name> (25 U.S.C. 450 et
				seq.).</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID65e9250140264e4fb6530236ccc8c28d"><enum>(4)</enum><text display-inline="yes-display-inline">in section 5 (25 U.S.C. 3404), by striking
			 <quote>in a demonstration project under any such</quote> and inserting
			 <quote>under any</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09CA93A8D13044A286A90C439F32DD38"><enum>(5)</enum><text display-inline="yes-display-inline">in section 6 (25 U.S.C. 3405), by striking
			 paragraph (3) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA1C7340D3F42473992DEE512A424BBE5" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID29035828a2854f0992a8ec86af9d6c6f"><enum>(3)</enum><text display-inline="yes-display-inline">identify—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id04B83E59539648AB80C55D94E108331F"><enum>(A)</enum><text display-inline="yes-display-inline">the full range of potential employment
				opportunities on and near the service area of the Indian tribe or tribal
				organization; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF20E00BEA564408486F96698B092807D"><enum>(B)</enum><text display-inline="yes-display-inline">the education, training, and related
				services to be provided to assist individual Indians to access those employment
				opportunities;</text>
						</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id65EC0E6DCFEB4EF7936903B005E2B0E5"><enum>(6)</enum><text display-inline="yes-display-inline">by striking sections 7 and 8 (25 U.S.C.
			 3406, 3407) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idFE950D3FF61B4B359E07E36A5FB0B8C4" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="idB2B8FD8CB05545D7AF553503CBA85C4C" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Plan review and approval</header>
						<subsection commented="no" display-inline="no-display-inline" id="id416B1669E82E40DF827D9D910EF3528A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				receipt of a plan under section 4, the Secretary shall approve the plan,
				including any request for a waiver that is made as part of the plan, and
				authorize the transfer of funds pursuant to that plan, unless the Secretary
				provides written notification of disapproval of the plan that contains a
				specific finding that clearly demonstrates that, or that is supported by a
				controlling legal authority that, the plan does not meet the requirements of
				section 6.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id3CAAAD792C7C48C1BE512D52A51CE2B0"><enum>(b)</enum><header display-inline="yes-display-inline">Failure
				To act</header><text display-inline="yes-display-inline">Any plan that the
				Secretary fails to act on by the date that is 90 days after the date of receipt
				(or such extended time as may be provided under subsection (c)) shall be
				considered to be approved.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID94a9c7f0c4984b518c7e56ec2211a958"><enum>(c)</enum><header display-inline="yes-display-inline">Extension of time</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				the Secretary may extend or otherwise modify the 90-day period specified in
				subsection (a), if before the expiration of that period, the Secretary obtains
				the express written consent of the Indian tribe or tribal organization to
				extend or alter the period for up to 90 additional days.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDe07b8a6aa2024177b4a44c7ae8459460"><enum>(d)</enum><header display-inline="yes-display-inline">Review of decision; applicable
				provisions</header><text display-inline="yes-display-inline">On a decision to
				disapprove a plan, the following provisions of the
				<act-name parsable-cite="ISDA">Indian Self-Determination and Education
				Assistance Act</act-name> (25 U.S.C. 450 et seq.) shall apply to the review of
				the decision:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID7c7cc388177e42d181360db4392b1820"><enum>(1)</enum><text display-inline="yes-display-inline">Section 102(b) (25 U.S.C. 450f(b))
				(relating to the declination process).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDbf522255554e4193830b076369ec7b57"><enum>(2)</enum><text display-inline="yes-display-inline">Section 102(e) (25 U.S.C. 450f(e))
				(relating to burden of proof and finality).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdc7d7bfde3dc4f51acbb4fd2ccdbab5f"><enum>(3)</enum><text display-inline="yes-display-inline">Subsections (a) and (c) of section 110 (25
				U.S.C. 450m–1) (relating to
				appeals).</text>
							</paragraph></subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1CB06A0604704DC88A7275551E36E3C8"><enum>(7)</enum><text display-inline="yes-display-inline">in section 11 (25 U.S.C. 3410)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id81B153151E7B46039D4CF7810D47852C"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a), by striking paragraphs
			 (1) through (4) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id370EEAED49F94EFDBB7A5C61D27A72EE" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID31f7b9e679b64b1aaea2688048f89e78"><enum>(1)</enum><text display-inline="yes-display-inline">the development and use of a model single
				report for each approved plan submitted by an Indian tribe or tribal
				organization to report on the consolidated activities undertaken and joint
				expenditures made under the plan;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa471c805bbb7424b918fd6f6e46f9f3e"><enum>(2)</enum><text display-inline="yes-display-inline">the provision, either directly or through
				contract, of appropriate technical assistance to an Indian tribe or tribal
				organization with an approved plan, on the condition that the Indian tribe or
				tribal organization retains the authority to accept the plan for providing such
				technical assistance and the technical assistance provider;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6bdc51945d454f58aaf0773c678bccca"><enum>(3)</enum><text display-inline="yes-display-inline">the development and use of a single
				monitoring and oversight system for the plan;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID085ab800d9d84df49a433a9ce1d75a6c"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idE236C2E5C8664DBEA2E3287E02473ACC"><enum>(A)</enum><text display-inline="yes-display-inline">the receipt of all funds covered by a plan
				submitted by an Indian tribe or tribal organization and approved by the
				Secretary; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7ABF4786DC8A435D813111DAD50B5F07" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the distribution of all such funds to the
				respective Indian tribe or tribal organization; and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID530c34f9b9ce490cb90e8d31eb9d67f8"><enum>(5)</enum><text display-inline="yes-display-inline">the performance of activities described in
				section 7 relating to agency waivers and the establishment of an inter-agency
				dispute resolution process.</text>
						</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3F99C678C20647FDA9AB105A845F01A3"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (c); and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5217FCC3922248548CD1501C31B512A6"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idFBDEC1C883D84B6194E1F3C2888A1AEF" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID69d4b92b46e749e3b80410e042136b7d"><enum>(b)</enum><header display-inline="yes-display-inline">Interdepartmental memorandum</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idBD3C64939FBC469F98E070E3A4342D93"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The interdepartmental memorandum described
				in subsection (a) shall include, at a minimum, requirements for—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDe8bd6eca157a4ad4a696705cd00a1228"><enum>(A)</enum><text display-inline="yes-display-inline">an annual meeting of participating Indian
				tribes, tribal organizations, and Federal agencies, with the meeting co-chaired
				by a representative of the President and a representative of the participating
				Indian tribes;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1908490a1ee14092b333378672d74536"><enum>(B)</enum><text display-inline="yes-display-inline">an annual review of the achievements under
				the Act as well as statutory, regulatory, administrative, and policy obstacles
				that prevent participating Indian tribes from fully carrying out the purposes
				of the Act; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDce9adaef88c74129b04ed64ff2801eeb"><enum>(C)</enum><text display-inline="yes-display-inline">in accordance with paragraph (2), the
				establishment of an advisory committee to identify and resolve inter-agency or
				Federal-tribal conflicts in the administration of the Act.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDD0DE156C7914FCE8967AB5616FC0C28"><enum>(2)</enum><header display-inline="yes-display-inline">Advisory committee</header><text display-inline="yes-display-inline">The Advisory Committee described in
				paragraph (1)(C) shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID9fc2d0a75d834af691547ea3e8aa16dd"><enum>(A)</enum><text display-inline="yes-display-inline">be comprised of representatives appointed
				by the Secretary of the Interior, the Secretary of Labor, the Secretary of
				Health and Human Services, the Secretary of Education, the Secretary of
				Commerce, the Secretary of Transportation, and the Secretary of
				Agriculture;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF101EF3C838A477B956100BDA9436A00"><enum>(B)</enum><text display-inline="yes-display-inline">have 2 representatives appointed by the
				Secretary of the Interior from nominations submitted by Indian tribes or tribal
				organizations;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID832aa02cc95b479aad6698da9a715ccc"><enum>(C)</enum><text display-inline="yes-display-inline">meet at least twice per year; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72822e6c99e9446284b8d92d12e2e861"><enum>(D)</enum><text display-inline="yes-display-inline">be exempt from the requirements of Federal
				Advisory Committee Act (5 U.S.C.
