			</subsection></section><section id="ID16eba905c19f4d959ae85346a7d43e0b"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID8991e5a534894f5bb47e076d97215dc7"><enum>(1)</enum><header>Asylum
			 seeker</header><text>The term <term>asylum seeker</term>—</text>
				<subparagraph id="id7DA5FA6C098E436FB743A722696B9EE2"><enum>(A)</enum><text>means—</text>
					<clause id="ID6ca7aaaeaa414341a7676799d1054056"><enum>(i)</enum><text>any
			 applicant for asylum under section 208 of the Immigration and Nationality Act
			 (8 U.S.C. 1158);</text>
					</clause><clause id="ID4afd04f15679408d9914bf2b3f3d69d8"><enum>(ii)</enum><text>any alien who
			 indicates an intention to apply for asylum under that section; and</text>
					</clause><clause id="IDa89fd20a7fbe497e9e3bdc3a21a1998c"><enum>(iii)</enum><text>any alien who
			 indicates an intention to apply for withholding of removal, pursuant to—</text>
						<subclause id="idFDDF70C18B314F119CD7D19392150013"><enum>(I)</enum><text>section 241 of
			 the Immigration and Nationality Act (8 U.S.C. 1231); or</text>
						</subclause><subclause id="idF61931E675094C838D14F3B8DECCDD20"><enum>(II)</enum><text>the Convention
			 Against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment,
			 done at New York December 10, 1984;</text>
						</subclause></clause></subparagraph><subparagraph id="id28B3CA4A4DE94614B514774A9882D5C6"><enum>(B)</enum><text>includes any
			 individual described in subparagraph (A) whose application for asylum or
			 withholding of removal is pending judicial review; and</text>
				</subparagraph><subparagraph id="id29F11C9E566F4A82AE7231FD6EFF04CC"><enum>(C)</enum><text>does not include
			 an individual with respect to whom a final order denying asylum and withholding
			 of removal has been entered if such order is not pending judicial
			 review.</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEA744F6B12E74DBB97A1DACD410F3845"><enum>(2)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Homeland Security.</text>
			</paragraph></section><section id="ID203ef329902948a79ef192f070672a84"><enum>3.</enum><header>Elimination of
			 arbitrary time limits on asylum applications</header><text display-inline="no-display-inline">Section 208(a)(2) of the Immigration and
			 Nationality Act (8 U.S.C. 1158(a)(2)) is amended—</text>
			<paragraph id="ID3d6a035c963a4783a9d73b525fd66ec2"><enum>(1)</enum><text>by striking
			 subparagraph (B);</text>
			</paragraph><paragraph id="ID8f319fb22a1949409c00446a57beceba"><enum>(2)</enum><text>by redesignating
			 subparagraphs (C) and (D) as subparagraphs (B) and (C), respectively;</text>
			</paragraph><paragraph id="ID8b3e42d3b0aa407eb082ef1bf42a861c"><enum>(3)</enum><text>in subparagraph
			 (B), as redesignated, by striking <quote>(D)</quote> and inserting
			 <quote>(C)</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd2594519777a4aafafd09dc238daa0a0"><enum>(4)</enum><text>by striking
			 subparagraph (C), as redesignated, and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id679E19BB853B42DF89AA7AF60857EF14" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="id0FD1BE5EF91E439C98A622257D9BDFA8"><enum>(C)</enum><header>Changed
				circumstances</header><text>Notwithstanding subparagraph (B), an application
				for asylum of an alien may be considered if the alien demonstrates, to the
				satisfaction of the Attorney General, the existence of changed circumstances
				that materially affect the applicant’s eligibility for
				asylum.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID1c94a8fbed8346e89286482cfdd4ee10"><enum>4.</enum><header>Protecting
			 victims of terrorism from being defined as terrorists</header><text display-inline="no-display-inline">Section 212(a)(3)(B) of the Immigration and
			 Nationality Act (8 U.S.C. 1182(a)(3)(B)) is amended—</text>
			<paragraph id="idC296D16E109144B8A1943D174C0FF4C9"><enum>(1)</enum><text display-inline="yes-display-inline">in clause (i)—</text>
				<subparagraph id="idCFDA50E813E1414A9FC04C7DD7FF59BE"><enum>(A)</enum><text display-inline="yes-display-inline">by amending subclause (IX) to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="id693CB4B2BB3F4F49B506EF36CD180F92" style="OLC">
						<subclause id="idD78185B2E29F497FA3FBE83108077827"><enum>(IX)</enum><text>is an officer,
				official, representative, or spokesman of the Palestine Liberation
				Organization,</text>
						</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="idFCD57B1021AD40129F3B2C82056CFFBC"><enum>(B)</enum><text>by striking the
			 matter following subclause (IX) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBEA1AB9383B34AD5B5F0AF81FA7C3E0F" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="clause">“is
				inadmissible.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id75F57F61121A4556AB6B7FC960CF87CE"><enum>(2)</enum><text display-inline="yes-display-inline">in clause (iii), by inserting <quote>which
			 is intended to intimidate or coerce a civilian population or to influence the
			 policy of a government by intimidation or coercion and</quote> after
			 <quote>means any activity</quote>;</text>
			</paragraph><paragraph id="idD94A166D650A4BF191BB7F33D5C21456"><enum>(3)</enum><text display-inline="yes-display-inline">in clause (iv)(VI), by inserting
			 <quote>(other than as the result of coercion)</quote> after <quote>to commit an
			 act</quote>;</text>
			</paragraph><paragraph id="id59681DCA996F40E796AB93F4338271E7"><enum>(4)</enum><text display-inline="yes-display-inline">in clause (vi)—</text>
				<subparagraph id="idEED467F1D4394E71808B8E977C5B7DF2"><enum>(A)</enum><text display-inline="yes-display-inline">in subclause (I), by adding
			 <quote>or</quote> at the end;</text>
				</subparagraph><subparagraph id="id89744BE25137432793BAE520B36F52B7"><enum>(B)</enum><text>in subclause
			 (II), by striking <quote>; or</quote> and inserting a period; and</text>
				</subparagraph><subparagraph id="idCBC67C604B83472DABA16C18564BDC93"><enum>(C)</enum><text display-inline="yes-display-inline">by striking subclause (III); and</text>
				</subparagraph></paragraph><paragraph id="idF1FC7D3A41E440E0B73C06223F4CE572"><enum>(5)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id2BEB201805E54BC3BF46C94720F3D9BA" style="OLC">
					<clause id="idEA02805F658E4F54989563FB045BD326"><enum>(vii)</enum><text>As used in this
				paragraph, the term, <term>coercion</term> means—</text>
						<subclause id="ID0aa408b683894e929ec9c91e50c9f59f"><enum>(I)</enum><text>serious harm,
				including restraint against any person; or</text>
						</subclause><subclause id="ID9df1fbf6717343e2a655f4b0ad188039"><enum>(II)</enum><text>any scheme,
				plan, or pattern intended to cause a person to believe that failure to perform
				an act would result in serious harm to, or restraint against, any
				person.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID57616b14fb2f45d583608a741d79a4ec"><enum>5.</enum><header>Protecting
			 certain vulnerable groups of asylum seekers</header>
			<subsection id="ID617fc71109904dcfb09329cb7b1d21ec"><enum>(a)</enum><header>Defined
			 term</header><text>Section 101(a)(42) of the Immigration and Nationality Act (8
			 U.S.C. 1101(a)(42)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idC1FF818B8A614165B9DC52525546436F" style="OLC">
					<paragraph id="idF90DAE97CAFE4CD19DCE3E4764DE4C68"><enum>(42)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6CC179B40B724160BF27C39CD0C4B825"><enum>(A)</enum><text>The term
				<term>refugee</term> means any person who—</text>
							<clause id="id1BB2CEBCBECF4C29B04FEF9C1CA4FCB2" indent="up1"><enum>(i)</enum><subclause commented="no" display-inline="yes-display-inline" id="id4A18C27A0BB549F9B085C8EEC98D89D5"><enum>(I)</enum><text>is outside any country
				of such person’s nationality or, in the case of a person having no nationality,
				is outside any country in which such person last habitually resided; and</text>
								</subclause><subclause id="idEFBAF18359B24ED69A56FAB8A3322ECF" indent="up1"><enum>(II)</enum><text>is unable to return to, and is
				unable or unwilling to avail himself or herself of the protection of, that
				country because of persecution, or a well-founded fear of persecution, on
				account of race, religion, nationality, membership in a particular social
				group, or political opinion; or</text>
								</subclause></clause><clause id="id1207115414A743C99C3D888C617BD5B6" indent="up1"><enum>(ii)</enum><text>in such circumstances as the
				President may specify, after appropriate consultation (as defined in section
				207(e))—</text>
								<subclause id="idCB5E8A660A0347B9BA63DF89A012786A"><enum>(I)</enum><text>is within the country of such person’s
				nationality or, in the case of a person having no nationality, within the
				country in which such person is habitually residing; and</text>
								</subclause><subclause id="id8DEBADD281484A2FAB09FDB221B02E7A"><enum>(II)</enum><text>is persecuted, or who has a well-founded
				fear of persecution, on account of race, religion, nationality, membership in a
				particular social group, or political opinion.</text>
								</subclause></clause></subparagraph><subparagraph id="id4401AED55BE148458D99B6C090A20E11" indent="up1"><enum>(B)</enum><text>The term <term>refugee</term> does not
				include any person who ordered, incited, assisted, or otherwise participated,
				other than as a result of coercion (as defined in section 212(a)(3)(B)(vii)),
				in the persecution of any person on account of race, religion, nationality,
				membership in a particular social group, or political opinion.</text>
						</subparagraph><subparagraph id="id4539764F94CD4912B7FB4D54D5E561E0" indent="up1"><enum>(C)</enum><text>For purposes of determinations under
				this Act—</text>
							<clause id="id9908F3A04FC643D5AF46EC3395F7E550"><enum>(i)</enum><text>a person who has been forced to
				abort a pregnancy or to undergo involuntary sterilization, or who has been
				persecuted for failure or refusal to undergo such a procedure or for other
				resistance to a coercive population control program, shall be deemed to have
				been persecuted on account of political opinion; and</text>
							</clause><clause id="idE9CA68A1B5694B08BF766C25286ED1F7"><enum>(ii)</enum><text>a person who has a well-founded
				fear that he or she will be forced to undergo such a procedure or subject to
				persecution for such failure, refusal, or resistance shall be deemed to have a
				well-founded fear of persecution on account of political opinion.</text>
							</clause></subparagraph><subparagraph id="id7BF83349E1214368B5FEA20A1BB37DFB" indent="up1"><enum>(D)</enum><text>For purposes of determinations under
				this Act, any group whose members share a characteristic that is either
				immutable or fundamental to identity, conscience, or the exercise of the
				person’s human rights such that the person should not be required to change it,
				shall be deemed a particular social group, without any additional
				requirement.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID6ed281820ddc4749893809d6fbea8e99"><enum>(b)</enum><header>Conditions for
			 granting asylum</header><text>Section 208(b)(1)(B) of the Immigration and
			 Nationality Act (8 U.S.C. 1158(b)(1)(B)) is amended—</text>
				<paragraph id="IDb9a8a6a417dc4eff97caf1feb603c238"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>at least one central reason for persecuting the
			 applicant</quote> and inserting <quote>a factor in the applicant’s persecution
			 or fear of persecution</quote>;</text>
				</paragraph><paragraph id="idA9755560936E4AEC814BEC75F708CBB4"><enum>(2)</enum><text>in clause (ii),
			 by striking the last sentence and inserting the following: <quote>If the trier
			 of fact determines that the applicant should provide evidence that corroborates
			 otherwise credible testimony, the trier of fact shall provide notice and allow
			 the applicant a reasonable opportunity to file such evidence unless the
			 applicant does not have the evidence and cannot reasonably obtain the
			 evidence.</quote>;</text>
				</paragraph><paragraph id="id2BAA27259E3F4900A6F90F809CF6730B"><enum>(3)</enum><text>by redesignating
			 clause (iii) as clause (iv);</text>
				</paragraph><paragraph id="id11DCA92FD9F94C21AE8CCBECD2FAAC7A"><enum>(4)</enum><text>by inserting
			 after clause (ii) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6D658288C3D147E88F6F0F11B9EBF603" style="OLC">
						<clause id="IDd1d2bed46ea84f25a745a68d925a71bd"><enum>(iii)</enum><header>Supporting
				evidence accepted</header><text>Direct or circumstantial evidence, including
				evidence that the State is unable to protect the applicant or that State legal
				or social norms tolerate such persecution against persons like the applicant,
				may establish that persecution is on account of race, religion, nationality,
				membership in a particular social group, or political
				opinion.</text>
						</clause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID55eeb24d6ddb45788398ababee6ef987"><enum>(5)</enum><text>in clause (iv),
			 as redesignated, by striking <quote>, without regard to whether an
			 inconsistency, inaccuracy, or falsehood goes to the heart of the applicant’s
			 claim, or any other relevant factor.</quote> and inserting <quote>. If the
			 trier of fact determines that there are inconsistencies or omissions, the alien
			 shall be given an opportunity to explain and to provide support or evidence to
			 clarify such inconsistencies or omissions.</quote>.</text>
				</paragraph></subsection><subsection id="IDf31ca725b1cc4f3da9298d3636df68f7"><enum>(c)</enum><header>Removal
			 proceedings</header><text>Section 240(c)(4) of the Immigration and Nationality
			 Act (8 U.S.C. 1229a(c)(4)) is amended—</text>
				<paragraph id="ID464752da0cfd4185ae73558a373acf32"><enum>(1)</enum><text>in subparagraph
			 (B), by striking the last sentence and inserting the following: <quote>If the
			 trier of fact determines that the applicant should provide evidence that
			 corroborates otherwise credible testimony, the trier of fact shall provide
			 notice and allow the applicant a reasonable opportunity to file such evidence
			 unless the applicant does not have the evidence and cannot reasonably obtain
			 the evidence.</quote>; and</text>
				</paragraph><paragraph id="IDeb38b28bb8fd458b8069b0f3c0e9acc3"><enum>(2)</enum><text>in subparagraph
			 (C), by striking <quote>, without regard to whether an inconsistency,
			 inaccuracy, or falsehood goes to the heart of the applicant’s claim, or any
			 other relevant factor</quote> and inserting <quote>. If the trier of fact
			 determines that there are inconsistencies or omissions, the alien shall be
			 given an opportunity to explain and to provide support or evidence to clarify
			 such inconsistencies or omissions.</quote>.</text>
				</paragraph></subsection></section><section id="idF43D72EE78064514B7E4D37B09C9FF6E"><enum>6.</enum><header>Effective
			 adjudication of proceedings</header><text display-inline="no-display-inline">Section 240(b)(4) of the Immigration and
			 Nationality Act (8 U.S.C. 1229a(b)(4)) is amended—</text>
			<paragraph id="IDd5d42ec950e345d785f5c1704d0dbf04"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>In proceedings under this
			 section, under regulations of the Attorney General</quote> and inserting
			 <quote>The Attorney General shall promulgate regulations for proceedings under
			 this section, under which—</quote></text>
			</paragraph><paragraph id="id8C4D2C9EBD1141A292226ABE7E986C82"><enum>(2)</enum><text>in subparagraph
			 (B), by striking <quote>, and</quote> at the end and inserting a
			 semicolon;</text>
			</paragraph><paragraph id="idF84801FECE484E3C977CBFFA8C85794F"><enum>(3)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (D); and</text>
			</paragraph><paragraph id="ID3177ea6e3c6a4639aef1478eec8c33b6"><enum>(4)</enum><text>by inserting
			 after subparagraph (B) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7A616C050ECD44BABAB6D1C07328E2E2" style="OLC">
					<subparagraph id="ID56b71a4e9b13449eb6dddbeab92b5d01"><enum>(C)</enum><text>the Attorney
				General, or the designee of the Attorney General, may appoint counsel to
				represent an alien if the fair resolution or effective adjudication of the
				proceedings would be served by appointment of counsel;
				and</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="IDa10dff964cc04bef944c5e832744eda8"><enum>7.</enum><header>Scope and
			 standard for review</header><text display-inline="no-display-inline">Section
			 242(b) of the Immigration and Nationality Act (8 U.S.C. 1252(b)) is
			 amended—</text>
			<paragraph id="idD3CE41A5F8B94B1697870E534ED7438C"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the
			 following: <quote>The alien shall not be removed during such 30-day period,
			 unless the alien indicates in writing that he or she wishes to be removed
			 before the expiration of such period.</quote>; and</text>
			</paragraph><paragraph id="idFA9DB1DB99FE49FE8F9769434996CC6B"><enum>(2)</enum><text display-inline="yes-display-inline">by striking paragraph (4) and inserting the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idBAF492021B7A4696B100126BCDC94632" style="OLC">
					<paragraph id="id3EE897E4B951403AA99BDAC82E6E5828"><enum>(4)</enum><header>Scope and
				standard for review</header><text display-inline="yes-display-inline">Except as
				provided in paragraph (5)(B), the court of appeals shall sustain a final
				decision ordering removal unless it is contrary to law, an abuse of discretion,
				or not supported by substantial evidence. The court of appeals shall decide the
				petition only on the administrative record on which the order of removal is
				based.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID1a8d2fb94f284360b48cd0bdc8afb91d"><enum>8.</enum><header>Efficient asylum
			 determination process and detention of asylum seekers</header>
			<subsection id="id75C2EE4759D6475EB603802F7028D4A9"><enum>(a)</enum><header>In
