		<section commented="no" display-inline="no-display-inline" id="id82CA90732BFF4D38BED648E29AEE41F1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>On-the-Job Training Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idAFFBFFD6DF3B4EEE8403A39A8D61C6FE" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">On-The-Job Training</header>
			<subsection commented="no" display-inline="no-display-inline" id="id204E0594770C493182DC934BF3309D10"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle D of title I of the Workforce
			 Investment Act of 1998 is amended by inserting after section 173A (29 U.S.C.
			 2918a) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id69CEB875F5914BBAA88BAD06FACBA4AD" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="idABB372CDFAB44812817B80C3C6EAED62" section-type="subsequent-section"><enum>173B.</enum><header display-inline="yes-display-inline">On-The-Job Training</header>
						<subsection commented="no" display-inline="no-display-inline" id="id61F93A8C08D74C12874CBA45E01D97F1"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <quote>federally
				recognized tribal organization</quote> means an entity described in section
				166(c)(1).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id6F5E97953E834AA9BDA08ADB59C25B8F"><enum>(b)</enum><header display-inline="yes-display-inline">Grants</header><text display-inline="yes-display-inline">From the amount made available under
				subsection (g), and subject to subsection (d)—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID7bddaa7813bb4b04bc5cd7a46962cc8c"><enum>(1)</enum><text display-inline="yes-display-inline">the Secretary shall make grants on a
				discretionary basis to local areas, for adult on-the-job training, or
				dislocated worker on-the-job training, carried out under section 134;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id562827B624524DB38792D18D68805B23"><enum>(2)</enum><text display-inline="yes-display-inline">using an amount that is not more than 10
				percent of the funds made available under subsection (g), the Secretary shall
				make grants to States, local boards, and federally recognized tribal
				organizations for developing on-the-job training programs, in consultation with
				the Secretary.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idF5969B64907047B5810065A7BDBEDC5D"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				subsection (b), a State, local board, or federally recognized tribal
				organization shall submit an application to the Secretary at such time, in such
				manner, and containing such information as the Secretary may require. In
				preparing such an application for a grant under subsection (b)(1), a local
				board shall consult with the corresponding State.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id7444E645B23D43AC8E666E47BADFA547"><enum>(d)</enum><header display-inline="yes-display-inline">Reimbursement of wage rates</header><text display-inline="yes-display-inline">Notwithstanding the limitation in section
				101(31)(B), in making the grants described in subsection (b)(1) the Secretary
				may allow for higher levels of reimbursement of wage rates the Secretary
				determines are appropriate based on factors such as—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="idEE9EC2DDCFE142368CBC5CF6BDF902D1"><enum>(1)</enum><text display-inline="yes-display-inline">employer size, in order to facilitate the
				participation of small- and medium-sized employers; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id514C78331D6446E99CCEAE2DDD5419C4"><enum>(2)</enum><text display-inline="yes-display-inline">target populations, in order to enhance job
				creation for persons with barriers to employment.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB98712ADA4BB4AFAA48D363961B79D44"><enum>(e)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The Secretary may use an amount that is not
				more than 1 percent of the funds made available under subsection (g) for the
				administration, management, and oversight of the programs, activities, and
				grants, funded under subsection (b), including the evaluation of the use of
				such funds.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id75B5659404DA4C54AAF3C3953E731616"><enum>(f)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section shall be construed
				to affect the manner in which subtitle B is implemented, for activities funded
				through amounts appropriated under section 137.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="idDF29D8CF313F49DBAE9B9B490E4DCBE1"><enum>(g)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section such sums as may be
				necessary for fiscal year 2011 and each subsequent fiscal
				year.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA07D3E4219AB484D990BAF5CFE3649F6"><enum>(b)</enum><header display-inline="yes-display-inline">Table of contents</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of
			 the Workforce Investment Act of 1998 is amended by inserting after the item
			 relating to section 173A the following:</text>