				App.).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2e7c2fbd1d554b69bb718094bda29a92"><enum>(8)</enum><text display-inline="yes-display-inline">in section 12 (25 U.S.C. 3411), by striking
			 <quote>tribal government involved in any demonstration project be reduced as a
			 result of </quote> and inserting <quote>participating Indian tribe or tribal
			 organization be reduced as a result of the approval or implementation of a plan
			 under this Act or</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID41df139963624c519417a65561104382"><enum>(9)</enum><text display-inline="yes-display-inline">in section 13 (25 U.S.C. 3412), by striking
			 <quote>a tribal government in order to further the purposes of this Act</quote>
			 and inserting <quote>an Indian tribe or tribal organization in order to further
			 the purposes of this Act (including any amendments made to this
			 Act)</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id611E060C46DE4FC7B5625C5240A42175"><enum>(10)</enum><text display-inline="yes-display-inline">in section 14 (25 U.S.C. 3413)—</text>

				individual programs; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID01f7dc8f2be241e5810eb77ed81b9634"><enum>(C)</enum><text display-inline="yes-display-inline">to audit expenditures by original program
				source.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE424BDE072E04464BF01CFD6E2DCC82C"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>

				and participating Indian tribes shall be entitled to the full amount of the
				costs, subject to the regulations of each program or department.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1824FD9EB41D4C448432F9EB4DB4AD20"><enum>(B)</enum><header display-inline="yes-display-inline">Audit
				purposes</header><text display-inline="yes-display-inline">The difference
				between the amount of the commingled funds and the actual administrative cost
				of the programs, or the overage, shall be considered to be properly spent for
				Federal audit purposes, if the overage is used to carry out this Act.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF123E667E4A44558AE8F98642A8615FE"><enum>(C)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Amounts described in subparagraphs (A) and
				(B) shall be required to be obligated or expended consistent with the plan of
				the Indian tribe or tribal organization, but no additional justification or
				documentation of the purposes shall be required to be provided by the Indian
				tribe or tribal organization as a condition of receiving or expending the
				funds.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDffafe1563b6844519b80aa9544a8987e"><enum>(2)</enum><header display-inline="yes-display-inline">Carryover</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDaf5bab5d830e4bcba036c061f2c1c22e"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each fiscal year, any amounts
				transferred to an Indian tribe or tribal organization pursuant to this Act that
				remain unobligated or unexpended shall remain available for obligation or
				expenditure without fiscal year limitation.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID557da41b43d24c1784627ba0ed57f1c0"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Amounts described in subparagraph (A) shall
				be required to be obligated or expended consistent with the plan of the Indian
				tribe or tribal organization, but no additional justification or documentation

								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa9c97c783e37494d8695cadaf837a3d8"><enum>(3)</enum><header display-inline="yes-display-inline">Indirect
				costs</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of law, an Indian tribe or tribal organization shall be
				entitled to recover the full indirect costs associated with any amounts
				transferred to the Indian tribe or tribal organization pursuant to this Act, at
				the applicable indirect cost rate of the Indian tribe or tribal organization,
				as approved by the relevant Federal
				agency.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA2926B4ED4CD439FB21E76C8914A8386"><enum>(11)</enum><text display-inline="yes-display-inline">by amending section 16 (25 U.S.C. 3415) to
			 read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idC2DE4A07709F4B4188BACF75403A0459" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="IDc9be07e73b0a41c19c33151226b9fc3d" section-type="subsequent-section"><enum>16.</enum><header display-inline="yes-display-inline">Report on statutory obstacles to program
				integration</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID54b47c6ccce14f50842e8608aa68cab3"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 3 years after the date of
				enactment of the Native American Employment Act of 2010, the advisory committee
				established pursuant to section 11(b)(2) shall submit to the Committee on
				Indian Affairs and the Committee on Finance of the Senate and the Committee on
				Natural Resources and the Committee on Education and Labor of the House of
				Representatives a report on the implementation and administration of this Act
				and any inter-agency or Federal-tribal conflicts in the administration of this
				Act.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id77C47B2393664EEB858F1E654C6ADEFB"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The report shall identify any barriers to
				the ability of tribal governments to integrate more effectively the employment,
				training, and related services of the tribal governments in a manner consistent
				with the purposes of this Act.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDef3f3843ee5a40028924a73a028f1f08"><enum>(c)</enum><header display-inline="yes-display-inline">Feasibility study</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
				enactment of Native American Employment Act of 2010, the Comptroller General of
				the United States shall publish a study on the feasibility of expanding the
				integration program established under this Act to other Federal agencies that
				provide funding for employment, training, and related services to Indian tribes
				and tribal
				organizations.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDb06aba4e73fd417dbe71bb3cd6f769b5" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Native initiatives</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8BA12523C1D54CE8B4F7F9F3A51DB6DD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 104 of the Community Development
			 Banking and Financial Institutions Act of 1994 (12 U.S.C. 4703) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2697AD1B6DA6429798A7C65C08C66409" style="USC">
					<subsection commented="no" display-inline="no-display-inline" id="id716050EB44D449F2A4FFD48298B22470"><enum>(l)</enum><header display-inline="yes-display-inline">Native initiatives</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID940468bf5a2947e09e9d9ba04bd5d438"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDf47a9f0aca1241b0afbe6f1f74275f15"><enum>(A)</enum><header display-inline="yes-display-inline">Emerging Native community development
				financial institution</header><text display-inline="yes-display-inline">The
				term <term>emerging Native community development financial institution</term>
				means an entity that—</text>
								<clause commented="no" display-inline="no-display-inline" id="idEC9911E1A24342A4A8105F10264578ED"><enum>(i)</enum><text display-inline="yes-display-inline">primarily serves a Native community;
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idEE754AE84B7F4BA6B126791237B68472"><enum>(ii)</enum><text display-inline="yes-display-inline">demonstrates to the satisfaction of the
				Fund that the entity has a reasonable plan to achieve certification as a Native
				community development financial institution.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf2181ea79eed4666bce76e9d3359da8e"><enum>(B)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The terms <quote>Indian</quote> and
				<quote>Indian tribe</quote> have the meaning given the terms in section 4 of
				the Indian Self Determination and Education Assistance Act (25 U.S.C.
				450b).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1437a00560024c25a758e9645aa8102d"><enum>(C)</enum><header display-inline="yes-display-inline">Native community</header><text display-inline="yes-display-inline">The term <term>Native community</term>
				means targeted populations comprising—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDf059ad80a75f44e7aee195e5a2a52899"><enum>(i)</enum><text display-inline="yes-display-inline">Indian tribes; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDdcc866e55274417fb8003e6504f0d517"><enum>(ii)</enum><text display-inline="yes-display-inline">Native Hawaiians, as that term is defined
				in section 116 of the Carl D. Perkins Career and Technical Education Act of
				2006 (20 U.S.C. 2326).</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID620baf90c4504661a3d651f2866a4b8c"><enum>(D)</enum><header display-inline="yes-display-inline">Native community development financial
				institution</header><text display-inline="yes-display-inline">The term
				<term>Native community development financial institution</term> means a
				community development financial institution that primarily serves a Native
				community.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75a5a2e836974e6aaf22aa1ad8484b98"><enum>(2)</enum><header display-inline="yes-display-inline">Establishment and purposes</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idF11D6AAD50DF49FEBA34DEABE99DEE7B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 90 days after the date of
				enactment of this subsection, the Administrator shall establish the Native
				Initiatives as a component of the Fund.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8AEE26B48BA04E909246054A182046CE"><enum>(B)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of the Native Initiatives
				are—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID053f6353cc584f4aadbb975aad74236a"><enum>(i)</enum><text display-inline="yes-display-inline">to assist Native community development
				financial institutions to overcome barriers preventing access to credit,
				capital, and financial services in Native communities;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDa3143ec130fd4bd69adfa8004f678ed2"><enum>(ii)</enum><text display-inline="yes-display-inline">to foster the development of new Native
				community development financial institutions, strengthen the operational
				capacity of existing Native community development financial institutions, and
				guide Native community development financial institutions in the establishment
				of important financial education and asset building programs for the applicable
				Native communities;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDae02302f41184bccb3c3acf604861aa5"><enum>(iii)</enum><text display-inline="yes-display-inline">to provide seed capital for loan products
				to new and emerging Native community development financial institutions;
				and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID2437f482f4934b47a40ef677dd32ab86"><enum>(iv)</enum><text display-inline="yes-display-inline">to serve as the point of contact for an
				authorized Native community representative with respect to issues relating to
				access to credit, capital, and financial services in Native communities.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID30628110495f45779b47a4275be1070d"><enum>(3)</enum><header display-inline="yes-display-inline">Activities</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idFDD347AB85494EDEBC6FCC326E8D47A6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Through the Native Initiatives, the Fund
				shall provide to emerging and existing Native community development financial
				institutions—</text>
								<clause commented="no" display-inline="no-display-inline" id="idF2D99E94EFF341D2BD72F623AC728010"><enum>(i)</enum><text display-inline="yes-display-inline">outreach in accordance with section
				105(c);</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idA9B270FC0CA4437DA0135ADE5E00D880"><enum>(ii)</enum><text display-inline="yes-display-inline">financial assistance and technical
				assistance in accordance with section 108; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id4BE52F6B508B4D029D9AFD9B937F1B1C"><enum>(iii)</enum><text display-inline="yes-display-inline">training in accordance with section
				109.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8CAD5D1CA8194DCD87E5F0D34BCED132"><enum>(B)</enum><header display-inline="yes-display-inline">Matching requirements</header><text display-inline="yes-display-inline">In providing assistance under this
				subsection, the Secretary may apply matching requirements under section 108(e)
				at the discretion of the Secretary.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb52dca31f63243129682bab50a702a09"><enum>(4)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Administrator shall prescribe regulations and
				guidelines to carry out this subsection.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3e4a7fc30d1c438bbf7c0e76633d2b7f"><enum>(5)</enum><header display-inline="yes-display-inline">Consultation with tribal
				governments</header><text display-inline="yes-display-inline">In reviewing the
				performance of any assisted Native community development financial institution,
				the Fund shall conduct regular and meaningful consultation with, and seek input
				from, any appropriate authorized Native community.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3714736cc25944539a5bbabaedcc9fe3"><enum>(6)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Each year, the Fund shall submit to the
				Committee on Indian Affairs and the Committee on Banking, Housing, and Urban
				Development of the Senate and the Committee on Natural Resources and the
				Committee on Financial Services of the House of Representatives a report on the
				Native Initiatives regarding the effectiveness of the program developed under
				this
				subsection.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id128BF34716EA42C2A8633E1207618C05"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 121(a)(5) of the Community
			 Development Banking and Financial Institutions Act of 1994 (12 U.S.C.
