		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Level Playing Field Contracting
			 Act of 2010</short-title></quote>.</text>
		</section><section id="id072CB7FBDCAF4E9BAEA4F6C4815B5C67"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idAB0C495DB96A4C21A298FFDCD493FB83"><enum>(1)</enum><text>The term
			 <term>executive agency</term> has the meaning given the term in section 4 of
			 the Office of Federal Procurement Policy Act (41 U.S.C. 403).</text>
			</paragraph><paragraph id="id2160234C474747FEAEB9FC36D5DEBF77"><enum>(2)</enum><text>The term
			 <term>small business concern</term> has the meaning given the term in section 3
			 of the Small Business Act (15 U.S.C. 632).</text>
			</paragraph></section><section id="id109F8F6DE5A54CF7A0DFF75B977A365A"><enum>3.</enum><header>Reduced bundling
			 of Federal contracts</header>
			<subsection id="id80035E27DB5546FD82391C45581DB631"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id83DC9D379ACA4FDD9F4D0FF09CC4B543"><enum>(1)</enum><header>Covered
			 consolidated civilian contract</header><text>The term <term>covered
			 consolidated civilian contract</term>—</text>
					<subparagraph id="id8482EA70F0ED4206AB8719C53EA0325F"><enum>(A)</enum><text>means—</text>
						<clause id="id62CD0A3914A14A258715AFC668CC042A"><enum>(i)</enum><text>a
			 multiple award contract valued in excess of $2,000,000; or</text>
						</clause><clause id="id3FD4EC861D9B43C691E4527EAD956759"><enum>(ii)</enum><text>a
			 contract of an executive agency for property or services valued in excess of
			 $2,000,000 that—</text>
							<subclause id="id32E0D3D086D44FAF86B09CA524C2ED5A"><enum>(I)</enum><text>combines discrete
			 procurement requirements from 2 or more existing contracts;</text>
							</subclause><subclause id="idDED174338E3F4844AF55DA05EFF9AC15"><enum>(II)</enum><text>adds new,
			 discrete procurement requirements to an existing contract; or</text>
							</subclause><subclause id="idD90A1395CC544282AF22CAE5F1182F25"><enum>(III)</enum><text>includes 2 or
			 more discrete procurement or acquisition requirements; and</text>
							</subclause></clause></subparagraph><subparagraph id="id2B9094E2B03247BC9F1AC8546B1619E5"><enum>(B)</enum><text>does not include
			 any consolidated acquisition, procurement, or contracting plan of the
			 Department of Defense.</text>
					</subparagraph></paragraph><paragraph id="id1E406C4E049046E1878C12DF51D7B862"><enum>(2)</enum><header>Covered
			 consolidated Defense contract</header><text>The term <term>covered consolidated
			 Defense contract</term> means—</text>
					<subparagraph id="idEC438872B1DB4799978D6CF78C16A52F"><enum>(A)</enum><text>a multiple award
			 contract of the Department of Defense valued in excess of $7,500,000; or</text>
					</subparagraph><subparagraph id="idB7E6D2A34DBA4DF58C0711751D488E41"><enum>(B)</enum><text>a contract of the
			 Department of Defense for property or services valued in excess of $7,500,000
			 that—</text>
						<clause id="id16EDC40CA46544928DCB405B4888D74D"><enum>(i)</enum><text>combines discrete
			 procurement requirements from 2 or more existing contracts;</text>
						</clause><clause id="id13E22D97142040C4A2C05EDB60DF1916"><enum>(ii)</enum><text>adds new,
			 discrete procurement requirements to an existing contract; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9D7231BECCC544B6B4CB66B30954B53E"><enum>(iii)</enum><text>includes 2 or
			 more discrete procurement or acquisition requirements.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idB2686D81EF3C45EAAAA578FE598F0E1C"><enum>(b)</enum><header>Restriction on
			 civilian contract bundling</header>
				<paragraph id="id3D2412CF76034FD6B73BE7FA19B968AD"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Federal Acquisition Regulatory Council shall amend the Federal
			 Acquisition Regulation to require that the head of an executive agency may not
			 enter into a covered consolidated civilian contract unless the senior
			 procurement official for the agency determines that the consolidation of such
			 contract is necessary and justified.</text>
