		  create clean energy jobs.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Pollution and Costs Reduction
			 Act</short-title></quote>.</text>
		</section><section id="ID03507d48a6d94089a73c7fba8e65fcfd"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="IDfe21325c72da4883a9cff6e79bb8fd9c"><enum>(1)</enum><text>actions taken to
			 reduce greenhouse gas emissions and emissions of other air pollutants, as
			 defined in section 302 of the Clean Air Act (42 U.S.C. 7602), will spur
			 investments that create new jobs and foster innovation and entrepreneurship in
			 clean technology industries; and</text>
			</paragraph><paragraph id="idF32AFA516BF14FF98785D81295DB631F"><enum>(2)</enum><text>on April 2, 2007,
			 in Massachusetts v. EPA, 549 U.S. 497 (2007), the Supreme Court held that
			 greenhouse gases are air pollutants, as defined in section 302 of the Clean Air
			 Act (42 U.S.C. 7602).</text>
			</paragraph></section><section id="id937A7A1B63714B5C849FAEA0540DE00A"><enum>3.</enum><header>Building
			 pollution reduction program</header><text display-inline="no-display-inline">Section 105 of the Clean Air Act (42 U.S.C.
			 7405) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id7BB40024F4EB44BD870F3B9DC5C16BD4" style="OLC">
				<subsection id="ID0cb7cecfcd3b43a08265d27ae61bcd23"><enum>(f)</enum><header>Building
				pollution reduction program</header>
					<paragraph id="IDea8aad1badae4616a96546ade1bf0f0e"><enum>(1)</enum><header>Definitions</header><text>In
				this subsection:</text>
						<subparagraph id="ID4100a683046b4444b8891cbdc0641014"><enum>(A)</enum><header>Air
				pollutant</header><text>The term <term>air pollutant</term> has the meaning
				given the term in section 302.</text>
						</subparagraph><subparagraph id="id4A678E71B0BD40748A2A05BFC0025C25"><enum>(B)</enum><header>Greenhouse
				gases</header><text>The term <term>greenhouse gases</term> means carbon
				dioxide, methane, nitrous oxide, hydrofluorocarbons, per­fluo­ro­car­bons, and
				sulfur hexafluoride.</text>
						</subparagraph><subparagraph id="IDc57758e4ea82444f8c177f745904d6d0"><enum>(C)</enum><header>Greenhouse gas
				emissions</header><text>The term <term>greenhouse gas emissions</term>
				means—</text>
							<clause id="ID6a4acac40d8d4a40983299878e10e1f4"><enum>(i)</enum><text>direct greenhouse
				gas emissions from sources that are owned or controlled by an owner of a
				building; and</text>
							</clause><clause id="ID11983e818ee94567b9ea8e5f5df8e516"><enum>(ii)</enum><text>indirect
				greenhouse gas emissions resulting from the generation of electricity, heat, or
				steam purchased by the owner of a building.</text>
							</clause></subparagraph><subparagraph id="IDb7903a815445413b9b44782270bce8ba"><enum>(D)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> has the meaning
				given the term in section 211(o)(1).</text>
						</subparagraph></paragraph><paragraph id="idD4DC0B9978DE4374AC4F095A24F20F7A"><enum>(2)</enum><header>Program</header><text>The
				Administrator shall establish and carry out a program, to be known as the
				<term>Building Pollution Reduction Program</term>, to provide assistance to
				owners of buildings in the United States to reduce the emission of air
				pollutants and building operating costs by—</text>
						<subparagraph id="id2A50BD8B18DC48859233D9A3897A7219"><enum>(A)</enum><text>constructing
				highly efficient buildings in the United States; or</text>
						</subparagraph><subparagraph id="id5AB3B4900570425D976D365B7190EAA3"><enum>(B)</enum><text>increasing the
				efficiency of and reducing the greenhouse gas emissions associated with
				existing buildings in the United States.</text>
						</subparagraph></paragraph><paragraph id="ID93e7b74f3d0e4ffa818cb119efbc2454"><enum>(3)</enum><header>Requirements</header><text>The
				Administrator shall provide assistance under this section to owners of
				buildings in the United States based on the extent to which projects relating
				to the buildings of the owners result in verifiable, additional, and
				enforceable reductions in emissions of air pollutants through operational
				improvements such as—</text>
