		<official-title>To amend the Fair Labor Standards Act of 1938 to require
		  persons to keep records of non-employees who perform labor or services for
		  remuneration and to provide a special penalty for persons who misclassify
		  employees as non-employees, and for other purposes.</official-title>

		<section id="H8C6CB9BC6BF9492C9C58A32195AC1745" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Employee Mis­clas­si­fi­ca­tion
			 Prevention Act</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H4DAF7725D9E34714AC8D9DBCCADCF5A1"><enum>2.</enum><header>Classification of
			 employees and non-employees</header>
			<subsection id="H75074709490146849F0644F97B5F00A4"><enum>(a)</enum><header>Recordkeeping
			 and notice requirements</header><text display-inline="yes-display-inline">Section 11(c) of the Fair Labor Standards
			 Act of 1938 (29 U.S.C. 211(c)) is amended—</text>
				<paragraph id="HE15CBC7DA08540AC9C281B1300AA78A2"><enum>(1)</enum><text>by striking
			 <quote>(c) Every employer subject to any provision of this Act or of any order
			 issued under this Act</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id74FF9A8850964F93BB8394B9B944B036" style="OLC">
						<subsection id="idEF81027E995A4557AF110A3820CECF6F"><enum>(c)</enum><header>Recordkeeping
				and notice requirements</header>
							<paragraph id="id8B3D1A0E4CD242DEAE4403C10707A4B7"><enum>(1)</enum><header>In
				general</header><text>Every person subject to any provision of this Act or of
				any order issued under this
				Act</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H634121F932B2464399E1241D89D72395"><enum>(2)</enum><text>by striking
			 <quote>of the persons employed by him</quote> and inserting the following:
			 “of—</text>
					<quoted-block display-inline="no-display-inline" id="idE99740A1F9B44CE795D66F2F9EBD63E4" style="OLC">
						<subparagraph id="idEA32897871BB4D21B6866FC2200AA6F9"><enum>(A)</enum><text>each individual
				employed by such
				person</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HF1B3B2356D764F75A45F9968D5E6DF82"><enum>(3)</enum><text>by striking
			 <quote>employment maintained by him, and shall</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="yes-display-inline" id="idC33EDE60E3ED43AC8B2FF0CF0DB4414E" style="OLC">
						<text>employment;</text><subparagraph id="ID0530228f74f4440287c516f53d5f90f5"><enum>(B)</enum><text>subject to
				paragraph (2), each individual—</text>
							<clause id="id58B313CD680B47B983D60D95291EC75E"><enum>(i)</enum><text>who is not an
				employee within the meaning given the term in section 3(e) (referred to in this
				subsection as a <term>non-employee</term>);</text>
							</clause><clause id="id16BA9B7E15E24FE7892D045AE73F6393"><enum>(ii)</enum><text>whom the person
				has engaged, in the course of the person's trade or business, for the
				performance of labor or services; and</text>
							</clause><clause id="id1A3F87A95A6B478E89003FA2F99CBC82"><enum>(iii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id35022EA619BC41A7BCBC301307CA8783"><enum>(I)</enum><text>with respect to whom
				the person is required to file an information return under section 6041A(a) of
				the Internal Revenue Code of 1986; or</text>
								</subclause><subclause id="IDb604261e00474618a91fd2323a766569" indent="up1"><enum>(II)</enum><text>who is providing labor or services to
				the person through an entity that is a trust, estate, partnership, association,
				company, or corporation (as such terms are used in section 7701(a)(1) of the
				Internal Revenue Code of 1986) if—</text>
									<item id="id400A312858BA495FABED7387BDD4349B"><enum>(aa)</enum><text>such individual has an ownership
				interest in the entity;</text>
									</item><item id="idC285E570A15A4C2CA544033E565CE06C"><enum>(bb)</enum><text>creation or maintenance of such
				entity is a condition for the provision of such labor or services to the
				person; and</text>
									</item><item id="id785D2F714FC5410B82A39C2680EB3AF6"><enum>(cc)</enum><text>the person would be required to file
				an information return for the entity under section 6041A(a) of the Internal
