		  Secretary of Energy to barter, transfer, or sell surplus uranium from the

		<section id="id73F7E40313F5480C98FC9C711E12623D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Surplus Uranium Disposition Act of
			 2010</short-title></quote>.</text>
		</section><section id="id99F11C7BCB7C4671A1E3CB5C55EADC41"><enum>2.</enum><header>Barter,
			 transfer, or sale of surplus uranium</header>
			<subsection id="id409B90E387574E1B81F5516370F785A3"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 14 of title I
			 of the Atomic Energy Act of 1954 (42 U.S.C. 2201 et seq.) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id23D53F85E3494303A5F2D2DAA1D05F56" style="OLC">
					<section id="idF29004E29C284AD6B06B59A50969D36C"><enum>170J.</enum><header>Barter,
				transfer, or sale of surplus uranium</header>
						<subsection id="ID3868daefcfb0439faa3eabb02448c1be"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="id2255BB439DD64D5C9695300B05C9690D"><enum>(1)</enum><header>Commission</header><text>The
				term <term>Commission</term> means the Nuclear Regulatory Commission.</text>
							</paragraph><paragraph id="idCE356AADBCB04445805DF324EF06C211"><enum>(2)</enum><header>Department</header><text>The
				term <term>Department</term> means the Department of Energy.</text>
							</paragraph><paragraph id="ID8d94732b4c554734aaa2c9704ebbc41a"><enum>(3)</enum><header>Initial
				core</header><text>The term <term>initial core</term> means the quantity of
				uranium required to fuel the first operating cycle of a newly constructed
				nuclear reactor located in the United States.</text>
							</paragraph><paragraph id="id12810B5413C643CB915559E848843CA8"><enum>(4)</enum><header>Long-term
				contract</header><text>The term <term>long-term contract</term> means a
				contract—</text>
								<subparagraph id="idF35C1B525E234971865540CE8B91CC5C"><enum>(A)</enum><text>entered into
				under subsection (e); and</text>
								</subparagraph><subparagraph id="id46A39832064143DE92BF450100AC2AA7"><enum>(B)</enum><text>the duration of
				which is not less than 3 years.</text>
								</subparagraph></paragraph><paragraph id="ID748ca9f0407c4ab3ba0727f77dbdc148"><enum>(5)</enum><header>Reserve
				inventory</header><text>The term <term>reserve inventory</term> means the
				quantity of the excess uranium stockpile of the Department, the barter, sale,
				or transfer of which is prohibited except in the case of a national energy
				emergency, as declared by the President under subsection (l)(2).</text>
							</paragraph><paragraph id="id940F8482710641CBB513BA806A875153"><enum>(6)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Energy.</text>
							</paragraph><paragraph id="id7421B925EEE74F8092AB7C57D4CE116B"><enum>(7)</enum><header>Uranium</header><text>The
				term <term>uranium</term> means any form of surplus uranium from the inventory
				of the Department. Any reference in this section to a quantity of uranium means
				a quantity of natural uranium (uranium containing 0.711 percent U–235) or its
				equivalent.</text>
							</paragraph></subsection><subsection id="IDb13c678b511d4a0fbcec56aa34ceb486"><enum>(b)</enum><header>Authority of
				Secretary</header><text>As soon as practicable after the date of enactment of
				this section, the Secretary may barter, transfer, or sell to eligible entities,
				at fair market value, uranium in accordance with this section.</text>
						</subsection><subsection id="idAA57676757D94857815B91A99EA483FE"><enum>(c)</enum><header>Eligible
				entities</header>
							<paragraph id="idA76EB270C52B412998469E52489E62FB"><enum>(1)</enum><header>Barters,
				transfers, or sales for initial cores</header><text>To be eligible to obtain
				uranium under subsection (d)—</text>
								<subparagraph id="id552FB0E54D9943648AC81F55293C1CD6"><enum>(A)</enum><text>an eligible
				entity shall have submitted to the Commission an application for a combined
				operating license for a reactor; and</text>
								</subparagraph><subparagraph id="id0F210F91059D4956A2639A32456B873E"><enum>(B)</enum><text>the Commission
				shall have approved, or agreed to review, the application.</text>
								</subparagraph></paragraph><paragraph id="id622D8825F1484BCD9222FDB0F0828DFE"><enum>(2)</enum><header>Additional
				barters, transfers, or sales</header><text>To be eligible to obtain uranium
				under subsection (e), an eligible entity shall possess a license from the
				Commission.</text>
							</paragraph></subsection><subsection id="ID008221ea55d64b558a6636e696aa08a4"><enum>(d)</enum><header>Barters,
				transfers, or sales for initial cores</header><text>The Secretary shall offer
				to barter, transfer, or sell to eligible entities, on a first-come,
				first-served basis and at fair market value, 20,000,000 pounds of uranium for
				initial cores for projects to build new reactors.</text>
						</subsection><subsection id="IDfe0041e9f9bb4564b1330d95131566a0"><enum>(e)</enum><header>Additional
				barters, transfers, or sales</header><text>In addition to initial core barters,
				transfers, or sales under subsection (d), the Secretary may barter, transfer,
				or sell to eligible entities, on a first-come, first-served basis and at fair
				market value, uranium in accordance with the following schedule:</text>

							</table>
						</subsection><subsection id="ID90b5d131c34e470a8ef350c216caf9d8"><enum>(f)</enum><header>Transparency