						<subparagraph id="IDa08a2ea2cbc546b4af896afa0b955c35"><enum>(A)</enum><text>improved energy
				efficiency;</text>
						</subparagraph><subparagraph id="ID85db6481a1ff4cb798b8d9cca3dd73cf"><enum>(B)</enum><text>increased
				water-use efficiency;</text>
						</subparagraph><subparagraph id="ID793afcd8b6b34ecba56ba601958f7c7d"><enum>(C)</enum><text>use of renewable
				energy sources; and</text>
						</subparagraph><subparagraph id="ID30079edae3b04914acabfe7eaf8b8e6b"><enum>(D)</enum><text>such additional
				measures, as determined by the Administrator, as will result in a measurable
				decrease in emissions of air pollutants.</text>
						</subparagraph></paragraph><paragraph id="ID43f78aed430346a5becad748b8a7585e"><enum>(4)</enum><header>Priority</header><text>In
				providing assistance under this subsection, the Administrator shall give
				priority to projects that—</text>
						<subparagraph id="IDbf2f97f135c24719983a55953d9adaaa"><enum>(A)</enum><text>achieve the
				following minimum scores as evaluated by energy performance bench­marking
				tools—</text>
							<clause id="ID07e539b094094a86898683ce3f3cc8d3"><enum>(i)</enum><text>in new or
				renovated buildings that demonstrate exemplary performance by achieving—</text>
								<subclause id="idCAE08D17391E4CDE9703A1BACC812FBE"><enum>(I)</enum><text>a minimum score
				of 75 on the benchmarking tool of the Energy Star program established by
				section 324A of the Energy Policy and Conservation Act (42 U.S.C. 6294a);
				or</text>
								</subclause><subclause id="id0B24C809C36148899C149739CEF49AEC"><enum>(II)</enum><text>an equivalent
				score on an established energy performance bench­marking metric selected by the
				Administrator, such as the metric used for the National Building Rating Program
				of the Department of Energy; and</text>
								</subclause></clause><clause id="IDc0da3a165dd44fcea70a4179d12b764c"><enum>(ii)</enum><text>in retrofitted
				existing buildings that demonstrate—</text>
								<subclause id="idB78B094059D449BA8300B3E6453A5E44"><enum>(I)</enum><text>substantial
				improvement in the score or rating on the bench­marking tool described in
				clause (i) by a minimum of 30 points; or</text>
								</subclause><subclause id="idB2FD33BEB711404287823E0AE3603202"><enum>(II)</enum><text>an equivalent
				improvement using an established performance bench­marking metric selected by
				the Administrator;</text>
								</subclause></clause></subparagraph><subparagraph id="IDe1f29a4f561f4aebabf93abdc4947bf6"><enum>(B)</enum><text>are completed by
				building owners with a proven track record of reducing pollution through the
				measures described in paragraph (3); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1d74d635bc5049d9b2feacffa9edaf4d"><enum>(C)</enum><text>result in
				measurable pollution reduction benefits not encompassed within the metrics of
				the Energy Star program described in subparagraph (A)(i)(I).</text>
						</subparagraph></paragraph><paragraph id="ID81eb622fb4dc43f49cca0fd8bdadd627"><enum>(5)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to the
				Administrator to carry out this section $50,000,000 for each of fiscal years
				2011 through
				2015.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idF5A8014B8D1544A0A3686759DCCF4C97"><enum>4.</enum><header>Advanced
			 biofuels</header>
			<subsection id="ID76db867bdbe2441694675de6404faf11"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph id="ID1894d35cf4c14ebfbf1309bebe0c6e1c"><enum>(1)</enum><text>according to the
			 Environmental Protection Agency, the transportation sector is responsible for a
			 significant quantity of the greenhouse gas emissions of the United
			 States;</text>
				</paragraph><paragraph id="ID42bdc6f66c8944f3b59de44af0813616"><enum>(2)</enum><text>advanced,
			 environmentally sustainable bio­fuels can help promote a safe, secure, and
			 domestic source of low-carbon fuels that reduce the emissions of pollutants (as
			 defined in section 302 of the Clean Air Act (42 U.S.C. 7602)); and</text>
				</paragraph><paragraph id="ID4008d5c2e7f042cca80748be39654236"><enum>(3)</enum><text>such biofuels
			 can—</text>
					<subparagraph id="ID9d70d3e78d404b898415e636d609c4c5"><enum>(A)</enum><text>help the United
