		<official-title>To establish penalties for servicers that fail to timely
		  evaluate the applications of homeowners under home loan modification programs.

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Mortgage Modification Reform Act
			 of 2010</short-title></quote>.</text>
		</section><section id="ID82e7bf6bb9f949ba9d3231f3cf0b8636"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="ID8edd6de7d9d646eda9284060d5d10533"><enum>(1)</enum><text>the term
			 <term>covered trial loan modification</term> means a trial loan
			 modification—</text>
				<subparagraph id="ID03cc0076679e48278a8bc6910a5e38f5"><enum>(A)</enum><text>offered by a
			 servicer to a homeowner under a home loan modification program; and</text>
				</subparagraph><subparagraph id="ID710ac8ed6dcd4f9799afa8da80c63d3b"><enum>(B)</enum><text>for which the
			 servicer has received from the homeowner the information required for a trial
			 loan modification;</text>
				</subparagraph></paragraph><paragraph id="IDc7f87e3e241c4495afad154d2f9c93d3"><enum>(2)</enum><text>the term
			 <term>home loan modification program</term> means a home loan modification
			 program put into effect by the Secretary under title I of division A of the
			 Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5211 et seq.),
			 including the Home Affordable Modification Program;</text>
			</paragraph><paragraph id="IDb706a34260934dbd950647e9fd86a146"><enum>(3)</enum><text>the term
			 <term>homeowner</term> means an individual who applies for a home loan
			 modification under a home loan modification program;</text>
			</paragraph><paragraph id="ID72e9e7b3dc1c464dbc068bc538f675de"><enum>(4)</enum><text>the term
			 <term>permanent loan modification</term> means any agreement reached between a
			 homeowner and a servicer on a long-term basis, as determined by the Secretary,
			 under a home loan modification program;</text>
			</paragraph><paragraph id="ID2975cab15e48457e93781b014ea083dc"><enum>(5)</enum><text>the term
			 <term>qualified counselor</term> means a qualified counselor described in
			 section 255(f) of the National Housing Act (12 U.S.C. 1715z–20(f));</text>
			</paragraph><paragraph id="ID9906ff2208eb4dbab8566708069d35f1"><enum>(6)</enum><text>the term
			 <term>Secretary</term> means the Secretary of the Treasury;</text>
			</paragraph><paragraph id="ID49beb21a20c8426c913b38a54f627641"><enum>(7)</enum><text>the term
			 <term>servicer</term> has the same meaning as in section 129 of the Truth in
			 Lending Act (15 U.S.C. 1639a) (relating to the duties of servicers of
			 residential mortgages), as added by section 201(b) of the Helping Families Save
			 Their Homes Act of 2009 (Public Law 111–22; 123 Stat. 1638);</text>
			</paragraph><paragraph id="ID8357e9cf8e1f48f697258ea69f3e16a5"><enum>(8)</enum><text>the term
			 <term>servicer incentive payment</term> means a payment that is made by the
			 Secretary to a servicer—</text>
				<subparagraph id="IDb2ce742b6e504c7aba61bd3d7d872a44"><enum>(A)</enum><text>in exchange, or
			 as an incentive, for making a loan modification under a home loan modification
			 program; and</text>
				</subparagraph><subparagraph id="IDdfe48e005983423b82d0beb9996bef03"><enum>(B)</enum><text>at the time the
			 servicer makes an offer of a trial or permanent modification to a homeowner;
			 and</text>
				</subparagraph></paragraph><paragraph id="ID1339e5a1d05e46faabe4135a52f3550f"><enum>(9)</enum><text>the term
			 <term>trial loan modification</term> means any agreement reached between a
			 homeowner and a servicer on a temporary basis, as determined by the Secretary,
			 under a home loan modification program.</text>
			</paragraph></section><section id="IDd4611446eb2d4f6c935e4b12b2b40eef"><enum>3.</enum><header>Foreclosure</header><text display-inline="no-display-inline">A servicer may not initiate or continue a
			 foreclosure proceeding with respect to the mortgage of a homeowner if—</text>
			<paragraph id="ID03a88a9c637b4a84a3b7f870f7adf7ed"><enum>(1)</enum><text>the homeowner
			 submitted an application for a loan modification under a home loan modification
			 program—</text>
				<subparagraph id="id27823893FF7941E1AE14DBD479368160"><enum>(A)</enum><text>before receiving
			 a notice of foreclosure from the servicer; or</text>
				</subparagraph><subparagraph id="idFBB1931FDED447768DB858EC8452640D"><enum>(B)</enum><text>not later than 30
