		  database on a public website for congressional earmarks as called for by the

		<section changed="deleted" committee-id="SSGA00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Earmark Transparency
			 Act</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSGA00" id="ID4344ece83bc14193923168005281f390" reported-display-style="strikethrough"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID9b1b66b23e644dbda0c554ef33979ca4"><enum>(1)</enum><header>Congressionally
			 directed spending item</header><text>The term <term>congressionally directed
			 spending item</term> shall have the same meaning as given the term in section
			 521 of the Honest Leadership and Open Government Act of 2007 (Public Law
			 110–81).</text>
			</paragraph><paragraph id="ID811e381f0c2548ecaca8dc8666ba9dc2"><enum>(2)</enum><header>Request</header><text display-inline="yes-display-inline">The term <term>request</term> means a
			 formal communication, most commonly in writing, from a Member of Congress to a
			 committee of Congress or a chairman or ranking member of such a committee
			 requesting a congressionally directed spending item.</text>
			</paragraph><paragraph commented="no" id="ID60fd07cead4542d5ad5381298cddb851"><enum>(3)</enum><header>Requestor</header><text>The
			 term <term>requestor</term> means the Member or Members of Congress that
			 submits a request.</text>
			</paragraph><paragraph id="ID88940520511f4485a55cf35833abeccd"><enum>(4)</enum><header>Searchable
			 website</header><text>The term <term>searchable website</term> means a website
			 that allows the public to—</text>
				<subparagraph id="IDf559ee6ec2ea49e0af01427e05256bfe"><enum>(A)</enum><text>search and
			 aggregate congressionally directed spending items by any element required under
			 section 3;</text>
				</subparagraph><subparagraph id="ID841a07b46fce48e19cb9d74f29e3c074"><enum>(B)</enum><text>ascertain through
			 a single search the total number and dollar value of congressionally directed
			 spending items requested by an individual Member of Congress;</text>
				</subparagraph><subparagraph id="ID2aadacf692554f7db208004014883561"><enum>(C)</enum><text>download data
			 included in subparagraph (A) included in the outcome from searches;</text>
				</subparagraph><subparagraph id="IDd77053c29c3b4a74a41bc9bfee05a662"><enum>(D)</enum><text>programmatically
			 search and access all data in a serialized machine readable format via a
			 web-services application programming interface;</text>
				</subparagraph><subparagraph id="id2603E8585BBC426DBC1FB93353746354"><enum>(E)</enum><text>access a public
			 facing interface that can be queried across multiple fields from a single
			 search, or through an advanced search that allows users to query for
			 information in specific fields; and</text>
				</subparagraph><subparagraph id="idEE1CCAAEEF4C4B7A805072A22A2688F6"><enum>(F)</enum><text>access the website
			 address and link on the front page of the websites of the Secretary of the
			 Senate and Clerk of the House of Representatives.</text>
				</subparagraph></paragraph></section><section changed="deleted" committee-id="SSGA00" id="IDfba5a890d18b40ceba590df5503ac7e6" reported-display-style="strikethrough"><enum>3.</enum><header>Congressional
			 earmark database</header>
			<subsection id="IDc00203debc044fd48360db1bc29a4d9a"><enum>(a)</enum><header>Website</header><text>Not
			 later than 6 months after the date of enactment of this Act, the Clerk of the
			 House of Representatives, in coordination with the Secretary of the Senate,
			 shall ensure the existence of a single searchable website, available to the
			 public at no cost to access, that includes for each request—</text>
				<paragraph id="ID049fb315313c4296b84e2029d6f5449b"><enum>(1)</enum><text>the fiscal year in
			 which the congressionally directed spending item would be funded;</text>
				</paragraph><paragraph id="IDbfcef8c89fe148bfa38235ae40848933"><enum>(2)</enum><text>the bill number on
			 which request is made;</text>
				</paragraph><paragraph id="IDeefaff72f380426685bd345d8fa9a058"><enum>(3)</enum><text>the bill section
			 location;</text>
				</paragraph><paragraph id="ID7a6b40404b2244698171e09a373219c9"><enum>(4)</enum><text>the amount of
