		<official-title>To fully offset the cost of the extension of unemployment
		  benefits and other Federal aid. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Rescission of unspent and
			 uncommitted Federal funds</header>
			<subsection id="ID9f63ae9c3eee4082a99c2ffaa57d16d0"><enum>(a)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, of all
			 available unobligated Federal funds, $9,200,000,000 in discretionary, unexpired
			 funds are rescinded.</text>
			</subsection><subsection id="id2E4228F2B14A4C499343084AED203A55"><enum>(b)</enum><header>Implementation</header><text>Not
			 later than 60 days after the date of enactment of this Act, the Director of the
			 Office of Management and Budget shall—</text>
				<paragraph id="idEEA1BF19E9AF47B5A3E6FD236A257356"><enum>(1)</enum><text>identify the
			 accounts and amounts rescinded to implement subsection (a); and</text>
				</paragraph><paragraph id="idA17630553100471298CD5D775AD232D1"><enum>(2)</enum><text>submit a report
			 to the Secretary of the Treasury and Congress of the accounts and amounts
			 identified under paragraph (1) for rescission.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H45591F3644E545D59EDB2235A130B85C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Continuing Extension Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H8F3FB0630A274513BB003A6B93597710" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Extension of unemployment insurance
			 provisions</header>
			<subsection commented="no" display-inline="no-display-inline" id="H793A0F14CA184423B1491FDE3442032B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><paragraph commented="no" display-inline="yes-display-inline" id="HE950604A5D4C4532A2EF49D4BEA40E05"><enum>(1)</enum><text display-inline="yes-display-inline">Section 4007 of the Supplemental
			 Appropriations Act, 2008 (<external-xref legal-doc="public-law" parsable-cite="pl/110/252">Public Law 110–252</external-xref>;
			 <external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C.
			 3304</external-xref> note) is amended—</text>

			 this section shall take effect as if included in the amendments made by section
			 2 of the Temporary Extension Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/144">Public Law 111–144</external-xref>).</text>

			 assistance for COBRA benefits</header><text display-inline="no-display-inline">Subsection (a)(3)(A) of section 3001 of
			 division B of the American Recovery and Reinvestment Act of 2009 (Public Law
			 111–5), as amended by section 3(a) of the Temporary Extension Act of 2010
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/144">Public Law
			 111–144</external-xref>), is amended by striking <quote>March 31, 2010</quote>
			 and inserting <quote>April 30, 2010</quote>.</text>

			 physicians</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H230FB6DA99844CCABB31CBDF5C4ECA40"><enum>(1)</enum><header display-inline="yes-display-inline">Medicare</header><text display-inline="yes-display-inline">Section 1848(o)(1)(C)(ii) of the Social
			 Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-4">42
			 U.S.C. 1395w–4(o)(1)(C)(ii)</external-xref>) is amended by striking

			 U.S.C. 1396b(t)(3)(D)</external-xref>) is amended by striking <quote>setting
			 (whether inpatient or outpatient)</quote> and inserting <quote>inpatient or
			 emergency room setting</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBFBCDEDA748D4E32BDC5589F876593C8"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall be effective as if included in the enactment of the HITECH
			 Act (included in the American Recovery and Reinvestment Act of 2009 (Public Law
			 111–5)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB0B870C38020471DB31E609BD3FF7A48"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the Secretary of Health and Human Services may implement the amendments made by
			 this section by program instruction or otherwise.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H6327AED7AF2241CAA0525C6F5F634EFE" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Extension of use of 2009 poverty
			 guidelines</header><text display-inline="no-display-inline">Section 1012 of the
			 Department of Defense Appropriations Act, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/118">Public Law
			 111–118</external-xref>), as amended by section 7 of the Temporary Extension
			 Act of 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/144">Public Law 111–144</external-xref>), is amended by
			 striking <quote>March 31, 2010</quote> and inserting <quote>April 30,
			 2010</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HD86DCE89BDD54F03ACFC23A1F157DBD0" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Extension of national flood insurance
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="H513E1D94EB314BACB4340E7792FB4009"><enum>(a)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">Section 129 of the Continuing
			 Appropriations Resolution, 2010 (<external-xref legal-doc="public-law" parsable-cite="pl/111/68">Public Law 111–68</external-xref>), as amended by
			 section 8 of <external-xref legal-doc="public-law" parsable-cite="pl/111/144">Public Law 111–144</external-xref>, is amended by
			 striking <quote>by substituting</quote> and all that follows through the period
			 at the end and inserting <quote>by substituting April 30, 2010, for the date
			 specified in each such section.</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF5E409BDEA7B4EA899E704C7C41E3CF7"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall be considered to have taken effect on February 28,
			 2010.</text>

