		<official-title display="yes">To amend the Clean Air Act to direct the
		  Administrator of the Environmental Protection Agency to provide competitive
		  grants to publicly funded schools to implement effective technologies to reduce
		  air pollutants (as defined in section 302 of the Clean Air Act), including
		  greenhouse gas emissions, in accordance with that Act.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sustainable Schools Pollution
			 Reduction Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id3931D73688C94296A1035EC967DD78E0" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sustainable schools pollution reduction
			 grant program</header><text display-inline="no-display-inline">Section 105 of
			 the Clean Air Act (42 U.S.C. 7405) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idBF563DAB342C4866B8E6CA5F8EEA669C" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="id66BC993FAF0240668368311995F21E47"><enum>(f)</enum><header display-inline="yes-display-inline">Sustainable schools pollution reduction
				grant program</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id57B97CBB0ACC4E8FA17D5D8152EACFEA"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idA33B60FB3F1E473AB7A26F90002C6118"><enum>(A)</enum><header display-inline="yes-display-inline">Elementary school; secondary
				school</header><text display-inline="yes-display-inline">The terms
				<term>elementary school</term> and <term>secondary school</term> have the
				meanings given the terms, respectively, in section 9101 of the Elementary and
				Secondary Education Act of 1965 (20 U.S.C. 7801).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC71446B740284988BD71A46679C97083"><enum>(B)</enum><header display-inline="yes-display-inline">Eligible school</header><text display-inline="yes-display-inline">The term <term>eligible school</term>
				means—</text>
							<clause commented="no" display-inline="no-display-inline" id="id36812157B0994D0E9DA9D7E127A3562F"><enum>(i)</enum><text display-inline="yes-display-inline">a public elementary school or a public
				secondary school; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idC4F3A34A52394CE4A1710174114F452B"><enum>(ii)</enum><text display-inline="yes-display-inline">a school district that encompasses a public
				elementary school or a public secondary school.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C5BEE786742450BA770620BF2A8B297"><enum>(C)</enum><header display-inline="yes-display-inline">Program</header><text display-inline="yes-display-inline">The term <term>program</term> means the
				sustainable schools pollution reduction program established by paragraph
				(2)(A).</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id09150809C5B8421C9FBAFDA29AF9F6FF"><enum>(2)</enum><header display-inline="yes-display-inline">Program</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC9E8184430074299ACB445B344156CFB"><enum>(A)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">There is established within the
				Environmental Protection Agency a sustainable schools pollution reduction
				program.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1158F60EEF4149248618DE263930578C"><enum>(B)</enum><header display-inline="yes-display-inline">Grants</header>
							<clause commented="no" display-inline="no-display-inline" id="id37B1EBD5CB654A9095F46E785B3DECFE"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out the program, for each of
				fiscal years 2011 through 2015, the Administrator shall provide competitive
				grants to eligible schools for use in implementing effective technologies to
				reduce air pollutants, including greenhouse gas emissions.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id7DCDB751DA2F41FC873429A188FF3B34"><enum>(ii)</enum><header display-inline="yes-display-inline">Criteria for selection of
				grantees</header><text display-inline="yes-display-inline">The Administrator
				shall provide criteria for selection for grants under the program, including
				criteria that ensure—</text>
								<subclause commented="no" display-inline="no-display-inline" id="idEA9E22BC4E7C4954B703221EEA156F6A"><enum>(I)</enum><text display-inline="yes-display-inline">implementation of clean technologies that
				reduce air pollution and greenhouse gas emissions, and offer additional
				benefits, such as—</text>
									<item commented="no" display-inline="no-display-inline" id="idEB0E20E81E094928A6D8A13E68A84A9C"><enum>(aa)</enum><text display-inline="yes-display-inline">reduction of water consumption or water
				pollution;</text>
									</item><item commented="no" display-inline="no-display-inline" id="id8D481C01741F4E13BFDEE5B1E7421FE5"><enum>(bb)</enum><text display-inline="yes-display-inline">promotion of distributed renewable energy
				technologies, such as solar, small-scale or community-scale wind, geothermal,
				biomass, and other energy technologies; or</text>
									</item><item commented="no" display-inline="no-display-inline" id="idEF27AFD53D2545758A415358835706DD"><enum>(cc)</enum><text display-inline="yes-display-inline">demonstration of new and innovative
				technologies; and</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="idEE599275F15D4BD2B81A2BD01E1A1F66"><enum>(II)</enum><text display-inline="yes-display-inline">prioritization of projects that provide
				opportunities for student involvement in the project to be funded,
				including—</text>