			 initial request made by requestor;</text>
				</paragraph><paragraph id="ID9fbec4e6379b49a3821df117bba83945"><enum>(5)</enum><text>the amount
			 approved by the committee of jurisdiction;</text>
				</paragraph><paragraph id="IDa34ac68999354cda9ab46681eb257a27"><enum>(6)</enum><text>the amount
			 approved in final legislation (if approved);</text>
				</paragraph><paragraph id="ID3ae39eecdc224ea4990c8024dcf7ed3b"><enum>(7)</enum><text>the name of
			 Federal department or agency through which the entity will receive the
			 funding;</text>
				</paragraph><paragraph id="id9F33BC06584240C79F638208BB248CD5"><enum>(8)</enum><text>if the request was
			 included in the President’s budget for the relevant fiscal year;</text>
				</paragraph><paragraph id="idEE544DBBD5C74F6DAA2F265F8A1FBAC7"><enum>(9)</enum><text>if the request is
			 authorized in law and when any such authorization expires;</text>
				</paragraph><paragraph id="ID181b8171d6f4459883c194b2bcaa4280"><enum>(10)</enum><text>the name of the
			 requestor or requestors;</text>
				</paragraph><paragraph id="ID2680cdb0b0e641c9a524e66d91c1c868"><enum>(11)</enum><text>the requestor
			 State (for Members of the Senate) or State and District (for Members of the
			 House of Representatives);</text>
				</paragraph><paragraph id="IDa46a2da650eb41dbb2d61b1aa3d78179"><enum>(12)</enum><text>the name of any
			 beneficiary designated to receive appropriations, including Federal agencies,
			 municipalities, and States;</text>
				</paragraph><paragraph id="ID5f0680da9b8645a1ace2e878e41a76c2"><enum>(13)</enum><text>the type of
			 organization (public, private non-profit, or private for-profit entity);</text>
				</paragraph><paragraph id="idC0769C97649A4EAC81566E804C319BDF"><enum>(14)</enum><text>the address of
			 each beneficiary identified in paragraph (12);</text>
				</paragraph><paragraph id="ID33e1777ca47541d4b4db514369cd5d79"><enum>(15)</enum><text>the project
			 name;</text>
				</paragraph><paragraph id="ID89884de2a1c841829e96b77cfd552cfb"><enum>(16)</enum><text>the project
			 description;</text>
				</paragraph><paragraph id="ID9694744ee4164997a83630a8cb74383d"><enum>(17)</enum><text>the
			 justification, as provided by the requestor or requestors, explaining how
			 congressionally directed spending item would benefit taxpayers;</text>
				</paragraph><paragraph id="id3516E15BA638413786E9A90766C67D89"><enum>(18)</enum><text>an indication of
			 whether congressionally directed spending item related to request is a
			 continuing project;</text>
				</paragraph><paragraph id="ID1cbb2096b28d4cdc86491cf0e165a385"><enum>(19)</enum><text>for each
			 congressionally directed spending item identified as a continuing project under
			 paragraph (18), an indication of how long it has received
			 appropriations;</text>
				</paragraph><paragraph id="IDe29c7a2e0c9d46b99408776b82aad6ff"><enum>(20)</enum><text>the estimated
			 completion date of the project funded by the congressionally directed spending
			 item;</text>
				</paragraph><paragraph id="ID57f7029cb364467185665de1dfadcce6"><enum>(21)</enum><text>a description, if
			 applicable, of any Federal or non-Federal sources of funding for the previous 2
			 fiscal years, including the amount of a State or local matching requirement,
			 for the congressionally directed spending item;</text>
				</paragraph><paragraph id="ID9ff5b22b6bd7481cb826c5a0d7f9ced5"><enum>(22)</enum><text>for any
			 non-Federal sources of funding identified under paragraph (21), an
			 identification of the sources and their percentage of the project’s total
			 funding;</text>
				</paragraph><paragraph id="ID5e28ad1dd2704bb0acbd0e36d117feaa"><enum>(23)</enum><text>a copy of all
			 requests and supplemental documents submitted to a committee of Congress
			 relevant to each request; and</text>
				</paragraph><paragraph id="IDebea3ee24d104f309b7cd472105fd962"><enum>(24)</enum><text>the status of the
			 congressionally directed spending item, including if it was only requested, or
			 then inserted into a bill passed by either House, and also noted if it was
			 included in final conference report, including any changes in final dollar
			 amount awarded for the item.</text>