			 4718(a)(5)) is amended by inserting before the period at the end the following:
			 <quote>, including funds, in an amount of not less than 10 percent of the
			 amounts appropriated to the Fund for any fiscal year under paragraph (1), to
			 carry out section 104(l).</quote>.</text>

						<subsection commented="no" display-inline="no-display-inline" id="IDae16680595b04ffabc308eb2d24d33a7"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">To the maximum extent practicable and
				notwithstanding any other provision of law, in any case in which funds are
				appropriated for the benefit of Indians, the Secretary shall direct that Indian
				labor shall be employed and any contract to fulfill requirements for goods or
				services, manufacturing, or construction, renovation, or demolition work
				(including, at a minimum, housing, schools, other facilities, roads, bridges,
				and other infrastructure projects) shall be awarded to an Indian organization
				or economic enterprise (as those terms are defined in section 3 of the Indian
				Financing Act of 1974 (25 U.S.C. 1452)).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDb9d09068850e4d778575eb8c0db5c33a"><enum>(c)</enum><header display-inline="yes-display-inline">Advertisement</header><text display-inline="yes-display-inline">To the maximum extent practicable,
				contracts to which this section applies shall be advertised sufficiently in
				advance of the selection process and the date that contract performance is
				required in a manner that permits a subsequent open market advertisement of the
				contract if the contract cannot be awarded under the limited competition
				provided in this section.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDfbb54b0edda54fa29836c43df8f132bc"><enum>(d)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">To implement the contracting directive
				under subsection (a), a contracting officer—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID012e818105ed46c3952514809d5d9124"><enum>(1)</enum><text display-inline="yes-display-inline">shall limit the competition for award of a
				contract to Indian economic enterprises if—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID37f103b8241f4a47b9a997c9943a567e"><enum>(A)</enum><text display-inline="yes-display-inline">there is a reasonable expectation that
				offers will be obtained from at least 3 unaffiliated responsible offerors;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8dcab971cb374593b064a7a4fa776549"><enum>(B)</enum><text display-inline="yes-display-inline">the contract can be awarded at a fair and
				reasonable price;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfc0b2b4d931f418da78e0b64d7a84510"><enum>(2)</enum><text display-inline="yes-display-inline">shall consider the extent to which the
				offerors will provide positive economic impact, including training and
				employment of Indians in connection with contract performance and in
				subcontracting any work under the contract, on 1 or more Indian reservations
				(as defined in section 3 of the Indian Financing Act of 1974 (25 U.S.C.
				1452));</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2827b2f80f55468594c9bdbe4e8e257f"><enum>(3)</enum><text display-inline="yes-display-inline">may, if only 1 offer is received under a
				competition limited to Indian economic enterprises, negotiate an award of the
				contract at a fair and reasonable price to the offering Indian economic
				enterprise; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7507759468fd4518865ce53f194b3879"><enum>(4)</enum><text display-inline="yes-display-inline">shall not make an award of any contract
				subject to this section until the prospective awardee has submitted an
				acceptable plan for contract performance that will maximize the use of
				qualified Indian labor, supplies, and economic enterprises as
				subcontractors.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf99c4e53298c438faf45826702e0ab6a"><enum>(e)</enum><header display-inline="yes-display-inline">Other circumstances</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id0B71ED00F73C40A59F0CB5C34F194BFB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If it is not feasible for competition to be
				limited as provided in subsection (d) and the contracting officer elects to
				award the contract after full and open competition, the contract shall be
				awarded to any responsible Indian economic enterprise submitting the lowest bid
				submitted by a responsible Indian economic enterprise, if that bid does not
				exceed the bid submitted by any other responsible bidder by more than 10
				percent.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFC1DD6D0E5C146C183B57BCF0FD544C2"><enum>(2)</enum><header display-inline="yes-display-inline">Other determinative factor</header><text display-inline="yes-display-inline">If a factor other than price is
				determinative in the award of a contract, the contracting officer shall use a
				comparable method to provide a preference to Indian economic enterprises in the
				selection process.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8e9cc51fdcc74d84a3a470313a99b4c8"><enum>(f)</enum><header display-inline="yes-display-inline">Waiver</header><text display-inline="yes-display-inline">The requirements of this section may be
				waived only if—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id261117B958F24D248B9DE02939953F5E"><enum>(1)</enum><text display-inline="yes-display-inline">there are extraordinary circumstances;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCC4D93232F4B461F85B65E6E37D40D9C"><enum>(2)</enum><text display-inline="yes-display-inline">the Assistant Secretary of the Interior for
				Indian Affairs makes the waiver determination.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDac934f35883c44dbba9fd0c05027d13b"><enum>(g)</enum><header display-inline="yes-display-inline">Utilization</header><text display-inline="yes-display-inline">The Secretary shall provide a preference to
				an Indian economic enterprise in the award of a contract that does not involve
				funds appropriated for the benefit of Indians by an agency within the
				Department of the Interior if the Secretary determines that the preference will
				help fulfill the special responsibilities of the Secretary to 1 or more Indian
				tribes.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4f827d4436274dc7bdfd39b6af64fcf3"><enum>(h)</enum><header display-inline="yes-display-inline">Appropriated for the benefit of
				Indians</header><text display-inline="yes-display-inline">For purposes of this
				section, funds awarded or distributed under a contract are appropriated for the
				benefit of Indians if—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDe0d90a6191124316b31a50601670ca20"><enum>(1)</enum><text display-inline="yes-display-inline">Indians are the primary beneficiaries of
				the contract; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3631fda427c2428f97baa70268651a24"><enum>(2)</enum><text display-inline="yes-display-inline">the majority of the activity to be
				undertaken under the contract takes place on or near boundaries of reservations
				(as defined in section 3 of the Indian Financing Act of 1974 (25 U.S.C.
