		<official-title>To amend title XVIII of the Social Security Act to
		  provide flexibility in the manner in which beds are counted for purposes of
		  determining whether a hospital may be designated as a critical access hospital
		  under the Medicare program and to exempt from the critical access hospital
		  inpatient bed limitation the number of beds provided for certain
		  veterans.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Critical Access Hospital
			 Flexibility Act of 2009</short-title></quote>.</text>
		</section><section id="H78DAED6CC49F40E000FB652574E2E12E" section-type="subsequent-section"><enum>2.</enum><header>Flexibility in the
			 manner in which beds are counted for purposes of determining whether a hospital
			 may be designated as a critical access hospital under the Medicare
			 program</header>
			<subsection id="H058ADEC4D7824820AA5DEFAFA858BA6D"><enum>(a)</enum><header>In
			 general</header><text>Section 1820(c)(2)(B) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1395i–4(c)(2)(B)) is amended—</text>
				<paragraph id="H402A1BB9CED941A8923634A8D43FF39"><enum>(1)</enum><text>in
			 clause (iii), by inserting <quote>(or 20, as determined on an annual, average
			 basis)</quote> after <quote>25</quote>; and</text>
				</paragraph><paragraph id="HE8D5D3146B5E42F0A2D52B36E5D219F5"><enum>(2)</enum><text>by adding at the
			 end the following flush sentence:</text>
					<quoted-block display-inline="no-display-inline" id="H41167F1E6ADC4849AC9B2696D55976FF" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">In
				determining the number of beds for purposes of clause (iii), only beds that are
				occupied shall be
				counted.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HCE4908F575CC4FCBA1A6DCACD79700BA"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by this section take effect on January
			 1, 2010.</text>
			</subsection></section><section id="H6381EC68F9C04023B2F7D949C69EF61"><enum>3.</enum><header>Critical access
			 hospital inpatient bed limitation exemption for beds provided to certain
			 veterans</header>
			<subsection id="H2ECE4E024B454EFFB084C026F90099BA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1820(c) of
			 the Social Security Act (42 U.S.C. 1395i–4(c)) is amended by adding at the end
			 the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="HAA1A013ACFA040069DB2EA552EA723C" style="OLC">
					<paragraph id="H70D61575F1784C478845FCC9A7CE6300"><enum>(3)</enum><header>Exemption from
				bed limitation</header><text display-inline="yes-display-inline">For purposes
				of this section, no acute care inpatient bed shall be counted against any
				numerical limitation specified under this section for such a bed (or for
				inpatient bed days with respect to such a bed) if the bed is provided for an
				individual who is a veteran and the Department of Veterans Affairs referred the
				individual for care in the hospital or is coordinating such care with other
				care being provided by such
				Department.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB7C6CB4F21054E2F8FE5B36502664CAD"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by subsection (a) shall apply to cost
			 reporting periods beginning on or after the date of the enactment of this
			 Act.</text>