				</paragraph></subsection><subsection id="IDa98a5e58f2bf44bebe673e3291dcf2b1"><enum>(b)</enum><header>Scope of
			 data</header><text>The website created under subsection (a) shall contain all
			 requests made on or after the date of enactment of this Act consistent with the
			 provision of this Act.</text>
			</subsection><subsection id="IDfab2e83d655846f4a1059e6d9f26820f"><enum>(c)</enum><header>Search
			 requirements</header><text>The website created under subsection (a)
			 shall—</text>
				<paragraph id="IDcca08f4bcb7d4122ac0d41104023f63b"><enum>(1)</enum><text>distinguish
			 between requests that have been included in authorizing or appropriation
			 legislation and those that were requested but not included in any
			 legislation;</text>
				</paragraph><paragraph id="idAFD1BB0183FF43A2B2BA9B5B5129E921"><enum>(2)</enum><text>provide a
			 permanent and unique identification number for each request for a
			 congressionally directed spending item;</text>
				</paragraph><paragraph id="ID6daa4efdb448459d920c9138bf38b185"><enum>(3)</enum><text>provide that all
			 search results return permanent weblinks; and</text>
				</paragraph><paragraph id="id0096DAC87BF34B09B3E502294F538ABA"><enum>(4)</enum><text>include
			 information from all relevant sources including bills, conference reports,
			 amendments, manager’s amendments, and committee reports.</text>
				</paragraph></subsection><subsection id="ID3002e977c6ff4912b6de37e6b7fac557"><enum>(d)</enum><header>Availability</header><text>Requests
			 shall be made available on the website created under subsection (a) not later
			 than 5 days after submission by a requestor to a committee of Congress. For
			 items under paragraphs (2), (3), (5), and (6) of subsection (a), information
			 shall be added to the website as soon as it becomes available.</text>
			</subsection><subsection id="ID8e3d5bbf54bd40a09fbe4d831695e654"><enum>(e)</enum><header>Conference
			 reports</header><text>The database shall be updated to include congressionally
			 directed spending items included in any conference report.</text>
			</subsection><subsection id="ID8263b0cfc58c4c2da7e53d388ee637a2"><enum>(f)</enum><header>Committees
			 Responsible</header><text>The burden to provide information in a timely manner
			 and in compliance with this Act to the Secretary of the Senate and the Clerk of
			 the House regarding requests shall be on the committee of Congress to which a
			 request is made.</text>
			</subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSGA00" id="id16CEF23E31FE462CA6C8CB81F584067D" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Earmark Transparency
			 Act</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSGA00" id="ida4ea2606-aecd-44d2-9709-386fe0d15c6b" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id14dd4c1a-b926-4d51-a51f-fb5886d47f37"><enum>(1)</enum><header>Earmark</header><text>The
			 term <term>earmark</term> means a congressionally directed spending item,
			 limited tax benefit, or limited tariff benefit as defined in paragraph 5 of
			 rule XLIV of the Standing Rules of the Senate, as added by section 521 of the
			 Honest Leadership and Open Government Act of 2007 (Public Law 110–81).</text>
			</paragraph><paragraph id="id63e1a312-8193-4f92-99ca-18685de4453e"><enum>(2)</enum><header>Request</header><text display-inline="yes-display-inline">The term <term>request</term> means any
			 formal communication, including in writing or by electronic submission, from a
			 Member of Congress to a committee of Congress or a chairman or ranking member
			 of such a committee requesting an earmark.</text>
			</paragraph><paragraph commented="no" id="id2aabba3b-ccc7-49b6-bc78-8a12499fa7a4"><enum>(3)</enum><header>Requestor</header><text>The
			 term <quote>requestor</quote> means the Member or Members of Congress that
			 submits a request.</text>
			</paragraph><paragraph id="id48a693c3-096b-4819-86f1-0b924d037d8c"><enum>(4)</enum><header>Searchable
			 website</header><text>The term <term>searchable website</term> means a website
			 that—</text>
				<subparagraph id="id1AB54D379AF446CC8CCF3D95ECC7C526"><enum>(A)</enum><text>has the uniform resource