				1452)).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID955b9d33efbc4b8a8b0b6d7162248c17"><enum>(i)</enum><header display-inline="yes-display-inline">Other
				agencies</header><text display-inline="yes-display-inline">Nothing in this
				section precludes the Indian Health Service or the Administration of Native
				Americans within the Department of Health and Human Services, the Office of
				Native American Programs in the Department of Housing and Urban Development, or
				any other Federal agency from using, at the discretion of the agency, the
				preferences provided under this section in cases in which funds are
				appropriated for the benefit of Indians.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5764b2e984d74df5a31cae71e15d28d7"><enum>(j)</enum><header display-inline="yes-display-inline">Certification</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id7C5E21B2A84A44D69B0D142B96C06A9E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An Indian economic enterprise seeking a
				contract award pursuant to this section shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idF090C30AC22943488AC9894734AB5319"><enum>(A)</enum><text display-inline="yes-display-inline">certify that the enterprise is an Indian
				economic enterprise eligible for award of a contract or subcontract under this
				section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDC73CA837347416581811484FA2416F1"><enum>(B)</enum><text display-inline="yes-display-inline">submit an affidavit certifying compliance
				with the requirements set out by the agency awarding the contract or
				subcontract.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id76CB3D5495D84CA6AB813B5FD9D57BE0"><enum>(2)</enum><header display-inline="yes-display-inline">Investigation</header><text display-inline="yes-display-inline">Nothing in this section prohibits the
				Secretary of the Interior, in conducting a pre-award review, from—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id1DF1B51C16F44CB18D43F8D09B1F1E97"><enum>(A)</enum><text display-inline="yes-display-inline">investigating the eligibility of an
				enterprise; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE6309EBCEB94AB6A06AB634CFE775CE"><enum>(B)</enum><text display-inline="yes-display-inline">determining at that stage that an apparent
				awardee is, in fact, not eligible for award under this section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA2060DB04CEB41D0BC0026C182640F6E"><enum>(3)</enum><header display-inline="yes-display-inline">Protest</header><text display-inline="yes-display-inline">The regulations of the Department of the
				Interior implementing this section and providing for protest to challenge and
				enter an Indian economic enterprise certification shall provide that the
				eligible protestors include—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id2A0FF1165181491896FECF8B92457826"><enum>(A)</enum><text display-inline="yes-display-inline">the Indian tribe on whose reservation the
				contract is to be carried out; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE5628D1382BC4B3AAFFA92508013F095"><enum>(B)</enum><text display-inline="yes-display-inline">any other offerors eligible to submit
				offers for contract award under this section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id149987ACDA51455A9859D8B524B6B4D0"><enum>(4)</enum><header display-inline="yes-display-inline">Enforcement</header><text display-inline="yes-display-inline">This section shall be subject to the
				relevant provisions of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id5DEF6C54C20D4E7CB819D4F24AD25850"><enum>(A)</enum><text display-inline="yes-display-inline">the Act of August 27, 1935 (25 U.S.C. 305
				et seq.) (commonly known as the <quote>Indian Arts and Crafts Act</quote>);
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id726DF094261A4728A53F5A96815540EE"><enum>(B)</enum><text display-inline="yes-display-inline">section 1159 of title 18, United States
				Code.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4D0507321B314524B363BE8B8D67F9B5"><enum>(b)</enum><header display-inline="yes-display-inline">Database</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID19f35e38af1b45b790e4ca62eaee96dd"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDdff522f5dddd42e7a783f1762c4b8194"><enum>(A)</enum><header display-inline="yes-display-inline">Data center</header><text display-inline="yes-display-inline">The term <term>Data Center</term> means the
			 Indian Economic Enterprise Data Center established under paragraph (2).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id89E064D9E6594818A7A81F09E6691688"><enum>(B)</enum><header display-inline="yes-display-inline">Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means
			 a tribal, private, public, or educational institution with experience in Indian
			 business development.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcc5d36f3336f4b8d8c03ff133d29fc3f"><enum>(C)</enum><header display-inline="yes-display-inline">Indian economic enterprise</header><text display-inline="yes-display-inline">The term <term>Indian economic
			 enterprise</term> has the meaning given the term in section 3 of the Indian
			 Financing Act of 1974 (25 U.S.C. 1452).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9f87e6cf0069443ba5b658afa3db15ba"><enum>(2)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall enter into 1 or more
			 contracts with an eligible entity to establish and operate an Indian Economic
			 Enterprise Data Center.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2966639a53cc43408b0562fe5b8374e3"><enum>(3)</enum><header display-inline="yes-display-inline">Responsibilities</header><text display-inline="yes-display-inline">The responsibilities of the Data Center
			 shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID5ce4b56f21ae494b862107ee78c0bcad"><enum>(A)</enum><text display-inline="yes-display-inline">listing Indian economic enterprises
			 eligible for various Federal minority preference programs;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3a1b3454254b44f58718131299c4b41c"><enum>(B)</enum><text display-inline="yes-display-inline">listing the businesses in which the
			 enterprises are engaged;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8332cb72417940ea881c251b8dc67e2f"><enum>(C)</enum><text display-inline="yes-display-inline">listing the experience of the enterprises
			 in fulfilling contract obligations;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf513700ceefd4796b1cb4c7c765c7db9"><enum>(D)</enum><text display-inline="yes-display-inline">listing the capabilities of the
			 enterprises;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4be3923c0a634d8789355162394dc14f"><enum>(E)</enum><text display-inline="yes-display-inline">verifying preference information and
			 documentation submitted to the Data Center;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID73cd1a656c5a4aeb8f4b641e64b62332"><enum>(F)</enum><text display-inline="yes-display-inline">listing advance procurement information for
			 the purposes of bid matching contract opportunities to contractor
			 capabilities;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0e4931c0efda4a78b4f23763e2b48be3"><enum>(G)</enum><text display-inline="yes-display-inline">listing known front organizations or
			 fraudulent operators; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb74a4a5d18944e9c8870b03a87e5598a"><enum>(H)</enum><text display-inline="yes-display-inline">providing such additional information as
			 the Secretary considers to be appropriate.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf25c41eca2414869854e37d37e0ee72e"><enum>(4)</enum><header display-inline="yes-display-inline">Information dissemination</header><text display-inline="yes-display-inline">Each year, the Data Center shall provide a
			 list of Indian economic enterprises eligible for various minority preferences
			 to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDd71d25a786444906aea510d1e026fe6c"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal agencies that administer the
			 preferences; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID55eb1fd284344270b8086302fbf85bb5"><enum>(B)</enum><text display-inline="yes-display-inline">any private entities that request the
			 list.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8c756ae3de9d406cbf3bd4cbab83f378"><enum>(5)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">Entities eligible to enter into a contract
			 under paragraph (2) shall be tribal, private, public, or educational
			 institutions with experience in Indian business development.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID323dd53fd3cd4ccc96c58f534fd38abc"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting requirements</header><text display-inline="yes-display-inline">Each year, the Secretary of the Interior
			 shall submit to the Committee on Indian Affairs of the Senate and the Committee
			 on Natural Resources of the House of Representatives a report describing the
			 status of Indian economic enterprises under this section and section 23 of the
			 Act of June 25, 1910 (25 U.S.C. 47) (commonly known as the <quote>Buy Indian
			 Act</quote>) across the entire Department of the Interior and the information
			 from the Data Center.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID1bf5a41343564e3db774199080634687" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Native American small business development
			 program</header><text display-inline="no-display-inline">The Small Business Act
			 (15 U.S.C. 631 et seq.) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="IDa21959fdfad1422ca3c64da761264248"><enum>(1)</enum><text display-inline="yes-display-inline">in section 4(b)(1) (15 U.S.C.
			 633(b)(1))—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idC7B3DC04B4224D588EA7B0EFA85180F4"><enum>(A)</enum><text display-inline="yes-display-inline">in the fifth sentence, by striking
			 <quote>five Associate Administrators</quote> and inserting <quote>6 Associate
			 Administrators</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1f698e76838a4a198be931130b77e247"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after the fifth sentence the
			 following: <quote>1 Associate Administrator shall be the Associate
			 Administrator of the Office of Native American Affairs established by section
			 44.</quote>;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd503c317fc5d4c00af3d0c9c6deaf5b8"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating section 44 as section 45;
			 and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID51e80d9702444717882320e005eff2f3"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after section 43 (15 U.S.C.