				Revenue Code of 1986 if the entity were an individual; and</text>
									</item></subclause></clause></subparagraph><subparagraph id="idAF7B210043DD4222B18B994ACF23DF7F"><enum>(C)</enum><text>the remuneration
				and hours relating to the performance of labor or services by each individual
				described in subparagraph (B); and</text>
						</subparagraph><subparagraph id="idDA60D94246D1445AA750549A96716D9D"><enum>(D)</enum><text>the notices
				required under paragraph (5),</text>
						</subparagraph><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">and
				shall</quoted-block-continuation-text><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HE08105CAF129480F8FDA02895F4C4CA0"><enum>(4)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H275AC8D2C8F646B29CA9350829E248D" style="USC">
						<paragraph id="id0915FF40086F4290B50526B36998B19A"><enum>(2)</enum><header>Recordkeeping
				limitation</header><text>A person otherwise subject to the requirements of
				paragraph (1) shall have no responsibility for making, keeping, or preserving
				records, including the records described in such paragraph and paragraph (4),
				concerning the employees of any individual described in paragraph (1)(B) or the
				non-employees with whom such individual has engaged for the performance of
				labor or services for such person, unless such records are provided during the
				course of the trade or business to the person.</text>
						</paragraph><paragraph commented="no" id="idB39706E650124B0BAD8BB8477FED34D3"><enum>(3)</enum><header>Presumption</header>
							<subparagraph commented="no" id="idFA6894992F5B470E85FF8DEEFCD47FB4"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">For purposes of this
				Act and the regulations or orders issued under this Act, an individual who is
				employed, or who is remunerated for the performance of labor or services, by a
				person, shall be presumed to be an employee of the person if—</text>
								<clause commented="no" id="idED0F39606E4E4851BB783C8744A6CD92"><enum>(i)</enum><text>the person has
				not made, kept, and preserved records in accordance with subparagraphs (B) and
				(C) of paragraph (1) regarding the individual; or</text>
								</clause><clause commented="no" id="idDE88F4D52D7C421B961CAF46F5C709B0"><enum>(ii)</enum><text>the person has
				not provided the individual with the notice required under paragraph
				(5).</text>
								</clause></subparagraph><subparagraph commented="no" id="id8D2C62A5A8144E418111378588178FBF"><enum>(B)</enum><header>Rebuttal</header><text>The
				presumption under subparagraph (A) shall be rebutted only through the
				presentation of clear and convincing evidence that an individual described in
				such subparagraph is not an employee (within the meaning of section 3(e)) of
				the person.</text>
							</subparagraph></paragraph><paragraph id="H88250AA3493145CABC572DF08E80D8E1"><enum>(4)</enum><header>Accurate
				classification</header><text display-inline="yes-display-inline">An accurate
				classification of the status of each individual described in paragraph (1) as
				either an employee (within the meaning of section 3(e)) of the person
				maintaining the records or a non-employee of such person shall be included
				within the records under this subsection.</text>
						</paragraph><paragraph id="H4275A9D6A5DF41989D8BC5C35051C813"><enum>(5)</enum><header>Notice</header>
							<subparagraph id="H417465CCDBD5450BAA5FD43657882C46"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">Every person subject
				to any provision of this Act or of any order issued under this Act shall
				provide the notice described in subparagraph (C) to each employee of the person
				and each individual classified by the person as a non-employee under paragraph
				(1)(B).</text>
							</subparagraph><subparagraph id="HE6831F654BBE4BBD899055F79D15C4B"><enum>(B)</enum><header>Timing of
				notice</header>
								<clause id="id2F431330DD3344A9987A03D1BD2629CA"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">Such notice shall be
				provided, at a minimum, not later than 6 months after the date of enactment of