			 locator of earmarks.congress.gov, which shall be prominently displayed under
			 the official websites of the Senate and the House of Representatives;
			 and</text>
				</subparagraph><subparagraph id="idC28BBFD893664A0691677033CF990B9C"><enum>(B)</enum><text>allows the public
			 to—</text>
					<clause id="id6270b5fc-6fd6-436e-af63-b164be174b0c"><enum>(i)</enum><text>search and sort earmarks
			 by any element required under section 3;</text>
					</clause><clause id="id007cd41c-3c0c-4392-8772-d60a0a247e21"><enum>(ii)</enum><text>ascertain through a
			 single search the total number and dollar value of earmarks requested by an
			 individual Member of Congress;</text>
					</clause><clause id="idcb4fca4b-88dc-43fc-b551-d66c531a5e33"><enum>(iii)</enum><text>download data included
			 in clause (i) included in the outcome from searches;</text>
					</clause><clause id="id2f46a04e-3523-45f1-9bc5-b08340e0d41b"><enum>(iv)</enum><text>programmatically
			 retrieve information regarding specific earmarks; and</text>
					</clause><clause id="idf09f9328-1da4-4e99-bbc6-bfd27a50593c"><enum>(v)</enum><text>query across multiple
			 fields in a single search, or through an advanced search for information in
			 specific fields.</text>
					</clause></subparagraph></paragraph></section><section changed="added" committee-id="SSGA00" id="id7c16cfb3-b6ba-44f8-bda2-cac9bd573fa0" reported-display-style="italic"><enum>3.</enum><header>Congressional earmark
			 database</header>
			<subsection id="id9a6ccf73-947d-47a6-8600-8c13fcbfdcac"><enum>(a)</enum><header>Website</header><text>Upon
			 the date of enactment of this Act, the Secretary of the Senate, the Senate
			 Sergeant of Arms, and the Clerk of the House, in consultation with the relevant
			 congressional committees, shall begin the development of a single searchable
			 website, available to the public at no cost to access, that includes for each
			 request—</text>
				<paragraph id="id76dc6d11-583c-4547-a388-52833f73f21e"><enum>(1)</enum><text>the fiscal year in which
			 the earmark would be funded;</text>
				</paragraph><paragraph id="id93b83720-413a-43d6-b350-4ee108d9cb47"><enum>(2)</enum><text>the bill number on which
			 request is made;</text>
				</paragraph><paragraph id="id6d85f162-b223-4f4c-9245-acba68feb74b"><enum>(3)</enum><text>the amount of initial
			 request made by requestor;</text>
				</paragraph><paragraph id="id41163861-0e7f-4759-adb7-3304a5bdb710"><enum>(4)</enum><text>the amount approved by
			 the committee to which the request was made;</text>
				</paragraph><paragraph id="id57f65073-f6a4-4ab6-98e8-80a9d37411d1"><enum>(5)</enum><text>the amount approved in
			 final legislation (if approved);</text>
				</paragraph><paragraph id="idbc7b8eb3-0f68-490f-99f8-13ca7cf5ab14"><enum>(6)</enum><text>the name of Federal
			 department or agency through which the entity will receive the funding;</text>
				</paragraph><paragraph id="idf7a0dd65-0f52-47dd-9907-77951228de16"><enum>(7)</enum><text>the name of the requestor
			 or requestors;</text>
				</paragraph><paragraph id="id9f8d4fff-fa5c-4b1e-aeb0-dad1394592d5"><enum>(8)</enum><text>the requestor State (for
			 Members of the Senate) or State and District (for Members of the House of
			 Representatives);</text>
				</paragraph><paragraph id="id90f09b24-b03b-4285-b4d1-94a24506e66d"><enum>(9)</enum><text>the name of any
			 beneficiary designated to receive appropriations, including Federal agencies,
			 municipalities, and States;</text>
				</paragraph><paragraph id="id399cc467-b3a5-4413-aa49-9a62888f02f9"><enum>(10)</enum><text>the type of organization
			 (public, private non-profit, or private for-profit entity);</text>
				</paragraph><paragraph id="id5c105c5a-4c11-4827-8955-d4356e3be01b"><enum>(11)</enum><text>the address of each
			 beneficiary identified in paragraph (9);</text>
				</paragraph><paragraph id="id040e66b4-af0c-4750-bca4-ebe9b0915b4c"><enum>(12)</enum><text>the project name;</text>
				</paragraph><paragraph id="id4193a736-5fde-4086-b82b-4150501c07f0"><enum>(13)</enum><text>the project
			 description;</text>
				</paragraph><paragraph id="id71126cb8-81ec-43b9-8e03-2f2e14307bd9"><enum>(14)</enum><text>the justification, as