			 States reduce greenhouse gas emissions, which are considered to be air
			 pollutants under section 302 of that Act (42 U.S.C. 7602); and</text>
					</subparagraph><subparagraph id="ID4902234c09bb44d891dd6c1a183cdd93"><enum>(B)</enum><text>benefit consumers
			 and environmental quality.</text>
					</subparagraph></paragraph></subsection><subsection id="idE5F2FEBA1F30461C9B43836E56826ACC"><enum>(b)</enum><header>Definition of
			 advanced green biofuel</header><text>Section 211(o)(1) of the Clean Air Act (42
			 U.S.C. 7545(o)(1)) is amended—</text>
				<paragraph id="id5B1916FEBC9048B0B46AA85438EE7747"><enum>(1)</enum><text>by redesignating
			 subparagraphs (C) through (L) as subparagraphs (D) through (M), respectively;
			 and</text>
				</paragraph><paragraph id="id8A0B7BEC132B452DAC42C34255611067"><enum>(2)</enum><text>by inserting
			 after subparagraph (B) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD40E1B23D44C4A77B2BF35504EC29BA0" style="OLC">
						<subparagraph id="idDC55BBF109454C64B489E66808337252"><enum>(C)</enum><header>Advanced green
				biofuel</header><text>The term <term>advanced green biofuel</term> means an
				advanced biofuel that the Administrator determines—</text>
							<clause id="idDF966FA03F36466181BC1D77FE26625B"><enum>(i)</enum><text>has lifecycle
				greenhouse gas emissions that are at least 60 percent less than the baseline
				lifecycle greenhouse gas emissions;</text>
							</clause><clause id="ID33ad5fa828654aaf8266ef6f98d017ee"><enum>(ii)</enum><text>is made from
				advanced renewable biomass; and</text>
							</clause><clause id="ID39bf8100a5c948e7b67a0046a4807826"><enum>(iii)</enum><text>minimizes
				biorefinery water requirements to the maximum extent achievable, taking into
				consideration costs and other appropriate
				factors.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id7EB7B1A0836F40FDA554E4B912C9AB36"><enum>(c)</enum><header>Advanced
			 biofuels</header><text>Section 211 of the Clean Air Act (42 U.S.C. 7545) is
			 amended by inserting after subsection (o) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id53BF2B88C59943F78B267A2DA96D9E26" style="OLC">
					<subsection id="ID10b484bce2c84089a8eefad03bf2e789"><enum>(p)</enum><header>Advanced
				biofuels</header>
						<paragraph id="idA21F97CE2C204607A0EA86F19F3F4C81"><enum>(1)</enum><header>Definition of
				advanced renewable biomass</header><text display-inline="yes-display-inline">In
				this subsection:</text>
							<subparagraph id="ID85a18a40a423449d9e62774d132e049c"><enum>(A)</enum><header>Advanced
				renewable biomass</header><text>The term <term>advanced renewable
				biomass</term> means renewable biomass that is produced using sustainable
				practices, as determined by the Administrator, in consultation with the
				Secretary of Agriculture, taking into consideration factors such as—</text>
								<clause id="IDba8c63d777664b14bf0c3f42a72f0e90"><enum>(i)</enum><text>the maintenance
				and enhancement of the quality and productivity of the soil;</text>
								</clause><clause id="ID75ad224be9d244fca96be309a73b78f5"><enum>(ii)</enum><text>the conservation
				of soil, water, energy, natural resources, and fish and wildlife
				habitat;</text>
								</clause><clause id="IDfdac14f189584e42a56eb7b3f0bf369c"><enum>(iii)</enum><text>the maintenance
				and enhancement of the quality of surface water and groundwater;</text>
								</clause><clause id="IDc654da5948964784954a9266ad6a50a3"><enum>(iv)</enum><text>the protection
				of the health and safety of individuals involved in the production
				system;</text>
								</clause><clause id="ID7f14f3240dd44f88b2f731d933078944"><enum>(v)</enum><text>the promotion of
				the well-being of animals;</text>
								</clause><clause id="ID8dc7cc785847406aae07916e543b3084"><enum>(vi)</enum><text>the increase in
				employment opportunities in the agricultural sector; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDc33ec4f73fe24035a7a2df019027d1c8"><enum>(vii)</enum><text>prevention of
				the introduction of invasive species, including consideration of a review by
				the Invasive Species Council established by Executive Order 13112 (64 Fed. Reg.
