		<official-title display="yes">To grant the Secretary of Health and Human
		  Services authority to design, construct, and operate facilities for the purpose
		  of developing and producing biological products in order to meet critical
		  national needs for such biological products, in response to potential
		  bioterrorist attacks or naturally occurring pathogens.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Biosecurity and Vaccine Development
			 Improvement Act of 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idEA540FFC4F33468CA88505B7B4134736" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Development and production of biological
			 products</header><text display-inline="no-display-inline">Subpart 1 of part F
			 of title III of the Public Health Service Act (42 U.S.C. 262 et seq.) is
			 amended by adding at the end the following:</text>

				<section commented="no" display-inline="no-display-inline" id="id7AB9A622E435420F8D23A0F527960A67" section-type="subsequent-section"><enum>352A.</enum><header display-inline="yes-display-inline">Development and production of biological
				products</header>
					<subsection commented="no" display-inline="no-display-inline" id="id6EEB7B2A19C640BF9133C6FD148F2BD0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may design, construct, and
				operate one or more facilities for the purpose of developing and producing
				biological products to meet critical national needs for such biological
				products, in response to potential bioterrorist attacks or to naturally
				occurring pathogens, for which the Secretary determines that private industry
				has not devoted adequate development effort, or has not produced adequate
				stocks of, such needed biological products.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="IDf1cfb020882342aea5fc28151d249f85"><enum>(b)</enum><header display-inline="yes-display-inline">Competitive award</header><text display-inline="yes-display-inline">In carrying out the authority described in
				subsection (a), the Secretary—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id2C949E825B5C46AEBDE644DAC88FCF35"><enum>(1)</enum><text display-inline="yes-display-inline">shall ensure that there is competition and
				may establish a public-private partnership to design, construct, own, and
				operate a facility described in subsection (a); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7C26D527A4C24680852463E9A0EA6536"><enum>(2)</enum><text display-inline="yes-display-inline">may use the authority to enter into other
				transactions under section 319L to establish such a
				facility.</text>