				the <short-title>Employee Mis­clas­si­fi­ca­tion
				Prevention Act</short-title>, and thereafter—</text>
									<subclause id="idC4F4FFC5E494485E9D5D1AD1ED854B76"><enum>(I)</enum><text display-inline="yes-display-inline">for new employees, upon employment;
				and</text>
									</subclause><subclause id="id5D68E170CB4742E4AF9BD9CF422787AE"><enum>(II)</enum><text display-inline="yes-display-inline">for new non-employees who are classified
				under paragraph (1)(B), upon commencement of the labor or services described in
				such paragraph.</text>
									</subclause></clause><clause id="idB8955C4D70484FEFB46089DDCB3BEEDD"><enum>(ii)</enum><header>Change in
				status</header><text display-inline="yes-display-inline">Each person required
				to provide notice under subparagraph (A) to an individual shall also provide
				such notice to such individual upon changing such individual's status as an
				employee or non-employee under paragraph (1).</text>
								</clause></subparagraph><subparagraph id="H0A6DA6C55ABA48C79D9C45B398E7D0BE"><enum>(C)</enum><header>Contents of
				notice</header><text display-inline="yes-display-inline">The notice required
				under this paragraph shall be in writing and shall—</text>
								<clause id="H3631E0E0A60540268E977278DC4EC901"><enum>(i)</enum><text display-inline="yes-display-inline">inform the individual of the individual's
				classification, by the person submitting the notice, as an employee or a
				non-employee under paragraph (1);</text>
								</clause><clause id="H83E57DA1332D439DB7A606AB510602CF"><enum>(ii)</enum><text>include a
				statement directing such individual to a Department of Labor Web site
				established for the purpose of providing further information about the rights
				of employees under the law;</text>
								</clause><clause id="HBDED361E1AB9427F9107917D72BC47BB"><enum>(iii)</enum><text>include the
				address and telephone number for the applicable local office of the United
				States Department of Labor;</text>
								</clause><clause id="H6D1C9C8A037248C194EFB46091A0D01B"><enum>(iv)</enum><text display-inline="yes-display-inline">include for each individual classified as a
				non-employee under paragraph (1)(B) by the person submitting the notice, the
				following statement: <quote>Your rights to wage, hour, and other labor
				protections depend upon your proper classification as an employee or
				non-employee. If you have any questions or concerns about how you have been
				classified or suspect that you may have been misclassified, contact the U.S.
				Department of Labor.</quote>; and</text>
								</clause><clause id="H0E833751F3C74CF4BAD7AF5ECFB7BB97"><enum>(v)</enum><text display-inline="yes-display-inline">include such additional information as the
				Secretary shall prescribe by
				regulation.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA55DA293007347B9A5843F32DC597605"><enum>(b)</enum><header>Special
			 prohibited acts</header><text>Section 15(a) of the Fair Labor Standards Act of
			 1938 (29 U.S.C. 215(a)) is amended—</text>
				<paragraph id="id8BD660BF9B914E0DBE105FC9C4A23655"><enum>(1)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id0A76134175BA4F208FA263FABD82FB07" style="OLC">
						<paragraph id="ID04c8c8f26d224a788ec2ac6d85472319"><enum>(3)</enum><text>to discharge or
				in any other manner discriminate against any individual (including an employee)
				because such individual has—</text>
							<subparagraph id="id48B75A2744D8420C8FF5C1429D080F8E"><enum>(A)</enum><text>opposed any
				practice, or filed a petition or complaint or instituted or caused to be
				instituted any proceeding—</text>
								<clause id="idFD52B83774844612996F084A49CA93E7"><enum>(i)</enum><text>under or related
				to this Act (including concerning an individual's status as an employee or
				non-employee for purposes of this Act); or</text>
								</clause><clause id="idA49420474DD4430C8F5D2846401AC086"><enum>(ii)</enum><text>concerning an
				individual's status as an employee or non-employee for employment tax purposes
