		<official-title>To amend title 49, United States Code, to allow for
		  additional transportation assistance grants. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Expansion of transit
			 operating assistance grant program</header><text display-inline="no-display-inline">Section 5307(b) of title 49, United States
			 Code, is amended—</text>
			<paragraph id="ID4f2a358970f44c3fbd3a6ec16dd775b9"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph id="ID301e4db07b2248b7ae40d6258209dc85"><enum>(A)</enum><text>in subparagraph
			 (D), by striking <quote>of less than 200,000</quote> and inserting “of—</text>
					<quoted-block display-inline="no-display-inline" id="id545D0AEEC6A84695A81565EE87611F2E" style="OLC">
						<clause id="id2211E67EDD104B0A8B2860F33235B71F"><enum>(i)</enum><text>less than
				200,000;</text>
						</clause><clause id="IDc4f0e7aff0a8413cbdfe2a4d735168d1"><enum>(ii)</enum><text>not less than
				200,000, and less than 400,000, if the State or regional authority providing
				public transportation for the area operates at least 100 buses in fixed-route
				service in the area during peak service hours;</text>
						</clause><clause id="ID277e4007f7f444889d29d05be979a174"><enum>(iii)</enum><text>not less than
				400,000, and less than 600,000, if the State or regional authority providing
				public transportation for the area operates at least 100 buses in fixed-route
				service in the area during peak service hours;</text>
						</clause><clause id="ID206087cd29934efd80d987f1b85d926d"><enum>(iv)</enum><text>not less than
				600,000, and less than 800,000, if the State or regional authority providing
				public transportation for the area operates at least 100 buses in fixed-route
				service in the area during peak service hours;</text>
						</clause><clause id="IDaa0763bfbe8c41c8b6567ea1b59ddc40"><enum>(v)</enum><text>not less than
				800,000, and less than 1,000,000, if the State or regional authority providing
				public transportation for the area operates at least 100 buses in fixed-route
				service in the area during peak service hours; and</text>
						</clause><clause id="ID319a14a9e88c4cf4acf1ccb58eab90ae"><enum>(vi)</enum><text>not less than
				1,000,000, if the State or regional authority providing public transportation
				for the area operates at least 100 buses in fixed-route service in the area
				during peak service
				hours;</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" id="id1BEAF68E9B7F4240A46E4E070520D543"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph commented="no" id="id0321D922DD734D5686AF89DDD5F539D3"><enum>(A)</enum><text>by striking
			 subparagraphs (B) through (D); and</text>
				</subparagraph><subparagraph commented="no" id="id54D251EA38B94445AF9BB8CA41BD795E"><enum>(B)</enum><text>by redesignating
			 subparagraph (E) as subparagraph (B);</text>
				</subparagraph></paragraph><paragraph commented="no" id="idA605D7386E4B451B979895EF8B571083"><enum>(3)</enum><text>by redesignating
			 paragraph (3) as paragraph (6); and</text>
			</paragraph><paragraph id="id761C035A2B3347FDB98F3705AA21F5C9"><enum>(4)</enum><text>by inserting
			 after paragraph (2) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB2897D54A3194B02ADBA07A09C293F1F" style="OLC">
					<paragraph id="ID4de1d831b593454bb3d04589fce0b62f"><enum>(3)</enum><header>Limitations on
				use of funds</header><text>A designated recipient may use—</text>
						<subparagraph id="ID36ae2ced85a04da7ae3bb53030def476"><enum>(A)</enum><text>not more than 50
				percent of the funds made available to the designated recipient under this
				section for activities described in paragraph (2)(D)(iii);</text>
						</subparagraph><subparagraph id="ID1f564855669f45028a655c9ad90610ef"><enum>(B)</enum><text>not more than 45
				percent of the funds made available to the designated recipient under this
				section for activities described in paragraph (2)(D)(iv);</text>
						</subparagraph><subparagraph id="ID3e4914516748441797e42a7b48b661ff"><enum>(C)</enum><text>not more than 40
				percent of the funds made available to the designated recipient under this
				section for activities described in paragraph (2)(D)(v);</text>
						</subparagraph><subparagraph id="ID1ff617d29edc4398b2f661883fd83828"><enum>(D)</enum><text>not more than 35
				percent of the funds made available to the designated recipient under this
				section for activities described in paragraph (2)(D)(vi); and</text>