			 657o) the following:</text>

				program</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID32e171af299e446684e6933e876d5789"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID00b12700fd604ce682cd403ad7878821"><enum>(1)</enum><header display-inline="yes-display-inline">Associate Administrator</header><text display-inline="yes-display-inline">The term <term>Associate
				Administrator</term> means the Associate Administrator of the Office of Native
				American Affairs established under subsection (b).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1d376169bae746498ae32b1d53030ff1"><enum>(2)</enum><header display-inline="yes-display-inline">Center; Native American business
				center</header><text display-inline="yes-display-inline">The terms
				<term>center</term> and <term>Native American business center</term> mean a
				center established under subsection (c).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDca47da5144c743ea92d4add588fb3046"><enum>(3)</enum><header display-inline="yes-display-inline">Eligible applicant</header><text display-inline="yes-display-inline">The term <term>eligible applicant</term>
				means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf6eafeae0c3d49b497a603c5006e927b"><enum>(A)</enum><text display-inline="yes-display-inline">a tribal college;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID752ed030d6564ba0b037cc0781f435ea"><enum>(B)</enum><text display-inline="yes-display-inline">a private, nonprofit organization—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID91992477e4c746569c028ed59cf94a6a"><enum>(i)</enum><text display-inline="yes-display-inline">that provides business and financial or
				procurement technical assistance to 1 or more Native American communities;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID079fab78f6cb41d19443c04c7a1a4505"><enum>(ii)</enum><text display-inline="yes-display-inline">that is dedicated to assisting one or more
				Native American communities; or</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdc3067011fe34f49bb9281440549c914"><enum>(C)</enum><text display-inline="yes-display-inline">a small business development center,
				women’s business center, or other private organization participating in a joint
				project.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID127dc80bba4146879fa61201f49ca227"><enum>(4)</enum><header display-inline="yes-display-inline">Joint project</header><text display-inline="yes-display-inline">The term <term>joint project</term> means a
				project that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDf8f67909e0ae4a8ea6e527b2a5c76eec"><enum>(A)</enum><text display-inline="yes-display-inline">combines the resources and expertise of 2
				or more distinct entities at a physical location dedicated to assisting the
				Native American community; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID689e42b321614118b2bdef393bd65936"><enum>(B)</enum><text display-inline="yes-display-inline">submits to the Administration a joint
				application that contains—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID33589a43901c42379b3c9882d2129f10"><enum>(i)</enum><text display-inline="yes-display-inline">a certification that each participant of
				the project—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID69cc231826e0445199fe4d8de86851c0"><enum>(I)</enum><text display-inline="yes-display-inline">is an eligible applicant;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID8f311aab34ad45e0a8f2fa5a07e2853c"><enum>(II)</enum><text display-inline="yes-display-inline">employs an executive director or program
				manager to manage the center; and</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDe54f1bc1b57044818eb00804f0cb6031"><enum>(ii)</enum><text display-inline="yes-display-inline">information demonstrating a record of
				commitment to providing assistance to Native Americans; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDaec117376d294caebfdab2e4725ad9b3"><enum>(iii)</enum><text display-inline="yes-display-inline">information demonstrating that the
				participants in the joint project have the ability and resources to meet the
				needs, including the cultural needs, of the Native Americans to be served by
				the project.</text>

				concern</header><text display-inline="yes-display-inline">The term <term>Native
				American small business concern</term> means a small business concern that is
				at least 51 percent owned and controlled by—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idFA00141F3CDD4823AE3245CB8EDE3932"><enum>(A)</enum><text display-inline="yes-display-inline">an Indian tribe or a Native Hawaiian
				Organization, as the terms are described in paragraphs (13) and (15) of section
				8(a), respectively; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFA06D61298C4A8581C402A1B49312DD"><enum>(B)</enum><text display-inline="yes-display-inline">1 or more individuals members of an Indian
				tribe or Native Hawaiian Organization.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8d6d47adb395486c9a538405e74146d9"><enum>(6)</enum><header display-inline="yes-display-inline">Native American small business development
				program</header><text display-inline="yes-display-inline">The term <term>Native
				American small business development program</term> means the program
				established under subsection (c).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID01d5858bb4fa4d71833dcc58942189cd"><enum>(7)</enum><header display-inline="yes-display-inline">Small business concern</header><text display-inline="yes-display-inline">The term <term>small business
				concern</term> has the same meaning as in section 3.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDe2f917f0398d4a29abc19fbe5bf6b59f"><enum>(8)</enum><header display-inline="yes-display-inline">Small business development
				center</header><text display-inline="yes-display-inline">The term <term>small
				business development center</term> means a small business development center
				described in section 21.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4c33668de5904f05b7b660fd8303442f"><enum>(9)</enum><header display-inline="yes-display-inline">Tribal
				college</header><text display-inline="yes-display-inline">The term <term>tribal
				college</term> has the meaning given the term <term>tribally controlled college
				or university</term> in section 2(a) of the Tribally Controlled Community
				College Assistance Act of 1978 (25 U.S.C. 1801(a)).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDabe2624520f0404aba504277d33ddfe7"><enum>(10)</enum><header display-inline="yes-display-inline">Tribal land</header><text display-inline="yes-display-inline">The term <quote>tribal land</quote> has the
				meaning given the term <quote>reservation</quote> in section 3 of the Indian
				Financing Act (25 U.S.C. 1452).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID657ceb62a54a4e8da90f53a0306a6c71"><enum>(b)</enum><header display-inline="yes-display-inline">Office of Native American Affairs</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8b53e3bca6a84fffa2aab8be0c0084e8"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the
				Administration the Office of Native American Affairs, which, under the
				direction of the Associate Administrator, shall implement the programs of the
				Administration for the development of business enterprises by Native
				Americans.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5405e9c585744847ad7ec721236454b0"><enum>(2)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the Office of Native
				American Affairs is to help Native American small business concerns—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID00a51e454cc54d9c878170486f8a3110"><enum>(A)</enum><text display-inline="yes-display-inline">to start, operate, and increase the
				business of small business concerns;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa9acdd4776f945c3860807c99199f532"><enum>(B)</enum><text display-inline="yes-display-inline">to develop management and technical
				skills;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID17764f2b28634ec4a980b9388e1f40e1"><enum>(C)</enum><text display-inline="yes-display-inline">to seek Federal procurement
				opportunities;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf0daa83fa0024009bdbba6700cce1880"><enum>(D)</enum><text display-inline="yes-display-inline">to increase employment opportunities for
				Native Americans through the establishment and expansion of small business
				concerns; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4e1433bf5f9748928aeef3fff96c21dc"><enum>(E)</enum><text display-inline="yes-display-inline">to increase the access of Native Americans
				to capital markets.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd89caf72396b4952879b985677de060f"><enum>(3)</enum><header display-inline="yes-display-inline">Associate Administrator</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID6903df8f09a04e6799f7c96adb3b6627"><enum>(A)</enum><header display-inline="yes-display-inline">Appointment</header><text display-inline="yes-display-inline">The Administrator shall appoint a qualified
				individual to serve as Associate Administrator of the Office of Native American
				Affairs in accordance with this paragraph.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2c42abdfb60e447e828bd45d1da57329"><enum>(B)</enum><header display-inline="yes-display-inline">Qualifications</header><text display-inline="yes-display-inline">The Associate Administrator appointed under
				subparagraph (A) shall have—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID9afd02230da943a0861f15668f9d325f"><enum>(i)</enum><text display-inline="yes-display-inline">knowledge of Native American culture;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDbf6be3500fe34c89bb73f86ce7969fc7"><enum>(ii)</enum><text display-inline="yes-display-inline">experience providing culturally tailored
				small business development assistance to Native Americans.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID163f61639924450ea9b480dfa5fd9f46"><enum>(C)</enum><header display-inline="yes-display-inline">Employment status</header><text display-inline="yes-display-inline">The Administrator shall establish the
				position of Associate Administrator, who shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="idFA4F3EB01D4447D3BC5DB4BEA6AAE719"><enum>(i)</enum><text display-inline="yes-display-inline">be an appointee in the Senior Executive
				Service (as defined in section 3132(a) of title 5, United States Code);
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID78cf9e156e7843dca6e9fe053b4007b7"><enum>(ii)</enum><text display-inline="yes-display-inline">shall report to and be responsible directly
				to the Administrator.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID72eea072614c47408f82c11e47b406f7"><enum>(D)</enum><header display-inline="yes-display-inline">Responsibilities and duties</header><text display-inline="yes-display-inline">The Associate Administrator shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID546938bfc0494ddd8a700d062305e843"><enum>(i)</enum><text display-inline="yes-display-inline">administer and manage the Native American
				small business development program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID3ea2add1c4ea4340839f07393797982c"><enum>(ii)</enum><text display-inline="yes-display-inline">formulate, execute, and promote the
				policies and programs of the Administration that provide assistance to small
				business concerns owned and controlled by Native Americans;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id44C7EC1AB8F8400EB4D383726005B551"><enum>(iii)</enum><text display-inline="yes-display-inline">act as an ombudsman for full consideration
				of Native Americans in all programs of the Administration;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id70D98D67CFAF4839BB52A8D59E6F1C2E"><enum>(iv)</enum><text display-inline="yes-display-inline">recommend the annual administrative and
				program budgets for the Office of Native American Affairs;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDc741fa9f0c224b0394de3cf62e24b086"><enum>(v)</enum><text display-inline="yes-display-inline">consult with Native American business
