			 of 1990 (33 U.S.C. 2704(a)(3)) is amended by striking <quote>plus
			 $75,000,000</quote> and inserting <quote>and the liability of the responsible
			 party under section 1002</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idD6344162EC354E2194C74442AC60E40A"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section takes effect on April 15, 2010.</text>
			</subsection></section><section changed="added" committee-id="SSEV00" id="id0F8399EF531148BB9C64DD8B8E0DDA1A" reported-display-style="italic"><enum>3.</enum><header>Claims
			 procedure</header><text display-inline="no-display-inline">Section 1013(c)(2)
			 of the Oil Pollution Act of 1990 (33 U.S.C. 2713(c)(2)) is amended by striking
			 <quote>settled by any person by payment within 90 days</quote> and inserting
			 <quote>settled in whole by any person by payment within 30 days</quote>.</text>
		</section><section changed="added" committee-id="SSEV00" id="id65B42BDEBD6E4CA9AD070F0B4A0C7D65" reported-display-style="italic"><enum>4.</enum><header>Oil and hazardous
			 substance response planning</header>
			<subsection id="idA95BA8F1687B4364BA6935CE02D95EA7"><enum>(a)</enum><header>National response
			 system</header><text>Section 311(j)(5) of the Federal Water Pollution Control
			 Act (33 U.S.C. 1321(j)(5)) is amended—</text>
				<paragraph id="id1C670B6229D24DFEB4FB14F0D933A3C9"><enum>(1)</enum><text>in subparagraph (A), by
			 adding at the end the following:</text>
					<quoted-block changed="added" committee-id="SSEV00" display-inline="no-display-inline" id="id5DC4BA8C879249628B90530A24226502" reported-display-style="italic" style="OLC">
						<clause id="id1BE236C1B5644B20B6DA2C36BF48D2D3"><enum>(iii)</enum><text>The President shall
				ensure that the regulations promulgated pursuant to this paragraph are designed
				to prevent, to the maximum extent practicable, injury to the economy, jobs, and
				the environment, including to prevent—</text>
							<subclause id="id050276D386EC42E4B06CD24E4BDA59BE"><enum>(I)</enum><text>loss of, destruction of,
				or injury to, real or personal property;</text>
							</subclause><subclause id="id7CB6E69111AB4040B2A54BADA1F408B9"><enum>(II)</enum><text>loss of subsistence use
				of natural resources;</text>
							</subclause><subclause id="id6A5ACA74275149DBB0E98F204AC06D3E"><enum>(III)</enum><text>loss of revenue;</text>
							</subclause><subclause id="idDC93835A34654D28BC9FC9D9DAE4625B"><enum>(IV)</enum><text>loss of profits or
				earning capacity;</text>
							</subclause><subclause id="id3AEE35E07BA34B9F9B2942BF9FA2AA33"><enum>(V)</enum><text>an increase in the cost
				of providing public services to remove a discharge; and</text>
							</subclause><subclause id="id7E105D61902644C3A35219538DD27CF5"><enum>(VI)</enum><text>loss of, destruction of,
				or injury to, natural resources.</text>
							</subclause></clause><clause id="id3A959220B82E4D1F8D445B3BED7C62F5"><enum>(iv)</enum><text>The President shall
				promulgate regulations that clarify the requirements of a response plan in
				accordance with subparagraph (D).</text>
						</clause><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idD4777512C2804F17A82C8D0A4D2D5033"><enum>(2)</enum><text>by striking subparagraph
			 (D) and inserting the following:</text>
					<quoted-block changed="added" committee-id="SSEV00" display-inline="no-display-inline" id="id9E1EF7DC9349461FB2B7DE0323FDDB4E" reported-display-style="italic" style="OLC">
						<subparagraph id="id72D145730E554766AEB55F90A7EFD2F8"><enum>(D)</enum><text>A response plan required
				under this paragraph shall—</text>
							<clause id="ID5fed8c075e8d4599a85d677951b5b020"><enum>(i)</enum><text>be consistent with the
				requirements of the National Contingency Plan and Area Contingency
				Plans;</text>
							</clause><clause id="ID5c16d66dde1b42c9b879b647e23a0e5f"><enum>(ii)</enum><text>identify the qualified
				individual having full authority to implement removal actions, and require
				immediate communications between that individual and the appropriate Federal
				official and the persons providing personnel and equipment pursuant to clause
