		<official-title display="yes">To amend title 10, United States Code, to
		  improve access to mental health care counselors under the TRICARE program, and
		  for other purposes. </official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>TRICARE Mental Health Care Access
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id0555B336422945288287B2011FE291A0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Mental health counselors under the TRICARE
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="id09612321BF2F411B855BD0504E709B32"><enum>(a)</enum><header display-inline="yes-display-inline">Referral under TRICARE</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5548693b3acb4ee0a76ea3f1290f4cc4"><enum>(1)</enum><header display-inline="yes-display-inline">Referral</header><text display-inline="yes-display-inline">Paragraph (8) of section 1079(a) of title
			 10, United States Code, is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idCBB773FF1AEC4E7FA3653E69EF73D6CA"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>or licensed or
			 certified mental health counselors</quote> after <quote>certified marriage and
			 family therapists</quote> both places it appears; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1C611573C729469CADFD3CEC67452EB3"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting <quote>or licensed or
			 certified mental health counselors</quote> after <quote>that the
			 therapists</quote>.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD21E30492F343A4976924B62C07362C"><enum>(2)</enum><header display-inline="yes-display-inline">Authority to assess medical or
			 psychological necessity of service or supply</header><text display-inline="yes-display-inline">Paragraph (13) of such section is amended
			 by inserting <quote>licensed or certified mental health counselor,</quote>
			 after <quote>certified marriage and family therapist,</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9C53B46569A247DC99F80FDED35E01EB"><enum>(b)</enum><header display-inline="yes-display-inline">Services of mental health
			 counselors</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id155FC3EB84B84BA6847D9374D46078D9"><enum>(1)</enum><header display-inline="yes-display-inline">Authority to enter into personal services
			 contracts</header><text display-inline="yes-display-inline">Section 704(c)(2)
			 of the National Defense Authorization Act for Fiscal Year 1995 (10 U.S.C. 1091
			 note) is amended by inserting <quote>mental health counselors,</quote> after
			 <quote>psychologists,</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4937107783B443F2A0840A65F0BA204F"><enum>(2)</enum><header display-inline="yes-display-inline">Applicability of licensure requirements for
			 health care professionals</header><text display-inline="yes-display-inline">Section 1094(e)(2) of title 10, United
			 States Code, is amended by inserting <quote>mental health counselor,</quote>
			 after <quote>psychologist,</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2C98661769A640E7B0C2AB44C5FD7630"><enum>(c)</enum><header display-inline="yes-display-inline">Requirements for mental health counselors
			 practicing under TRICARE</header><text display-inline="yes-display-inline">For
			 purposes of practicing as a mental health counselor under the TRICARE program
			 pursuant to the amendments made by subsections (a) and (b), an individual shall
			 meet the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id8A1A29FFA3C34E599FBA7B7ACBEEB81E"><enum>(1)</enum><text display-inline="yes-display-inline">The individual shall possess a masters
			 degree or higher level degree in counseling from a program in mental health
			 counseling or clinical mental health counseling that is accredited by the
			 Council for Accreditation of Counseling and Related Educational
			 Programs.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3918E19B02A44821A22E5B6DD634BC98"><enum>(2)</enum><text display-inline="yes-display-inline">The individual shall possess a State
			 license in mental health counseling at the <quote>clinical</quote> or higher
			 level or at the highest level available in States that have tiered licensing
			 schemes.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB97BA9F8FFB84092B625C5F025CD37E3"><enum>(3)</enum><text display-inline="yes-display-inline">The individual shall have passed the
			 National Clinical Mental Health Counseling Examination.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1888FEF87EB9490B8140602DD6AF0D9E"><enum>(4)</enum><text display-inline="yes-display-inline">The individual shall have a well-defined
			 scope of practice (as determining utilizing a systematic assessment of the
			 professional competencies necessary to address the mental and behavioral needs
			 of the population of beneficiaries under the TRICARE program).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idAEEF38766FAC472E96CF1D962D07B87E"><enum>(d)</enum><header display-inline="yes-display-inline">Reports on implementation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idF605ADF2A7CF4BFD81553D7F0A698F00"><enum>(1)</enum><header display-inline="yes-display-inline">Initial
			 report</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Secretary of Defense
			 shall submit to Congress a report on the implementation of this section and the
			 amendments made by this section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1FDC75D94EE04C508F450CB1F371E040"><enum>(2)</enum><header display-inline="yes-display-inline">Updated
			 report</header><text display-inline="yes-display-inline">Not later than one
			 year after the date of the enactment of this Act, the Secretary shall submit to
			 Congress an update to the report submitted under paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEF324188801B44ED84C4A4151F4AD562"><enum>(e)</enum><header display-inline="yes-display-inline">TRICARE program defined</header><text display-inline="yes-display-inline">In this section, the term <term>TRICARE
			 program</term> has the meaning given that term in section 1072(7) of title 10,
			 United States Code.</text>