				centers in carrying out the Native American small business development
				program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDe79b88d38c2a4004830d98935a1db405"><enum>(vi)</enum><text display-inline="yes-display-inline">recommend appropriate funding
				levels;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDb4f2e4c327cd412f827711c404964e5e"><enum>(vii)</enum><text display-inline="yes-display-inline">review the annual budgets submitted by each
				applicant for the Native American small business development program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDfd32425725404a0392c99c39b7cadb42"><enum>(viii)</enum><text display-inline="yes-display-inline">select applicants to participate in the
				Native American small business development program;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID4857b76fd99d4989b3720e57bf54d813"><enum>(ix)</enum><text display-inline="yes-display-inline">implement this section; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID8b7e3160f04b448bb9fc7da698a1fee5"><enum>(x)</enum><text display-inline="yes-display-inline">maintain a clearinghouse for the
				dissemination and exchange of information between all Administration-sponsored
				business centers.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdc7f205dabb74c83ba5f967824d1531a"><enum>(E)</enum><header display-inline="yes-display-inline">Consultation requirements</header><text display-inline="yes-display-inline">In carrying out the responsibilities and
				duties described in this paragraph, the Associate Administrator shall confer
				with and seek the advice of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDad252e69838f41e69f1a4c4521406c6f"><enum>(i)</enum><text display-inline="yes-display-inline">officials of the Administration working in
				areas served by Native American business centers; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDa0dcfd0607d8427680c7562e9f0e1c1f"><enum>(ii)</enum><text display-inline="yes-display-inline">eligible applicants.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe0e4df9cb0024a109a78e7e87e34e988"><enum>(c)</enum><header display-inline="yes-display-inline">Native American small business development
				program</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID6c6c78a871a240c4a4c4956256a84170"><enum>(1)</enum><header display-inline="yes-display-inline">Financial assistance</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID13bb64dd91ee441897aaf5887529542f"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administration, acting through the
				Associate Administrator, shall provide financial assistance to eligible
				applicants to establish Native American business centers in accordance with
				this section.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf0ab0b7db6d542618c34fa2c0c0fa685"><enum>(B)</enum><header display-inline="yes-display-inline">Use of funds</header><text display-inline="yes-display-inline">The financial and resource assistance
				provided under this subsection shall be used to establish a Native American
				business center to overcome obstacles impeding the establishment, development,
				and expansion of small business concerns, in accordance with this
				section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb376d5300bd6432f8ee2292666c8ddda"><enum>(2)</enum><header display-inline="yes-display-inline">3-Year projects</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID52150ba1150247eda4f87c6326ac30f0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each Native American business center that
				receives assistance under paragraph (1)(A) shall conduct a 3-year project that
				offers culturally tailored business development assistance in the form
				of—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDefd6f8103c9e440cbf7c3d1975af0bb9"><enum>(i)</enum><text display-inline="yes-display-inline">financial education, including training and
				counseling in—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID153752e549bc4634b098bdef274b32bc"><enum>(I)</enum><text display-inline="yes-display-inline">applying for and securing business credit
				and investment capital;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3e197626d1744d7693c48bd65b38df15"><enum>(II)</enum><text display-inline="yes-display-inline">preparing and presenting financial
				statements; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID77ae7a32be27429bae5da5d852d15410"><enum>(III)</enum><text display-inline="yes-display-inline">managing cash flow and other financial
				operations of a business concern;</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID0c003364795c40bda351e928358efa05"><enum>(ii)</enum><text display-inline="yes-display-inline">management education, including training
				and counseling in planning, organizing, staffing, directing, and controlling
				each major activity and function of a small business concern; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID74c594ebd5084a00ac2df0895ce8e888"><enum>(iii)</enum><text display-inline="yes-display-inline">marketing education, including training and
				counseling in—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDe066f663942c4924b2e2b3b168a52e5b"><enum>(I)</enum><text display-inline="yes-display-inline">identifying and segmenting domestic and
				international market opportunities;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa36953ad5bf34f35a5151faec655af44"><enum>(II)</enum><text display-inline="yes-display-inline">preparing and executing marketing
				plans;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDbefc4905ab054d4eb8e81eee2f2e6ff1"><enum>(III)</enum><text display-inline="yes-display-inline">developing pricing strategies;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc6adfa67c21a47f9b62e0431be03b2cd"><enum>(IV)</enum><text display-inline="yes-display-inline">locating contract opportunities;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID85a56e01741947858883be9ed7464f18"><enum>(V)</enum><text display-inline="yes-display-inline">negotiating contracts; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID049d700e419d4c259bfce5663f72c968"><enum>(VI)</enum><text display-inline="yes-display-inline">using varying public relations and
				advertising techniques.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID56f9005e319a480e84636a7e424292d3"><enum>(B)</enum><header display-inline="yes-display-inline">Business development assistance
				recipients</header><text display-inline="yes-display-inline">The business
				development assistance under subparagraph (A) shall be offered to prospective
				and current owners of Native American small business concerns.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8538b5e3e7604b9298ec72b11b626715"><enum>(3)</enum><header display-inline="yes-display-inline">Form of Federal financial
				assistance</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID2a55be8483814159aa94d9a59febc4a4"><enum>(A)</enum><header display-inline="yes-display-inline">Documentation</header><text display-inline="yes-display-inline">The financial assistance to Native American
				business centers authorized under this subsection may be made by grant,
				contract, or cooperative agreement.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDb038f40277404dd5a6be5b6d45a6ba6f"><enum>(B)</enum><header display-inline="yes-display-inline">Payments</header>
									<clause commented="no" display-inline="no-display-inline" id="ID0bd6aa084c3848639609214e58351202"><enum>(i)</enum><header display-inline="yes-display-inline">Timing</header><text display-inline="yes-display-inline">Payments made under this subsection may be
				disbursed in periodic installments, at the request of the recipient.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID9f2d0cfb22b04805af7207cb7719318a"><enum>(ii)</enum><header display-inline="yes-display-inline">Advance</header><text display-inline="yes-display-inline">The Administrator may disburse not more
				than 25 percent of the annual amount of Federal financial assistance awarded to
				a Native American business center after notice of the award has been
				issued.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID68876eca01074e85ac6df69432256036"><enum>(C)</enum><header display-inline="yes-display-inline">Non-Federal contributions</header>
									<clause commented="no" display-inline="no-display-inline" id="ID8ce04852536c4da4bd3004a189465462"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header>
										<subclause commented="no" display-inline="no-display-inline" id="IDc853b45ce19146b08e55a3badd347fa0"><enum>(I)</enum><header display-inline="yes-display-inline">Initial financial assistance</header><text display-inline="yes-display-inline">Except as provided in subclause (II), an
				eligible applicant that receives financial assistance under this subsection
				shall provide non-Federal contributions for the operation of the Native
				American business center established by the eligible applicant in an amount
				equal to—</text>
											<item commented="no" display-inline="no-display-inline" id="IDe7486657ab07448f818d3083c394cf1b"><enum>(aa)</enum><text display-inline="yes-display-inline">in each of the first and second years of
				the project, not less than 33 percent of the amount of the financial assistance
				received under this subsection; and</text>
											</item><item commented="no" display-inline="no-display-inline" id="IDa5a73aa4596f47f78c1d9a5d12aceab4"><enum>(bb)</enum><text display-inline="yes-display-inline">in the third year of the project, not less
				than 50 percent of the amount of the financial assistance received under this
				subsection.</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID553c081d9fa64c8ea3627df46b9f5c52"><enum>(II)</enum><header display-inline="yes-display-inline">Renewals</header><text display-inline="yes-display-inline">An eligible applicant that receives a
				renewal of financial assistance under this subsection shall provide non-Federal
				contributions for the operation of a Native American business center
				established by the eligible applicant in an amount equal to not less than 50
				percent of the amount of the financial assistance received under this
				subsection.</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDd21957d901244482b02d176986d5c619"><enum>(III)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">The requirements of this section may be
				waived at the discretion of the Administrator, based on an evaluation of the
				ability of the eligible applicant to provide non-Federal contributions.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDfb8b9c8be72849b4ba7f0b8a6f2608f6"><enum>(4)</enum><header display-inline="yes-display-inline">Contract and cooperative agreement
				authority</header><text display-inline="yes-display-inline">A Native American
				business center may enter into a contract or cooperative agreement with a
				Federal department or agency to provide specific assistance to Native American
				and other underserved small business concerns located on or near tribal land,
				to the extent that the contract or cooperative agreement is consistent with and
				does not duplicate the terms of any assistance received by the Native American
				business center from the Administration.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd4d2129b16a641a4b00de9cb5bab277d"><enum>(5)</enum><header display-inline="yes-display-inline">Application process</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID930c8a4526674acb863529db766546e1"><enum>(A)</enum><header display-inline="yes-display-inline">Submission of a 3-year plan</header><text display-inline="yes-display-inline">Each applicant for assistance under
				paragraph (1) shall submit a 3-year plan to the Administration on proposed
				assistance and training activities.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID95108c3b1a694790882beb9187a02730"><enum>(B)</enum><header display-inline="yes-display-inline">Criteria</header>
									<clause commented="no" display-inline="no-display-inline" id="ID4f75a884430245379d44e5b09866a7cd"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall evaluate applicants
				for financial assistance under this subsection in accordance with selection