			 general</header><text>Section 235(b)(1)(B) of the Immigration and Nationality
			 Act (8 U.S.C. 1225(b)(1)(B)) is amended—</text>
				<paragraph id="ID539b0cad291742aca814cc16e6d10756"><enum>(1)</enum><text>in clause (ii),
			 by striking <quote>shall be detained for further consideration of the
			 application for asylum</quote> and inserting <quote>may, in the Secretary’s
			 discretion, be detained for further consideration of the application for asylum
			 by an asylum officer designated by the Director of United States Citizenship
			 and Immigration Services. The asylum officer, after conducting a nonadversarial
			 asylum interview, may grant asylum to the alien under section 208 or refer the
			 case to a designee of the Attorney General, for a de novo asylum determination,
			 for relief under the Convention Against Torture and Other Cruel, Inhuman or
			 Degrading Treatment or Punishment, done at New York December 10, 1984, or for
			 withholding of removal under section 241(b)(3).</quote>;</text>
				</paragraph><paragraph id="ID5917d57441d6457a955098cd6f2d5a01"><enum>(2)</enum><text>in clause
			 (iii)(IV)—</text>
					<subparagraph id="id4AC4ED8C87354CFB95843AD4DA4E107D"><enum>(A)</enum><text>by amending the
			 subclause heading to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="id61B9EBD17F43441087F5F4CB18EFAEF6" style="OLC">
							<subclause id="id4DF8B2C1E43241A78CE2FF094ED4EEC1"><enum>(IV)</enum><header>Detention</header>
							</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="ID120dc2fd10c543859ef2a85d72da64f0"><enum>(B)</enum><text>by striking
			 <quote>shall</quote> and inserting <quote>may, in the Secretary’s
			 discretion,</quote>; and</text>
					</subparagraph></paragraph><paragraph id="id9B79109DAB7F4A44ACBB9B40E3BF25BB"><enum>(3)</enum><text>by inserting
			 after clause (v) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4096F31B5FDB4479ACD77697DDC77EE8" style="OLC">
						<clause id="ID9943be77fc974453867782c2f7ebf143"><enum>(vi)</enum><header>Parole of
				certain aliens</header><text>Any alien subject to detention under clause
				(iii)(IV) who has established identity and been determined to have a credible
				fear of persecution shall be released from the custody of the Department of
				Homeland Security not later than 7 days after such determination unless the
				Department demonstrates by substantial evidence that the alien—</text>
							<subclause id="ID60b35ddb097b4ce0b9e06740d389f8cb"><enum>(I)</enum><text>poses a risk to
				public safety, which may include a risk to national security; or</text>
							</subclause><subclause id="IDee90a520397f490892cfc1876196f429"><enum>(II)</enum><text>is a flight
				risk, which cannot be mitigated through other conditions of release, such as
				bond or secure alternatives, that would reasonably ensure that the alien would
				appear for immigration proceedings.</text>
							</subclause></clause><clause id="IDd591b4e41ba64a33abcd6b994e56d7cf"><enum>(vii)</enum><header>Review of
				detention</header><text>If an alien described in clause (vi) is denied release
				from detention, the Attorney General shall—</text>
							<subclause id="ID1e9de4f7be4c459d9a7abc7c45719faf"><enum>(I)</enum><text>not later than 7
				days after such denial, review the parole determination through a hearing
				before an immigration judge, who shall determine whether the alien should be
				paroled and any conditions of such release; and</text>
							</subclause><subclause id="IDd10fd516e5ed4f2a8656b870cde7f4ad"><enum>(II)</enum><text>notify the
				detained alien and the alien’s legal representative of the reason for such
				denial, orally and in writing, in a language the alien claims to
				understand.</text>
							</subclause></clause><clause id="ID4423e27336394f01b65a3a138830303a"><enum>(viii)</enum><header>Waiver</header><text>The
				alien may waive the 7-day review requirement under clause (vii)(I) and request
				a review at a later time. Any alien whose parole request has been reviewed and
				denied under clause (vii)(I) may request another review and determination upon
				showing that there was a material change in circumstances since the last
				review.</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID9b0047e2f0c7425b8b5acb5154c496e6"><enum>(b)</enum><header>Rulemaking</header><text>The
			 Secretary and the Attorney General shall promulgate regulations establishing a
			 process for reviewing the eligibility of aliens for parole in accordance with
			 clause (vi) and (vii) of section 235(b)(1)(B) of the Immigration and
			 Nationality Act, as amended by subsection (a).</text>
			</subsection></section><section id="IDb656d03e86c840d8958a5bc00ff3b105"><enum>9.</enum><header>Secure
			 alternatives program</header>
			<subsection id="IDadfe283c944642e1b5b28b2693c62299"><enum>(a)</enum><header>Establishment</header><text>The
			 Secretary shall establish the Secure Alternatives Program (referred to in this
			 section as the <quote>Program</quote>) under which an alien who has been
			 detained may be released under enhanced supervision—</text>
				<paragraph id="id2ACD976A5F6E4416B1C4D71A8335B502"><enum>(1)</enum><text>to prevent the
			 alien from absconding;</text>
				</paragraph><paragraph id="id9D03069CB8EB491B92682558D68711D9"><enum>(2)</enum><text>to ensure that
			 the alien makes appearances related to such detention; and</text>
				</paragraph><paragraph id="id0BC5B43914FF4A5C8DCCEC716878F328"><enum>(3)</enum><text>to authorize and
			 promote the utilization of alternatives to detention of asylum seekers.</text>
				</paragraph></subsection><subsection id="ID9dfdd93602114b568625ab1227586cfe"><enum>(b)</enum><header>Program
			 requirements</header>
				<paragraph id="IDb275eaa4ded94abea7a94eaf092eaae2"><enum>(1)</enum><header>Nationwide
			 implementation</header><text>The Secretary shall facilitate the nationwide
			 implementation of the Program.</text>
				</paragraph><paragraph id="ID88b97f207d9746e8bd983d8dbe8da689"><enum>(2)</enum><header>Utilization of
			 alternatives</header><text>The Program shall utilize a continuum of
			 alternatives based on the alien’s need for supervision, which may include
			 placement of the alien—</text>
					<subparagraph id="id23FB406072714A74932B1BFBC3FD1C28"><enum>(A)</enum><text>with an
			 individual or organizational sponsor; or</text>
					</subparagraph><subparagraph id="id61A5C782B39E4E489BB5ED0BECF9D2C2"><enum>(B)</enum><text>in a supervised
			 group home.</text>
					</subparagraph></paragraph><paragraph id="IDf6580bd301ae456b8fe77c8294ddd1b0"><enum>(3)</enum><header>Program
			 elements</header><text>The Program shall include—</text>
					<subparagraph id="ID4d2f057cc269464680cf14aa6815e0eb"><enum>(A)</enum><text>individualized
			 case management by an assigned case supervisor; and</text>
					</subparagraph><subparagraph id="ID469b4fbcfa9b49bc8d8a07fae67bad4b"><enum>(B)</enum><text>referral to
			 community-based providers of legal and social services.</text>
					</subparagraph></paragraph><paragraph id="ID4d91ff825cad4e1dbac4cd8f4bc1f749"><enum>(4)</enum><header>Restrictive
			 electronic monitoring</header>
					<subparagraph id="idCAA56EF1B20441459F1E15893E0DE32D"><enum>(A)</enum><header>In
			 general</header><text>Restrictive electronic monitoring devices, such as ankle
			 bracelets, may not be used unless there is a demonstrated need for such
			 enhanced monitoring.</text>
					</subparagraph><subparagraph id="id8085FF8990284FE7BFE1B9C9F74F5E2A"><enum>(B)</enum><header>Periodic
			 review</header><text>The Secretary shall periodically review any decision to
			 require the use of devices described in subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="IDf3210313834444cea4458c0c587dd1e8"><enum>(5)</enum><header>Aliens eligible
			 for secure alternatives program</header>
					<subparagraph commented="no" id="ID98dd2668810746938d319e9ac49d1eba"><enum>(A)</enum><header>In
			 general</header><text>Asylum seekers shall be eligible to participate in the
			 Program.</text>
					</subparagraph><subparagraph id="ID6bdce416557c4c358ed0eb3e0fb82e8a"><enum>(B)</enum><header>Program
			 design</header><text>The Program shall be designed to ensure sufficient
			 supervision of the population described in subparagraph (A).</text>
					</subparagraph></paragraph><paragraph id="IDdee250dda28142828d106d308de02508"><enum>(6)</enum><header>Contracts</header><text>The
			 Secretary shall enter into contracts with qualified nongovernmental entities to
			 implement the Program.</text>
				</paragraph><paragraph id="ID566562d8c80347cf90b05bdd06540adf"><enum>(7)</enum><header>Other
			 considerations</header><text>In designing the Program, the Secretary
			 shall—</text>
					<subparagraph id="IDb4fa826add4c42708629709e0f973658"><enum>(A)</enum><text>consult with
			 relevant experts; and</text>
					</subparagraph><subparagraph id="IDb2611a95461b49b788f5b9aa589cd436"><enum>(B)</enum><text>consider programs
			 that have proven successful in the past, including the Appearance Assistance
			 Program developed by the Vera Institute of Justice.</text>
					</subparagraph></paragraph></subsection></section><section id="ID0058d7ab3b6046648647483bef035113"><enum>10.</enum><header>Conditions of
			 detention</header>
			<subsection id="ID4acb0f479f464e01bae279d88738ef55"><enum>(a)</enum><header>Rulemaking</header><text>The
			 Secretary shall promulgate regulations that—</text>
				<paragraph id="ID939e6c4fc41c4f32a3a7a013d52caf51"><enum>(1)</enum><text>authorize and
			 promote the utilization of alternatives to detention of asylum seekers;</text>
				</paragraph><paragraph id="IDc43ebd31064f45b48d198284aa23d402"><enum>(2)</enum><text>establish the
			 conditions for detention of asylum seekers that ensure a safe and humane
			 environment; and</text>
				</paragraph><paragraph id="id2A4AE28EA60843C8810511AB348381D8"><enum>(3)</enum><text>include the
			 rights and procedures set forth in subsections (c) through (h).</text>
				</paragraph></subsection><subsection id="ID4b8578cf92ca45f4be7abecc949d8edc"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="idAF969E1399EE46689AC2F00D44FFDA96"><enum>(1)</enum><header>Detainee</header><text>The
			 term <term>detainee</term> means an individual who is detained under the
			 authority of United States Immigration and Customs Enforcement.</text>
				</paragraph><paragraph id="id881666F6A5A347B18D380E27A740BB97"><enum>(2)</enum><header>Detention
			 facility</header><text>The term <term>detention facility</term> means any
			 Federal, State, local government facility, or privately owned and operated
			 facility, which is being used to hold detainees longer than 72 hours.</text>
				</paragraph><paragraph id="idB335C2D60A60410EAE74136E98CA935E"><enum>(3)</enum><header>Short-term
			 detention facility</header><text>The term <term>short-term detention
			 facility</term> means any Federal, State, local government, or privately owned
			 and operated facility that is used to hold immigration detainees for not more
			 than 72 hours.</text>
				</paragraph><paragraph id="idD4B510B9D3854D97870EA74E6FB815FF"><enum>(4)</enum><header>Group legal
			 orientation presentations</header><text>The term <term>group legal orientation
			 presentations</term> means live group presentations, supplemented by individual
			 orientations, pro se workshops, and pro bono referrals, that—</text>
					<subparagraph id="id9500061A08BD4B2CA7FAEFAB5D20C871"><enum>(A)</enum><text>are carried out
			 by private nongovernmental organizations;</text>
					</subparagraph><subparagraph id="id94F6E021DC8845BFB8DBDE0D053063DF"><enum>(B)</enum><text>are presented to
			 detainees;</text>
					</subparagraph><subparagraph id="id03DBF865F7D3478DBDEC41568D1C9933"><enum>(C)</enum><text>inform detainees
			 about United States immigration law and procedures; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3C33C105BF2B4448B9F086273D393B2E"><enum>(D)</enum><text>enable detainees
			 to determine their eligibility for relief.</text>
					</subparagraph></paragraph></subsection><subsection id="ID4bac165066ed4d43a1d9bce5601cd664"><enum>(c)</enum><header>Access to legal
			 services</header>
				<paragraph id="IDe080bc39bd584f9c952b3560773ee706"><enum>(1)</enum><header>Lists of legal
			 service providers</header><text>All detainees arriving at a detention facility
			 shall promptly receive—</text>
					<subparagraph id="IDb55a80ea94d84bc1a94962dc93216e7e"><enum>(A)</enum><text>access to legal
			 information, including an on-site law library with up-to-date legal materials
			 and law databases;</text>
					</subparagraph><subparagraph id="ID1610ec8f2b0d4b1782b325fca5ffe735"><enum>(B)</enum><text>free access to
			 the necessary equipment and materials for legal research and correspondence,
			 such as computers, printers, copiers, and typewriters;</text>
					</subparagraph><subparagraph id="ID458185ee99404163a7ec037058f03499"><enum>(C)</enum><text>an accurate,
			 updated list of free or low-cost immigration legal service providers
			 that—</text>
						<clause id="idAA97521436BA47E6BA90E91E26EF9C42"><enum>(i)</enum><text>are
			 near such detention facility; and</text>
						</clause><clause id="id40C3905BA99743B3B38E6F111E680090"><enum>(ii)</enum><text>can assist those
			 with limited English proficiency or disabilities;</text>
						</clause></subparagraph><subparagraph id="ID561a55821e9147369903c8e970b010e2"><enum>(D)</enum><text>confidential
			 meeting space to confer with legal counsel; and</text>
					</subparagraph><subparagraph id="ID235b9e6a28824c6ba7d7583b8285b56f"><enum>(E)</enum><text>services to send
			 confidential legal documents to legal counsel, government offices, and legal
			 organizations.</text>
					</subparagraph></paragraph><paragraph id="ID97bffd70039546f4bef5668bd9192679"><enum>(2)</enum><header>Group legal
			 orientation presentations</header>
					<subparagraph id="ID9d082e2c215c4d32b19152cc6b7d0549"><enum>(A)</enum><header>Establishment
			 of a national legal orientation support and training center</header><text>The
			 Attorney General, in consultation with the Secretary, shall establish a
			 National Legal Orientation Support and Training Center (referred to in this
			 subsection as the <quote>Center</quote>) to ensure quality and consistent
			 implementation of group legal orientation programs nationwide.</text>
					</subparagraph><subparagraph id="IDd1fceabce9824a5890d482e04830bfc9"><enum>(B)</enum><header>Duties</header><text>The
			 Center shall—</text>
						<clause id="IDd447b91a52284cc5a8ffadaa895a00a2"><enum>(i)</enum><text>offer training to
			 nonprofit agencies that will offer group legal orientation programs;</text>
						</clause><clause id="IDfbb78cdd8b6e49d0a178d96f0cd1a7e7"><enum>(ii)</enum><text>consult with
			 nonprofit agencies offering group legal orientation programs regarding program
			 development and substantive legal issues; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID9de2fc2d3a094e899b2e2e63a04cbc7b"><enum>(iii)</enum><text>develop
			 standards for group legal orientation programs.</text>
						</clause></subparagraph><subparagraph id="ID681750ec250f411ba462d86cad0eb0b8"><enum>(C)</enum><header>Procedures</header><text>The
			 Secretary shall establish procedures for regularly scheduled, group legal
			 orientation presentations.</text>
					</subparagraph></paragraph><paragraph id="ID68b25e75fe5b4205955457c7a6e1796b"><enum>(3)</enum><header>Grants
			 authorized</header><text>The Attorney General shall establish a program to
			 award grants to nongovernmental agencies to develop, implement, or expand legal
			 orientation programs for all detainees at a detention facility that offers such
			 programs.</text>
				</paragraph><paragraph id="ID83d0dd1ae41b4095aa48ce12acfd3540"><enum>(4)</enum><header>Notification
			 requirement</header><text>The Secretary shall establish procedures to promptly
			 notify detainees at a detention facility, orally and in writing in a language
			 that the detainee claims to understand, of—</text>
					<subparagraph id="idD4ED048860254C68B0652D8751306EB9"><enum>(A)</enum><text>their available
			 release options; and</text>
					</subparagraph><subparagraph id="id04B9D28493574FEA9B9DF1161042C0E2"><enum>(B)</enum><text>the procedures
			 for requesting such options.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0732c41b1db142bd991176610dab0b5b"><enum>(d)</enum><header>Visits</header>
				<paragraph id="ID240ed8c2711b497f9a92c61e7cc90cf0"><enum>(1)</enum><header>Legal
			 representation</header><text>Detainees in detention facilities have the right
			 to meet privately with current or prospective legal representatives,
			 interpreters, and other legal support staff for at least 8 hours per day on
			 regular business days and 4 hours per day on weekends and holidays, subject to
			 appropriate security procedures. Legal visits may only be restricted for
			 narrowly defined exceptional circumstances, such as a natural disaster or
			 comparable emergency.</text>
				</paragraph><paragraph id="ID615518632d134856bc1b5542067a5887"><enum>(2)</enum><header>Pro bono
			 organizations</header><text>Detention facilities shall prominently post, in
			 detainee housing units and other appropriate areas, official lists of pro bono
			 legal organizations and their contact information. The Secretary shall update
			 such lists semiannually.</text>
				</paragraph><paragraph id="ID4e594916b4e342dfbf12e65d777cd1aa"><enum>(3)</enum><header>Religious,
			 cultural, and spiritual visitors</header><text>Detainees have the right to
			 reasonable access to religious or other qualified individuals to address
			 religious, cultural, and spiritual considerations.</text>
				</paragraph><paragraph id="IDb27a1d80c8a7457dbf3f7471bc906bfc"><enum>(4)</enum><header>Children</header><text>Detainees
			 have the right to regular, private contact visits with their children (as
			 defined in section 101(b)(1) of the Immigration and Nationality Act (8 U.S.C.