				and competitive procedures</header><text>In making barters, transfers, or sales
				of uranium to eligible entities under this section, the Secretary shall ensure,
				to the maximum extent practicable, that—</text>
							<paragraph id="idF7E6CAC8CE8A4C06843AD644BB55E940"><enum>(1)</enum><text>the United States
				receives the fair market value for any uranium bartered, transferred, or sold
				to the entities; and</text>
							</paragraph><paragraph id="id4D1A7C20DFEF4068B98D79C972A30A64"><enum>(2)</enum><text>any barter,
				transfer, or sale under this section is conducted in a transparent and
				competitive manner.</text>
							</paragraph></subsection><subsection id="idE65CB3CDD9C141D386D27D934F0EFE14"><enum>(g)</enum><header>Sale of
				bartered or transferred uranium</header><text>If the Secretary barters or
				transfers uranium under this section, any uranium sold by the recipient shall
				be—</text>
							<paragraph id="id3F9ACFBB1C03479EAFFC575F7AE15678"><enum>(1)</enum><text>sold at fair
				market value; and</text>
							</paragraph><paragraph id="idC4AE278D41524763990DFB41A952B39B"><enum>(2)</enum><text>considered part
				of the annual sales quantity of the Department for the year bartered or
				transferred.</text>
							</paragraph></subsection><subsection id="ID5e50383a1bb9409c8e8a4764b25046f2"><enum>(h)</enum><header>Dissemination
				requirement</header><text>Not later than 14 days before the date on which the
				Secretary barters, transfers, or sells to an eligible entity any uranium under
				this section, the Secretary shall publish in the Federal Register, with respect
				to the barter, transfer, or sale, the determination required by the Secretary
				under section 3112(e)(2) of the USEC Privatization Act (42 U.S.C.
				2297h–10(e)(2)).</text>
						</subsection><subsection id="ID1678b13e97c24eb183c66f40579d95ae"><enum>(i)</enum><header>Other
				programs</header>
							<paragraph id="IDd35781daedb241a1bff5e9fb41c1637d"><enum>(1)</enum><header>Compliance</header><text>In
				carrying out this section, the Secretary shall comply with—</text>
								<subparagraph id="ID55e9745fdaa54368a15f83c740e23202"><enum>(A)</enum><text>the National
				Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.);</text>
								</subparagraph><subparagraph id="ID5e54269fc6dd46749e5dc0fa536c302d"><enum>(B)</enum><text>section 3112 of
				the USEC Privatization Act (42 U.S.C. 2297h–10); and</text>
								</subparagraph><subparagraph id="IDedc028cea82047628d72f34643acde78"><enum>(C)</enum><text>other applicable
				provisions of law (including regulations).</text>
								</subparagraph></paragraph><paragraph id="ID15466283401c433db7d9d8ba7104b855"><enum>(2)</enum><header>Use of
				proceeds</header><text>No funds or other value obtained from the barter,
				transfer, or sale of uranium under this section may be used to carry out other
				programs of the Department without a specific appropriation by Congress.</text>
							</paragraph></subsection><subsection id="IDf78e62b03be8425ea7b09d4287902e0e"><enum>(j)</enum><header>Schedule</header><text>The
				Secretary shall ensure that long-term contracts cover not less than 50 percent
				of the quantity of uranium bartered, transferred, or sold under this section
				during each calendar year.</text>
						</subsection><subsection id="ID2edc41b8400f48d3b1c747ab1313e540"><enum>(k)</enum><header>Department
				needs</header><text>Notwithstanding any other provision of this section, the
				Secretary shall maintain a sufficient inventory of uranium to meet the current
				and foreseeable needs of the missions and programs of the Department, including
				missions and programs of—</text>
							<paragraph id="ID50a2dc29802c4096930549e7845d82b2"><enum>(1)</enum><text>the National
				Nuclear Security Agency;</text>
							</paragraph><paragraph id="IDd6c545a664844c9ea53a434b19f45cd3"><enum>(2)</enum><text>the Office of
				Nuclear Energy, Science, and Technology Programs;</text>
							</paragraph><paragraph id="ID0667bf8dbd8343cc9afb569d2ececf65"><enum>(3)</enum><text>the Office of the
				Assistant Secretary for Environmental Management; and</text>
							</paragraph><paragraph id="ID0fe7de7e5959475fb9c38c7e743668f5"><enum>(4)</enum><text>other agencies of
				the Department, as determined by the Secretary.</text>
							</paragraph></subsection><subsection id="ID32b31222752143738f1897222b3ffc83"><enum>(l)</enum><header>Reserve
				inventory</header>
							<paragraph id="ID11fa2c6acfe743419f63cfaf6b3ddc25"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall maintain a reserve inventory of
				uranium that contains not less than 20,000,000 pounds of uranium.</text>
							</paragraph><paragraph id="ID998626a8ac4a4beeab018f6cab28a36c"><enum>(2)</enum><header>National energy
				emergency</header><text>The Secretary shall release uranium from the reserve
				inventory only in the case of a national energy emergency declared by the
				President.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id6853B3FEB2224B5481462CFE06440FEA"><enum>(b)</enum><header>Technical
			 amendment</header><text>Section 11 f. of the Atomic Energy Act of 1954 (42
			 U.S.C. 2014(f)) is amended by striking <quote>Atomic Energy Commission</quote>
			 and inserting <quote>Nuclear Regulatory Commission</quote>.</text>