				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H0C5BA592B6B64C5389FCA697620B6678" section-type="subsequent-section"><enum>11.</enum><header display-inline="yes-display-inline">Compensation and ratification of authority
			 related to lapse in highway programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="H0F345DBA4B41401B8E9DB467D30E5373"><enum>(a)</enum><header display-inline="yes-display-inline">Compensation for Federal
			 employees</header><text display-inline="yes-display-inline">Any Federal
			 employees furloughed as a result of the lapse in expenditure authority from the
			 Highway Trust Fund after 11:59 p.m. on February 28, 2010, through March 2,
			 2010, shall be compensated for the period of that lapse at their standard rates
			 of compensation, as determined under policies established by the Secretary of
			 Transportation.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC3F78FAAD0924384B1771CA3DE2641A5"><enum>(b)</enum><header display-inline="yes-display-inline">Ratification of essential
			 actions</header><text display-inline="yes-display-inline">All actions taken by
			 Federal employees, contractors, and grantees for the purposes of maintaining
			 the essential level of Government operations, services, and activities to
			 protect life and property and to bring about orderly termination of Government
			 functions during the lapse in expenditure authority from the Highway Trust Fund
			 after 11:59 p.m. on February 28, 2010, through March 2, 2010, are hereby
			 ratified and approved if otherwise in accord with the provisions of the
			 Continuing Appropriations Resolution, 2010 (division B of Public Law
			 111–68).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H410A83B35679435DBDB5AFB67A54937F"><enum>(c)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">Funds used by the Secretary to compensate
			 employees described in subsection (a) shall be derived from funds previously
			 authorized out of the Highway Trust Fund and made available or limited to the
			 Department of Transportation by the Consolidated Appropriations Act, 2010
			 (<external-xref legal-doc="public-law" parsable-cite="pl/111/117">Public Law
			 111–117</external-xref>) and shall be subject to the obligation limitations
			 established in such Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7CC8F8FE789146B5AF7A873BA38C38E3"><enum>(d)</enum><header display-inline="yes-display-inline">Expenditures from Highway Trust
			 Fund</header><text display-inline="yes-display-inline">To permit expenditures
			 from the Highway Trust Fund to effectuate the purposes of this section, this
			 section shall be deemed to be a section of the Continuing Appropriations
			 Resolution, 2010 (division B of
			 <external-xref legal-doc="public-law" parsable-cite="pl/111/68">Public Law
			 111–68</external-xref>), as in effect on the date of the enactment of the last
			 amendment to such Resolution.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HC16924D87B60450EA8A917B0AEE40028" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Determination of budgetary effects</header>
			<subsection commented="no" display-inline="no-display-inline" id="H6C4C7B22B9A443949FB2157034DA6541"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The budgetary effects of this Act, for the
			 purpose of complying with the Statutory Pay-As-You-Go Act of 2010, shall be
			 determined by reference to the latest statement titled <quote>Budgetary Effects
			 of PAYGO Legislation</quote> for this Act, submitted for printing in the
			 Congressional Record by the Chairman of the Committee on the Budget of the
			 House of Representatives, provided that such statement has been submitted prior
			 to the vote on passage.</text>

			 Enforcement</header><text display-inline="yes-display-inline">This Act, with
			 the exception of section 4, is designated as an emergency for purposes of
			 pay-as-you-go principles. In the Senate, this Act is designated as an emergency
			 requirement pursuant to section 403(a) of S. Con. Res. 13 (111th Congress), the
			 concurrent resolution on the budget for fiscal year 2010.</text>