				within the meaning of subtitle C of the Internal Revenue Code of 1986;</text>
								</clause></subparagraph><subparagraph id="IDa4b0d97b95864ad2a1ee3f2fdc45c5ae"><enum>(B)</enum><text>testified or is
				about to testify in any proceeding described in subparagraph (A); or</text>
							</subparagraph><subparagraph id="id6493CE652DBF42668B697DFECA0C4550"><enum>(C)</enum><text>served, or is
				about to serve, on an industry
				committee;</text>
							</subparagraph></paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id732C6688EA43448A9FA252697A26EB3E"><enum>(2)</enum><text>in paragraph (5),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="id890E732608374831A912EB7161BF3590"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id34CCB4CA8B824191A82CB9CC50106D05" style="OLC">
						<paragraph id="H6D3973F1B8874688AB12742E9C602386"><enum>(6)</enum><text display-inline="yes-display-inline">to fail to accurately classify an
				individual as an
				employee.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H615C31DA2C1A415FBBBC6B8272F8A108"><enum>(c)</enum><header>Special penalty
			 for certain mis­clas­si­fi­ca­tion, recordkeeping, and notice
			 violations</header><text display-inline="yes-display-inline">Section 16 of the
			 Fair Labor Standards Act of 1938 (29 U.S.C. 216) is amended—</text>
				<paragraph id="H9EAA3C65647F47F3B8FFF3DDF1851A3"><enum>(1)</enum><text>in
			 subsection (b)—</text>
					<subparagraph id="id533072762D8D43BF9C2CCCE60A91581C"><enum>(A)</enum><text>in the sixth
			 sentence, by striking <quote>any employee</quote> each place the term occurs
			 and inserting <quote>any employee or individual</quote>;</text>
					</subparagraph><subparagraph id="id73538492EB024EE59269D6418ABBFE3A"><enum>(B)</enum><text>in the fourth
			 sentence, by striking <quote>employee</quote> and inserting <quote>employee or
			 individual</quote>;</text>
					</subparagraph><subparagraph id="HBCCE3D885ADE44E795748CC5BEC1FBC1"><enum>(C)</enum><text>in the third
			 sentence—</text>
						<clause id="id9A28504CF2BB4FDDBA63D9F5D5222EFF"><enum>(i)</enum><text>by
			 striking <quote>either of the preceding sentences</quote> and inserting
			 <quote>any of the preceding sentences</quote>;</text>
						</clause><clause id="idD3653E8BA73E4133ACCF3A7ECD1CFD94"><enum>(ii)</enum><text>by
			 striking <quote>one or more employees</quote> and inserting <quote>one or more
			 employees or individuals</quote>; and</text>
						</clause><clause id="id9F1C996B757746CBB1F2F7EB2F0A5B5B"><enum>(iii)</enum><text>by striking
			 <quote>other employees</quote> and inserting <quote>other employees or
			 individuals, respectively,</quote>; and</text>
						</clause></subparagraph><subparagraph id="H45693F8EB5F24EF29FDAF8E2AFE30000"><enum>(D)</enum><text>by inserting after
			 the first sentence the following: <quote>Such liquidated damages are doubled
			 (subject to section 11 of the Portal-to-Portal Pay Act of 1947 (29 U.S.C. 260))
			 where, in addition to violating the provisions of section 6 or 7, the employer
			 has violated the provisions of section 15(a)(6) with respect to such employee
			 or employees.</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBF00340A1A0D49AD967806E1DCE9A6DB"><enum>(2)</enum><text>in subsection
			 (e), by striking paragraph (2) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idB960B06117944A5C852F92F3020BE251" style="OLC">
						<paragraph id="id3274A473EBCD4AEB9CDB65F15DED48EC" indent="up1"><enum>(2)</enum><text>Any person who violates section 6, 7,
				11(c), or 15(a)(6) shall be subject to a civil penalty, for each employee or
				other individual who was the subject of such a violation, in an amount—</text>
							<subparagraph id="id7158D6EAAB5A46C88B01DE9807FEA092"><enum>(A)</enum><text>not to exceed $1,100; or</text>
							</subparagraph><subparagraph id="id2C60626AA9044950A0C709CE3F943C95"><enum>(B)</enum><text>in the case of a person who has
				repeatedly or willfully committed such violation, not to exceed
				$5,000.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H34B9201CA9404AECB71F5164AFBDA468"><enum>(d)</enum><header>Employee rights