				</paragraph><paragraph id="idBBDDA8FC125044499CF9DF21D45C14B5"><enum>(2)</enum><header>Necessary and
			 justified determinations</header>
					<subparagraph id="id064E17835A944772873FCC337A539804"><enum>(A)</enum><header>Required
			 criteria</header><text>In making a determination that a contract is necessary
			 and justified pursuant to paragraph (1), the head of an executive agency
			 shall—</text>
						<clause id="idCACDBBCF4E0F49E18BBBE43FC0F0D503"><enum>(i)</enum><text>identify the
			 benefits anticipated from the consolidation;</text>
						</clause><clause id="id6C3FCC0043AB4DF48B3C8F15E862F536"><enum>(ii)</enum><text>identify any
			 alternative contracting approaches that would involve a lesser degree of
			 contract consolidation; and</text>
						</clause><clause id="idD9D3FEC0E5574D23819B92C8E1466F4D"><enum>(iii)</enum><text>justify how the
			 consolidation substantially exceeds the benefits of any alternative contracting
			 approaches.</text>
						</clause></subparagraph><subparagraph id="idF7A0C6F6B37143D18F0FDB2D5B484258"><enum>(B)</enum><header>Restrictions on
			 basis of determination</header><text>The head of an executive agency may not
			 base a determination that a contract is necessary and justified solely on
			 savings in agency administrative or personnel costs or lack of a sufficient
			 procurement workforce.</text>
					</subparagraph></paragraph></subsection><subsection id="id4BD83BED34E141638B30C0C05F87FF10"><enum>(c)</enum><header>Restriction on
			 Defense contract bundling</header>
				<paragraph id="idA06F42A9BB224A4A830AC7FB4885275F"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Secretary of Defense shall modify the Department of Defense
			 Supplement to the Federal Acquisition Regulation to require that the head of an
			 agency may not enter into a covered consolidated Defense contract unless the
			 senior procurement official for the agency determines that the consolidation of
			 such contract is necessary and justified or that such consolidation is
			 appropriate in the face of exigent circumstances and national security.</text>
				</paragraph><paragraph id="idCE439525507447EF93689784207F73E3"><enum>(2)</enum><header>Necessary and
			 justified determinations</header>
					<subparagraph id="id4C6458A4D4284671B1296C048B304955"><enum>(A)</enum><header>Required
			 criteria</header><text>In making a determination that a contract is necessary
			 and justified pursuant to paragraph (1), the head of an agency shall—</text>
						<clause id="id0CB81F61718D4850847701A4867A6875"><enum>(i)</enum><text>identify the
			 benefits anticipated from the consolidation;</text>
						</clause><clause id="id6A3C8EF36A5D43A89EE275CED9A0CF60"><enum>(ii)</enum><text>identify any
			 alternative contracting approaches that would involve a lesser degree of
			 contract consolidation; and</text>
						</clause><clause id="idB548236C888A45B8AFEED0E4EF78EF36"><enum>(iii)</enum><text>justify how the
			 consolidation substantially exceeds the benefits of any alternative contracting
			 approaches.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5DDAB1CE3F554376BC6A0BE4A91E46EC"><enum>(B)</enum><header>Restrictions on
			 basis of determination</header><text>The head of an agency may not base a
			 determination that a contract is necessary and justified solely on savings in
			 agency administrative or personnel costs or lack of a sufficient procurement
			 workforce.</text>
					</subparagraph></paragraph></subsection></section><section id="id5A31881232324BBA9A3778F0AB104280"><enum>4.</enum><header>Quantitative
			 methodology for evaluation of contract bids</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Federal Acquisition Regulatory Council shall
			 amend the Federal Acquisition Regulation to require the head of an executive
			 agency—</text>
			<paragraph id="idCE962E72EF1F45EAB5984DEEDFD2E4A4"><enum>(1)</enum><text display-inline="yes-display-inline">to use a numeric grading or other
			 quantitative methodology to evaluate bid proposals for each contract of such
			 agency that is awarded through full and open competitive procedures; and</text>