			 1101(b)(1)).</text>
				</paragraph></subsection><subsection id="id4FB445980A9F417B8FF86401B9162893"><enum>(e)</enum><header>Quality of
			 medical care</header>
				<paragraph id="ID48aa25199f16492f873e60a368ed9294"><enum>(1)</enum><header>Right to
			 medical care</header><text>Each detainee has the right to—</text>
					<subparagraph id="ID62dc88d58ef84bbc838be5872f69ba47"><enum>(A)</enum><text>prompt and
			 adequate medical care, designed to ensure continuity of care, at no cost to the
			 detainee;</text>
					</subparagraph><subparagraph id="ID946a5290355f450aafbb6af328c11c29"><enum>(B)</enum><text>care to address
			 medical needs that existed prior to detention; and</text>
					</subparagraph><subparagraph id="ID3ec180db7be84f16934ce78e103c21d7"><enum>(C)</enum><text>primary care,
			 emergency care, chronic care, reproductive health care, prenatal care, dental
			 care, eye care, mental health care, and other medically necessary specialized
			 care.</text>
					</subparagraph></paragraph><paragraph id="IDf0fa578b7cd4462ca91849342d43cce8"><enum>(2)</enum><header>Screenings and
			 examinations</header><text>Each detainee shall receive—</text>
					<subparagraph id="IDfc99ce657e08475ba2b39f8581482733"><enum>(A)</enum><text>a comprehensive
			 medical, dental, and mental health intake screening, including screening for
			 sexual abuse or assault, conducted by a licensed health care professional upon
			 arrival at a detention facility or short-term detention facility; and</text>
					</subparagraph><subparagraph id="ID3b9880bd4d2b4abfbd64d1952cfef7ce"><enum>(B)</enum><text>a comprehensive
			 medical and mental health examination by a licensed health care professional
			 not later than 14 days after the detainee’s arrival at a detention
			 facility.</text>
					</subparagraph></paragraph><paragraph id="IDd0c9608c6e6e43b199cc09be22301d56"><enum>(3)</enum><header>Medications and
			 treatment</header>
					<subparagraph id="ID5c525e9b516243f7acabd4d5b3b65b20"><enum>(A)</enum><header>Prescriptions</header><text>Each
			 detainee taking prescribed medications prior to detention shall be allowed to
			 continue taking such medications, on schedule and without interruption, until a
			 licensed health care professional examines the immigration detainee and decides
			 upon an alternative course of treatment. Detainees who arrive at a detention
			 facility without prescription medications and report being on specific
			 prescription medications shall be evaluated by a qualified health care
			 professional not later than 24 hours after such arrival. All decisions to
			 discontinue or modify a detainee’s reported prescription medication regimen
			 shall be conveyed to the detainee in a language that the detainee understands
			 and recorded in writing in the detainee’s medical records.</text>
					</subparagraph><subparagraph id="ID421af274702e479b8476770eb0995910"><enum>(B)</enum><header>Psychotropic
			 medication</header><text>Medication may not be forcibly administered to a
			 detainee to facilitate transport, removal, or otherwise to control the
			 detainee’s behavior. Involuntary psychotropic medication may only be used, to
			 the extent authorized by applicable law, in emergency situations after a
			 physician has personally examined the detainee and determined that—</text>
						<clause id="ID48da0aefed014be4b849dc833262054f"><enum>(i)</enum><text>the
			 detainee is imminently dangerous to self or others due to a mental illness;
			 and</text>
						</clause><clause id="ID01de15742a8640589e9cfef043334742"><enum>(ii)</enum><text>involuntary
			 psychotropic medication is medically appropriate to treat the mental illness
			 and necessary to prevent harm.</text>
						</clause></subparagraph><subparagraph id="ID7c5a1a330ee8470bb8ce258d939c2d60"><enum>(C)</enum><header>Treatment</header><text>Each
			 detainee shall be provided medically necessary treatment, including prenatal
			 care, prenatal vitamins, hormonal therapies, and birth control. Female
			 detainees shall be provided with adequate access to sanitary products.</text>
					</subparagraph></paragraph><paragraph id="ID4eb76a16a47442f6a785a8fba6c476bf"><enum>(4)</enum><header>Medical care
			 decisions</header><text>Any decision regarding requested medical care for a
			 detainee—</text>
					<subparagraph id="ID0594222d29d54b41852dfbeec0bbfd35"><enum>(A)</enum><text>shall be made in
			 writing by an on-site licensed health care professional not later than 72 hours
			 after such medical care is requested; and</text>
					</subparagraph><subparagraph id="IDe87666b22ebb49ca92445ff9c3b195cd"><enum>(B)</enum><text>shall be
			 immediately communicated to the detainee.</text>
					</subparagraph></paragraph><paragraph id="ID835aa18357684a079827aa12176a4f4e"><enum>(5)</enum><header>Administrative
			 appeals process</header>
					<subparagraph id="ID36d4721720eb4e9089f64a95d16b4a8d"><enum>(A)</enum><header>In
			 general</header><text>The operators of detention facilities, in conjunction
			 with the Department of Homeland Security, shall ensure that detainees, medical
			 providers, and legal representatives are provided the opportunity to appeal a
			 denial of requested health care services by an on-site provider to an
			 independent appeals board.</text>
					</subparagraph><subparagraph id="ID24792c15ba8146139f0f5ca77f6aa7cf"><enum>(B)</enum><header>Appeals
			 board</header><text>The appeals board shall include health care professionals
			 in the fields relevant to the request for medical or mental health care.</text>
					</subparagraph><subparagraph id="IDdc30b74f255c43868e9cf8c833d6e7e7"><enum>(C)</enum><header>Decision</header><text>Not
			 later than 7 days after an appeal is received by the appeals board under this
			 paragraph, or earlier if medically necessary, the appeals board shall—</text>
						<clause id="ID5e8deb8603f5486f85fd34348b2fca57"><enum>(i)</enum><text>issue a written
			 decision regarding the appeal; and</text>
						</clause><clause id="ID47182c89930a44459434c2f9d7f5d380"><enum>(ii)</enum><text>notify the
			 detention facility and the appellee, orally and in a writing in a language the
			 appellee claims to understand, of such decision.</text>
						</clause></subparagraph></paragraph><paragraph id="ID31c03af7d6a446f6b7b74c6242b00b1e"><enum>(6)</enum><header>Review of
			 on-site medical provider requests</header>
					<subparagraph id="ID593e54643f5e49b695284fd73575ed8e"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall respond within 72 hours to any
			 request by an on-site medical provider for authorization to provide medical or
			 mental health care to a detainee.</text>
					</subparagraph><subparagraph id="ID312a560cfb574985b773dc32f0f0eb39"><enum>(B)</enum><header>Written
			 explanation</header><text>If the Secretary denies or fails to grant a request
			 described in subparagraph (A), the Secretary shall immediately provide a
			 written explanation of the reasons for such decision to the on-site medical
			 provider and the detainee.</text>
					</subparagraph><subparagraph id="ID13bb96d5ccb34527a61d4c91b25976f1"><enum>(C)</enum><header>Appeals
			 board</header><text>The on-site medical provider and the detainee (or the
			 detainee’s legal representative) shall be permitted to appeal the denial of, or
			 failure to grant, a request described in subparagraph (A) to an independent
			 appeals board.</text>
					</subparagraph><subparagraph id="ID94a228d233f44a8f873a011ba0a7abb3"><enum>(D)</enum><header>Decision</header><text>Not
			 later than 7 days after an appeal is received by the appeals board under this
			 paragraph, or earlier if medically necessary, the appeals board shall—</text>
						<clause id="id59E1A03C48764E95812B8DA65E1D282F"><enum>(i)</enum><text>issue a written
			 decision regarding the appeal;</text>
						</clause><clause id="id4008C0D64F064287ACA2A61ADA30451D"><enum>(ii)</enum><text>notify the
			 detainee of such decision, orally and in a writing in a language the detainee
			 claims to understand; and</text>
						</clause><clause id="id42E22A2D2C5F4931A884B82B0388236F"><enum>(iii)</enum><text>notify the
			 on-site medical provider and the detention facility of such decision.</text>
						</clause></subparagraph></paragraph><paragraph id="ID5088e3535ca147e286c3a446f044cd3b"><enum>(7)</enum><header>Conditional
			 release</header>
					<subparagraph id="ID19c356eb5da14042b208e1cf2af57931"><enum>(A)</enum><header>In
			 general</header><text>If a licensed health care professional determines that a
			 detainee has a medical or mental health care condition, is pregnant, or is a
			 nursing mother, the Secretary shall consider releasing the detainee on parole,
			 on bond, or into a secure alternatives program.</text>
					</subparagraph><subparagraph id="ID16139d51207347c792874d9e98fe804f"><enum>(B)</enum><header>Reevaluation</header><text>If
			 a detainee described in subparagraph (A) is not initially released under this
			 paragraph, the Secretary shall periodically reevaluate the situation of the
			 detainee to determine if such a release would be appropriate.</text>
					</subparagraph><subparagraph id="ID8deb1c1915cf476a8d05973d57238577"><enum>(C)</enum><header>Discharge
			 planning</header><text>Upon removal or release, all detainees with serious
			 medical or mental health conditions and women who are pregnant shall receive
			 discharge planning to ensure continuity of care for a reasonable period of
			 time.</text>
					</subparagraph></paragraph><paragraph id="ID64ff8f8253b84a40a9d734a7f4929f21"><enum>(8)</enum><header>Medical
			 records</header>
					<subparagraph id="ID3e886fe9d28d4445817eea1ff82adeb4"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall—</text>
						<clause id="id624E8339CD9141B6B775B5E0AFAA1AA9"><enum>(i)</enum><text>maintain
			 complete, confidential medical records for each detainee and make such records
			 available to the detainee, or to individuals authorized by the detainee, not
			 later than 72 hours after receiving a request for such records.</text>
						</clause></subparagraph><subparagraph id="IDa2c8157c6762466abb300d3e013073c0"><enum>(B)</enum><header>Transfer of
			 medical records</header><text>Immediately upon a detainee’s transfer between
			 detention facilities, the detainee’s complete medical records, including any
			 transfer summary, shall be provided to the receiving detention facility.</text>
					</subparagraph></paragraph></subsection><subsection id="ID145676cb822348dfb2cd7221a4b928e4"><enum>(f)</enum><header>Transfer of
			 detainees</header>
				<paragraph id="id5AB4782ECD1842139865CBAB7BE9D88B"><enum>(1)</enum><header>Notice</header><text>Absent
			 exigent circumstances, such as a natural disaster or comparable emergency, the
			 Secretary shall provide written notice to any detainee, orally and in a writing
			 in a language the detainee claims to understand, not less than 72 hours before
			 transferring such detainee to another detention facility. Not later than 24
			 hours after such transfer, the Secretary shall notify the detainee’s legal
			 representative, or other person designated by the detainee of the transfer, by
			 telephone and in writing.</text>
				</paragraph><paragraph id="id4EBF4B4695934DECAA467A45A7AABED4"><enum>(2)</enum><header>Procedures</header><text>Absent
			 exigent circumstances, such as a natural disaster or comparable emergency, the
			 Secretary may not transfer a detainee to another detention facility if such
			 transfer would—</text>
					<subparagraph id="idBD16CC14C7594B13BEF453EF83742201"><enum>(A)</enum><text>impair an
			 existing attorney-client relationship;</text>
					</subparagraph><subparagraph id="id983585FF83BC41FB806AE0BEF313B4DF"><enum>(B)</enum><text>prejudice the
			 rights of the detainee in any legal proceeding, including any Federal, State,
			 or administrative proceeding; or</text>
					</subparagraph><subparagraph id="id41CB310B853D48269037FFCC9B40D703"><enum>(C)</enum><text>negatively affect
			 the detainee’s health, including by interrupting the continuity of medical care
			 or provision of prescription medication.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5b0e20b90e5a4c7abef1643c24f408fd"><enum>(g)</enum><header>Access to
			 telephones</header>
				<paragraph id="IDf6bf9e883dbc48b1ab4e2c7c06898239"><enum>(1)</enum><header>In
			 general</header><text>Not later than 6 hours after the commencement of a
			 detention of a detainee, the detainee shall be provided reasonable access to a
			 telephone, with at least 1 working telephone available for every 25
			 detainees.</text>
				</paragraph><paragraph id="ID46d215ec2d874301a31fede8b4c7c161"><enum>(2)</enum><header>Contacts</header><text>Each
			 detainee has the right to contact by telephone, free of charge—</text>
					<subparagraph id="ID1e82bd22b8b841a7aa4c1734b258b8d2"><enum>(A)</enum><text>legal
			 representatives;</text>
					</subparagraph><subparagraph id="ID222a8c50facf4469a4f39b828a7ba087"><enum>(B)</enum><text>nongovernmental
			 organizations designated by the Secretary;</text>
					</subparagraph><subparagraph id="ID211cd63e6ced4d1ea255a64076ff12f5"><enum>(C)</enum><text>consular
			 officials;</text>
					</subparagraph><subparagraph id="IDf9e5e125e069487ba66a98da49f4890c"><enum>(D)</enum><text>the United
			 Nations High Commissioner for Refugees;</text>
					</subparagraph><subparagraph id="id9562E69D962444E084EDA3122A732831"><enum>(E)</enum><text>Federal and State
			 courts in which the detainee is, or may become, involved in a legal proceeding;
			 and</text>
					</subparagraph><subparagraph id="ID0d38506d77b341429feec0cfb2a11341"><enum>(F)</enum><text>all government
			 immigration agencies and adjudicatory bodies, including the Office of the
			 Inspector General of the Department of Homeland Security and the Office for
			 Civil Rights and Civil Liberties of the Department of Homeland Security,
			 through confidential toll-free numbers.</text>
					</subparagraph></paragraph><paragraph id="IDf321593600b049abad4aa7d9b39e55c0"><enum>(3)</enum><header>Emergencies</header><text>Each
			 detainee subject to expedited removal or who is experiencing a personal or
			 family emergency, including the need to arrange care for dependents, shall be
			 allowed to make confidential calls at no charge.</text>
				</paragraph><paragraph id="ID333a1ede7ab64a74ae59498633c9dfcd"><enum>(4)</enum><header>Privacy</header><text>Each
			 detainee has the right to hold private telephone conversations for the purpose
			 of obtaining legal representation or related to legal matters.</text>
				</paragraph><paragraph id="ID4256c920889645a99177b36a5ccf528d"><enum>(5)</enum><header>Rates</header><text>The
			 Secretary shall ensure that rates charged in detention facilities for telephone
			 calls are reasonable and do not significantly impair the detainee’s right to
			 make telephone calls.</text>
				</paragraph></subsection><subsection id="ID9a61b77e167b45c1a2b79c84ce445b1c"><enum>(h)</enum><header>Physical and
			 sexual abuse</header>
				<paragraph id="ID3ed0904b8f844f44a840582c6b914fc7"><enum>(1)</enum><header>In
			 general</header><text>No detainee, whether in a detention facility or
			 short-term detention facility, shall be subject to degrading or inhumane
			 treatment such as physical abuse, sexual abuse or harassment, or arbitrary
			 punishment.</text>
				</paragraph><paragraph id="ID2113369c7fc74b7abfcc990de8e535c5"><enum>(2)</enum><header>Prevention</header><text>The
			 operators of detention facilities shall take all necessary measures—</text>