				(iii);</text>
							</clause><clause id="ID3480d4afc6f347aca138eb20e1af9b98"><enum>(iii)</enum><text>identify, and ensure by
				contract or other means approved by the President the availability of, private
				personnel and equipment in the quantities necessary, staged and available in
				the appropriate region to respond immediately to and sustain the response
				effort for as long as necessary—</text>
								<subclause id="id9CDC4B6F81144D2EB2F28F74B4313F70"><enum>(I)</enum><text>to remove, to the maximum
				extent practicable, a worst-case discharge (including a discharge resulting
				from fire or an explosion);</text>
								</subclause><subclause id="id5DFE1A10C592464492488196037A5CAE"><enum>(II)</enum><text>to mitigate damage from
				a discharge; and</text>
								</subclause><subclause id="idE638C3FE658D414AADCE9B90566EDDA6"><enum>(III)</enum><text>to prevent or reduce a
				substantial threat of such a discharge;</text>
								</subclause></clause><clause id="id3830346016074CCF9330651E79106A5A"><enum>(iv)</enum><text>demonstrate the
				financial capability to pay for removal costs and damages;</text>
							</clause><clause id="ID883ac435b2c34feeaa5909af71e3aff2"><enum>(v)</enum><text>describe the training,
				equipment testing, periodic unannounced drills, and response actions of persons
				on the vessel or at the facility, to be carried out under the plan to ensure
				the safety of the vessel or facility and to meet the requirements of this
				subparagraph;</text>
							</clause><clause id="id87D80709738F4070B304227E351077B4"><enum>(vi)</enum><text>describe the
				environmental effects of the response plan methodologies and equipment;</text>
							</clause><clause id="idF75A7975331E4FD1B2AAED94F8776732"><enum>(vii)</enum><text>describe the process
				for communication and coordination with Federal, State, and local agencies
				before, during, and after a response to a discharge;</text>
							</clause><clause id="idAA368396E1E44964AA8FCA0D1E96C556"><enum>(viii)</enum><text>identify performance
				standards for the quantity of oil or hazardous substance that will be removed
				under the response plan immediately following the discharge and at regular,
				identified periods, including provisions for reporting the degree to which
				actual removal meets the required performance standards;</text>
							</clause><clause id="id92E74D396DDC413D8BA473E7588DD868"><enum>(ix)</enum><text>in the case of oil
				production, drilling, and workover facilities, describe the specific measures
				to be used in response to a blowout or other event involving loss of well
				control;</text>
							</clause><clause id="idE41B50CC45BE4820A1152BA42660CB5E"><enum>(x)</enum><text>identify potential
				economic and ecological impacts of a worst-case discharge and response
				activities to prevent or mitigate, to the maximum extent practicable, those
				impacts in the event of a discharge;</text>
							</clause><clause id="id4A2C84BFE246416ABCEE6BA0D6F55B42"><enum>(xi)</enum><text>be updated periodically;
				and</text>
							</clause><clause id="IDa77e3e3ca6214abf9817b38f294523c1"><enum>(xii)</enum><text>be resubmitted for
				approval of each significant change.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idA57A0A6B6C9249FF8028561A02A96F2C"><enum>(3)</enum><text>in subparagraph (E), by
			 striking clauses (i) through (v) and inserting the following:</text>
					<quoted-block changed="added" committee-id="SSEV00" display-inline="no-display-inline" id="id80B1E195782245B197D2D465A9EB64BD" reported-display-style="italic" style="OLC">
						<clause id="id714B9F685A034801AAAD5AD4B0A4446B"><enum>(i)</enum><text>require notice of the
				proposed response plan to be published in the Federal Register and provide for
				a public comment period for the plan of at least 30 days;</text>
						</clause><clause id="idF96CD74BEA014F619138CCB30F81EC8A"><enum>(ii)</enum><text>promptly review the
				response plan;</text>
						</clause><clause id="ID82ce2d3be3074f8598cfcdf6c8826273"><enum>(iii)</enum><text>require amendments to
