				or</text>
							</clause><clause id="idE58E394E53EE494F90F7CE0BB7618EF9"><enum>(ii)</enum><text display-inline="yes-display-inline">water collected by the dewatering relief
				well installed in June of 2008.</text>
							</clause></subparagraph><paragraph id="id823DAF1A6C534E04879C6251EE109B90"><enum>(3)</enum><header>Authorization of
				Secretary</header><text>The Secretary may—</text>
							<subparagraph id="id090D367E5FF04A0DBCC2E26AF3812E02"><enum>(A)</enum><text>improve and expand
				the Reclamation Treatment Plant; and</text>
							</subparagraph><subparagraph id="idE8DD362A74404D179B1BBD672C25D1DB"><enum>(B)</enum><text>develop processes
				under which the treatment of any water in the Treatment Plant (excluding
				historical flows through the Tunnel and water collected by the dewatering
				relief well installed in June of 2008) could be made a reimbursable
				expense.</text>
							</subparagraph></paragraph><paragraph id="id5A21BBFC81194EB4BFB8907D267F8732"><enum>(4)</enum><header>Duty of
				Secretary</header><text>If the Administrator of the Environmental Protection
				Agency proposes to amend or issue a new Record of Decision for operable unit 6,
				the Administrator shall consult with the Secretary on each feature of the
				proposed new or amended Record of Decision that may require alterations to, or
				otherwise affect, the operation or maintenance of the Tunnel or Reclamation
				Treatment Plant.</text>

				water.</text>
						</paragraph></subsection><subsection id="idF4E332F3A3E8435786E80EDA3C636846"><enum>(b)</enum><header>Water treatment
				plant</header>
						<paragraph id="id91059AB71FAD482BA33FD4D8B53DE084"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to section
				705, the Secretary shall be responsible for the operation and maintenance of
				the water treatment plant authorized under section 701, including any sludge
				disposal authorized under this title.</text>
						</paragraph><paragraph id="idEC175FEEE2F942D4A7BC7E179CBA27FE"><enum>(2)</enum><header>Authority to offer to
				enter into contracts</header><text display-inline="yes-display-inline">In
				carrying out paragraph (1), the Secretary may offer to enter into 1 or more
				contracts with any appropriate individual or entity for the conduct of any
				service required under paragraph
				(1).</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

						</paragraph><paragraph id="idE3700A085A9245D5A5D5EDDA5E8DDA0F"><enum>(2)</enum><text display-inline="yes-display-inline">upon entering into an agreement under
				paragraph (1)—</text>
							<subparagraph id="idCF4A728C83534413928256B0AEF25AD5"><enum>(A)</enum><text display-inline="yes-display-inline">make any necessary capital improvement to
				or expansion of the treatment plant; and</text>
							</subparagraph><subparagraph id="id143E2EA3A36D46BDA59F2939D317B5ED"><enum>(B)</enum><text display-inline="yes-display-inline">treat flows that are conveyed to the
				treatment plant, including any—</text>
								<clause id="id49ED657056934F4E8CA7CB5C7F8A3B4C"><enum>(i)</enum><text display-inline="yes-display-inline">surface water diverted into the Leadville
				Mine Drainage Tunnel; and</text>