				6183 (February 3, 1999)).</text>
								</clause></subparagraph><subparagraph id="id721F0F958BF54D82A4C7D7E3A958D94A"><enum>(B)</enum><header>Program</header><text>The
				term <term>Program</term> means the 1,000,000,000-Gallon Challenge Grant
				Program established under paragraph (2)(A).</text>
							</subparagraph><subparagraph id="IDf355e11e01e840bb9f86757d2c7a4317"><enum>(C)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> has the meaning
				given the term in subsection (o)(1).</text>
							</subparagraph></paragraph><paragraph id="ID67fd2d8201ef4a67997f577f40b963dd"><enum>(2)</enum><header>1,000,000,000-Gallon
				Challenge Grant Program</header>
							<subparagraph id="IDa3bdbae666c14da1a542512554d114a8"><enum>(A)</enum><header>Establishment</header><text>The
				Administrator shall establish within the Environmental Protection Agency a
				program, to be known as the <quote>1,000,000,000-Gallon Challenge Grant
				Program</quote>, under which the Administrator shall provide grants in
				accordance with this subsection.</text>
							</subparagraph><subparagraph id="ID498d5e867a85432b9b7c0ec9dabae640"><enum>(B)</enum><header>Applications</header>
								<clause id="id5EF3F140106A4255B180E5440C4F4932"><enum>(i)</enum><header>In
				general</header><text>During each calendar year for the period described in
				clause (ii), the Administrator shall solicit applications for grants under the
				Program from owners and operators of projects that, as determined by the
				Administrator, have the potential, in the aggregate, to produce up to
				500,000,000 gallons in annual domestic production capacity of advanced green
				biofuels.</text>
								</clause><clause id="id181CE0FF50F140FEB815ED36C2CCAE97"><enum>(ii)</enum><header>Description of
				period</header><text>The period referred to in clause (i) is the period
				that—</text>
									<subclause id="idF1A7D7A59FE844F5B7CFDD522230911F"><enum>(I)</enum><text>begins on the
				date of establishment of the Program; and</text>
									</subclause><subclause id="idC151EDC00A8A48788E097496127C4444"><enum>(II)</enum><text>ends on the date
				on which, as determined by the Administrator, the Program supports projects
				that have the potential to produce, or are producing, not less than
				1,000,000,000 gallons in annual domestic production capacity of advanced green
				biofuels.</text>
									</subclause></clause><clause id="id5A5E06C93B004374B45DB5C7D90F9389"><enum>(iii)</enum><header>Adjustments</header>
									<subclause id="id38C4E61BFDD6404C941C8F3ECFC7DC63"><enum>(I)</enum><header>Definition of
				adjustment period</header><text>In this clause, the term <term>adjustment
				period</term> means the period that—</text>
										<item id="idC70DD1A8D57C44489EF05B7C198836AA"><enum>(aa)</enum><text>begins on the
				date of establishment of the Program; and</text>
										</item><item id="idAB4521AF711A49E9A916CB43FD364B59"><enum>(bb)</enum><text>ends on the
				earlier of, as determined by the Administrator—</text>
											<subitem id="id04C315356F8B43BF917BAD625E304A3E"><enum>(AA)</enum><text>the date on
				which the Program supports projects that have the potential to produce, or are
				producing, not less than 1,000,000,000 gallons in annual domestic production
				capacity of advanced green biofuels; and</text>
											</subitem><subitem id="idA5629888A6A048C78ACB2172C6297C4C"><enum>(BB)</enum><text>the date on
				which the Program achieves the annual domestic production capacity targets of
				the Program.</text>
											</subitem></item></subclause><subclause id="id663DF3C397144856806E705E31ED563F"><enum>(II)</enum><header>Solicitation
				of applications</header><text>For any calendar year during the adjustment
				period for which an application for a grant under the Program is withdrawn, or
				for which a recipient of a grant under the Program fails to meet the domestic
				production capacity targets of the recipient (as determined by the
				Administrator), the Administrator shall solicit additional applications for
				grants under the Program.</text>