				criteria that are—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID2ef77bd8eee14d6f8beae6b7ae3c7be9"><enum>(I)</enum><text display-inline="yes-display-inline">established before the date on which
				eligible applicants are required to submit the applications;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0cc478e5f3564390abe526281021cd14"><enum>(II)</enum><text display-inline="yes-display-inline">stated in terms of relative importance;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDa9d5ccedb39c445ba1d0f72616f4daf5"><enum>(III)</enum><text display-inline="yes-display-inline">publicly available and stated in each
				solicitation for applications for financial assistance under this subsection
				made by the Administrator.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID2b25ce6d95b74a2db1721d5587518cce"><enum>(ii)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">The criteria required by this subparagraph
				shall include—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID348e5db1b0874ad083d970e375d648dc"><enum>(I)</enum><text display-inline="yes-display-inline">the experience of the applicant in
				conducting programs or ongoing efforts designed to impart or upgrade the
				business skills of current or potential owners of Native American small
				business concerns;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDc6e656b9cabf4311b4af43676a0b53d5"><enum>(II)</enum><text display-inline="yes-display-inline">the ability of the applicant to commence a
				project within a minimum amount of time;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID92e0389d1f92467f85fe4bc216712bf0"><enum>(III)</enum><text display-inline="yes-display-inline">the ability of the applicant to provide
				quality training and services to a significant number of Native
				Americans;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID523cb8ad86c34be0be3c9e37a7f1f82e"><enum>(IV)</enum><text display-inline="yes-display-inline">previous assistance from the Administration
				to provide services in Native American communities;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID2c69e1a97fbf4be694b978b125330390"><enum>(V)</enum><text display-inline="yes-display-inline">the proposed location for the Native
				American business center, with priority given based on the proximity of the
				center to the population being served and to achieve a broad geographic
				dispersion of the centers; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4c2e173577984d85bd320346f9645718"><enum>(VI)</enum><text display-inline="yes-display-inline">demonstrated experience in providing
				technical assistance, including financial, marketing, and management
				assistance.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID86572daff38a419cb75bfe4922252efa"><enum>(6)</enum><header display-inline="yes-display-inline">Conditions for participation</header><text display-inline="yes-display-inline">Each eligible applicant desiring a grant
				under this subsection shall submit an application to the Administrator that
				contains—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDe0946dbdb56a44449900f4928b5f7867"><enum>(A)</enum><text display-inline="yes-display-inline">a certification that the applicant—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDefb56564cc0c45e4a2d682414981967a"><enum>(i)</enum><text display-inline="yes-display-inline">is an eligible applicant;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDe88a3474d055471b82ed603567e6ccb1"><enum>(ii)</enum><text display-inline="yes-display-inline">employs a full-time executive director,
				project director, or program manager to manage the Native American business
				center; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID3a2ed19a1b3f4aef8abefde127bde96e"><enum>(iii)</enum><text display-inline="yes-display-inline">agrees—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID17f4b4e5fc914baaaa268cd1c205a587"><enum>(I)</enum><text display-inline="yes-display-inline">to a site visit by the Administrator as
				part of the final selection process;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID1289ee6810154268af0cbb5b3273a540"><enum>(II)</enum><text display-inline="yes-display-inline">to an annual programmatic and financial
				examination; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4e33476a64b44d44a93729d5ac5e5a4d"><enum>(III)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, to
				remedy any problems identified pursuant to that site visit or
				examination;</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9a45ad39dce34f68ac029105a163d874"><enum>(B)</enum><text display-inline="yes-display-inline">information demonstrating that the
				applicant has the ability and resources to meet the needs, including cultural
				needs, of the Native Americans to be served by the grant;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd2d75786c8794fe993714291f59f306c"><enum>(C)</enum><text display-inline="yes-display-inline">information relating to proposed assistance
				that the grant will provide, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID4dc5e0bb1e2b44d281d433e325633569"><enum>(i)</enum><text display-inline="yes-display-inline">the number of individuals to be assisted;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID4728ee4d971140cf897fc744e7a4327e"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of hours of counseling,
				training, and workshops to be provided;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfdadd661aa994ef38537aaa0957e8be9"><enum>(D)</enum><text display-inline="yes-display-inline">information demonstrating the effectiveness
				and experience of the applicant in—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDcf08e6822f5e47368bc2e35e01578e2d"><enum>(i)</enum><text display-inline="yes-display-inline">conducting financial, management, and
				marketing assistance programs designed to educate or improve the business
				skills of current or prospective Native American business owners;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID09b76a4b6bc34165ba8b64dae42a4c30"><enum>(ii)</enum><text display-inline="yes-display-inline">providing training and services to a
				representative number of Native Americans;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1b8daa75d2ff46dd83df9e14fd8003d7"><enum>(iii)</enum><text display-inline="yes-display-inline">using resource partners of the
				Administration and other entities, including institutions of higher education,
				Indian tribes, or tribal colleges; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID39186930ac8c47efa0c1a3ac314628c5"><enum>(iv)</enum><text display-inline="yes-display-inline">the prudent management of finances and
				staffing;</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID366cc0a7c92441cfa7f94f37c8ea3d23"><enum>(E)</enum><text display-inline="yes-display-inline">the location at which the applicant will
				provide training and services to Native Americans;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6542afe1c1ae49cbbd9123068286fdfb"><enum>(F)</enum><text display-inline="yes-display-inline">a 3-year plan that describes—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDa37e4caba4fe42868a930087d231383f"><enum>(i)</enum><text display-inline="yes-display-inline">the number of Native Americans and Native
				American small business concerns to be served by the grant;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1ac8ec44fee94d4a83b77fe4ca4d16bb"><enum>(ii)</enum><text display-inline="yes-display-inline">if the Native American business center is
				located in the continental United States, the number of Native Americans to be
				served by the grant; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID648524b39c6340b1a35aaa5d5621307c"><enum>(iii)</enum><text display-inline="yes-display-inline">the training and services to be provided to
				a representative number of Native Americans; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd9100c61d6a041e981773bcbe398f946"><enum>(G)</enum><text display-inline="yes-display-inline">if the applicant is a joint project—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDdadb72ddf54945908db86f52ca808231"><enum>(i)</enum><text display-inline="yes-display-inline">a certification that each participant in
				the joint project is an eligible applicant;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDbce7a5ed0eca47b482e0848fce9c5c24"><enum>(ii)</enum><text display-inline="yes-display-inline">information demonstrating a record of
				commitment to providing assistance to Native Americans; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID64a7e981bdb04af0b46527ef61199d79"><enum>(iii)</enum><text display-inline="yes-display-inline">information demonstrating that the
				participants in the joint project have the ability and resources to meet the
				needs, including the cultural needs, of the Native Americans to be served by
				the grant.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDcf7abefa4a9b4cad8fbf0595bbaf2c4d"><enum>(7)</enum><header display-inline="yes-display-inline">Review of applications</header><text display-inline="yes-display-inline">The Administrator shall approve or
				disapprove each completed application submitted under this subsection not later
				than 90 days after the date on which the eligible applicant submits the
				application.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDca4fd67ddfde413ea35d30fa866acf5e"><enum>(8)</enum><header display-inline="yes-display-inline">Program examination</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID561cdb79c1d44013b8f59144bb83aede"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each Native American business center
				established under this subsection shall annually provide to the Administrator
				an itemized cost breakdown of actual expenditures made during the preceding
				year.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa92a8f5902084cf394dbbf4f445be234"><enum>(B)</enum><header display-inline="yes-display-inline">Administration action</header><text display-inline="yes-display-inline">Based on information received under
				subparagraph (A), the Administration shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDb72a1c577db64562815cd7a298bb6809"><enum>(i)</enum><text display-inline="yes-display-inline">develop and implement an annual
				programmatic and financial examination of each Native American business center
				assisted pursuant to this subsection; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6f4a728daacf43a69d980963ec68509a"><enum>(ii)</enum><text display-inline="yes-display-inline">analyze the results of each examination
				conducted under clause (i) to determine the programmatic and financial
				viability of each Native American business center.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4a5612f5a6dd449796788830726d7d3f"><enum>(C)</enum><header display-inline="yes-display-inline">Conditions for continued
				funding</header><text display-inline="yes-display-inline">In determining
				whether to renew a grant, contract, or cooperative agreement with a Native
				American business center, the Administration—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID849c83feff81498989520d6bd2eca246"><enum>(i)</enum><text display-inline="yes-display-inline">shall consider the results of the most
				recent examination of the center under subparagraph (B), and, to a lesser
				extent, previous examinations; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDdbbfc44f17b64ec49f9a82d7a7c70df4"><enum>(ii)</enum><text display-inline="yes-display-inline">may withhold the renewal, if the
				Administrator determines that—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDfe8aaa4cc81f4a3fb0e24d7cd7eb3655"><enum>(I)</enum><text display-inline="yes-display-inline">the center has failed to provide the
				information required to be provided under subparagraph (A), or the information
				provided by the center is inadequate;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID89093643dc7746fa840e78c3bb05e4a9"><enum>(II)</enum><text display-inline="yes-display-inline">the center has failed to provide adequate
				information required to be provided by the center for purposes of the report of