			 web site</header>
				<paragraph id="id202FDD40D56C4AC7AC4F78C2269ED870"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of enactment of this Act, the Secretary of Labor shall
			 establish, for purposes of section 11(c)(5)(C)(ii) of the Fair Labor Standards
			 Act of 1938 (as added by this Act), a single web page on the Department of
			 Labor Web site that summarizes in plain language the rights of employees as
			 described in the amendments made by subsection (a) and other information
			 considered appropriate by the Secretary, including appropriate links to
			 additional information on the Department of Labor Web site or other Federal
			 agency Web sites. In addition, such web page—</text>
					<subparagraph id="idC5B57B9CB162415EA0D306E4F9D10DAB"><enum>(A)</enum><text display-inline="yes-display-inline">shall include a statement explaining that
			 employees may have additional or greater rights under State or local laws and
			 how employees may obtain additional information about their rights under State
			 or local laws;</text>
					</subparagraph><subparagraph id="idBF3945DFC8F842C18B9F2048069C2023"><enum>(B)</enum><text display-inline="yes-display-inline">shall be made available in English and any
			 other languages that the Secretary determines to be prevalent among individuals
			 likely to access the web page; and</text>
					</subparagraph><subparagraph id="id5627F5EDB5504EC6AAE3B48AA77DB63A"><enum>(C)</enum><text display-inline="yes-display-inline">may provide a link to permit individuals to
			 file complaints online.</text>
					</subparagraph></paragraph><paragraph id="idFBA849934D8B4808896D6DCBA12845BC"><enum>(2)</enum><header>Coordination
			 with other Federal web sites</header><text display-inline="yes-display-inline">The Secretary shall coordinate with other
			 relevant Federal agencies in order to provide information similar to the
			 information described in paragraph (1) (or a link to the Department of Labor
			 web page required by this subsection) on the Web sites of such other
			 agencies.</text>
				</paragraph></subsection></section><section commented="no" id="HEDF9DC16F80343D4B7C34F008C33967F" section-type="subsequent-section"><enum>3.</enum><header>Misclassification of
			 employees for unemployment compensation purposes</header>
			<subsection commented="no" id="H8AA4579D91DD481B00588CE73C265EF1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 303(a) of the
			 Social Security Act (42 U.S.C. 503(a)) is amended—</text>
				<paragraph commented="no" id="H463BA1CF48C04AF8B5621700036769B2"><enum>(1)</enum><text>in paragraph (10),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</paragraph><paragraph commented="no" id="H4FA5982813044C5FA4A09B1DD5A4F570"><enum>(2)</enum><text>by adding after
			 paragraph (10) the following:</text>
					<quoted-block display-inline="no-display-inline" id="H01E1C7A11F0241398C30C1C14EF18717" style="traditional">
						<paragraph commented="no" id="HA01DFA53F888411993319382DDC0DAD9"><enum>(11)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HFF48896033FE44849766DA8D95D29509"><enum>(A)</enum><text display-inline="yes-display-inline">Such auditing and investigative procedures
				as may be necessary to identify employers that have not registered under the
				State law or that are paying unreported wages, where these actions or omissions
				by the employers have the effect of excluding employees from unemployment
				compensation coverage; and</text>
							</subparagraph><subparagraph id="HD92A80C3F8434E3790E992E983C91113" indent="up1"><enum>(B)</enum><text>The making of quarterly reports to the
				Secretary of Labor (in such form as the Secretary of Labor may require)
				describing the results of the procedures under subparagraph (A); and</text>
							</subparagraph></paragraph><paragraph id="HEEEA339EC88345439160C2A3DED1D578"><enum>(12)</enum><text>The establishment
				of administrative penalties for misclassifying employees, or paying unreported
				wages to employees without proper recordkeeping, for unemployment compensation