					<subparagraph id="ID009ea17c31374e61a47d6f728599c440"><enum>(A)</enum><text>to prevent sexual
			 abuse and sexual assaults of detainees;</text>
					</subparagraph><subparagraph id="ID919b6278abce452eb29e09ca7998cfd9"><enum>(B)</enum><text>to provide
			 medical and mental health treatment to victims of sexual abuse and sexual
			 assaults; and</text>
					</subparagraph><subparagraph id="IDf3386b63540f4702a693ad77c37fc4b6"><enum>(C)</enum><text>to comply fully
			 with the national standards for the detection, prevention, reduction, and
			 punishment of prison rape adopted pursuant to section 8(a) of the Prison Rape
			 Elimination Act of 2003 (42 U.S.C. 15607(a)).</text>
					</subparagraph></paragraph></subsection><subsection id="ID1d4c40a4e07d4504a563c00817fa80af"><enum>(i)</enum><header>Limitations on
			 solitary confinement, shackling, and strip searches</header>
				<paragraph id="IDc0d159606b8c4297a35dc0fdb5e8d635"><enum>(1)</enum><header>Extraordinary
			 circumstances</header><text>Solitary confinement, shackling, and strip searches
			 of detainees—</text>
					<subparagraph id="idDD4A27313FF7406A84920EB429004430"><enum>(A)</enum><text>may not be used
			 unless such techniques are necessitated by extraordinary circumstances in which
			 the safety of other persons is at imminent risk; and</text>
					</subparagraph><subparagraph id="idFCA3E9C7A5874C239C5470001E6892D4"><enum>(B)</enum><text>may not be used
			 for the purpose of humiliating detainees either within or outside the detention
			 facility.</text>
					</subparagraph></paragraph><paragraph id="ID5812282c35b54b16a2b5a6371c17ca47"><enum>(2)</enum><header>Protected
			 classes</header><text>Solitary confinement, shackling, and strip searches may
			 not be used on pregnant women, nursing mothers, women in labor or delivery, or
			 children who are younger than 18 years of age. Strip searches may not be
			 conducted in the presence of children who are younger than 21 years of
			 age.</text>
				</paragraph><paragraph id="IDfb7d339de1764ab3a1d55439433433fd"><enum>(3)</enum><header>Written
			 policies</header><text>Detention facilities shall—</text>
					<subparagraph id="ID8e60c8aace2d4f42ab44c8e11ceb5012"><enum>(A)</enum><text>adopt written
			 policies pertaining to the use of force and restraints; and</text>
					</subparagraph><subparagraph id="IDe3fc3839152e4336ae3a4a7674c0331f"><enum>(B)</enum><text>train all staff
			 on the proper use of such techniques and devices.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0dd938acf6fc42d093ba684570c70c3d"><enum>(j)</enum><header>Location of
			 detention facilities</header>
				<paragraph id="ID66a0757412194796a31172963a614ba9"><enum>(1)</enum><header>New
			 facilities</header><text>All detention facilities first used by the Department
			 of Homeland Security after the date of the enactment of this Act shall be
			 located within 50 miles of a community in which there is a demonstrated
			 capacity to provide free or low-cost legal representation by—</text>
					<subparagraph id="ID233922b1544740719602e3c24bc1dcd1"><enum>(A)</enum><text>nonprofit legal
			 aid organizations; or</text>
					</subparagraph><subparagraph id="IDc43c18b63b59458eb061db1b915a701e"><enum>(B)</enum><text>pro bono
			 attorneys with expertise in asylum or immigration law.</text>
					</subparagraph></paragraph><paragraph id="IDabd56c0bc1e54bfea69c417601290d70"><enum>(2)</enum><header>Existing
			 facilities</header><text>Not later than January 1, 2014, all detention
			 facilities used by the Department of Homeland Security shall meet the location
			 requirement described in paragraph (1).</text>
				</paragraph><paragraph id="IDabf3de1026b34fd58ab6de700e02a6a3"><enum>(3)</enum><header>Report</header><text>If
			 the Secretary fails to comply with the requirement under paragraph (2) by
			 January 1, 2014, the Secretary shall submit a report to Congress on such date,
			 and annually thereafter, that—</text>
					<subparagraph id="ID1ac16901a4a04aa0a889abd3cfa7e6e3"><enum>(A)</enum><text>explains the
			 reasons for such failure; and</text>
					</subparagraph><subparagraph id="IDfa2ef92549a64c0b8d3e4ff8216d96c2"><enum>(B)</enum><text>describes the
			 specific plans of the Secretary to meet such requirement.</text>
					</subparagraph></paragraph></subsection><subsection id="ID98f29e6cb7cb419286f16c8ed1f84bb8"><enum>(k)</enum><header>Translation
			 capabilities</header><text>The operators of detention facilities and short-term
			 detention facilities shall—</text>
				<paragraph id="IDf8d0da545455489b858b11f1788e4507"><enum>(1)</enum><text>employ staff who
			 are professionally qualified in any language spoken by more than 10 percent of
			 its detainee population;</text>
				</paragraph><paragraph id="ID98bc4184b350477abbb5eac20bfe6b5b"><enum>(2)</enum><text>arrange for
			 alternative translation services, as needed, in the exceptional circumstances
			 when trained bilingual staff members are unavailable to translate; and</text>
				</paragraph><paragraph id="IDa108b227b8cd4ea0839ff0df29e7e510"><enum>(3)</enum><text>provide notices
			 and written materials to detainees in the native language of such detainees if
			 such language is spoken by more than 5 percent of the detainees in the
			 facility.</text>
				</paragraph></subsection><subsection id="ID7e8163ce479a4ada98bdd59447bed987"><enum>(l)</enum><header>Recreational
			 programs and activities</header><text>Detainees shall be provided with access
			 to at least 1 hour of indoor and outdoor recreational programs and activities
			 each day.</text>
			</subsection><subsection id="IDe99c8655560c4f83b111963a73d46449"><enum>(m)</enum><header>Training of
			 personnel</header><text>All personnel at detention facilities and short-term
			 detention facilities shall be given comprehensive, specialized training and
			 regular, periodic updates, including—</text>
				<paragraph id="ID0a8e6fa099204041b2b8c7f8760b4b2b"><enum>(1)</enum><text>an overview of
			 immigration detention and all detention standards;</text>
				</paragraph><paragraph id="IDa6442619cf7e492d9063329cbc1f71f1"><enum>(2)</enum><text>the
			 characteristics of the noncitizen detainee population, including the special
			 needs of vulnerable populations among detainees and cultural, gender, gender
			 identity, and sexual orientation issues; and</text>
				</paragraph><paragraph id="IDa53e3bcd3f6547149ed5f23beee05e2e"><enum>(3)</enum><text>the due process
			 and grievance procedures to protect the rights of detainees.</text>
				</paragraph></subsection><subsection id="IDe20bde151641455e8436a904196deede"><enum>(n)</enum><header>Transportation</header><text>The
			 Secretary shall ensure that—</text>
				<paragraph id="IDee9712b7a395487d976f7ccb95bc1f52"><enum>(1)</enum><text>each detainee is
			 safely transported, which shall include the appropriate use of safety harnesses
			 and occupancy limitations of vehicles; and</text>
				</paragraph><paragraph id="ID512b45e4bcc7473b96633616ab0b3211"><enum>(2)</enum><text>female officers
			 are responsible and at all times present during the transfer and transport of
			 female detainees who are in the custody of the Department of Homeland
			 Security.</text>
				</paragraph></subsection><subsection id="ID3c7012c9e804499ab976ffbe433357b8"><enum>(o)</enum><header>Vulnerable
			 populations</header><text>Detention facility conditions and minimum
			 requirements for detention facilities shall recognize and accommodate the
			 unique needs of vulnerable detainees, including—</text>
				<paragraph id="IDfb5a4abd97da404c8641fe88e1005af5"><enum>(1)</enum><text>families with
			 children;</text>
				</paragraph><paragraph id="ID38fbdae5bce248d397bfaec8fc397999"><enum>(2)</enum><text>asylum
			 seekers;</text>
				</paragraph><paragraph id="ID4f79bc268f2d4590b0e0ee841d4204a4"><enum>(3)</enum><text>victims of abuse,
			 torture, or trafficking;</text>
				</paragraph><paragraph id="IDe1ae4bbe7bdf41dd8dbe8b3b7f87f7ea"><enum>(4)</enum><text>individuals who
			 are older than 65 years of age;</text>
				</paragraph><paragraph id="ID83fca1f270964a37babe70a152f3e0f8"><enum>(5)</enum><text>pregnant women;
			 and</text>
				</paragraph><paragraph id="ID61dfca835b004a42a2d59c42f878bf6e"><enum>(6)</enum><text>nursing
			 mothers.</text>
				</paragraph></subsection><subsection id="ID238344fab8a4458ba610ff7aa3c0b2cd"><enum>(p)</enum><header>Children</header><text>The
			 Secretary shall ensure that unaccompanied alien children are—</text>
				<paragraph id="IDb2fb2efdd185479db668cf31292e99ae"><enum>(1)</enum><text>physically
			 separated from any adult who is not an immediate family member; and</text>
				</paragraph><paragraph id="ID11e3f055ee45459780571c70a1d8e8c6"><enum>(2)</enum><text>separated by
			 sight and sound from—</text>
					<subparagraph id="ID7e45abe436574770b42347dba621e268"><enum>(A)</enum><text>immigration
			 detainees and inmates with criminal convictions;</text>
					</subparagraph><subparagraph id="ID49722fc77d5747e4836fdced67a09852"><enum>(B)</enum><text>pretrial inmates
			 facing criminal prosecution;</text>
					</subparagraph><subparagraph id="IDe1b2f0fc2f014bf5ab10703c2e091531"><enum>(C)</enum><text>children who have
			 been adjudicated delinquents or convicted of adult offenses or are pending
			 delinquency or criminal proceedings; and</text>
					</subparagraph><subparagraph id="IDf3212c92d2c945ae8609b81a244ce75a"><enum>(D)</enum><text>inmates
			 exhibiting violent behavior while in detention.</text>
					</subparagraph></paragraph></subsection><subsection id="ID446e0b8657384912977251395da6d281"><enum>(q)</enum><header>Short-Term
			 facility requirements</header>
				<paragraph id="IDfbf68c0a559b498d88bad25730654f06"><enum>(1)</enum><header>Access to basic
			 needs, people, and property</header>
					<subparagraph id="ID9f536584ee274c10950a63bf6b3fb131"><enum>(A)</enum><header>Basic
			 needs</header><text>All detainees in short-term detention facilities shall
			 receive—</text>
						<clause id="ID1916e38b5c27496b88f3bec9d7eaeef7"><enum>(i)</enum><text>potable
			 water;</text>
						</clause><clause id="ID310882a812c242a89296973546a5d2f8"><enum>(ii)</enum><text>food, if
			 detained for more than 5 hours;</text>
						</clause><clause id="ID1e28cbfdee74449ca24cd6a020edf7e0"><enum>(iii)</enum><text>basic
			 toiletries, diapers, sanitary products, and blankets; and</text>
						</clause><clause id="ID52600a45be674baca3facd3541a3644f"><enum>(iv)</enum><text>access to
			 bathroom facilities.</text>
						</clause></subparagraph><subparagraph id="ID8979f212c1824d2697099196fd9a60a3"><enum>(B)</enum><header>People</header><text>The
			 Secretary shall provide consular officials with access to detainees held at any
			 short-term detention facility. Detainees shall be afforded reasonable access to
			 a licensed health care professional. The Secretary shall ensure that nursing
			 mothers in such facilities have access to their children.</text>
					</subparagraph><subparagraph id="ID7d7eb75256334716a1c3090b41f69954"><enum>(C)</enum><header>Property</header><text>Any
			 property belonging to a detainee that was confiscated by an official of the
			 Department of Homeland Security shall be returned to the detainee upon
			 repatriation or transfer.</text>
					</subparagraph></paragraph><paragraph id="IDb173c73236dd465b991ab9e2a2568e4e"><enum>(2)</enum><header>Protections for
			 children</header>
					<subparagraph id="ID9ebaac9705f648eebb1e5d6d66611b04"><enum>(A)</enum><header>Qualified
			 staff</header><text>The Secretary shall ensure that adequately trained and
			 qualified staff are stationed at each major port of entry at which, during the
			 2 most recent fiscal years, an average of at least 50 unaccompanied alien
			 children have been held per year by United States Customs and Border
			 Protection. Such staff shall include—</text>
						<clause id="IDacfc531f16a14c8fbc9bf386bb533e4c"><enum>(i)</enum><text>independent
			 licensed social workers dedicated to ensuring the proper temporary care for the
			 children while in the custody of United States Customs and Border Protection;
			 and</text>
						</clause><clause id="ID96406b6b29b54d4587aea4ceea9ad55a"><enum>(ii)</enum><text>agents charged
			 primarily with the safe, swift, and humane transportation of such children to
			 the custody of the Office of Refugee Resettlement.</text>
						</clause></subparagraph><subparagraph id="ID59087b913d534a2e917b4f4dc7311d39"><enum>(B)</enum><header>Specific
			 rights</header><text>The social workers described in subparagraph (A)(i) shall
			 ensure that each unaccompanied alien child—</text>
						<clause id="IDa37b62013721434cbba173c88a9a0cb3"><enum>(i)</enum><text>receives
			 emergency medical care;</text>
						</clause><clause id="ID308f716ddd694b3ca868c04fe888c4e5"><enum>(ii)</enum><text>receives mental
			 health care in case of trauma;</text>
						</clause><clause id="ID1c5658e120b34b038b0d14a2f954fb14"><enum>(iii)</enum><text>has access to
			 psychosocial health services;</text>
						</clause><clause id="IDa556f3c3fd2343d5bcfc47f0ef64ffa2"><enum>(iv)</enum><text>is
			 provided with—</text>
							<subclause id="ID5a5710fa639445608c5c7418d24bdfdb"><enum>(I)</enum><text>a pillow, linens,
			 and sufficient blankets to rest at a comfortable temperature; and</text>
							</subclause><subclause id="IDcaa1b417ba2842a0bdcdf44ad6d2a439"><enum>(II)</enum><text>a bed and
			 mattress placed in an area specifically designated for residential use;</text>
							</subclause></clause><clause id="ID4cc4388113f544a9845438a5495b79df"><enum>(v)</enum><text>receives adequate
			 nutrition;</text>
						</clause><clause id="ID58015faa01ed44a894bddff9f2e5e565"><enum>(vi)</enum><text>enjoys a safe
			 and sanitary living environment;</text>
						</clause><clause id="ID793abeb4ba39425f8693832ad598f125"><enum>(vii)</enum><text>receives
			 educational materials; and</text>
						</clause><clause id="ID31c327d9c87d4a749c57256985a10b04"><enum>(viii)</enum><text>has access to
			 at least 3 hours of indoor and outdoor recreational programs and activities per
			 day.</text>
						</clause></subparagraph></paragraph><paragraph id="ID99b2b4bac763442fa1c276947d5caaec"><enum>(3)</enum><header>Confidentiality</header>
					<subparagraph id="IDe62032aa3c17472490c0f2aaf4f6e324"><enum>(A)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services shall maintain
			 the privacy and confidentiality of all information gathered in the course of
			 providing care, custody, placement, and follow-up services to unaccompanied
			 alien children, consistent with the best interest of such children, by not
			 disclosing such information to other government agencies or nonparental third
			 parties, except as provided under paragraph (2).</text>
					</subparagraph><subparagraph id="ID18299d527097430681b7b75bf3579647"><enum>(B)</enum><header>Limited
			 disclosure of information</header><text>The Secretary may disclose information
			 regarding an unaccompanied alien child only if—</text>
						<clause id="ID9546738dec304c3da51c8e4bdb452f8c"><enum>(i)</enum><text>the
			 child authorizes such disclosure and it is consistent with the child's best
			 interest; or</text>
						</clause><clause id="ID0169e6361c614fdfa84999c1e91bc6ff"><enum>(ii)</enum><text>the disclosure
			 is to a duly recognized law enforcement entity and is necessary to prevent
			 imminent and serious harm to another individual.</text>
						</clause></subparagraph><subparagraph id="ID68d154f1775748599dd9173fb6d2f4fa"><enum>(C)</enum><header>Written
			 record</header><text>All disclosures under paragraph (2) shall be duly recorded