									</subclause></clause><clause id="ID75468c988510437d9e2dc622a6aa0994"><enum>(iv)</enum><header>Application
				policy</header><text>The grant solicitation process of the Program shall
				provide for, as determined by the Administrator—</text>
									<subclause id="ID9a6d10c2bda74b4a8c521d1a07467c69"><enum>(I)</enum><text>simplified,
				standardized, and timely solicitation of applications; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="ID53c46b1c92ae41d4b83655494c910f3a"><enum>(II)</enum><text>a simplified,
				standardized funding process that requires—</text>
										<item commented="no" display-inline="no-display-inline" id="id43FC71866CED4DD6A3D16CFCCF3B4749"><enum>(aa)</enum><text>timely receipt
				and review of applications; and</text>
										</item><item commented="no" display-inline="no-display-inline" id="idC72B956C3EF843048C3369CD20E3B58E"><enum>(bb)</enum><text>protection of
				proprietary information provided in applications.</text>
										</item></subclause></clause></subparagraph><subparagraph id="id2E4F614046014661A49DC28E6BA50301"><enum>(C)</enum><header>Types of
				grants</header><text>In carrying out the Program, the Administrator shall
				provide 4 types of grants, as follows:</text>
								<clause id="id59CB679CB3F64694A72E6BD700D5A647"><enum>(i)</enum><header>Research and
				development grants</header>
									<subclause id="idDBCCE7E05F8140E3AA251660D3A16C39"><enum>(I)</enum><header>In
				general</header><text>A research and development grant may be provided under
				the Program to a project that, as determined by the Administrator, will assist
				biofuel developers in producing advanced green biofuels by facilitating—</text>
										<item id="IDd59b40d740d44085b5364f917061cb14"><enum>(aa)</enum><text>the development
				of technologies to produce advanced green biofuels;</text>
										</item><item id="IDa1b44f4297744595ad324d725f3f03c0"><enum>(bb)</enum><text>the creation of
				technologies used in facilities that produce advanced green biofuels; or</text>
										</item><item commented="no" display-inline="no-display-inline" id="ID52453a66a3714ee1ac13a326696a4dcd"><enum>(cc)</enum><text>the production
				of advanced green biofuels, including renewable biomass.</text>
										</item></subclause><subclause id="IDdd21451b39604782848d85b2057e9d37"><enum>(II)</enum><header>Limitation</header><text>The
				amount of a research and development grant provided under the Program shall not
				exceed the lesser of—</text>
										<item id="IDa757d47818764e63b2e53897fc6c82be"><enum>(aa)</enum><text>an
				amount equal to 80 percent of the cost of the project; or</text>
										</item><item commented="no" display-inline="no-display-inline" id="ID4fd2aac36ed041b1a0d7f2bbc23c2467"><enum>(bb)</enum><text>$2,000,000.</text>
										</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idA04AB92D8BF044ECAF3CCCF52DAFD6D0"><enum>(ii)</enum><header>Planning
				grants</header>
									<subclause commented="no" display-inline="no-display-inline" id="idCE997166E8134F5496B7038F6FA9D1A3"><enum>(I)</enum><header>In
				general</header><text>A planning grant may be provided under the Program to a
				project that, as determined by the Administrator, will assist biofuel
				developers in producing advanced green biofuels by facilitating the development
				and finalization of project plans and contracts that demonstrate that the
				project—</text>
										<item id="ID1b09a2ae85fb4743b8e52f2c04a3bd98"><enum>(aa)</enum><text>has the
				potential for commercial viability; and</text>
										</item><item id="ID0ded89abc872407ab4503ca6817545a0"><enum>(bb)</enum><text>is
				likely to be operational by not later than 3 years after the date on which the
				planning grant is provided.</text>
										</item></subclause><subclause id="ID09fd3efc362e404587db22c8f37cda7e"><enum>(II)</enum><header>Limitation</header><text>The
				amount of a planning grant provided under the Program shall not exceed the
				lesser of—</text>
										<item id="IDbda11987e9da4f9ba1cc08fccdb41bec"><enum>(aa)</enum><text>an
				amount equal to 80 percent of the cost of the project; or</text>