				any plan that does not meet the requirements of this paragraph;</text>
						</clause><clause id="ID34e2f35a865d40d09a6d0817b6261ed7"><enum>(iv)</enum><text>approve any plan only
				after finding, based on evidence in the record, that—</text>
							<subclause id="id0F2876FDCC014531BD449E521F7FB412"><enum>(I)</enum><text>the response plan meets
				the requirements of subparagraph (D);</text>
							</subclause><subclause id="idC594A26B0F884757B5E5693B2A7C4858"><enum>(II)</enum><text>there have been 1 or
				more field tests of the plan in the area in which the tank vessel, nontank
				vessel, or facility is proposed to operate, and the results of that field
				testing are publicly available;</text>
							</subclause><subclause id="id8D7D78CAE585461C976A57230CA71D0A"><enum>(III)</enum><text>the methods and
				equipment proposed to be used under the response plan are demonstrated to be
				technologically feasible in the area and under the conditions (including the
				depth of a well, in the case of an offshore facility) in which the tank vessel,
				nontank vessel, or facility is proposed to operate;</text>
							</subclause><subclause id="idFD980632A0A04D009EAE2D8FB77449C0"><enum>(IV)</enum><text>the available scientific
				information about the area allows for identification of potential impacts to
				ecological areas and protection of those areas in the event of a discharge,
				including adequate surveys of wildlife; and</text>
							</subclause><subclause id="idBEC33311327A4C229B3019C7ED18F9C0"><enum>(V)</enum><text>the response plan
				describes the quantity of oil likely to be removed in the event of a worst-case
				discharge;</text>
							</subclause></clause><clause id="id8763AC9FAAC542E9892DF96C72F243F7"><enum>(v)</enum><text>obtain the written
				concurrence of such other agencies as the President determines to be
				appropriate;</text>
						</clause><clause id="IDbaf93149612442afa7b956815781e1f5"><enum>(vi)</enum><text>review each plan
				periodically thereafter; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID8f87102063df415faaa77d1b75674296"><enum>(vii)</enum><text>in the case of a plan
				for a nontank vessel, consider any applicable State-mandated response plan in
				effect on August 9, 2004, and ensure consistency to the maximum extent
				practicable.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id6077886779B242958BCF23D89A2E8EBF"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 311(a)(24)(B) of the Federal Water
			 Pollution Control Act (33 U.S.C. 1321(a)(24)(B)) is amended by inserting
			 <quote>, including from an unanticipated and uncontrolled blowout or other loss
			 of well control,</quote> after <quote>foreseeable discharge</quote>.</text>
			</subsection></section><section changed="added" committee-id="SSEV00" id="id239440EC00C0440EB2C95C4AE669CFC5" reported-display-style="italic"><enum><added-phrase committee-id="SSEV00" reported-display-style="italic">5.</added-phrase></enum><header>Reports</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act and every 90 days thereafter until all claims resulting
			 from the blowout and explosion of the mobile offshore drilling unit
			 <italic>Deepwater Horizon</italic> that occurred April 20, 2010, and resulting
			 hydrocarbon releases into the environment, have been paid, the administrator of
			 the fund described in paragraph (1) shall submit to Congress a report that
			 describes—</text>
			<paragraph id="id187479A2EB4944ED9FDCA5588D3174A7"><enum>(1)</enum><text>the status of the
			 compensation fund established by British Petroleum Company to pay claims
			 resulting from the blowout and explosion; and</text>
			</paragraph><paragraph id="id765E822296564576B232C9492DF69F2F"><enum>(2)</enum><text><italic></italic>each
			 claim that has been paid from that fund.</text>
			</paragraph></section></legis-body><official-title-amendment>Amend the title so as to read:
	 <quote>A bill to amend the Oil Pollution Act of 1990 and the Federal Water
	 Pollution Control Act to require oil polluters to pay the full cost of oil
	 spills, and for other purposes.</quote>.</official-title-amendment>