			 in writing and placed in the child’s file.</text>
					</subparagraph></paragraph></subsection></section><section id="ID805872903fc04257af60ed8d5278f3f4"><enum>11.</enum><header>Timely notice
			 of immigration charges</header><text display-inline="no-display-inline">Section
			 236 of the Immigration and Nationality Act (8 U.S.C. 1226) is amended by adding
			 at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id0DD317896CC14B4EA5F8D0FCB5474616" style="OLC">
				<subsection id="IDe8bef6640efd4e8baa6610eb463e9e8a"><enum>(f)</enum><header>Notice and
				charges</header><text>Not later than 48 hours after the commencement of a
				detention of an individual under this section, the Secretary of Homeland
				Security shall—</text>
					<paragraph id="IDb09335b845bb40ebb824a1b1f21fdb62"><enum>(1)</enum><text>file a Notice to
				Appear or other relevant charging document with the immigration court closest
				to the location at which the individual was apprehended; and</text>
					</paragraph><paragraph id="IDe88d8a43cb764e5e96b4497a6352ae73"><enum>(2)</enum><text>serve such notice
				or charging document on the
				individual.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID770229ea3531480b970a6d716cc075c5"><enum>12.</enum><header>Procedures for
			 ensuring accuracy and verifiability of sworn statements taken pursuant to
			 expedited removal authority</header>
			<subsection id="ID48d5c2eb67ba424bb294584ec2f2b95f"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall establish quality assurance
			 procedures to ensure the accuracy and verifiability of signed or sworn
			 statements taken by employees of the Department of Homeland Security exercising
			 expedited removal authority under section 235(b) of the Immigration and
			 Nationality Act (8 U.S.C. 1225(b)).</text>
			</subsection><subsection id="IDf1e22f91e7954124ba51fed793ffc5fe"><enum>(b)</enum><header>Recording of
			 interviews</header>
				<paragraph id="id1993160696E844C5B805DA915B7F47FB"><enum>(1)</enum><header>In
			 general</header><text>Any sworn or signed written statement taken from an alien
			 as part of the record of a proceeding under section 235(b)(1)(A) of the
			 Immigration and Nationality Act shall be accompanied by a recording of the
			 interview which served as the basis for such sworn statement.</text>
				</paragraph><paragraph id="id58417CF130AF4EF18CD5E1B6D53C3903"><enum>(2)</enum><header>Content</header><text>The
			 recording shall include—</text>
					<subparagraph id="id801F97D2B3494EB685C0CB226ADDB279"><enum>(A)</enum><text>a reading of the
			 entire written statement to the alien in a language that the alien claims to
			 understand; and</text>
					</subparagraph><subparagraph id="id1DCB3B93469E49F4A14D1978D01010CE"><enum>(B)</enum><text>the verbal
			 affirmation by the alien of the accuracy of—</text>
						<clause id="id76A71AD1D8874E7D839C9EC205E7E0F7"><enum>(i)</enum><text>the
			 written statement; or</text>
						</clause><clause id="idDA671B07AE4F44DD9CF3DB433DEBE916"><enum>(ii)</enum><text>a
			 corrected version of the written statement.</text>
						</clause></subparagraph></paragraph><paragraph id="ID78f53aa3a324428b977b7e6bcb45682b"><enum>(3)</enum><header>Format</header><text>The
			 recording shall be made in video, audio, or other equally reliable
			 format.</text>
				</paragraph><paragraph id="ID7bcd6f53ad334fc596c54e4264b6ef73"><enum>(4)</enum><header>Evidence</header><text>Recordings
			 of interviews under this subsection may be considered as evidence in any
			 further proceedings involving the alien.</text>
				</paragraph></subsection><subsection id="IDb2f927dd82b44f67a7f70405bb68ac7d"><enum>(c)</enum><header>Exemption
			 authority</header>
				<paragraph id="IDbdf9c0ace4cb4dc3b9b8cd517921a2ec"><enum>(1)</enum><header>Exempted
			 facilities</header><text>Subsection (b) shall not apply to interviews that
			 occur at detention facilities exempted by the Secretary under this
			 subsection.</text>
				</paragraph><paragraph id="ID0b12f91bd4ea4020b3b42476f9cb8742"><enum>(2)</enum><header>Criteria</header><text>The
			 Secretary, or the Secretary’s designee, may exempt any detention facility if
			 compliance with subsection (b) at that facility would impair operations or
			 impose undue burdens or costs.</text>
				</paragraph><paragraph id="ID3e4883d4528c49dea13e256a057a3042"><enum>(3)</enum><header>Report</header><text>The
			 Secretary shall annually submit a report to Congress that identifies the
			 facilities that have been exempted under this subsection.</text>
				</paragraph><paragraph id="ID7480a6e4049542c19408b5c7bad5d85a"><enum>(4)</enum><header>No private
			 cause of action</header><text>Nothing in this subsection may be construed to
			 create a private cause of action for damages or injunctive relief.</text>
				</paragraph></subsection><subsection id="ID0e3d2ca06eb34a558394c07009874dbb"><enum>(d)</enum><header>Interpreters</header><text>The
			 Secretary shall ensure that a professional fluent interpreter is used
			 if—</text>
				<paragraph id="id2FB69F96801643D2BCEA8C65E0CA1CD4"><enum>(1)</enum><text>the interviewing
			 officer does not speak a language understood by the alien; and</text>
				</paragraph><paragraph id="id77FCBCCC90DF492581ACE9B13EFCB02A"><enum>(2)</enum><text>there is no other
			 Federal Government employee available who is able to interpret effectively,
			 accurately, and impartially.</text>
				</paragraph></subsection></section><section id="IDa542b6ff02a844d4a280c7f891e9f9c9"><enum>13.</enum><header>Study on the
			 effect of expedited removal provisions, practices, and procedures on asylum
			 claims</header>
			<subsection id="ID35d72c00d5ef4debbf5c9ef832f89d0c"><enum>(a)</enum><header>Study</header>
				<paragraph id="ID88315d0fb47f4f9e98c9659b52e38311"><enum>(1)</enum><header>In
			 general</header><text>The United States Commission on International Religious
			 Freedom (referred to in this section as the <quote>Commission</quote>) is
			 authorized to conduct a study to determine whether immigration officers
			 described in paragraph (2) are engaging in conduct described in paragraph
			 (3).</text>
				</paragraph><paragraph id="ID7a658c67d9b64650889edcf888551a5b"><enum>(2)</enum><header>Immigration
			 officers described</header><text>An immigration officer described in this
			 paragraph is an immigration officer performing duties under section 235(b) of
			 the Immigration and Nationality Act (8 U.S.C. 1225(b)) with respect to aliens
			 who—</text>
					<subparagraph id="id90E39CEA29F24CD28093D2C1354DF9E0"><enum>(A)</enum><text>are apprehended
			 after entering the United States; and</text>
					</subparagraph><subparagraph id="idFD12C30B9E304F92A133CA5AECBA3C81"><enum>(B)</enum><text>may be eligible
			 to apply for asylum under section 208 or 235 of such Act.</text>
					</subparagraph></paragraph><paragraph id="IDa3356e1817244eb58a8da698ac682e8b"><enum>(3)</enum><header>Conduct
			 described</header><text>An immigration officer engages in conduct described in
			 this paragraph if the immigration officer—</text>
					<subparagraph id="ID73d87ed39c9d455fa6db5ac2fb8dbbb8"><enum>(A)</enum><text>improperly
			 encourages an alien referred to in paragraph (2) to withdraw or retract claims
			 for asylum;</text>
					</subparagraph><subparagraph id="IDa91883f8c3bd41d5894abde073c2f25d"><enum>(B)</enum><text>incorrectly fails
			 to refer such an alien for an interview by an asylum officer to determine
			 whether the alien has a credible fear of persecution (as defined in section
			 235(b)(1)(B)(v) of such Act (8 U.S.C. 1225(b)(1)(B)(v)));</text>
					</subparagraph><subparagraph id="IDb15df3cad61c4d89add708304fdbbf4c"><enum>(C)</enum><text>incorrectly
			 removes such an alien to a country in which the alien may be persecuted;
			 or</text>
					</subparagraph><subparagraph id="ID20beb61cc0344c60b13404767d2f506c"><enum>(D)</enum><text>detains such an
			 alien improperly or under inappropriate conditions.</text>
					</subparagraph></paragraph></subsection><subsection id="ID5806f812d53c4f82b4bedf0f2630fe1f"><enum>(b)</enum><header>Report</header><text>Not
			 later than 2 years after the date on which the Commission initiates the study
			 under subsection (a), the Commission shall submit a report containing the
			 results of the study to—</text>
				<paragraph id="ID8c75f57b9ee34282958b67decddc887a"><enum>(1)</enum><text>the
			 <committee-name committee-id="SSGA00">Committee on Homeland Security and
			 Governmental Affairs of the Senate</committee-name>;</text>
				</paragraph><paragraph id="id140326DD58CE472DB6FCDA6B8A49ACA1"><enum>(2)</enum><text>the
			 <committee-name committee-id="SSJU00">Committee on the Judiciary of the
			 Senate</committee-name>;</text>
				</paragraph><paragraph id="id3D27FD2A726A41B6A6AE31A08E7032CE"><enum>(3)</enum><text>the
			 <committee-name committee-id="SSFR00">Committee on Foreign Relations of the
			 Senate</committee-name>;</text>
				</paragraph><paragraph id="idE0728BAF143F4C6ABD9B406E6164C654"><enum>(4)</enum><text>the
			 <committee-name committee-id="">Committee on Homeland Security of the House of
			 Representatives</committee-name>;</text>
				</paragraph><paragraph id="id518938A6338B4713944853B7EC6D2999"><enum>(5)</enum><text>the
			 <committee-name committee-id="">Committee on the Judiciary of the House of
			 Representatives</committee-name>; and</text>
				</paragraph><paragraph id="ID71a9f8e26c214b4a930ba1c2915b6f4c"><enum>(6)</enum><text>the
			 <committee-name committee-id="">Committee on Foreign Affairs of the House of
			 Representatives</committee-name>.</text>
				</paragraph></subsection><subsection id="IDd3746039cd1b404b972066dab1a9c150"><enum>(c)</enum><header>Staff</header>
				<paragraph id="IDcc9250096b6f47bd9ce210832dc02baf"><enum>(1)</enum><header>From other
			 agencies</header>
					<subparagraph id="id55419DF78B1F4644A88B1158AF20B0F5"><enum>(A)</enum><header>Identification</header><text>The
			 Commission may identify employees of the Department of Homeland Security, the
			 Department of Justice, and the Government Accountability Office that have
			 significant expertise and knowledge of refugee and asylum issues.</text>
					</subparagraph><subparagraph id="id7043278EF7944B978DF61A7D01635CAB"><enum>(B)</enum><header>Designation</header><text>At
			 the request of the Commission, the Secretary, the Attorney General, and the
			 Comptroller General of the United States shall authorize staff identified under
			 subparagraph (A) to assist the Commission in conducting the study under
			 subsection (a).</text>
					</subparagraph></paragraph><paragraph id="ID365f6bd124b043e69c399012870a07b4"><enum>(2)</enum><header>Additional
			 staff</header><text>The Commission may hire additional staff and consultants to
			 conduct the study under subsection (a).</text>
				</paragraph><paragraph id="IDa6ab8a78ec9c4813a090964e48df0296"><enum>(3)</enum><header>Access to
			 proceedings</header>
					<subparagraph id="id261D32B447E74F0DA5DA503E6647EED6"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), the Secretary and
			 the Attorney General shall provide staff designated under paragraph (1) or
			 hired under paragraph (2) with unrestricted access to all stages of all
			 proceedings conducted under section 235(b) of the Immigration and Nationality
			 Act (8 U.S.C. 1225(b)).</text>
					</subparagraph><subparagraph id="IDd2373796463a419a8239c3f7b198793c"><enum>(B)</enum><header>Exceptions</header><text>The
			 Secretary and the Attorney General may not permit unrestricted access under
			 subparagraph (A) if—</text>
						<clause id="ID97966ca146fd49f988db31f5b222f6c7"><enum>(i)</enum><text>the
			 alien subject to a proceeding under such section 235(b) objects to such access;
			 or</text>
						</clause><clause id="IDf56007bd43584fd3af962083d0bd5dc5"><enum>(ii)</enum><text>the Secretary or
			 Attorney General determines that the security of a particular proceeding would
			 be threatened by such access.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="ID4c62a38cb3ea454b9aafbb9c3a22ab06"><enum>14.</enum><header>Lawful
			 permanent resident status of refugees and asylum seekers granted
			 asylum</header>
			<subsection id="ID58eba4012e62487fa088aa32b8d6a95f"><enum>(a)</enum><header>Admission of
			 emergency situation refugees</header><text>Section 207(c) of the Immigration
			 and Nationality Act (8 U.S.C. 1157(c)) is amended—</text>
				<paragraph id="idEB15780141F040B49B94035AF42C0C41"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="id207A335DB9E74092A13B76173E17E63F"><enum>(A)</enum><text>by striking
			 <quote>Attorney General</quote> the first time it appears and inserting
			 <quote>Secretary of Homeland Security</quote>;</text>
					</subparagraph><subparagraph id="id6C596DFCDDE2437A97C324302FA1B328"><enum>(B)</enum><text>by striking
			 <quote>Attorney General</quote> each additional place it appears and inserting
			 <quote>Secretary</quote>; and</text>
					</subparagraph><subparagraph id="id577BAB660991477ABA056E1CEEA43769"><enum>(C)</enum><text>by striking
			 <quote>(except as otherwise provided under paragraph (3)) as an immigrant under
			 this Act.</quote> and inserting <quote>(except as provided under subsection (b)
			 and (c) of section 209) as an immigrant under this Act. Notwithstanding any
			 numerical limitations specified in this Act, any alien admitted under this
			 paragraph shall be regarded as lawfully admitted to the United States for
			 permanent residence as of the date of such alien’s admission to the United
			 States.</quote>;</text>
					</subparagraph></paragraph><paragraph id="id500D2218CF004F8FB638A59802E6B611"><enum>(2)</enum><text>in paragraph
			 (2)(A)—</text>
					<subparagraph id="id677D3685191B4301BDAB94F13E587CFE"><enum>(A)</enum><text>by striking
			 <quote>(except as otherwise provided under paragraph (3))</quote> and inserting
			 <quote>(except as provided under subsection (b) and (c) of section
			 209)</quote>; and</text>
					</subparagraph><subparagraph id="id84B97BA4148F4D43A1F983CB7D746EDF"><enum>(B)</enum><text>by striking the
			 last sentence and inserting the following: <quote>An alien admitted to the
			 United States as a refugee may petition for his or her spouse or child to
			 follow to join him or her in the United States at any time after such alien’s
			 admission, notwithstanding his or her treatment as a lawful permanent resident
			 as of the date of his or her admission to the United States.</quote>;</text>
					</subparagraph></paragraph><paragraph id="idC70A1658DED94F559722B84C667DAB6D"><enum>(3)</enum><text>by striking
			 paragraph (3);</text>
				</paragraph><paragraph id="id36334C5A38174F5A8173F1CC03184E58"><enum>(4)</enum><text>by redesignating
			 paragraph (4) as paragraph (3); and</text>
				</paragraph><paragraph id="id5D0F84E265DB41BCB68299EC3A181BC6"><enum>(5)</enum><text>in paragraph (3),
			 as redesignated—</text>
					<subparagraph id="id3ACB0F4BA88942AFA6B71A81E9E1A219"><enum>(A)</enum><text>by striking
			 <quote>Attorney General</quote> the first time it appears and inserting
			 <quote>Secretary of Homeland Security</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1C151B7593524184B67430F836633D7D"><enum>(B)</enum><text>by striking
			 <quote>Attorney General</quote> each additional place it appears and inserting
			 <quote>Secretary</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="ID9a2ca678ffe7470382a1ab23bd0c3a95"><enum>(b)</enum><header>Treatment of
			 spouse and children</header><text>Section 208(b)(3) of such Act (8 U.S.C.