			</paragraph><paragraph id="id7B32E3267F39487988929E627F120B4A"><enum>(2)</enum><text>to disclose the
			 methodology in the bid solicitation documents for the contract.</text>
			</paragraph></section><section id="id9AF35F14FF054A80A6BC987DB4B90956"><enum>5.</enum><header>Enforcement of
			 local workforce requirements</header>
			<subsection id="id88C8F98B235047DD959EF31290420526"><enum>(a)</enum><header>GSA
			 report</header>
				<paragraph id="id564B2959ED6349D18005DB4AF6647AC7"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, and annually thereafter, the
			 Administrator of General Services shall submit to Congress a report describing
			 efforts to enforce the local workforce subcontracting requirements included in
			 contracts entered into by the General Services Administration. The report shall
			 include an assessment of the effectiveness of enforcement efforts related to
			 such requirements and proposals to better enforce the requirements.</text>
				</paragraph><paragraph id="id68A2AD71014F48589A93AA557725AECB"><enum>(2)</enum><header>Efforts to
			 remedy noncompliance with requirements</header><text display-inline="yes-display-inline">If local workforce subcontracting
			 requirements have not been met in any contract entered into by the General
			 Services Administration, the report required under this subsection shall
			 include a description of efforts made by the General Services Administration to
			 meet the requirements in such contract.</text>
				</paragraph></subsection><subsection id="id763D74C27E954C5EB12B680AE424DE10"><enum>(b)</enum><header>GAO
			 report</header><text>Not later than 180 days after submission of the first
			 report required under subsection (a), the Comptroller General of the United
			 States shall submit to Congress a report commenting on the findings described
			 in such report and including recommendations for further actions to ensure
			 compliance with local workforce subcontracting requirements.</text>
			</subsection></section><section id="idB42D2BD63C9A4AA891C45C477AD07199"><enum>6.</enum><header>Acquisition
			 workforce improvements</header>
			<subsection id="id22C18CFABD434D09A55F8C528956CF5C"><enum>(a)</enum><header>Evaluation and
			 report</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the head of each executive
			 agency shall submit to Congress a report evaluating the strength and
			 sufficiency of its acquisition workforce.</text>
			</subsection><subsection id="idC8909A2C5A46484DA212C8C44FCB1C0D"><enum>(b)</enum><header>Content</header><text>The
			 report required under subsection (a) shall include—</text>
				<paragraph id="id4CB387C7C4E3478CAFFEBE091F8267DD"><enum>(1)</enum><text>a 30-year history
			 of the size of the acquisition agency's workforce; and</text>
				</paragraph><paragraph id="id5A4A5226938548AEB67DDCA0FF769B45"><enum>(2)</enum><text>a description of
			 measures the agency is implementing to address any shortage of acquisition
			 workforce personnel.</text>
				</paragraph></subsection><subsection id="id0F983529E7E44D86AEF47BC00F27A602"><enum>(c)</enum><header>Public
			 comment</header><text>In preparing the report required under subsection (a),
			 the head of each executive agency shall solicit feedback regarding the agency's
			 acquisition workforce, including through a public comment process.</text>
			</subsection></section><section id="idF07E1A336B6E40EF8A67407302BB9F8A"><enum>7.</enum><header>Use of
			 procurement assistance resources</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Federal Acquisition Regulatory Council shall
			 amend the Federal Acquisition Regulation to require executive agencies to take
			 actions to encourage prospective contractors to utilize contracting assistance
			 resources that are offered in their communities. The Federal Acquisition
			 Regulation, as so amended, shall include a requirement that the bid
			 solicitation documents for a contract include language encouraging the use of
			 such resources.</text>
		</section><section id="id5E98A0ABA98942C3B72AFDCA886B7C10"><enum>8.</enum><header>Improving
