		<official-title display="yes">To amend chapter 303 of title 46, United
		  States Code, to provide fair treatment for the families of those killed on the
		  high seas. </official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Survivors Equality Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id397FAF3486814DE7AEB5391769673029" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Fair treatment for the families of those
			 killed on the high seas</header><text display-inline="no-display-inline">Chapter 303 of title 46, United States Code,
			 is amended by striking section 30303 and inserting the following:</text>

				<section commented="no" display-inline="no-display-inline" id="ID5988e054d01440e6be9e292048a44bf5" section-type="subsequent-section"><enum>30303.</enum><header display-inline="yes-display-inline">Amount and apportionment of
				recovery</header>
					<subsection commented="no" display-inline="no-display-inline" id="id0DB66E1CB5F447F3B6E120CFD52E30BF"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term
				<term>nonpecuniary loss</term> means loss of care, comfort, and
				companionship.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="id6ABCE8A3BED742458BEE46858B45F1FB"><enum>(b)</enum><header display-inline="yes-display-inline">Recovery</header><text display-inline="yes-display-inline">The recovery in an action under this
				chapter shall be a fair compensation for the pecuniary and nonpecuniary loss
				sustained by the individuals for whose benefit the action is brought. The
				individuals for whose benefit the action is brought may also recover damages
				for the decedent’s pre-death pain and
				suffering.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id509FE961D4134A549BC1D016F2985647" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="no-display-inline">The amendment made by
			 this Act shall take effect on the date of enactment of this Act and apply to
			 any civil action filed on or after that date.</text>