			 1158(b)(3)) is amended—</text>
				<paragraph id="idB4ECB2E413984E9EA2B0E6EDDC17AABB"><enum>(1)</enum><text>by redesignating
			 subparagraph (B) as subparagraph (E); and</text>
				</paragraph><paragraph id="idF5602897E9FD4666B59F07039335B76E"><enum>(2)</enum><text>by inserting
			 after subparagraph (A) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idDEFFAE951BA94F738B67A9DE770065D1" style="OLC">
						<subparagraph id="ID60561c93c3b44a45ac2c9b4c44cbddad"><enum>(B)</enum><header>Petition</header><text>An
				alien granted asylum under this subsection may petition for the same status to
				be conferred on his or her spouse or child at any time after such alien is
				granted asylum whether or not such alien has applied for, or been granted,
				adjustment to permanent resident status under section 209.</text>
						</subparagraph><subparagraph id="id809E80FC31A44FBBB14C365BF13DFDC0"><enum>(C)</enum><header>Permanent
				resident status</header><text>Notwithstanding any numerical limitations
				specified in this Act, a spouse or child admitted to the United States as an
				asylee following to join a spouse or parent previously granted asylum shall be
				regarded as lawfully admitted to the United States for permanent residence as
				of the date of such spouse’s or child’s admission to the United States.</text>
						</subparagraph><subparagraph id="idFBE07C199F5C458BA8FD42CCAB23E406"><enum>(D)</enum><header>Application for
				adjustment of status</header><text>A spouse or child who was not admitted to
				the United States pursuant to a grant of asylum, but who was granted asylum
				under this subparagraph after his or her arrival as the spouse or child of an
				alien granted asylum under section 208, may apply for adjustment of status to
				that of lawful permanent resident under section 209 at any time after being
				granted
				asylum.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDcd890bb159494ea8a6c256975726f7dd"><enum>(c)</enum><header>Refugees</header>
				<paragraph id="id7DF9DD9796FC49CFAACE0FAE617212B0"><enum>(1)</enum><header>In
			 general</header><text>Section 209 of such Act (8 U.S.C. 1159) is amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="id8ADF915FC4E945348C932218832EBEA2" style="OLC">
						<section id="id117DFA4753404CDD9A3DC1FC1D1356FC"><enum>209.</enum><header>Treatment of
				aliens admitted as refugees and of aliens granted asylum</header>
							<subsection commented="no" display-inline="no-display-inline" id="id6D376C08151F4B4FB4FAD0E5CB69753D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id234599CA83844662962FA5ECCB23F90E"><enum>(1)</enum><header display-inline="yes-display-inline">Treatment of refugees</header><text display-inline="yes-display-inline">Notwithstanding any numerical limitations
				specified in this Act, any alien who has been admitted to the United States
				under section 207 shall be regarded as lawfully admitted to the United States
				for permanent residence as of the date of such admission.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37AAA611A5CB405DB6B0E1C02391B521"><enum>(2)</enum><header>Treatment of
				spouse and children</header><text display-inline="yes-display-inline">Notwithstanding any numerical limitations
				specified in this Act, any alien admitted to the United States under section
				208(b)(3) as the spouse or child of an alien granted asylum under section
				208(b)(1) shall be regarded as lawfully admitted to the United States for
				permanent residence as of the date of such admission.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8BF864CA18494442936E69F9422CE73D"><enum>(3)</enum><header>Adjustment of
				status</header><text display-inline="yes-display-inline">The Secretary of
				Homeland Security or the Attorney General, in the discretion of the Secretary
				or the Attorney General, and under such regulations as the Secretary or the
				Attorney General may prescribe, may adjust, to the status of an alien lawfully
				admitted to the United States for permanent residence, the status of any alien
				who, while in the United States—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id3554FF86A54F4D51B7F44F374965AD4A"><enum>(A)</enum><text display-inline="yes-display-inline">is granted—</text>
										<clause commented="no" display-inline="no-display-inline" id="id6176FD3EC0934C3EB33B94E76C599F70"><enum>(i)</enum><text display-inline="yes-display-inline">asylum under section 208(b) (as a principal
				alien or as the spouse or child of an alien granted asylum); or</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="id02F7498B95474CFC87F48FAC624BDF0D"><enum>(ii)</enum><text display-inline="yes-display-inline">refugee status under section 207 as the
				spouse or child of a refugee;</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEC0D7030FD81442899C1BE7B65B4BC67"><enum>(B)</enum><text display-inline="yes-display-inline">applies for such adjustment of status at
				any time after being granted asylum or refugee status;</text>
									</subparagraph><subparagraph id="ID71dc218c21d0445690ae766af30ff70b"><enum>(C)</enum><text>is not firmly
				resettled in any foreign country; and</text>
									</subparagraph><subparagraph id="ID5d19cd5dbabb4d91aece61e6c2b981b8"><enum>(D)</enum><text>is admissible
				(except as otherwise provided under subsections (b) and (c)) as an immigrant
				under this Act at the time of examination for adjustment of such alien.</text>
									</subparagraph></paragraph><paragraph id="ID2eb7f85708544801952bd3a9f81ad5c8"><enum>(4)</enum><header>Record</header><text>Upon
				approval of an application under this subsection, the Secretary of Homeland
				Security or the Attorney General shall establish a record of the alien’s
				admission for lawful permanent residence as of the date such alien was granted
				asylum or refugee status.</text>
								</paragraph><paragraph id="IDcd4e9e84f4bf4aa69664be2e93176408"><enum>(5)</enum><header>Document
				issuance</header><text>An alien who has been admitted to the United States
				under section 207 or 208 or who adjusts to the status of a lawful permanent
				resident as a refugee or asylee under this section shall be issued
				documentation indicating that such alien is a lawful permanent resident
				pursuant to a grant of refugee or asylum status.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id4CC0444C67E74121A840C08218FF5150"><enum>(b)</enum><header display-inline="yes-display-inline">Inapplicability of certain inadmissibility
				grounds to refugees, aliens granted asylum, and such aliens seeking adjustment
				of status to lawful permanent resident</header><text display-inline="yes-display-inline">Paragraphs (4), (5), and (7)(A) of section
				212(a) shall not apply to—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idDAF0678051D04BD79D6620EAF3A21435"><enum>(1)</enum><text display-inline="yes-display-inline">any refugee under section 207;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id25B9D96469BF4E88B55678E278D71848"><enum>(2)</enum><text display-inline="yes-display-inline">any alien granted asylum under section 208;
				or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD2F0452D200646F588941C0EEBB53427"><enum>(3)</enum><text display-inline="yes-display-inline">any alien seeking admission as a lawful
				permanent resident pursuant to a grant of refugee or asylum status.</text>
								</paragraph></subsection><subsection id="ID3b1a4d288b734714a132132f1b5ce5f1"><enum>(c)</enum><header>Waiver of
				inadmissibility or deportability for refugees, aliens granted asylum, and such
				aliens seeking adjustment of status to lawful permanent resident</header>
								<paragraph id="IDcbb5e1186c7749c3b61126745b0f00f7"><enum>(1)</enum><header>In
				general</header><text>Except as provided in paragraph (2), the Secretary of
				Homeland Security or the Attorney General may waive any ground of
				inadmissibility under section 212 or any ground of deportability under section
				237 for a refugee admitted under section 207, an alien granted asylum under
				section 208, or an alien seeking admission as a lawful permanent resident
				pursuant to a grant of refugee or asylum status if the Secretary or the
				Attorney General determines that such waiver is justified by humanitarian
				purposes, to ensure family unity, or is otherwise in the public
				interest.</text>
								</paragraph><paragraph id="ID9217c5f561504355a12972e9e824415c"><enum>(2)</enum><header>Ineligibility</header><text>A
				refugee under section 207, an alien granted asylum under section 208, or an
				alien seeking admission as a lawful permanent resident pursuant to a grant of
				refugee or asylum status shall be ineligible for a waiver under paragraph (1)
				if it has been established that the alien is—</text>
									<subparagraph id="id69612636AD8E47199C80A05D1290B112"><enum>(A)</enum><text>inadmissible
				under section 212(a)(2)(C) or subparagraph (A), (B), (C), or (E) of section
				212(a)(3);</text>
									</subparagraph><subparagraph id="id32F3B3A14CD143F78E2D1CCB2D3405D8"><enum>(B)</enum><text>deportable under
				section 237(a)(2)(A)(iii) for an offense described in section 101(a)(43)(B);
				or</text>
									</subparagraph><subparagraph id="id7FBAFE9E369B41DABD1DBFFC1D6C03D9"><enum>(C)</enum><text>deportable under
				subparagraph (A), (B), (C), or (D) of section
				237(a)(4).</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID594c87aa6df74960bc54dfa8d07aeee3"><enum>(d)</enum><header>Technical
			 amendments</header>

				</paragraph></subsection><subsection id="id9B5C091F69D1455C8D26F9C7A792EDFC"><enum>(f)</enum><header>Effective
			 date</header><text>This section, and the amendments made by this section, shall
			 become effective on the earlier of—</text>
				<paragraph id="id446BFA69897F4FB8BB5C7797598DD713"><enum>(1)</enum><text>the date that is
			 180 days after the date of the enactment of this Act; or</text>
				</paragraph><paragraph id="id98F701753AC344239C159ACBDE1A2735"><enum>(2)</enum><text>the date on which
			 a final rule is promulgated to implement this section.</text>
				</paragraph></subsection></section><section id="ID033b9316490640c7a7aa240f99f0bda0"><enum>15.</enum><header>Protections for
			 minors seeking asylum</header>
			<subsection id="IDdebf9e7dfba849de9892c8776739e5b4"><enum>(a)</enum><header>In
			 general</header><text>Section 208 of the Immigration and Nationality Act (8
			 U.S.C. 1158) is amended—</text>
				<paragraph id="id3956C41D65794C898B5C5C8CD19B186F"><enum>(1)</enum><text>in subsection
			 (a)(2), as amended by section 3, by adding at the end the following:</text>

						<subparagraph id="id11145C284F9E4F1F902FB20ADB5C60FC"><enum>(D)</enum><header>Applicability
				to minors</header><text>Subparagraphs (A), (B), and (C) do not apply to an
				applicant who is younger than 18 years of age on the earlier of—</text>
							<clause id="id537E3B7943EE464CAF5F100A28A51712"><enum>(i)</enum><text>the date on which
				the asylum application is filed; or</text>

				issued.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID5173ee1e4d6a4d8b95a47f1dc1234447"><enum>(b)</enum><header>Reinstatement
			 of removal</header><text>Section 241(a) of the Immigration and Nationality Act
			 (8 U.S.C. 1231(a)) is amended—</text>
				<paragraph id="id7C9F9893555C45B389238F7AB1C62BB1"><enum>(1)</enum><text>in paragraph (5),
			 by striking <quote>If the Attorney General</quote> and inserting <quote>Except
			 as provided in paragraph (8), if the Secretary of Homeland Security</quote>;
			 and</text>
				</paragraph><paragraph id="idD9AE84C1A0BE41BB81B2A7754481EDF7"><enum>(2)</enum><text>by adding at the
			 end of the following:</text>

						<paragraph id="ID328351dc9b984419ae1c6c3ede474a20"><enum>(8)</enum><header>Applicability
				of reinstatement of removal</header><text>Paragraph (5) shall not apply to an
				alien who has reentered the United States illegally after having been removed
				or having departed voluntarily, under an order of removal, if the alien was
				younger than 18 years of age on the date on which the alien was removed or
				departed voluntarily under an order of
				removal.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID025eb7936b3c4b92a6a4257e69b3f644"><enum>16.</enum><header>Multiple forms
			 of relief</header>
			<subsection id="id42148B0557954F15858E8824158D1A02"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Applicants for
			 admission as refugees may simultaneously pursue admission under any visa
			 category for which such applicants may be eligible.</text>
			</subsection><subsection id="id96DA30260819400AA4CDEF89101EEE93"><enum>(b)</enum><header>Asylum
			 applicants who become eligible for diversity visas</header><text>Section
			 204(a)(1)(I) (8 U.S.C. 1154(a)(1)(I)) of the Immigration and Nationality Act (8
			 U.S.C. 1154(a)(1)(I)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id35BAD862A7514000BF3D1AF5A03BE00D" style="OLC">
					<clause id="ID2f39eef7eee5408e90080728435a9455" indent="up3"><enum>(iv)</enum><subclause commented="no" display-inline="yes-display-inline" id="id7B3F2DAC2A3B49A79146B5A71A063FD2"><enum>(I)</enum><text>An asylum seeker in the
				United States who is notified that he or she is eligible for an immigrant visa
				pursuant to section 203(c) may file a petition with the district director that
				has jurisdiction over the district in which the asylum seeker resides (or, in
				the case of an asylum seeker who is or was in removal proceedings, the
				immigration court in which the removal proceeding is pending or was
				adjudicated) to adjust status to that of a permanent resident.</text>
						</subclause><subclause id="id9ACB8A92699D49EEB21B89622CD931E1" indent="up1"><enum>(II)</enum><text>A petition under subclause (I) shall
				be filed not later than 30 days before the end of the fiscal year for which the
				petitioner received notice of eligibility for the visa and shall contain such
				information and be supported by such documentary evidence as the Secretary of
				State may require.</text>
						</subclause><subclause id="id8B9B7418FB7B49418ED7548C61CA4D55" indent="up1"><enum>(III)</enum><text>The district director or
				immigration court shall attempt to adjudicate each petition under this clause
				before the last day of the fiscal year for which the petitioner was selected.