									<item commented="no" display-inline="no-display-inline" id="idF61225996C5E4E1B9457415F196CBA03"><enum>(aa)</enum><text display-inline="yes-display-inline">project installation;</text>
									</item><item commented="no" display-inline="no-display-inline" id="id0C9AC0BB01F149289F6D6A3AEDE4DA9A"><enum>(bb)</enum><text display-inline="yes-display-inline">project data monitoring; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="id2B32A7FE96DE4146AF0243B3F4F334BC"><enum>(cc)</enum><text display-inline="yes-display-inline">incorporation of the project into classroom
				curricula.</text>
									</item></subclause></clause><clause commented="no" display-inline="no-display-inline" id="idB485393FE4894208940E9F2EE4BA0D91"><enum>(iii)</enum><header display-inline="yes-display-inline">Categories of grants and matching
				funds</header><text display-inline="yes-display-inline">Of the grant funds
				provided under the program—</text>
								<subclause commented="no" display-inline="no-display-inline" id="id885FA40FA6014B16BFEA8068AF708B1C"><enum>(I)</enum><text display-inline="yes-display-inline">not less than 40 percent shall be provided
				in amounts not to exceed $50,000 for each grant, with no required matching
				share; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="id605C3A219126455CA65B4ED6957F9930"><enum>(II)</enum><text display-inline="yes-display-inline">the remaining funds shall be
				provided—</text>
									<item commented="no" display-inline="no-display-inline" id="id83D897F82D074BC7A0491EAC52E547D3"><enum>(aa)</enum><text display-inline="yes-display-inline">in amounts of not less than $50,000 but not
				to exceed $100,000 for each grant, with a required non-Federal share of 20
				percent; and</text>
									</item><item commented="no" display-inline="no-display-inline" id="id4F91EC0D370A4709B874D97A9F2EB136"><enum>(bb)</enum><text display-inline="yes-display-inline">in amounts that exceed $100,000 but not to
				exceed $200,000, with a required non-Federal share of 50 percent.</text>
									</item></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf28ce06ae4d1475ca6bfd7254646fab7"><enum>(C)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">Not later than 18 months after the date on
				which funds are made available to carry out this subsection, and annually
				thereafter, the Administrator shall submit to Congress a report evaluating the
				implementation of the program, including, at a minimum, a description
				of—</text>
							<clause commented="no" display-inline="no-display-inline" id="idEEDE9A6FB67E49B088AF1E2C54285351"><enum>(i)</enum><text display-inline="yes-display-inline">the number of grant applications
				received;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id7A28AFA2E01F438C8209B7A780B76125"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of grants funded, including the
				amount of each grant funded;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idD5F4E91EC6BC414FBFFE8659393317E9"><enum>(iii)</enum><text display-inline="yes-display-inline">the types of technologies funded;
				and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idCBDD4E1B8DFE490AB8DB6228EB4B4C70"><enum>(iv)</enum><text display-inline="yes-display-inline">the environmental, educational, and
				financial benefits to eligible schools receiving the grants.</text>
							</clause></subparagraph><subparagraph changed="added" id="idAA7D9F2D50DC4E09AB70B913A2C800F5" reported-display-style="italic"><enum>(D)<?LEXA-Enum “(D)?></enum><header>Allocations</header>
							<clause id="id3565F81C25C64680AD08D45572FC63ED"><enum>(i)<?LEXA-Enum “(i)?></enum><header>States</header><text>Notwithstanding the other
				provision of this section, the Administrator shall ensure, in awarding grants
				under this subsection, that at least 1 grant shall be awarded to an eligible
				school in each State if at least 1 eligible school in the State has submitted
				an application that meets the criteria described in subparagraph
				(B)(ii).</text>
							</clause><clause id="idAE50C865C0A94194B34BD462DF41BC43"><enum>(ii)<?LEXA-Enum “(ii)?></enum><header>Indian
				tribes</header><text>Notwithstanding any other provision of this subsection,
				before providing grants under this subsection, the Administrator shall allocate
				at least 2.0 percent of the total annual amount made available to carry out
				this subsection among Indian tribes, based on criteria described in
				subparagraph (B)(ii).</text>
							</clause></subparagraph><subparagraph changed="added" id="id84DF0B0BC32144F7A39EA74810ACB70B" reported-display-style="italic"><enum>(E)<?LEXA-Enum “(E)?></enum><header>Geographical and size
				differences</header><text>In addition to applying the criteria described in
				subparagraph (B)(ii), the Administrator shall ensure geographical diversity
				among grant awardees and ensure that grant awardees reflect a variety of
				schools sizes.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDaa5c35b92ea243b4a06aaf05e27dfdcf"><enum><added-phrase reported-display-style="italic">(F)</added-phrase></enum><clause commented="no" display-inline="yes-display-inline" id="id9241C93FA1C94309A85873888DE7B153"><enum><deleted-phrase reported-display-style="strikethrough">(D)</deleted-phrase></enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this subsection such sums as are
				necessary for each of fiscal years 2011 through
				2015.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