			 outreach to small business concerns</header><text display-inline="no-display-inline">Section 15 of the Small Business Act (15
			 U.S.C. 644) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idDA7BBDB9F5414EBB94C5C76ACD850C69" style="OLC">
				<subsection id="id7F61B48A52D04BFEA9E1998B695B3A1E"><enum>(q)</enum><header>Small business
				outreach program</header>
					<paragraph id="id303CDA3CDAD845D5A5774BA11F118A88"><enum>(1)</enum><header>Program
				established</header><text>The Administrator and the Administrator of General
				Services shall jointly establish an outreach program—</text>
						<subparagraph id="id61A05ED5429C44DEA72C3BBF8662326E"><enum>(A)</enum><text>to communicate
				with small business concerns regarding specific contracting opportunities with
				the Federal Government; and</text>
						</subparagraph><subparagraph id="idA3D4922ED2734DFCA6202346252F1ED8"><enum>(B)</enum><text>to inform small
				business concerns about opportunities to learn about the process of contracting
				with the Federal Government.</text>
						</subparagraph></paragraph><paragraph id="id750F031C4566437594F19164E24F9FB6"><enum>(2)</enum><header>Annual report
				to Congress</header><text>Not later than 1 year after the date of enactment of
				this subsection, and annually thereafter, the Administrator and the
				Administrator of General Services shall jointly submit to Congress a report on
				the program under this subsection that includes the number of small business
				concerns that entered into a contract with the Federal Government for the first
				time during the applicable year as a result of the
				program.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idB78F4D7F2188401EA5694FDF38F2D1F6"><enum>9.</enum><header>GAO report on
			 Federal contracts for small business concerns</header>
			<subsection id="id3BBD53225A914A3CA24DBB015752FD82"><enum>(a)</enum><header>Study</header>
				<paragraph id="idE52129B4C82B4328BF051B77299EC404"><enum>(1)</enum><header>In
			 general</header><text>The Comptroller General of the United States shall
			 conduct a study of changes in the definition of the term <quote>small business
			 concern</quote> and the size standards established under section 3(a)(2) of the
			 Small Business Act (15 U.S.C. 632(a)(2)) during the 10-year period ending on
			 the date of the enactment of this Act.</text>
				</paragraph><paragraph id="id864CDD0A99414D60AAEC48C76FAF6E89"><enum>(2)</enum><header>Contents</header><text>The
			 study conducted under paragraph (1) shall, for each change in the definition of
			 the term <quote>small business concern</quote> or the size standards
			 established under section 3(a)(2) of the Small Business Act (15 U.S.C.
			 632(a)(2))—</text>
					<subparagraph id="id8CFEEF34B75E42568381403FBB390E4B"><enum>(A)</enum><text>analyze the size
			 and number of small business concerns that—</text>
						<clause id="id238AF626E9504B5DB4709772C8662EC3"><enum>(i)</enum><text>did
			 not qualify as a small business concern before the change; and</text>
						</clause><clause id="id1F1EFB998DF54B7387AEDD74FE5B5923"><enum>(ii)</enum><text>entered into a
			 contract with the Federal Government for the first time after the effective
			 date of the change; and</text>
						</clause></subparagraph><subparagraph id="idDDF2AB1165614A28A3E3C21620CDE3E2"><enum>(B)</enum><text>assess whether
			 the ability of small business concerns that qualified as a small business
			 concern before the change to compete for contracts with the Federal Government
			 was inhibited by the change.</text>
					</subparagraph></paragraph></subsection><subsection id="id3249032BD486430EA8580B663E29ECA2"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the
			 Comptroller General of the United States shall submit to Congress a report
			 detailing the results of the study conducted under subsection (a).</text>
			</subsection></section><section id="id5F706CFA066C4ACD9F21A18DBB6BA278"><enum>10.</enum><header>GAO report on
			 potential barriers to entry in Federal contracting</header>
