		<official-title>To amend title 38, United States Code, to provide for the
		  tolling of the timing of review for appeals of final decisions of the Board of
		  Veterans' Appeals, and for other purposes.</official-title>

		<section id="idB1D6632DAACB41D08CAC9525AA919103" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fair Access to Veterans Benefits Act
			 of 2010</short-title></quote>.</text>
		</section><section id="id998A0AABD6AB4CA1B8E52B7782E4DF6A" section-type="subsequent-section"><enum>2.</enum><header>Tolling of timing of
			 review for appeals of final decisions of Board of Veterans' Appeals</header>
			<subsection id="idC059118CEFFC4327BA187E598191DE43"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 7266(a) of
			 title 38, United States Code, is amended—</text>
				<paragraph id="id4D6CF9F993F44A059CD1AF66E6715B24"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>In order</quote> and
			 inserting <quote>(1) Except as provided in paragraph (2), in order</quote>;
			 and</text>
				</paragraph><paragraph id="id5961A0E799B641FEA092E493DE4A855A"><enum>(2)</enum><text>by adding at the
			 end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id2418D68AA33748BDB42C641115390D88" style="OLC">
						<paragraph id="id0CBDB845A992451A91DEC0D46F435F0B" indent="up1"><enum>(2)</enum><text>The 120-day period described in
				paragraph (1) shall be extended upon a showing of good cause for such time as
				justice may
				require.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id03825090190545CEAF37B8F8FACE815C"><enum>(b)</enum><header>Applicability</header>
				<paragraph id="id3142B811C0C240ADB0E9598E57DFFD49"><enum>(1)</enum><header>In
			 general</header><text>Paragraph (2) of section 7266(a) of such title, as added
			 by subsection (a), shall apply to a notice of appeal filed with respect to a
			 final decision of the Board of Veterans' Appeals that was issued on or after
			 July 24, 2008.</text>
				</paragraph><paragraph id="id2F3609238C1C4010924ABDB32BABE40C"><enum>(2)</enum><header>Reinstatement</header><text>Any
			 petition for review filed with the Court of Appeals for Veterans Claims that
			 was dismissed by such Court on or after July 24, 2008, as untimely, shall, upon
			 the filing of a petition by an adversely affected person filed not later than
			 six months after the date of the enactment of this Act, be reinstated upon a
			 showing that the petitioner had good cause for filing the petition on the date
			 it was filed.</text>