			 provided by the requestor or requestors, explaining how the earmark would
			 benefit taxpayers;</text>
				</paragraph><paragraph id="id1c3d9ccd-ee0b-4186-b640-bd51969c6309"><enum>(15)</enum><text>for any non-Federal
			 sources of funding, the percentage of the project's total funding; and</text>
				</paragraph><paragraph id="id599c5d64-17c9-4f44-b4e9-bb7e6dc0e1df"><enum>(16)</enum><text>a copy of all documents
			 provided by the requestor to a committee relevant to each request.</text>
				</paragraph></subsection><subsection id="id7ce963b3-ca4f-4126-a6ad-3f35049b59c8"><enum>(b)</enum><header>Scope of
			 data</header><text>The website created under subsection (a) shall contain all
			 requests made beginning 1 year after the date of enactment of this Act
			 consistent with the provision of this Act.</text>
			</subsection><subsection id="ida1cb7fc6-8109-4506-8af3-7a2d6f5604e2"><enum>(c)</enum><header>Search
			 requirements</header><text>The website created under subsection (a)
			 shall—</text>
				<paragraph id="id6454fea7-6616-410b-a849-165a886d4f79"><enum>(1)</enum><text>provide a permanent and
			 unique identification number for each request and for each requestor;</text>
				</paragraph><paragraph id="id494dca3a-7fca-4814-af8f-2d1d950b5bd8"><enum>(2)</enum><text>provide that all search
			 results return permanent weblinks; and</text>
				</paragraph><paragraph id="id57f85769-6036-4701-97a8-ec0bcf811d15"><enum>(3)</enum><text>include information from
			 all relevant sources including bills, conference reports, amendments, manager’s
			 amendments, and committee reports.</text>
				</paragraph></subsection><subsection id="idda2c846f-01b3-49f2-a4de-46a56d62dd6a"><enum>(d)</enum><header>Availability</header><text>Requests
			 shall be made available on the website created under subsection (a) not later
			 than 5 days after submission by a requestor to a committee of Congress. For
			 items under paragraphs (4), (5), and (6) of subsection (a), information shall
			 be added to the website as soon as it becomes available.</text>
			</subsection><subsection id="idf0f6f262-c0bc-4924-8611-970ed8029b25"><enum>(e)</enum><header>Responsibility for
			 providing data</header><text>The burden to provide information in a timely
			 manner and in compliance with this Act to the Secretary of the Senate and the
			 Clerk of the House regarding requests shall be—</text>
				<paragraph id="id0A97F9BAA6B14549BACB4DD004CA5C85"><enum>(1)</enum><text>in the case of a
			 requestor, the requirements under subsection (a)(1), (2), (3), (7), (8), (9),
			 (10), (11), (12), (13), (14), (15), and (16); and</text>
				</paragraph><paragraph id="idFCBF8B44384C4B72B40BB0A4ED73550A"><enum>(2)</enum><text>for all other
			 requirements be on the chair of each committee to which a request is
			 made.</text>
				</paragraph></subsection><subsection id="idCA8C7F420CE0474CA77BC5A831DAB31D"><enum>(f)</enum><header>Effective date</header>
				<paragraph id="id5D54275B18F7449B99DFE8012E35CCB3"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), this Act shall be
			 implemented not later than 18 months after the date of enactment of this
			 Act.</text>
				</paragraph><paragraph id="id623FA592B4534A4585FB6C995EF162D7"><enum>(2)</enum><header>Exception</header><text>The
			 provisions referred to under subsection (c) may be implemented not later than 2
			 years after the date of enactment of this Act, if the Secretary of the Senate

				</paragraph><paragraph commented="no" id="idA03623775D2A47D2BA3B358D02540169"><enum>(3)</enum><header>Offset</header><text>Any
			 funds that remain unobligated or unspent at the end of fiscal year 2010 or 2011
			 from the Official Personnel and Office Expense Account of any Senator who
			 agrees to a transfer may be transferred from such account to the office of the
			 Secretary of the Senate for the purpose of paying for any costs associated with
			 the searchable website established by this Act. Not later than 10 days after
			 the conclusion of the fiscal year, a Member of the Senate may provide in
			 writing notification to the Majority Leader of the Senate of the amount of
			 funding that shall be transferred to the office of the Secretary of the Senate
			 under this section.</text>