				Notwithstanding clause (ii)(II), if the district director or immigration court
				is unable to complete such adjudication during such fiscal year, the
				adjudication and adjustment of the petitioner’s status may take place after the
				end of such fiscal
				year.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="ID555a6dc73825480f9e231198b2d02589"><enum>17.</enum><header>Protection of
			 refugee families</header>
			<subsection id="ID5d225482f6be44ba975a4d6e93f53a11"><enum>(a)</enum><header>Children of
			 refugee or asylee spouses and children</header><text>A child of an alien who
			 qualifies for admission as a spouse or child under section 207(c)(2)(A) or
			 208(b)(3) of the Immigration and Nationality Act (8 U.S.C. 1157(c)(2)(A) and
			 1158(b)(3)) shall be entitled to the same admission status as such alien if the
			 child—</text>
				<paragraph id="IDa5e7b981f61543e68357c3fd1cb40f37"><enum>(1)</enum><text>is accompanying
			 or following to join such alien; and</text>
				</paragraph><paragraph id="ID33aadedf40c248e5962976831c95bb05"><enum>(2)</enum><text>is otherwise
			 admissible under such section 207(c)(2)(A) or 208(b)(3).</text>
				</paragraph></subsection><subsection id="ID8873c334c0254043be409c5dc8d79402"><enum>(b)</enum><header>Separated
			 children</header><text>A child younger than 18 years of age who has been
			 separated from the birth or adoptive parents of such child and is living under
			 the care of an alien who has been approved for admission to the United States
			 as a refugee shall be admitted as a refugee if—</text>
				<paragraph id="ID33f3a03940d44968b4826fb2f35cb54c"><enum>(1)</enum><text>it is in the best
			 interest of such child to be placed with such alien in the United States;
			 and</text>
				</paragraph><paragraph id="ID63e6abb5c5f149eda19350337ce184fb"><enum>(2)</enum><text>such child is
			 otherwise admissible under section 207(c)(3) of the Immigration and Nationality
			 Act (8 U.S.C. 1157(c)(3)).</text>
				</paragraph></subsection><subsection id="IDf1782eb9df96476b94f625afaed584c1"><enum>(c)</enum><header>Elimination of
			 time limits on reunification of refugee and asylee families</header>
				<paragraph id="id632E74294A8A4ED28856B9718D7C69B9"><enum>(1)</enum><header>Emergency
			 situation refugees</header><text>Section 207(c)(2)(A) of the Immigration and
			 Nationality Act (8 U.S.C. 1157(c)(2)(A)) is amended by striking <quote>A spouse
			 or child (as defined in section 101(b)(1) (A), (B), (C), (D), or (E))</quote>
			 and inserting, <quote>Regardless of when such refugee was admitted to the
			 United States, a spouse or child (other than a child described in section
			 101(b)(1)(F))</quote>.</text>
				</paragraph><paragraph id="ID4aaa6c90a1a8498e89922a76307977b8"><enum>(2)</enum><header>Asylum</header><text>Section
			 208(b)(3)(A) of such Act (8 U.S.C. 1158(b)(3)(A)) is amended to read as
			 follows:</text>
					<quoted-block display-inline="no-display-inline" id="id5590D08B1F844B82AB335624BABA46A3" style="OLC">
						<subparagraph id="idEF090B9D39EA432983A83656A327310D"><enum>(A)</enum><header>In
				general</header><text>A spouse or child (other than a child described in
				section 101(b)(1)(F)) of an alien who was granted asylum under this subsection
				at any time may, if not otherwise eligible for asylum under this section, be
				granted the same status as the alien if accompanying or following to join such
				alien.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID2bde079441fe4204aae91d4229855f4c"><enum>(d)</enum><header>Timely
			 adjudication of refugee and asylee family reunification
			 petitions</header><text>The Immigration and Nationality Act (8 U.S.C. 1101 et
			 seq.) is amended—</text>
				<paragraph id="ID0aa94deeb6cc4ddaa2c9716ffb1b5850"><enum>(1)</enum><text>in section
			 207(c)(2), as amended by subsection (c), by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id5082343718CB437F9A621D3FA633D6E6" style="OLC">
						<subparagraph id="idF28BFACC3AD64A2187D2024272265CC1" indent="up2"><enum>(D)</enum><text>The Secretary shall ensure that the
				application of an alien who is following to join a refugee who qualifies for
				admission under paragraph (1) is adjudicated not later than 90 days after the
				submission of such application.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID8afe58f4173f4f8894f2663dbea07fe4"><enum>(2)</enum><text>in section
			 208(b)(3), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id189DB9A25C5A498997DA124A9AACE288" style="OLC">
						<subparagraph id="idBED8C9F9FD4C4F6EAE5D10607C53EA04"><enum>(G)</enum><header>Timely
				adjudication</header><text>The Secretary shall ensure that the application of
				each alien described in subparagraph (A) who applies to follow an alien granted
				asylum under this subsection is adjudicated not later than 90 days after the
				submission of such
				application.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID0caa07e426e54e24aaf455035fe9cfc1"><enum>18.</enum><header>Reform of
			 refugee consultation process and refugee processing</header><text display-inline="no-display-inline">Section 207 of the Immigration and
			 Nationality Act (8 U.S.C. 1157) is amended—</text>
			<paragraph id="idC1F135F9B68F4129950E8BE01BBCE192"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id5D1D14178C5B4E77BB3237BB78F2B58E" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="idDB9C5C9237F44D67A684992431EE0A2A" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">All officers of the Federal Government
				responsible for refugee admissions or refugee resettlement shall treat the
				determinations made under this subsection and subsection (b) as the refugee
				admissions goal for the fiscal
				year.</text>
					</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idB681BA693628480587ABAE799A5046E0"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d), by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idCF6A3D443C654338BED8069B6E20FA22" style="OLC">
					<paragraph id="idB88B4D47DE6F47D0A3C26690B3D68914" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Not later than 15 days after the last day
				of each calendar quarter, the President shall submit a report to the
				<committee-name committee-id="SSJU00">Committee on the Judiciary of the
				Senate</committee-name> and the <committee-name committee-id="">Committee on
				the Judiciary of the House of Representatives</committee-name> that
				contains—</text>
						<subparagraph id="id1EF476E16B1548DDA825E6117E096057"><enum>(A)</enum><text display-inline="yes-display-inline">the number of refugees who were admitted
				during the previous quarter;</text>
						</subparagraph><subparagraph id="idDBA3280CBD764E5D8BD074E8BFF27E98"><enum>(B)</enum><text display-inline="yes-display-inline">the percentage of those arrivals against
				the refugee admissions goal for such quarter;</text>
						</subparagraph><subparagraph id="idFF327A5A317F4BD099D881E4B2B4A5FD"><enum>(C)</enum><text display-inline="yes-display-inline">the cumulative number of refugees who were
				admitted during the fiscal year as of the end of such quarter;</text>
						</subparagraph><subparagraph id="idE5F42156F8B84078A3E109626E517A5B"><enum>(D)</enum><text display-inline="yes-display-inline">the number of refugees to be admitted
				during the remainder of the fiscal year in order to meet the refugee admissions
				goal for the fiscal year; and</text>
						</subparagraph><subparagraph id="id70CC56351DDF49DAB28674AD0CE434B2"><enum>(E)</enum><text display-inline="yes-display-inline">a
				plan that describes the procedural or personnel changes necessary to achieve
				the refugee admissions goal for the fiscal
				year.</text>
						</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idCEB6EC060EF14CC2B0972393A83A6841"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (e)—</text>
				<subparagraph id="idA6912538E2C64BAF8579CD6B89BADE48"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) through (7)
			 as subparagraphs (A) through (G), respectively;</text>
				</subparagraph><subparagraph id="id590F281FA23348AD8CD48A9F5EFD280C"><enum>(B)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 as redesignated—</text>
					<clause id="idC4407846877D41498421F8948191ADAE"><enum>(i)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> after
			 <quote>(e)</quote>; and</text>
					</clause><clause id="id1E761B4EF8A6402AA5914B563E501857"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting <quote>, which shall be
			 commenced not later than May 1 of each year and continue periodically
			 throughout the remainder of the year, if necessary,</quote> after
			 <quote>discussions in person</quote>;</text>
					</clause></subparagraph><subparagraph id="idC80089E8C3DF498EBCC53A3698E34BF3"><enum>(C)</enum><text>by striking
			 <quote>To the extent possible,</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2BA6E9C7494D4107BBBC9A8470C2DE82" style="OLC">
						<paragraph id="id1536D43C3F9140C3A9D1B797E9ECD31E" indent="up1"><enum>(2)</enum><text>To the extent
				possible</text>
						</paragraph><after-quoted-block>;

				</subparagraph><subparagraph id="idD939284D910148479343507F93717352"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id56C9B7C9AF3A4D57A763566A9DA031C7" style="OLC">
						<paragraph id="id589E4A8DC4FD40F4B421C841107CAD15" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id90EDA522638C4C37B76C8A5A93C5E762"><enum>(A)</enum><text>The plans referred to
				in paragraph (1)(C) shall include estimates of—</text>
								<clause id="id0E1097E9184C44D8B3EC95CA8670F143" indent="up1"><enum>(i)</enum><text>the number of refugees the President
				expects to have ready to travel to the United States at the beginning of the
				fiscal year;</text>
								</clause><clause id="id41AC6E665174464C95EC621C18184CCB" indent="up1"><enum>(ii)</enum><text>the number of refugees and the
				stipulated populations the President expects to admit to the United States in
				each quarter of the fiscal year; and</text>
								</clause><clause id="id02B717D8F0FF461E9F327E8D2CE77C41" indent="up1"><enum>(iii)</enum><text>the number of refugees the President
				expects to have ready to travel to the United States at the end of the fiscal
				year.</text>
								</clause></subparagraph><subparagraph id="id8FB10D734F3A470481E9631182B754D3" indent="up1"><enum>(B)</enum><text>The Secretary of Homeland Security
				shall ensure that an adequate number of refugees are processed during the
				fiscal year to fulfill the refugee admissions goals under subsections (a) and
				(b).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section id="ID25e5ab409cc549dab79b1b5554b399dc"><enum>19.</enum><header>Admission of
			 refugees in the absence of the annual presidential determination</header><text display-inline="no-display-inline">Section 207(a) of the Immigration and
			 Nationality Act (8 U.S.C. 1157(a)) is amended—</text>
			<paragraph id="idF3CD443B4F1D40A3BCEAB82C99CEB707"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (1);</text>
			</paragraph><paragraph id="id4782A9AE37D54AA7B59B04084B08C58A"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2), (3), (4),
			 and (5) as paragraphs (1), (2), (3), and (4), respectively;</text>
			</paragraph><paragraph id="id832977C0F8CA4FB694B9E250CEFC8E00"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (1), as redesignated—</text>
				<subparagraph id="id32939BEA4A464094A81627F5E8D1386C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>after fiscal year
			 1982</quote>; and</text>
				</subparagraph><subparagraph id="id967631B777C24CA38A2CCD1C4EE1100A"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:
			 <quote>If the President does not issue a determination under this paragraph
			 before the beginning of a fiscal year, the number of refugees that may be
			 admitted under this section in each quarter before the issuance of such
			 determination shall be 25 percent of the number of refugees admissible under
			 this section during the previous fiscal year.</quote>; and</text>
				</subparagraph></paragraph><paragraph id="id01103235222941AB866734E4E44BC7AE"><enum>(4)</enum><text>in paragraph (3),
			 as redesignated, by striking <quote>(beginning with fiscal year
			 1992)</quote>.</text>
			</paragraph></section><section id="ID7cb676ea25a14e9288492762e7573196"><enum>20.</enum><header>Authority to
			 designate certain groups of refugees for consideration</header>
			<subsection id="IDe344f589bd584e53ac455cb1f8a8e3dd"><enum>(a)</enum><header>In
			 general</header><text>Section 207(c)(1) of the Immigration and Nationality Act
			 (8 U.S.C. 1157(c)(1)) is amended—</text>
				<paragraph id="idC9ADAE2C5A8B40FAA5CD5AE72B7C2FB1"><enum>(1)</enum><text>by inserting
			 <quote>(A)</quote> before <quote>Subject to the numerical limitations</quote>;
			 and</text>
				</paragraph><paragraph id="id6D5A07B26A404AB18A9346A542F71D1C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA1C9209FC15046F38EADA0510F048447" style="OLC">
						<subparagraph id="IDa96a339700024f21a94eb812f90c3d01" indent="up2"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idB5060E7337814D28845BB93CD208B146"><enum>(i)</enum><text>The Secretary of State,
				after notification to Congress, may designate specifically defined groups of
				aliens whose resettlement in the United States is justified by humanitarian
				concerns or is otherwise in the national interest and who share common
				characteristics that identify them as targets of persecution on account of
				race, religion, nationality, membership in a particular social group, or
				political opinion or who otherwise have a shared need for resettlement due to
				vulnerabilities or a lack of local integration prospects in their country of
				first asylum.</text>
							</clause><clause id="id825A9E9541AE4A1998CD6C0DC7400656" indent="up1"><enum>(ii)</enum><text>An alien who establishes membership
				in a group designated under clause (i) to the satisfaction of the designee of
				the Secretary of Homeland Security shall establish, for purposes of admission
				as a refugee under this section, that such alien has a well-founded fear of
				persecution on account of race, religion, nationality, membership in a
				particular social group, or political opinion.</text>
							</clause><clause id="id4C0EA965E54446339F693ADBE3DE9D82" indent="up1"><enum>(iii)</enum><text>A designation under clause
				(i)—</text>
								<subclause id="id81C17BF1DDF544E4AA081E8C26935A80"><enum>(I)</enum><text>shall expire at the end of each fiscal
				year; and</text>
								</subclause><subclause id="idE24CACBE462D425D834610426D7E8EBE"><enum>(II)</enum><text>may be extended by the Secretary of
				State after notification to Congress.</text>
								</subclause></clause><clause id="id8B70DBA5B69C412EA36244860BFE6F12" indent="up1"><enum>(iv)</enum><text>An alien’s admission under this
				subparagraph shall count against the refugee admissions goal under subsection
				(a).</text>
							</clause><clause id="id1B659FE008AF419BBFE52601784A734F" indent="up1"><enum>(v)</enum><text>A designation under clause (i) shall
				not influence decisions to grant, to any alien, asylum under section 208,
				protection under section 241(b)(3), or protection under the Convention Against
				Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, done at
				New York December 10,
				1984.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID3c8d05419d7c42bb914ff937fd54a0c7"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on the
			 first day of the first fiscal year that begins after the date of the enactment
			 of this Act.</text>
			</subsection></section><section id="IDccda267189614ec1af3cb93e7a01677a"><enum>21.</enum><header>Update of
			 reception and placement grants</header><text display-inline="no-display-inline">Beginning with fiscal year 2012, not later
			 than 30 days before the beginning of each fiscal year, the Secretary shall
			 notify Congress of the amount of funds that the Secretary will provide in its
			 Reception and Placement Grants in the coming fiscal year. In setting the amount
			 of such grants each year, the Secretary shall ensure that—</text>
			<paragraph id="ID2446d4d327164a7e89ecb0371bf46b32"><enum>(1)</enum><text>the grant amount
			 is adjusted so that it is adequate to provide for the anticipated initial
			 resettlement needs of refugees, including adjusting the amount for inflation
			 and the cost of living;</text>
			</paragraph><paragraph id="IDc5c8d03f3f7e436b9adca6cb82e73a2c"><enum>(2)</enum><text>an amount is
			 provided at the beginning of the fiscal year to each national resettlement
			 agency that is sufficient to ensure adequate local and national capacity to
			 serve the initial resettlement needs of refugees the Secretary anticipates the
			 agency will resettle throughout the fiscal year; and</text>
			</paragraph><paragraph id="IDbca2a4da89bf40aca90c17153def8560"><enum>(3)</enum><text>additional
			 amounts are provided to each national resettlement agency promptly upon the
			 arrival of refugees that, exclusive of the amounts provided pursuant to
			 paragraph (2), are sufficient to meet the anticipated initial resettlement
			 needs of such refugees and support local and national operational costs in
			 excess of the estimates described in paragraph (1).</text>
			</paragraph></section><section id="id643808D88A8F45D2ADF8B33EED0751A4"><enum>22.</enum><header>Legal
			 assistance for refugees and asylees</header><text display-inline="no-display-inline">Section 412(c)(1)(A) of the Immigration and
			 Nationality Act (8 U.S.C. 1522(c)(1)(A)) is amended—</text>
			<paragraph id="id049B30ED56C5434DAA805197365768FD"><enum>(1)</enum><text>in clause (ii),
			 by striking <quote>and</quote> at an end;</text>
			</paragraph><paragraph id="id80D4B530FA1D4394B655228E822E97C8"><enum>(2)</enum><text>by redesignating
			 clause (iii) as clause (iv); and</text>
			</paragraph><paragraph id="idBD499504674D4676BE611D9C9CDE2F74"><enum>(3)</enum><text>by inserting