			 days after the homeowner received a notice of foreclosure from the servicer;
			 and</text>
				</subparagraph></paragraph><paragraph id="IDde3be1ce12334496a351b8d6b9c584f0"><enum>(2)</enum><text>the servicer has
			 not made a determination, as described in section 5(a) that the homeowner does
			 not qualify for a loan modification under a home loan modification
			 program.</text>
			</paragraph></section><section id="ID00c1474862bd46b5b3e60b1be497ca93"><enum>4.</enum><header>Process for
			 review of improper denials</header>
			<subsection id="ID5ac5a34573bb4dd1bc697f4c2b952512"><enum>(a)</enum><header>Process for
			 review</header>
				<paragraph id="idFBB16E9FFE9143D4892C2625837E2840"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish a process by which a
			 homeowner may request the Secretary to review a denial by a servicer of an
			 application by the homeowner for a trial loan modification or permanent loan
			 modification.</text>
				</paragraph><paragraph id="ID8197c5baf27744a2a514ea4119260867"><enum>(2)</enum><header>Qualified
			 counselors</header><text>The process established under paragraph (1) shall
			 include the use of qualified counselors to report wrongful denials of trial
			 loan modifications and permanent loan modifications.</text>
				</paragraph><paragraph id="id5459BE5785DC4D139A2CFF2C2E5C74F5"><enum>(3)</enum><header>Supporting
			 documentation</header><text>The Secretary shall require a servicer to submit
			 supporting documentation with respect to any denial by the servicer of an
			 application by a homeowner for a trial loan modification or permanent loan
			 modification that is reviewed by the Secretary under the process established
			 under paragraph (1).</text>
				</paragraph></subsection><subsection id="IDb58eb59c827e41e8a899ba123f88bb78"><enum>(b)</enum><header>Penalties</header><text>If
			 the Secretary determines after a review under the process established under
			 subsection (a) that a servicer has wrongly denied the application of a
			 homeowner for a trial loan modification or a permanent loan modification, the
			 Secretary shall impose a penalty on the servicer.</text>
			</subsection></section><section id="ID9522f3e01be84f79834de1f0cd0f6fa9"><enum>5.</enum><header>Penalties for
			 servicers that do not timely evaluate homeowners</header>
			<subsection id="ID912af2f030e7431fab7d2c4866343e16"><enum>(a)</enum><header>Time for
			 evaluation of homeowners</header><text>Not later than 3 months after the date
			 on which a homeowner submits an application for a loan modification to a
			 servicer that participates in a home loan modification program, the servicer
			 shall—</text>
				<paragraph id="ID1c2350d57307453db992bd5c452675b2"><enum>(1)</enum><text>evaluate the
			 application of the homeowner; and</text>
				</paragraph><paragraph id="ID69eda7b8d66c45398856b5b868c10b0a"><enum>(2)</enum><text>notify the
			 homeowner that—</text>
					<subparagraph id="ID5893d86db2474868837d94255005ce9b"><enum>(A)</enum><text>the homeowner is
			 qualified for a trial loan modification or a permanent loan modification under
			 the home loan modification program; or</text>
					</subparagraph><subparagraph id="ID9ea1902e2ec34d54a0db9518d93eb53f"><enum>(B)</enum><text>the servicer has
			 denied the application.</text>
					</subparagraph></paragraph></subsection><subsection id="ID9ae686c143a54c04b9a4dc962e05c1de"><enum>(b)</enum><header>Priority for
			 evaluating amendments</header>
				<paragraph id="IDdd3ab6885a534d67affe7439dec9f04b"><enum>(1)</enum><header>Priority</header><text>A
			 servicer that participates in a home loan modification program shall evaluate
			 the applications of homeowners for loan modifications in the order in which the
			 servicer receives the applications.</text>
				</paragraph><paragraph id="IDbbd474b44df14e23a1be61d9a90db9eb"><enum>(2)</enum><header>Prohibition</header><text>A
			 servicer that participates in a home loan modification program may not select
			 the order in which the applications of homeowners are evaluated for loan
			 modifications—</text>
					<subparagraph id="IDbd3b7c6986254479a92f4b5df004dc5e"><enum>(A)</enum><text>on the basis
			 of—</text>
						<clause id="IDecc7d2367e2a4d91982ebbaee888a10c"><enum>(i)</enum><text>the
			 income of the homeowner that made the application; or</text>
						</clause><clause id="ID605507461e504ad99d1eb744f3e69cbf"><enum>(ii)</enum><text>the value of the
