		<section id="H7995908E054D4CE69EA9F9546203A5D7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>TRICARE Dependent Coverage Extension
			 Act</short-title></quote>.</text>
		</section><section id="H1CDAF9C97B03461094DFBBB132D5FD0B" section-type="subsequent-section"><enum>2.</enum><header>Extension of dependent
			 coverage under TRICARE</header>
			<subsection id="H9AEA4B2BCA4246B0BBB4D0C5DFB64244"><enum>(a)</enum><header>Dependent
			 coverage</header>
				<paragraph id="HA02B4C01FEDE44479E1C537A0389A8D2"><enum>(1)</enum><header>In
			 general</header><text>Chapter 55 of title 10, United States Code, is amended by
			 adding at the end the following new section:</text>
					<quoted-block display-inline="no-display-inline" id="H155828ABC6F14ABC94C2BEB15B4F015C" style="USC">
						<section id="H789119F72E614193A815F28CD192E7E6"><enum>1110b.</enum><header>TRICARE
				program: extension of dependent coverage</header>
							<subsection id="HA378A55FD9804F8B8C84A85AEB66E3E1"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">In accordance with
				subsection (c), an individual described in subsection (b) shall be deemed to be
				a dependent (as described in section 1072(2)(D) of this title) for purposes of
				TRICARE coverage.</text>
							</subsection><subsection id="H107207F6F44F4CD69C02984BC10E0868"><enum>(b)</enum><header>Individual
				described</header><text>An individual described in this subsection is an
				individual who—</text>
								<paragraph id="H4C137F137D754B8D951343E447D192E9"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to a member or former member
				of a uniformed service, is—</text>
									<subparagraph id="HE38B601D9D9946AD8764105F9085C5F0"><enum>(A)</enum><text>a child who has
				not attained the age of 26 and is not eligible to enroll in an eligible
				employer-sponsored plan (as defined in section 5000A(f)(2) of the Internal
				Revenue Code of 1986); or</text>
									</subparagraph><subparagraph id="H193AB28570D34E29A4881E598CA29D5E"><enum>(B)</enum><text display-inline="yes-display-inline">a person who—</text>
										<clause id="HE5C6B12D2CAB42F4ADD756E6450E5DF4"><enum>(i)</enum><text display-inline="yes-display-inline">is placed in the legal custody of the
				member or former member as a result of an order of a court of competent
				jurisdiction in the United States (or possession of the United States) for a
				period of at least 12 consecutive months;</text>
										</clause><clause id="H70FE7B39989742F98B2E6A8F556919A3"><enum>(ii)</enum><text display-inline="yes-display-inline">has not attained the age of 26;</text>
										</clause><clause id="H791FC69FFCAC4200BCAA4E91196A5AD7"><enum>(iii)</enum><text>is not eligible
				to enroll in an eligible employer-sponsored plan (as defined in section
				5000A(f)(2) of the Internal Revenue Code of 1986);</text>
										</clause><clause id="HA86EBADED3254DEFA1767755824DE6F6"><enum>(iv)</enum><text display-inline="yes-display-inline">resides with the member or former member
				unless separated by the necessity of military service or to receive
				institutional care as a result of disability or incapacitation or under such
				other circumstances as the administering Secretary may by regulation
				prescribe;</text>
										</clause><clause id="H5FF2AF9D9E0244BF994EAA08A33A98DD"><enum>(v)</enum><text>is
				not otherwise a dependent of a member or a former member under any subparagraph
				of section 1072(2) of this title; and</text>
										</clause><clause id="H10DA2F89235B4543A8CB0E18EA032B7D"><enum>(vi)</enum><text display-inline="yes-display-inline">is not the child of a dependent who is
				described in subparagraph (D) or (I) of section 1072(2) of this title and is a
				covered beneficiary; and</text>
										</clause></subparagraph></paragraph><paragraph id="H7916CC92E05C4ED18C2052300FC0A78E"><enum>(2)</enum><text>meets other
				criteria specified in regulations prescribed by the administering
				Secretary.</text>
								</paragraph></subsection><subsection id="HCCF169602DF04B46B79AA54EFA905EAB"><enum>(c)</enum><header>Premium</header><paragraph commented="no" display-inline="yes-display-inline" id="HE7AE0B6094B6401384DFF3871BF3C7F1"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall prescribe by
				regulation a premium for TRICARE coverage provided pursuant to this section to
				an individual described in subsection (b). The premium shall apply uniformly to
				all individuals covered by the coverage.</text>
								</paragraph><paragraph id="HA990A9E8C16147248012E8242A72E6ED" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The monthly amount of the premium in effect
				for a month for TRICARE coverage pursuant to this section shall be an amount
				not to exceed the cost of coverage that the Secretary determines on an
				appropriate actuarial basis.</text>
								</paragraph><paragraph id="HBD0D2A7B06FF40F4915F99E54AC0E0BC" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall prescribe the
				requirements and procedures applicable to the payment of premiums under this
				subsection.</text>
								</paragraph><paragraph id="H234C676874A84F7DB89B90F12F90A197" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Amounts collected as premiums under this
				subsection shall be credited to the appropriation available for the Defense
				Health Program Account under section 1100 of this title, shall be merged with
				sums in such Account that are available for the fiscal year in which collected,
				and shall be available under subsection (b) of such section for such fiscal
				year.</text>
								</paragraph></subsection><subsection id="HC3F2DBD6C5EC41249DD41CD61A9699DE"><enum>(d)</enum><header>TRICARE coverage
				defined</header><text display-inline="yes-display-inline">In this section, the
				term <term>TRICARE coverage</term> means health care to which a dependent
				described in section 1072(2)(D) of this title is entitled under section 1076d,
				1076e, 1079, 1086, or 1097 of this
				title.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HB205B9D794AF4331ACE02E11C11A2BC2"><enum>(2)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 55 of such title is amended by inserting
			 after the item relating to section 1110a the following new item:</text>

						</toc>
						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H68F1B5D975374BE7814EC3D7FD8FEB98"><enum>(b)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 1086(c) of title 10, United States Code, is amended by inserting after
			 <quote>of this title</quote> the following: <quote>(or an individual described
			 in section 1110b(b) of this title who meets the requirements for a dependent
			 under paragraph (1) or (2) of such section 1076(b))</quote>.</text>
			</subsection><subsection id="H01C92AE2F0494660A695AEB572878D6F"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 October 1, 2010.</text>