			 after clause (ii) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id699A6F3CE39340CD920F65847B359574" style="OLC">
					<clause id="ID06a053f8fc334e28a2be53754cf1771c" indent="up2"><enum>(iii)</enum><text>to provide legal services for
				refugees to assist them in obtaining immigration benefits for which they are
				eligible;
				and</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID2a6bdcbbe4bd4e83b930e9384e6dec81"><enum>23.</enum><header>Protection for
			 aliens interdicted at sea</header><text display-inline="no-display-inline">Section 241(b)(3) of the Immigration and
			 Nationality Act (8 U.S.C. 1231(b)(3)) is amended—</text>
			<paragraph id="ID5513d3ab639c4a82a66902cb055945bf"><enum>(1)</enum><text>in the paragraph
			 heading, by striking <quote><header-in-text level="paragraph" style="OLC">to a
			 country where alien’s life or freedom would be
			 threatened</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">or return if refugee’s life or freedom would be
			 threatened or alien would be subjected to
			 torture</header-in-text></quote>;</text>
			</paragraph><paragraph id="id48678121C3114200A84780AA0528B768"><enum>(2)</enum><text>in subparagraph
			 (A)—</text>
				<subparagraph id="id12D4F6401FC448E9A9E1E705C7D9B18E"><enum>(A)</enum><text>by striking
			 <quote>Notwithstanding</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id852FD0AB61024A5E8E44D5D2FE220832" style="OLC">
						<clause id="id4523F58E219544BAA3418048A0DAFC34"><enum>(i)</enum><header>Life or freedom
				threatened</header><text>Notwithstanding</text>

				</subparagraph><subparagraph id="id9C9EA600FB2944E19B6B24D7CD666BF1"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id374D2C35D21548019E79064A7DD60A35" style="OLC">
						<clause id="ID62af84fc96e34cbbb4457387e31f133f"><enum>(ii)</enum><header>Asylum
				interview</header><text>Notwithstanding paragraphs (1) and (2), a United States
				officer may not return any alien interdicted or otherwise encountered in
				international waters or United States waters who has expressed a fear of return
				to his or her country of departure, origin, or last habitual residence—</text>
							<subclause id="idEEB1E45FA14B47A09656BFE81286764F"><enum>(I)</enum><text>until such alien
				has had the opportunity to be interviewed by an asylum officer to determine
				whether that alien has a well-founded fear of persecution because of the
				alien’s race, religion, nationality, membership in a particular social group,
				or political opinion, or because the alien would be subject to torture in that
				country; or</text>
							</subclause><subclause id="id29AD1C4A2B994227AB52D0A2F26716A9"><enum>(II)</enum><text>if an asylum
				officer has determined that the alien has such a well-founded fear of
				persecution or would be subject to torture in his or her country of departure,
				origin, or last habitual
				residence.</text>
							</subclause></clause><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="idAB0ED62CBE994B6BA3DCFE2D8DC83BC3"><enum>(3)</enum><text>by redesignating
			 subparagraphs (B) and (C) as subparagraphs (C) and (D), respectively;
			 and</text>
			</paragraph><paragraph id="id73A197DE95C64233BE7C7E3118DC77F2"><enum>(4)</enum><text>by inserting
			 after subparagraph (A) the following:</text>
				<quoted-block display-inline="no-display-inline" id="idA0EA06F6807F4410A6E6D6A450A4DA36" style="OLC">
					<subparagraph id="ID41a51380a93649d3bea4a6aa14aeeacb"><enum>(B)</enum><header>Protections for
				aliens interdicted in international or United States waters</header><text>The
				Secretary of Homeland Security shall issue regulations establishing a uniform
				procedure applicable to all aliens interdicted in international or United
				States waters that—</text>
						<clause id="ID069c65708fa0463c822e96f6a6c0e426"><enum>(i)</enum><text>provides each
				alien—</text>
							<subclause id="id34128A2408A64EDD9BD3C99C0F13FF58"><enum>(I)</enum><text>a meaningful
				opportunity to express, through a translator who is fluent in a language the
				alien claims to understand, a fear of return to his or her country of
				departure, origin, or last habitual residence; and</text>
							</subclause><subclause id="IDde2cb7fb7255477f96a4342fd7ae20fa"><enum>(II)</enum><text>in a
				confidential setting and in a language the alien claims to understand,
				information concerning the alien’s interdiction, including the ability to
				inform United States officers about any fears relating to the alien’s return or
				repatriation;</text>
							</subclause></clause><clause id="IDf4d48dd3ef19498797359d5eb6e28f81"><enum>(ii)</enum><text>provides each
				alien expressing such a fear of return or repatriation a confidential interview
				conducted by an asylum officer, in a language the alien claims to understand,
				to determine whether the alien’s return to his or her country of origin or
				country of last habitual residence is prohibited because the alien has a
				well-founded fear of persecution—</text>
							<subclause id="idFFF8CFB326AE41B19332DBAD50B8D4D2"><enum>(I)</enum><text>because of the
				alien’s race, religion, nationality, membership in a particular social group,
				or political opinion; or</text>
							</subclause><subclause id="id6C13426DB05B464FB0A2C7E01EA9B79D"><enum>(II)</enum><text>because the
				alien would be subject to torture in that country;</text>
							</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDd126a95f7baf44aab992d63b3f179ced"><enum>(iii)</enum><text>ensures that
				each alien can effectively communicate with United States officers through the
				use of a translator fluent in a language the alien claims to understand;
				and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id1B0F77E51F5C4577B6699EC6DF0EB3AE"><enum>(iv)</enum><text>provides each
				alien who, according to the determination of an asylum officer, has a
				well-founded fear of persecution for the reasons specified in clause (ii) or
				would be subject to torture, an opportunity to seek protection in—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id840005D08F8F40C28EEC11E52DDBE3E7"><enum>(I)</enum><text>a country other
				than the alien’s country of origin or country of last habitual residence in
				which the alien has family or other ties that will facilitate resettlement;
				or</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id76F8D05D26914EE891A233C9B6562023"><enum>(II)</enum><text>if the alien has
				no such ties, a country that will best facilitate the alien’s resettlement,
				which may include the United
				States.</text>
							</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID3f20c2dde94946ff9725c888ea8bdf2a"><enum>24.</enum><header>Protection of
			 stateless persons in the United States</header>
			<subsection id="id5B7DC74B21D447388CF1B8503CE1D19A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Chapter 1 of title II
			 of the Immigration and Nationality Act (8 U.S.C. 1151 et seq.) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id210BC2675ACF43CDBCBF145702F9E077" style="OLC">
					<section id="id7ED5F9A5F39F467F8B43FE664134ED16"><enum>210A.</enum><header>Protection of
				stateless persons in the United States</header>
						<subsection id="ID524a67b3f34b4449b4a9a5ca67e4be00"><enum>(a)</enum><header>Defined
				term</header>
							<paragraph id="id63FA80E342FE4A1B8F32716745F14E38"><enum>(1)</enum><header>In
				general</header><text>In this section, the term <term>de jure stateless
				person</term> means an individual who is not considered a national under the
				laws of any country.</text>
							</paragraph><paragraph id="ID3eb5bb8f960c4002a4921d0dc5cd516f"><enum>(2)</enum><header>Designation of
				specific de jure groups</header><text>The Secretary of Homeland Security may
				designate specific groups of individuals who are considered de jure stateless
				persons, for purposes of this section.</text>
							</paragraph></subsection><subsection id="ID73c4e809d5cd430f9a99bf025aedc9ca"><enum>(b)</enum><header>Mechanisms for
				regularizing the status of stateless persons</header>
							<paragraph id="ID83178988763e466789ac98e13a06560a"><enum>(1)</enum><header>Relief for
				individuals determined to be de jure stateless persons</header><text>The
				Secretary of Homeland Security or the Attorney General may cancel removal or
				provide conditional lawful status to an alien who is otherwise inadmissible or
				deportable from the United States if the alien—</text>
								<subparagraph id="IDf13aa7e6c30a4e47bdfe7d819d66b59c"><enum>(A)</enum><text>is a de jure
				stateless person;</text>
								</subparagraph><subparagraph id="ID21ab66eb5ead4a8d85dcc461450108db"><enum>(B)</enum><text>applies for such
				relief;</text>
								</subparagraph><subparagraph id="ID43db2fe96c704a45b994338fdcd8dd3f"><enum>(C)</enum><text>is not
				inadmissible under paragraph (2) or (3) of section 212(a);</text>
								</subparagraph><subparagraph id="IDe6fab6ebad8b46fbb3d6c6e9e9c3bf18"><enum>(D)</enum><text>is not deportable
				under paragraph (2), (3), or (4) of section 237(a); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd6020636eece4a4fad5417f97024b571"><enum>(E)</enum><text>is not described
				in section 241(b)(3)(C)(i).</text>
								</subparagraph></paragraph><paragraph id="ID14a433d841114c3ca2fd446985d5bf2c"><enum>(2)</enum><header>Waivers</header>
								<subparagraph id="id8AB4C7E2C12B42B499AC9F054A9B8DBE"><enum>(A)</enum><header>Automatic
				waivers</header><text>In determining an alien’s eligibility for relief under
				paragraph (1), paragraphs (4), (5), (6)(A), (7)(A), and (9) of section 212(a)
				shall not apply.</text>
								</subparagraph><subparagraph id="idF55F28F7C4584065A940B65DEA07D510"><enum>(B)</enum><header>Application</header><text>An
				alien seeking relief under paragraph (1) may apply to the Secretary or the
				Attorney General for a waiver of any of the grounds set forth in subparagraph
				(C) and (D) of paragraph (1).</text>
								</subparagraph><subparagraph id="idB7951D3994044B68A23E2321A8D1FA6C"><enum>(C)</enum><header>Other
				waivers</header><text>The Secretary or the Attorney General may waive any other
				ground of inadmissibility or deportability (except for section 241(b)(3)(C)(i))
				with respect to such an applicant, including felony convictions and health
				conditions, if such waiver—</text>
									<clause id="id785068039B704F5586C8ECCDA4332DDC"><enum>(i)</enum><text>is justified by
				humanitarian purposes;</text>
									</clause><clause id="id6B1CE6BC687D4B86845739D72FD16587"><enum>(ii)</enum><text>would ensure
				family unity; or</text>
									</clause><clause id="id550CB3F01A5A49A0A5A4ADDBCC7EA0F6"><enum>(iii)</enum><text>is otherwise in
				the public interest.</text>
									</clause></subparagraph></paragraph><paragraph id="ID03ae9718df7c49d190b63161f1556427"><enum>(3)</enum><header>Work
				authorization</header><text>The Secretary may—</text>
								<subparagraph id="idFE6A71E4A91A4DFAAD8D925FBF078C5E"><enum>(A)</enum><text>authorize an
				alien who has applied for relief under paragraph (1) to engage in employment in
				the United States while such application is being considered; and</text>
								</subparagraph><subparagraph id="id227ED51A014B46C0B95F2F6D62A52FA0"><enum>(B)</enum><text>provide such
				applicant with an employment authorized endorsement or other appropriate
				document signifying authorization of employment.</text>
								</subparagraph></paragraph><paragraph id="IDde1966ca84764bceae89f9a0554628e0"><enum>(4)</enum><header>Dependent
				spouses and children</header><text>The spouse, child, or unmarried son or
				daughter of an alien who has been granted conditional lawful status under
				paragraph (1) may apply for conditional lawful status under this section as a
				dependent if—</text>
								<subparagraph id="IDc26fe62f2e834b609f245c0b5e95019b"><enum>(A)</enum><text>the dependent
				properly files an application for such status;</text>
								</subparagraph><subparagraph id="ID7c157832dbf04a32b3dab8689f9c5557"><enum>(B)</enum><text>the dependent is
				physically present in the United States on the date on which such application
				is filed;</text>
								</subparagraph><subparagraph id="ID1690d8ed4c98499590351d9dc52a8306"><enum>(C)</enum><text>the dependent
				meets the eligibility criteria set forth in paragraph (1); and</text>
								</subparagraph><subparagraph id="ID888ca206d4ce46c2a5abcfb85705684c"><enum>(D)</enum><text>the qualifying
				relationship to the principal beneficiary existed on the date on which such
				alien was granted conditional lawful status.</text>
								</subparagraph></paragraph></subsection><subsection id="ID611dd1796c894f8ea5b34efbd074a42e"><enum>(c)</enum><header>Adjustment of
				status</header>
							<paragraph id="ID89a7a329c9c14d38b9b4806d3e86cac0"><enum>(1)</enum><header>Inspection and
				examination</header><text>At the end of the 1-year period beginning on the date
				on which an alien has been granted conditional lawful status under subsection
				(b), the alien may apply for lawful permanent residence in the United States
				if—</text>
								<subparagraph id="IDab90b345400b478b9787ab423940515c"><enum>(A)</enum><text>the alien has
				been physically present in the United States for at least 1 year;</text>
								</subparagraph><subparagraph id="id7EFB24376BDC42D6A8BCD671BD14DA72"><enum>(B)</enum><text>the alien’s
				conditional lawful status has not been terminated by the Secretary of Homeland
				Security or the Attorney General, pursuant to such regulations as the Secretary
				or the Attorney General may prescribe; and</text>
								</subparagraph><subparagraph id="id261284D7A09849CE9D1211D1EF9A4F51"><enum>(C)</enum><text>the alien has not
				otherwise acquired permanent resident status.</text>
								</subparagraph></paragraph><paragraph id="ID7e341bbf0d44466fa6a085f6b2b88174"><enum>(2)</enum><header>Requirements
				for adjustment</header><text>The Secretary or the Attorney General, under such
				regulations as the Secretary or the Attorney General may prescribe, may adjust
				the status of an alien granted conditional lawful status under subsection (b)
				to that of an alien lawfully admitted for permanent residence if such
				alien—</text>
								<subparagraph id="ID4fc4588f263543348452864ed0c9d575"><enum>(A)</enum><text>is a de jure
				stateless person;</text>
								</subparagraph><subparagraph id="id91F35856E6124382889D6ABA4E4F91AD"><enum>(B)</enum><text>properly applies
				for such adjustment of status;</text>
								</subparagraph><subparagraph id="ID8eb0f2b7ceb04ba88dd985ee688af926"><enum>(C)</enum><text>has been
				physically present in the United States for at least 1 year after being granted
				conditional lawful status under subsection (b);</text>
								</subparagraph><subparagraph id="ID0a1cc2edd0194ff9abf19bcb4fb4eb6d"><enum>(D)</enum><text>is not firmly
				resettled in any foreign country; and</text>
								</subparagraph><subparagraph id="IDc54c5c693a3943c09331450d89b6fac7"><enum>(E)</enum><text>is admissible
				(except as otherwise provided under subsection (b)(2)) as an immigrant under
				this chapter at the time of examination of such alien for adjustment of
				status.</text>
								</subparagraph></paragraph><paragraph id="id28058FFB167945C1B9C187689AF7F0EA"><enum>(3)</enum><header>Proving the
				claim</header><text>In determining an alien’s eligibility for adjustment of
				status under this subsection, the Secretary or the Attorney General shall
				consider any credible evidence relevant to the application. The determination
				of what evidence is credible and the weight to be given that evidence shall be
				within the sole discretion of the Secretary or the Attorney General.</text>
							</paragraph><paragraph id="IDb3744bb8e2d04fa5b8b9949c3ebad450"><enum>(4)</enum><header>Record</header><text>Upon
				approval of an application under this subsection, the Secretary or the Attorney
				General shall establish a record of the alien’s admission for lawful permanent
				residence as of the date that is 1 year before the date of such
				approval.</text>
							</paragraph></subsection><subsection id="ID9443a19ef0a94cfa964b29d46d6a9463"><enum>(d)</enum><header>Review</header>
							<paragraph id="id94AD748F555049AC9C000F879A91AFF4"><enum>(1)</enum><header>Administrative
				review</header><text>The Attorney General shall provide applicants for relief
				under this section the same right to, and procedures for, administrative review
				as are provided to aliens subject to removal proceedings under section
				240.</text>
							</paragraph><paragraph id="IDc48fb1b46fdc4e7c9d2e3cc2170a9753"><enum>(2)</enum><header>Judicial
				review</header><text>The United States Court of Appeals shall—</text>
								<subparagraph id="idD69A4C21F40E49A1A0C267E19A08AA61"><enum>(A)</enum><text>sustain a final
				decision denying relief under this section unless it is contrary to law, an
				abuse of discretion, or not supported by substantial evidence; and</text>
								</subparagraph><subparagraph id="idA2971B4E51FC4DC48E3906CCD33DFAE8"><enum>(B)</enum><text>decide the
				petition only on the administrative record on which the denial of relief is
				based.</text>
								</subparagraph></paragraph><paragraph id="ID5377efe1b20547c5b8eaede215f7497b"><enum>(3)</enum><header>Motions to
				reopen</header><text>Notwithstanding any limitation imposed by law on motions
				to reopen removal or deportation proceedings, any individual who is eligible
				for relief under this section may file 1 motion to reopen removal or
				deportation proceedings in order to apply for relief under this
				section.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id36E53C8A6B5A4863A4F9A2E227C8DD65"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents for the Immigration and
			 Nationality Act is amended by inserting after the item relating to section 210
			 the following:</text>