			 loan for which a modification is requested; or</text>
						</clause></subparagraph><subparagraph id="IDc6d23146237e4ac3aac4f31c56bc25ec"><enum>(B)</enum><text>for any reason
			 other than the time at which the servicer receives the applications.</text>
					</subparagraph></paragraph></subsection><subsection id="IDe67f8dfc088e48c2b794bdd76631207b"><enum>(c)</enum><header>Late fees for
			 servicers</header>
				<paragraph id="ID242e44278668403a8f4f71bf61c66c17"><enum>(1)</enum><header>Reduced
			 servicer incentive payments for loans individual homeowners</header><text>The
			 Secretary shall reduce the amount of any servicer incentive payment with
			 respect to the loan modification of an individual homeowner by 10 percent for
			 each full month that—</text>
					<subparagraph id="ID0f2067b127f64758a861def1981226a3"><enum>(A)</enum><text>follows the date
			 that is 3 months after the date on which the homeowner submits an application
			 for a loan modification to the servicer; and</text>
					</subparagraph><subparagraph id="IDd4e77ebe05cf4e21a48ce3828209c311"><enum>(B)</enum><text>precedes the date
			 on which the servicer notifies the homeowner under subsection (a)(2).</text>
					</subparagraph></paragraph><paragraph id="ID8960a2849a15468cacd82c614bd9352c"><enum>(2)</enum><header>Reduced
			 payments for all loans</header><text>If the Secretary determines that, on the
			 date that is 3 months after the date of enactment of this Act, less than 75
			 percent of all homeowners who applied to a servicer for loan modifications
			 under a home loan modification program have been evaluated within 3 months of
			 the date of the application, the Secretary shall reduce by 25 percent the
			 amount of any servicer incentive payment the servicer would otherwise be
			 eligible to receive under the home loan modification program.</text>
				</paragraph></subsection><subsection id="ID90513fb6d588478e88209e1377b095f3"><enum>(d)</enum><header>Delinquency
			 Fees Charged to Homeowners</header><text>No servicer may impose a fee on a
			 homeowner due to delinquency during the period beginning on the date on which
			 the homeowner submits an application to the servicer for a loan modification
			 and ending on the date on which the homeowner receives notice under subsection
			 (a)(2).</text>
			</subsection><subsection id="IDaed07feab9e4450aa426afda2d952abb"><enum>(e)</enum><header>Collection and
			 Report of Data</header>
				<paragraph id="ID6bde77df1427491096b65e73ba4bb1e0"><enum>(1)</enum><header>Collection of
			 data</header><text>Each servicer shall report to the Secretary, at such time
			 and in such manner as the Secretary may determine, data relating to the
			 processing by the servicer of applications for loan modifications.</text>
				</paragraph><paragraph id="ID7206f14765fd4c6bb72c191639c3f794"><enum>(2)</enum><header>Report of
			 data</header><text>The Secretary shall publish a monthly report containing the
			 data collected under paragraph (1).</text>
				</paragraph></subsection></section><section id="ID8542255ad58e4c9c901934a02282eb69"><enum>6.</enum><header>Reduced payments
			 for failure to evaluate homeowners for permanent modifications</header><text display-inline="no-display-inline">If the Secretary determines that, on the
			 date that is 3 months after the date of enactment of this Act, less than 70
			 percent of all covered trial loan modifications offered by a servicer have been
			 evaluated for conversion to permanent loan modifications before the date that
			 is 3 months after the date on which the servicer and the homeowner entered into
			 an agreement for a trial loan modification, the Secretary shall reduce by 25
			 percent the amount of any servicer incentive payment the servicer would
			 otherwise be eligible to receive under the home loan modification program. Such
			 reduction shall be in addition to any other reduction in payment that may have
			 been imposed on the servicer for any other violation of this Act.</text>
		</section><section id="ID59cf3afae6534627a7ee95719c1c1e81"><enum>7.</enum><header>Rule of
			 construction relating to payments to homeowners</header><text display-inline="no-display-inline">Nothing in this Act may be construed to
			 require a reduction of a payment by the Secretary made on behalf or for the
			 benefit of a homeowner in connection with a loan modification.</text>