			<subsection id="idB4B2AD4ADB6F44058BE6B8DD1B1CD4F5"><enum>(a)</enum><header>Covered
			 agency</header><text>In this section, the term <term>covered agency</term>
			 means—</text>
				<paragraph id="idFF2ED3AFB9FF40AC8C67CB49E443F7F6"><enum>(1)</enum><text>the General
			 Services Administration;</text>
				</paragraph><paragraph id="id892696F1B0FC46A880C6EF653020B0A1"><enum>(2)</enum><text>the Army Corps of
			 Engineers; and</text>
				</paragraph><paragraph id="id3B6FC6C8374C4233839F3C7D627FE6D5"><enum>(3)</enum><text>the Department of
			 Homeland Security.</text>
				</paragraph></subsection><subsection id="id4B1A09A6E9794085AA52B2E981CAA679"><enum>(b)</enum><header>Study</header><text>The
			 Comptroller General of the United States shall conduct a study examining the
			 degree to which covered agencies have entered into contracts since January 1,
			 2004, with contractors that have previous experience performing Federal
			 contracts.</text>
			</subsection><subsection id="id14AEA07538F144DFA284BA4EF0479D7A"><enum>(c)</enum><header>Report</header>
				<paragraph id="id988888760A17496BA8C81F511ED93097"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Comptroller General shall submit to Congress a report on the
			 study conducted under subsection (b).</text>
				</paragraph><paragraph id="id80BBEA2791C842A9959CE22DA63805CE"><enum>(2)</enum><header>Content</header><text>The
			 report required under paragraph (1) shall include the following:</text>
					<subparagraph id="id973FE91437E24269BCAF2CB4826E8826"><enum>(A)</enum><text>A description of
			 the frequency with which covered agencies enter into contracts with contractors
			 that have previous experience performing Federal contracts.</text>
					</subparagraph><subparagraph id="idDE8B2BC3DF7A413699E05CE00D9B0FCF"><enum>(B)</enum><text>An assessment, by
			 year, from 2004 through 2009, of whether the number of repeat contractors has
			 increased or decreased in proportion to the number of contractors awarded
			 Federal contracts.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3F32A2CD7EA541B192215F493220BF04"><enum>(3)</enum><header>Contracts
			 covered</header><text>The report required under paragraph (1) shall include
			 information on the awarding of contracts using full and open competition
			 procedures and the awarding of sole source contracts.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id80391A64B82C45E5B664E4C230BEBD6D"><enum>11.</enum><header>GAO report on
			 awarding of Federal contracts</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8DF5AF9CC28744A28A5143AAB66DF040"><enum>(a)</enum><header>Study</header><text>The
			 Comptroller General of the United States shall conduct a study on the size and
			 experience of contractors awarded contracts by the General Services
			 Administration, the Army Corps of Engineers, and the Department of Homeland
			 Security.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id6B8D75E92EDA4E3D9BC8E6FBE6524D1C"><enum>(b)</enum><header>Report</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id4DA311DB1583415A9C8569203DD71CA0"><enum>(1)</enum><header>In
			 general</header><text>Not later than 180 days after the date of the enactment
			 of this Act, the Comptroller General shall submit to Congress a report on the
			 study conducted under subsection (a).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id844D59D7622842EB88579A320332A9CB"><enum>(2)</enum><header>Content</header><text>The
			 report required under paragraph (1) shall include, with respect to contracts
			 entered into by the General Services Administration, the Army Corps of
			 Engineers, and the Department of Homeland Security on or after January 1, 2000,
			 the following information:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB8A2BED0CB3548428B5BFFA9C020CC51"><enum>(A)</enum><text>The number of
			 contractors with fewer than 50 employees.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4D72C9972F5647A689E35F6813E031B6"><enum>(B)</enum><text>The number of
			 contractors with fewer than 10 employees.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