										</item><item commented="no" display-inline="no-display-inline" id="ID262c0a9d66da42b086d83cdd5948524a"><enum>(bb)</enum><text>$2,000,000.</text>
										</item></subclause></clause><clause id="IDeb8eb6836aef4ae8ba261bbf81ffce95"><enum>(iii)</enum><header>Translational
				grants</header>
									<subclause id="idD82F1ACD35E64A658C81DA3A8AE80C9C"><enum>(I)</enum><header>In
				general</header><text>A trans­la­tion­al grant, which helps to create
				successful technological innovations and the commercial use of those
				innovations, may be provided under the Program to a project that, as determined
				by the Administrator, will assist biofuel developers in producing advanced
				green biofuels, including from the development of a basic proof-of-concept for
				the project to the establishment of a pilot-scale advanced green biofuel
				production facility through a phased process, as described in subclause
				(II).</text>
									</subclause><subclause id="id2B27ED26040B41F39AAD2DFAD6ED13F0"><enum>(II)</enum><header>Phases</header><text>The
				phases referred to in subclause (I) are the following:</text>
										<item id="idBDE80D5D85C74DC9B76FE97757A600AB"><enum>(aa)</enum><header>Phase
				I</header><text>A project shall be considered to be in phase I for purposes of
				this subparagraph if the purpose of the project is to determine the scientific
				and technical merit and feasibility of ideas that appear to have commercial
				potential, as described in item (bb).</text>
										</item><item id="id1863BA8CB8334BA4860DC375B456A1E1"><enum>(bb)</enum><header>Phase
				II</header><text>A project shall be considered to be in phase II for purposes
				of this subparagraph if the purpose of the project is to advance the
				development of a project that meets particular Program needs, based on the
				scientific and technical merit and feasibility demonstrated in the application
				for the project (as evidenced by phase I of the project), taking into
				consideration, among other things, the commercial potential of the project, as
				evidenced by—</text>
											<subitem id="ID564e2afe8ff74e9186084b18da1d0c11"><enum>(AA)</enum><text>the record of
				success of the applicable biofuel developer in commercializing the results of
				research;</text>
											</subitem><subitem id="IDff57464606ac41158a2c919b8a5cd0d4"><enum>(BB)</enum><text>the existence of
				phase II-appropriate funding commitments from the private sector or a funding
				source other than the Program;</text>
											</subitem><subitem id="ID36d83b3c69044711b15eb42aa1f20cc0"><enum>(CC)</enum><text>the existence of
				commitments for phase III of the project; and</text>
											</subitem><subitem id="IDfff96a56945a47b7bc0addd21c389228"><enum>(DD)</enum><text>the presence of
				other indicators of the commercial potential of the project.</text>
											</subitem></item><item id="id37A248A5671141B59213F429A6803CE4"><enum>(cc)</enum><header>Phase
				III</header><text>A project shall be considered to be in phase III for purposes
				of this subclause if—</text>
											<subitem id="id3364DD95B7804856A7D0D96695CCA5D0"><enum>(AA)</enum><text>the project has
				completed phases I and II; and</text>
											</subitem><subitem id="idF15BD268E8334F9ABB1E40D7651A1E19"><enum>(BB)</enum><text>commercial
				application of, or the continuation of work on, the project will be funded by
				the private sector or a funding source other than the Program.</text>
											</subitem></item></subclause><subclause id="IDae5d1525f7f9439da5c345a6b7bfa523"><enum>(III)</enum><header>Limitation</header><text>The
				amount of a translational grant provided under the Program shall not exceed the
				lesser of—</text>
										<item id="ID1daf9ae2e9be479f9a1368f773e55bf3"><enum>(aa)</enum><text>an
				amount equal to 80 percent of the cost of the project; or</text>
										</item><item commented="no" display-inline="no-display-inline" id="IDb59288c8db464917bb3d03d9fc4fd147"><enum>(bb)</enum><text>$8,000,000.</text>
										</item></subclause></clause><clause id="ID18b0ef6f26e04793a25cbc50ff6f1c77"><enum>(iv)</enum><header>Construction