				purposes.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HBD1F5CA9ACA84010BE0407DC8342FD25"><enum>(b)</enum><header>Review of
			 auditing programs</header><text>The Secretary of Labor shall include, in the
			 Department of Labor’s system for measuring States’ performance in conducting
			 unemployment compensation tax audits, a specific measure of their effectiveness
			 in identifying the underreporting of wages and the underpayment of unemployment
			 compensation contributions (including their effectiveness in identifying
			 instances of such underreporting or underpayments despite the absence of
			 cancelled checks, original time sheets, or other similar documentation).</text>
			</subsection><subsection commented="no" id="H0504B69F363F421CB028E1A1D55E78F7"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph commented="no" id="HFAD05AA5D7B64154A538C781113B71FD"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 paragraph (2), the amendments made by subsection (a) shall take effect 12
			 months after the date of the enactment of this Act.</text>
				</paragraph><paragraph commented="no" id="H7FB1DCD60DEB4D85008C96085E4C9D5B"><enum>(2)</enum><header>Exception</header><text>If
			 the Secretary of Labor finds that legislation is necessary in order for the
			 unemployment compensation law of a State to comply with the amendments made by
			 subsection (a), such amendments shall not apply with respect to such law until
			 the later of—</text>
					<subparagraph commented="no" id="HA0F11A55DCE84C56903C3FFDE05CD461"><enum>(A)</enum><text>the day after the
			 close of the first regular session of the legislature of such State which
			 begins after the date of the enactment of this Act; or</text>
					</subparagraph><subparagraph commented="no" id="H2AE94868FB2049ACBA2D8D8323D533DE"><enum>(B)</enum><text>12 months after
			 the date of the enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" id="HEA9A4419FE984E0EBA02007700862910"><enum>(d)</enum><header>Definition of
			 State</header><text>For purposes of this section, the term <term>State</term>
			 has the meaning given such term by section 3306(j) of the Internal Revenue Code
			 of 1986.</text>
			</subsection></section><section commented="no" id="H43BFEAE000A943DAAE153DC67CB3D83E"><enum>4.</enum><header>Department of
			 Labor coordination, referral, and regulations</header>
			<subsection commented="no" id="idAD8305D0831E45DC9DC1D00BC6AE66BF"><enum>(a)</enum><header>Coordination
			 and referral</header><text display-inline="yes-display-inline">Notwithstanding
			 any other provision of law, any office, administration, or division of the
			 Department of Labor that, while in the performance of its official duties,
			 obtains information regarding the misclassification by a person subject to the
			 provisions of the Fair Labor Standards Act of 1938 (29 U.S.C. 201 et seq.) or
			 any order issued under such Act of any individual regarding whether such
			 individual is an employee or a non-employee contracted for the performance of
			 labor or services for purposes of section 6 or 7 of such Act (29 U.S.C. 206,
			 207) or in records required under section 11(c) of such Act (29 U.S.C. 211(c)),
			 shall report such information to the Wage and Hour Division of the Department.
			 The Wage and Hour Division may report such information to the Internal Revenue
			 Service as the Division considers appropriate.</text>
			</subsection><subsection commented="no" id="idD31EC14751824D698651DAE7BA7F8DFA"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Secretary of Labor shall promulgate
			 regulations to carry out this Act and the amendments made by this Act.</text>
			</subsection></section><section id="H5AE7300EE2E9474385A272B453A0E78D"><enum>5.</enum><header>Targeted
			 audits</header><text display-inline="no-display-inline">The audits of employers
			 subject to the Fair Labor Standards Act of 1938 (29 U.S.C. 201 et seq.) that
			 are conducted by the Wage and Hour Division of the Department of Labor shall
			 include certain industries with frequent incidence of misclassifying employees
			 as non-employees, as determined by the Secretary of Labor.</text>