				the Administrator under subparagraph (E);</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf0098cdb31a84e43b4e515bde2225dce"><enum>(III)</enum><text display-inline="yes-display-inline">the center has failed to comply with a
				requirement for participation in the Native American small business development
				program, as determined by the Administrator, including—</text>
											<item commented="no" display-inline="no-display-inline" id="ID0cbfe640744040de8a9285db952dc3ff"><enum>(aa)</enum><text display-inline="yes-display-inline">failure to acquire or properly document a
				non-Federal contribution;</text>
											</item><item commented="no" display-inline="no-display-inline" id="IDc7b0a7ec0e2e427989162c7be3f0a0c0"><enum>(bb)</enum><text display-inline="yes-display-inline">failure to establish an appropriate
				partnership or program for marketing and outreach to reach new Native American
				small business concerns;</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID896762df6346434e9a17dffaa14187ed"><enum>(cc)</enum><text display-inline="yes-display-inline">failure to achieve results described in a
				financial assistance agreement; and</text>
											</item><item commented="no" display-inline="no-display-inline" id="ID98cf6be428224b9681bfbb6b5927b752"><enum>(dd)</enum><text display-inline="yes-display-inline">failure to provide to the Administrator a
				description of the amount and sources of any non-Federal funding received by
				the center;</text>
											</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID6e6e260d7c8c4a36a365996fb52bdc9b"><enum>(IV)</enum><text display-inline="yes-display-inline">the center has failed to carry out the
				3-year plan under in paragraph (6)(F); or</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID88d529a3636f4a1d82a7beac74596250"><enum>(V)</enum><text display-inline="yes-display-inline">the center cannot make the certification
				described in paragraph (6)(A).</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID45bfee7a12b94151a21b4c4423300034"><enum>(D)</enum><header display-inline="yes-display-inline">Continuing contract and cooperative
				agreement authority</header>
									<clause commented="no" display-inline="no-display-inline" id="ID643e8fbcd7444f58a7d5f8b1cf5d2722"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The authority of the Administrator to enter
				into contracts or cooperative agreements in accordance with this subsection
				shall be in effect for each fiscal year only to the extent and in the amounts
				as are provided in advance in appropriations Acts.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDa61aaeefb6db468b8295d6484f294e01"><enum>(ii)</enum><header display-inline="yes-display-inline">Renewal</header><text display-inline="yes-display-inline">After the Administrator has entered into a
				contract or cooperative agreement with any Native American business center
				under this subsection, the Administrator may not suspend, terminate, or fail to
				renew or extend any such contract or cooperative agreement unless the
				Administrator—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id04A214F7A2944783AC1A07CCD26F5867"><enum>(I)</enum><text display-inline="yes-display-inline">provides the center with written
				notification that describes the reasons for the action of the Administrator;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idF5E3E2361CDE4938AF390884A32B3F6C"><enum>(II)</enum><text display-inline="yes-display-inline">affords the center an opportunity for a
				hearing, appeal, or other administrative proceeding under chapter 5 of title 5,
				United States Code.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc6549c793c6346a996dc86c0ecc60461"><enum>(E)</enum><header display-inline="yes-display-inline">Annual management report</header>
									<clause commented="no" display-inline="no-display-inline" id="ID2505daff278b4e58b6a07a272243e77a"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall prepare and submit
				to the Committee on Small Business and Entrepreneurship and the Committee on
				Indian Affairs of the Senate and the Committee on Small Business and the
				Committee on Natural Resources of the House of Representatives an annual report
				on the effectiveness of all projects conducted by Native American business
				centers under this subsection and any pilot programs administered by the Office
				of Native American Affairs.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID1e4474f8b49f4800a2ae40af9e26d807"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under clause (i)
				shall include, with respect to each Native American business center receiving
				financial assistance under this subsection—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID9209cf025c3248e685dbad2834c2fca5"><enum>(I)</enum><text display-inline="yes-display-inline">the number of individuals receiving
				assistance from the Native American business center;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID7729ccbd2e584fa79b52f7b893618aa4"><enum>(II)</enum><text display-inline="yes-display-inline">the number of startup business concerns
				established with the assistance of the Native American business center;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID38f62dcfbfb94fd0903586733dbf8ea1"><enum>(III)</enum><text display-inline="yes-display-inline">the number of existing businesses in the
				area served by the Native American business center seeking to expand
				employment;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0b1ba20cb55d4313af1ed6d22a2ea0ca"><enum>(IV)</enum><text display-inline="yes-display-inline">the number of jobs established or
				maintained, on an annual basis, by Native American small business concerns
				assisted by the center since receiving funding under this section;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID67777f004e3c48cdbc24a850d04a56c9"><enum>(V)</enum><text display-inline="yes-display-inline">to the maximum extent practicable, the
				amount of the capital investment and loan financing used by emerging and
				expanding businesses that were assisted by a Native American business
				center;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID4ebf0ec231fa4d92937b46caf567073c"><enum>(VI)</enum><text display-inline="yes-display-inline">any additional information on the
				counseling and training program that the Administrator determines to be
				necessary; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDf2712938e703451e936bc8719fa2c975"><enum>(VII)</enum><text display-inline="yes-display-inline">the most recent examination, as required
				under subparagraph (B), and the determination made by the Administration under
				that subparagraph.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID576b41a7ec9f4b2088f1d7d9e8862e7d"><enum>(9)</enum><header display-inline="yes-display-inline">Annual
				reports</header><text display-inline="yes-display-inline">Each Native American
				business center receiving financial assistance under this subsection shall
				submit to the Administrator an annual report on the services provided with the
				financial assistance, including—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID3ff1244090d34b80905790a6de2d73f9"><enum>(A)</enum><text display-inline="yes-display-inline">the number of individuals assisted, by
				tribal affiliation;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDfd87741a79864ad582b6d188a63430c9"><enum>(B)</enum><text display-inline="yes-display-inline">the number of hours spent providing
				counseling and training for those individuals;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf0ab90bde0b54fb6812f274e95a50b5c"><enum>(C)</enum><text display-inline="yes-display-inline">the number of startup small business
				concerns established or maintained with the assistance of the Native American
				business center;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc731c26f56cb456ab1591d02a3c38924"><enum>(D)</enum><text display-inline="yes-display-inline">the gross receipts of small business
				concerns assisted by the Native American business center;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc978209745ee401c92f649cc5833e934"><enum>(E)</enum><text display-inline="yes-display-inline">the number of jobs established or
				maintained by small business concerns assisted by the Native American business
				center; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd06b3aad905e4b2c95913d9f0c7f5425"><enum>(F)</enum><text display-inline="yes-display-inline">the number of jobs for Native Americans
				established or maintained at small business concerns assisted by the Native
				American business center.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID378581918c1f4432af349f717d886493"><enum>(10)</enum><header display-inline="yes-display-inline">Record retention</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDccfcf7f6860d461c861721e89dd61764"><enum>(A)</enum><header display-inline="yes-display-inline">Applications</header><text display-inline="yes-display-inline">The Administrator shall maintain a copy of
				each application submitted under this subsection for not less than 7
				years.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8d8a30227fbc4ac9975387058983bcf3"><enum>(B)</enum><header display-inline="yes-display-inline">Annual
				reports</header><text display-inline="yes-display-inline">The Administrator
				shall maintain copies of the certification submitted under paragraph (6)(A)
				indefinitely.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID17228f1e109a4a458dc50fb186c03796"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id854BC7F1678D44608C9FD7229EF67F55"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is authorized to be appropriated to
				carry out the Native American small business development program $10,000,000
				for each of fiscal years 2011 through 2013.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id769D31405EDB47D6BC57D7C2E8451D11"><enum>(2)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">Not more than 10 percent of funds
				appropriated for a fiscal year may be used for the costs of administering the
				programs under this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID11f0301d0b2e42dd9d56f187e7c385ed" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Qualified school construction bond escrow
			 account</header><text display-inline="no-display-inline">Part B of title II of
			 the Indian Self-Determination and Education Assistance Act (25 U.S.C. 458) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idBD48D7FA645B4DC5B21DBF2B4EDC4666" style="OLC">
				<section commented="no" display-inline="no-display-inline" id="IDeb9e06579c0b4e87ac26e940989f38aa" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Authorization to establish qualified school
				construction bond escrow account</header>
					<subsection commented="no" display-inline="no-display-inline" id="IDed65d00fa5e2452ca14cb8349ca0c3a2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Pursuant to the authority granted under
				section 54F(d)(4) of the Internal Revenue Code of 1986, the Secretary shall
				establish a qualified school construction bond escrow account for the purpose
				of implementing section 54F of the Internal Revenue Code of 1986.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9074b6603eea4402a733b2645984657d"><enum>(b)</enum><header display-inline="yes-display-inline">Transfer to escrow account</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID0775ebbc50474491a94f7e9042eaaab3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall allocate to the escrow
				account described in subsection (a) amounts described in section 54F(d)(4) of
				the Internal Revenue Code of 1986.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2033e3e96b15460e972fa8870be58177"><enum>(2)</enum><header display-inline="yes-display-inline">Other funds</header><text display-inline="yes-display-inline">The Secretary shall accept and disburse to
				the escrow account described in subsection (a) amounts received to carry out
				this section from other sources, including other Federal agencies, non-Federal
				public agencies, and private
				sources.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