				grants</header>
									<subclause id="id55EB301E1FCD48D28E4FB5928AE855D9"><enum>(I)</enum><header>In
				general</header><text>A construction grant may be provided under the Program to
				a project that, as determined by the Administrator—</text>
										<item id="id59A94FC4C607437D95A5ECBB1DA50221"><enum>(aa)</enum><text>will assist
				biofuel developers in producing advanced green biofuels by paying construction
				costs and other costs;</text>
										</item><item id="ID956ad170a9fa4c6182d906bfe47ffaf7"><enum>(bb)</enum><text>demonstrates the
				potential for commercial success; and</text>
										</item><item commented="no" display-inline="no-display-inline" id="ID24e17f4c6009412aa5612ce9c39fcc95"><enum>(cc)</enum><text>will commence
				construction by not later than 1 year after the date on which the construction
				grant is provided.</text>
										</item></subclause><subclause commented="no" display-inline="no-display-inline" id="ID9930b2687a154cdd8e59e40637667811"><enum>(II)</enum><header>Limitation</header><text>The
				amount of a construction grant provided under the Program shall not exceed an
				amount equal to 60 percent of the cost of the project.</text>
									</subclause></clause></subparagraph><subparagraph id="ID0f87182831f34a068b3a7575b5d1c46e"><enum>(D)</enum><header>Selection</header>
								<clause id="ID3d8b6464b1a8483ea0573387c9324202"><enum>(i)</enum><header>Research and
				development grants</header><text>In evaluating applications for research and
				development grants under the Program, the Administrator shall take into
				consideration—</text>
									<subclause id="ID3dacc1d8b9a14c82aba5898266860952"><enum>(I)</enum><text>the potential of
				a project for commercial viability;</text>
									</subclause><subclause id="ID7e3ebce6601f4387afd74eeea492f0cf"><enum>(II)</enum><text>the potential of
				the project to provide environmental and public health benefits;</text>
									</subclause><subclause id="IDd7f092cdacc640309bfeecf577594cba"><enum>(III)</enum><text>the potential
				of the project to use existing fuel delivery and distribution systems;
				and</text>
									</subclause><subclause id="ID8f66f696b8c24f03b143037e4891cb45"><enum>(IV)</enum><text>such other
				factors as the Administrator determines to be appropriate.</text>
									</subclause></clause><clause id="IDf2281724fee844b29714acb397b6846b"><enum>(ii)</enum><header>Planning
				grants</header><text>In evaluating applications for planning grants under the
				Program, the Administrator shall take into consideration—</text>
									<subclause id="ID1ed6bbe7ec4a49199635464c25d1e3c8"><enum>(I)</enum><text>the potential of
				a project for commercial viability;</text>
									</subclause><subclause id="ID5439da9f9a1d4d77bbd256e4268dcab3"><enum>(II)</enum><text>the potential of
				the project to provide environmental and public health benefits;</text>
									</subclause><subclause id="ID57661daae7a84deca31b93a67d67db6e"><enum>(III)</enum><text>the potential
				of the project to use existing fuel delivery and distribution systems;</text>
									</subclause><subclause id="IDd40a0f6a3e4c4d2f85a53b4374a9908c"><enum>(IV)</enum><text>the scalability
				of the project; and</text>
									</subclause><subclause id="IDad038f7bd1e24be3b8f8160e39992ddd"><enum>(V)</enum><text>such other
				factors as the Administrator determines to be appropriate.</text>
									</subclause></clause><clause id="ID97057434b83640b392a0065c70515d0c"><enum>(iii)</enum><header>Translational
				grants</header><text>In evaluating applications for translational grants under
				the Program, the Administrator shall take into consideration—</text>
									<subclause id="ID6d8791de5b6243aaa949fd0f1334b9b4"><enum>(I)</enum><text>the potential of
				a project for commercial viability;</text>
									</subclause><subclause id="ID1fe2af8c8355402aa34ade71aa1354cc"><enum>(II)</enum><text>the potential of
				the project to provide environmental and public health benefits;</text>
									</subclause><subclause id="IDf43919fa0e3e4d729b1c9f70870f553b"><enum>(III)</enum><text>the potential