						</subparagraph><subparagraph id="IDa1af99c6d4154139bcdfbce198eba717"><enum>(E)</enum><text>not more than 30
				percent of the funds made available to the designated recipient under this
				section for activities described in paragraph (2)(D)(vii).</text>
						</subparagraph></paragraph><paragraph id="IDc339da8ecac94f70868d5f9506ae9d7f"><enum>(4)</enum><header>Conditional use
				of funds in an urbanized area with a population of at least 200,000</header>
						<subparagraph id="idC964757BA7F34B648BB67635FFD4B2B7"><enum>(A)</enum><header>In
				general</header><text>For each of fiscal years 2010 through 2015 and subject to
				subparagraph (B), a designated recipient may use a percentage of the funds made
				available to the designated recipient under this section, in addition to the
				percentage described in paragraph (3), to finance the operating costs of
				equipment and facilities for use in public transportation in an urbanized area
				with a population of not less than 200,000.</text>
						</subparagraph><subparagraph id="id484EAB0C654747668EBD052EE4CDBEE2"><enum>(B)</enum><header>Operating
				cost</header><text>To be eligible under subparagraph (A), the designated
				recipient's percentage of revenue for the operating cost of equipment and
				facilities for use in public transportation from non-Federal sources (excluding
				farebox revenue) must be greater than such revenue from the previous fiscal
				year.</text>
						</subparagraph><subparagraph id="id98C20FE8C68D4FFE81898B0D28F49516"><enum>(C)</enum><header>Limitation</header><text>The
				amount available for a grant under this paragraph shall not exceed the
				percentage of such increase.</text>
						</subparagraph></paragraph><paragraph id="ID5992efe03ec9439ca45171de12873efb"><enum>(5)</enum><header>TIGGER
				grant</header>
						<subparagraph id="id6BF03EF010AB45D5812C089D10576DF3"><enum>(A)</enum><header>In
				general</header><text>In addition to any other grant under this section, the
				Secretary may award a grant, from any funds that may be made available to carry
				out this section for each of fiscal years 2010 through 2015, to a designated
				recipient for the operating cost of equipment and facilities for use in public
				transportation in an urbanized area with a population of 200,000 or more, if
				the designated recipient—</text>
							<clause id="idEC3CD64CF0304643844B2288F85F02ED"><enum>(i)</enum><text>was awarded a
				grant under the Transit Investments for Greenhouse Gas and Energy Reduction
				program, established under the ninth proviso under the heading
				<quote><header-in-text level="appropriations-small" style="OLC">Transit capital
				assistance</header-in-text></quote> under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Federal Transit
				Administration</header-in-text></quote> under the heading
				<quote><header-in-text level="appropriations-major" style="OLC">Department of
				Transportation</header-in-text></quote> of title XII of division A of the
				American Recovery and Reinvestment Act of 2009 (Public Law 111–105; 123 Stat.
				210); and</text>
							</clause><clause id="id45F55DE66BC647AFA857767B6AD3D2D2"><enum>(ii)</enum><text>demonstrates
				that the designated recipient has achieved—</text>
								<subclause id="IDa4eab58c5ab14ef7b670678ccecb6b66"><enum>(I)</enum><text>total energy
				savings of not less than 10 percent, as a result of a project funded using a
				grant under the Transit Investments for Greenhouse Gas and Energy Reduction
				program;</text>
								</subclause><subclause id="ID446c4e88eaed4b4db20c9747f7b3193b"><enum>(II)</enum><text>energy savings
				of not less than 10 percent, as a percentage of the total energy usage of the
				public transit agency, as a result of a project funded using a grant under the
				Transit Investments for Greenhouse Gas and Energy Reduction program; or</text>
								</subclause><subclause id="ID60ddcb7947fa4dd8beb2bd0035b98306"><enum>(III)</enum><text>total
				greenhouse gas emission reduction of not less than 10 percent as a result of a
				project funded using a grant under the Transit Investments for Greenhouse Gas
				and Energy Reduction program.</text>
								</subclause></clause></subparagraph><subparagraph id="ID70816110b0f5434a87e97c3f6c124ddc"><enum>(B)</enum><header>Funds</header><text>The
				Secretary shall use not less than 10 percent of the funds made available to
				carry out this section for grants under this
				paragraph.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