				of the project to use existing fuel delivery and distribution systems;</text>
									</subclause><subclause id="IDcf4f4b6929fb45858b5f7bba42cb006d"><enum>(IV)</enum><text>the scalability
				of the project; and</text>
									</subclause><subclause id="IDdedee5bbcb9a41b7b0dfbf386d096a69"><enum>(V)</enum><text>such other
				factors as the Administrator determines to be appropriate.</text>
									</subclause></clause><clause id="IDf36f93d2b2604070bfb84b852d0b20ee"><enum>(iv)</enum><header>Construction
				grants</header><text>In evaluating applications for construction grants under
				the Program, the Administrator shall take into consideration—</text>
									<subclause id="ID4ff2fb2280d141f59c1b3e0215025062"><enum>(I)</enum><text>the potential of
				a project for commercial success;</text>
									</subclause><subclause id="ID9e40471857054c2a8fbd6898b7774174"><enum>(II)</enum><text>the potential of
				the project to provide environmental and public health benefits;</text>
									</subclause><subclause id="IDd5b91129f36140e6a48801f686650ad0"><enum>(III)</enum><text>the potential
				of the project to use existing fuel delivery and distribution systems;</text>
									</subclause><subclause id="ID4b2e6a0c56334ec7b516cc57110a9eb5"><enum>(IV)</enum><text>the scalability
				of the project;</text>
									</subclause><subclause id="ID8da39876168b449eb33f3c93d9d7b65e"><enum>(V)</enum><text>the readiness of
				the project to commence construction by not later than 1 year after the date on
				which the construction grant is provided; and</text>
									</subclause><subclause id="IDc465987f1cfd40b390e54a877300e365"><enum>(VI)</enum><text>such other
				factors as the Administrator determines to be appropriate.</text>
									</subclause></clause><clause id="IDf9085e05ccc8477091a06f46d06f7d56"><enum>(v)</enum><header>Exercise of
				discretion in funding projects</header><text>The Administrator shall not
				exclude an application from consideration under this subparagraph solely on the
				basis that the project that is the subject of the application uses, or proposes
				to use, any item described in subsection (o)(1)(I).</text>
								</clause></subparagraph><subparagraph id="ID549f130a32644ca08308f0d648e37490"><enum>(E)</enum><header>Coordination
				with complementary programs</header>
								<clause id="idC3E07AF466684A3B9442CB56C0D33A78"><enum>(i)</enum><header>Definition of
				complementary program</header><text>In this subparagraph, the term
				<term>complementary program</term> means a grant program under any other
				provision of law (including a regulation) under which a recipient of a grant
				under the Program receives, or has the potential to receive, funds to assist
				the project of the recipient to achieve environmental performance standards
				equivalent to, or greater than, the standards required under the
				Program.</text>
								</clause><clause id="id9498013B9F5240F2A465B0D18AF4B5F9"><enum>(ii)</enum><header>Effect of
				Program</header>
									<subclause id="id0DE7644B5D0E4095A8A5532C699A6B59"><enum>(I)</enum><header>In
				general</header><text>A grant provided to a recipient under the Program—</text>
										<item id="idB0116848F4494E4A82155FC707222D68"><enum>(aa)</enum><text>shall be
				provided in addition to any grant provided to the recipient under a
				complementary program; and</text>
										</item><item id="idBE1D2F760FE04B4DB9131ECE9369B87E"><enum>(bb)</enum><text>shall not be
				diminished as a result of receipt by the recipient of funds under any
				complementary program.</text>
										</item></subclause><subclause id="id0118A0F413444D68AD12B424B9BA3AB6"><enum>(II)</enum><header>Amount of
				other grants</header><text>Receipt of a grant under the Program shall not
				affect the amount the recipient is otherwise eligible to receive under any
				complementary program.</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID80bd29b6c171455baa4ec03f8b2675ee"><enum>(3)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this subsection $500,000,000 for the
				period of fiscal years 2011 through
				2015.</text>
